[pt] Diversos processos nos últimos vinte e cinco anos vêm transformando o entendimento das fronteiras e da mobilidade internacional, com um número cada vez maior de pessoas que se deslocam e de fronteiras que se multiplicam para além dos limites territoriais de cada estado. Ao lado desses processos, que alteram a velocidade do movimento, criam novos caminhos para a circulação e oferecem novas formas de vigilância e bloqueio dos indivíduos, a interpretação das fronteiras começa a ser redefinida buscando dar conta desses novos processos, tanto para facilita-los quanto para proibi-los. Seguindo essas transformações no entendimento das fronteiras e com um histórico de constantes inovações nas políticas migratórias, a Austrália em 2013 adotou a Operation Sovereign Borders, uma operação que abarca diversas dessas transformações. A Operation Sovereign Borders criou e institucionalizou novas práticas de controle da imigração, sendo permeada por uma racionalidade específica do medo da invasão e apoiada em extensas e controversas inovações legislativas. O presente trabalho apresenta as diferentes transformações das fronteiras e suas interpretações, explorando para isso o caso australiano, seu campo de controle de imigração e fronteiras, os atores desse campo, sua legislação, racionalidade e práticas. / [en] Different processes in the last twenty-five years have transformed the understanding of borders and international mobility, with an increasing number of people on the move and borders that multiply beyond the territorial limits of the state. Alongside these processes that alter the speed of movement, create new pathways for circulation and offer new forms of surveillance and blocking of individuals, the interpretation of borders is being redefined seeking to account for these new processes, both to facilitate them and to prohibit them. Following these changes in the understanding of borders and with a history of constant innovations in immigration policies, Australia in 2013 adopted the Operation Sovereign Borders, an operation that encompasses several of these transformations in seeking greater control and by using more violence against asylum seekers. The Operation Sovereign Borders created and institutionalized new immigration control practices, being permeated by a specific rationality of the fear of invasion and supported by extensive and controversial legislative innovations. This dissertation presents the transformations of borders and their interpretations, exploring the Australian case, its field of migration and border control, the actors in this field, its legislative structure, its rationality and practices.

This paper aims to analyze the important role of the reception of music in Marcel Proust's novel À la recherche du temps perdu. This analysis is founded on a theoretical framework inspired by critical theory and theory of critical ideology, where important theorists are Theodor W. Adorno, Fredric Jameson, and Slavoj Zizek. By drawing on these theorists, the firsts two analytical parts of this study shows how the reception of music in the novel creates supplements that reinforce hegemonic ideological consciousness, and how the reception of music also has a thematic role in revealing how these different ideological consciousnesses permeate social relations to both music and other people. In the final analytical part of the work, the study can further conclude that the Bildung of the novel, which constitutes the basic thematic structure of the whole novel, is based on breaking away from these two ideological consciousnesses, and freeing the music from the supplements that permeate the reception of the music in the novel, by making a sovereign gesture of liberation by exposing this process, so as to be able to take a critical approach to those ideological consciousnesses whose ideological theatricality prevents music, and in the long run involuntary memory, from mediating a true philosophical discovery of the nature of subjectivity

In today’s centralized identity systems, large companies control and store user datain a centralized manner, which poses a risk to users’ privacy and personal data. Self-sovereign identity (SSI) decentralizes digital identity management and gives individu-als full control over which personal data is shared and with whom. Furthermore, SSIenables verifiable credentials, allowing companies, authorities and individuals to buildnetworks of trust among themselves. This thesis discusses SSI, as well as a project whereSSI is practically applied in a mobile software application project for the distribution ofdigital drink tickets. The goal of the project is to develop a prototype to demonstratehow SSI can be applied in a general application, that involves issuing a verifiable cre-dential in the form of a drink ticket. To realize the project goal, an application has beendeveloped in React Native, where several frameworks for SSI have been studied. ”AriesCloud Agent Python” (ACA-Py) has been integrated with a REST API to provide SSIfunctionality to the project. The project has resulted in a working mobile applicationthat can issue and verify digital drink tickets, stored in the digital wallet application ofthe ticket holder. Minimal personal data is shared with the application, and only withthe exclusive approval of the ticket holder. The result confirms the potential of SSI fordecentralized identity management. / I dagens centraliserade identitetssystem är det stora teknikföretag som lagrar och kon-trollerar användardata, vilket medför en risk för användarnas integritet och personligadata. ”Self-sovereign identity” (SSI) decentraliserar digitala identiteter och ger indivi-den full kontroll över vilka personliga data som delas och till vem. Vidare möjliggörSSI verifierbara legitimationer, där förtroendenätverk byggs mellan företag, myndig-heter och individer. Denna uppsats avhandlar SSI, samt ett projekt där SSI appliceratspraktiskt i en mobilapplikation för distribution av digitala dryckesbiljetter. Målet medprojektet är att utveckla en prototyp för att visa hur SSI kan appliceras på en generellapplikation som innebär utgivande av en verifierbar legitimation i form av en dryckesbil-jett. För att realisera målet har en applikation utvecklats i React Native, där flera ramverkför SSI har studerats. ”Aries Cloud Agent Python” (ACA-Py) har integrerats genomREST API för att tillhandahålla SSI-funktionalitet till projektet. Guardians of the Grid: Enhancing Cybersecurity of Blockchain-Based Renewable Energy Marketplace

Blockchain technology emerged as a potent tool for revolutionizing energy systems, offering secure transactions and efficient resource management. Blockchain offers transparency by enabling decentralized transactions. Despite adopting blockchainbased solutions, some cybersecurity issues persist in Decentralized Renewable Energy Marketplaces (DREMs). Specifically, data privacy, security, and verifiability remain a concern for prosumers and grid operators. To address such issues, several blockchainbased solutions utilize technologies such as Self-Sovereign Identities (SSIs), Digital Machine Identities (DMIs), and Zero-knowledge Proofs (ZKPs). In this work, we first review the literature to gain insight into cybersecurity issues within DREMs addressed using blockchain technology. Based on our review, we conceptualize a framework that leverages SSIs, DMIs, and ZKPs to address these issues. This work-in-progress shows the potential of these technologies to enhance security, privacy, and trust in decentralized energy transactions, paving the way for more resilient and efficient energy systems.

A contemporary concept of monetary sovereignty

This thesis analyses whether the concept of monetary sovereignty evolves under the impact of globalization and financial integration, and provides a framework for assessing what this implies. Thereby, this thesis contributes to a better understanding of both the contemporary exercise of sovereign powers in monetary and financial matters and of the driving forces behind the evolution of international law in this field. As elaborated in chapter 1, the contemporary concept of monetary sovereignty proposed by this thesis is not static but dynamic in nature. Due to the dual nature of sovereignty as a concept having not only positive but also important normative components, monetary sovereignty cannot become eroded under the impact of legal and economic constraints. Chapter 2 examines the ongoing hybridization of international monetary law arising from changes in the sources of this complex body of law, from the unsuitability of the categories of ‘hard’ and ‘soft’ law for characterizing all normative evolutions in this field, and from the rise of private and transnational monetary law. Chapter 3 scrutinizes the phenomenon of exchange rate misalignment under monetary and trade law. Intrinsically related, it assesses which aspects of the IMF’s legal framework should be reformed in order to tackle contemporary challenges to the stability of the international monetary system, such as global current account imbalances. Chapter 4 analyses the increasing regionalization of monetary sovereignty. It argues that, to the extent that transferring sovereign powers to a monetary union is what provides a state’s population with maximum monetary and financial stability, the underlying transfers are not a surrender of monetary sovereignty, but its effective exercise under the form of cooperative sovereignty. Finally, chapter 5 assesses the implications of the contemporary concept of monetary sovereignty proposed herein for the reorganization of the international financial architecture in the wake of the Great Recession.

Les enjeux présentés par la puissance financière des fonds souverains et les réactions politiques des pays d’accueil appellent naturellement à s’interroger sur la façon dont la fiscalité appréhende ces questions. La réponse nécessite de se placer tant sur le plan du droit interne français que sur celui de la fiscalité internationale. La présente étude procède à une analyse comparée de la fiscalité directe applicable aux fonds souverains en France et aux Etats-Unis. Cette analyse se poursuit à travers l’examen de conventions fiscales conclues par la France mais aussi par des Etats étrangers détenteurs de fonds souverains. La question de l’application des conventions fiscales aux fonds souverains est évoquée à travers l’exposé des modèles de conventions fiscales de l’OCDE et des Etats-Unis. Le statut fiscal des fonds souverains est confronté à celui des apporteurs de capitaux privés au regard de la distorsion de concurrence fiscale entre investisseurs. En l’absence de dispositions législatives précises, de doctrine administrative et de jurisprudence, ces travaux sont principalement fondés sur une interprétation des faits et du droit positif. Les solutions proposées tentent de remédier aux problématiques ainsi dégagées. / The growing number of investments made by sovereign wealth funds and the reactions of host countries has raised questions regarding the tax treatment of those public financial entities. Answering these questions implies to analyze the tax legislation on both a national and international level. In this respect this paper compares the direct taxation of sovereign wealth funds investments in France and in the United States. It is then followed by an analysis of some tax treaties signed by France as well as tax treaties signed by countries owning sovereign wealth funds. Questions related to the application of tax treaties to sovereign wealth funds are examined through the presentation of the OECD model tax convention and the United States income model tax convention. We then compare the tax status of sovereign wealth funds and private investors regarding tax competition and portfolio choices. We will see through the lack of tax regulations, guidance and the absence of court decision that this study is mainly based on an interpretation of the facts and the law as a consequence. The solutions provided in this paper aim at clarifying the issues we have identified. Hopefully this will raise further interrogations and will be followed by other studies.

Essays in historical finance

This dissertation concentrates on the interplay between politics and financial markets using various empirical tools applied on historical financial statistics. The first essay examines the effect of stock transaction taxation on trading activity and asset prices, specifically focusing on the case of early 20th century Sweden. The main finding is that the tax substantially reduced trading as well as the level of asset prices. In the second essay, modern ex post historical writing is contrasted with the ex ante views of contemporaries which are estimated from historical price data. The specific case study is the events around World War II related to the Nordic countries and Germany. The comparisons point out considerable differences between the assessments of historical events in the ex post and ex ante approaches. The third essay is an empirical study of price controls on asset price movements and how these controls affect asset returns. The study finds that the controls have large significant effects which even may influence estimates of the long-run equity premium. Altogether, this raises concerns about the use of century-long series of asset returns without correcting for the impact of institutional variation and market constraints. Finally, the fourth essay examines the growth effects of international financial liberalization and integration using a large country- industry sample from the 1980s. The main result is that industries highly dependent on external financing do not experience higher value added growth in countries with liberalized financial markets. Liberalization does, however, increase the growth rates of both output and firm creation among externally dependent industries. The Political Implications of Nietzsche's Perspectivism

In the first chapter of my doctoral thesis, entitled The Political Implications of Nietzsche's Perspectivism, I argue that due to conflicting passages present throughout his oeuvre, Nietzsche is best understood as a twofold metaphysical sceptic. That is, a sceptic about the existence of the external world, and consequently, as a sceptic about such a world's correspondence to our perspectives. Nietzsche presents a threefold conceptualization of 'nihilism' and a twofold one of the 'will to power.' Neutral nihilism is humanity's inescapable condition of having no non-humanly created meanings and values. This state can be interpreted positively as an opportunity to create one's own meanings and values, or negatively as a terrifying incentive to return to dogmatism. The will to power is life before and as it becomes life, the unqualified will to power, and all the realities in it, the qualifiable will to power. The combination of these ontological concepts brings me to my second chapter and to the determination of Nietzsche's general epistemology: perspectivism. Perspectivism is an admittedly created, ontologically derived interpretation of knowledge, which both entails and goes beyond relativism. Nietzsche's perspectivism is constructed to support any norm that allows for univocal evaluations, not just Nietzsche's. Moreover, it can be derived from any ontology that conceptualizes life as a unit of growth and decay and human beings as creators of all their perspectives. These two elastic concepts allow me to propose, in my third chapter, that, although his texts disavow an all-inclusive democracy in favour of a new spiritual aristocracy, on the one hand, the proper political implications of perspectivism allow for democracy, while on the other hand, Nietzsche can be read as disapproving of an all inclusive or representative democracy, yet as approving of the direct democracy that arises naturally among elite peers.

Extra-Financial Risk Factors and the Cost of Debt / Coût de la dette et facteurs de risque extra-financiers

Cette thèse a pour ambition d’analyser si la performance environnementale, sociale et de gouvernance (ESG) est intégrée par les marchés de la dette d'entreprise et souveraine. Le premier chapitre se concentre sur les informations ESG publiés à contenu négatif et leur impact négatif sur le coût de la dette. Plus exactement, dans les secteurs industriels et utilitaires les événements négatifs sociaux et de gouvernance font augmenter le coût de la dette. Également, un bon niveau général de performance ESG agit comme un mécanisme d'assurance contre ces événements négatifs. Dans un deuxième chapitre seront présentés les résultats d’une simulation de portefeuille intégrant la performance ESG d'entreprise. Un gérant de portefeuille peut améliorer le niveau agrégé de la performance ESG du portefeuille de 1,5 écart-type sans faire baisser la performance financière. Ainsi, le gérant peut combiner cette intégration avec des stratégies d'allocation d'actif financiers ou des stratégies de rendement absolu. Dans un troisième chapitre les résultats sur la réduction du coût de la dette dû à une bonne performance environnementale et sociale de souverains émergents seront analysés. Enfin dans le quatrième chapitre je décris comment la performance de gouvernance des souverains influence la différence entre le yield émis en devise étrangère et celui émis en devise locale. Dans les pays développés cette différence augmente avec le risque politique, i.e. le yield étranger augmente plus rapidement que le yield domestique. Dans les pays émergents, c'est l’effet inverse qui est observé. Cette différence entre les deux yields varie plus fortement avec un taux croissant de la dette domestique détenue par des investisseurs étrangers. / This thesis analyzes if and to what extent debt markets value the environmental, social and governance (ESG) performance of firms and sovereigns. The first chapter shows that negative ESG news has a negative impact on the cost of debt of firms. The news relates to environmental and social events within the industrial/utilities sector. In this sector, a sound corporate social performance acts as an insurance against the adverse impact of negative environmental events on bond prices. The second chapter reveals that ESG scores integrated into portfolios do not change the financial performance ex post. A portfolio manager can increase the average ESG rating of her portfolio by 1.5 standard deviations without incurring cost. This leaves substantial room and opportunity for ESG ratings to be combined with asset allocation or absolute return strategies. The third chapter shows how ESG performance is linked to a lower cost of debt of emerging sovereigns. Research indicates that an emerging country’s average cost of capital decreases with its positive environmental and social performance. The fourth chapter discusses how governance performance may influence the spread of debt denominated in local and foreign currency. In developed countries, the spread between a foreign currency yield and a hedged local currency yield increases with our political risk indicator, i.e. the foreign yield increases faster than the domestic one. For emerging countries, the reverse trend is true. Interestingly, the foreign currency and local currency yield spreads move significantly stronger in absolute terms with increasing foreign investment participation in both emerging countries and developed countries’ debt markets.
