Panua Partners in Hope, Naivasha, Kenya: Legal and Domestic Related Challenges

The complexities of issues existing in Kenya create a domino effect directly affecting not only the effective management and economic growth of Kenya, but also social and legislative constraints to the lower socioeconomic classes. Land dispossession, proof of ownership to property and nationality are ongoing troubling issues affecting increased orphans and vulnerable children (OVC) in Kenya, most noticeably within predominantly poverty stricken rural enclaves. This research focuses on the bold move of stakeholders of Trinity United Methodist Church in Naivasha, Kenya partnering with First United Methodist Church of Winter Park, Orlando, United States of America. In 2010, they conceptualized Panua Partners in Hope, a transformational ministerial assisted non-profit organization program. These churches recently established support to orphans and vulnerable children (OVC) in Naivasha, Kenya. Decisively apply all their available resources to stem the varying issues these orphaned and vulnerable children (OVC) are facing. Whereby, the program is designed to teach self-sufficiency, wealth creation through sustainable income generation and entrepreneurship, and religious relationship development. Continued education is a key component of which Panua mandates. Ongoing (learning) education ensures each child remain in school – (basic, primary and secondary school levels). In addition to ensuring orphans and vulnerable children (OVC) are legally aware of their civil, human and property rights. Conversely, these issues being perpetual worldwide challenges, however, the aim of this research is to specifically address its impactive progression on orphans and vulnerable children (OVC). Thus, outlining their local conditions, the provisions of governmental policies, and assistance, or lack thereof to remedy such current challenges. Additionally, the research will outline reformed constitutional statutes despite being ratified, have not addressed the major issues currently impinging on the freedom and rights of rural communities in Naivasha, Kenya.

Medico-judicial framework for the rehabilitation of forensic psychiatric patients in Zimbabwe

The purpose of this study was to develop a medico-judicial framework for the rehabilitation of forensic psychiatric patients in Zimbabwe. The study used the grounded theory approach utilising a mixed sequential dominant status design. Purposive sampling of key stakeholders was the primary method and theoretical sampling became necessary as the study evolved in the qualitative phase. A confirmatory retrospective document review of 119 files of patients was done in the quantitative phase. Pierre Bourdieu’s conceptual canon of field, habitus and capital was utilised as the theoretical point of departure for the study. Findings and results showed dislocation and dissonance between and within the habitus of social fields the judiciary, health (medical) and the prison systems with an ensuing hysteretic effect that negatively affected the outcome of forensic psychiatric rehabilitation in special institutions in Zimbabwe. Forensic psychiatric patients were caught up in a double bind situation of aligning to both of the contradictory functions of the medical and the prison systems. The result of this hysteretic scenario seemed to breed some kind of rehabilitative schizophrenia. The developed medico-judicial framework is projected to transform the libido dominandi of the present into a widened scope of therapeutic jurisprudence. The medico-judicial framework is forwarding the forensic psychiatric practitioner to a new address since it has changed its residence from the special institution to the forensic psychiatric hospital. It is inviting the person involved with forensic psychiatric rehabilitation to begin again, inciting him or her to be open to the possibilities of mapping a path through the tangled growth of current realities into an increased width and depth of comprehensive forensic psychiatric practice that follows an empowering legislative prescript / Health Studies / D. Race and Sentencing Equality in Kentucky

Disparity in sentencing felons based on racial considerations has long has been considered a problem for civil libertarians and scholars alike. Examining data gathered in Kentucky, this thesis addresses this issue through the application of recently developed methodological techniques. Utilizing an index of sentencing equality, this study shows that while differences do exist in black and white offender offense characteristics, these differences do not account for the variations in sentences rendered in cases of white as opposed to black felons. This exploratory research reviews and critiques previous research and provides evidence which should prove useful in resolving the problem of racial-based sentencing disparity.

The vicissitudes of the defence of the Constitution in Brazil, the broad outlines of organisation and operation of the Judiciary - which, starting from the establishment of the Republican regime in Brazil, had a duty to analyse legislation by contrasting it with the Constitution, thereby confirming its validity - and the role of the Brazilian Public Prosecution Service as an active defender of the Constitution, are also examined. The dissertation confronts the issue of the judicialisation of politics and hopes to demonstrate that the increase in social, cultural and economical rights, in peripheral countries such as Brazil, compels the legal system to enter into contact with conflicts generated in other social systems (economy, health, education, religion, sport etc), the Public Prosecution Service being an important channel - at the same time as introducing discussions about social, cultural and economical rights - for the preservation of the judicial system code (lawful/unlawful) and its self-generating, or "autopoiético", character to keep the centre of the judicial system free of spurious interference from the other social systems / A presente dissertação destina-se a historiar o conceito de Constituição desde seus primórdios e demonstrar seu duplo significado, político e jurídico, bem como os meios utilizados para garantir a prevalência da Constituição nas tradições européia e norte-americana. The research covers the last two administrations of the São Paulo State Court of Justice´s, Public Ministry´s and Public Defender's Offices, from the beginning of 2012 to June 2016, and analyzes the social impacts of Justice administration in the fields of Public Security and the Penitentiary System, which are brought to the debate to put the analyzed issues in context. As the disputes for the control of Justice administration are structured according to political parties, embedded in the remuneration and corporate guidelines of legal careers, we propose to shift the focus from the judicialization of politics as the key element to explain the separation of powers, to enlighten the effects of the Executive Power agenda into the institutions of justice. In this context, the influence of political decision-making on judicial independence is explored considering practices that are not usually seen in the discussion about the formal and normative dynamics of separation of powers. / Considerando o conceito de Democracia proposto por Boaventura de Sousa Santos, compreendida como “sistema de transformação do poder desigual em autoridade partilhada” (2016), e partindo da hipótese de que o Sistema de Justiça tanto pode favorecer o aprofundamento democrático quanto, ao contrário, pode o obstaculizar, o estudo se propõe a desvelar os processos de politização do Sistema de Justiça do Estado de São Paulo para compreender de que maneira afetam o aprofundamento democrático local. A pesquisa leva em conta o período abarcado nas duas últimas gestões do Tribunal de Justiça, do Ministério Público e da Defensoria Pública do Estado de São Paulo, ou seja, do início de 2012 até junho de 2016, e analisa os impactos sociais da administração da justiça nos campos da segurança pública e penitenciário, que são trazidos a debate para por em contexto os temas analisados. É diante da verificação de que as disputas envolvidas no controle da administração da justiça têm um componente político partidário estruturante, que se imbrica às pautas remuneratórias e corporativas das carreiras jurídicas, que propomos o deslocamento do foco das análises que consideram apenas a judicialização da política no equacionamento democrático da separação ideal entre os poderes, para trazer à luz também a agenda do Poder Executivo dentro das instituições de justiça. Trazemos à baila, neste debate, a influência dos processos de decisão política sobre a independência judicial, considerando práticas que não se localizam necessariamente nos espaços mais visíveis da dinâmica formal e normativa da separação de poderes.

Having the need of facing this problem, one of the ways pointed by Law was the creation of law 11.323/2006 as a way to compensate them for the suffered discrimination since the domestic violence is one of the expressions of the patriarchal power and the women´s subordination situation in society. However, the formal existence of the law does not guarantee that the victim of domestic violence have effective access to justice neither that transformations of gender hierarchical relations will occur. In the following work, we start from the hypotheses that the interpretation/application of the Maria da Penha Law in the light of the sensitive-gender perspective will make the access to justice easier to victims of domestic violence because this scope takes into consideration that this violence is a product of the gender patriarchal system and is generated by a cultural thought that establishes unequal parts of power in detriment to women, putting her in an inferior position in relation to men, being an instrument of reproduction/maintenance of male domination. The following study aims at investigating the work of criminal judges in João Pessoa court district in 2009, trying to know if law 11.340/2006 was interpreted and applied in such a way to facilitate the access to justice for women victims of domestic violence. It was done through empirical research in the 2009 sentence register books from the criminal lower courts in João Pessoa, state capital of Paraiba, with the help of a semistructured instrument of research, having come to conclusion that the decisions were made, in most of times, without having effective contribution to the right of women to have a life free of violence. By not associate the juridical field to the social one, the Judicial System ended up applying Maria da Penha Law incorporating the practical side of it and no the political one, confirming the androcentric aspect of Law and stimulating the reprivatization of the conjugal domestic conflict. / A despeito das conquistas alcançadas no espaço público, as mulheres ainda se encontram vulneráveis à violência doméstica no espaço privado. Diante da necessidade de enfrentamento dessa problemática, um dos caminhos apontados pelo Direito foi a criação da lei 11.340/2006 como forma de compensá-las pela discriminação sofrida, já que a violência doméstica é uma das expressões do poder patriarcal e da situação de subordinação da mulher na sociedade. Entretanto, apenas a existência formal da lei não garante que a vítima de violência doméstica tenha efetivo acesso à justiça, nem que haverá transformação das relações hierárquicas de gênero. No presente trabalho, parte-se da hipótese de que a interpretação/aplicação da lei Maria da Penha à luz da perspectiva gênero-sensitiva facilita o acesso à justiça da vítima de violência doméstica, porque esse enfoque leva em conta que essa violência é produto do sistema patriarcal de gênero e é gerada a partir de um construto cultural que estabelece parcelas desiguais de poder em detrimento da mulher, colocando-a em posição de inferioridade em relação ao homem, sendo instrumento de reprodução/manutenção da dominação masculina. O estudo em epígrafe se propôs a investigar a atuação dos juízes na comarca de João Pessoa/PB em 2009, com o fim de saber se a lei 11.340/2006 foi interpretada e aplicada de modo a facilitar o acesso à justiça da mulher vítima de violência doméstica, o que foi feito através de pesquisa empírica junto aos livros de registros de sentenças de 2009 das varas criminais da capital paraibana, com ajuda de instrumento semiestruturado de pesquisa, tendo-se chegado à ilação de que os julgados foram proferidos, em sua maioria, sem que houvesse efetiva contribuição com o direito das mulheres a uma vida livre de violência. Isso porque ao não vincular o campo jurídico ao campo social, o Judiciário acabou por aplicar a lei Maria da Penha incorporando o viés pragmático, e não político, dessa lei, ratificando o caráter androcêntrico do Direito e estimulando a reprivatização do conflito doméstico conjugal.

Une analyse microéconomique des règles de preuve dans le contentieux civil / A microeconomic analysis of rules of proof in civil litigation

Les normes procédurales sont susceptibles d'affecter les stratégies mises en place par les parties à un litige. Nous étudions leur impact sur le volume des contentieux et sur le montant des dépenses engagées par les parties afin de gagner le procès. Ces deux composantes du coût social des litiges sont au coeur des défis que les pays développés doivent relever pour garantir l'effectivité des règles de droit substantiel. Nos travaux portent en particulier sur les règles de preuve, et nous mettons l'accent sur l'opposition entre les règles civilistes et celles de common law.Après avoir défini les contours et les enjeux de notre sujet dans l'introduction générale, nous développons un plan en deux parties. La première partie porte sur le comportement des parties lorsque celles-ci ont la possibilité de parvenir à un accord. Des modèles stratégiques et optimistes sont développés pour appréhender les décisions d'aller en justice et de négocier. La seconde partie est centrée sur le processus de production de preuves qui précède l'audience finale. Nous utilisons des modèles de recherche de rente pour analyser les incitations des parties à engager des dépenses.Les résultats suggèrent que les règles de preuve ont un impact considérable sur le coût social des contentieux. Nous montrons que le volume des litiges en France et aux Etats-Unis peut s'expliquer par les différentes règles de preuve s'appliquant dans ces deux pays. Notre analyse révèle également que les règles de preuves constituent un déterminant majeur du coût privé des litiges et des stratégies de défense des défendeurs. / Procedural rules are likely to affect the strategies of the parties in a dispute. We study their impact on the volume of litigation and on the amount of legal expenses incurred by parties to win the trial. These two components of the social cost of litigation are at the heart of the challenges that must be addressed by developed countries to guarantee the effective enforcement of the substantive law. Our works relate more specifically to rules of proof, and the emphasis is given on the opposition between civilian and common law rules. After defining the scope and the stakes of the thesis in the general introduction, we develop a plan in two parts. Part I studies parties' behavior when they have the possibility to negotiate to avoid a trial. Strategic and divergent expectations models are developed to apprehend parties' decisions to sue and to settle. The second Part is oriented toward the evidence production process preceding the final hearing. We use rent-seeking models to analyze parties' incentives to engage legal expenditures.The results suggest that rules of proof have a substantial effect on the social cost of litigation. We show that the volume of litigation in the US and in France can be explained by the various rules of proof prevailing in these two countries. Moreover, our analysis reveals that the rules of proof constitute a major determinant of the private cost of litigation and of defendant's defense strategies.

Prosecution of grave violations of human rights in light of challenges of national courts and the International Criminal Court: the Congolese dilemma

"Although the United Nations (UN) has often been pivotal in forging the international response to serious human rights crimes in such settings, the justice gap in countries such as the Democratic Republic [of] Congo (DRC) (the focus of this study) underscores the need for more systematic UN efforts. The war in the DRC has resulted in one of the world's worst humanitarian crisis with over 3.4 million displaced persons scattered throughout the country. An estimated 3.5 million people have died as a result of the war. The armed conflict has been characterised by appalling widespread and systematic human rights violations, including mass killings, ethnic cleansing, rape and the destruction of property. The most pressing need to be addressed is the question of justice and accountability for these human rights atrocities in order to achieve a durable peace in the country and also in the Great Lakes region (Rwanda, Burundi, Uganda, Angola and the DRC, to name just a few). In this respect, this study will address the grave human rights violations committed in the DRC and the mechanisms for dealing with them. It is particularly true in post-conflict situations where justice systems have been either partially or completely destroyed, that national courts are not capapble of arriving at a uniform stance, or willing to provide justice for atrocities in the immediate future. As a result, international justice seems to be a crucial and last resort that must continue to be fortified against efforts to undermine it. ... Chapter two will discuss the state obligations in international law to prosecute gross violations of human rights and gives a summary of the human rights violations situation during the Congolese war.
