Le rôle des entreprises dans la distribution des richesses

Quel rôle les entreprises doivent-elles jouer dans la société ? Dans le premier chapitre, nous critiquons l’idée selon laquelle les entreprises ont des responsabilités sociales au-delà de la loi : elles n’ont ni les capacités ni la légitimité démocratique d’agir au nom du bien commun. Elles doivent se contenter d’assumer leur rôle économique en respectant la loi. Cependant, celui-ci inclut la distribution des richesses. Le deuxième chapitre présente trois intuitions issues de la pensée économique classique. Celles-ci permettent de justifier une distribution égalitaire des revenus du travail. Dans le troisième chapitre, nous montrons que les entreprises ont un rôle important dans la coordination des activités économiques et doivent être des institutions clés dans l’instauration d’une distribution plus égalitaire des revenus. Pour promouvoir cet objectif distributif, il faut repenser la propriété, la régulation et le design institutionnel des entreprises. Il faut par exemple favoriser les coopératives et la démocratie d’entreprise. / What role should firms play in modern economies ? In the first chapter, I criticize the idea that firms have broad social responsibilities beyond the law : they have neither the capacity nor the democratic legitimacy to act on behalf of the common good. They must therefore stick to their economic role. However, when defining this economic role, one should include distributive considerations. The second chapter exposes three intuitions of classical economists. These provide the basis to justify an equal distribution of labour income. In the third chapter, I show that firms play an important role in coordinating economic activities, and should be key institutions in establishing a fairer distribution of labour income. In order to promote this distributive goal, one must rethink the ownership and institutional design of firms. For example, the regulation should promote cooperative ownership and workplace democracy.

Climate Change Action through Co-Productive Design in Science-Policy Partnerships at Municipal, Provincial, and National Levels of Government

Why is it that the international scientific consensus on climate change has not been followed by a proportionate policy response in Canada? Perhaps the relationships between the country’s science organizations and government agencies are not functioning properly. My research adopts an interdisciplinary approach (i.e. science studies and political science) to this issue, highlighting the relevant literature’s underlying consensus on co-production, a norm of deliberative two-way engagement between scientists and policy-makers. I hypothesize that relationships embodying elements of co-productive design (e.g. informal communication, appointed liaisons) are more likely to facilitate climate action. To test this, I examine three cases of climate science-policy partnership in Canada by interviewing participants from both sides. The partnership between the Pacific Climate Impacts Consortium and BC municipalities exhibits substantial influence on policy, tied to a considerable degree of co-productive design. The partnership between the Pacific Institute for Climate Solutions and the Climate Action Secretariat of the BC provincial government also displays notable design characteristics, but primarily facilitates side benefits and soft influences rather than concrete policy changes. The attempted partnership between the Canadian Foundation for Climate and Atmospheric Sciences and the federal government exhibits few elements of co-productive design and has been effectively terminated, demonstrating the prerequisite importance of political interest. The relevant literature is not sufficiently nuanced to fully predict or explain these situations, so I put forward a new theoretical model. My science-policy relationship hierarchy (SPRHi) suggests that each such case can be classified as incidental interaction, basic partnership, interactive dialogue, or true co-production. It specifies the conditions which must be met for any given relationship to improve, maximizing potential benefits and influences. Concrete policy changes seem to result only from true co-production, though, which generally requires exceptional external requirements and thus cannot be deliberately facilitated. As such, co-productive design ultimately does not offer a clear way to address Canada’s climate inaction. I suggest that further research be conducted on international coordination mechanisms, public attitudes, and (especially) political leadership. However, the soft influences of science-policy partnerships may affect these broader factors in unpredictable ways, so the importance of co-productive design should not be underestimated. / Graduate

Peruvian voters abroad have participated for 36 years in domestic elections. This community has a political and economic agenda which is not represented in the Peruvian legislature. The Peruvian political elites neglect that the current institutional design disregards this group. Peruvian voters abroad have a particular set of offers and demands related to the migrant reality. This article analyzes the political engineering of the representation of voters abroad in the Peruvian electoral design and compares it to other political scenarios. Since other countries with similar voting populations such as Croatia and Ecuador have special constituencies of national residents living abroad, it is paradoxical that Peru has not yet one. The study shows the inconsistencies of the arguments that have hindered the creation of the special district of Peruvians voters abroad and discusses proposals for an applied reform. / Los peruanos en el exterior vienen participando 36 años en los procesos electorales del Perú. Esta comunidad tiene un potencial político y económico que no se representa en el Legislativo peruano. El actual diseño político institucional obvia que este grupo tiene un conjunto de ofertas y demandas particulares de la realidad migrante que las élites políticas desatienden. En el presente artículo, se analiza el tratamiento político que se le ha dado a la representación de los peruanos en el exterior en el diseño legislativo electoral peruano y se evalúa en perspectiva comparada. Dado que otros países en el mundo con poblaciones electorales parecidas, como Croacia y Ecuador, tienen circunscripciones especiales de residentes en el exterior es paradójico que el Perú no cuente con una. El estudio muestra las incoherencias que han imposibilitado la creación de la circunscripción especial de peruanos en el exterior y explora propuestas de reforma aplicada.

Esta pesquisa tem por objetivo a análise do Conselho Municipal de Educação de Ribeirão Preto (CMERP) a partir de três aspectos essenciais - os contornos do seu desenho institucional, os conteúdos dos seus processos deliberativos e os sentidos da participação em seu contexto. Es-peramos que essa análise possa indicar os caminhos que têm sido tomados por conselheiras e conselheiros no espaço participativo do Conselho, bem como compreender suas conquistas e desafios na direção da ampliação democrática. Os objetivos específicos são a investigação sobre o traçado e o funcionamento instituicional, a efetividade dos processos deliberativos e as rela-ções que se estabelecem numa conjuntura de partilha de poder entre o Poder Público e a socie-dade civil. O enfoque metodológico é qualitativo, com a reunião de dados documentais e a coleta de entrevistas semiestruturadas. O fenômeno da participação democrática no Brasil, em especial por meio das mais diversas instituições participativas criadas desde a redemocratização do país, tem gerado um campo vasto de pesquisas empíricas que tomam por base a democracia como processo de deliberação argumentativa e buscam avaliar ganhos e dificuldades desse ca-minho. Os resultados produzidos dentro de algumas décadas de funcionamento das instituições participativas ganham a centralidade da agenda de pesquisa, que busca medir a capacidade de tornar mais democráticas as relações entre Poder Público e sociedade civil. Para a nossa pesquisa, realizamos a análise de dados colhidos sobre o CMERP - a legislação, as atas das reuniões ordinárias e extraordinárias, o Plano Municipal de Educação de Ribeirão Preto, as entrevistas com conselheiras e conselheiros e as notas de campo. O CMERP é um conselho em funcionamento e que cumpre com suas atribuições legais. A instituição conta com uma participação marcadamente fiscalizatória do Poder Público e das políticas educacionais, com uma representação concentrada nos segmentos da educação municipal, em especial do professorado. Dentre os desafios encontrados em termos de ampliação democrática, estão a aproximação da sociedade civil e a diversificação dos setores representados internamente. / This research aims to analyze the Municipal Education Council of Ribeirão Preto (CMERP) through three essentials aspects: the outlines of its institutional design, the contentes of its de-liberative processes and the meanings of the participation in its context. We hope this analysis may indicate the paths that have been taken by counselers in the Council\'s participative space, as well as the understanding of its conquers and challenges towards a democratic enlargement. The specific objectives are the investigation on the layout and the institutional operation, the effectivness of deliberative processes and the relations that take place in a conjucture of power sharing between public Power and the civil society. The metodologic approach is qualitative, gathering documental data and collecting semi-structured interviews. The democratic partici-pation phenomenum in Brazil, especially by the means of several participative institutions that were created since the country\'s redemocratization, has generated a wide field of empirical researches that base the democracy as an argumentative deliberation process and aim to evalu-ate gains and difficulties on that path. From this perspective, the results produced whithin a few decades of operations of the participatory institutions gain the centrality of the research agenda in this area, which seeks to measure its ability to turn the relations between public sector and civil society more democratic. For our research, we did the analysis of direct and indirect data gathered on the CMERP - legislation, the minutes of meetings (ordinary and extraordinary), the Ribeirão Preto\'s Educational Municipal Plan, the interviews with advisors and counselors and the field notes. We can say that the Council is in operation and fulfills its legal atributions. The institution has a participation thar markedly fiscalizes do Public Power and educational public policies, with concentrated representation in the fields of municipal education, in special the teachers. Among the challenges in terms of democratic expansion, are the approaching of civil society and the diversification of sectors represented internally.

To this end, three mechanisms of diffusion are investigated – political nature, top-down and horizontal – and relevant contextual variables are identified – such as the apparent turmoil between management flexibility and regulation, regulatory federalism, the presence of strongly articulated societal actors and the importance of trade-worthy coalition goods in Brazil‟s multi-party presidentialism that took place in the Brazilian process of agencification. The peculiarities of the Brazilian case, such as the creation of an independent agency for the film industry and the state-level changes that took place indicate the existence of a 'diffusion without convergence', or 'divergent convergence' since, while Brazil has experienced a regulatory agency 'boom', agencies were modeled according to local needs and the specificities of the national context. / O presente trabalho tem como objetivo analisar o processo de difusão das agências reguladoras independentes no Brasil, ou agencificação, com o intuito de verificar se este processo foi convergente ou divergente, de acordo com duas perspectivas teóricas concorrentes que buscam compreender os processos de difusão. Para isso, foram verificados os mecanismos de difusão – natureza política, verticais e horizontais – e identificadas variáveis contextuais relevantes – como a aparente confusão feita entre flexibilidade de gestão e regulação, o federalismo regulatório, a presença de atores setoriais fortemente articulados, e a importância das moedas de troca no presidencialismo multipartidário brasileiro – que atuaram no processo brasileiro de agencificação. As peculiaridades do caso brasileiro, como a criação de uma agência independente para o cinema e as mudanças ocorridas em âmbito estadual, indicam tratar-se de uma 'difusão sem convergência' ou 'convergência divergente', uma vez que, embora o Brasil tenha experimentado uma 'explosão' de agências reguladoras, estas foram modeladas de acordo com as necessidades locais e especificidades do contexto nacional.

Integrated Community Energy Systems

Energy systems across the globe are going through a radical transformation as a result of technological and institutional changes, depletion of fossil fuel resources, and climate change. Accordingly, local energy initiatives are emerging and increasing number of the business models are focusing on the end-users. This requires the present centralized energy systems to be re-organized. In this context, Integrated community energy systems (ICESs) are emerging as a modern development to re-organize local energy systems allowing simultaneous integration of distributed energy resources (DERs) and engagement of local communities. With the emergence of ICESs new roles and responsibilities as well as interactions and dynamics are expected in the energy system. Although local energy initiatives such as ICESs are rapidly emerging due to community objectives, such as cost and emission reductions as well as resiliency, assessment and evaluation of the value that these systems can provide to both local communities and the whole energy system are still lacking. The value of ICESs is also impacted by the institutional settings internal and external to the system. With this background, this thesis aims to understand the ways in which ICESs can contribute to enhancing the energy transition. This thesis utilizes a conceptual framework consisting of institutional and societal levels in order to understand the interaction and dynamics of ICESs implementation.  Current energy trends and the associated technological, socio-economic, environmental and institutional issues are reviewed. The developed ICES model performs optimal planning and operation of ICESs and assesses their performance based on economic and environmental metrics. For the considered community size and local conditions, grid-connected ICESs are already beneficial to the alternative of solely being supplied from the grid, both in terms of total energy costs and CO2 emissions, whereas grid-defected systems, although performing very well in terms of CO2 emissions reduction, are still rather expensive. ICESs ensure self-provision of energy and can provide essential system services to the larger energy system. This thesis has demonstrated the added value of ICESs to the individual households, local communities and the society. A comprehensive institutional design considering techno-economic and institutional perspectives is necessary to ensure effective contribution of ICESs in the energy transition. / Energisystem över hela världen går igenom en radikal omvandling till följd av tekniska och institutionella förändringar, utarmning av fossila bränsleresurser och klimatförändringar. Följaktligen växer lokala energiinitiativ fram och ett ökande antal affärsmodeller fokuserar på slutanvändarna. Detta förutsätter att de nuvarande centraliserade energisystemen omorganiseras. I det här sammanhanget utvecklas integrerade samhällsenergisystem (ICES) som en modern utveckling för att omorganisera lokala energisystem som möjliggör samtidig integration av distribuerade energiresurser och engagemang från lokala samhällen. Med framväxten av ICES nya roller och ansvarsområden samt interaktioner och dynamik förväntas i energisystemet. Även om lokala energiinitiativ som ICES snabbt framträder på grund av samhällsmål, såsom kostnad och utsläppsminskningar samt resiliens, bedömning och utvärdering av det värde som dessa system kan ge till både lokala samhällen och hela energisystemet saknas fortfarande. Värdet av ICES-värden påverkas också av de institutionella inställningarna internt och externt för systemet. Med denna bakgrund syftar denna avhandling till att förstå hur ICES kan bidra till att förbättra energiövergången. Denna avhandling använder en konceptuell ram som består av institutionella och samhälleliga nivåer för att förstå samspelet och dynamiken i ICES-genomförandet. Nuvarande energitrender och de därtill hörande tekniska, socioekonomiska, miljömässiga och institutionella frågorna ses över. Den utvecklade ICES-modellen utför optimal planering och drift av ICES och bedömer deras prestanda baserat på ekonomiska och miljömässiga mätvärden. För den ansedda samhällsstorleken och lokala förhållandena är nätanslutna ICES redan fördelaktiga jämfört med alternativet att endast försörjas från nätet, både när det gäller totala energikostnader och koldioxidutsläpp, medan nät-defekterade system, även om de fungerar väldigt bra i termer av minskningen av koldioxidutsläppen fortfarande är ganska dyra. ICES garanterar självförsörjning av energi och kan tillhandahålla viktiga systemtjänster till det större energisystemet. Denna avhandling har visat mervärdet av ICES till de enskilda hushållen, lokalsamhällena och samhället. En omfattande institutionell utformning med hänsyn till de tekno-ekonomiska och institutionella perspektiven är nödvändigt för att säkerställa ett effektivt bidrag från ICES i energiövergången. / Los sistemas energéticos en todo el mundo atraviesan una transformación radical como resultado de cambios tecnológicos e institucionales, el agotamiento de combustibles fósiles y el cambio climático. Por consiguiente, las iniciativas locales de energía están surgiendo y los modelos de negocio se centran cada vez más en los usuarios finales. Esto requiere la reorganización de los actuales sistemas energéticos centralizados. En este contexto, los sistemas integrados de energía comunitaria (ICES, por sus siglas en inglés) están emergiendo como un desarrollo moderno para reorganizar los sistemas energéticos locales, permitiendo la integración simultánea de los recursos energéticos distribuidos y la participación de las comunidades locales. Con la aparición de ICESs se esperan nuevos roles y responsabilidades, así como interacciones y dinámicas, en el sistema energético. Aunque las iniciativas locales en materia de energía, como las ICESs, están surgiendo rápidamente debido a los objetivos de la comunidad, tales como la reducción de costos y emisiones, así como la resiliencia, y la evaluación, siguen careciendo del valor que estos sistemas pueden brindar tanto a las comunidades locales como a todo el sistema energético. El valor de los ICESs también se ve afectado por los entornos institucionales tanto internos como externos al sistema. Con este trasfondo, esta tesis pretende comprender las formas en que los ICESs pueden contribuir a mejorar la transición energética. Esta tesis utiliza un marco conceptual que consiste en niveles institucionales y sociales para comprender la interacción y dinámica de la implementación de los ICESs.  Además, esta tesis revisa las tendencias actuales de energía y los problemas tecnológicos, socioeconómicos, ambientales e institucionales asociados. La tesis desarrolla un modelo que optimiza la planificación y el funcionamiento óptimos de ICESs y evalúa su funcionamiento basado en métricas económicas y ambientales. Para el tamaño de la comunidad y las condiciones locales consideradas, los ICESs conectados a la red ya son beneficiosos tanto en términos de costos totales de energía como de emisiones de CO2 comparado con la alternativa de ser suministrados únicamente desde la red, mientras que los sistemas aislados y desconectados de la red, aunque desempeñándose muy bien en términos de reducción emisiones de CO2, siguen siendo bastante más costosos. Los ICESs garantizan el autoabastecimiento de energía y pueden proporcionar servicios esenciales al resto del sistema energético. Esta tesis demuestra el valor añadido de los ICESs a los hogares individuales, las comunidades locales y la sociedad. Un diseño integral que considere las perspectivas tecno-económicas e institucionales es necesario para asegurar la contribución efectiva de los ICESs en la transición energética. / Energiesystemen over de hele wereld gaan door een radicale transformatie als gevolg van technologische en institutionele veranderingen, uitputting van fossiele brandstoffen en klimaatverandering. Bijgevolg komen lokale energie-initiatieven op en richten steeds meer verdienmodellen zich op de eindgebruikers. Dit vereist dat de huidige gecentraliseerde energiesystemen opnieuw worden georganiseerd. In deze context komen geïntegreerde energiegemeenschapssystemen (ICESs) op als een moderne ontwikkeling om lokale energiesystemen te reorganiseren, welke gelijktijdige integratie van lokale energiebronnen en betrokkenheid van lokale gemeenschappen mogelijk maakt. Het wordt verwacht dat de opkomst van ICESs zowel nieuwe rollen en verantwoordelijkheden met zich meebrengt. Hoewel lokale energie-initiatieven zoals ICESs snel opkomen door de  doelstellingen van de gemeenschap, zoals kosten- en emissiereducties en veerkracht, schort het nog steeds aan beoordeling en evaluatie van de waarde die deze systemen kunnen hebben voor zowel de lokale gemeenschappen als het hele energiesysteem. De waarde van ICESs wordt ook beïnvloed door de institutionele kenmerken binnen en buiten het systeem. Met deze achtergrond beoogt dit proefschrift te begrijpen op welke manieren de ICESs kunnen bijdragen aan de verbetering van de energietransitie. Dit proefschrift maakt gebruik van een conceptueel raamwerk bestaande uit institutionele en maatschappelijke niveaus om de interactie en dynamiek van de implementatie van de ICES te begrijpen. De huidige energietrends en de bijbehorende technologische, sociaal-economische, milieu- en institutionele problemen worden beoordeeld. Het ontwikkelde ICES-model voert optimale planning en gebruik van ICESs uit en beoordeelt hun prestaties op basis van economische en milieu-indicatoren. Voor de beschouwde gemeenschapsgrootte en lokale omstandigheden zijn  op het net aangesloten ICESs al voordelig ten opzichte van het alternatief waarbij uitsluitend vanuit het net wordt geleverd, zowel wat betreft de totale energiekosten als de CO2-uitstoot, terwijl de grid-defected systemen, hoewel heel goed presterend in termen van CO2-emissiereductie, nog steeds vrij duur zijn. ICESs zorgen voor zelfvoorziening van energie en kunnen essentiële systeemdiensten leveren aan het grotere energiesysteem. Dit proefschrift heeft de toegevoegde waarde van ICESs voor de individuele huishoudens, lokale gemeenschappen en de samenleving aangetoond. Il est très commun d’entendre dans les discussions sur l’urbanisme que la participation du public est nécessaire, mais la manière de faire participer reste encore sujette à énormément d’expérimentation et d’incertitudes. Cette étude s’intéresse au design institutionnel des processus de participation en urbanisme, sous l’angle de leurs effets de démocratisation. L’étude cherchera à identifier les aspects déterminants des processus de participation en urbanisme afin d’offrir, à ceux qui les conçoivent, un éclairage sur les implications des choix qu’ils effectuent. L’analyse se construira à partir de l’étude du fonctionnement concret d’une opération de planification concertée à Porto Alegre, dans le secteur Lomba do Pinheiro. Elle s’appuiera sur un découpage des modalités du processus élaboré à partir d’une revue des ouvrages techniques sur la participation en aménagement. Après avoir décrit la culture de la participation et de planification propre à Porto Alegre et comment celle-ci s’est construite, l’analyse décrira, à partir d’observations sur l’évolution du processus et de ses résultats, les effets du processus en termes d’impact sur l’espace bâti, de transformation des relations sociales et de possibilité de faire apparaître des conflits. Les conclusions feront voir l’importance des modalités plus informelles du travail des organisateurs, de même que la nécessité de mettre le projet au centre du processus afin d’établir un terrain commun. Le rôle crucial de la sélection des participants sera souligné. De fortes réserves seront exprimées quant à la pertinence de la transformation des relations sociales comme objectif pour les processus de planification concertée. / It is quite common, when discussing city planning, to call upon the necessity of public participation. However, the means by which the public participates are still mainly left to experimentation and uncertainty. This dissertation questions the institutional design of participation processes in city planning, from the angle of their democratization effects. It will tempt to identify determining aspects of public participation processes in city planning in order to offer, to those who design them, keys to understanding the implications of their choices. The analysis will be based on the study of the day-to-day operations of a collaborative planning process in the Lomba do Pinheiro district of Porto Alegre. It will use a sectioning of process components built from a review of technical books on participation in design Having depicted Porto Alegre’s specific participation and planning culture and how it was constructed, the analysis will, by observing the evolution of the process and its result, describe the process’ effects in terms of impacts on the built environment, on the transformation of social relations, and on the possibility of making conflicts apparent. Conclusions will reveal the significance of informal aspects in the work of facilitators as well as the necessity to put the project at the center of the process in order to establish a common ground. The crucial role placed by the selection of participants will be outlined. The institutional choices of politicians : how and why legislators shape Lower Chambers

Cette thèse s’intéresse aux choix institutionnels des législateurs. Elle propose une analyse diachronique et comparative du développement des Chambre Nationale des Députés argentines et chiliennes des années 1940 aux années 2000. Inspiré de la théorie du Cartel (Cox et McCubbins, 1993), ce travail se concentre sur le rôle des partis politiques dans ce développement institutionnel. Il montre qu’en dépit de leurs différences, les partis uniques, coalitions, forces majoritaires ou minoritaires qui ont dirigé ces chambres ont adopté un large éventail de règles et de normes organisationnelles qui les avantagent. Ils se sont, en un mot, comportés comme des coalitions procédurales. L’analyse des modifications des règles de fonctionnement de ces chambres et de leurs systèmes de direction et de commissions montre que les partis et coalitions au pouvoir ont, pendant cette période, renforcé leur pouvoir, contrôlé l’agenda législatif, structuré les systèmes de commission et adopté des règles qui leur ont profité. Les résultats obtenus suggèrent en particulier que les coalitions qui ont dirigé la chambre Chilienne ont installé certains de leurs membres à plusieurs postes comme les présidences d’assemblée et de commissions. Ils montrent l’existence d’un pouvoir de véto sur l’agenda législative plus importante au Chili qu’en Argentine. L’étude du cas argentin montre que les partis au pouvoir ont, en particulier depuis les années 1960, conservé le contrôle de la chambre, non seulement en modifiant les règles et les structures du système de commissions, mais également en créant et distribuant à l’opposition des postes permanents mais sans réel pouvoir. Cette analyse confirme également les résultats obtenus par de récentes études concernant ce champ de recherche, notamment le professionnalisme du système de commission chilien et le caractère amateur des législateurs argentins. A l’inverse, elle met à jour des différences, négligées jusqu’alors, entre l’Argentine et le Chili concernant le contrôle de l’agenda législatif. Cette thèse est divisée en sept chapitres. Le premier introduit le sujet, l’hypothèse générale et les questions posées par la thèse, en expliquant également pourquoi les choix institutionnels des législateurs importent. Le chapitre II présente la théorie et la méthodologie. Il propose une définition du développement institutionnel et explicite les prédictions et critères permettant de tester l’hypothèse générale. Les chapitre III et IV, qui concernent respectivement l’Argentine et le Chili, décrivent le système politique de chaque pays et l’organisation des chambres durant la période étudiée. Les chapitre IV et VI, respectivement pour l’Argentine et le Chili, analysent les réformes des règles régissant les chambres, l’évolution de l’autorité qui les dirige et celle du système de commission. Ces chapitres se concluent par un résumé des différents schémas mis en évidence et une évaluation préliminaire de l’hypothèse générale. En conclusion, le chapitre VII résume les découvertes, donne un verdict global sur la fécondité de la théorie et suggère de nouvelles pistes de recherche. / This thesis is about the institutional choices of legislators. It provides a comparative and diachronic analysis of the institutional development of the National Chambers of Deputies of Argentina and Chile from the 1940s to the 2000s. Based on Cartel Theory (Cox and McCubbins 1993), it focuses on the role played by parties in this institutional development. It demonstrates that despite their differences, the various majorities and pluralities, single-parties and coalitions that ruled these Chambers have maintained and adopted a constellation of organizational rules and norms that advantaged their interests. In other words, they have behaved as procedural coalitions. The analysis of the reforms to the rules of these Chambers and of their directing board and committee systems indicates that ruling parties and coalitions have increased their power during the period, controlled the legislative agenda, structured the committee system, and adopted rules that benefit them on the floor. In particular, the results suggest that Chilean ruling coalitions have endowed several offices, such as the Presidency, the Chairs of committees, the committee on Finance (Hacienda) and on Rules, with negative agenda-setting power, and that some of them are more powerful than their Argentine’s counterparts. In the case of the Argentine Chamber, specifically since the 1960s, ruling parties have kept control of the Chamber not only by reforming the rules and structuring the committee system but also creating and distributing powerless but permanent positions to the opposition. The analysis also confirms previous findings made by recent studies in the subfield, specially the professionalism of the Chilean Committee system and the amateur character of Argentine legislators. By contrast, it shows differences in the agenda control between the Argentine and Chilean Chambers that were overlooked. The thesis is divided into seven chapters. Chapter I introduces the general hypothesis, the purposes and main questions of the thesis, and explains why the institutional choices of legislators matter. Chapter II presents the theory and the methodology. It provides the definition of institutional development and the criteria and predictions used to test the general hypothesis. Chapters III (Argentina) and V (Chile) offer an account of each country’s politics and a description of the Chambers’ organization during the period. Chapters IV (Argentina) and VI (Chile) analyze the reforms to the rules of the Chambers, and the evolution of the directing board and committee systems and conclude with a summary of the patterns found and a preliminary assessment of the general hypothesis. Chapter VII concludes. It sums up the findings, provides a final assessment of the theory, and suggests further avenues of research.

La combinaison de réglementation et de responsabilité civile environnementale : manifestations et efficacité dans le droit français

A l'origine de l'étude se trouve un paradoxe ; alors que l'analyse économique met en avant la nécessité de réglementer les activités dangereuses pour l'environnement et les hommes, on voit émerger dans la plupart des pays développés des systèmes hybrides, de plus en plus complexes, mêlant réglementation et responsabilité civile pour traiter ces problématiques. Pour expliquer ce décalage entre théorie économique et évolution juridique, la première partie de la thèse revient sur les fondements de l'économie de l'environnement et propose une approche opérationnelle qui permet de déterminer l'efficacité de chaque institution – propriété, responsabilité et réglementation – selon les caractéristiques des situations et des risques envisagés. Ce faisant, elle aboutit à la conclusion que seul un système combinant les institutions de la responsabilité civile et de la réglementation publique des activités risquées est à même de promouvoir le développement tout en maîtrisant ses dangers. Confrontant cette théorie nouvelle au cas français, la thèse met en évidence les interactions des deux acteurs clés du système, le juge et le régulateur, et observe l'influence positive et réciproque de l'un sur l'autre. A l'aide d'une base de données unique regroupant l'ensemble des litiges environnementaux traités devant la Cour de Cassation et le Conseil d'Etat au cours des soixante dernières années, la seconde partie éclaircit les rôles de chaque institution et démontre que loin d'être paradoxal, le système français a évolué spontanément vers davantage de cohérence et d'efficacité grâce à l'information diffusée par les tribunaux. / Most developed countries use a mix of public regulation and civil liability to cope with environmental risks and damages. Though, a vast majority of economic scholars tend to favour a regime of pure regulation in the domain of environmental accidents, arguing that liability cannot provide incentives for polluters and potential injurers to take socially desirable care. Our dissertation aims to answer this paradox between legal reality and economic theory. In the first part of our study, we develop an operational approach of the concept of externality based on the concrete characteristics that represent an impediment to individual cooperation and thus to the application of property rights. This method allows us to compare the efficiency of public regulation and civil liability and to reach a clear-cut conclusion: in the most complex situations, neither regulation nor liability is able to encourage socially desirable care and to ensure complete compensation for victims at the same time. In these situations, joint use of both legal instruments might be superior to regulation or liability alone because it enables each instrument to overcome the inefficiencies of the other, through interactions and informational transfers occurring between judges and regulators. In the second part, we test our theory in the French case. To observe the existence of institutional interactions between judges and regulators, we create a unique dataset gathering the whole litigations on environmental accidents from cases adjudicated by the Court of Cassation since 1956. Our econometric results show that joint use of regulation and liability emerged to promote economic efficiency of the legal system.
