Právní aspekty nezapsaných označení zboží a služeb užívaných v obchodě / Legal Aspects of the Unregistered Marks of Goods and Services Used in the Course of Trade

Vozáb, Jakub January 2005 (has links)
This dissertation theses addresses the phenomenon of the unregistered mark for goods and services in accordance with trade mark law of the Czech Republic, while taking into consideration the given scope of EU law and its comparison with the legal protection of applied trade marks in the framework of the "passing-off" doctrine of the legal systems of the United Kingdom of Great Britain and Northern Ireland. While the subject of trade marks has already been thoroughly established in juristic theory and has also become commonplace in legal practice, the institute of the unregistered trade mark has not yet to be comprehensively examined, and as such it presents significant difficulties in applied practice, as it bears no solid legal foundation, and in the context of the regulations of trade mark law it is always possible to identify specific special entitlements arising from the existence or application of unregistered trade marks, whereas the nature of their verbal formulations and systematic classification presents difficulties in the interpretation and application of such entitlements. The basis for this reasoning is namely the historical evolution of the phenomenon of the unregistered mark in trade mark law in Austrian, respectively in subsequent Cisleithania, and its reception and evolvement within Czechoslovak law as the legal predecessor to the Czech Republic. The goal of the research presented herein is to identify answers to the underlying theoretical questions concerning unregistered marks of fundamental significance to applied practice, and in so far as they concern the nature of the unregistered mark as perceived by trade mark law and its definitional attributes, terms of origin, duration, and expiration of unregistered marks, or more precisely as they concern rights to them, as well as the terms and scope of disposition with unregistered marks, namely in so far as they in turn relate to transfer or conversion and the grant of license or other temporary right of use. Subsequently, the establishment of answers to the aforementioned questions addresses the problem of the absence of an explicit legal principle to the phenomenon of the unregistered mark and the interpretation difficulties offered in the poorly formulated laws and subsequent fluctuations in legal practice. This problem is examined within the legal setting of the Czech Republic as a democratic nation with a market economy, in which holds true the classic legal rudiment of "that which is not prohibited by law is permitted", and in which hold true the fundamental and indefeasible rights of man, a component of which is the right to freely pursue economic activities and possess property within a framework of restrictions favouring the preservation of the rights of others as set forth by the law.

Dopady úpravy v novém občanském zákoníku do pojištění odpovědnosti za škody / The impact of the new Civil Code on liability insurance

Klierová, Irena January 2014 (has links)
On 1 January 2014 the new Civil Code, the most important piece of legislation, has come into effect. It is a part of large recodification of the Czech civil law. This thesis, "The impact of the new Civil Code on liability insurance", points out the most significant changes and the implications which effects, among others, the insurance sector. The first part of the thesis addresses mostly the theoretical concept of liability, the elemental preconditions of liability and methods of compensation for material and immaterial damage, including comparison of claim rights under former legal norm and the current legal norm. It also mentions the ambiguity in law in case of compensation for work-related injuries and occupational diseases. The second part of the thesis is dedicated to describing the process of implementation of the new Civil Code to operation of insurance companies from both legal and financial point of view. This includes evaluation of the impact of the changes on settlement of compensation claims for immaterial damage from the first available data. The third part is focused on the characteristics of liability insurance and its construction. It includes basic breakdown by legal bindings and a description of types of liability insurances. The conclusion contains overall assessment of liability insurance on the Czech insurance market.

Développement local et Culture Occitane / Local development and Occitan culture

Thibal, Suzanne 04 February 2012 (has links)
The Occitan language and culture now play an important part in the cultural development programmes of organized public areas, such as a regional natural park and rural districts, in the South of France. Many initiatives have been taken for the protection and valorization of the living memory of a traditional popular culture ; their implementation may benefit from news regulatory and financial measures from the Departments, Regions as well as from European programmes. At the same time, the (material as well as immaterial) heritage has been acknowledged as a major axis of sustainable development by International Institutions ; indeed, they recommend its valorization as an ident marker that facilitates social cohesion.--- From this point of view and through a systemic review of the international founding texts, European programmes, policies of the local authorities, charters and action plans of regional natural parks, cultural events and netwworks of local actors, the thesis, Local development and Occitan culture, analises the forces and weakness of the established parternships, and declineates the Occitan imprint on the local development.

How an archival collection is created

Kaijser, Ella January 2021 (has links)
In 2020, several Nordic archives and museums sent out ”question lists”, questionnaires, to collect the public’s experiences of the Covid-19 pandemic. The collections resulted in an incomparable collection of contemporary cultural history about the Covid-19 pandemic. The aim of this thesis is to follow the creation of this collection. The thesis is defined through three research questions: one asking about the initial creation of the collection projects, one about the implementation, and one about what will happen to the resulting collection as an archival material. The study is based on previous research about Nordic contemporary Mass-Observation projects and question lists, as well as health narrative studies and research about Covid-19 experiences. Aspects of the previous research are used to create a theoretical framework, based around the concept of actors in accordance with Giddens structural theory (Johansson 2003:422). The three primary terms that are used in the analysis are dialogue, (immaterial) monument, and post-custodial archives, all retrieved from previous research in the field. The empirical data is collected through semi-participatory observation and documentation of the question lists, as well as interviews with responsible personnel at the institutions. The analysis is divided into three chapters, based on the three research questions. The first chapter thus concerns the initial creation of the collection projects, with regards to the design of the question lists, and the institutions’ thoughts and aims with the projects. The term dialogue is used to analyse the interaction between and within the institutions during this process. The second chapter studies the implementation of the actual project and includes an analysis of the question lists themselves as well as the digital interface through which they are made accessible to the public. Here, too, the term dialogue is used, to analyse how the answers are made in the interaction between the institutions and the public. The third chapter studies the institutions’ plans and hopes for the collected experiences, with regards to future research projects and exhibitions as well as archiving. Here, the term monument is used to illustrate the value and usage of the overall collection. Post-custodial archives are also used to highlight discussions about how digital archival collections should be archived and made accessible. The thesis closes with a final discussion chapter, which expands on the questions about what the purposes of these kinds of collections are, as well as about what role and place archiving should have in the creation and implementation of these kinds of Mass-Observation projects. This is a two years master's thesis in Archival science.

Les biens immatériels saisis par le droit des sûretés réelles mobilières conventionnelles / Intangible assets seized by the conventional law of guarantees

Pinto Hania, Vanessa 07 December 2011 (has links)
Immaterial assets are traditionally described either as intangible assets or as intangible or intellectual property, or else as operating assets, but most of those terms are not satisfactory. This class of assets actually suffers from a lack of definition. However, some people state that they represent a form of economic wealth, a fantastic source of credit for the debtors, and a guarantee of safety for the creditors. And yet, French legislation seems to have ignored immaterial assets. This is first and foremost demonstrated by property law. Indeed, according to article 516 of the Code civil, which states that « property is either movable or immovable », one has to admit that immaterial assets cannot validly be linked to movable or immovable property. Immaterial assets are opposed to material assets (property of nature, commodities, intellectual property of the public domain or without protection under intellectual property law). They refer to property that has an object and a corpus. Two types of immaterial assets have been identified: financial immaterial assets, bringing together currencies, units and shares in a company, financial instruments, liabilities and industrial immaterial assets, bringing together business and intellectual property. This is also demonstrated by conventional real-property surety law. The surety law reform project which was awarded to the Grimaldi Commission was the source of significant hope. It had only been rarely amended since the inception of the Code civil and the structure was weakening and needed updating. This weakening had three main grounds : readability first, in particular since conventional real-property surety law on immaterial assets had developed outside of the Code civil, efficiency and capability of the contemplated systems regarding the preservation of the interests of the debtor and the creditor. Practice and doctrine had been denouncing such complexity for long and were calling for amendments. Unfortunately, order n°2006-346 of March 23rd 2006 reforming surety law didn't restore confidence. By creating the lien as the conventional real-property surety on immaterial movable assets without creating a consistent system, it has only emphasized the obvious concerns and critics. However, we are convinced that French law has the means that are essential to save this subject. Indeed, the new system of pledge, as amended by order n° 2006-346 of March 23rd 2006, now has a system that is suitable for industrial immaterial assets. As for the “fiducie-sûreté”, established by Act n° 2007-211 of February 19th 2007, it has revealed that, through the experiences observed abroad, it is fully efficient when it deals with financial immaterial assets.

The replacement of the doctrine of pith and marrow by the catnic test in English Patent Law : a historical evaluation

Zondo, Raymond Mnyamezeli Mlungisi 02 1900 (has links)
This dissertation is a historical evaluation of the movement of the English courts from the doctrine of pith and marrow to the Catnic test in the determination of non-textual infringement of patents. It considers how and why the doctrine was replaced with the Catnic test. It concludes that this movement occurred as a result of the adoption by a group of judges of literalism in the construction of patents while another group dissented and maintained the correct application of the doctrine. Although the Court of Appeal and the House of Lords initially approved the literalist approach, they, after realising its untennability, adopted the dissenters’ approach, but, ultimately, adopted the Catnic test in which features of the dissenters’ approach were included. The dissertation concludes that the doctrine of pith and marrow, correctly applied, should have been retained as the Catnic test creates uncertainty and confusion. / Mercantile Law / LL.M.

Augustynek, Dariusz 10 1900 (has links)
Historical origins of regional economic cooperation as a non-hegemonic form of cooperation. Abstract. This thesis examines the emergence of the regional economic cooperation as a non-hegemonic form of cooperation. We propose an alternative to the prevailing conception of hegemonic origin of systemic cooperation, proposed by the neorealist and neoliberal theories. Rather than relying on theories of the market, we focus instead on some critical processes of the anarchical structure itself, such as creation of forms of war by anarchy. More specifically, we focus on the forms of war that put the anarchical structure under maximal strain, bringing it to an overwhelming systemic crisis, the fall of a hegemonic power, the end of a hegemonic system, and the onset of a non-hegemonic systemic cooperation of more regional and economic nature. Prioritizing the historical approach we stress especially the role of long-distance trade and international credit in the construction, by the anarchical structure itself, of forms of war impossible for the hegemonic power to withstand.

The attempt to reconstruct the history of the festivals Nossa Senhora de Casaluce, Nossa Senhora Achiropita, São Vito, São Francisco de Paola and São Gennaro, permitted to discover other questions that are not limited to the description or recovery of a tradition. In search of the origin of these festivals in Italy, the field of study broadened, providing an analysis of today s much discussed issues like citizenship, identity, diversity and multiculturalism. These issues did not just complete the initial proposition, but opened ways to a more far-reaching discussion than it could have been imagined in the beginning / O registro das festas populares como Patrimônio Imaterial, neste trabalho especificamente as festas de origem italiana na cidade de São Paulo, representa muito mais do que um reconhecimento da importante influência cultural dos imigrantes.
