Securitization of Migration in Europe : Pushback practices and the Role of the European Court of Human Rights

An embedded case study investigating the ongoing securitization of migration in the EU from 2014-2020 and the role of legal institutions, in this case the European Court of Human Rights (ECtHR) in these processes. Securitization Theory is used in combination with Critical Legal Theory to create a framework that attempts to both illuminate the role of the functional actor in Securitization Theory further, and the impact securitization has on legal institutions. It provides explanations for sudden shifts in legal argumentation, especially in cases of high political relevance with the use of Critical Legal Theory. The case of N.D. & N.T. vs. Spain serves as an example of a functional actor providing two contrasting judgments on the same events within a short period of time and opens up discussions about political influences on legal institutions. Securitization and the framing of refugees as existential threats to European identity and culture is one of the many ongoing political processes related to the issue of migration and refuge in Europe. As the political landscape shifts and right-wing populist parties establish themselves in European Member States, illegal pushbacks have become common practice at the outer borders of the EU and are challenged both politically and legally. This study investigated cases of illegal pushbacks to renew criticism against the institutions engaging in and enabling the practice.

The aim of the presented diploma thesis called "Temporary protection of aliens in international and european law" is to introduce the concept of temporary refuge and temporary protection and tackle the various legal questions related to these concepts, both on the level and from the perspective of international law and the law of the European union. The first part of the thesis presents some (mainly doctrinal and UNHCR) defintions of temporary protection and temporary refuge as well as the definition of the concept of temporary protection enshrined in the EU's Temporary Protection Directive as the latter one represents the only case of regional and binding harmonisation of the temporary protection. The following part of the thesis deals with the minimum content requirements of temporary protection in international law, i. e. such requirements that should in every case be an inherent part of every legal instrument resembling temporary protection. This part focuses mainly on the issue of personal and temporal scope of temporary protection, the concept of mass influx is analysed in this part of the thesis as well as temporary protection as a legal instrument is usually intended to serve as a response to the situation of mass influx. Ce mémoire propose une analyse des enjeux éthiques et politiques à l’œuvre dans les crises des réfugié.es à l’aune de l’éthique féministe du care. Il présente une critique épistémologique des approches prédominantes en philosophie politique libérale : en raison d’un manque de considérations empiriques, ces approches créent des angles morts et invisibilisent certain.es enjeux vécus par les réfugié.es. De plus, la philosophie politique libérale n’offre pas les outils normatifs adéquats pour établir une responsabilité envers les réfugié.es. Face à ce double constat, je propose que l’éthique du care peut contribuer à remédier à ces problèmes. D’une part, grâce à la notion de responsabilité relationnelle, on peut montrer en quoi les citoyen.nes et États du Nord global ont la responsabilité de venir en aide aux populations déplacées. D’autre part, l’analyse contextuelle des enjeux quotidiens et incarnés préconisée par cette théorie éthique permettra d’éviter de reproduire certains angles morts dans nos enquêtes philosophiques. Cela permettra ultimement de mieux identifier et comprendre les injustices reproduites par les crises des réfugié.es et les meilleures façons d’y remédier. / This thesis offers an analysis of the ethical and political issues at play in contemporary refugee crises in the light of the feminist ethics of care. It presents a methodological critique of the predominant approaches in liberal political philosophy: due to a lack of empirical considerations, it tends to hide concrete issues experienced by refugees. Moreover, liberal political philosophy does not offer adequate normative tools to establish responsibility for refugees. In light of this, I argue that the ethics of care can help to overcome these problems. On the one hand, through the notion of relational responsibility, it can show that citizens and states in the global North have a responsibility to help displaced populations. On the other hand, the ethics of care preconizes a contextual analysis of everyday and embodied issues: this will avoid reproducing blind spots in our philosophical inquiries. This will ultimately allow us to better identify and understand the injustices reproduced by refugee crises, as well as the steps needed to remedy them.

[pt] O objetivo deste trabalho é orientar criticamente organizações não governamentais e outros agentes da sociedade civil engajados na construção discursiva de mensagens para campanhas em favor do acolhimento de refugiados, por julgarem que esta é uma temática de crescente relevância para a promoção dos direitos humanos tanto no Brasil quanto a nível internacional. Para tanto, apresentará considerações acerca de duas narrativas hegemônicas amplamente utilizadas por organizações e instituições globais, a fim de identificar as suas premissas conceituais e possíveis conexões com o estabelecimento de práticas das Relações Internacionais. A primeira delas refere-se à tradição do humanitarismo, guiado sobretudo pela mobilização de uma lógica afetiva e de imperativos morais de solidariedade para legitimar a proteção emergencial de grupos em situação de extrema vulnerabilidade; a segunda, por sua vez, recorre à linguagem do desenvolvimento pautado por premissas essencialmente neoliberais para projetar uma imagem de capacidade adaptativa e resiliência sobre indivíduos acolhidos por comunidades nacionais, de modo a discursivamente convertê-los em potencial capital humano para economias de mercado do Sul Global. Publicações oficiais do site brasileiro do Alto Comissariado das Nações Unidas para Refugiados (Acnur) e o Pacto Global sobre Refugiados das Nações Unidas serão revisados para argumentar sobre o despontar de um significado discursivo comum entre ambas as instâncias textuais na contemporaneidade. / [en] This article aims to offer indepth considerations to non governmental organizations and other civil society agents engaged in the discursive construction of messages for campaigns in favor of the reception of refugees as an issue of increasing relevance for the promotion of human rights both in Brazil and internationally. To this end, it will present perspectives on two hegemonic narratives widely used by global organizations and institutions to identify their conceptual premises and possible connections with the establishment of practices of International Relations. The first one refers to humanitarianism, guided mainly by the mobilization of an affective logic and moral imperatives of solidarity to legitimize the urgent protection of groups under extreme vulnerability; the second one uses the language of development and its essentially neoliberal premises to project an image of adaptivity and resilience on individuals hosted by national communities, discursively converting them into potential human capital designed for market economies of the Global South. Official news articles published by the Brazilian website of the United Nations High Commissioner for Refugees (UNHCR) and the United Nations Global Compact on Refugees will be reviewed to argue that a common discursive meaning emerges from both in the present time.

[pt] Os refugiados adquiriram especial relevo no século XX e ao longo do presente século, uma vez que não havia, desde o fim da Segunda Guerra Mundial, um número tão elevado de solicitantes de refúgio e refugiados no mundo. Nos últimos anos, como resultado da atenção sobre os fenômenos migratórios e sobre o seu impacto social e cultural, cresce a presença da temática em livros para crianças e jovens. Há um investimento simbólico no sentido de fazer crianças e jovens refletir sobre a crise. É a partir dessa perspectiva que surge o interesse em analisar obras literárias que abram caminhos para conhecer a situação dos refugiados. Afinal, a visão da literatura como veículo de compreensão cultural do mundo sempre foi um valor muito presente no campo da Literatura Infantil e Juvenil. Esta dissertação analisa cinco obras literárias: Migrando (2015), de Mariana Chiesa Mateos; Para onde vamos (2016), de Jairo Buitrago e ilustrado por Rafael Yockteng; O cometa é um sol que não deu certo (2017), de Tadeu Sarmento e ilustrado por Apo Fousek; A menina que abraça o vento (2018), de Fernanda Paraguassu e ilustrado por Suryara Bernardi, e Refugiados (2019), de Alan Gratz. Considerando a necessidade de se olhar para a questão dos refugiados como um desafio contemporâneo, esta dissertação tem o objetivo geral de refletir sobre a construção imaginária da criança refugiada nas obras de Literatura Infantil e Juvenil que compõem o corpus, sobre as experiências desestabilizadoras desses personagens, e problematizar as questões sociais existentes. E tem como objetivo específico contribuir para uma nova leitura sobre as narrativas do corpus, expandindo suas possibilidades interpretativas. / [en] From the 20th century onwards, challenges faced by refugee populations have become increasingly well known. Indeed, since the end of World War II, there have never been so many refugees or asylum seekers around the world. As a result of the careful attention now devoted to migratory phenomena and to their social and cultural impact, recent years have seen a surge in the presence of such themes in children s and youth literature — segments which have historically viewed literature as an instrument to culturally apprehend the world. In contemporary times, a symbolic effort is repeatedly made to encourage children and youth to reflect on the crisis; moreover, there is a growing interest in analysing literary works which may raise awareness about the material conditions of refuge. In light of this panorama, this dissertation analyses five literary works: Migrando (2015), by Mariana Chiesa Mateos; Para onde vamos (2016), written by Jairo Buitrago and illustrated by Rafael Yockteng; O cometa é um sol que não deu certo (2017), written by Tadeu Sarmento and illustrated by Apo Fousek; A menina que abraça o vento (2018), written by Fernanda Paraguassu and illustrated by Suryara Bernardi; and Refugiados (2019), by Alan Gratz. As it acknowledges the contemporary relevance of refuge-related issues, our study reflects on the imaginary construction of the refugee child in the works of children s and youth literature which compose our corpus. In particular, we wish to discuss the de-stabilizing experiences undergone by the characters and to critically approach the social issues which frame and inform the narratives. Finally, we aim to advance a new reading of the narratives in focus and to broaden their interpretive possibilities.

A Socio-Economic Assessment of Marine Turtle Eco-tourism

Marine turtles have historically contributed to economic activity through consumptive harvest for food, tools, and decorative objects. Only recently have they begun to benefit humans economically through non-consumptive roles, primarily as a focal point of educational eco-tourism. In recent years, the annual number of turtle walks conducted around the Archie Carr National Wildlife Refuge (ACNWR) has risen. This expansion contributed to a statistically significant increase in attendance from 2,162 in 2001 to 3,047 participants in 2014. I examined the regional economic impacts of marine turtle eco-tourism around the ACNWR using social surveys and an economic impact analysis tool. IMPLAN, an input-output modeling package, has been used in tourism industries around the U.S. since 1992, but this study is the first to use this tool to evaluate the holistic economic effects of marine turtle-based eco-tourism within a selected region. During the 2014 turtle walk season (June through July), surveys were distributed at six different turtle walk locations within Brevard and Indian River Counties, Florida, along the central Florida Atlantic coast. Adults attending the turtle walks (n=2,274) were given time before the educational presentation began to complete a one-page survey. Approximately 93% of turtle walk participants completed surveys. Due to market interactions within this two-county region, turtle walks contributed a minimum of three new jobs and a conservative estimate of almost $250,000 (USD) to the local economy during the two-month turtle walk season. Using financial comparisons and economic impact tools, like IMPLAN, can improve our understanding of the many roles, especially non-consumptive uses, sea turtles have in our communities. This information can be useful in resource management and conservation-based decision making.

Impact of Increased Green Turtle Nesting on Loggerhead Fitness

Marine turtles exhibit strong fidelity to their nesting beaches, making the conservation of nesting beaches important for ensuring successful sea turtle populations. Conservation of these nesting beaches involves understanding how species interact with the environment and each other, and understanding how environmental change and population growth can affect the suitability of the nesting habitat. The Archie Carr National Wildlife Refuge (ACNWR) is unusual in its high density of sea turtle nesting by two species: green (Chelonia mydas) and loggerhead (Caretta caretta) turtles. The ACNWR in Melbourne Beach, Florida was established in 1991 due to the high density of loggerhead nesting, but in the time since it was established there has been a significant increase in green turtle nesting, from fewer than 50 nests in 1982 to over 15,000 in 2017. With such a high density of these two species in one relatively small area (21 kilometers of beach), the two species may compete for space. This is especially true for green turtles, which disturb large amounts of sand during their nesting process; in 2017, we observed 338 loggerhead clutches disturbed by nesting females during nesting surveys, nearly all of which were disturbed by green turtles. Using observed spatial and temporal nesting patterns for both green turtles and loggerheads on the ACNWR, I examined the effects these species may have on each other's nests now and in the future. Additionally, green turtles and loggerheads nest in different densities along the length of the ACNWR, with green turtles more concentrated in the southern portions of the Refuge. Finally, green turtle nesting begins and peaks approximately one month later on the ACNWR than loggerhead nesting. For each of these metrics, there is both considerable overlap and distinct separation between the two species. By using these metrics in a modeling approach, I estimated the probability of nest disturbance by a subsequently nesting female, ranging from 0 to 0.105, and how these probabilities are predicted to change over time with a growing green turtle population. Evaluating the carrying capacity of this beach is important in the context of habitat disturbance, including climate change and an increase in storm frequency, and informing adaptive management strategies for effective conservation.

[pt] A presente dissertação analisou os desafios e perspectivas da proteção social de crianças e adolescentes refugiadas e solicitantes de refúgio no município do Rio de Janeiro, a partir da atuação de atores governamentais e não governamentais. Para tanto, empreendeu-se uma abordagem qualitativa a partir de entrevistas com doze profissionais de instituições voltadas para o atendimento da população refugiada e das que compõem o Sistema de Garantia de Direitos da Criança e do Adolescente. Na compreensão dos dados coletados, utilizamos as normatizações nacionais e internacionais que regulam a proteção de refugiados e de crianças e adolescentes. A pesquisa permitiu debater as conexões entre integração local e acesso às políticas sociais, com foco nas ações e estratégias de inserção e nas dificuldades práticas e administrativas-jurídicas vivenciadas por esta população. Os resultados apontam para a potencialidade da intervenção das instituições junto a este público, mas revelam também que os marcos normativos por si só não são suficientes para a consolidação dos seus direitos. Concluímos que existem ainda desafios a serem enfrentados no campo das políticas sociais que atendem esse grupo social cujas especificidades devem ser reconhecidas no desenvolvimento dos seus serviços vislumbrando a reparação de mais uma das iniquidades sociais. / [en] The present dissertation analyzed the challenges and perspectives of the social protection of refugee children and adolescents and refugee applicants in the city of Rio de Janeiro, based on the actions of governmental and non-governmental actors. Therefore, a qualitative approach was undertaken based on interviews with twelve professionals from institutions focused on serving the refugee population and those that make up the Child and Adolescent Rights Guarantee System. In understanding the data collected, we use national and international regulations that regulate the protection of refugees and children and adolescents. The research allowed to discuss the connections between local integration and access to social policies, focusing on the actions and strategies of insertion and the practical and administrative-legal difficulties experienced by this population. The results point to the potential of the intervention of the institutions with this public, but also reveal that the normative frameworks alone are not sufficient for the consolidation of their rights. We conclude that there are still challenges to be faced in the field of social policies that serve this social group whose specificities must be recognized in the development of their services with a view to redressing one more of social inequities.

[pt] Das últimas décadas para os dias atuais, o fluxo de refugiados vindo para o Brasil vem aumentando cada vez mais. Preocupados com a inserção dos refugiados dentro da cidade, o governo, as instituições e a sociedade civil trabalham para integrar esse grupo de pessoas. Apesar de existirem diversas formas de integração, a maneira mais visada desde então é a integração econômica, ou seja, a obtenção de um emprego no país de acolhida e consequente empoderamento econômico do(a) refugiado(a). Assim, outras formas de integração tão importantes quanto esta acabam por ficar esquecidas. Este trabalho, com o intuito de contribuir para o debate de políticas públicas voltadas para a integração dos imigrantes forçados, parte da premissa que a desatenção às políticas culturais ligadas à integração dos refugiados no Rio de Janeiro se relacionam às dificuldades de pertencimento e visibilidade dentro da cidade. Em primeiro lugar, é discutido a importância desse debate nos dias atuais, seguido de uma revisão bibliográfica que discute processos de integração e a importância da cultura nesse cenário. Em segundo lugar, o relatório traz, dentro do seu estudo de caso, um olhar mais aprofundado sobre o deslocamento dos congoleses diante desse quadro e como o ensino da língua portuguesa é peça-chave na integração cultural. Por fim, são feitas algumas recomendações, dando ênfase na preponderância da atuação dos atores governamentais, a fim de que o processo integratório seja feito de maneira mais humana. / [en] From the last decades to the present day, the flow of refugees to Brazil has been increasing. Concerned about the inclusion of refugees within the city, government, institutions and civil society are working to integrate this group of people. Although there are various forms of integration, the most targeted approach since then is economic integration, ie obtaining employment in the host country and consequent economic empowerment of the refugee. Thus, other forms of integration as important as this are eventually forgotten. This work, with the aim of contributing to the debate of public policies aimed at the integration of forced immigrants, starts from the premise that the lack of attention to the cultural policies related to the integration of refugees in Rio de Janeiro are connected to the difficulties of belonging and visibility within the city. Within this work, firstly, the importance of this debate in the present day is discussed, followed by a bibliographical review that discusses integration processes and the importance of culture in this scenario. Secondly, the report brings, in its case study, a more indepth look at the displacement of Congolese in this context and how the teaching of the Portuguese language is a key element in cultural integration. Finally, some recommendations are made, emphasizing the preponderance of the performance of governmental actors, so that the integration process is done in a more humaneway.
