Causation and foreseeability in private law The issue of this thesis is the causation and foreseeability in private law. The aim of this diploma thesis is to provide comprehensive view of both presented legal institutes and their significance in law. This thesis especially focuses on detailed analysis of procedure of proving the causation and introduces the most significant issues arising from this proceeding. Introduction is aimed at the function and especially at detailed definition of the term causality not only in law, but also in the area of natural sciences. It defines the term foreseeability in the same way. Moreover, it defines conditions that considerably affect foreseeability. Consequently, it aims to provide the relation between foreseeability and causation. This thesis also deals with the significance of causation from the perspective of legal liability. In this context, it mentions the issue of causally relevant conditions. On this basis, this paper tends to its core which consists of detailed analysis of methods of proving the factual causation. Universally accepted method of proving factual causation is considered the 'conditio sine qua non' test. However, this test is found to be ineffective in cases of causal uncertainty. Analisa também a crise econômica, política e institucional que assola o poder público e impede, em âmbito nacional, a adoção de medidas capazes de implementar uma adequada gestão do risco ambiental, vislumbrando, na formação teórica do pool of risks, a partir da teoria criada por Gunther Teubner, abordada na presente dissertação de modo eminentemente descritivo, a possibilidade de ser implementado um eficaz modelo preventivo de gestão. Nesse contexto, são expostos os fundamentos que embasam essa formação teórica, que se pauta na criação de conglomerados de empreendedores cujas atividades se mostrem capazes de gerar danos ao meio ambiente, em bases territoriais previamente delimitadas, com especial enfoque à individualização das áreas ecológicas de risco e à possibilidade de responsabilização solidária desse conglomerado, na hipótese de um dano vir a ser concretizado nos territórios previamente individualizados. Ganha destaque o fato de que, no pool of risks, a responsabilização solidária ocorre mesmo quando ausente o liame de causalidade entre o dano e o efetivo responsável pela sua concretização, sendo possível, em tais circunstâncias, a penalização de qualquer dos integrantes do pool, concluindo-se pela viabilidade dessa nova sistematização ser recepcionada pelas estruturas jurídicas vigentes, com potencial inovador que ostenta condições de impulsionar relevantes medidas de controle pelo direito pátrio, podendo reduzir a incidência de desastres ambientais em território nacional. / This dissertation comprises the analysis of the characteristics of the postindustrial society, marked by globalization and a visible distance from the legal rules applicable to the actual needs of the contemporary period, based on mass industrialization, technological development and proliferation of risk on a large and complex scale. It also analyzes the economic, political and institutional crisis that destroys public authorities and prevents, at a national level, the adoption of measures capable of implementing an adequate management of the environmental risk, envisaging in the theoretical formation of the pool of risks, from the theory created by Gunther Teubner, addressed in this dissertation in eminently descriptive, the possibility of implementing an effective preventive management model. In this context, the fundamentals underlying this theoretical formation are presented, which are based on the creation of conglomerates of entrepreneurs whose activities are capable of generating environmental damages, in previously delimited territorial bases, with special focus on the individualization of ecological risk areas and on the possibility of joint liability of this conglomerate, in the event of any damage being brought about in previously individualized territories. The fact that in the pool of risks joint liability occurs even when there is no causal relationship between the damage and the actual responsible for its consummation gains prominence, being possible in such circumstances to penalize any of the members of the pool, concluding on the feasibility of this new systematization be received by the legal structures in force, with innovative potential that has the conditions to promote relevant measures of control by the country's law, which may reduce the incidence of disasters in national territory.

Příčinná souvislost v občanském právu / Causal nexus in civil law

The aim of this thesis is to provide an insight into the topic of causation in law and to acquaint its reader with the common methods of proving the causation before courts. Among the most used methods such as the 'but for' test, this paper focuses on specific aspects of this topic which were introduced to the Czech legal system together with the adoption of the Civil Code 2014. The thesis also includes description and analysis of alternatively used methods of proving 'multiple causation' cases such as the theory of 'loss of chance' and 'pure economic loss'. Among this analysis the comparison between Czech and British legal system is used extensively. The core of this thesis is the effort to confirm or to refute the hypothesis that despite the Czech legal system does not officially recognize distinction between 'factual causation' and 'legal causation' as it is done in the British legal system, methods from both categories are actively used by Czech courts. This paper also aims to analyze whether, due to the fact that recognition between 'factual causation' and 'legal causation' is not explicitly expressed in the Czech legal system, does exist any negative or positive impact on judicial decisions. Les conditions de la responsabilité en droit privé : éléments pour une théorie générale de la responsabilité juridique / The conditions of responsibility in private law : elements for a general theory of legal responsibility

Alors que l’on enseigne classiquement la distinction radicale du droit pénal et de la responsabilité civile, une étude approfondie du droit positif révèle une tendance générale et profonde à la confusion des deux disciplines. Face à ce paradoxe, le juriste s’interroge : comment articuler le droit civil et le droit pénal de la responsabilité ? Pour y répondre, cette thèse suggère d’abandonner l’approche traditionnelle de la matière, consistant à la tenir pour une simple catégorie de classement des différentes branches, civile et pénale, du droit de la responsabilité. La responsabilité juridique est présentée comme une institution autonome et générale organisant la réaction du système à la perturbation anormale de l’équilibre social. Quant au droit de la responsabilité civile et au droit criminel, ils ne sont plus conçus que comme les applications techniques de cette institution en droit positif.Sur le fondement de cette approche renouvelée et par le prisme de l’étude des conditions de la responsabilité en droit privé, la thèse propose un ordonnancement technique et rationnel du droit pénal et de la responsabilité civile susceptible de fournir les principes directeurs d’une véritable théorie générale de la responsabilité juridique. En tant qu’institution générale, celle-ci engendre à la fois un concept de responsabilité, composé des exigences de dégradation d’un intérêt juridiquement protégé, d’anormalité et de causalité juridique et qui fonde la convergence du droit pénal et du droit civil, et un système de responsabilité, qui en commande les divergences et pousse le premier vers la protection de l’intérêt général et le second vers celle des victimes. / While the radical distinction between criminal law and civil liability is classically taught, a thorough survey of positive law reveals a general and profound trend towards a confusion of these two disciplines. Faced with this paradox, the jurist wonders : how to articulate the civil and criminal laws of responsibility ? To answer this question, the thesis suggests abandoning the traditional approach of the subject, which consists in treating it as a mere category of classification of the different branches, civil and criminal, of responsibility/liability. Legal responsibility is presented as an autonomous and general institution organizing the response from the system to abnormal disturbance of social equilibrium. Civil liability law and criminal law are, as far as they are concerned, henceforth conceived as the mere technical applications of this institution in positive law.On the basis of this new approach and through the prism of the study of liability conditions in private law, the thesis proposes a technical and rational organization of criminal law and civil liability that may provide the guiding principles of a real general theory of legal responsibility. As a general institution, it gives not only a concept of responsibility, requiring degradation of a legally protected interest, abnormality and legal causation, and establishing the convergence of criminal law and civil law, but also a system of responsibility, determining the divergences of them and steering the first towards the protection of general interest and the second towards the protection of victims.
