The study used a qualitative approach which involved key informant interviews and focus group discussions. The selected institutions were Makerere University Kampala (MUK)and Mbarara University of Science and Technology (MUST). The findings show that MUST have a comprehensive HIV/AIDS Institutional Policy (HIP) which followed several stages during policy development. The basic stages identified were policy formulation, policy adoption, policy implementation and policy evaluation. The findings also show that MUST have a comprehensive implementation plan. In contrast, MUK had no record of the HIV/AIDS institutional policy development process. Coming from the assumption that Social Protection Polices, institutionally practiced, are not sufficient to support the vulnerabilities presented by the students of IFSul/campus Pelotas, which represents, majorly, the reality of adolescents in Brazil. Different sources, such as the UNICEF/2011 report about the situation of adolescents in Brazil, reveal that the privation of fundamental rights to the adolescents generates impacts in their scholar development. Recent statements, which are registered in specific legislation about Social Protection to adolescents, relate the mentioned privations to the lack of scholar success, demonstrated in the forms or repetition and evasion, and consequently broadening the social exclusion. In this sense, two main objectives leaded the production of this research: the first objective was to identify the Social Protection Practices directed to the adolescent students of IFSul/campus Pelotas concerning the scope and the ways of making them work; the second was the will of getting to know the conditions that promoted and/or restricted the action of the Social Protection practices directed to the students inside the institutional environment. During the research process, the aim was to understand the relation between the guiding principles of the National Policy for Student Assistance and the Social Protection practices offered by the IFSul/campus Pelotas, a legal and autarchic institution attached to the Ministry of Education. The research was characterized by a qualitative approach. To the gathering of the necessary data, three procedures were used: documental analysis; semi structured interview, with the professionals of different Coordinations and Boards; specific groups of adolescents which are students of the Eletrotechnical Course, some that received the support of Student Assistance and some that did not receive the benefits and also representatives of the Students Union. To perform the analysis and interpretation of the data, based on the contents analysis, four categories were organized, created from the convergence of ideas found among the student s and professional s testimonials. The following aspect were highlighted to express the findings of the research: a) the concept of Social Protection, that was constructed by the subjects of the research, is still focused on the compulsory assistance to the adolescents that can not support themselves due to their social and economical vulnerability, for this reason being considered a citizen s right; b) the Social Protection practices that are offered by the IFSul/campus Pelotas, in order to care for these vulnerabilities, are not sufficient to correspond the students reality, therefore, these practices do not have a universal aspect on the school s environment; c) it is assumed that there is a strict relation between the necessities expressed by the adolescents and the evasion phenomenon, as it is with the repetition found in the IFSul/campus Pelotas; d) the Social Protection process directed to adolescents in the referred institution, presents both restrictive and favorable conditions to its realization, being the restrictive conditions the indicators to the need of remodeling, broadening and qualification of the Social Protection policies / Este trabalho resultou de um estudo de caso realizado no Instituto Federal de Educação, Ciência e Tecnologia Sul-rio-grandense IFSul/campus Pelotas que procurou conhecer como se processam as práticas de Proteção Social aos alunos adolescentes promovidas por essa Instituição Educacional. Partiu-se do suposto de que as Políticas de Proteção Social, praticadas institucionalmente, são insuficientes para atender às vulnerabilidades apresentadas pelo alunado do IFSul/campus Pelotas, que representa, em grande parte, a realidade da adolescência no Brasil. Fontes diversas, como o Relatório sobre a Situação da Adolescência Brasileira/UNICEF/2011, revelam que a privação dos direitos fundamentais ao adolescente tem impacto em seu desempenho escolar. Posicionamentos recentes, inclusive presentes na legislação específica sobre Proteção Social ao adolescente, relacionam tais privações ao insucesso escolar, evidenciado nas formas de repetência e evasão, e, consequentemente, ampliando a exclusão social. Nesse sentido, dois objetivos orientaram a realização da pesquisa: o primeiro foi o de identificar as práticas de Proteção Social direcionadas aos alunos adolescentes do IFSul/campus Pelotas quanto à abrangência e às formas de operacionalização; o segundo objetivo intentou conhecer as condições promotoras e/ou restritivas das práticas institucionais de Proteção Social orientadas a esses alunos. No processo de pesquisa, procurou-se conhecer a relação entre os princípios orientadores da Política Nacional de Assistência Estudantil e das práticas de Proteção Social viabilizadas no IFSul/campus Pelotas, instituição com natureza jurídica de autarquia, vinculada ao Ministério da Educação. A pesquisa caracterizou-se como de abordagem qualitativa. Para a coleta de dados, foram utilizados três procedimentos: a análise documental; a entrevista semiestruturada, realizada com profissionais de diferentes Coordenadorias e Diretorias; grupos focais, envolvendo alunos adolescentes do Curso de Eletrotécnica, beneficiados e não beneficiados pela Assistência Estudantil, assim como representantes do Grêmio de Estudantes. Para a análise e interpretação dos dados, com base na análise de conteúdo, foram organizadas quatro categorias, a partir de ideias convergentes encontradas nos depoimentos de profissionais e estudantes e identificadas nos documentos analisados. Ressaltam-se, como principais achados da investigação: a) a concepção de Proteção Social, construída pelos sujeitos da pesquisa, ainda se encontra fortemente focada na ideia de obrigatoriedade de assistência àqueles adolescentes que não têm condições de se auto-sustentarem, por razões de pobreza/vulnerabilidades socioeconômicas, sendo considerada como um direito de cidadania; b) as práticas de Proteção Social, implementadas pelo IFSul/campus Pelotas, de modo a atender a essas vulnerabilidades, são insuficientes à realidade dos alunos adolescentes, não se caracterizando como universais no âmbito escolar; c) pressupõe-se que exista estreita relação entre as necessidades evidenciadas pelos adolescentes e o fenômeno da evasão e da repetência verificado no IFSul/campus Pelotas; d) o processo de Proteção Social ao adolescente na Instituição pesquisada apresenta, tanto condições favoráveis como restritivas à sua implementação, sendo que as condições limitadoras levam ao reconhecimento de que as práticas de Proteção Social precisam ser redimensionadas, ampliadas e qualificadas

We base this research in the Marxist theory, including Michael Löwy contribuition, in relation to totalitary category. We aim at learning, in a sequential proximity process, the object movement, its afinity proceeding. The studies made from social assistant practices, in the constitution of this afinity relation, took us, therefore, to a complex dynamic, proper from the social net constitution, resulted from strengh and facing different and distinct realities that make a unit in diversity, a dynamic totality changing. We, therefore conclude, that afinity between the Social Assistant Institutional Policy and PNAS express a dynamic movement in changing in which the way we estabilish the interactions are determined and determine the afinity constitution / Esta dissertação aborda a relação de afinidades existentes entre os princípios e diretrizes da Política Nacional de Assistência Social (PNAS) e a Política Institucional de Assistência Social da Província Marista do Brasil Centro-SUL, a partir do estudo da prática profissional dos assistentes sociais das unidades sociais do setor de assistência, ancorado no resultado da análise dos dados coletados em entrevistas semi-estruturadas e estudo documental e bibliográfico. Fundamentamos esta pesquisa na teoria marxiana, valendo-nos da contribuição de Michael Löwy, no que se refere à categoria da totalidade. Buscamos apreender, em um processo de aproximações sucessivas, o movimento do objeto; sua processualidade na constituição dessas afinidades. O estudo feito a partir da prática dos profissionais assistentes sociais, na constituição dessa relação de afinidades, remeteu-nos, portanto, à complexa dinâmica, própria da constituição da teia social, resultante do jogo de forças e embates entre diversas e distintas realidades, que constituem uma unidade na diversidade, uma totalidade dinâmica em constante transformação. Concluímos que a afinidade entre a Política Institucional de Assistência Social e a PNAS expressa o movimento dinâmico de transformações, no qual o modo como se estabelecem as interações são determinados e determinam a constituição dessas afinidades

It also seeks to understand how the relationship is set between the formalization of an institutional policy such as the General Plan of Action and the constitutional principle of the functional independence of the Public Prosecutor's Office. / Esta dissertação tem como objeto empírico o Plano Geral de Atuação do Ministério Público do Estado de São Paulo, instrumento por meio do qual são fixadas as metas prioritárias anuais que promotores e procuradores devem levar em conta no desempenho de suas funções. A ocorrência desta violência pode implicar, em alguns casos, no afastamento da vítima da convivência familiar e comunitária, através da aplicação de medidas jurídicas de proteção a vítima, passando esta a viver em abrigo institucional. Mas, paradoxalmente, o que era para ser excepcional e transitório, tem-se configurado como a modalidade mais utilizada pela sociedade brasileira, e o tempo de permanência nos abrigos tende a ser longo. Assim, esta pesquisa tem como objetivo geral analisar o processo de institucionalização e desinstitucionalização através da perspectiva das adolescentes vítimas de abuso sexual. Buscou-se conhecer o “mundo” social, o cotidiano e os vínculos afetivos e sociais das adolescentes ingressas, e as representações sociais que as egressas (re)constroem no momento da saída do abrigo após (longos) anos de institucionalização, sinalizando para os desafios encontrados na vida de egressa. Para dar conta dessa dimensão privilegiamos uma metodologia de pesquisa qualitativa e de caráter exploratório. A Instituição estudada foi a ONG Lar Flor de Lis, Salvador/BA, que ampara cerca de 120 crianças e adolescente, do gênero masculino e feminino. A maioria dos abrigados é composta de afrodescendentes, possui baixa escolaridade, são oriundos de bairros periféricos de Salvador, Região Metropolitana e municípios do interior do Estado da Bahia. O recorte empírico privilegiou cinco adolescentes do gênero feminino, vítimas de abuso sexual. Verificou-se que as representações sociais sobre o abrigo são experienciadas de forma ambígua, sendo este entendido como um espaço de apoio, proteção, quanto de aprisionamento. Em relação a sua vivência na instituição, observou-se que o abrigamento tende a ser visto pelas adolescentes como uma dupla punição, sentem-se injustiçadas pelo afastamento da convivência familiar e comunitária, e pela impunidade do agressor. Uma questão apontada nos casos de abuso sexual verificada nessa pesquisa é que há uma tendência para uma idealização cristalizada de um tipo imaginário de família feliz, normal, dissimulando dessa forma, a realidade socioafetiva familiar vivenciada por essas, e a negação das relações de violência e “proteção social”.The shelter of children and adolescents is one of the forms of institutional care foreseen in the Child and Adolescent Statute (ECA), Law 8.069/90 (updated by Law 12,010 of 2009) as a measure of exceptional and temporary protection in cases of threat or violation of rights of children and adolescents, including sexual abuse cases against children and adolescents. The occurrence of this violence can lead, in some cases, to the removal of the victim from his/her family and community, through the application of legal measures to protect the victim that then begins to live in an institutional shelter. But, paradoxically, the measure of protection that is supposed to be exceptional and temporary, has been configured as the modality of protection used most often by Brazilian society, and the length of stay in the shelters tends to be long. Thus, this research aims to analyze the process of institutionalization and deinstitutionalization through the perspective of adolescents victims of sexual abuse. We sought to understand the social "world", the everyday life and the social and emotional bonds of intern teenagers, and the social representations that those who leave (re) build on leaving the shelter after (long) years of institutionalization, signaling to challenges encountered in the after-shelter life. To understand this dimension we favor a qualitative exploratory research methodology. The institution studied was the NGO Lar Flor de Lis, Salvador / BA, which shelters about 120 children and adolescents, male and female. Most sheltered children and adolescents are Afro-Brazilian, have low education, and are from the outskirts of Salvador metropolitan area and municipalities of the state of Bahia. The empirical cut favored five teenage female victims of sexual abuse. It was found that social representations about the shelter are experienced ambiguously, being perceived as a place of support, protection, but also of imprisonment. Regarding their experience at the institution, it was observed that the shelter tends to be seen by teenagers as a double punishment, they feel wronged by the separation from the family and community, and by the impunity of the perpetrator. It can be noticed in the sexual abuse cases analyzed in this research that there is a tendency toward idealizing a happy, normal, family, thus disguising the reality of the socio-affective family experienced by these, and the denial of the relations of violence and "social protection.

FundaÃÃo de Amparo à Pesquisa do Estado do Cearà / A temÃtica desta tese refere-se à importÃncia da formaÃÃo docente para a educaÃÃo superior diante dos desafios postos pela sociedade da informaÃÃo e do conhecimento à profissionalizaÃÃo efetivada nesse nÃvel de ensino, mais especificamente à aÃÃo do professor no cotidiano da sua profissÃo. A Universidade Federal do Cearà â UFC foi escolhida para a realizaÃÃo da pesquisa de campo pelo fato de representar, historicamente, a principal instituiÃÃo formadora de profissionais atuantes na docÃncia da educaÃÃo superior do CearÃ. Primeira universidade a ser criada no Estado, continua sendo um dos maiores referenciais para as demais InstituiÃÃes de EducaÃÃo Superior - IES pela importÃncia dos debates que promove, das parcerias que estabelece e da significativa contribuiÃÃo de formaÃÃo profissional para o mundo do trabalho. O estudo desenvolveu-se mediante uma pesquisa qualitativa, do tipo estudo de caso, utilizando entrevistas semiestruturadas e anÃlise documental. Os sujeitos da pesquisa estÃo representados por 43 gestores, atuantes no perÃodo de 1997 a 2006 â reitores, prÃ-reitores, diretores de centro ou faculdade, chefes de departamentos, coordenadores de cursos, gestores de recursos humanos, representante sindical, ouvidor, dentre outros. As categorias Ingresso, AvaliaÃÃo e FormaÃÃo foram definidas para orientar as prioridades pertinentes à pesquisa de campo, em especial. As informaÃÃes e reflexÃes decorrentes sinalizam a necessidade de implementar uma polÃtica institucional de formaÃÃo docente para os professores da Universidade, concebida no Ãmbito de referenciais de desenvolvimento profissional. Para que se efetive, à imprescindÃvel estabelecer rupturas para o enfrentamento dos problemas evidenciados e assumir posturas inovadoras diante das possibilidades explicitadas. / The thematic of this thesis concerns to the importance of the teaching formation for the superior education face to the challenge disposed by the society of information and knowledge to the accomplished professionalization on this teaching level. The Federal University of Cearà â UFC was chosen for the achievement of this field research as it historically represents the main former institution of active professionals in the teaching of superior education in CearÃ. It was the first university created in the State and continues being one of the greatest referential for the others Superior Teaching Institutions by the importance of its debates, partnerships established and the meaningful contribution in the professional formation for the world of the work. This study was developed through a qualitative research, that is a case study using semistructured interviews and documental analysis. The subjects of the research are represented by 43 active managers from the period 1997 to 2006 â rectors, pro-rectors, directors of centers or faculties, chiefs of departments, coordinators of courses, managers of human resources, syndicate representative, auditor among others. The categories of Entrance, Evaluation and Formation were defined to guide the priorities pertaining specially to field research. The information and reflections resultant just show the necessity to implement an institutional policy of teaching formation to the teachers of the University, conceived in the scope of references of professional development. So, to have this effectuated, it is urgent to establish ruptures in order to face the evident problems and assume innovated attitudes in the face of explicit possibilities.

F. A. Hayek's Critique of Legislation

The dissertation concerns F. A. Hayek’s (1899–1992) critique of legislation. The purpose of the investigation is to clarify and assess that critique. I argue that there is in Hayek’s work a critique of legislation that is distinct from his well-known critique of social planning. Further that the main claim of this critique is what I refer to as Hayek’s legislation tenet, namely that legislation that aims to achieve specific aggregate results in complex orders of society will decrease the welfare level.           The legislation tenet gains support; (i) from the welfare claim – according to which there is a positive correlation between the utilization of knowledge and the welfare level in society; (ii) from the dispersal of knowledge thesis – according to which the total knowledge of society is dispersed and not available to any one agency; and (iii) from the cultural evolution thesis – according to which evolutionary rules are more favorable to the utilization of knowledge in social cooperation than are legislative rules. More specifically, I argue that these form two lines of argument in support of the legislation tenet. One line of argument is based on the conjunction of the welfare claim and the dispersal of knowledge thesis. I argue that this line of argument is true. The other line of argument is based on the conjunction of the welfare claim and the cultural evolution thesis. I argue that this line of argument is false, mainly because the empirical work of political scientist Elinor Ostrom refutes it. Because the two lines of argument support the legislation tenet independently of each other, I argue that Hayek’s critique of legislation is true. In this dissertation, I further develop a legislative policy tool as based on the welfare claim and Hayek’s conception of coercion. I also consider Hayek’s idea that rules and law are instrumental in forging rational individual action and rational social orders, and turn to review this idea in light of the work of experimental economist Vernon Smith and economic historian Avner Greif. I find that Smith and Greif support this idea of Hayek’s, and I conjecture that it contributes to our understanding of Adam Smith’s notion of the invisible hand: It is rules – not an invisible hand – that prompt subjects to align individual and aggregate rationality in social interaction. Finally, I argue that Hayek’s critique is essentially utilitarian, as it is concerned with the negative welfare consequences of certain forms of legislation. And although it may appear that the dispersal of knowledge thesis will undermine the possibility of carrying out the utilitarian calculus, due to the lack of knowledge of the consequences of one’s actions – and therefore undermine the legislation tenet itself – I argue that the distinction between utilitarianism conceived as a method of deliberation and utilitarianism conceived as a criterion of correctness may be used to save Hayek’s critique from this objection.

The Federal University of Ceará – UFC was chosen for the achievement of this field research as it historically represents the main former institution of active professionals in the teaching of superior education in Ceará. It was the first university created in the State and continues being one of the greatest referential for the others Superior Teaching Institutions by the importance of its debates, partnerships established and the meaningful contribution in the professional formation for the world of the work. This study was developed through a qualitative research, that is a case study using semistructured interviews and documental analysis. The subjects of the research are represented by 43 active managers from the period 1997 to 2006 – rectors, pro-rectors, directors of centers or faculties, chiefs of departments, coordinators of courses, managers of human resources, syndicate representative, auditor among others. The categories of Entrance, Evaluation and Formation were defined to guide the priorities pertaining specially to field research. The information and reflections resultant just show the necessity to implement an institutional policy of teaching formation to the teachers of the University, conceived in the scope of references of professional development. So, to have this effectuated, it is urgent to establish ruptures in order to face the evident problems and assume innovated attitudes in the face of explicit possibilities / A temática desta tese refere-se à importância da formação docente para a educação superior diante dos desafios postos pela sociedade da informação e do conhecimento à profissionalização efetivada nesse nível de ensino, mais especificamente à ação do professor no cotidiano da sua profissão. A Universidade Federal do Ceará – UFC foi escolhida para a realização da pesquisa de campo pelo fato de representar, historicamente, a principal instituição formadora de profissionais atuantes na docência da educação superior do Ceará. Primeira universidade a ser criada no Estado, continua sendo um dos maiores referenciais para as demais Instituições de Educação Superior - IES pela importância dos debates que promove, das parcerias que estabelece e da significativa contribuição de formação profissional para o mundo do trabalho. O estudo desenvolveu-se mediante uma pesquisa qualitativa, do tipo estudo de caso, utilizando entrevistas semiestruturadas e análise documental. Os sujeitos da pesquisa estão representados por 43 gestores, atuantes no período de 1997 a 2006 – reitores, pró-reitores, diretores de centro ou faculdade, chefes de departamentos, coordenadores de cursos, gestores de recursos humanos, representante sindical, ouvidor, dentre outros. As categorias Ingresso, Avaliação e Formação foram definidas para orientar as prioridades pertinentes à pesquisa de campo, em especial. As informações e reflexões decorrentes sinalizam a necessidade de implementar uma política institucional de formação docente para os professores da Universidade, concebida no âmbito de referenciais de desenvolvimento profissional.
