Depuis 1990, l’Afrique de l’ouest connait une phase complexe dans sa sécurisation et dans la lutte contre les conflits armés. Constamment déstabilisés par des tentatives de coups d’Etat militaires, les pays de l’Afrique de l’ouest, notamment la Côte d’Ivoire, le Libéria et la Sierra Léone ont bénéficié d’une aide de la communauté internationale pour le règlement des sources de conflit et le redressement de leurs institutions dans le cadre d’une démocratisation globale des pays africains. Malgré cette ingérence dans les affaires internes des Etats, les stratégies adoptées par organisations internationales pour sortir la sous-région ouest africaine de l’instabilité et l’insécurité continuent de poser problèmes. Les Etats restent encore fragiles. Dans l’aide apportée, les différentes agences spécialisées des Nations unies construisent plutôt un ensemble de réseaux avec les organisations non gouvernementales internationales (ONGI) pour la gestion des conséquences des conflits armés. Ces ONGI, tout en participant à la stratégie globale de sortie de crise renforcent leur position au niveau national tout en s’ouvrant à de nouvelles missions d’assistance. Malgré les différentes dispositions prises par la CEDEAO, l’Organisation de l’Unité africaine et de l’Union africaine pour prévenir les conflits et trouver des mécanismes pour leurs gestions et leur règlement, les pays étudiés ne parviennent pas à consolider durablement la paix. Les Etats membres profitent du chaos généré, luttant plus pour leurs propres intérêts que ceux de la sécurité et le retour à la paix. Face à ce manque de cohérence dans les actions et aux limites des stratégies adoptées jusque-là, la résolution des conflits armés en Afrique de l’ouest continue de suscité interrogations, amenant à proposer une nouvelle approche de la résolution des crises armées en Afrique. Cette thèse vise donc à comprendre les stratégies des organisations internationales, leur efficacité et leur faiblesse dans le retour à la paix et le renforcement des institutions démocratiques. / Since 1990, the West African states face insecurity and the struggle for armed conflict resolution. They are mostly destabilized by military coup. International community support Côte d’Ivoire, Liberia and Sierra Leone in the research of conflict solutions and the building of democratic institutions in the African states. Instead of the interference of the international organization in the African’s internal affairs and the strategies adopted, the insecurity continues to be a real problem for the stability of the sub-region. The states continue to be fragile. According to the assistance of UNO specialized agencies, an international Non-Government Organization (INGO) network is built around the assistance activities, to support the consequences of the armed conflicts. The INGO make the most of the opportunities to reinforce their position in the state and to create others activities to improve their business. Despite all positions of ECOWAS, African unity organization, and African Union to prevent conflicts and to find mechanisms of the management and peaceful solution, the states are not able to build a long term peace. The member states make the most opportunity of the insecurity of the sub region. Theirs strategies are to protect their own interests instead of finding solutions for peace. This behavior and the incoherence in theirs peace-actions continue to be subjects of discussion. This makes think another approach of conflict resolution in Africa. My research is to analyze the strategies of the international organizations, their strength and their weakness in peacekeeping and the capacity-building of African democratic institutions.

[pt] A idéia inicial da justiça em Rawls é a de que todas as pessoas tenham direito a um igual conjunto de bens sociais primários, a partir do qual seja possível para cada uma delas buscar realizar os seus respectivos planos de vida. As pessoas estão sujeitas desde o seu nascimento às contingências naturais e sociais que afetam profundamente as suas perspectivas de vida, especialmente daquelas menos favorecidas. Rawls afirma que é preciso regular esse quadro de desigualdades moralmente arbitrárias e, para isso, elabora dois princípios de justiça. O princípio da igualdade garante o direito a um mais amplo possível sistema de liberdade igual para todas as pessoas. O princípio da diferença admite desigualdades econômicas entre as pessoas somente se tais desigualdades beneficiarem especialmente os menos favorecidos. Os povos também possuem diferentes níveis de riqueza entre si. A justiça entre os povos deve efetivar um princípio - o dever de assistência - pelo qual seja possível mitigar tal condição de desigualdade de modo a fazer com que os povos onerados façam parte da Sociedade dos Povos razoavelmente justa. Assim, a concepção rawlsiana de justiça com equidade é mantida no plano internacional quando é elaborado o Direito dos Povos. Em ambos os casos, as pessoas e os povos menos favorecidos natural e socialmente contam com um princípio que lhes garante dispor de uma condição social suficientemente necessária que os possibilite perseguir os seus planos de vida com dignidade e auto respeito. / [en] The conception of justice as fairness elaborated by John Rawls state the consideration about which terms of cooperation people consider as reasonably just to offer one another having in mind the society as a cooperative scheme for mutual advantage. The first idea is one that all people have a right to an equal set of primary social goods which makes possible for each one of them pursue their respective life plans. Nevertheless Rawls notes that people are exposed since they are born to natural and social contingencies and that mental and physical talents and abilities and conditions of wealth and social status are arbitrarily distributed. This affects profoundly peoples perspectives of life. Rawls afirms that is necessary regulate this scene of morally arbitrary inequalities and so he elaborates two principles of justice. The first - the equality principle - guarantees the right to an equal and most extensive system of liberties to all people. The second - the difference principle - admit economic inequalities only if these benefit especially those who are less favoured by the natural and social lucky. In the Rawlsian Society of Peoples there are different levels of wealth among peoples. So, the international justice must establish principles which struggle these inequalities so as to allow burned peoples to join well ordered peoples in the reasonably just Society of Peoples. It is the duty of assistance which makes it possible. So, the Rawlsian conception of justice as fairness is maintained when the law of peoples is elaborated so that the purpose to be reached by the difference principle in the closed system society is also reached in the Society of Peoples by the duty of assistance. In both cases the less natural and socially lucky persons and peoples rely on a principle which guarantee them a social condition sufficiently necessary that make possible for them to pursue with dignity and self-respect their life plans.

Esse trabalho tem como objetivo apresentar as principais teorias políticas contemporâneas que tratam desse tema, em busca da que melhor responde a seguinte questão-problema: qual proposta de filosofia política se adapta uniformemente a valoração dos direitos individuais e argumenta como fatores internacionais afetam a sociedade doméstica? Fazemos uma revisão bibliográfica a partir da obra Uma teoria da justiça de John Rawls, apontamos como o debate se expandiu para o âmbito internacional e quais as críticas que foram feitas ao longo desse processo. Demonstramos como as relações internacionais afetam a política interna de sociedades em desenvolvimento e, assim, não somente devem ser consideradas quando pensamos em direitos individuais, mas também devem se tornar parte essencial e imprescindível de uma teoria de justiça. Repenser la justice transitionnelle en Afrique subsaharienne : concilier l'un et le multiple dans la reconstruction des sociétés post-guerre civile / Rethinking transitional justice in sub-saharan Africa

Par l'étude comparative de différents conflits africains, cette recherche a pour but de démontrer l'importance des pratiques traditionnelles africaines de justice au sein des processus de résolution de conflit. De nombreux exemples tels que la Sierra Leone, la République Centrafricaine, le Rwanda, l'Ouganda, le Darfour, ou encore le Mozambique, démontrent que chaque État possède sa propre expérience de justice transitionnelle. Lorsque les victimes deviennent les bourreaux, et que les bourreaux sont eux-mêmes des victimes, il devient alors impossible de se reposer sur des modèles de justice préconçus. Sur le continent africain, comme ailleurs, la justice transitionnelle nécessite d'être adaptées aux spécificités des contextes politiques, historiques et structurels de chaque conflit. Par ailleurs, les mécanismes qui composent aujourd'hui la justice transitionnelle, que ce soit à l'échelon international, national, ou local, se doivent de travailler de concert au service de la reconstruction d'un pacte social entre les populations. Il faudra donc réussir à créer des liens entre ces mécanismes, afin que la justice post-conflit représente un atout efficace pour la paix et la réconciliation. L'ambition de ce projet est d'adopter une vision plurielle et renouvelée de la Justice au service de la réconciliation en Afrique et répondant davantage aux attentes des populations impliquées, et de formuler des propositions en vue d'une complémentarité plus efficace entre les différents instrument de la justice transitionnelle. / Through a comparative study of different African conflicts, this research aims at underlying the need for complementarity between the different judicial and extra-judicial mechanisms of the transitional justice process. Sierra Leone, Central African Republic, Rwanda, Uganda, Darfur, Mozambique, every post-conflict situation has its own experience of Transitional Justice. There is no pre-conceived solution to solve a conflict, where the frontier between victims and perpetrators is constantly shaken, and with mass atrocities committed by both sides. Be it International Justice, National Justice, Truth and Reconciliation Commissions, or Local and Traditional Justice, none of these mechanisms of Transitional Justice can be efficient if they aren't any linkage between them and if they are not adapted to each specific contexts. For post-conflict justice to be a catalyst toward Reconciliation and a Sustainable Peace, peacemakers have to look deep into the political, the historical, and structural reasons that led to the commission of international crimes. The purpose of this PhD project is to encourage the adoption of a renewed plural vision of Justice in Africa, which would meet more specifically the needs of the war-torn population for a long-term peaceful society.

Climate Justice and the Paris Agreement : Dimensions of Climate Justice in the Nationally Determined Contributions

Climate change is a critical threat to all the countries of the world today, not least because of the severe human rights infringements it may well lead to. However, although climate change is a collective, global challenge, there are considerable inequalities regarding contribution to cause and burden of the effects. Those suffering the most from the effects of climate change tend to be least responsible for the emissions causing it. The theoretical concept of climate justice aims to address these injustices, between different countries as well as societal groups and generations. To contribute to the understanding of how this concept is present in the global climate debate today, this thesis examines a selection of the Paris Agreement parties’ Nationally Determined Contributions (NDCs) from a perspective of climate justice. The analysis is based on a theoretical framework developed by Andrea Schapper, focusing on three dimensions of climate justice – international, intra-societal and intergenerational. Through this framework, a total of 36 NDCs are studied, the top and bottom three countries for each world region based on levels of cumulative CO2-emissions. The aim of the case selection has been to obtain a variation regarding development status, vulnerability to the effects of climate change, levels of greenhouse gas emissions and geographical location of the studied countries. The results of the study show that all the dimensions are present in at least some of the studied NDCs, but to a very different extent. Primarily, the parties discuss the issue of international justice. Intra-societal justice is touched upon quite frequently but very few bring up the matter of intergenerational justice. Moreover, all three dimensions are predominantly handled by countries classified as ”developing” (according to the UN statistics division).  This implies that climate justice is a higher priority for the most vulnerable to and least responsible for climate change, which is problematic for many reasons. Above all, it indicates that rich, industrialized countries are reluctant to take responsibility for their current and historical emissions, as well as the effect those emissions have on others.

This thesis provides a critical examination of John Rawls’s political philosophy as it relates to international justice and human rights, Rawls’s theory of justice as fairness has made an enormous impact on contemporary political and ethical theory, yet it has been criticized by some for failing to address the extra-domestic aspects of social justice, including universal human rights. In Chapter One I describe the theoryof.rights, developed in the social contract tradition and how this theory has influenced the modern discourse of human rights. In Chapter Two I discuss Rawls’s theory of justice as fairness, the basic rights and liberties, and the idea of political liberalism. In Chapter Three 1 analyze Rawls’s account of international justice and argue that it fails to uphold the same rigorous principles of justice as found in his account of domestic justice. Finally, in Chapter Four l discuss Rawls’s more recent attempts to theorize international justice and human rights, I conclude that Rawls is not justified in limiting the set of human rights available to persons in different societies, and that this limitation is an unnecessary feature of his theory of justice.
