Studies indicate that most of these events are preventable. Objective: to characterize the deaths due to external causes, according to sociodemographic variables, the type of death, the immediate cause that led to death. Method: descriptive epidemiological study on the characteristics of external causes of death in children and adolescents, submitted to necropsy in the Medicolegal Institute of Feira de Santana-Ba, from January 1, 2013 to December 31, 2015. Results: from 2013 -1015, 466 children and adolescents were killed, due to external causes and examined in the Santana-Bahia Feira IML, 86.3 %% belonged to the male sex; 86.3% were adolescents; 82% were brown; Homicide was the leading cause of death, with 61.6%, followed by traffic accidents, with 23.9% of cases; Being the public place the most frequent occurrence of the cases, with 65.2%; Of all deaths, 60.3% were caused by firearms; With traumatic brain injury being the most frequent among the immediate causes of death, with 33.5%. Conclusion: In Feira de Santana, the profiles found of these victims are young, male, brown and black, with the main type of death, homicide, followed by traffic accidents, such corroborate several studies in this area. The study points the magnitude of external causes as a social problem. In this way, it is necessary to work on the prevention of these causes, in order to reduce early deaths, as well as the economic impact of society's expenditures, besides avoiding emotional and psychological consequences for the families of these young people. / Introdu??o: os ?bitos por causas externas est?o entre as principais causas de mortalidade em crian?as e adolescentes. Estudos apontam que a maior parte desses eventos s?o evit?veis. Objetivo: caracterizar os ?bitos por causas externas, segundo vari?veis sociodemogr?ficas, o tipo de morte e causa imediata que levou a morte. M?todo: estudo epidemiol?gico descritivo sobre caracter?sticas dos ?bitos por causas externas em crian?as e adolescentes, submetidas a necropsia no IML de Feira de Santana-Ba, no per?odo de 01 de janeiro de 2013 a 31 de dezembro de 2015. Resultados: no per?odo de 2013-2015, foram necropsiados 466 crian?as e adolescentes, v?timas de mortes por causas externas no IML de Feira de Santana-Bahia, 86,3% pertenciam ao sexo masculino; 86,3% eram adolescentes; 82% eram pardos. O homic?dio foi a principal causa de morte, com 61,6%, seguido de acidentes de tr?nsito, com 23,9% casos; sendo a via p?blica o local de maior ocorr?ncia dos casos, com 65,2%; entre todos os tipos de mortes, 60,3% foram causadas por arma de fogo; sendo o traumatismo cr?nio encef?lico a causa imediata mais frequente, com 33,5%. Conclus?o: Em Feira de Santana, os perfis encontrados dessas v?timas s?o jovens, do sexo masculino, pardos e negros, tendo como principal tipo de morte, o homic?dio, seguido de acidentes de tr?nsito, dados que corroboram diversos estudos nesta ?rea. O estudo aponta a magnitude das causas externas como problema social. Dessa forma, observa-se a necessidade de trabalhar a preven??o dessas causas, a fim de reduzir mortes precoces, bem como minimizar o impacto econ?mico desses fatores nos gastos da sociedade, al?m de precaver poss?veis sequelas emocionais e psicol?gicas para as fam?lias desses jovens.

Le fondement de la responsabilité du transporteur / The ground for the carrier’s liability

Le transporteur est tenu d’une obligation de résultat, dont l’inexécution engage automatiquement sa responsabilité, dès lors qu’il en découle un préjudice. Mais il peut se libérer de sa responsabilité en prouvant l’existence d’une cause d’exonération. Considérée comme un obstacle à l’indemnisation, l’exonération sera appréciée avec plus ou moins de méfiance, selon le mode employé et l’objet transporté. A cet égard, il convient de distinguer le transport de passagers et le transport de marchandises. La prise en compte croissante du besoin de protection du passager fait évoluer le régime auquel est soumis le transporteur. L’analyse de cette évolution est indispensable à la recherche d’un fondement commun à la responsabilité du transporteur. Considéré comme une victime, le passager devient le pivot du régime applicable au transporteur, lequel cesse d’être un régime de responsabilité. Au contraire, lorsque la responsabilité demeure, la défense exonératoire révèle le fondement rationnel de la responsabilité du transporteur : sa faute. / The carrier is under an obligation of result, the nonfulfilment of which he /she will be automatically held liable for, as soons as damage arises. Yet he can escape liablitiy if he can prove the existence of a ground for exemption. Considered as an impediment to compensation, the exemption will be assessed with more or less suspicion, depending on the transport mode and the cargo. In this respect, there should be a distinction made between the transport of passengers and goods. As the passenger’s need for protection is more and more taken into account, this causes the regime governing carriers to evolve. Analyzing these developments is essential to look for a common ground for the carrier’s liability. Considered as a victim, the passenger becomes the pivot of the regime applicable to the carrier, this regime being no longer a system of liablity. On the contrary, when liability remains, the defense based on exemption reveals the rationale behind the carrier’s liability: his fault.

Les conditions de la responsabilité en droit privé : éléments pour une théorie générale de la responsabilité juridique / The conditions of responsibility in private law : elements for a general theory of legal responsibility

Alors que l’on enseigne classiquement la distinction radicale du droit pénal et de la responsabilité civile, une étude approfondie du droit positif révèle une tendance générale et profonde à la confusion des deux disciplines. Face à ce paradoxe, le juriste s’interroge : comment articuler le droit civil et le droit pénal de la responsabilité ? Pour y répondre, cette thèse suggère d’abandonner l’approche traditionnelle de la matière, consistant à la tenir pour une simple catégorie de classement des différentes branches, civile et pénale, du droit de la responsabilité. La responsabilité juridique est présentée comme une institution autonome et générale organisant la réaction du système à la perturbation anormale de l’équilibre social. Quant au droit de la responsabilité civile et au droit criminel, ils ne sont plus conçus que comme les applications techniques de cette institution en droit positif.Sur le fondement de cette approche renouvelée et par le prisme de l’étude des conditions de la responsabilité en droit privé, la thèse propose un ordonnancement technique et rationnel du droit pénal et de la responsabilité civile susceptible de fournir les principes directeurs d’une véritable théorie générale de la responsabilité juridique. En tant qu’institution générale, celle-ci engendre à la fois un concept de responsabilité, composé des exigences de dégradation d’un intérêt juridiquement protégé, d’anormalité et de causalité juridique et qui fonde la convergence du droit pénal et du droit civil, et un système de responsabilité, qui en commande les divergences et pousse le premier vers la protection de l’intérêt général et le second vers celle des victimes. / While the radical distinction between criminal law and civil liability is classically taught, a thorough survey of positive law reveals a general and profound trend towards a confusion of these two disciplines. Faced with this paradox, the jurist wonders : how to articulate the civil and criminal laws of responsibility ? To answer this question, the thesis suggests abandoning the traditional approach of the subject, which consists in treating it as a mere category of classification of the different branches, civil and criminal, of responsibility/liability. Legal responsibility is presented as an autonomous and general institution organizing the response from the system to abnormal disturbance of social equilibrium. Civil liability law and criminal law are, as far as they are concerned, henceforth conceived as the mere technical applications of this institution in positive law.On the basis of this new approach and through the prism of the study of liability conditions in private law, the thesis proposes a technical and rational organization of criminal law and civil liability that may provide the guiding principles of a real general theory of legal responsibility. As a general institution, it gives not only a concept of responsibility, requiring degradation of a legally protected interest, abnormality and legal causation, and establishing the convergence of criminal law and civil law, but also a system of responsibility, determining the divergences of them and steering the first towards the protection of general interest and the second towards the protection of victims.
