More broadly, this work is the inclusion of Brazil in a survey of Latin American countries that have established TCs, such as Chile, Argentina, Ecuador, Paraguay, Peru and Uruguay. The TC is a form of transitional justice, installed after repressive regimes or armed conflict, contributing to the democratic transition of the country. Some objectives of these committees are: knowledge of the truth about what happened, building a collective memory and search for justice from the victims. Introduced in March 2012, the National Truth Commission (NTC) extended its activities by December 2014. Despite the creation of NTC constitute a milestone in the Brazilian history and democracy, psychology as a science and socio-political knowledge has contributed little to the discussion about serious violations of HR occurred in Brazil. This deficit reflects the low production on the subject. Brazil features as one of the last countries in Latin America to set up a TC, considering the time interval between the end of the dictatorship and the establishment of the commission. From the military dictatorship (1964-1985) to the creation of NTC it took 27 years. These data and little social impact of NTC demonstrate the difficulty of Brazilian people in dealing with the past. In the present study, we sought to verify the social representations of College students on the NTC and how these representations were related to corresponding variables to force ideas. Specifically, we sought to investigate the relationship between variables related to forceideas; analyze the relationship between variables corresponding to the Military Dictatorship (MD); check the relationship between strength and ideas variables related to MD; examine the relationship between force-ideas and related variables and NTC; investigate the relationship between variables corresponding to the MD and variables related to NTC. Participants were 252 students of the Center for Humanities of UFPB, located in the Campus I, in João Pessoa/PB, Brazil. The instrument used for data collection consisted of a questionnaire composed of different thematic scales (Degree of exposure to violence; Predisposition to review the past, social sharing on MD and NTC, rating of the work of NTC; violence usage compliance indicators, degree of post-conventionality; Attitudes to HR, institutional trust; basic principles of equality and tolerance, political orientation, etc.), was developed and implemented in other countries (Chile, Argentina, Ecuador, Paraguay, Peru and Uruguay), translated from Spanish to Portuguese and validated semantically. Data analyses were performed using SPSS software. Descriptive analysis, correlation analysis, factor analysis and multiple linear regressions were performed. Among the results we observed that the forceideas - political, ideological and moral aspects -, concepts for Doise, anchored the social representations of NTC and to the approval of the NTC work and positive predisposition to the last review are consistent with the positive attitudes to HR. / A presente dissertação de mestrado é fruto de um estudo empírico situado no campo da Justiça transicional, mais especificamente, das Comissões da Verdade (CV), das Representações Sociais e dos Direitos Humanos. De modo mais amplo, este trabalho constitui a inserção do Brasil numa pesquisa sobre países latinoamericanos que instauraram CVs, como o Chile, Argentina, Equador, Paraguai, Peru e Uruguai. A CV é uma modalidade de justiça transicional, instalada após regimes repressivos ou conflitos armados, que contribui para a transição democrática dos países. Dentre os objetivos dessas comissões estão: conhecimento da verdade sobre o ocorrido, construção de uma memória coletiva e busca por justiça junto às vítimas. Implantada em março de 2012, a Comissão Nacional da Verdade (CNV) estendeu suas atividades até dezembro de 2014. Apesar da criação da CNV constituir um marco para a história e democracia brasileiras, a psicologia, enquanto ciência e conhecimento sociopolítico, pouco tem contribuído com a discussão das graves violações dos DH ocorridas no Brasil. Esse déficit reflete na baixa produção sobre o tema. O Brasil figura como um dos últimos países da América Latina a instalar uma CV, considerando o intervalo de tempo entre o fim do regime ditatorial e a implantação da comissão. Da Ditadura Militar (1964-1985) à criação da CNV passaram-se 27 anos. Esses dados e o impacto pouco expressivo da CNV demonstram a dificuldade do brasileiro em lidar com o passado. No presente estudo, buscouse verificar as representações sociais de universitários sobre a CNV e como essas representações relacionavam-se com variáveis correspondentes às ideias força. Especificamente, pretendeu-se investigar a relação entre variáveis referentes às ideias força; analisar a relação entre variáveis correspondentes à Ditadura Militar (DM); verificar a relação entre ideias força e variáveis referentes à DM; examinar a relação entre ideias força e variáveis relativas à CNV; e investigar a relação entre variáveis correspondentes à DM e variáveis relativas à CNV. Este estudo tem caráter transversal e contou com a participação de 252 universitários do Centro de Ciências Humanas e Letras da UFPB, localizado no Campus I, em João Pessoa/PB. O instrumento utilizado para a coleta de dados consistiu num questionário, composto por diferentes escalas temáticas (Grau de exposição à violência, Predisposição para rever o passado, Compartilhamento social sobre a DM e a CNV, Avaliação do trabalho da CNV, Indicadores de concordância com o uso da violência, Grau de pós-convencionalismo, Atitudes frente aos DH, Confiança institucional, Princípios básicos de igualdade e tolerância, Orientação política, etc.), já elaborado e aplicado em outros países (Chile, Argentina, Equador, Paraguai, Peru e Uruguai), traduzido do espanhol para o português e validado semanticamente. Para a análise de dados, foi utilizado o software SPSS. Realizaram-se análises descritivas, análises de correlação, análises fatoriais e regressões lineares múltiplas. Dentre os resultados, foi possível verificar que as ideias força – aspectos políticos, ideológicos e morais –, conceituadas por Doise, ancoraram as representações sociais da CNV e que a aprovação do trabalho da CNV e a predisposição positiva para a revisão do passado são coerentes com as atitudes positivas frente aos DH.

(Re)Imagining 'justice': documentation of sexual violence against Rohingya women and girls in Myanmar

The Rohingya population of Myanmar have been called one of the most persecuted ethnic minorities on earth. Beyond the systemic discrimination and ongoing violations of basic human rights, Tatmadaw operations against Rohingya communities in Rakhine State in recent years have amounted to ethnic cleansing, if not genocide. Reports of widespread sexual violence by security forces have garnered significant international attention, increasing our collective awareness of how rape is used as a weapon of war. In light of Canada’s Special Envoy to Myanmar’s report recommending that investigation take place to establish an evidence base for future prosecutions, it is critical that sexual and gender-based violence crimes be adequately factored into documentation strategies. This strategy will send a message that abuses upon women’s bodies are no longer regarded as mere inevitable ‘spoils of war’, but instead belong among the gravest of crimes, worthy of international resources and expertise to address. In order to minimize further intrusion into the lives of Rohingya survivors, it is necessary to consider the various possible justice mechanisms that may be used, and the different methods and standards of documentation that may be required for each. While early documentation efforts are encouraged so that relevant evidence is not lost, these considerations call for careful research, planning and ethical reflection. In order to contribute to this process, this thesis explores how law may operate to bring about justice for sexual and gender-based violence, and provides guidance on how to document evidence to be used for this purpose. At the same time, it recognizes that the form of justice international criminal trials can offer is inherently limited in scope. It further explores how “justice”, a contested concept, is not always defined or achieved through the punishment of perpetrators alone. It therefore draws on critiques of international criminal justice to imagine other ways that justice might manifest, and then identifies the methods of documentation possible to facilitate these efforts. / Graduate / 2019-09-07

As a product of the armed violence and the human rights violations committed in the decades of the eighties and nineties, the Peruvian government initiated a process of transitional justice in order to compensate the victims and reconcile a fragmented and divided society. However, there are still issues pending in that matter. One of these issues is the search of the missing persons.The present article will delve into the importance of a policy of search of missing persons in the light of the international obligations on human rights matters of the Peruvian state, and will analyze the weaknesses of their judicial actions to accomplish this task. The need of a centralized organism in charge of this function will be sustained, and a normative proposal for its implementation in the Peruvian legal system will be presented. / Producto de la violencia armada y de las vulneraciones a los derechos humanos cometidas en las décadas de los ochenta y noventa, el Estado peruano inició un proceso de justicia transicional con la finalidad de resarcir a las víctimas y reconciliar a una sociedad fragmentada. A pesar de ello, aún se mantienen pendientes en esta materia, como la búsqueda de las personas desaparecidas.El presente artículo ahondará en la importancia de una política de búsqueda de personas desaparecidas a la luz de las obligaciones internacionales en materia de derechos humanos del Estado peruano, y analizará las falencias de sus acciones de judicialización para cumplir esta tarea. Se sustentará la necesidad de un organismo centralizado que se encargue de esta función, y se presentará una propuesta normativa para su implementación en nuestro ordenamiento.

The Khmer Rouge Tribunal : Searching for Justice and Truth in Cambodia

The aim of this thesis is to analyze the relationship between the Khmer Rouge tribunal in Cambodia and the national reconciliation process. A qualitative method involving secondary source analysis as well as field study interviews is being used. The point of departure is a theoretical framework of reconciliation assembled from different sources, as there seems to be no coherent and widely accepted framework available for use. An analysis model is constructed, focusing on the concepts of justice and truth. The findings indicate that reconciliation is nowhere near fulfillment, although a few steps towards national reconciliation have been taken. The Cambodian process of reconciliation is only at its earliest stages. Furthermore, the findings suggest that there is a strong relationship between the tribunal and the reconciliation process, inasmuch as the tribunal is perceived to have positive effects on reconciliation, and that continued reconciliation would not be possible without the tribunal. The tribunal is not the only part in reconciliation though, it is a necessary but not sufficient precondition for continued reconciliation. The tribunal can not bring reconciliation close to fulfillment on its own, other mechanizms must be involved in order to do so.

O direito à verdade frente a graves violações de direitos humanos foi criado recentemente e tem um significado jurídico que permanece incerto em diversos aspectos relevantes. As divergências em torno do seu conceito, que ainda está em formação, geram problemas práticos quando se busca tornar esse direito efetivo. A tese analisa a questão que está na base do debate jurídico-dogmático sobre esse direito, a saber, o significado que o termo verdade adquire ao se tornar o seu objeto. É feita uma investigação sobre a forma como este tema é abordado pelos estudos sobre justiça de transição e sobre como se deu a emergência e o desenvolvimento do direito à verdade no direito internacional dos direitos humanos, nas esferas universal e interamericana. O objetivo é, depois, buscar compreender o que, de um ponto de vista teórico, fez com que surgisse na história e no pensamento político-jurídico a necessidade de sua criação e passou a alimentar o esforço para a sua conceituação. Essa análise aponta que a verdade almejada com o direito em estudo tem outras dimensões para além da busca de informações desconhecidas sobre casos individuais de violações a direitos humanos. Como o tema da verdade, sabidamente, é de enorme extensão no campo filosófico, o presente trabalho faz uso de temas de reflexão de Hannah Arendt, que para essa temática tem tido grande repercussão inclusive em sede doutrinária, com o fim de, por meio de um desenvolvimento extensivo, examinar as diferentes dimensões do problema. / The right to the truth concerning gross human rights violations was created recently, and has a legal meaning that remains uncertain in many relevant aspects. The disagreements about its concept, which is still in development, cause practical problems when one tries to make this right effective. The thesis analyses the issue that underlies the legal-dogmatic debate about this right, i.e., the meaning of the term truth when it becomes its object. An investigation is undertaken on how this theme is addressed by studies on transitional justice and also on the emergence and development of the right to the truth in international human rights law, in the universal and in the inter-American systems. The goal is then to try to understand what, from a theoretical point of view, led to the emergence in history and political-legal thought of the need for its creation, and began to feed the effort to its conceptualization. This analysis indicates that the truth sought with the right examined here has dimensions other than the search for unknown information about individual cases of human rights violations. The theme of truth being, as known, a subject of enormous extension in the philosophical field, the present study makes use of topics of reflection by Hannah Arendt, which have had a great repercussion on this subject even in legal dogmatic thought, in order to examine, through an extensive development, the different dimensions of the problem. By doing so, it is intended to shed light on the way the conceptualization of the right to the truth is being consolidated and on the difficulties it faces.

Esta dissertação tem como objeto a análise do impacto da condenação do Brasil pela Corte Interamericana de Direitos Humanos no caso Guerrilha do Araguaia sobre a atuação do Ministério Público Federal na persecução penal das graves violações de direitos humanos ocorridas na ditadura militar no Brasil. Considerando a existência de uma norma global de responsabilização penal individual, verifica-se que a demanda doméstica de responsabilização dos agentes da ditadura foi submetida ao Sistema Interamericano de Direitos Humanos e retornou ao plano doméstico de modo a destravar a atuação institucional do Ministério Público Federal na pauta. Se antes da condenação pela corte internacional havia uma atuação de poucos procuradores, depois da sentença se verifica uma gradual institucionalização da pauta internamente no Ministério Público Federal, que tomou para si a determinação da Corte Interamericana de Direitos Humanos de responsabilização dos agentes da ditadura. O estudo discute a movimentação institucional do Ministério Público Federal na pauta, as teses adotadas pelos procuradores, as vinte e seis ações penais ajuizadas desde 2011, os obstáculos encontrados, a recepção do Judiciário e os desafios para a persecução penal hoje no Brasil. Assim, a dissertação sustenta que o Ministério Público Federal tem tido uma atuação fundamental como ator judicial interno na mobilização do direito internacional dos direitos humanos para fazer avançar a cascata da justiça, configurando-se como um ator central para o processo de justiça de transição no Brasil, que sempre encontrou uma limitação no aspecto da responsabilização penal em razão da Lei de Anistia. / This thesis aims to analyze the impact of Brazil\'s conviction by the Inter-American Court of Human Rights regarding the Araguaia Guerrilla on Federal Prosecution Service\'s (MPF) action, namely in the penal prosecution of gross human rights violations that occurred during Brazil\'s military dictatorship. Bearing in mind the existence of an international law of individual penal responsibility, it was noted that the domestic suit against dictatorship agents was submitted to the Inter-American System of Human Rights; it returned to the domestic sphere as to unlock the institutional action of MPF. Before the international court\'s conviction there was little action in the hands of few prosecutors. After the sentence, one can observe a gradual institutionalization and internalization of this subject in the MPF, which took on the responsibilization of dictatorship agents determined by the Inter-American Court of Human Rights. The study discusses the institutional mobilization of MPF in the subject, prosecutors\' legal arguments, the 26 penal suits filed since 2011, obstacles found, Judiciary\'s reception, and challenges of criminal prosecution in Brazil. Hence, this thesis holds that the MPF has been crucial as a domestic judicial actor regarding the use of international human rights law to enforce the justice cascade, posing itself as a core actor for Brazil\'s transitional justice, which has been obstructed by the country\'s Amnesty law.

Esta tese analisa os processos de transições à democracia e os debates referentes à luta pela educação sobre/para os direitos humanos, em três países distintos (Argentina, Paraguai e Uruguai). Utilizando-se de uma metodologia transnacional, na qual o pano de fundo é o fluxo de conhecimento sobre violações cometidas pelos Estados, durante as ditaduras destes países, conectadas pelo Sistema Condor, ela procura delinear a construção de uma identidade conformada pelo território imaginado do Río de la Plata. Esta identidade se baseia nas memórias sobre a violência e nas lutas pela consolidação das memórias das vítimas em um espaço público, sob a pretensão da construção de conhecimento para a não repetição de histórias de catástrofes. Desta forma, as discussões trabalhadas abrangem debates sobre os direitos humanos de níveis locais, regionais e globais, em diferentes contextos. E elas trazem para o debate rio-platense dois conceitos essenciais dentro dos direitos humanos, que marcam a identidade regional: a prática social genocida e o desaparecimento forçado. / This thesis analyzes the processes of transitions to democracy and the debates concerning the struggle for education about/for human rights in three different countries (Argentina, Paraguay and Uruguay). Using a transnational methodology, in which the background is the movement of knowledge about violations committed by the states, during the dictatorships of these countries, connected by the Condor System, it seeks to delineate the construction of an identity conformed by the imagined territory of the River Plate. This identity is based on memories of violence and struggles to consolidate the victims memories in a public space, under the pretense of building knowledge for non-repetition of catastrophic stories. In this way, the discussions include human rights debates at local, regional and global levels in different contexts. And they bring to the River Plate debates two essential concepts within human rights that mark the regional identity: genocidal social practice and forced disappearance.

Gacaca courts versus the international criminal tribunal for Rwanda and national courts: lessons to learn from the Rwandan justice approaches to genocide

Doctor Legum - LLD / The 20th century witnessed several wars and genocides worldwide. Notable examples include the Armenian and Jews genocides which took place during World War I and World War II respectively. The Rwandan genocide of 1994 is a more recent example where a large number of the population was affected, either as victims or perpetrators. Over 800,000 Tutsis were dead, and more than 120,000 suspects were in prison for the genocide. The present study focuses on the Rwandan genocide against Tutsi where the scale of the crimes simultaneously dictated the overwhelming need for justice at both international and national level. At the international level, the ICTR was set up by the United Nations to deal with the organisers of the genocide while the Rwandan national courts were left to deal with the remaining suspects. Yet it became increasingly clear that the national courts lacked themselves the capacity to deal with the vast majority of alleged perpetrators. If their impact was to be enhanced, they needed to rely on the support of alternative justice mechanisms. So Rwanda introduced a modern version of the traditional Gacaca courts as an attempt to deal with the huge backlog of cases in order to combat the culture of impunity. However, having different courts for one and the same situation has had its own limitations. One of these issues is the legal and practical disparities that exist between the ad hoc International Tribunal and national justice mechanisms in the process of prosecuting perpetrators, such as the unequal treatment of the accused. This study therefore attempts to show these discrepancies and their impact on the process of accountability and reconciliation. Thus, the study analyses the relationship between the ICTR, national courts and Gacaca in prosecution of genocide suspects as well as lessons from the adopted ‘multifaceted approaches’ to deal with the crime of genocide.
