A \'crise\' do poder público em Regino de Prüm e Raul Glaber (séculos IX-XI) / Public power crisis in Regino of Prüm and Rodulfus Glaber (IX-XI centuries)

Crise é um dos principais conceitos usados pela historiografia para explicar os acontecimentos ocorridos durante o período de 980 a 1060, chamado de Ano Mil. Após o fim do Império Carolíngio, a crise teria se instalado na Europa, e, entre diversas transformações, teria levado à privatização do poder público e ao domínio de um senhorio que exerceu seu poder a partir da cobrança de taxas, serviços e violência, elementos estes que formaram o paradigma da mutação feudal. O objetivo deste trabalho é analisar duas escritas históricas, a Crônica (Chronicon), escrita entre 900 e 908, por Regino, abade de Prüm, na Lotaríngia; e Os Cinco Livros de Histórias (Historiarum Liber Quinque), do monge Raul Glaber, escritos entre 1016 e 1046, na região da Borgonha. Buscaremos, assim, discutir se as citadas fontes sustentam a ideia de uma crise do poder público no período. / Historiography had used crisis as one of the main to explain the events happened in Europe from 980 to 1060, period called Year 1000. According to those historians, after the end of the Carolingian Empire, the crisis would have been installed in Europe. Among several transformations, it would have led to the privatization of public power and to dominion of \"landlords\", those who exercised his power from the collection of taxes, services and violence, elements that formed the paradigm of \"feudal mutation\". The purpose of this dissertation is to analyse two historical writings, the Chronicle (Chronicon) , written between 900 and 908 by Regino, abbot of Prüm, in Lotharingia; and The Five Books of Histories (Historiarum Liber Quinque), by the monk Rodulfus Glaber, written between 1016 and 1046, in Burgundy. Therefore, we will seek to discuss whether the quoted sources support the idea of a public power crisis during that time.

O objetivo deste trabalho é o de demonstrar que o conjunto dos nove contos de Sagarana apresenta uma unidade de conteúdo. Desenvolvendo as idéias gerais de Luiz Dagobert de Aguirra Roncari expostas em um curso de pós-graduação ministrado na Universidade de São Paulo (USP) no segundo semestre de 2005, foi possível concluir que uma representação do Brasil da Primeira República constitui o significado central da obra. Esta visão possibilita posicionar Guimarães Rosa entre os intelectuais que se ocuparam de um tema candente na primeira metade do século XX, o de analisar o Brasil com a finalidade de corrigi-lo. Adicionalmente, o trabalho pretende mostrar que a determinação desse significado central é indispensável para a compreensão de Sagarana na sua totalidade. / The objective of this work is to demonstrate that the collection of the nine Sagarana tales has a unified content. The book\'s central theme is a representation of Brazil during the First Republic. I reached this conclusion after analyzing Luiz Dagobert de Aguirra Roncari´s general ideas presented at a graduate course at the Universidade de São Paulo (USP) in the second semester of 2005. This conclusion places Guimarães Rosa amongst the intellectuals who dealt with the heated issues of the first half of the twentieth century that were focused on studying Brazil with the objective to improving the country. Additionally, this work intends to show that the awareness of that central theme is indispensable for the total comprehension of Sagarana.

Relations that unite and divide : a study of Freedom of Information legislation and transparency in Scotland

This research (the first long-term ethnographic study of FOI in Britain) investigates concepts at the heart of FOI - transparency, trust, secrecy, truth, private, public, power and agency. Eighteen months participant observation fieldwork, alongside policy-makers, practitioners, and end-users facilitated in depth, study of the radical subject-object transformations that FOI requires, and the aesthetics that underpin it. The introduction of FOI entailed a 'culture change' - from a culture of secrecy to one of disclosure - driven, in Scotland, by the Scottish Information Commissioner through conferences. These were an opportunity for practitioners to come into new knowledge about the Act, their shared knowledge dissolving the divisions between them. But new divisions then opened between practitioners and colleagues; culture change being in the replication of a form of a relationship that previously lay between government and citizens. In their replicated form, individual practitioners disappeared - were made 'transparent' - only to reappear on being differentiated, leaving them acutely aware of the personal relations this fissure disclosed, and throwing into sharp question a theory of people's division as indicative of their 'secrecy'. Transparency, here, depended on whether people were divided or combined - acting in their own capacity, or that of the organization. While making personal relations absent from new disclosures was necessary for FOI compliance, this concealment hid a complex network of relations, and turned knowledge into 'information'. Yet the division between information and knowledge was not crisp: end-users continued to read practitioners' personal relations in disclosed information, thus relations were both absent from and implied in the information released. Whether information was public (and accessible) depended on the undifferentiated status of those who created, handled, or were the subjects of, information. As people came into new knowledge, invoking their divided or common footing, they alternated between appearing 'private' or 'public' - person or thing - a division between individuals reflecting a division within each of them.

Utajený výkon veřejné moci a hodnoty chráněné ústavním pořádkem / The concealed performance of public power and values protected by the constitutional order

The aim of this diploma paper is to analyse and define the nature of secret exercise of public authority and to asses this phenomena in respect of the fundamental principles of the democratic rule of law. Any secrecy in exercising public authority is in fact a clear contradiction to a natural concept of the human rights and fundamental freedoms. Therefore the republic, as a public institution, should not have too many secrets to hide away from the people if its own principles are not to be completely disgraced. Secrecy in exercising public authority is a specific feature often related to the areas such as securing the sovereignity and territorial integrity of the Czech Republic, protecting its democratic foundations, protection of the lives and health of the population as well as the right to own the property. This is in full accordance with the constitutional duty of the state. Limited access to the information has a unique and 84 inevitable role in these areas and it is clearly mentioned in the Charter of Fundamental Rights and Freedoms, the European Convention of Human Rights and Freedoms and the International Covenant on Civil and Political Rights. Sendo possível perceber o desempenho da Igreja Católica, enquanto instituição oficial legítima, de desenvolver métodos de administração para "controlar" este complexo. Ao mesmo tempo em que está aliada aos anseios sociais e políticos dos "leigos" para alcançar apoio necessário. Tomando como base a forma de atuação administrativa de Poder Público, também são traçadas políticas públicas em concordância com as necessidades expostas por praticantes e organizadores das manifestações religiosas em prol do desenvolvimento do município. Supporting up to Tragtenberg, Silva Jr and Huert among other authors who deal specifically, the supervision of teaching, it is making a historical review of the legislation, spreadsheets and data that were collected through depositions and interviews with supervisors, Effective teaching of three Diretorias of Education of Greater Sao Paulo. The result of the research points to the predominance of a profile and bureaucratic oversight in the action of the supervisor of education, as well as implementing public policies and not partícipe their development. The supervisor of education is a representative of a political power that favors a certain order, even if there is an attempt to overrun a unilateral representation in the supervision of education.(AU) / Numa perspectiva sociológica, este trabalho tem o objetivo de identificar o perfil profissional do supervisor de ensino que atua na Secretaria de Estado da Educação de São Paulo, verificando se sua atuação está voltada ao pedagógico ou ao administrativo e qual o compromisso político e as concepções educacionais destes profissionais. ICT in a Public Organisation - A study in Greece

The thesis presents a research in the Public Power Corporation S.A. – PPC in Athens, Greece. The main purpose of this study is to examine the employees of PPC use of the IT (Information Technology) system and whether the system supports, helps and facilitates their work or generate problems to them in their daily work. The IT system that is being used in the PPC is SAP (Systems, Applications and Products) and was implemented about two years ago, in 2015. Therefore, my intention is to explore and analyze the usefulness and efficiency of SAP and detect the advantages as well as the problems of this IS which have impact on the quality of the customer services. Furthermore, the latest years that the financial crisis occurs in Greece the common interest for public firm’s development, became a motive for me to propose and undertake this research due to the fact that these kinds of public companies can contribute to the economy of Greece. For the research, I used the interpretive paradigm. The methodology used is ethnography and the two methods are the interviews and the observation. The research was conducted in different departments of PPC. The participants are the employees, the managers and one Director of PPC. The data collected from the two methods are analyzed by using the Lichtman’s six step of analysis. After the data analysis, the results indicate that there are vital problems in the PPC in relation to the use of the IT system which in some cases are more than the advantages. The users of SAP have expressed their experience in relation to the implementation of the new IT system. They recognize the importance on using such an advanced IT system but on the other hand, they express the limitations and the problems because of the vital problems on PPC.

The meaning of 'Organ of State` in South African law

`Organ of state' as a constitutional concept was first introduced by the 1993 Constitution, in which it was defined as including any statutory body or functionary. In their interpretation of this notion, the courts and academic writers invoked the tests developed at common law in order to determine its meaning. The commentators, on the one hand, used a variety of tests. The courts, on the other hand, subscribed to what has come to be known as the `control test'. The 1996 Constitution followed with a comprehensive definition of `organ of state'. This notion is also employed in other laws by direct reference or incorporation of the definition in section 239 with slight adjustments. Regrettably, the limited approach developed by the court in their interpretation of the notion of `organ of state' for the purposes of the 1993 Constitution has spilled over to the interpretation of the concept under the 1996 Constitution. The question is whether this is justifiable. The constitutional definition of `organ of state' makes it clear that other institutions and functionaries are organs of state on the basis of what they are and others by virtue of the functions they are engaged in. Therefore strict adherence to the control test or any other test could unjustifiably limit the application of the Constitution. / Jurisprudence / LL.M.

The jurisprudence always refers to such theory as an exceptional circumstance, but it is not enough to close the debate regarding the issue. On the contrary, it is important to stress that the exceptional being has nothing to do with being legal. This argument has been only used in lawsuits filed against Public authorities, which demonstrates that, in cases where the public authority is not the defendant, there would be no accomplished fact. This conception indicates clearly that the legal institutions that permeate the debate about accomplished fact have been inserted in the context of liquid modernity , in which the rigid rules of behavior give way to personal desires of each agent. The problem is more serious when the debate involves decisions issued by the Judiciary, once, in a democratic State, such decisions cannot prevail on the Legislative Power s expressions. Concerning the issue subject of this paper, the manifestations of the Legislative Power are clear and fruitful: regulate the summary injunction with depth as well as the juridical fact. If the current jurisprudence has a penchant for removal of these concepts clearly defined in the name of principles, there is no way to note something about the accomplished fact without making a foray brief about the theory of principles discussed in the works of Humberto Avila, Marcelo Neves, Robert Alexy and Ronald Dworkin. If this is essential, so is the definition of what is an accomplished fact, that is and how the natural, physical or social events are held in the legal world without any normative implications (chronological time, the practice of acts during the term the summary trust, good faith in the action of the measure applicant and so forth). After this time, the argument of the accomplished fact has to be compared with the corresponding assumptions and with those established by the jurisprudence itself, in an analytical study to allow, with some confidence, understand what effectively it comes and keeps compatibility with the juridical discourses rationality. Based on the analysis made in this paper, it is allowed a clear conclusion towards the lack of legality of the theory the accomplished fact, which it should not be relied upon in the litigations against the Public authorities for suffering from lack of normative justification and democratic argument. It is an argument of authority, subjective and uncontrollable that, without a critical perspective, can preserve the legal system situations that are remarkably strange / Questionar a juridicidade da teoria do fato consumado é o grande objetivo do presente trabalho. A referência sempre viva na jurisprudência de que se trata de situação excepcionalíssima não basta para fechar a discussão. Muito pelo contrário, o ser excepcional não tem nada a ver com ser jurídico. Esse argumento é utilizado unicamente em demandas contra o Poder Público, demonstrando que, se não fosse ele o demandado, não haveria fato consumado. Isso demonstra com clareza que os institutos jurídicos que permeiam o debate foram inseridos em um contexto de modernidade líquida, em que as rígidas regras de conduta cedem lugar aos desejos pessoais de cada agente. O problema é mais grave, entretanto, quando estão em discussão decisões do Poder Judiciário, que em um Estado Democrático de Direito, em regra, não podem anular as expressões do Poder Legislativo. Na temática, as manifestações do Legislativo são claras e férteis: regulam as tutelas sumárias com profundidade, bem como o fato jurídico. Se a jurisprudência tem se inclinado pelo afastamento desses conceitos tão bem definidos em nome de princípios, não há como constatar algo a respeito do fato consumado sem fazer uma breve incursão na teoria dos princípios, a partir das obras de Humberto Ávila, Marcelo Neves, Robert Alexy e Ronald Dworkin. Se isso é indispensável, também é a definição do que é o fato consumado, em que consiste e como os fatos naturais, físicos ou sociais são mantidos no mundo jurídico sem qualquer incidência normativa (o tempo cronológico, a prática de atos durante a vigência da tutela sumária, a boa-fé na ação do requerente da medida etc). Após esse momento, o argumento do fato consumado precisa ser cotejado com as premissas fixadas e com aquelas estabelecidas pela própria jurisprudência, em um estudo analítico que permita, com alguma segurança, compreender do que efetivamente se trata e se guarda compatibilidade com a racionalidade do discurso jurídico. Feita essa análise, é permitida uma conclusão clara no sentido da carência de juridicidade da teoria do fato consumado, que não deve ser invocada nas lides contra o Poder Público por padecer de falta de justificação normativa e argumentação democrática. É argumento de autoridade, subjetivo e incontrolável que, sem uma perspectiva crítica, pode preservar no sistema jurídico situações que lhe são notavelmente estranhas
