O estudo é resultado de uma pesquisa bibliográfica e o referencial teórico é a obra de Jürgen Habermas. Busca analisar o conceito de agir comunicativo sob o aspecto da linguagem e do discurso. Define competência comunicativa. Analisa a linguagem como o meio gerador do agir comunicativo, o entendimento como o meio gerador do consenso e as pretensões de validade. Explicita o conceito de discurso e a sua legitimidade é obtida mediante o uso de regras procedimentais. Pretende aplicar o referencial teórico na análise da ação educativa. Busca localizar simbolicamente a instuição escolar na inter-relação entre os conceitos de sistema e mundo da vida. Apresenta uma tipologia das ações educativas realizadas nas instituições sociais. Descreve os contextos de interação das relações funcionais, das interações entre os membros adultos da instituição escolar, das interações entre adultos e alunos, e das interações entre os próprios alunos. Expõem as relações entre os tipos de ações realizadas na escola e o saber neles materializado, a forma de argumentação utilizada, o modelo de racionalidade existente e o modo como se manifestam nos contextos educacionais. O agir comunicativo comprende aquelas ações orientadas para o entendimento e o agente é o sujeito competente lingüisticamente para agir na busca do consenso. A ação educativa compreende as ações intencionais cuja finalidade (imediata ou futura) é a formação do aluno, segundo os critérios de uma teoria crítica da educação e os agentes são os profissionais integrantes da comunidade escolar. A interação professor-aluno é assimétrica e deve estar intencionalmente orientada para a formação do aluno. A escola, entendida como um contexto social e historicamente determinado, por um lado, cumpre a função sistêmica quando realiza ações orientadas para o produto e, por outro, cumpre a função simbólica quando realiza ações orientadas para o entendimento / Abstract: The present work intends to examine the educational action in the perspective of the theory of acting talkative having as objective to identify the kind of action produced by the interaction teacher-student in the context of the teaching institution. The study is the result of a bibliographical research and the theoretical referencial is based on Jürgen Habermas work. It looks for to analyze the concept of acting talkative on the aspect of the language and of the speech. It defines talkative competence. It analyzes the language as the generator way of the acting talkative, the understanding as the generator way of the consent and the validity pretenses. It explicit the speech concept and its legitimacy is obtained with of the use of proceeding rules. It intends to apply the theoretical referencial in the analysis of the educational action. It looks for to locate by symbols the school institution in the interrelation between the concepts system and world of the life. It presents a typology of the educational actions accomplished in the social institutions. It describes the contexts of interaction of the functional relationships, of the interactions among the adult members of the school institution, of the interactions among adults and students, and of the interactions among the own students. It exposes the relationships among the types of actions accomplished in the school and the knowledge in them materialized, the way of argumentation used, the model of existent rationality and the way as they show in the educational contexts. It acting talkative comprehends those actions guided for the understanding and the agent is linguistically the competent subject to act in the search of the consent. The educational action embraces the intentional actions whose purpose (immediate or future) is the student's formation, according to the criteria of a critical theory of the education and the agents are the school community's professionals members. The interaction teacher-student is asymmetric and must be intentionally guided to the student's formation. [pt] O objetivo deste trabalho é trazer as principais contribuições teóricas acerca do debate sobre reconhecimento. Vivemos uma época em que o eixo da política e do poder desloca-se cada vez mais das lutas de distribuição para as lutas por reconhecimento simbólico. As sociedades democráticas contemporâneas são marcadas pela tensão entre a força homogeneizadora de uma cultura mundial e o acirramento das lutas em defesa de identidades particulares. A falta de reconhecimento ou o falso reconhecimento resultam em uma formação distorcida da própria identidade, assim, o reconhecimento não pressupõe cortesia, mas algo que deve ser garantido aos outros por consistir uma necessidade humana vital. A partir das reflexões propostas por Charles Taylor, Jürgen Habermas e Axel Honneth, pretendemos aproximar a temática, geralmente empreendida no campo da filosofia política, do Direito Constitucional e da realidade brasileira. / [en] The goal of this work is to put together the most important theoretical contributions concerning the recognition debate. We live in an era where the political and power axis shifted increasingly from the distribution of the symbolic recognition struggles. Contemporaneous democratic societies are marked by tension between the hegemonic global culture power and the aggravation of the particular identities struggles. The lack or false recognition results in a distorted formation of the self identity, and therefore, the recognition does not foresee courtesy, but something that should be guaranteed to others to consolidate a vital human need. Starting from the reflections proposed by Charles Taylor, Jürgen Habermas and Axel Honneth, we intend to approach the theme, usually covered in the political philosophy, of the Constitutional Law and the Brazilian reality.

[pt] Patriotismo Constitucional representa uma forma pós- nacional de identificação política para sociedades pluralistas. Lealdade aos princípios constitucionais e às instituições políticas que eles estruturam - portanto identificação focalizada no status político-legal da cidadania, ao invés do pertencer etnocultural - pode fornecer a base para uma forma racional de identidade coletiva que supera o chauvinismo que tem importunado a identificação nacional. A deliberação democrática fornece o meio no qual os cidadãos podem forjar uma identidade racional coletiva através da participação em um projeto constitucional democrático que pode se tornar foco de formas não-chauvinistas de reconhecimento mútuo, solidariedade e apego afetivo. / [en] Constitutional patriotism represents a postnational form of political identification for pluralistic societies. Loyalty to democratic constitutional principles and the political institutions they structure - hence identification focused on the legalpolitical status of citizenship rather than on ethnocultural belonging - can ground a rational form of collective identity that overcomes the chauvinism that have plagued national identification. Democratic deliberation provides the medium in which citizens can forge a rational collective identity through participation in a democratic constitutional project that can become the focus for non- chauvinistc forms of mutual recognition, solidarity and affective attachment.

[pt] Esta dissertação tem como escopo a interpretação da obra jurídico-política de Jürgen Habermas à luz dos problemas e desafios formulados por Carl Schmitt. A hipótese inicial, confirmada ao longo da exposição, versa sobre o caráter de modelo negativo que a obra weimariana de Schmitt adquiriu para Habermas. Trata-se de um trabalho que se propõe a ocupar a intercessão entre a teoria política e a filosofia do direito. O pensamento do político e das condições normativas da democracia articula-se com um determinado conceito de filosofia do direito - enquanto pensamento que não admite o esquecimento da questão da legitimidade do direito. Atua, ainda, num registro marcadamente contemporâneo. São as exigências, os problemas, as crises do mundo de hoje que norteiam as leituras de Schmitt, a compreensão da experiência de Weimar e dos elementos fundamentais da obra de Habermas nos anos 90. / [en] This research aims to interpret the legal-political work of Jürgen Habermas in light of the problems and challenges indicated by Carl Schmitt. Initial hypothesis, confirmed later, affirms that Schmitt s Weimar work has a negative model function in the Habermasian theoretical perspective. The present work places itself in the interdisciplinary field of philosophy of law and political theory. The thought of the political and the normative conditions of democracy interweave into a certain concept of philosophy of law - as a thought that does not allow itself to forget the issue of legal legitimacy. It works yet in the contemporary register. Requirements, problems and crises of the current world are those which guide the readings of Schmitt, the comprehension of the Weimar experience, and of the fundamental elements of the work of Habermas in the 90 s.

[pt] A missão do Espírito Santo possui aspectos que com o avanço da teologia ganharam maior atenção pelos teólogos e as diversas tradições cristãs. Jurgen Moltmann, entre um grande número de teólogos, desenvolve uma reflexão original e complexa sobre o Espírito Santo, começando em sua famosa Teologia da Esperança e tendo como ápice a produção do livro O Espírito da vida, obra dedicada exclusivamente à reflexão sobre o Espírito Santo. Ele produzirá uma Pneumatologia que será orientada pela sua concepção de Escatologia cristã e pelos textos do bíblicos do Apóstolo Paulo. Essa pesquisa tem como objetivo principal fazer uma abordagem sobre como Jurgen Moltmann apresenta a relação entre o Espírito Santo e a Esperança Cristã, tendo como ponto de partida os acenos teológicos que ele desenvolveu na Teologia da Esperança, seu primeiro livro. Nossa abordagem se dividirá em três diferentes etapas. Em um primeiro momento, iremos nos dedicar a apresentar os principais textos produzidos por teólogos ao refletirem sobre o Espirito Santo. Em seguida, este trabalho vai fazer uma apresentação dos principais aspectos da Pneumatologia moltmanianna através de suas principais obras. O último passo, então, é discorrer sobre como Jurgen Moltmann compreende a relação entre Espírito Santo e a Esperança Cristã. Após a pesquisa, concluímos que nosso autor produz uma Pneumatologia que deve ser lida a partir da Escatologia que ele fomenta em sua Teologia da Esperança. O Espírito Santo é compreendido como o poder vivificante de Deus que faz com que homens e mulheres possam experimentar as promessas do futuro, parcialmente, ainda no presente. Ele garante que elas serão cumpridas e impulsiona a Igreja, que vive na esperança de uma realização plena do que foi prometido, a caminhar dentro da história sinalizando o Reino vindouro por meio de suas ações. / [en] The mission of the Holy Spirit has aspects that with the advancement of theology have gained more attention by theologians and the diverse Christian traditions. Jurgen Moltmann, among a large number of theologians, develops an original and complex reflection on the Holy Spirit, beginning with his famous Theology of Hope and having as its apex the production of the book The Spirit of Life, a work that he dedicates exclusively To reflection on the Holy Spirit. He will produce a Pneumatology that will be guided by his conception of Christian eschatology and by the biblical texts of the Apostle Paul. This research has as main objective to make an approach on how Jurgen Moltmann presents / displays the relation between the Holy Spirit and the Christian Hope taking as starting point the theological nods that it builds in the Theology of the Hope. Our approach will be divided into three different steps. At first, we will devote ourselves to presenting the main texts produced by theologians in reflecting on the Holy Spirit. Then this work will make a presentation of the main aspects of Pneumatologia moltmanianna through his main works. The final step is to discuss how Jurgen Moltmann understands the relationship between the Holy Spirit and Christian Hope. After the research, we conclude that our author produces a Pneumatology that must be read from the Eschatology that he promotes in his Theology of Hope. The Holy Spirit is understood as the life-giving power of God, which enables men and women to experience the promises of the future with God, partially, still in the present. He ensures that they will be fulfilled and propels the Church, which lives in this hope of a full realization of what has been promised, to walk within history by signaling the coming Kingdom through its actions.
