Practicing the law of human dignity

Die philosophischen Grundlagen der Meta-Dimension des Rechts auf Menschenwürde lösen eine Fragestellung aus, die die Grenzen der Disziplin des Rechts übertrifft: wie könnte das Transzendentale als ein Aspekt der Bedeutung von Menschenwürde dargestellt werden? Das Beharren auf der nicht-Bestimmung des Menschenbildes oder auf dem Begriff ‚Gott’ in der Präambel des Deutschen Grundgesetzes, wie es sich in der Deutschen Dogmatik widerspiegelt, gepaart mit dem Bestreben nach einer Fall-zu-Fall ad hoc Konkretisierung dessen, was Menschenwürde bedeutet, inspiriert diese Untersuchung von ‚etwas fehlt’ [‘something missing’]. In postmoderner Art und Weise beschreibt diese Geschichte das Gesetz der Menschenwürde als Trojanisches Pferd und bietet hermeneutische und literarische Grundlagen für eine affirmative Haltung gegenüber einer ''leeren'' Rede im juristischen Diskurs. Die Forschungsfrage erweckt und umkreist die polemisch verbrämten Begriffe von ‚Leere’ und ‚Black Box’: Warum erscheint der Rechtsbegriff der Menschenwürde ‚leer’? Oder wie ist er ‚leer’? Warum und wie ist er eine ‚Black Box’? Wie erscheinen Manifestationen des Konzepts abstrakt wie Universalien, aber im Einzelnen konkret? Die ontologischen, sprachlich-analytischen und phänomenologischen philosophischen Erkenntnisse, vorgestellt im ersten Kapitel, bilden die Linse, durch die fünf maßgebliche Fälle des Bundesverfassungsgerichtes – über Abtreibung, lebenslange Freiheitsstrafe, Transsexualität, staatliche Reaktion auf Terroranschläge und die Gewährleistung eines menschenwürdigen Existenzminimums – im zweiten Kapitel analysiert werden. Die philosophischen Quellen werden nicht als Momente im langen Verlauf der Menschenwürde in der Geschichte der Ideen eingeklammert. / The philosophical underpinnings of what may be called the meta-dimension of the law of human dignity trigger a question that surpasses the boundaries of the discipline of law: how could the transcendental as an aspect of human dignity meaning be portrayed? The insistence on non-determination of the Menschenbild [human image] or ‘God’ in the Preamble to the German Basic Law [Grundgesetz] reflected in German legal doctrine, paired with the commitment to case-by-case ad hoc concretization of what human dignity means inspire this story of ‘something missing’. In postmodern fashion, this story portrays the law of human dignity as a Trojan Horse and provides hermeneutic and literary foundations for an affirmative stance towards ‘emptiness’ talk in legal discourse. The research question rekindles and twists polemically framed ‘emptiness’ and ‘black box’ contentions: Why does the legal concept of human dignity appear ‘empty’? Or, how is it ‘empty’? Why and how is it a ‘black box’? How do manifestations of the concept appear abstract as universals and concrete as particulars? The ontological, linguistic-analytical, and phenomenological philosophical insights presented in Chapter One compose the lens through which five benchmark Bundesverfassungsgericht cases – on abortion, life imprisonment, transsexuals, state response to terrorist attacks, and the guarantee of a dignified subsistence minimum – are analyzed in Chapter Two. The philosophical sources are not bracketed as moments in the long course of human dignity in the history of ideas.

De son premier court-métrage Xiao Shan Going Home (1995) jusqu’à I Wish I Knew, de son premier films trilogie Xiao Wu, artisan pickpocket (1997), Platform (2000), Plaisirs Inconnus (2002) qui est considéré comme des films underground, à la sortie en Chine de Still Life en face du film blockbuster La cité interdite de Zhang Yi-mou, Jia Zhang-ke reste fidèle à son attitude de cinéaste de films d’auteur. Il ne change jamais. Il est un authentique paradigme de la société chinoise. Il est comme un écrivain qui enregistre la mutation de la société chinoise des années 1980 et 1990 jusqu’à aujourd’hui. Il cherche la vérité, avec sincérité, soucieux de ne jamais simplifier la réalité, dans le respect de l’homme et de la complexité de sa vie quotidienne. C’est une recherche qui s’articule sur une double démarche Art et Science. Elle met en scène une bactérie bioluminescente. Ma réflexion présente la bioluminescence comme une construction intellectuelle et phénoménologique, où la dimension ontologique de la lumière prend tout son sens dans l’idée d’u Contenant Lumière Vivante.La thèse retrace aussi un parcours artistique ponctué de lumière et faite de rencontres humaines et littéraires comme le Petit Prince de Saint-Exupéry. Elle met aussi en lumière ma rencontre d’outre-tombe avec le savant et philosophe Raphaël Dubois 1849-1929, qui m’a ouvert les pistes de recherche sur ses traces de biologiste, sur sa philosophie du Protéon et de la Mémoire en général.Ma réflexion sous-tend une double éthique : celle qui concerne l’honnêteté scientifique par rapport à la mémoire de Dubois et celle liée au droit de réserve, attachée à la pratique du vivant et à la responsabilité qui incombe à tout un chacun. Je pose aussi un regard critique sur la lumière vivante comme phénomène de mode. On peut être séduit par sa qualité esthétique, sa nature intrinsèque de lumière froide et sa finalité, supposée écologique, mais la « pratique » dans la réalité soulève de nombreux problèmes. / This research work is based on a dual approach of art and science. It features a bioluminescent bacterium. My reflection presents bioluminescence as an intellectual and phenomenological construction where the ontological dimension of light takes on its full meaning from the idea of living light container.The thesis also traces my artistic career punctuated by light and human encounters as well as books such as the Little Prince by Saint-Exupéry. It also highlights my meeting from beyond the grave with the scientist and philosopher Raphael Dubois 1849-1929 who opened for me a track of research following his steps as a biologist and a field of reflection on his philosophy of Protéon and on memory in general. My reflection underlies a double ethics, that of scientific honesty in relation to Dubois' memory, and that related to the right of reserve linked to the practice of living and to the responsibility that falls to everyone. I also cast a critical look at this living light as a fashion phenomenon, one may probably be attracted by its aesthetic quality, its intrinsic nature of cold light, and its supposed ecological end, but in fact its « practice » raises many problems.

A multi-agent based system to promote collaboration among Namibian transport stakeholders in order to reduce empty runs

The main aim of transport stakeholders has always been to transport freight efficiently, as this efficiency contributes to the growth and success of their business. A country like Namibia is no different as the efficiency of transport lies in the effective utilisation of carrier capacity in any direction. Due to the various types of freight, transport operators rarely have the capacity to cover all freight movement requests. This research put the empty runs experienced by most of the Namibian transporters at 33%. Empty runs could however be reduced through collaboration and sharing of capacity among transport stakeholders. Multi-agent systems (MAS) are various individual computer agents that are configured independently to interact with other agents to achieve one goal. These systems have been explored as an approach to achieve collaboration among transporter stakeholders. Taking into consideration the characteristics and requirements of MAS, this research was able to conduct a feasibility of its implementation within Namibia. Concluding with an evaluation of available Multi-agent based systems that could achieve collaboration and reduce empty runs in the Namibian transport environment. / Information Science / M. Tech. El discurso se construye a través de un transitar sobre la banda de Moebius y en su vaivén y en su doblez aparecen y desparecen imágenes, ideas y textos sobre los que fluye la voluntad de construir una interpretación nueva sobre el objeto descrito. Martin Heidegger, Gilles Deleuze y Gaston Bachelard son los tres sostenes teóricos de esta estructura. Y más cerca y más lejos de este texto siempre se mantiene la difícil tarea de entender cuál es la forma de habitar y de ser (Ich bin) del hombre en la tierra. / The purpose of this study is to address the concept of space and, in particular, its disoccupation through three different pieces of work: Empty/Metaphysical Box by Jorge Oteiza, Who´s afraid of red, yellow and blue by Barnett Newman and German Pavilion by Ludwig Mies van der Rohe. The discourse is constructed through a move on the Moebius band, its swing and double apparition and disappearance of images, ideas and texts which build a new interpretation of the subject matter. Martin Heidegger, Gilles Deleuze and Gaston Bachelard are the three theorists of this structure. The difficult task of understanding what is the way of living and being of man (Ich bin) on earth always remains what is closer and further away from this text.

[pt] No final dos anos 1960, os projetos arquitetônicos em grandes escalas foram desacreditados no Ocidente por estarem associados à presença dos Poderes vigentes. Influenciados pelos ideais de Maio de 1968, os arquitetos ocidentais passaram a procurar modelos alternativos, baseados na linguagem histórica. Eles buscavam com isso alcançar a autonomia da forma arquitetônica, esvaziando-a do suposto conteúdo ideológico, que estaria aderido às formas abstratas modernas. No entanto, o enfoque pós-moderno nos elementos formais do objeto arquitetônico e do espaço urbano implicava no abandono da questão urbanística na escala metropolitana. Esta escala espacial seria marcada pela perda das referências às estruturas formais orgânicas. No Japão, a pesquisa moderna em grandes escalas não foi interrompida, oferecendo um amplo instrumental para a questão urbanística contemporânea. Esta dissertação verifica como os arquitetos Fumihiko Maki e Rem Koolhaas propõem a retomada e a revisão do urbanismo moderno metropolitano. Eles partem do pressuposto de que a Forma arquitetônica seria vazia de significados intrínsecos. A apropriação por parte dos Poderes e, também, por parte das pessoas imprimiria à arquitetura significados, retirando dos arquitetos a responsabilidade sobre a totalidade do projeto e devolvendo-lhes a legitimidade da disciplina. Esta pesquisa percorre os caminhos seguidos por esses arquitetos a partir de suas referências orientais e ocidentais, mostrando como, em diversos momentos, os conceitos arquitetônicos dos dois mundos convergem, apontando a persistência do pensamento moderno. / [en] By the end of the 1960s, large-scale architectural projects were discredited in West because they were associated with the established Power. Influenced by the ideals of May 1968, architects began searching alternative models based on the Historical language. They wanted to reach the autonomy of the architectural form by releasing it from their supposed ideological content, which was adhered to the abstract modern forms. Nevertheless, the post-modern approach, which was based on formal elements of the architectonical object and of the urban space, implied in the relinquishment of the metropolitan-scale. This urban-scale would be characterized by the references loss of organic formal structures. In Japan, modern research on large-scales was not interrupted, offering an important arsenal to the questions of contemporary urbanism. This dissertation verifies how the architects Fumihiko Maki and Rem Koolhaas propose the retaking and revision of modern metropolitan urbanism. They presuppose that architectonical Form is devoid of intrinsic meaning. Its appropriation by Power and also by people gives it meaning, removing architects responsibility on the totality of the project and giving them back the legitimacy of the discipline. This research follows the paths opened by these two architects through their Eastern and Western references, revealing the many instances in which architectonical concepts of both worlds converge, aiming to the persistence of modern thought.

Incivility in social media as agonistic democracy? : a discourse theory analysis of dislocation and repair in select government texts in Kenya

In an era when adversarial politics is condemned for either being archaic or right-wing extremism, proposing that incivility can be used to counter existing hegemonies, despite its potential to incite violence, is proposing an unorthodox project. By rejecting foundationalist approaches to the current incivility crisis, this study sees an opportunity for it to act as a populist rapture that defies simple binary categorisation and deconstructs incivility, at an ontological level, to reveal the deep meanings and concealed causes that contrast the grand narrative of hate speech. After an overview in chapter one, the study continues with a theoretical review of literature on incivility, guided by the works of radical democracy theorists who universalise what seems particular to Kenya. This review is followed by the description of Bakhtin’s concept of carnivalesque as utani, a joking relationship common in East Africa. For its theoretical perspective, the study is guided by Mouffe’s theory of agonistic democracy and a research method developed by transforming Laclau and Mouffe’s (1985) work in Hegemony and Socialist Strategy: Towards a Radical Democratic, into a method for Discourse Analysis. Various concepts from Laclau and Mouffe’s work are used to innovate an explanation of how political practices in social media, both linguistic and material texts, enhance incivility and the struggle to fix a regime’s preferred meaning. Guided by Laclau and Mouffe’s Discourse Analysis, the study describes how the government is using linguistic tools and physical technologies to repair the dislocation caused by incivility in social media in its attempts to re-create hegemonic practices. Without engaging in naïve reversal of the polarities between acceptable and unacceptable speech, and considering that at the ontological level politics is a friend—enemy relation, the study argues that incivility in social media is part of the return of politics in a post-political era, rather than simple unacceptable speech. While remaining aware of the dangers of extreme speech, but without reinforcing the anti-political rational consensus narrative, incivility is seen as having disruptive counterhegemonic potential, that is, if we consider the powerplay inherent in democracy. Graph databases provide schema-flexible storage and support complex, expressive queries. However, the flexibility and expressiveness in these queries come at additional costs: queries can result in unexpected empty answers or too many answers, which are difficult to resolve manually. To address this, we introduce subgraph-based solutions for graph queries “Why Empty?” and “Why So Many?” that give an answer about which part of a graph query is responsible for an unexpected result. We also extend our solutions to consider the specifics of the used graph model and to increase efficiency and experimentally evaluate them in an in-memory column database.

[pt] Esta dissertação propõe uma leitura da especificidade do laço social na atualidade, assim como propõe uma maneira como, a partir deste laço, poderia ser decantada uma política contemporânea. Para esta costura, uma leitura do sociólogo Zygmunt Bauman fornece balizas para delimitarmos o estado atual do laço social. Em seguida, algumas das perspectivas de Sigmund Freud, com relação ao social e aos modos de organização grupal, especialmente quanto ao lugar que estes dão ao líder, são contrapostas à descrição de Bauman. Jorge Alemán e Ernesto Laclau trazem, então, elementos para a aplicação de conceitos desenvolvidos por Jacques Lacan, a partir de Freud, ao momento político atual, especialmente no que concerne às concepções de solidão comum, significante vazio e ato instituinte. Por fim, os conceitos lacanianos de nó borromeano e sinthome são examinados para localizar em que se apoiam os conceitos de Alemán e Laclau, com referência ao ensino de Lacan. Amarra-se, assim, nossa dissertação, propondo alguma orientação dentro do campo demarcado. / [en] This dissertation proposes a reading of the specificity of the social tie in the present time, as well as proposes a way where, from this tie, a contemporary politics could be decanted. For this seam, a reading by sociologist Zygmunt Bauman provides reading beacons for delimiting the current state of the social tie. Next, some of Freud s perspectives on the social and modes of group organization, especially as to the place they give to the leader, are opposed to Bauman s description. Jorge Alemán and Ernesto Laclau bring elements for the application of concepts developed by Jacques Lacan from Freud s work to the present political moment, especially in what concerns his conceptions of common solitude, empty signifier and institute act. Finally, the Lacanian concepts of the Borromean node and sinthome are examined with the objective of locating in which the concepts of Alemán and Laclau are supported in the teaching of Lacan. Thus, our dissertation is tied, proposing some orientation within the demarcated field.
