Wilhelm von Bode and the International Art Market: the Unpublished Correspondence with Rudolphe Kann and Joseph Duveen This dissertation explores changing trends in the European and American art market in the late 19th and beginning of the 20th Centuries, in particular their influences, presented from the perspective of Wilhelm von Bode, renowned connoisseur and, at the time, director general of the Berlin Museums and explored predominantly through his relationship with the private collector Rudolphe Kann and art dealer Joseph Duveen. At the time, the collection of Rudolphe Kann was considered to be one of the most refined among the European private collections, yet it hasn't received much attention by contemporary scholars. This dissertation therefore offers the most systematic review of Kann's collection since 1907, the year when Bode compiled the revised catalogue. Wilhelm Bode was actively involved in building the Kann collection, as shown by the extensive numbers of private, previously unpublished, correspondence, which provided the foundation of this research. L’utilisation équitable existe-t-elle toujours ?

Jusqu'à l'arrêt CCH Canadienne Ltée c Barreau du Haut-Canada, rendu par la Cour suprême en 2004, la doctrine canadienne opposait deux exceptions générales au droit d’auteur : l'utilisation équitable (fair dealing), existant surtout dans les pays du Commonwealth (dont le Canada), et l’usage loyal (fair use), exception présente aux États-Unis. Alors que le premier modèle serait restrictif et conservateur, le second se voudrait plus libéral et soucieux des droits des utilisateurs. Il va sans dire que certains auteurs contestaient le statu quo juridique et souhaitaient plutôt l'adoption d'une approche libérale, voire étatsunienne, en matière d'utilisation équitable au Canada. Or, depuis l'arrêt CCH et la pentalogie du droit d’auteur de 2012, un important changement conceptuel de cette dichotomie s’est opéré. Certains auteurs décrivent une réduction significative des différences entre les deux approches, rendant les distinctions futiles. Ainsi, nous sommes amenés à nous poser la question suivante : suite à la jurisprudence canadienne contemporaine, existe-t-il toujours une différence significative entre l'utilisation équitable et l’usage loyal ? Ce mémoire se veut une analyse de l’état du droit en 2019 afin de répondre à cette question. Au terme de son raisonnement, l’auteur arrive à la conclusion que même si les deux régimes se ressemblent plus que jamais, les différences entre ceux-ci sont suffisamment importantes pour ne pas les assimiler à une unique approche avec des variations mineures. / Until the Supreme Court of Canada decision CCH Canadian Ltd v Law Society of Upper Canada in 2004, the legal literature in Canada acknowledged two competing general exceptions to copyright: fair dealing, which exists especially in Commonwealth countries (including Canada), and fair use, an exception in the United States. While the former was seen as restrictive and conservative, the second was viewed as intending to be liberal and more concerned with user rights. Needless to say, some writers contested the legal status quo and wanted a liberal, even American, approach to fair dealing in Canada. However, since the CCH decision and the copyright pentalogy of 2012, there has been a significant conceptual shift with regard to this dichotomy. Some authors describe a significant reduction in the differences between the two approaches, making the distinctions of little consequence. As such, we are led to ask the following question: given the contemporary Canadian jurisprudence, is there still a significant difference between fair dealing and fair use? This dissertation is an analysis of the state of the law in 2019 for the purpose of answering this question. At the end of his examination of the issue, the author comes to the conclusion that even if the two regimes are more similar than ever, the differences between them are sufficiently important to not assimilate them into a single approach with minor variations.

Educating adolescents towards spiritual intelligence

A critical evaluation of the National Curriculum Statement (NCS) was undertaken to uncover strategies for infusing values across the curricula – values that may facilitate the development of spiritual intelligence (SQ) in adolescents. A literature study was conducted to determine whether SQ may be harnessed to cultivate values within an educational context. In addition, moral and spiritual development in adolescence was explored and a case made for values-education. An empirical investigation was undertaken using both a qualitative research design and semi-structured interviews. A purposive sample was used comprising 14 education specialists, principals and Life Orientation teachers from six secondary schools in Gauteng and Mpumalanga provinces. The most important finding was the fact that values-education in the NCS was problematic. The conclusion was thus drawn that teachers should be trained to incorporate values within curriculum activities − values that could engender SQ and, thus, address the moral dilemmas in our schools. / Psychology of Education / M. The thesis aims to stimulate the debate on the need of improvement of the history education in the Czech Republic. It concentrates on describing the consequences of current historical situation, defined by the dealing with the communist past discourse, to history education. First, it analyses the very concept of dealing with the communist past, using available linguistic and statistic tools (e.g. Czech National Corpus and Mediasearch archive) and multidisciplinary literature. Then the three studies follow. The first case study explores the public debates on teaching of communist history that took place in the public since 1989 and included some criticism of the quality of history education. It also analyses conceptualizations of history education within the national curriculum since 1989. As a result, two dominant discursive types that have had an influence on the public debate about history education and teaching practice are defined. The second study explores the memory, pedagogical and discursive practices related to the application of oral history method for both remembrance and history education. The fair dealing doctrine in respect of digital books

Copyright is essentially the right of the rightsholder of an original work to prohibit others from making or distributing unauthorised copies of his or her work. More specifically for this dissertation, when an end user deals with digital content, one of the aims of copyright becomes the balancing of the conflicting interests in ‘exclusivity’ on the one hand, and in ‘access to information’ on the other. Exclusivity is achieved by the rightsholders through technological protection measures to protect their commercial interests. Access to information is achieved where works are available to the general public without payment and technological protection measures and where the digital content is not directly marketed for commercial gain. Exclusivity and access to information are two conflicting cultures surrounding copyright in the digital era. It is submitted that unless we find a socio-economic-legal way for the dynamic coexistence of these two conflicting cultures by means of fair dealing, the culture of exclusivity will eventually dominate fair access to information. The transient nature of digital content means that rightsholders have little or no control over their works once the end user has obtained a legal digital copy of the work. The right ‘to prohibit’ end users from copying and distributing unauthorised copies is, therefore, largely meaningless unless a legal or other solution can be found to discourage end users from the unauthorised reproduction and distribution of unauthorised copies of the work. Currently, technological protection measures are used to manage such digital rights because legal permissions within the doctrine of fair dealing for works in printed (analogue) format are inadequate. It is, however, submitted that a legal solution to discourage end users from copying and distributing unauthorised copies rests on two pillars. Firstly, the solution must be embedded in state-of-the-art digital rights management systems and secondly the business model used by publishers, and academic publishers in particular, should change fundamentally from a business-to-consumer model to a business-to-business model. Empirical evidence shows that the printing of e-content will continue to be relevant far into the future. Therefore, the management of fair dealing to allow for the printing of digital content will become increasingly important at educational institutions that use e-books as prescribed course material. It is submitted that although the origination cost of print editions and e-books correspond, the relatively high retail price of e-books appears to be based on the fact that academic publishers of digital content do not have the legal or digital rights management tools to manage the challenges arising from the fair dealing doctrine. The observation that academic publishers are reluctant to grant collecting societies mandates to manage the distribution of digital content, and/or the right to manage the authorised reproduction (printing) of the digital content, supports this hypothesis. Ultimately, with technologies at our disposal, the fair use of content in digital and print format can be achieved because it should simply be cheaper to comply with copyright laws than to make unauthorised digital or printed copies of content that our society desperately needs to make South Africa a winning nation. / Mercantile Law / LL. 近年來我國屢次爆發掏空公司資產之弊案,而細究其掏空之方式,多係藉由公司之交易行為,將公司資產不法輸送予特定人士。我們不難發現這些特定人士時常某程度與公司之董事或控制股東,具有一定之利害關係,甚至這些特定人士即為董事或控制股東本身。正因如此,關係人交易在我國公司治理議題上逐漸受到重視,並引起廣泛之討論,尤其針對具有董事或控制股東身分之人。由於此兩類身分之人同時具有掌握公司資訊及影響公司經營決策之權力,更易藉此方式自公司謀取私利。 我國對於關係人交易下董事之義務,雖已有規範,然而自比較法之觀點,美國法對此部分顯然較我國完備,不僅對於關係人交易設有事前之董事行為標準,並且對於符合行為標準之關係人交易,給予董事安全港之保護。同時,配合司法實務上所發展之司法審查標準,採取寬嚴不一的審查模式,使董事得於關係人交易中合理預測訴訟風險。一方面可降低關係人交易中非常規交易發生之可能性,另一方面亦不至於全然扼殺關係人交易在現代經濟社會中產生之正面價值。我國法之董事義務既是繼受英美法上受任人義務之概念,因此本文嘗試分析美國法中關於關係人交易之相關規定,希冀做為我國修法之參考以求法制之完備。 又我國現行公司法在控制股東義務方面,似存在重大之法律漏洞。尤其在關係人交易下,有心人士為規避擔任董事可能帶來之相關義務,轉而選擇置身於幕後,成為不具董事身分卻實際掌握公司經營決策權之控制股東。此無疑對於欲利用關係人交易不法掏空公司之人,開啟方便之大門。事實上,在英國及美國法上對於控制股東在特定情況下課予如同公司董事一般之受任人義務,而本文則將其焦點限縮在關係人交易下控制股東之義務,經由整理分析英美兩國法制上之條文、學說及重要判決,以期建構出我國規範關係人交易下控制股東義務之依據。
