Freed by the Court: The Role of Images Between Remembrance and Oblivion of War Crimes

This paper explores the role of images in facilitating debates on the responsibility of convicted war criminals. Previous research on the mediation of war crime trials in Serbia has mainly focused on political and media discourses or everyday practices as verbal or textual modes of communication, showing the dominant nationalism and widespread denial, with convicted war criminals appearing as heroes and celebrities. This article argues that the normalization of convicts was partially realized through the avoidance of atrocity images and the prevalence of iconic images of convicts, who are described as persons “freed by the court.” The paper explores two instances when iconic images of convicts served as catalysts in debates on their criminal responsibility, pointing out that images might limit the scope of the debate, and condition the type of questions posed. Archival atrocity images, on the other hand, might provide much-needed context and evidence about crimes. Considering the powerful role of images, the article urges a more systematic analysis of images in the transitional justice field, as some of the images turn into symbolic presentations of the past for future generations.

The policing of sex workers in Sunnyside

In South African Law, sex work is currently mainly dealt with in terms of the Sexual Offences and Related Matters Act 32 of 2007, although other legislation, such as the Aliens Control Act 3 of 1993 also contains provisions that are peripherally relevant to sex work. In addition, municipal by-laws play an important role in the regulation of sex work, especially outdoor sex work. These by-laws are often aimed at addressing the more visible aspects of outdoor sex work. This dissertation aims to analyse the policing methods used by the police when policing sex work in Sunnyside, and whether the police have the ability and capacity to enforce current legislation in this regard. The enormous incidents of dehumanization and abuse of sex workers by the police who are supposed to enforce the Sexual Offences Act 32 of 2007 and the previous legislation on sex work questions whether the police should be given more or less powers in dealing with this crime. This dissertation aims to conduct an in-depth analysis of relevant literature in order to provide a background for the discussion on the origins of sex work and the different legal models for dealing with sex work. The study also endeavours to establish a frame of reference for considering different legal models to deal with sex work and to identify different policies and legal approaches to sex work, and to consider the impact of the current laws regulating sex workers and the harm that result from this. The dissertation aims to explore and describe the challenges that the police in Sunnyside experience, and also to analyse the difficulties that sex workers often encounter. The knowledge generated in this study will enhance the existing knowledge in the policing of sex work, and will also serve to educate the police, criminal justice institutions, and the community about the nature and extent of the problems that policing agencies experience when policing sex workers in Sunnyside. / Police Practice / M. Text in Afrikaans / This study ascertains the extent of the experience of stress and the nature of stress management by educators. The literature showed that stress is defined from various theoretical perspectives; various approaches to stress management exist; and educators manage stress in various ways. This study defines stress from a cognitive-transactional perspective. A qualitative research method was used, descriptive data were generated by focus groups and inductively analysed. The results show that educators experienced stress ( much as seen in the literature) due to organisational, management and personal factors. According to this research, educators experience stress on the physical, emotional, social and intellectual levels. Educators' efforts to deal with stress reflect direct techniques such as seeking personal support and using confrontational techniques, as well as indirect techniques which encompass intellectual and physical techniques. Afrikaans text / Met hierdie studie is beoog om leerders se persepsies van skool vas te stel en om riglyne vir ouers daar te stel om leerders met negatiewe persepsies van skool te hanteer. Daar is beoog om hierdie riglyne deur middel van praktiese modelle en werksvelle te implementeer sodat ouers begrip vir kinders se persepsies kan verkry en dat konflik opgelos kan word deur middel van positiewe kommunikasie. In die literatuurstudie word ondersoek ingestel na persepsievorming en die oorsake vir die vorming van negatiewe persepsies van skool. ‘n Persepsie word gevorm deurdat betekenis aan ‘n ervaring, op grond van die persoon se verwysingsraamwerk gegee word. Interne- sowel as eksterne faktore speel ‘n rol wanneer persepsies gevorm word. Eksterne faktore behels die verhouding met rolspelers soos: die ouers, die skool en onderwysers, die portuurgroep en die leerder se verhouding met homself. Interne faktore wat in hierdie studie ondersoek is, behels: lokus van kontrole, motivering, emosionele probleme, kognitiewe probleme en gedragsprobleme.Die navorsingsprobleem is verken met behulp van ‘n loodsondersoek as ‘n voortoets en diagnostiese vraelys wat deur die navorsingsgroep van 50 leerders voltooi is. Onderhoude is met vyf leerders gevoer oor hulle ervaringe en behoeftes met betrekking tot hulle persepsies van skool. Bevindinge dui aan dat ongeveer ‘n vyfde van die skool se leerders oor ‘n negatiewe persepsie van skool beskik. In die vraelys is leerders se persepsies ten opsigte van verskeie rolspelers vasgestel. Daar bestaan behoefte by leerders dat ouers betrokke en ondersteunend sal wees en dat ouers begrip vir hulle persepsies sal toon. Deur middel van praktiese diagramme en werksvelle is begrip en positiewe kommunikasie tussen ouer en kind bewerkstellig. In Hoofstuk 6 word praktiese riglyne aan ouers gegee oor hoe om sy kind, met ‘n negatiewe persepsie van skool, te hanteer. Op hierdie wyse is gepoog dat leerders positiewe ervaringe sal geniet; ‘n positiewe verwysingsraamwerk sal vorm en sodoende positiewe persepsies van skool sal vorm. ‘n Bydrae is ten opsigte van ouerleiding gelewer. Ouers word toegerus om ‘n kind met negatiewe persepsies van skool met begrip te hanteer. / The aim of this study was to determine learners’ perceptions of school and to provide guidelines for parents to deal with negative perceptions of school. These guidelines were implemented using practical models as well as work sheets. These were specifically aimed at enhancing parents’ understanding of the negative perceptions and resolving conflict through positive communication. In the literary study, the constitution of perceptions as well as the causes of the constitution of negative perceptions was investigated. A perception is established when a person gives meaning to an experience based on that person’s frame of reference. Internal and external factors play a part when perceptions are constituted. External factors in this study entail the relationship with parents, school and teachers, peer group and the learner's relationship with himself. Internal factors referred to in this study are locus of control, motivation, emotional problems, cognitive problems and behavioural problems. vii The research problem was explored using a pilot investigation as pre-test. A diagnostic questionnaire was also completed by 50 learners. Five learners were interviewed about their experiences and needs specifically in relation to their perceptions of school. Findings show that approximately one fifth of the learners of the school have negative perceptions of school. In the questionnaire, the learners’ perceptions with respect to a variety of role players were determined. There is a definite need for parents to be involved and supportive. Learners also need them to show understanding for their perceptions. Positive communication and understanding between parents and learners were established through practical diagrams and work sheets. In Chapter 6 practical guidelines are given to equip parents to understand how to handle the child with negative perceptions. The aim of this was to encourage learners to enjoy positive experiences, to form a positive frame of reference and therefore develop positive perceptions of school. Users' entitlements under the fair dealing exceptions to copyright

Thesis (LLM)--Stellenbosch University, 2012. / Includes bibliography / ENGLISH ABSTRACT: This thesis analyses current South African copyright law to ascertain the proper interpretation and application of the fair dealing provisions contained in the Copyright Act 98 of 1978. Copyright law ensures that authors’ works are not used without their consent, which they can grant subject to compensation or conditions attached to the use. Fair dealing exceptions allow the general public to use copyright works for certain purposes without the copyright owner’s consent and without paying compensation. These provisions are intended to balance copyright owners’ interests with the interest that members of the public have in using copyright works for socially beneficial purposes. These provisions typically allow the use of a copyright work for the purposes of research or private study, personal or private use, criticism and review, and news reporting. Unfortunately there is no South African case law concerning the fair dealing provisions, and the application of these exceptions remains unclear. This study aims to clarify the extent of application of the fair dealing exceptions to copyright infringement so that courts may be more willing to consider foreign and international law and in doing so develop South African intellectual property law. The social and economic policy considerations underlying the fair dealing exceptions are considered to determine their function. International conventions relating to copyright and neighbouring rights are examined, specifically the provisions allowing exceptions to copyright. The legislation and case law of Australia and the United Kingdom are analysed to determine the proper interpretation and application of these statutory defences. This knowledge is then used to inform South African law. The Copyright Act 98 of 1978 does not contain a fair dealing exception for parody and satire. Australian legislation does contain such an exception, and it is analysed in that context. An exception for parody is proposed for South African law, and the need for and application of this provision is considered. The constitutionality of the proposed exception is evaluated in terms of its impact on the constitutional property rights of copyright owners. / AFRIKAANSE OPSOMMING: Hierdie tesis ondersoek Suid-Afrikaanse outeursreg om die behoorlike uitleg en toepassing van die “billike gebruik”-bepalings in die Wet op Outeursreg 98 van 1978 te bepaal. Outeursreg beskerm die werk van ʼn outeur teen ongemagtigde gebruik van haar intellektuele eiendom. Gebruik kan deur die outeur gemagtig word, òf teen vergoeding òf onderhewig aan bepaalde voorwaardes. Artikels 12-19B (die billike gebruik-bepalings) van die Wet op Outeursreg laat ander toe om sekere werke te gebruik sonder die toestemming van die eienaar van die werk en sonder om vergoeding te betaal. Die bepalings streef om ʼn balans te tref tussen die belange van die outeur en die belange van die publiek. ʼn Werk mag volgens hierdie bepalings tipies gebruik word vir die doeleindes van navorsing of private studie, persoonlike of private gebruik, beoordeling of resensie, of om nuus te rapporteer. Daar is tans geen Suid-Afrikaanse regspraak rakende hierdie uitsonderings nie, en hul toepassing is dus onseker. Hierdie tesis beoog om die werking van die billike gebruik-bepalings duidelik uiteen te sit om hoër gewilligheid in howe te skep om internasionale en buitelandse reg toe te pas, en sodoende Suid-Afrikaanse immateriële goederereg te ontwikkel. <p>Uppsatsen är en närläsning av Patricia C. Wredes bok <em>Dealing with Dragons </em>och undersöker huruvida boken i fråga är en parodi eller travesti på de klassiska sagorna, t.ex. Törnrosa och Askungen. Jag tar också reda på om det går att läsa boken på olika sätt beroende på hur stor förkunskap man har om de gamla sagorna. Gérard Genette har skrivit boken <em>Palimpsestes: La</em> <em>littérature au second degré</em>, och jag har med hjälp av en svensk översättning använt mig av hans teorier om hypotext - hypertext, parodi, travesti och transformation. Jag tar även hjälp av Jack Zipes och hans bok <em>The Brothers Grimm - From Enchanted Forests to the Modern</em> <em>World. </em>Dessutom används Barbara Walls bok <em>The Narrator's Voice - The Dilemma of</em> <em>Children's fiction </em>för att reda ut begreppet dubbelt tilltal.</p><p>Uppsatsen är indelad i tre delar med tillhörande underrubriker: Inledning, analys och slutdiskussion. Under analysdelen tar jag upp Wredes sätt att använda sig av direkt och indirekt transformation samt om hänvisningarna till bl.a. Grimms sagor är inslag av parodi eller travesti. Metoden jag använder mig av är att visa och analysera utdrag ur boken som är direkt eller indirekt transformerade från sedan länge befintliga sagor eller legender.</p><p>Resultatet av analysen når sitt syfte och svarar på frågeställningen. Slutsatsen är att boken <em>Dealing with Dragons </em>till största delen är en parodi på kända sagor, men att inslagen av travesti är nödvändiga och behövs för den roliga och lite snälla tonen som boken tillhandahåller.</p>

The thesis deals with questions of pre-contractual liability which is seen as a very specific institute whose conception is diverse in different EU countries and also outside. The main research question is a difference between pre-contractual liability perception in the different countries and its full description in relation to the negotiations of business contracts with an emphasis on Czech law. In the first part, the author analyses historical background of pre-contractual liability in relation to Roman law and German-Austrian legal systems in which the professor Jhering developed that construction of culpa in contrahendo. In the following chapters, the author deals with the description and nature of pre-contractual liability, particularly in questions of whether they are contractual or delictual liability and enter into details the basic facts, example and extent of damages with respect to the European concept of pre-contractual liability. He concludes that the pre-contractual liability is in the European concept as delictual liability, with regard to the decision of European Court of Justice. The author simultaneously mentions that although similar facts in the legal systems, the extent of damages is very different when there is a clear dichotomy between positive and negative interesse. Theoretical section defines the concept of direct selling, describes its history and current development in the world and in the Czech Republic. It further addresses its advantages and organizations which determine international rules and ethical standards of direct selling. The practical part focuses on direct selling of telecommunications services. First, it analyzes development of telecommunication market in years 2007-2011. Based on this analysis, it presents strategy of building a data network of local Internet service provider PJcomp Ltd. in the same period. It describes pricing and practices in direct selling of internet connection. It further addresses the negotiating tactics towards residential houses, developers and suppliers of IT services. The conclusion is based on SWOT analysis and proposes a new corporate strategy.

Le préjudice de l'actionnaire est un sujet encore peu étudié en France alors qu'il soulève de nombreuses interrogations. A l'inverse de nombre de solutions reçues dans les droits étrangers, le droit français n'admet que peu sa réparation tant il reste lié à la distinction jurisprudentielle fondamentale entre préjudice purement personnel (réparable) et préjudice simple corollaire du préjudice social (non réparable). Pourtant, cette distinction n'est pas des plus satisfaisantes ni sur le plan théorique, ni sur le plan pratique. Elle est en outre remise partiellement en cause dès lors que le préjudice trouve sa source dans une infraction pénale, telle que la communication d'informations mensongères. Par ailleurs, l'internationalisation des mouvements de capitaux soulève de plus en plus fréquemment la question de la loi applicable ou du juge compétent (judiciaire ou arbitral également) relativement aux actions en justice des actionnaires. Cette étude se propose dès lors de fournir une appréciation critique du droit positif afin de tenter l'élaboration d'un droit prospectif. Les solutions existantes peuvent-elles et doivent-elles changer ? Pour adopter quel type de solutions ? / The subject of shareholder damages has seldom been studied in France. Nonetheless, it is a topic of much discussion and debate in legal circles. Unlike under some foreign laws, French law rarely permits the direct compensation of shareholder damages because of the summa divisio between the personal damage (recoverable) and the damage of the company (not recoverable). However, this distinction is not relevant both in terms of theory and practice. More doubt is cast on this distinction where the potential damage arises from an infringement of the penal law, such as the use of false or misleading information to induce shareholder reliance or action. Furthermore, the internationalisation of capital introduces conflicts of law and jurisdictional questions, asking the courts to first determine whether they are the proper authority to hear a shareholder’s case, and which nation’s laws to apply.This study presents a critical analysis of the positive law and proposes avenues of reforming French laws concerning shareholder damages. Should the existing remedies be changed ? Which remedies should be adopted to reverse the strict trends in French law against adequately compensating shareholders’ losses ?

Les Commissions Vérité et Réconciliation comme mécanisme de justice transitionnelle : La question de la justice, de la vérité et de la réconciliation dans les sociétés en transition démocratique / Truth and Reconciliation Commission as transitional justice mechanism

La question de la justice dans les sociétés en transition est systématiquement soulevée après un conflit ou une période répressive ou autoritaire. En effet, les violations flagrantes du droit international des droits de l’homme et les violations graves du droit international humanitaire perpétrées sous les précédents régimes ne sauraient laisser aux institutions politiques nouvelles le choix de l’inaction face au passé. Les commissions vérité et réconciliation constituent un des mécanismes de la justice transitionnelle qui place la victime au cœur de ses préoccupations notamment parce que l’incrimination du bourreau n’est pas le seul objectif de la justice et que, comme le remarquait Hannah Arendt, il faut bien constater qu’il y a « des crimes qu’on ne peut ni punir, ni pardonner ». Parfois présentées comme une solution alternative à la justice pénale, ces commissions ont pour objectif d’établir les méfaits des anciens régimes. Le possible choix entre les commissions vérité et la justice répressive interne ou internationale est écarté dans cette étude qui entend accorder une place importante à la complémentarité des commissions vérité et réconciliation avec les autres mécanismes de la justice transitionnelle, notamment les poursuites judiciaires contre les auteurs des crimes de droit international les plus graves et les réparations pour les victimes. De fait, le but de cette étude n’est pas d’analyser de manière isolée ces commissions mais de constater que les normes internationales et la situation propre à chaque pays en transition limitent les options disponibles du traitement du passé. La recherche est fondée sur la méthode d'étude de cas de plusieurs pays dans une démarche comparative afin d’en tirer des conclusions aboutissant à démontrer la légitimité des commissions vérité et réconciliation en période de transition ainsi que leur fonctionnement. / The issue of justice in societies in transition is systematically raised after a conflict, a repressive period or an authoritarian period. Gross violations of international human rights law and grave breaches of international humanitarian law perpetrated under previous regimes cannot let the choice of inaction concerning the past to the new political institutions.Truth and reconciliation commissions constitute one of the mechanisms of transitional justice, which place the victim at the middle of its concerns especially because the criminalization of perpetrators is not the only goal of justice and, as noted by Hannah Arendt, “men are unable to forgive what they cannot punish and are unable to punish what turns out to be unforgivable”. Sometimes presented as an alternative mean to criminal justice, these commissions aim to establish the misdeeds committed by former regimes. The possible choice between truth commissions and international or internal criminal Justice is avoided in this study, which aims to highlight the important role of the complementarity of truth and reconciliation commissions with other transitional justice mechanisms, notably legal prosecutions against the perpetrators of crimes against international law and reparations for victims. In this regard, the aim of this study is not to analyze these commissions in an isolated manner, but to notice that international standards as well as situations in each country restrict the options available for dealing with the past. This research is based on a comparative approach presenting a case study on different countries for demonstrate the legitimacy of truth and reconciliation commissions and their functioning in period of transition.
