數位時代下圖書館經營與著作權法

圖書館除典藏當代文化外,亦負有發展教育、傳播文化、提供資 訊等功能(公共圖書館宣言)。隨著科技的進步,人類文明不斷向前推 展,尤以電腦科技的日益精進,網際網路的使用者快速成長,圖書館 無論是在資料蒐集、整理、資訊的提供等功能上,都面臨數位化的需 求。 關於數位化圖書館所涉及之著作權法問題,可分為二大部分探討: 一、紙本館藏數位化重製,及數位化後透過網路提供圖書館服務之著 作權法問題。 二、圖書館直接從市面上購置數位著作,其取得與利用之問題。 壹、圖書館數位化涉及之著作權法問題 一、重製概念是否包含「數位化重製」 貳、圖書館網路服務涉及公開傳輸權 一、新法對於線上文獻傳遞服務之影響 二、圖書館內部網路使用與公開傳輸權 三、線上列印之合理使用審查 參、可否經由網路出借數位館藏 肆、圖書館取得數位著作授權之困境 一、數位著作取得、利用之限制 二、相關著作權仲介團體之欠缺 四、解決機制 (一)相關著作權仲介團體之設立 (二)利用著作的送存制度 (三)電子資料庫市場的擴大 伍、修法方向 一、明文賦予圖書館數位化重製權 為了順應數位時代下圖書館數位化之時代潮流,並得以有效地保 存館藏著作,著作權法應於第四十八條明文賦予圖書館得將館藏著作 數位化之權限,為合理使用之部分。至於數位化之館藏,無須區分已 公開或未公開發行之著作,蓋即使未公開之著作,亦有以數位化重製 保存以及提供利用之必要。不過,對於數位化重製仍須有一定之限 制,亦即,若在市面上已有相關之數位化著作存在,則不得再就館藏 數位化,而應付費取得使用之權限。 二、限制圖書館數位化服務之範圍 基於數位著作保護技術措施尚未成熟,若直接賦予圖書館就數位 重製後之著作,可透過網路或類似管道提供公眾利用,將造成著作權 人之嚴重損害。因此,數位化後之館藏,在館內使用時,僅限於數位 化資料之檢索用途、全文內容閱覽,若讀者第四十八條第一款要求圖 書館重製著作,則僅能提供紙本的版本,不得將全文內容之數位化檔 案交與讀者利用;又就實體館外之使用者,圖書館僅得提供線上目錄 檢索,但不得提供線上資料全文內容閱覽及線上列印。若有此需求, 仍須取得著作權人之授權或同意始得為之。 三、增訂法定授權制度給予著作權人補償 在賦予圖書館數位化重製權利的同時,應採取前述的法定授權制 度或其他類似著作權補償制度,對於著作權人經濟之不利益加以適當 補償,以衡平雙方利益。圖書館依法進行數位重製,須向著作權人給 付主管機關所制訂公布之使用報酬。 四、學術論文資料庫之建置 本文認為,為了促進學術交流與進步,或可賦予圖書館建立論文 數位化全文之資料庫,以提供檢索、網路傳輸及線上列印。為避免影 響層面太廣,其範圍應限於依照「學位授予法」取得學位之本國博碩 士論文。不過此種利用將對論文之著作權人造成影響,應增訂法定授 權制度,給予著作權人一定之補償,才不致於不合理地損害著作人法 定利益。 五、圖書館共同營運準則之制訂 本文建議,為著作權專責機關之經濟部智慧財產局,可仿照美 國之CONTU(National Commission on New Technogical Uses Cppyrighted Works),制訂供圖書館營運遵守的準則,以使圖書館在 進行重製或其他圖書館服務時有所依循。

網路新聞公開傳播之問題研究-以西班牙附屬著作權法為例 / Ancillary Copyright for Press Publishers in the Case of Spain

新聞聚合平台於2000年初,在搜尋引擎科技的推波助瀾之下迅速崛起。然而,新聞聚合平台本身的商業行為也引起新聞出版業者的許多反彈。對於使用者而言,是一個相當便利好用的新聞分類平台,節省許多搜尋成本與時間;對於新聞聚合平台而言,與其他形式的平台一樣,獲利來源多為廣告商,而使用者不需要額外付費使用,且大多數的新聞聚合平台並不自行產出新聞內容,因此節省了製作新聞的成本;然而,對於製作新聞的傳統新聞出版產業而言,新聞聚合平台直接使用其新聞網站上的內容,無異於剽竊其辛苦製作新聞的成果,卻不需要付出製作成本,且提供連結給使用者的方式,令使用者直接連結至文章本身,降低使用者拜訪新聞網站瀏覽其他新聞的誘因,同時也降低了訂閱率,新聞產業的各大業主們為此向各大政府們提出異議,特別是歐洲新聞產業近幾年衰退嚴重,因此希望藉由政府的力量排除這個現象。在歐洲新聞業者的強力遊說與推動之下,德國率先於2013年通過新聞傳播附屬著作權法(ancillary copyright),2014年西班牙也於著作權法第32條第2項中新增新聞傳播附屬著作權,新法賦予新聞出版業者擁有專屬傳播新聞內容的附屬著作權,類似於廣播業者的專屬播送權,由於該權利須附麗於新聞著作權之上,因此稱之為附屬著作權或是附屬著作權。 本文將從新聞產業的衰退以及新聞聚合平台的崛起作為開端,介紹兩個產業之間的利益衝突關係,接著針對西班牙新聞傳播附屬著作權法本身的立法問題,其可能違反歐盟國際公約義務的潛在疑慮,以及其對市場的干擾與影響,最後透過商業模式的分析,試圖替新聞產業與新聞聚合平台擬定出雙贏的解決之道。

數位典藏加值應用相關法律議題之研究 / The Study on Legal Issues of Value-added Applications for Digital Archiving

走過資本與勞力密集的工業時代後,全世界已邁向知識密集的新局面,在這樣的潮流下,各國無不發展知識經濟以提升競爭優勢,我國政府也開始設法將內容、創意與科技結合,積極推動數位內容產業,此外,文化創意產業同樣已成為新世紀知識經濟的主流之一,由此可知,任何產業皆須開始重視內涵與創意,而文化又是知識的累積和傳承,若能將對國家的文化認同運用於創意產業,並深入表現在國民的生活文化裡,不啻為符合環境趨勢又能造就一種新經濟形態的好方法。 有鑑於數位出版典藏成長力道之強勁,以及目前國際間無不致力從事國家典藏數位化的工作,再加上我國包括「數位典藏國家型科技計畫」等數位典藏工作之進行,和近幾年針對數位典藏各層面問題之探究所召開的多場研討會,在在顯示數位內容產業之一的「數位典藏」愈來愈受到關注,而將文物數位化保存只是起步,運用數位典藏內容素材進行加值應用從而促進數位典藏與文化創意產業的發展才是更大的價值所在,因此本研究選擇以「數位典藏加值應用」為研究焦點,且由於數位典藏內容在加值應用過程中,包括數位內容之取得、保護、利用、甚至於授權、行銷等,每個階段都與法律考量環環相扣,如何確保數位典藏內容從產生到流通的過程中,創作者受到法律規範應有的保護,又不致過度妨礙知識的擴散以激發更多創新,是值得研究的議題,因此本研究擬分別由理論面與實務面歸納出與數位典藏加值應用發展相關的重要法律議題加以分析論述。 本研究在理論面係針對「資料庫之法律保護」與「科技保護措施衍生的法律爭議」兩大主題為探討,至於實務面則以個案訪談方式瞭解典藏機構與業界加值應用的現況、所遭遇的法律問題與挑戰、以及對於未來發展的看法,最後即根據文獻資料分析與訪談發現歸納研究結論與提出建議。 本研究在進行法律文獻研讀並比較國內外法制發展之後,認為著作權法對資料庫的之保護不足,以其它方式保護亦有其限制,為促進數位典藏資料庫之建置並保護投資,以推廣數位典藏之加值應用,因此建議我國應推行以雙軌制保護資料庫之立法。至於科技保護措施的立法方面,本研究主張為適當維護數位典藏內容擁有者與加值應用者的權利,以及符合我國政府推動數位內容產業的政策目標,並順應國際立法趨勢,必須就數位環境與網路時代下之數位內容給予更有力的保護,故我國仍應立法規範禁止規避科技保護措施的行為,但必須正視美國數位千禧年著作權法案之反規避條款所造成的諸多問題,亦即未來我國立法勢必要考量公益與產業情況。 值得一提的是,本研究在訪談中發現文化資產保存法第十六條規定在適用上似與著作權法第四十三條有所衝突,應修法使得文化資產保存法的定位更加明確,惟基於促進國家整體文化發展,本研究認為屬於公有的文化資產不妨儘量傳播並供後人利用。再者,進行數位典藏工作及其後的加值應用,均須留意智慧財產權問題,且在授權方面,應儘可能取得「再授權」他人利用的權利,以便於能就利用成果再創價值,而考量到數位時代大量運用著作的需要及效率,亦應催生著作權集體管理機制之建立。 關於數位典藏加值應用的推行,進而驅動數位內容與文化創意產業的發展,本研究在個案訪談後亦有數點建議。首先應正視文化認同問題,畢竟要形成產業必須活絡消費,而其根源在於整個社會人民是否對於我國文化仍有信心與熱愛;其次當然要重視創意與內容,因為這才是消費者最終體驗的核心。 又因我國擁有中華文化且位居多元文化交融之處,以華文市場為基石並準備進軍國際,是我國運用文化內容以發展創意產業的機會所在,其它如善用行銷與通路把創意的產品或服務帶到消費者面前、加強智慧財產權教育與宣導、培養包括創意人才、A型人才與智慧財產權專業人才等,皆是產業發展的關鍵要素。 附帶說明,本研究在訪談中,發現業界對於公部門的定位不清有其憂慮,故本研究建議政府應該提供一個公平、開放,讓市場機制自由運作的環境,並應避免過度介入反而有礙產業進展。 數位典藏讓珍貴文物資產有更多重的運用空間,其後續的加值利用更是商機無限,期待在整體環境日趨健全的情況下,透過典藏機構、學界與業界的合作,能真正實現「文化產業化、產業文化化」的願景。 / As the capital-intensive and labor-intensive industry era went by, the whole world has marched toward the knowledge-intensive new situation. Under this trend, many countries develop the knowledge economy to improve the competitiveness .Our government also begins to combine the content and originality with technology and develop the digital content industry positively. Besides, the cultural creative industry has already become one of the mainstreams of the knowledge economy in the new century. Thus every industry must pay attention to intension and creativity. Culture is the accumulation and inheritance of the knowledge. If we apply the cultural identification to the creative industry and make it display deeply in people's life, it will not only be the good method that can bring up a kind of new economic form, but can be corresponded with the environmental trend. Because digital publishing and digital archiving grow up powerfully, many countries are devoted to digitizing national collections at present. Besides, our country proceeds to digitize national collections, such as ' National Digital Archives Program '. Many seminars are held with many aspects of questions on digital archiving in recent years. The above-mentioned situations show that ' digital archive ' draws more and more attention. However, the digitization of historical relics is just the beginning. The greater value is to use digital archive content or materials to go into value-added applications and then push the development of digital content and cultural creative industry. Thus the ' value-added applications for digital archiving ' is focused in this study. Because in the process of value-added applications for digital archive content, including acquirement, protection, utilizing, authorizing and marketing , many questions should be considered with the law at each stage. How to guarantee that the creator is under the protection of the law from the beginning to circulation of digital archive content and make sure that these protections will not hinder the diffusion of knowledge is the worth studying topic. Thus this study plans to generalize some important legal issues which are relevant to the development of value-added applications for digital archiving from aspects of theory and practice and then analyze and discuss them. In the theoretical aspect, this study focuses on ' the legal protection of the database ' and ' the legal dispute of the technological protective measures '. In the practical aspect, the writer collects information about the archive institutions and industry’s present situation, legal questions, challenge and views on development in the future of value-added applications for digital archiving by means of case interview. Finally, the study puts forward the conclusion and the suggestion according to documents analysis and interview finding. After studying legal documents and comparing the development of domestic and international legal system, the writer thinks that the protection of database by copyright law is insufficient and is also limited by other way. This study suggests that our government should pursue the legislation of protecting the database with the dual track approach for the sake of promoting the construction of digital archive database and protection of investment to popularize value-added applications for digital archiving. As for the legislation of the technological protective measure, this study advocates that our government must offer stronger protection on digital content under digital environments and internet era to protect the rights of digital archive content owner and those who use digital archive content to add value properly. To accord with the policy goal that our government promotes the digital content industry and comply with the international legislative trend, our country should legislate against circumventing technological protective measure in the future. Nevertheless, our government must face the questions derived from anti-circumvention provisions of the Digital Millennium Copyright Act in US. It means that our government must consider public good and industry's situation in future lawmaking. It deserves to be mentioned that this study find there is likely conflict between application to article 16 of Cultural Assets Conservation Law and article 43 of copyright law in interview. Thus our government should revise law to make the orientation of Cultural Assets Conservation Law clearer. However, in the cause of bringing about an advance of national whole culture, this study has an idea that cultural assets belong to the public should be propagated and utilized as far as possible. Moreover, it must be looked out for intellectual property right on digital archiving and its value-added applications. In terms of authorization, this study suggests that authorized people should obtain the right of 'reauthorization ' so that they can use the achievement to create value again. Considering the need and efficiency of work utilization, our government should expedite to set up the collective management mechanism of copyright. In regard to the development of value-added applications for digital archiving and then drive digital content and cultural creativity industry, this study also propose several suggestions after case interview. First, we should face the question of cultural identification. Activating consumption can form the industry and its origin lies in whether the whole society is still confident of and has deep love for the Chinese culture. Second, we certainly should pay attention to the creativity and content because those are the cores that consumers experience ultimately. Because our country has Chinese culture and occupies the place where plural culture blend, it is the opportunity for our country to use cultural content to develop creativity industry and base on Chinese-language market to march into world. The rests of suggestions such as making the best of marketing and channel to take the creative products or service to consumers and strengthening the education and propagation of intellectual property right and training including creative talent , A type talent and professional talent of intellectual property right, etc. The foregoing are all key elements of industry development. Additionally, this study found in interview that the industry is worried about the unclearly position of the common department , so the writer advise government should offer fair and open environment to let market mechanism free operate so that avoid getting involved excessivly and hinder industry's progress instead . Digital archive lets precious historical assets have more multiple application space, and its follow-up value-added application bring limitless business opportunity. We expect that the vision of ' culture industrialization and industry culturalize' can really carry out by means of the cooperation between archive institutions and industry.

數位內容著作權管理之研究-以線上學習(e-learning)為例

網際網路的出現對我們的生活造成了重大的改變,我們面臨的是一個全新的世界。不論是工作模式、娛樂型態皆產生極大的變化,那網際網路下一步是什麼?思科系統執行長 錢伯斯(John Chambers)告訴了我們一個答案:「網際網路中成長最巨,而日後也會證實是促進變革的最大動力,就是e-learning。」數位科技使得內容變成了「數位內容」,帶來了相當多的便利,但同時也帶來了許多的改變,不論是產業面、科技面、法律面或是管理面,皆須面臨新的挑戰與新的議題。 本研究除了二手資料的收集外,並針對e-learning個案公司做深入的訪談,從資源、著作權、數位課程開發流程等構面進行探討研究,分析歸納出e-learning業者如何進行數位課程的管理,以及既有資源是否影響其數位課程管理策略,並且對於e-learning公司在經營數位課程所會遭遇到的著作權議題進行初步的研究與探索。本研究的研究目的如下: 一、探討e-learning業者數位課程管理模式。 二、探討e-learning業者既有資源與數位課程管理間的關係。 三、探討數位課程的開發流程與著作權相關之議題。 四、探討數位課程著作權管理模式。 本研究架構乃先由個案訪談的結果收集個案公司所擁有的既有資源、數位課程開發流程以及數位課程管理方式,且藉由資源基礎論中對於資源的運用方式,分析解構個案公司其數位課程管理策略。而後以既有資源研究其對數位課程管理策略之影響,與以著作權的觀點探討數位課程開發流程中,所產生的著作權議題,並將兩者所得之結論,加以整合描繪出數位課程著作權管理模式。本研究引用經營策略與資源基礎論等相關文獻,來探討e-learning業者如何進行管理數位課程。本研究主要在說明所觀察現象的具體意義,而非嚴謹的在驗證變數間的因果關係,屬於探索性研究,故採定性研究之「個案研究」法,以個案訪談和次級資料蒐集的方式來瞭解企業實際運作情形。 本研究所得之結論如下: 在課程素材取得階段,課程素材取得策略有內尋策略、外尋策略。著作權議題則為與課程素材提中者簽訂課程素材授權(讓與)契約、課程素材著作權的保證。 在數位課程取得階段,數位課程取得策略有自製策略、委製策略、取得授權策略、買斷策略。著作權議題則為與數位課程開發人員進行數位課程著作權歸屬契約的簽訂、對數位課程開發人員進行著作權的教育。 在數位課程運用階段,數位課程運用策略有內訓策略、教學策略、委用策略、 賣斷策略。著作權管理議題則有與數位課程使用者進行契約的簽訂、數位課程其著作類型是多媒體著作、數位課程著作權保護方式的進行。 而個案公司在面臨數位課程時所採行的事業策略則有核心策略、合作策略、專業代製策略、通路策略。 此外,根據研究發現得知,個案公司在進行e-learning之前所擁有的既有資源,會影響個案公司各階段所採行的數位課程管理策略。 而在其他發現,在外部經營問題主要為市場需求不足,而內部經營問題則為教師合作意願不高、缺乏跨領域專業課程企畫人才、缺乏整合性業務人員。 / The rise of internet has changed people’s life style dramatically. Nowadays, we are facing a whole new world. E-learning is considered as the star of the next century. Even John Chambers once mentioned that “the next big killer application for the Internet is going to be education.” Digital technique has digitalized the existing contents. Internet does not only deliver much convenience, however, internet related topics are also conducted and challenged from the perspectives of industry, law, and management. The objective of this thesis is to examine 1) The general framework for e-learning management model, 2) The relationship between the primarily resources and the management on e-learning, 3) The instructional development process for e-learning and its related copyright issues, and 4) Management model for copyrights on digital contents. The method of this research is primarily based on case study, six e-learning related companies. The interviews with the e-learning companies have contributed the great insights about the information of company resources, development process of digital content, and the modes of content management. Furthermore, collected information from the interviews has been analyzed about how original resources affect the digital content management strategy and the copyright issues in the development process of digital content. This study has found that there are four stages: Instructional material acquisition, digitalized course acquisition, digital course application stage, and business Strategy. In the Instructional material acquisition stage, the strategies of acquiring the instructional materials for e-learning is in-house finding, outsourcing or both. Licensing contracts and guarantees on course materials become an important issue when dealing with the material providers. In the digitalized course acquisition step, the strategies are self-manufacture, out-source manufacture, copyright acquisition, and buying copyright. The copyright issues are discussed and contracted between company and digital engineers, and in general, the company is responsible for the digital engineers. In the digital course application stage, the strategies are training, teaching, licensing, and selling. The copyright issues are discussed and contracted between company and digital content users. One should notice that the digital contents belong to multi-media. Moreover, in the final stage, core business, collaboration, ODM, channeling are the business strategies that the companies use for e-learning applications. In additional findings, this study found that market demand is the primary problem of e-learning environment, and there are three major problems within the e-learning companies: the motivations of the teachers, the lack of cross boundary-expertise and integrated business manager.

數位學習產業著作權爭議與法制因應-以美國及我國法規範為中心

數位學習產業於二十世紀末隨著數位潮流、知識管理之風潮,而成為數位內容產業中受矚目之焦點之一,數位與網路新科技,帶動學習內容與形態的變化,技術是發展數位學習的重要推手,但從各國數位學習產業之發展以觀,學習內容的完善建置與相關產業的法制政策抶植,才能真正達到資訊化社會、平衡數位落差等目標。 本論文觀察到我國目前對於數位學習產業可能產生之著作權議題,如:數位學習教材著作權歸屬、數位學習合理使用議題及數位學習內容保護之機制與問題,現行著作權法並未已針對數位學習產業可能特殊之需求為足夠因應或修正,因此本論文參酌學界、實務界對於數位學習產業相關著作權爭議有豐富討論之美國法,由其因應前揭數位學習著作權議題所作之法制上變革,提出對我國現行法之修法建議。 在數位學習教材及課程討論內容之著作權歸屬部分,為避免著作權歸屬公平性之爭議,本論文建議有效方法之一即係以契約明文約定之,以使雙方權利義務得以有效落實;在數位學習合理使用議題之法制因應部分,本論文建議合理使用利用目的判斷導入-轉化(transformation)原則、放寬可以主張合理使用的主體及權利範圍、參酌澳洲及美國CONFU教育多媒體合理使用準則所羅列之各項標準訂立具體合理使用著作利用之比例準則;在數位學習內容保護之機制與問題部分,本論文建議將著作權法中「防盜拷措施」之名稱,修正為「科技保護措施」,以避免造成社會大眾誤認我國著作權法僅限制規範「未經授權非法重製之措施」而就規避未經授權之進入、接觸著作或前述規避行為之準備行為並不處罰,而誤入於罪,同時建議增訂行為人就第八十條之一第一項權利管理電子資訊之移除或變更行為之主觀要件及責任例外,保障人民權益。

隨著科技的進展,產生了許多新興的創作媒介與方式,使得終端的網路使用者不再甘於僅做為主流媒體所提供內容之接收者,也想進一步地成為內容的提供者,網路上混搭創作的興盛正是在此種潮流趨勢下的一種社會文化現象。網路混搭創作可依其創作內容之不同而區分為三種:網路混搭、影片混搭與音樂混搭;但其創作之方式都有一個共同的特徵:將不同來源之資訊、素材,經由混搭創作者發揮創意後,以嶄新面貌而呈現之作品。著作權制度之目的乃在促進人類智識文化之進展與累積,因此對於新興之網路創作也應賦予一定之保護,才能真正發揮著作權制度之功能。然而,現行著作權制度制定時並未充分考量到數位時代下各種創作方式與媒介之特性,所以並無法提供此類創作適當之保護。為了社會文化之發展,現行的著作權制度有其修正之必要,讓負責平衡公私益之合理使用原則能夠發揮其功能,而不再僅具有象徵性之意義,而是能更實際地落實保護之功能。此外,在現行著作權制度尚未修正前,本文也嘗試提出兩個體制內解決之方法:創作共用以及創新之商業模式。透過創作共用可以讓目前的著作權制度更有彈性;創新的商業模式則能讓所有著作權關係人能夠互利共生,更有助於問題之實際解決。 / This thesis aims to study on copyrights concerning the mashups on blogs. The technology evolution brings about new media and new mode for creation and the end-users can both be the information recipients and providers. Mashups become one of the frequently adopted modes among the internet creation and the copyright of mashups call for a closer study. The main idea of mashups is to mash and recombine materials taken from different sources with the creator’s own creativity. Mashups are regarded as a creation, which requires legal protection. However, the protections for mashups and their creators in current laws are still incomplete and needed to be amended for a better environment for creators. Beside the amendment of copyright laws, other solutions are as well available, such as Creative Commons and new business models. Creative Commons provides authors with some licensing clauses, which helps to create a more flexible creative environment. On the other hand, a good business model could transform legal issues into a commercial opportunity and provide the best solution for all parties related. The first chapter of this thesis will outline the main purpose and possible contribution of this thesis. The second chapter will introduce the blogs. The introduction will begin with the streaming technology and concerning legal issues. Streaming technology is a crucial factor in the developments and the functions of blogs. Further on, the thesis will elaborates the history and future trend of blogs. In the third section of the chapter, some main copyright issues of blogs will be brought into discussion. The third chapter is the introduction of audio-visual mashups on blogs. The discussion begins with website mashup technology and the types of mashups. Remix Culture plays an important role in the development of mashups and its connection between audio-visual mashups on blogs will be elaborated. The chapter will also include some copyright issues of audio-visual mashups on blogs and a detailed discussion on the fair use doctrine of the current copyright law. The fourth chapter will focus on the Creative Commons and new business models, which should be an alternative solution beside the law amendments. The discussion will involve with an introduction about Creative Commons. The ccMixter and Jamendo can be taken as two examples of combination of Creative Commons and audio-visual mashups. The chapter will as well include some latest digital music business models and suggestions for future mashup business models. This thesis indicates the deficiency of current copyright laws concerning the protection of mashups and calls for attentions to the necessity of law amendments. In addition, the thesis propose two alternative solutions for the copyright dilemma: the Creative Commons and new business models, through which the mashups problems can hopefully dealt with in a more practical way.

從著作權法探討學術圖書館參與Google Book Search 計畫之研究 / Study on Academic Libraries Join the Google Book Search Project under Copyright Law

本研究旨在從著作權法探討國外大學圖書館參與GBS計畫之動機、內涵與著作權法問題,藉以瞭解數位圖書館相關的數位著作權法;並以深度訪談方式探究我國學術圖書館對GBS計畫之意義與價值,以及合理性與問題。本研究以文獻分析瞭解相關數位著作權議題,從個案研究中瞭解國外大學圖書館的觀點與做法,最後以深度訪談瞭解我國學術圖書館對其看法與意願。 本研究結論可歸納以下:(1)數位圖書館計畫相關之著作權主要在於有無授權、重製、公開傳輸與合理使用的議題上;(2)英美圖書館參與GBS計畫具有相當理由與動機;(3)英美圖書館參與GBS計畫採取全部、部分混合與無著作權模式;(4)英美圖書館考量著作權,而採取合理使用限制措施;(5)英美圖書館參與GBS計畫有制定其數位化程序與責任;(6)國外作者與出版社對於GBS計畫所侵犯的權利為重製、散布與展示;(7)我國學術圖書館對於參與GBS計畫看法兩極;(8)我國學術圖書館參與GBS計畫擔憂涉及著作權問題;(9)我國圖書館認為參與GBS計畫部分合法性不足;(10)我國學術圖書館對參與GBS計畫傾向採取無著作權保護之著作模式。 最後建議為:(1)政府宜制訂法定數位送存制度;(2)大學或圖書館應設置有關著作權管理權責中心以利處理智慧財產權問題;(3)Google應強化安全保護措施機制與保證,以維護其形象;(4)Google應積極與作家與出版社協商對談以及取得授權來降低爭議;(5)對著作權權利人之建議應勇於嘗試新的商業模式。 / The purpose of this study is to analyze the reasons that why foreign university libraries join the Google Book Search Library Project and copyright issues, so that conclude the issues related digital copyright law in digital library. Furthermore, the study used interviews for investigating the meaning, value, and legitimate issues of GBS Library Project from the viewpoint of academic libraries in Taiwan. According to the literature review, the study clarified digital copyright issues. In addition, the study obtained the views of foreign university libraries toward GBS Library Project by case studies. Finally, the study used interviews to understand the opinions of GBS Library Project from academic libraries in Taiwan. The results of the study are summarized below: (1)The key copyright issues that related to related to Digital Library Project are copyright authorization, reproduction, the fair use, and the right to public transmission. (2)There are legitimacies and motivations for UK and USA libraries participate in GBS Library Project. (3)There are three models that adopted by UK and USA libraries for participating in GBS: all collection or part of collection and no copyright works to scan. (4)Considering copyright issues, UK and USA libraries take reasonable measures to restrict the use of digital copies. (5)UK and USA libraries contract with Google for its procedures and responsibility. (6)Foreign authors and publishers consider that GBS is accused of violating for their rights of the reproduce, distribute and display. (7)The academic libraries in Taiwan have bipolar view for joining GBS. (8)The academic libraries in Taiwan worry about copyright issues for joining GBS. (9)The academic libraries in Taiwan consider that the GBS project is lack of legitimacy to join it. (10)If the academic libraries in Taiwan join the GBS project, they would be inclined to put in out-of-copyright works. Based on the final results of this study, several suggestions are as follow:(1)Government should establish a legal policy of digital deposit, (2)University or library should set up a copyright management center which has right and responsibility to deal with intellectual property rights issues; (3)Google should strengthen safety measures and guarantee mechanisms to protect it’s image. (4)In order to reduce the controversy, Google should consult with the authors and publishers actively to obtain authorization (5)The copyright owners should be willing to try a new business model.

在機器學習與深度學習技術帶動第三次人工智慧熱潮,特別是與機器人、大數據、3D列印等結合,「人工智慧」成為各大科技企業重點發展技術,無論是透過成立研究小組或是併購的方式,在2016年即有40多家人工智慧技術公司被併購,同時這些技術也被應用在各式產品與服務中。此外不同產業中也陸續引進人工智慧,從事需要耗時費力的基礎工作,節省成本,也引發人類被取代的恐慌。世界各國除著力投資發展人工智慧之外,也重視人工智慧為社會及經濟產生的影響與現行法制的衝擊。 人工智慧技術也應用於創作與發明過程中,且在機器學習技術下,人類僅需輸入指示與限制,人工智慧完成內容創作所產出作品,與人類創作成果並無二致。或是像是神燈精靈一般,人類只要以人工智慧可理解的方式定義問題、要件分析、功能設計,人工智慧即能完成最重要的物理設計,解決人類之問題,其產出物可能是符合產業利用性、新穎性與進步性等專利要件。這些人工智慧創作與發明物是否符合我國現行著作權法與專利法之規定而受到保護,將是本文探討重點,本文將以文獻研究以及比較法的方式深入研究。 智慧財產權制度設立的主旨是為保護人類精神活動成果,以人類為創作主體為前提,人工智慧參與創作之成果對於現行制度而言自然有所扞格。然而人工智慧創作力對於未來創作與發明而言,都是有所助益,可豐富文化的多樣性並加快技術的發展。而日本知識產權戰略本部也於2016年四月時也將針對人工智慧創作物之法律保護,擬修訂智慧財產權法。如我國未來亦研擬將人工智慧創作物納入法律保護,本文參考日本立法相關討論以及美國學者之見解,提出立法時應考量的權利歸屬以及衍生的相關問題。 / Machine Learning and Deep Learning are leading the new artificial intelligence era, especially when integrated with technologies of robot, big data, and 3D printing. As A.I. gradually became the one of the most popular technologies, corporate giants, such as Google, IBM, Facebook, and Apple, have been setting up research labs and acquiring A.I. startups to improve the quality of their services and products. Meanwhile, through using their service and products, our daily life is filled with A.I. Moreover, in many different industries, companies are using A.I. to reduce their cost by replacing labors from time-consuming jobs. Governments not only invest in the development of A.I. technology, but also response to the impact A.I. brings to the society, economic and Law. Artificial creativity is a new way for creation and invention. With machine learning, human only need to input the indication and limitation for A.I. to generate the outcome which is almost the same as what human can do. A.I. is also being described as a “genie in the machine”. Human input the description of their problems, functional analysis, and functional design, then A.I. will do the physical design to solve the problems and generate inventions which are useful, novelty and un-obviousness. Whether these creations and inventions are copyrightable and patentable is the core of this essay. Intellectual property system is aimed to protect the result from human’s mind activity, so the author or inventor must be human beings. When A.I. is not just a creation tool, but a creative subject, that’s where a conflict occurs. However, A.I. creativity is beneficial to human creative and inventing activity, because it can quicken the progress of technologies and improve culture diversity. Legislators in Japan are planning to protect A.I. creation through modification of intellectual property law. If we also expect to protect A.I. creation and invention in Taiwan in the future, with Japan legislative discussion and America scholars’ theories, this essay might offer some useful indications on the right attribution and other derivation problems.

自世界上第一部成文著作權法—安妮法案 (The Statute of Anne)在1709年問世以來,著作權問題迄今仍一直是紛擾不休。著作權問題的發展一直以來跟科技的進步息息相關。而關於著作權存續期間的問題,一直是著作權領域中最富爭議性的問題之一,兩百年來,這個問題持續不斷的形成各個時代共通的難題,從不曾真正畫下句點。 德沃金是當代西方世界最富盛名的一位法哲學家之一,他提出以權利作為核心的裁判理論,試圖解決當法官在面臨沒有明確的法律條文或判例可資作為依循的困難案件時,應如何作出判決的問題。本文以美國聯邦最高法院於2003年所作成的Eldred v. Ashcroft案判決作為觀察的重點,在Eldred v. Ashcroft一案中,雙方當事人最大的爭議在於著作權存續期間的延長是否合憲?本文認為,關於著作權存續期間是否合憲的問題屬於著作權法上的困難案件。 因此,本文試圖透過德沃金所提出的裁判理論來觀察Eldred v. Ashcroft案中,美國各級法院裁判的理由構成是否建構在權利的基礎上。本文也希望從Eldred案著作權存續期間延長的爭議中,一審到三審雙方當事人與美國各級法院法官的裁判與主張,提供一個我國法院裁判時可以參考與依據的借鏡,透過外國法院與學說對於這個問題的處理,來幫助我國解決同樣的爭議,並逐步建構我國的裁判理論。

網際網路對音樂產業智慧財產權的影響 / The Impacts of Internet on Intellectual Property Rights of Music Publication Industry

本論文旨在探討兩種主要的網路資料傳輸技術:主從式傳輸技術與點對點式交換技術對於音樂產業智慧財產權的影響。選定音樂產業作為研究對象,係因音樂產業自從mp3音樂壓縮格式風行以來,其高品質與高壓縮比例的特性,使音樂出版品不斷遭到非法重製,著作權人的權益也因此不斷遭到侵害。檢視此一事件的來龍去脈,並嘗試從中學習教訓,以求一可行的經營模式,是本論文要進一步探討的。   本研究主要研究問題如下:   一、美國法律增修條文、新增法案、與最新判例對於音樂出版產業智慧財產權的保護方向為何?   二、依據網路傳輸技術與電腦軟體之特性,政府部門應如何對智慧財產權加以保護與管理,以鼓勵學術與藝術創新,並兼顧相關產業與技術發展?   三、新創事業應如何規劃與執行其商業模式中的智慧財產權策略,以避免可能的訴訟風險?   四、傳統音樂出版產業面臨新科技與新商業模式的挑戰,應如何達成互利雙贏的局面?   本研究主要分析對象為美國與國內線上音樂服務廠商:MP3.com、Napster、飛行網、與ezPeer等四家公司,就其對於傳統音樂產業體系的衝擊與影響加以探討,並提出具體策略建議。選擇這些公司的主要原因有以下幾點:   一、營模式包含企業對個人(B to C)與個人對個人(C to C)兩種。   二、研究對象都是藉由應用網際網路之科技創新而興起。   三、音樂下載服務仰賴上游供應商程度極深。   四、音樂下載服務對供應商的經營管理造成重大影響。   五、研究對象均可能或已經面臨智慧財產侵權訴訟。   本研究之研究方法以文獻與個案分析為主。資料來源有三:第一為網站直接觀察,第二為電子郵件來往與直接訪談方式,第三則為次級資料蒐集。依研究過程與研究發現。本研究結論如下:   一、政府部門應加緊著作權法修正案立法腳步,以補足目前對輔助侵害與代理侵害規範不足之處。   二、智慧財產權法律知識與法律行動準備方面,國外個案公司較國內個案公司相對充分。   三、音樂產業可行的經營模式之一,是整合豐富內容、互動交流、與加值服務的數位音樂平台,而最有能力整合的,是既有資源豐富的傳統音樂出版(唱片)業者。   本研究以個案探討方式進行,研究方法屬於內容分析。但因為議題新穎、科技演變迅速,探討身賭與廣度難免有所偏頗或不足之處。展望未來,數位內容產業(按經濟部的定義,數位內容產業包含軟體、電子遊戲、媒體、出版、音樂、動畫、網路服務等領域)已成為政府「兩兆雙星」重點發展產業之一,後續研究可廣泛地就數位內容產業智慧財產權保護與管理進一步研究。 / This research is to discover the impacts of the two major internet data communication protocols, which are client-server and peer-to peer technology, on the intellectual property rights (IPR) of the music publication (recording) industry. The purpose of choosing this theme was that the popular audio file compressing technology, ISO-MPEG audio layer-3, mp3, has changed our daily life dramatically. The features of high audio quality and high compressing capability, accompanying with client-server and peer-to-peer technology, are accelerating illegally duplicating of those songs and all the other audio publications, and such abusing of technology has been infringe on copyrighters’ privilege since the debut day of the technology. To review all the related events, to attempt to gather some lessons learned, and to develop a possible business model, are the efforts to which we want to contribute.   There are four major issues of this thesis:   1.What has been exposed beyond the latest related IPR laws, acts, and cases in the States about the protection on copyrights of the music publication industry?   2.Regarding to the characters of internet and information technology, how congress, government, court, and law enforcement agency could do to encourage innovations of technology, industry and economy growth, and protect IPR?   3.How should start-ups plan and execute their business model and IPR associated strategy to avoid the risk of possible IPR related lawsuit?   4.Facing the challenge of new technology and business model, what can recording industry do to construct a win-win situation?   Four online music service providers in the U.S. and Taiwan have been chosen, which are MP3.com, Napster, Fashionow, and ezPeer. We seek to depict the impacts on current recording industry, and attempts to develop a solid strategy. The reasons of choosing these companies are:   1.Their business models consist of two typical categories, which are Business to Customer and Customer to Customer,   2.All these start-ups applied internet and information technology, and   3.They are no doubt a threat to recording and are or are facing going to face IPR lawsuits   The methodology of this research is content analysis, and the materials were gathered form: website evaluating, interview with the users, and secondary data collecting. The conclusions are:   1.(Taiwanese) Government should accelerate the progress of modifying copyright law to regulate contributory and vicarious infringement.   2.The U.S. subjects are better prepared for IPR laws and affairs than Taiwanese ones.   One feasible business model for recording industry is a “Digital Music Platform,” combining with a variety of content, interactive communication, and value-added services. Companies in current recording industry, with profuse resources, are certainly the best candidates.
