[pt] O poder dos juizes de rechaçar uma lei emanada dos poderes dotados de alto nível de legitimação democrática é elemento central das democracias constitucionais. Entretanto a sua justificação em um nível que transcende o enfoque positivista é complexa, já que a jurisdição constitucional envolve um paradoxo: ao mesmo tempo em que as cortes são vitais à democracia, também representam seu limite. Nesta dissertação propõe-se a abordagem da dificuldade contramajoritária da jurisdição constitucional a partir do debate doutrinário norteamericano e europeu, analisando, detalhadamente três perspectivas que procuram superar o seu déficit democrático através de uma justificação que a compatibilize com o ideal da democracia. A conclusão proposta considera a instituição da jurisdição constitucional num nível genérico centrada na democracia deliberativa que preconiza um equilíbrio entre direitos e soberania popular. / [en] The power of the Judicial Branch to overule a law enacted by other branches with higher democratic legitimation constitutes a central feature of constitutional democracies. Nevertheless its justification beyond a positivist approach is complex, since judicial review envolves a paradox: at the same time that courts seem to be vital to democracy they also impose limits. In this dissertation is proposed the discussion of the counter- majority difficulty of the judicial review from the american and european doctrines point of view, and a detailed analisys of the perpectives that try to overcome its democratic deficit, proposing one justification that reconciles it with the democratic ideal. The conclusion offered considers the institution of judicial review in a general level, and is focused in a deliberative democracy basis that promotes an equilibrium between human rights and popular sovereign.

The</p><p>representative elected politicians in Örebro tried to find ways to involve the people in the</p><p>process of ruling. Why they choose to try this experiment on this very delicate matter, the</p><p>closure of several schools in the municipal, is one of the questions this essay is trying to</p><p>answer.</p><p>The purpose of this essay is to find out whether the process was an attempt for the politicians</p><p>of the representative democracy to implement deliberative democracy in the structure of the</p><p>local governance.</p><p>The result of this study is that the politicians didn’t manage to reach to the citizens the way</p><p>they formerly had planned.</p>

O estudo analisou como ocorre o controle social da política social pública de educação, através dos Conselhos Nacionais e Estaduais de Educação, tomando como referência a interface com as políticas de educação na cidade de Cachoeira, neste Estado. Para levar a efeito a pesquisa, empregou-se a metodologia de análise de conteúdo com a técnica de pesquisa documental com análise quali-quantitativa e o estudo das Resoluções desses Conselhos no período de 2001 a 2013, além da pesquisa de dados, usando como fontes órgãos oficiais do Estado brasileiro, verificando a existência ou omissão de nomes e expressões previamente estabelecidos nessas resoluções, bem como sua periodicidade, que denotavam as contradições no ensino. Sob a premissa de que o Conselho de Políticas Sociais Públicas é um órgão que encerra uma série de contradições, todo o estudo foi realizado sob uma perspectiva do método dialético histórico, usando como categorias a contradição e a totalidade. Foi usado como perspectiva de análise crítica da ontologia do Estado, bem como de sua formação, da sociedade civil e movimentos sociais, situando-se esta pesquisa na noção de Democracia Deliberativa, reconhecendo o Conselho Quilombola do Vale do Iguape como um elemento fundamental para o controle social da política social de educação em Cachoeira. / The first decade of this century was marked among other things by the emergence of rights discourse in favor of traditional communities and especially the remnants of Quilombo with this, comes a tough debate on such rights, including the right to education in these communities. The study examined how is the social control of public social education policy, through the National Councils, State of Education, with reference to the interface with the education policies in the city of Cachoeira, in this state. To take effect the research used content analysis methodology with documentary research technique with qualitative and quantitative analysis to the study of these Councils resolutions from 2001 to 2013, in addition to data search, using as sources of organs official Brazilian state, verifying the existence or omission of names and expressions previously established in these resolutions as well as its frequency denoting the contradictions in teaching. Under the premise that the Board of Public Social Policy is an organ that contains a series of contradictions, all the study was conducted from the perspective of the historical dialectic method, using as categories the contradiction and all. It was used as a perspective of critical analysis of the state of ontology, as well as their training, civil society and social movements, reaching this research on the notion of participatory democracy. acknowledging the Quilombo Council Iguape Valley as a fundamental element for social control of social policy education in Cachoeira.

Um dos principais problemas apresentados pela concepção tradicional de democracia, caracterizada pela mera competição política entre interesses ou preferências, é sua insuficiência na avaliação dos resultados políticos. Em contraposição, a idéia de uma democracia deliberativa pretende, dentre outros objetivos, fornecer uma reflexão epistêmica, na medida em que se propõe a ir além do mérito dos procedimentos democráticos, com vistas a apresentar boas razões para as escolhas públicas. Ela requer uma justificação pública que se faça por meio da argumentação pública de todos os concernidos. Essa abordagem, contudo, é comprometida por falhas relacionadas a sua postura excessivamente idealista caso entendamos os procedimentos deliberativos como discussões políticas efetivas voltadas para o consenso ou à eventual vagueza de seus parâmetros epistêmicos. Procuro defender, em sentido contrário, que critérios adequados à justificação pública podem ser encontrados na concepção política de justiça presente no liberalismo político de John Rawls. Sua proposta deve ser interpretada, em discordância com críticas correntes, como defensora da democracia e plenamente compatível com a deliberação democrática. / One of the major problems that beset the traditional conception of democracy, marked by a mere political contention of interests or preferences, is the absence of a due appraisal of political outcomes. Contrarily, the idea of deliberative democracy intends inter alia to provide an epistemic account so far as it goes beyond procedural values in order to find good reasons for a public choice. It claims a public justification by way of a public reasoning among all those concerned. This account reveals, however, shortcomings for being either too idealist if its deliberative procedures mean a public discussion whose aim is consensus or too vague whether one considers those procedures as epistemic standards. I sustain otherwise that appropriate criteria for public justification can be found in a political conception of justice supported by John Rawls political liberalism. This account is to be shown in opposition to common objections - as encouraging democracy and not inimical to democratic deliberation.

A supera??o de tais obst?culos perpassa pelo interesse de a sociedade civil despertar e passar a ter voz ativa nessas institui??es. / The social participation in Brazil takes a new impetus with the (re)democratization process of the Brazilian society and is strengthened by the resurgence of the civil society and the 1988 Constitution. In this context, the study is conducted with the scope to verify the effectiveness of deliberative Municipal Health Council of Mossoro (CMSM), with theoretical and methodological support based on the following models: the participatory normativity, which measures the degree of institutionalization, democratization and council representation; and the effectiveness of deliberative that, from the calling capacity and agenda of the participants, from the kinds of manifestation, from the decisions and the council?s office, that measures the degree of effectiveness of the deliberative council. It appears, thus, that the council has an average degree of effectiveness deliberative, standing out as means an institution that practice, despite the existence of obstacles and challenges, the role of control over municipal health policies, due, among other factors, the conservative political context, the asymmetry of resources between the counselors, the little substantive participation of the actors who attend its meetings, either counselor or not, and in particular, the reduced influence of the members in its decision-making process. In public management of Mossoro, social participation, especially social control over public actions, face, today, great number of difficulties to be held. The study recognizes that, in such circumstances, the council partially fulfills the role for which it was created, what does not impede, however, be characterized as an important deliberative space, since it allows the participation of representatives of the various segments of the state, society, their demands and intentions. Overcoming such obstacles moves through the interest of civil society to wake up and fight for the spaces in these institutions.

Ao fim, conclui que o modelo procedimental baseado em J?rgen Habermas ? aplic?vel ao Brasil. / This dissertation aims to analyze the connection between procedurally constructed public opinion, through discourse, with the legitimacy and rationality of constitutional jurisdiction. The study is carried from a deductive method, through qualitative research and normative bias, and bibliographical support on the work of J?rgen Habermas, being the theory of communicative action the starting point. In the course of the study, considerations about the formation of public opinion in the context of deliberative democracy and its reflexes in judicature, being amicus curiae the communicative channel between civil society and the judiciary branch. Comprehends, moreover, that jurisdiction has its legitimacy conditioned to a procedural model, whose crossbeam is the dialogical cooperation between all procedural actors involved, being this one of the tones adopted by the Civil Procedural Law. In the end, it is concluded that the procedural model based in J?rgen Habermas is applied in Brazil.

A partir da pesquisa documental (leis de cria??o dos conselhos, regimentos internos, atas, resolu??es e relat?rios de gest?o), bem como da participa??o em reuni?es dos colegiados e das entrevistas com conselheiros e gestores, buscou-se empreender uma an?lise sobre como o compartilhamento do poder acontece nessas institui??es e como elas influenciam as respectivas gest?es municipais. Os resultados demonstram que a din?mica de funcionamento dos conselhos relaciona-se tanto ? abertura da gest?o ? participa??o social quanto ao protagonismo dos conselheiros em promover debates, apresentar demandas e exercer o controle social sobre as a??es e presta??es de contas dos gestores. Nesse sentido, ? poss?vel afirmar que as institui??es participativas atuam qualitativamente para a democratiza??o das pol?ticas p?blicas, mesmo que a correla??o de for?as desigual entre Estado e sociedade civil ainda esteja presente no processo decis?rio de alguma maneira nos casos analisados. / The Public Policy of Social Assistance established by the Federal Constitution of 1988 is a duty of the State and the right of the citizen and is carried out through a decentralized and participatory system, articulating the State and civil society in the decision-making process of management and in the inspection of actions and public resources. The managing councils institutionally assume the prerogative to materialize social participation for the democratization of public policies, and its existence is a legal condition for the transfer of federal resources in the scope of Social Assistance. The literature shows that these institutions are consolidated for this process, however, it is necessary to understand the dynamics of the functioning of the councils and their relationship with the management bodies to analyze the quality of social participation and its influence in the decision-making process and the exercise of Social control. The objective of this work is to analyze the dynamics of the municipal councils of Natal and Parnamirim (RN), based on the assumptions of theories of participatory and deliberative democracy, apprehending the analytical categories of participation, political representation, deliberative effectiveness and Accountability. Based on documentary research (council creation laws, internal regulations, minutes, resolutions and management reports), as well as participation in meetings of the collegiate and interviews with directors and managers, an attempt was made to analyze how sharing of power takes place in these institutions and how they influence the respective municipal administrations. The results demonstrate that the dynamics of functioning of the councils is related to the opening of management to social participation and to the role of directors in promoting debates, presenting demands and exercising social control over the actions and rendering of accounts of managers. In this sense, it is possible to affirm that participatory institutions act qualitatively for the democratization of public policies, even though the unequal correlation of forces between State and civil society is still present in the decision-making process in some way in the analyzed cases.

Neste aspecto, a participa??o social se apresenta como uma das ferramentas mais importantes da democracia e verdadeira express?o da soberania popular. Abre-se, portanto, espa?o para a investiga??o dos aspectos democr?ticos envolvidos na representa??o da UFRN junto aos Conselhos, oportunizando a verifica??o de seu papel neste contexto, pelas possibilidades de contribui??o ao processo de democratiza??o do Pa?s. O surgimento dos conselhos gestores de pol?ticas sociais revela a for?a da participa??o do cidad?o na interven??o e na formula??o das pol?ticas p?blicas, com o objetivo de aumentar sua efici?ncia por meio do controle social. Conclui-se que se faz necess?rio maior destaque para as representa??es sociais nos conselhos gestores e melhores condi??es para ampla participa??o dos membros da Universidade nestes espa?os, objetivando alcan?ar reais possibilidades de contribui??o e efetivo exerc?cio da delibera??o p?blica. / This paper discusses the UFRN participation in the Councils Municipal Managers of Social Policies through a case study of its representation in the Municipal Board of Education in Natal / RN, as the democratic participatory system assumption adopted by the Federal Constitution of 1988. The descriptive search, as a transversal character, with data collection gathered in the Council and by semi-structured interviews with representatives of the UFRN Education Center, as well with the effective members of CME, will have a qualitative approach to analyze the obtained content. Therefore, we start understanding that throughout history democracy has become the political system best suited to the social organization, protection of individual rights and freedoms and that popular sovereignty has established itself as the foundation for its legitimacy. In this respect, social participation is presented as one of the most important tools of democracy and true expression of popular sovereignty. Therefore, it opens up space for research of democratic aspects involved in the representation of UFRN close to the Councils, providing opportunities to check its role in this context, the contribution of possibilities to the country's democratization process. The emergence of social policies management councils reveals the strength of citizen participation in the intervention and the formulation of public policies, in order to increase their efficiency through social control. Therefore, this study focused on democratic theories to analyze how they can contribute to the improvement of management councils, as well as the role of the Academy in this regard. A certain influence of the Municipal Executive was detected in the activities of the Council, limiting the autonomy of its activities and the amplitude of the scope of the deliberations initiated there. About the UFRN's chair at the CME in Natal, it does not constitute a full and wide representation of the Institution, it is confined to the Education Center and is compromised at a time when there are no discussions at the University about its positioning on the issues to be addressed Deliberated in that instance. It is concluded that it is necessary to emphasize social representations in the management councils and better conditions for broad participation of the members of the University in these spaces, aiming to reach real possibilities of contribution and effective exercise of public deliberation.

Democratic Ethical Life and the Struggle for Recognition: AReconstruction of Hegel’s Inluence on Deliberative Democracy”. Hegel’s politicalphilosophy represents a signiicant contribution to the understanding of moderndemocracy and social dynamics. As regards modern democracy, the concept ofdemocratic ethical life presented by Wellmer allows for the integration of equalsubjective rights and citizen participation in a deliberative culture that illsdemocracy with citizen vitality without going against individual liberties. As forsocial dynamics, they can be explained by the need for reciprocal recognition asthe key to the constitution of subjectivity, which explains the moral motivation inthe struggles of social groups. Both concepts are closely interwoven because thestruggle for recognition allows for an explanation of the dynamics of democraticethical life. Thus, democratic ethical life and the struggle for recognition, asinterwoven concepts, offer two key notions for the solution of some of the obstacleswith which contemporary political philosophy must deal. / La ilosofía política de Hegel ofrece una signiicativa contribución parala explicación de la democracia moderna y de la dinámica social. En el primercaso, el concepto de eticidad democrática, que Wellmer postula, permite integrarderechos subjetivos iguales y la participación ciudadana en una cultura deliberativaque dota a la democracia de vitalidad ciudadana sin violentar libertadesindividuales. En el segundo caso, la dinámica social puede ser explicada a partirde la necesidad de reconocimiento recíproco como clave de la constitución de lasubjetividad, que explica la motivación moral de las luchas de los grupos sociales.Ambos conceptos se encuentran internamente ligados ya que la lucha porel reconocimiento permite explicar la dinámica de una eticidad democrática. A discussão contemporânea sobre a organização de uma sociedade política que estabeleça princípios normativos visando à legitimação do Estado de direito está no epicentro da fundamentação das teorias de democracia deliberativa. Assim, indagaremos sobre a estruturação de mecanismos constitucionais que possibilitem o exercício dos direitos políticos para a formação da opinião pública. A tese a ser defendida é que há pontos problemáticos na teoria deliberativa de Habermas que dificultam a sua aplicação na práxis social. O que observamos é a necessidade do estabelecimento de mecanismos para a defesa dos cidadãos perante a forma instrumental por meio da qual os sistemas sociais operam na sociedade capitalista tardia. Por isso, com o auxílio da teoria de democracia contestatória e a concepção de liberdade republicana, apresentadas por Pettit, almejamos salvaguardar os princípios discursivos da teoria habermasiana de democracia e, ao mesmo tempo, possibilitar uma ampliação no processo de reconstrução normativa e discursiva do Estado democrático de direito. A teoria republicana de liberdade como não-dominação nos oferece um estratagema para escapar da aporia na qual as teorias contemporâneas de democracia deliberativa encontram-se aprisionadas, em particular, no que se refere à finalidade de equilibrar a força de legitimação do poder comunicativo e a sua influência na formatação do aparelho administrativo-estatal. / The contemporary discussion on the organization of a political society to establish normative principles aimed at legitimizing the rule of law is at the epicenter of the grounds of deliberative democracy theories. Therefore, we inquire on structuring constitutional mechanisms that enable the exercise of political rights for the formation of public opinion. The thesis to be defended is that there are trouble spots in the deliberative theory of Habermas that hinder their implementation in social praxis. What we observe is the need to establish mechanisms for the protection of citizens before the instrumental means by which social system operate in late capitalist society. Therefore, with the help of contestatory democracy theory and the design of republican liberty, presented by Pettit, we aim to safeguard the discursive principles of Habermas\' theory of democracy and at the same time, enabling an expansion in the process of normative and discursive reconstruction of the democratic state of law. The republican theory of freedom as non-domination gives us a ploy to escape quandary in which contemporary theories of deliberative democratic are trapped in particular as regards the purpose of balancing the legitimacy under power communicative and their influence in shaping the administrative-state apparatus.
