It has as intention to present an introduction to the Calvin s hermeneutics. It calls attention for the fact of that although the great contribution of Calvin, its hermeneutics still is, in many aspects, stranger in Brazil. The author makes an attempt to establish the influences on Calvin s thought that had contributed for his hermeneutics. It continues demonstrating the importance of the authority of the Bible for Calvin. After that he presents the main points of Calvin s hermeneutics and for a better understanding, he divides them in presuppositions, principles and approaches. In the last chapter the focus is in an analysis of Calvin s hermeneutics, having the modern study of Psalms as aid. Finally, it presents an attempt of dialogue between Calvin s hermeneutics and contemporary Brazilian Protestantism. This dialogue is presented in the form of some challenges. / Neste trabalho, o autor procura resgatar a leitura que Calvino fez dos Salmos de lamento. Ele tem como propósito apresentar uma introdução à hermenêutica de Calvino. Ele chama atenção para o fato de que apesar da grande contribuição de Calvino, sua hermenêutica ainda é, em muitos aspectos, desconhecida no Brasil. O autor faz uma tentativa de estabelecer as influências sobre o pensamento de Calvino que contribuíram para a sua hermenêutica. Ele prossegue demonstrando a importância da autoridade da Bíblia para Calvino, em seguida, apresenta os pontos principais da hermenêutica de Calvino e, para uma melhor compreensão, divide-os em pressupostos, princípios e enfoques. No último capítulo, se propõe a fazer uma análise da hermenêutica de Calvino de forma mais focada, tendo o estudo moderno dos Salmos como ajuda. Finalmente, ele apresenta uma tentativa de diálogo entre a hermenêutica de Calvino e o protestantismo brasileiro, diálogo este apresentado em forma de alguns desafios.

Este trabalho remete seus esforços para uma investigação que indaga a possibilidade de autenticidade do fenômeno jurídico no público. O método, concebido no sentido de caminho, é trilhado a partir da analítica fundamental de Martin Heidegger, e da hermenêutica compreensiva de Hans-Georg Gadamer percebida sob o viés da via fenomenológica de investigação. O jurídico é constitutivo do ser humano existente, Dasein. Desse modo, o trabalho procura discutir o fenômeno jurídico, sua condição de autenticidade, o modo de ser tradicional do ente humano existente e a mundanidade que o constitui, sob a luz da filosofia heideggeriana do ser. Dasein é ontológico, reconhece esta existência e é interrogado quanto a ela. Dasein pode se mostrar como é, em sua autenticidade e propriedade, mas também pode ocultar-se de diversos modos. O impessoal, modo de ser preponderante do Dasein na cotidianidade, promove a dispersão do Dasein em seu ser-no-mundo, mediano e afastado e, determinado pela publicidade, obscurece o Dasein em sua propriedade. Assim considerando uma investigação do contexto em que se deu a emersão da analítica do ser tornou-se essencial. Uma vez lançadas as bases do pensamento heideggeriano e investigada a analítica fundamental, o modo de ser do direito que se conserva e se repete e que é ditado pela publicidade passa a ser questionado e a compreensão da juridicidade do Dasein no mundo circundante público abre possibilidades para o projeto autêntico na preocupação com o social. / The present work addresses its efforts on the inquisition of the possibility of authenticity in the legal phenomenon as perceived in the public. The method, conceived as a path, follows Martin Heideggers fundamental analytics, and Hans-Georg Gadamer´s comprehensive hermeneutics perceived phenomenologically. The legal phenomenon constitutes the Being that ex-ists, Dasein. Therefore, this study seeks to discuss the legal phenomenon, its Beingones-self condition, the everyday Being-with and its constitutive worldhood in the light of Heideggers philosophy of Being. Dasein is ontological, recognizes this existence and is questioned about it. Dasein can show itself as it is, in its authenticity and constitution, but it can also cloak its appearance in various modes. The They, the preponderant Dasein mode in its everydayness, promotes dispersion of the Dasein in its being-in-the world, making it detached and, keeps its authenticity obscured by publicity. Thus, it is essential to investigate Heideggers analytical thoughts in context. Once Heideggers basic thoughts have been studied and his fundamental analytics have been analized, the way of being of the law, maintained, repeated and dictated by publicity, begins to be questioned and the understanding Dasein´s legal phenomenon of the public world provides possibilities for an authentic project in its social concern.

O objetivo consiste na construção de uma teoria da clareza jurídica, pragmática, com passos iniciais, em oposição a uma teoria clássica da clareza lingüística do direito e de uma clareza jurídica estreita, na produção, interpretação e decisão. Delineia-se um perfil de clareza jurídica, pragmática, em oposição a um perfil de uma teoria clássica, da clareza lingüística do direito e da clareza jurídica, estreita. Desloca-se para uma teoria do claro-escuro em uma teoria geral da norma jurídica e sua construção de sentido, em uma teoria geral da interpretação e uma teoria da decisão. Recorre-se à técnica do direito, como linguagem, por uma semiótica jurídica, distinguindo-se a utilização de uma semiótica no direito e de uma semiótica do direito. A máxima interpretativa, in claris cessat interpretatio, redefinida para interpretar-se norma clara e não-clara, passa a ser regra de regulagem, integrante de uma norma jurídica e do ordenamento. Na construção do claro-escuro jurídico, pragmático, o não-claro é redefinido como defeito atenuado, que convive com o claro, com seu título de validade, em um ordenamento jurídico, a partir do estatuto da linguagem, como constitutiva de seu próprio funcionamento. A clareza jurídica, pragmática, exerce o papel de controle regulador, em uma teoria da decisão. O claro-escuro, jurídico, pragmático, na qualidade de valor, torna-se regra de calibração de um ordenamento. / The objective consists in the construction of a juridic clarity theory, pragmatic, with inicial steps, in opposition of a classic theory from linguistic clarity of law and from a narrow juridic clarity, in production, interpretation and decision. There is a profile of a juridic clarity, pragmatic, in opposition of a classic theory profile, from linguistic clarity of law, and from a narrow juridic clarity. It deslocates to a chiaroscuro theory in a general theory of juridic norm and its meaning construction, in a general theory of interpretation and also a decision theory. It appeals to the law technique , as a language, for a juridic semiotic, distinguishing the utilization of a semiotic on law and of a semiotic from law. The interpretative precept, in claris cessat interpretatio, redefined to interpretate clear norm and non-clear norm, becomes a regulation rule, part of a juridic norm and of the legal system. In the construction of a juridic chiaroscuro, pragmatic, the chiaroscuro is redefined as a attenuated defeat, wich lives with the clear, with its validity title, in a legal system, starting from the language statute, as constitutive of its own operation.Juridic clarity, pragmatic, exercising the role of a regulator control, in a decision theory. The chiaroscuro, juridic, pragmatic, in the quality of value, becomes a calibration rule of a legal system.

O objetivo desta tese é propor um aporte teórico-filosófico vale dizer, uma filosofia do design que possa, de um lado, dimensionar a dinâmica dos processos simbólicos mediados pelo design e, de outro, situar a experiência estética articulada por esses processos. Os instrumentos de orientação utilizados foram as obras de Nietzsche, Clément Rosset, Paul Ricoeur, Rogério de Almeida e Mario Perniola, entre outros autores, além de obras literárias e cinematográficas, convocadas a ilustrar a noção de hermenêutica trágica, inaugurada neste trabalho. Tais instrumentos foram operados metodologicamente por meio de revisão bibliográfica (modalidade básica de pesquisa), guiando-se pela hermenêutica simbólica (Ricoeur). A discussão delineada em três capítulos (Filosofia do design, Filosofia trágica e Hermenêutica trágica) visa apresentar, no quarto capítulo (Design como articulação simbólica), aspectos de uma articulação simbólica operada pelo design e da qual se vale o olhar contemporâneo para compreender o mundo e para nele atuar. / This thesis aims to propose a theoretical and philosophical supply that is, a philosophy of design which can, on the one hand, to scale the dynamics of symbolic processes mediated by design and, on the other, to place the aesthetic experience articulated by these processes. The orientation tools were the works of Nietzsche, Clément Rosset, Paul Ricoeur, Rogério de Almeida, Mario Perniola, among others, in addition to films and literary works, convened to illustrate the notion of \"tragic hermeneutic\", inaugurated in this thesis. These instruments were methodologically operated through literature review (basic mode of research) and guided by the symbolic hermeneutics (Ricoeur). The discussion delineated in three chapters (\"Philosophy of design,\" \"Tragic philosophy\" and \"Tragic hermeneutics\") aims to present, in the fourth chapter (\"Design as symbolic articulation\"), some aspects of a symbolic articulation operated by design and by which the contemporary view takes to understand the world and to act on it.

Esta tese apresenta estudos interpretativos sobre as obras musicais compostas pelo autor durante seu doutoramento: Introverso (piano), Ao Pó (clarinete em si , trombone, violoncelo, piano), Breviário das Narrativas Absurdas (vibrafone, piano), Coisas Pelo Ar (piano), O Desvão (2 clarinetes em si, clarone, piano), Epopeia Fantástica (oboé, trombone, percussão, violino, contrabaixo). A partir de uma perspectiva teórica hermenêutica, é realizada uma adaptação do conceito de narrativa musical a essas obras, alicerçando-a em extensa revisão bibliográfica sobre o assunto e estabelecendo procedimentos metodológicos para a elaboração de interpretações narrativas desse repertório. O objetivo geral do trabalho é conceber e fundamentar teoricamente interpretações que possam ser consideradas como transformadoras conceituais da música e continuadoras do processo composicional do autor. Esses procedimentos são complementados com definições reflexivas sobre o processo composicional, enfatizando o viés criativo e performático da disciplina ‘análise musical’. Assim, o produto desta tese pode ser dividido em três categorias: reflexão crítica sobre obras musicais compostas durante o curso de doutorado (apresentadas aqui em partitura e gravação audiovisual); interpretação analítica e narrativa dessas obras; fundamentação teórica e metodológica dessa interpretação. As três categorias são consideradas como complementares e imprescindíveis para o cumprimento dos objetivos desta tese, a qual o autor oferece como contribuição a debates pertinentes e correntes nas áreas de composição e teoria da música. / This thesis presents interpretive studies on musical works composed by the author during his doctoral studies. From a hermeneutical perspective, the concept of musical narrative was adapted to the analytical necessities found in these works. This adaptation includes extensive bibliographic review on the issue of musical narrative; it establishes methodological procedures for the elaboration of analytical/narrative interpretations for this repertoire. The overall objective of this thesis is to conceive and substantiate theoretically these interpretations, considering them as conceptual and transformative actions on the music, and therefore a continuation of the author’s compositional process. For this purpose, the abovementioned procedures were complemented with reflexive definitions regarding this compositional process, emphasizing the creative and performing bias of musical analysis. Thus, the product of this thesis may be divided into three categories: publication and critical reflection on the musical compositions created during this doctorate (presented here as scores and audiovisual recordings); analytical and narrative interpretations of these works; implementation of theoretical and methodological foundations for these interpretations. These three categories are seen as complementary and indispensable for the purposes of this thesis, which is meant by its author as a consistent contribution for the current debates on musical composition and musical theory. Dessa forma, o assunto em discussão consiste em identificar essas abordagens e o diálogo é estabelecido de modo mais específico com o currículo de formação inicial desses professores. O diálogo entre o texto (currículo) e intérprete (pesquisa) permite pela linguagem identificar vários preconceitos, que segundo Gadamer são herdados da tradição. A tarefa hermenêutica, nesse aspecto, consiste em encontrar os preconceitos legítimos, sendo estes fundamentais para a compreensão. Dito isso, e a partir do estudo realizado, a ressurreição vem se mantendo como abordagem da morte predominante em relação às demais que não deixam de acontecer, haja vista a forte presença da tradição judaico-cristã católica na sociedade brasileira, servindo de base e manutenção de vários preconceitos legítimos e ilegítimos alcançando as Ciências da Religião e o Ensino Religioso, restringindo a importância de outras abordagens tanto na formação inicial quanto na prática do componente curricular, implicando no diálogo e na própria compreensão do ser que pode ser compreendido como linguagem. / The present study aims to identify the approach of the death on the beginning of the curriculum formation of the Religious study teacher in Pará, starting from the methodological conceptions qualitative research, of hermeneutic-phenomenological tradition, applying to a philosophical hermeneutic approach of Has George Gadamer (1900-2002), treated on the work Truth and method (2011), to whom the comprehension is a dialog between question and answer, whose aim is to establish a compromise about the subject discussed. Thus, the discussed subject consists of identify these approach and the dialog established in a more specific way with the curriculum of the beginning formation of these teachers. The dialog between the text (curriculum) and reader (researcher) permit, by the language, to identify several prejudices that according to Gadamer are inherited by the tradition. The hermeneutical task, in this aspect, consists in finding the legitimate prejudice being fundamental for comprehension. After saying that, and besides the study done, the resurrection is being kept as a the approach of the death remarkable comparing to the others that still happen, due to the presence of the strong presence of catholic Judeo-Christian tradition on Brazilian society, serving as a basis and maintenance of several legitimate concepts of illegitimate reaching Science of Religion and Religious Study, restricting the importance of other approach as in the beginning studies as in the practice of the curricular compound, implying in the dialogue and in the comprehension itself of the being, that can be understood as language.

Partindo da noção hermenêutica de que a compreensão de uma norma geral prévia é sempre um ato de deliberação criativa, busca-se mostrar que essa deliberação inclui sempre uma margem de arbitrariedade, a qual precisa, antes de ser criticada ou superada, ser compreendida a partir das necessidades concretas do direito, e não de uma pretensa adequação a normas previamente delimitadas. Assim, a redução da arbitrariedade é proposta não com base em um esquema teórico prévio que guie a “correta interpretação”, mas a partir de uma noção dialógica de hermenêutica, na qual as teses jurídicas deixam de ser compreendidas como idéias puramente lógicas e abstratas e passam a ser avaliadas sempre frente a um caso concreto, em uma relação dialética direta com as teses antagônicas e, sobretudo, com a tradição que está vindo à tona por meio daquela interpretação. / This paper addresses the question of the degree of indeterminacy in interpretation and application of law. Based on the hermeneutical notion that understanding a general advance is always a creative act of deliberation, we seek to show that this deliberation has always included in it a margin of arbitrariness, which must, rather than be overcome or criticized, be understood from the concrete needs of the law, not by an alleged adequacy standards previously set. Thus, reducing the arbitrary proposal is not based on a previous theoretical framework to guide the "correct"interpretation, but from a notion of dialogical hermeneutics, in which legal arguments are no longer understood as a purely logical and abstract ideas and are always being evaluated against a case, in a dialectical relationship with the direct antagonistic theses, and especially with the tradition that is coming up through that interpretation.

Durante os trabalhos desenvolvidos no período de oferta da primeira disciplina, Pragmática Linguística, a constatação de que alguns alunos da turma de 2007 atuavam como mediadores, ao interagir com os colegas, levou à realização da presente pesquisa, que consistiu na investigação das condições que podem fazer do aluno um mediador, contribuindo, assim, para o estudo da mediação semiótico-pedagógica que se dá em contexto online. Partindo-se da noção de mediação de Vygotsky (1967/2008), buscou-se, em trabalhos de autores interessados no estudo das condições em que se realiza o ensino-aprendizagem online e na interação por meio do fórum – como Gunawardena (1999), Garrison e Anderson (2003), Pallof e Pratt (2004), Coffin et al. (2005, 2006), Celani e Collins (2006), Collins (2008), Coll e Monereo (2010), Monereo e Pozo (2010), entre outros – subsídios teóricos para a interpretação das mensagens postadas por alunos mediadores, com base na orientação da hermenêutica de Ricoeur (2002, 2006, 2009), para quem as ações expressas em textos escritos podem tornar-se objeto da ciência. Às considerações às quais levou a pesquisa indicam a importância do fórum como um espaço privilegiado para a mediação feita por alunos com relação a seus colegas. / This research is inserted in the realm of Applied Linguistics studies and aims to identify mediating actions performed by students in the 2007 class of the Specialization Course Teaching and Learning of the Portuguese Language for through the interpretation of messages posted in the discussion forum. During the activities developed in the course of Linguistic Pragmatics discipline, the finding that some students when interacting with their classmates acted as mediators led to the conception of this research whitch investigated the conditions that can make the student a mediator, thus contributing to the study of semiotic-pedagogic mediation that takes place in the online context. By starting from the Vygotsky’s notion of mediation (1967/2008), the theoretical foundation of this study was grounded in authors interested in researching on the conditions under which interaction through forums are carried out in the online courses – such as Gunawardena (1999), Garrison e Anderson (2003), Pallof e Pratt (2004), Coffin et al. (2005, 2006), Celani e Collins (2006), Collins (2008), Coll e Monereo (2010), Monereo e Pozo (2010), among others. The interpretation of messages posted by student mediators was based on the hermeneutic orientation supported by Ricoeur (2002, 2006, 2009), for whom the actions expressed in written texts can become an object of science. The research interpretation indicates the importance of the discussion forum as a privileged space for mediations made by students toward their peers.

Aponta para a necessidade de controle da decisão judicial infracional, comoforma de efetivação de direitos e garantias fundamentais de adolescentes e de superação dareferida crise, no campo da justiça infracional. Para tanto, apresenta, no primeiro capítulo, ocontexto de responsabilização de adolescentes, no Brasil, indicando a permanência dadiscricionariedade judicial na aplicação da referida medida, mesmo após a entrada em vigordo ECA e de seus critérios supostamente objetivos para a internação de adolescentes pelaprática de ato infracional. No segundo capítulo, a partir de decisões do Superior Tribunal deJustiça (STJ), expõe algumas possibilidades de exercício discricionário na determinação e/oumanutenção da medida de internação. Indica, a partir da fundamentação, como essas decisõesabrigam argumentos casuísticos, extranormativos e subjetivos para legitimar a aplicação damedida e se distanciam de um modelo constitucional e democrático de responsabilização.Diante do problema da discricionariedade, apresenta a hermenêutica, no último capítulo,como condição de possibilidade para o controle da decisão infracional. Sustenta como ainterpretação levada a cabo pelo juiz não é um processo arbitrário de escolha de sentido ejustifica como é possível pensar em um constrangimento democrático para a decisão judicial,sem que isso configure uma proibição de interpretar. Apresenta ainda a relação entre ahermenêutica e a dogmática jurídica, debatendo como uma compreensão hermeneuticamentesituada do processo de interpretação no direito não inviabiliza outras perspectivas teóricaspara o controle da decisão judicial. / The dissertation discusses the problem of discretion regarding the enforcement of socioeducationalmeasure of detention pursuant to Article 122 of the Statute of the Child andAdolescente (ECA). The scope is to understand the so-called interpretation crisis of the ECAand to presente under what conditions it is established in the field of enforcement of socioeducationalmeasure of detention. As results, the paper concludes that there is a need tocontrol judicial decisions in order to protect the rights and guarantees of adolescents and as away to overcome the crisis in the field of socio-educational justice. Chapter one explains thecontext of punishment of adolescents in Brazil. It indicates the permanence of judicialdiscretion concerning the enforcement of the measure, even after the entry into force of theECA and its supposedly objective criteria for detention of adolescents by the practice ofinfraction. In the second chapter, from decisions of the Superior Court Of Justice (STJ) sharessome discretionary possibilities in maintaining / or in determining the measure of detention.The paper explains, in view of the judicial reasoning, that these decisions contain arbitraryand subjective arguments to justify the enforcement of the measure. This type of reasoning isnot in accordance with the constitutional and democratic model of punishment. The finalchapter analyzes wheter hermeneutics is a condition of possibility to control the judicialdecision. It argues that the interpretation carried out by the judge is not an arbitrary processoof choosing sense and it justifies how its possible to think a democratic constraint for thejudicial decision, and it doesn’t imply a prohibition to interpret. It also presents therelationship between hermeneutics and legal dogmatic, debating as a hermeneutically situatedunderstanding of the interpretation process does not preclude other theoretical perspectives forthecontrol of decision.
