Les contributions de la pratique de l'arbitrage d'investissement en Amérique latine au développement de l'arbitrage international / From the contributions to Arbitration practices in Investment in Latin America to development to International Arbitration

Depuis les années deux-mille, les Etats latino-américains ont activement participé aux arbitrages d’investissement administrés par le Centre international pour le règlement des différends relatifs aux investissements (CIRDI). Ainsi, la pratique arbitrale de ce Centre trouve son origine dans les très nombreuses affaires latino-américaines qui ont permis d’encadrer la procédure et d’entériner certaines pratiques liées aux questions de fond de l’arbitrage. Les affaires latino-américaines ont enrichi la procédure en consacrant notamment la participation des tiers à la procédure arbitrale par le biais de l’amicus curiae (l’ami de la Cour). Cette innovation démontre la prise en compte de l’impact des questions d’intérêt public sur les populations concernées. Les divers standards juridiques insérés dans les accords d’investissement ont également été invoqués par les investisseurs afin de voir engagée la responsabilité internationale des Etats. Ainsi, les arbitres ont pu s’exprimer sur le caractère imprécis de certains standards comme celui du traitement juste et équitable. Les tribunaux ont dégagé certains étalons de mesure qui permettent d’évaluer et de comparer les éléments de l’affaire. Deux étalons de mesure semblent être pertinents dans le cas latino-américain. Il s’agit du respect de la stabilité du cadre juridique puis de la protection des attentes légitimes de l’investisseur. C’est dans ce cadre que les Etats latino-américains ont réagi différemment face au contentieux arbitral auprès du CIRDI, ce dernier ayant fait l’objet de critiques quant à sa légitimité et quant aux différentes condamnations prononcées par les tribunaux à l’encontre des Etats. Certains Etats ont pris l’initiative de dénoncer les accords internationaux donnant compétence au CIRDI et de créer un nouveau centre d’arbitrage sur le continent, capable de connaître les différends en matière d’investissement. Ceci dit, les décisions et sentences arbitrales rendues dans le contexte latino-américain constituent une source d’inspiration précieuse pour les arbitrages internationaux en cours et futurs. / Since 2001, Latin American Countries have actively participated in investment arbitrations administered by the International Centre for Settlement of Investment Disputes (ICSID). Because of that the way to arbitrate in this Centre base itself on a great number of Latin American affairs which helped to delimit the procedures and endorse some practices linked to the very founding principles of arbitration.The procedure of arbitration has been improved by Latin American affairs, by example with the help of the Amicus Curiae, which is the participation of a third party to the arbitral process. This innovation shows how much these questions of public interest are important for the populations concerned.The multiple juridical standards inserted in the investment agreements have often been brought forward by the investors in order to see the responsibility of some countries engaged in an international way. Arbitrators have been able to emphasize on the inaccuracy of some of these standards, such as the the fair and equitable treatment.Different ways to measure the elements of an affair have been brought to light by the tribunals. Two of them are present in the case of Latin American affairs: the compliance with the juridical framework stability and the protection of the investor's legitimate expectations.Latin American countries did take action differently in front of the arbitrations brought to the ICSID which was criticized for its lack of legitimacy and for its decisions in a great number of cases against these countries. Some countries renounced the international treaties giving the ICSID its arbitration rights and created a new arbitration center on the continent capable of giving a ruling in the matter of investment affairs. In spite of this the arbitral decisions and the arbitral awards in the Latin American context should be able to be inspirations for the future of arbitration.

That is, the penalty clause is a simple formula arising from Roman law. This formula establishes a social relationship based on legal standards that justify its compliance under all aspects, including philosophical aspects, as to the application of the right to the concrete case, in order to reach justice. And the value of the punishment and the equitable reduction of the penalty, expressly dealt with in the new Civil Code, are the parameters to dimension the value amount at each case. The purpose of this essay is to demonstrate that the value of the punishment and the equitable reduction of the penalty as a prerequisite for the application of the penalty clause will serve to measure the standard of value of the penalty in case of total or partial default, non-execution of some special clause or delay. The standard of value of the penalty is under the responsibility of our courts in pursuit of a legal democratic state, a state that guarantees the fundamental rights of the human being. The study of this topic is justified by the attempt to settle visible conflicts among principles that guarantee fundamental rights. This is entitled theory of the weighing of goods and values. This essay is of topical interest since this is a concrete issue in several countries that have a similar legal structure. As from 2002, the Brazilian system established that the equitable reduction of the penalty is mandatory. Before 2002, this reduction was a judge‟s prerogative. The methods used in this research were basically the deductive and inductive methods under a dialectic perspective. The results obtained were the following: 1) a judgment will be fair if the application of the law to the concrete case was correct. And it will be correct the application of the law that took into consideration the real or substantial equality of the parties - to treat equal persons equally and to treat unequal persons unequally in the exact measure of their inequality; 2) this is reached through the application of the adequate value of punishment; and 3) as to the equitable reduction of the penalty, it became mandatory at the time of its application. In the past, this reduction was a judge‟s prerogative that many times did not exercise it / A cláusula penal o valor da cominação e a redução equitativa da pena está ligada aos direitos imemoriais, isto é, uma fórmula simples proveniente do Direito Romano que determina uma relação social estruturada em standards legais que justificam sua observância sob todos os aspectos, inclusive filosóficos, de como aplicar o direito ao caso concreto para atingir a justiça. E o valor da cominação e a redução equitativa da pena, contemplada expressamente no novo Código Civil são os parâmetros para se dimensionar o quantum valorativo a cada caso. O objetivo deste trabalho é demonstrar que o valor da cominação e a redução equitativa da pena como pressuposto para aplicação da cláusula penal servirá como mensurador do padrão valorativo da penalidade em caso de inadimplemento total ou parcial da obrigação, inexecução de alguma cláusula especial ou à mora que encampa nossos tribunais em busca de um Estado Democrático de Direito garantidor dos direitos fundamentais da pessoa humana. O estudo deste tema justifica-se pela busca em resolver conflitos aparentes entre princípios garantidores de direitos fundamentais. É o que se chama de teoria da ponderação de bens e valores. O trabalho é atual, porque tal discussão se mostra concreta em vários países de semelhante modelo jurídico, sendo que o nosso sistema a partir de 2002 tornou obrigatória a redução equitativa da pena, antes faculdade concedida ao juiz. Os métodos utilizados nesta pesquisa foram basicamente os métodos dedutivos e indutivos sob uma perspectiva dialética. Os resultados obtidos foram: 1) uma sentença será justa se a aplicação da lei foi a correta para o caso concreto. E será correta a aplicação da lei que atentou à igualdade real ou substancial das partes: tratar os iguais de maneira igual, e os desiguais, desigualmente na exata medida de sua desigualdade; 2) e isto é alcançado através da aplicação do valor adequado da cominação; e 3) já a redução equitativa da pena tornou-se obrigatória quando de sua aplicação, antes faculdade atribuída ao juiz, que por muitas vezes não o aplicava

The purpose of this Master’s Report was to determine an appropriate preservation strategy for a particular set of buildings and their accompanying art from the Modern Architecture Movement. The research question was: What type of strategy is best suited for the preservation of installed art created for Modern style buildings? The study analyzed preservation strategies afforded to Modern art and architecture during rehabilitation of the buildings. The case studies are Modern Movement office or bank buildings with art commissioned for the space by the architects or owners. An analysis of the main case study’s preservation strategies looks at all the actions taken and proposed to protect, not only the material fabric of the art, but the primary interior space. The main case study was the American National Bank building in Austin, Texas designed by Kuehne, Brooks and Barr Architects with a mural by Seymour Fogel. The secondary case studies were: Harry Bertoia sculpture + Manufacturers Trust Building, New York City, Pietro Belluschi mural + Equitable Building, Portland, Oregon, Richard Lippold sculpture + Inland Steel Building, Chicago, and Roger Darricarrere dalle de verre + Columbia Savings Buildings, Los Angeles. After study and analysis, the preservation strategies were categorized in four categories: in situ conservation, removal, recreation/replacement and demolition/destruction. It was concluded that there is not a general approach for these projects, and each should be analyzed through various factors (Design Intent, Intrinsic Value, Collaboration and Context) to determine the appropriate intervention. / text

Brief descriptions of the doctrine of appropriation, diffuse surface waters and developed waters are presented to illustrate the complexities of the problem of urban runoff development. It is suggested that planners must not only be aware of the legal issues involved but also must understand the philosophy and principles of water law.

Provision of education to minority groups in Austria

Austria's aim to provide equitable education to its citizens is an ongoing process. In 1747 a decree opened schools to all children. From 1891 to 1941 schooling was compulsory for children between 6 and 14. In 1955 the Austrian Constitution guaranteed Austrian minority groups equal access to education. In 1966 and 1976 legislation further guaranteed minority groups' right to be taught in their home language subject to certain provisos. Currently minority groups are supposed to be taught in their horne language for the frrst three years of school and school is compulsory for nine years. This study wished to establish whether minority groups are, in fact, provided with education as provided for by law, and examined the situation in the United States of America, the United Kingdom and Canada as well. Le modèle de production, consommation et distribution agro-industriel fait l’objet depuis les années 1970 de critiques portant sur son impact environnemental, économique et sociétal. En réponse à ces critiques, s'est développé depuis les années 60 au Japon, 80 aux États- Unis, et plus récemment en France, une diversité d’initiatives et d’expérimentations socio-économiques visant à soutenir une agriculture plus respectueuse de l’homme et de la planète, basée sur de nouvelles formes d’organisation et orientée vers des échange économiques plus justes. Ces initiatives, qualifiées de systèmes agro-alimentaires alternatifs, associent de manière variée des modes production respectueux de la planète (agriculture raisonnée et biologique, agro-écologie, permaculture. Ils s’appuient par ailleurs sur des formes organisationnelles ancrées dans des dynamiques d’économie sociale et solidaire : Amaps, circuits-courts, coopératives, initiatives de commerce équitable local. Ils développent ainsi des modèles de gouvernance et d'organisation qui reconsidèrent les finalités et les modalités de l’activité économique et sont animés par une volonté de s’engager dans une « autre économie ». La question de la justice dans l’échange, incarnée par la cherche d'un prix juste, est centrale pour ces initiatives.Dans ce contexte, la thèse propose d’analyser la construction d’un prix juste au sein d’un système agro-alimentaire alternatif, engagé dans une démarche de commerce équitable local et s’appuyant sur une forme organisationnelle innovante. Il s’appuie sur le suivi, pendant trois ans, de la Société Coopérative d’Intérêt Collectif Alter-Conso, engagée dans la distribution hebdomadaire de paniers issus de l’agriculture biologique, locale et paysanne dans 14 lieux de distribution de l’agglomération lyonnaise. Cette SCIC se caractérise par un projet d’entreprise orienté vers une transformation des modes de production et de consommation alimentaire, et s'appuie sur une démarche ancrée dans les principes et valeurs coopératives. Elle réunit autour d'un même projet quatre catégories d'acteurs : salariés, producteurs, consommateurs, et sympathisants. Au sein de la coopérative, l’activité marchande est le support d’un projet avant tout sociétal et politique, orienté vers une transformation des pratiques agricoles et des modalités de gestion de l’activité économique. La thèse propose d’analyser comment les acteurs de la coopérative construisent un prix juste, au regard du projet d’entreprise et de ses modalités d’organisation.La thèse permet de montrer que la construction du prix juste au sein de cette organisation reflète une exigence de justice à la fois procédurale, commutative, et distributive. Ce travail met par ailleurs en évidence un processus de fixation du prix alternatif au prix de marché, et qui incarne les spécificités d’une organisation coopérative à finalité sociale. La construction du prix juste intègre par les finalités et les valeurs de la coopérative, à la fois dans les critères de définition et dans le choix des procédures de fixation du prix. Le prix juste est ainsi construit sur la base d’une discussion et indépendamment des variations de l’offre et de la demande. Il est défini sur la base d’une relation tripartite, durable et compréhensive entre producteurs, salariés et consommateurs de la coopérative, caractérisée par une reconnaissance des besoins réciproques des acteurs concernés par l'échange. / The industrial model of food production, consumption and distribution has been criticised since the seventies in reference to its environmental, social and economical impacts. These critics led to the emergence of a diversity of socio-economic initiatives, engaged in the promotion of a model of agriculture that is more respectful of the planet and its inhabitants, based on new organizational forms and oriented towards fair economic exchange. These alternative food systems refer to a diversity of production methods, including responsible and organic farming, agroecology, permaculture. Alternative food systems generally rely on organisations engaged in a social or solidarity economy : Community supported agriculture, short food supply channels, cooperatives, local fair trade. They reconsider the purpose and terms of economic activity and are driven by a desire to engage in an alternative economy. The question of fairness in exchange, embodied by the will to define a fair price, is of central matter for these initiatives.In this context, this thesis aims at analysing the construction of a fair price within an alternative food system. This system is engaged in a dynamic of local fair trade, and is based on an innovative organizational form. An empirical study has been conducted during three years within the cooperative Alter-Conso. This social cooperative proposes a weekly distribution of local and organic food products, in 14 delivery points in and around the city of Lyon. It puts forward the values and principle of a social and solidarity economy, and brings together into cooperation four categories of members : employees, producers, consumers, supporters. In this sense, economic activity aims primarily at achieving a social and political goal, oriented towards a transformation of agricultural practices and questioning the dominant management practices of economic life. The thesis aims at analysing how the members of the cooperative construct a fair price, considering its social project and its organizational form.The thesis shows that the construction of a fair price articulates three forms of justice : distributive , commutative, and procedural. It shows how the cooperative defines a price definition process that is an alternative to the market price. Indeed, the price construction takes into account the values and social goals of the cooperative, both in the criteria that define a fair price and in the price fixation process. The price construction is based on a discussion among the cooperative’s stakeholders, regardless of the variations of supply and demand. It is constructed on the basis of a lasting, comprehensive and tripartite relationship between the producers, the consumers, and the cooperative employees. The relationship is based on reciprocity and on the recognition of the needs of all the people affected by the exchange.

Cette étude traite de la répartition de la richesse nationale en Turquie vis-à-vis des principes démocratiques. La richesse nationale peut être formulée à des fins d'utilisation dans le domaine juridique comme le total du patrimoine des ménages et des personnes morales de droit public de l’année précédente additionné au produit national net de l'année donnée. La démocratie exprime la possibilité pour chacun de participer à la politique (la participation) avec ses différences (dans ses intérêts- selon son revenu, son âge, son état de santé et des états similaires- et son idéologie) et d’avoir ainsi une influence en politique à travers ses différences (le pluralisme). Cette étude se base sur l'idée que doit être analysée avant tout la manière dont est répartie la richesse du peuple pour savoir si l'Etat revêt un caractère démocratique. En effet, l’attente de chacun d’une organisation comme l’Etat ne peut être qu’une meilleure vie et cette dernière satisfaisant tous les besoins des hommes tels que l’hébergement, la santé, l’enseignement, la liberté, la culture, les espaces verts a une contrepartie monétaire. / This study deals with the distribution of the national wealth in Turkey according to the principles of democracy. National wealth can be formulated for use in the legal field as the sum of the previous year’s household assets and the assets of legal persons governed by public law added to the net national product of the current year. Democracy is the possibility for everyone to participate in politics (participation) with his or her differences (in his or her interests based on income, age, state of health and similar conditions and his or her ideology) and thus to have an influence in politics through his or her differences (pluralism). This study is based on the idea that the way which the national wealth is distributed must be brought up before anything else, in order to find out whether a state has a democratic nature or not. Indeed, everyone expects a better life from an organization like the state, and such a life satisfying all human needs such as housing, health, education, freedom, culture, green spaces has a monetary consideration.

Perceptions about Student Diversity and Equity in Early Childhood Science Education: A Teacher Preparation Study

Using a mixed-methods approach, the current study examined the relationship between early childhood preservice teachers' cultural awareness and their self-efficacy in equitable science education. It further aimed to determine if the relationship between these two constructs was moderated by their race/ethnicity or the number of languages they speak. Finally, it sought to identify preservice teachers' understanding of equity in science education, as well as how they planned to incorporate the equity concept into their future science teaching practices for diverse learners in early childhood classrooms. Data for this study were drawn from 380 preservice teachers who self-enrolled in a science methods course as part of a teacher preparation program. To measure the preservice teachers' cultural awareness and self-efficacy in equitable science education, two Likert-scale instruments, Cultural Diversity Awareness Inventory (CDAI) and Self-Efficacy Beliefs about Equitable Science Teaching and Learning (SEBEST), were employed. Qualitative data were collected by administering six open-ended questions. For quantitative results, statistically significant findings indicated that when the participants were more aware of creating a multicultural environment and instruction and/or when they were less biased and were more sensitive/knowledgeable about diversity of students and families, their expectations about science learning of students from diverse backgrounds would be higher. Furthermore, when the participants were more aware of creating a multicultural environment and instruction and/or when they felt more comfortable about confronting students or parents whose cultures and languages were different from their own, they tended to have a stronger sense of efficacy in teaching science to those students. In addition, when the participants were less biased and were also sensitive and knowledgeable about students' and families' diverse backgrounds, they were more likely to have a strong sense of science teaching efficacy. Along with these findings, participants' race/ethnicity was a statistically significant moderator affecting the relationship between their sense of science teaching outcome expectancy and awareness of creating a multicultural environment and instruction. When the awareness of creating a multicultural environment and instruction of both White and non-White participants were increased at an equal level, White participants' expectations for science learning of students from diverse backgrounds were higher than those of non-White participants. Measurement challenges were identified through the analysis process that compromised the validity of the quantitative findings. Thus, they should be interpreted with caution. For qualitative results, three predominant themes related to the participants' conceptualization of equity in science education were identified. First, the participants harbored alternative understandings of the definitions of equity in science education. One third of the participants understood equity as providing appropriate access and support based on the levels of students' needs whereas another one third defined equity as providing identical teaching services and resources to all students regardless of their backgrounds. They also conceptualized equity in science education as an issue independent of their future students' racial/ethnic backgrounds; instead, they regarded it as a subject associated with their students' English proficiency.

Ainsi, l'État congolais mise sur l’amélioration de son arsenal juridique interne dont l’objectif consiste à attirer de nombreux investisseurs et investissements étrangers sur son territoire. Pour ce faire, des réformes tendant à l’amélioration de principaux textes juridiques applicables directement ou indirectement en matière d’admission et de sécurisation des investissements étrangers afin de se conformer aux standards internationaux deviennent une obsession pour cet État, dont la finalité demeure : la valorisation de ses ressources naturelles notamment le cobalt, le germanium et la colombo-tantalite etc. très souvent inexploitées et utile à même de servir à la production des batteries pour les voitures électriques. Il serait donc nécessaire désormais que le contrôle de l’État souverain sur ses ressources naturelles considérées comme des minerais stratégiques soit davantage renforcé et que le contentieux en matière d’investissement soit confié à des entités qui prennent en compte l’intérêt général au détriment des arbitrages sous l’égide des arbitres privés, défendant les intérêts privés. Ainsi, la création d’un Centre international africain de règlement des différends pourrait être profitable notamment en permettant aux experts africains - tant arbitres qu’avocats - d’être plus présents dans le cadre des procédures impliquant leurs États d’origine / Foreign investment is now considered a key factor or even an added value that can facilitate the development of the host country. Thus, the Congolese State is focusing on improving its domestic legal arsenal, the objective of which is to attract many foreign investors and investments to its territory. To this end, reforms aimed at improving the main legal texts directly or indirectly applicable to the admission and security of foreign investments in order to comply with international standards are becoming an obsession for this State, the purpose of which remains: the development of its natural resources, in particular cobalt, germanium and colombo-tantalite etc., which are very often unexploited and useful for the production of batteries for electric cars. It would therefore now be necessary for the sovereign State to strengthen its control over its natural resources considered as strategic minerals and for investment litigation to be entrusted to entities that take into account the general interest to the detriment of arbitrations under the aegis of private arbitrators, defending private interests. Thus, the creation of an African International Dispute Resolution Centre could be beneficial, in particular by allowing African experts - both arbitrators and lawyers - to be more present in proceedings involving their States of origin

This thesis attempts to apply the Representative Bureaucracy theory established and developed within the Public Administration scholarship addressing the lack of formal accountability of bureaucratic bodies on the case of the largest international bureaucracy in the world - the United Nations Secretariat. It builds on the normative presumption that it is necessary to staff the bureaucracy proportionally from all the societal groups so that it reflected the values of the society in whole and the policy outcomes corresponded to those produced if all the society participated in the process. Accordingly, we aspire to find out whether the UN Secretariat is a representative sample of the world population in terms of its bureaucrats' national affiliation, and, if not, what are the factors associated with a better relative representation of a Member State in the UN Secretariat. Through the usage of descriptive statistics tools and Ordinary Least Squares Multiple Linear Regression, we find out that the per capita representation of different Member States in the UN Secretariat is by no means equal and, thus, the UN Secretariat is not a representative sample of the world population.
