A (in)suficiência do paradigma dogmático no modo de observar e ensinar o direito

O modo como se pretende realizar esta atividade parte da percepção cientificista, desenvolvida por Descartes e Newton, durante os séculos XVI e XVII. A busca por um conhecimento certo, seguro, puro e verdadeiro também pode ser encontrado no direito. A dogmática, considerada paradigma científico do direito dominante na modernidade, influencia ainda hoje as estruturas judiciária e educacional brasileiras. Ocorre que, tanto o modelo mecanicista, quanto o pensamento jurídico encontram-se limitados diante das complexidades, desordens, incertezas e inseguranças do mundo. Entretanto, permanecem presentes no imaginário dos juristas, os quais apresentam concepções reducionistas, minimalistas, disjuntivas e insuficientes do direito e da sociedade. Subjektivní vnímání času se zaměřením na krátkodobé činnosti / Subjective perception of time focusing on short-term activities

The diploma thesis investigates the subjective perception of time, especially the exactness of the interval length estimation, subjective passage of time, in relation to the time perspective, the level of difficulty in emotion regulation and age. Furthermore, the thesis investigates differences in retrospective and prospective paradigm in interval length estimate. Research was conducted online, with a total number of 180 respondents. Data collection had occurred during a 4 month period. Main instruments were the Czech versions of the ZTPI - Zimbardo's time perspective inventory and the DERS-SF-CZ - Difficulty in emotion regulation scale; moreover, for the declaration of subjective passage of time was employed a method of verbal estimation. Subjective interval length was registered after finishing rewriting of two short texts. The results have showed statistically significant relationships between subjective passage of time and age; between the level of difficulty in emotion regulation and subjective passage of time. Amongst the persons orientated onto positive and negative past, there was found a significant relationship between the subjective passage of time and the difficulty in emotion regulation. The material collected was analyzed based on the methodological guidelines for the Jungian paradigm. The analysis of the research projects identified the main methodological procedures adopted by the researchers, both for collecting and for interpreting the data, and the articulation between the objective of the research, the phenomenon selected as the object of research and the methodological procedures used to collect and analyze the material; the most frequent research modules were identified together with the main difficulties faced by the researchers in undertaking their research. Based on an analysis of the material collected, a research method for investigation into analytical psychology was proposed. The research process, within the Jungian paradigm, includes stages for apprehending and comprehending phenomena, during which methodological procedures and resources are used that are compatible with the basic guidelines for the paradigm, which include symbolic amplification. Special attention was given to the researcher s participation in the process, considering his/her function and academic background and more importantly, the development of a symbolic attitude to approach the work and within the relationship researcher-researched . This research also identifies the main risk that the research activity presents to the contemporary Jungian researcher, and consequently, the care that needs to be taken during the research process. Finally, the ethical implications of scientific activity in general are discussed, and particularly in the work of Jungian researchers. The research method in analytical psychology, given its characteristics, epistemology and methodologies, is referred to as an archetypical symbolic procedure / Com o objetivo de fazer uma proposta de método de pesquisa em psicologia analítica, foi feito um levantamento da produção acadêmica nesta abordagem teses de doutorado e dissertações de mestrado em duas universidades brasileiras PUC-SP e USP no período de 2002 a 2007. O material coletado foi analisado, a partir das diretrizes metodológicas do paradigma junguiano. A análise das pesquisas destacou os principais procedimentos metodológicos utilizados pelos pesquisadores, tanto na coleta como na interpretação dos dados. A articulação entre o fenômeno eleito com o objeto de pesquisa, o objetivo e os procedimentos metodológicos de coleta e análise do material propiciou a identificação das modalidades de pesquisa mais frequentes e as principais dificuldades dos pesquisadores. Com base na análise do material coletado, foi feita uma proposta de método de investigação em psicologia analítica. O processo de pesquisa, no paradigma junguiano, abarca as etapas de apreensão e compreensão dos fenômenos, nas quais são empregados recursos e procedimentos metodológicos compatíveis com as diretrizes básicas do paradigma. Dentre eles, destaca-se a amplificação simbólica. A participação do pesquisador, sua função, sua formação e, sobretudo, o aprimoramento da atitude simbólica na condução do processo e na relação pesquisador-pesquisado foram ressaltados. São, também, apontados os principais riscos que a atividade de pesquisa oferece ao pesquisador junguiano contemporâneo e com isso, os cuidados a serem observados durante o processo. Its objective is to reflect about the teaching practices adopted in the undergraduate programs in technology offered by that institution. Reflection is conducted in the light of the guiding principles of action research, in one of its variants, known as Investigación-Acción (Carr e Kemmis,1988; MacTaggart, 1988; e Latorre 2003). The strategies of this variant are non-cartesian, and, therefore, better applicable to non-linear systems. The question of which pedagogical practices are most appropriate to the programs in technology offered by the institution, given the competencies and skills that the social and productive environment requires today, is the starting-point of this reflection. It is proposed, in answer to this question, that an analysis of the procedures adopted by the actors involved in the projects (students, professors and coordinators of different academic areas and disciplines) can, when guided by theoretical frameworks open to uncertainty, unveil the principles of a complex methodology that can be applied, with good results, to any programs of technology. The present study, based on the tools of action research and on the theoretical assumptions of the General Systems Theory (Bunge and Vieira), of the eco-systemic paradigm (Moraes) and of the theory of complex thought (Morin), has shown that project methodologies evolved from interdisciplinary projects (first phase) into integrating projects (second phase), and, presently, show a tendency to move into a third phase, still under construction, named bureau of integrating projects. The present phase has shown a significant increase in the organization and complexity, both of the institution offering the projects and of the methodology used, when and if open, non-linear systems are considered / Este trabalho enfoca a metodologia de projetos e, mais especificamente, os projetos integradores praticados pela Faculdade de Tecnologia Professor Luiz Rosa, Jundiaí, Estado de São Paulo, com a finalidade de reflexionar sobre as práticas docentes levadas a efeito nos cursos de graduação tecnológica ali oferecidos à luz dos princípios norteadores da pesquisa-ação, em uma de suas variantes, conhecida como Investigación-Acción (Carr e Kemmis,1988; MacTaggart, 1988; e Latorre 2003), cujas estratégias não cartesianas são mais adequadas à aplicação em sistemas não lineares. Partindo da indagação de quais práticas pedagógicas seriam mais apropriadas aos cursos tecnológicos oferecidos pela instituição face às habilidades e competências hoje requeridas pelos sistemas social e produtivo, considero que a análise dos procedimentos dos atores envolvidos nos projetos, ou seja, de alunos, coordenadores e professores de diferentes áreas e disciplinas, quando orientados por referenciais abertos à incerteza, pode desvelar princípios de uma metodologia complexa capaz de se aplicar a quaisquer cursos tecnológicos com bons resultados. The origin and the explanation for this phenomenon can be found in the coexistence, in the school environment of two paradigms, both opposite and divergent: one from the unity and the one from multiplicity, each one with its own features built in distinguished cultural moments. The former in the Modern Age and the latter in the Post-Modern Age. Based on an anthropological understanding which finds the human being constituted by desire and pursuit, at the same time, from the unity and the from multiplicity, we propose a dialectical method as a tool for the understanding, the approach and the overcoming of the two antagonistic paradigms surpassing the harmful aspects and keeping the achievements of each one for the educational practice. Then, we present some discussions starting from the dialectic, seeking a synthesis between the unity and the multiplicity. At the end of the study, we investigate some aspects of the Ignatian Pedagogy - a pedagogical purpose of the Jesuit education - demonstrating, from its documents and its educational tradition, as it is itself, dialectically, facing, and overcoming of the mentioned tensions and the dynamic feature of the crisis in school education / A presente dissertação tem como ponto de partida a constatação de que a educação escolar vive um momento de tensão e crise. A origem e a explicação desse fenômeno encontram-se na coexistência, no ambiente escolar, de dois paradigmas, opostos e divergentes: o da unidade, e o da multiplicidade, com suas características próprias, tecidos em cenários culturais distintos. O primeiro, na Modernidade; o segundo, na Pós-modernidade. Partindo de uma compreensão antropológica que entende o ser humano como constituído pelo desejo e busca, ao mesmo tempo, de unidade e de multiplicidade, propomos o método dialético, como ferramenta, para a análise dos dois paradigmas, superando os aspectos nocivos e conservando as conquistas de cada um deles para a prática educativa. Em seguida, apresentamos algumas reflexões, a partir da dialética, buscando nelas a síntese entre unidade e multiplicidade. The impact of senior management on middle management's experience of integrity

A rise in the number of high-profile cases of management failure and leadership misconduct increased the awareness of one of the core challenges of management, namely to lead responsibly and with integrity. The environment which senior managers create and within which middle managers need to function seems to have a direct bearing on the moral behaviour and integrity of the middle manager. The aim of this research was therefore to gain a better understanding of how middle managers view the impact of senior managers on their experience of integrity. There is an increasing need in organisations for responsible leadership, leadership with integrity and leadership towards developing the integrity of the follower. This study was conducted within the interpretive research paradigm. Sampling was directed by criterion-based guidelines, focusing on current middle managers from different industries in the private sector. In-depth interviews were conducted and the data was analysed using a grounded theory method. The main findings indicated that senior managers should engage in two debates with middle managers in the organisation. Firstly, integrity is not something that is demonstrated but rather means that leaders can be differentiated from other leaders when they lead with integrity. Secondly, defining integrity and linking it to personal standards and values, as well as aligning these standards and values to the organisational strategy, vision and mission, are important. The findings of this study can assist senior managers with decreasing unethical behaviour and increasing integrity in the organisation. Movement synchrony, social bonding and pro-sociality in ontogeny

Human sociality, with its wide scope, early ontogeny and pervasiveness across cultures, is remarkable from an evolutionary perspective. We form bonds with other individuals and live in large social groups. We help, empathise with and share our resources with others, who are unfamiliar and genetically unrelated to us. It has been suggested that interpersonal coordination and rhythmic synchronisation of movements may be one proximate mechanism that enables such widespread human sociality and facilitates cooperation. In the last decade, considerable research has examined the effect of movement synchrony on social bonding and cooperation. However, when this thesis started, there was virtually no experimental study investigating the ontogeny of the movement synchrony-social bonding link, which is proposed to have deep evolutionary roots and important, long-lasting consequences in social life. This thesis aims to investigate the effects of movement synchrony on social bonding and cooperative behaviour across different time points in ontogeny. Three experimental studies were conducted examining infancy, early childhood and middle childhood. Each study explored a different aspect of social bonding and cooperation based on the motor, social and cognitive developments that mark that age group. Study 1a found that at 12 months of age, infants prefer individuals who move in synchrony with them, when the individuals are social entities, but not when they are non-social. Study 1b showed no preferences for synchrony at 9 months in either social or non-social contexts, however. Study 2 revealed that in early childhood, performing synchronous movements actively with a peer facilitates helping behaviour among the children, as well as eye contact and mutual smiling during the interaction. Finally, Study 3 showed that the social bonding effects of movement synchrony applied to inter- group settings and that performing synchronous movements with out-groups increased bonding towards the out-group in middle childhood. This thesis followed an interdisciplinary, integrative and naturalistic approach, where (i) literature from a wide range of disciplines motivated and guided the present research; (ii) links between motor, social and cognitive aspects of development, which are often investigated separately, are formed; and (iii) the experiments were designed in ways that represent the real-life occurrences of the investigated phenomena. The current findings provide the first substantial evidence that movement synchrony facilitates social bonding and cooperation in childhood and thereby provides a foundation for future research.

As transformações da regulação em saúde suplementar no contexto das mudanças do papel do Estado / The changes in regulation of the health supplement in the context of crises and changes in the role of the state

Esta tese analisa a trajetória, os desafios e as perspectivas da regulação em saúde suplementar, contextualizados num ambiente de grandes transformações do papel dos Estados nacionais e das relações entre a Economia e a Política no âmbito mundial e no Brasil. As interrelações entre economia e política são a base para importantes mudanças no papel do Estado brasileiro, do arcabouço regulatório e da regulação da saúde suplementar em particular. A tese tem início com o desenvolvimento de uma análise sobre o panorama político e econômico mundial, de modo a identificar suas influências sobre o Brasil e o setor de saúde brasileiro. À luz deste arcabouço analítico, é desenvolvido um detalhamento retrospectivo dos principais normativos que compuseram a regulação em saúde suplementar, editados por intermédio da Agência Nacional de Saúde Suplementar ANS. Para tanto, foi construído um banco de dados que servirá não apenas para a pesquisa da tese, mas para outros trabalhos a serem desenvolvidos posteriormente. O estudo desse material permitiu identificar uma trajetória da saúde suplementar marcada por três diferentes tônicas, que tem se desdobrado a partir da cena das grandes transformações mundiais. As conclusões aqui obtidas sobre a trajetória da regulação foram ainda apreciadas, por meio de pesquisa com todos os atuais e antigos dirigentes da ANS. Adiante, foi realizada uma breve análise dos efeitos produzidos por cada uma das tônicas anteriormente descritas, bem como discutidos os principais desafios que se colocam na ordem do dia na agenda da saúde suplementar no Brasil. É interessante destacar que discussão da perspectiva futura da regulação da saúde suplementar no Brasil se dá sobre um pano de fundo de profundas transformações no plano da política e das relações de hegemonia e poder na esfera global. Por fim, o trabalho aqui apresentado tem a finalidade de contribuir para o desenvolvimento do tema e sugerir aperfeiçoamentos de modo a aprimorar o planejamento, a gestão e a regulação da saúde suplementar, buscando relações público-privadas mais harmoniosas e eficientes no tocante à assistência e promoção da saúde. / This thesis analyzes the trajectory, challenges and prospects of private health insurance regulation in Brazil in a context of changing of hegemony and relationship between economics and politics. This scenario of economy and political change is the basis for the Brazilian State agenda on health regulation. This work analyzes the worlds economic and political landscape in order to identify its influence on Brazil and on the Brazilian healthcare industry. Based on this framework, we develop a retrospective analysis of the major private health insurance regulatory policies enacted by the Brazilian National Health Agency ANS. In this way, a database was built not only for research thesis, but also for later studies. Subsequent analytical study has identified three different waves in the Brazilian regulation trajectory. Results were, then, checked by all current and former ANS directors. This work, also analyses the effects of those three waves and discusses the main challenges of health insurance regulation agenda in Brazil. It is worth noting that discussions of future regulatory policies in Brazil take place on the grounds of critical changes in policy, power and hegemony over the world. Lastly, this work provides contribution to the development of the theme and suggests enhancements to improve planning, management and regulation of health, seeking more harmonious and efficient public-private relations in the field of disease prevention and health promotion.

O direito ao acesso universal a medicamentos no Brasil: diálogos entre o direito , a política e a técnica médica / The right to universal access to medicines in Brazil: dialogues between law, policy and technical medical

Introdução. Desde a promulgação da Constituição Federal de 1988 no Brasil, que consolida a saúde como um direito social, a ser garantido de forma integral e universal pelo Estado brasileiro, os cidadãos passaram a reivindicar este direito em juízo, acionando legitimamente o Estado para a garantia de suas pretensões sanitárias. E, neste sentido, o número de ações que demandam medicamentos vem crescendo de forma exponencial no Brasil, impactando diretamente a política pública de saúde, e suscitando debates sobre a segurança sanitária dos medicamentos dispensados em juízo. Objetivo. Evidenciar de que forma as questões técnicas e políticas que envolvem o direito social à assistência farmacêutica vem sendo debatidas dentro de processos judiciais que tem por objeto a solicitação de medicamentos em face do Estado. Isto para que se possa relacionar estes resultados aos atuais debates sobre o papel do Poder Judiciário em face da garantia do direito à saúde, e seu impacto perante a política pública de saúde. E, também, aos atuais debates político-sanitários sobre a prescrição médica, e sua importância para o exercício do direito em foco. Método. A metodologia de pesquisa revestiu-se em duas etapas distintas. A primeira etapa consistiu na análise de processos judiciais que versavam sobre a demanda de medicamentos em face do Estado, provenientes de quatro Tribunais Estaduais do país, em primeira instância: São Paulo, Minas Gerais, Rio Grande do Sul e Rio de Janeiro. Os processos foram analisados através do uso da Metodologia Qualiquantitativa do Discurso Coletivo. A segunda etapa consistiu na pesquisa de artigos científicos, nas principais bases de dados de periódicos científicos de saúde pública, que tivessem relação com a pergunta de pesquisa: Como hoje estrutura-se a discussão político-sanitária em torno da prescrição médica? Resultados. Pela análise dos processos judiciais, evidencia-se que as demandas que envolvem pedidos de medicamento em juízo vêm sendo deferidas pelos juízes, prioritariamente, com base nas prescrições médicas individuais e com base na leitura pura do ordenamento jurídico, sem considerar as dimensões técnicas e políticas que envolvem o direito à assistência farmacêutica. A análise dos artigos científicos nos demonstra a vasta discussão técnica acerca da prescrição médica e suas implicações sanitárias, e aponta a necessidade de contraditar esses documentos e investir em educação e informação médicas, em prol da segurança sanitária dos pacientes-cidadãos. Conclusão. O direito à saúde é um direito complexo, que requer, para a sua adequada proteção e garantia, que ultrapassemos o paradigma positivista, com sua leitura exclusivamente normativa e dogmática, em prol de um novo paradigma que permita maior penetração de questões e saberes técnicos e políticos no âmbito do direito. Tanto judicial quanto extrajudicialmente precisam ser criados caminhos de proteção à saúde, que abriguem todos os profissionais jurídicos, políticos e técnicos envolvidos na temática, rumo à construção interdisciplinar do direito à saúde e da cidadania sanitária no Brasil / Introduction. Since the enactment of the 1988 Federal Constitution in Brazil, that consolidates health as a social right, the citizens began to demand this right in court, lawfully driving the state to guarantee their health claims. And, in this sense, the number of actions that require medicines is growing exponentially in Brazil, which impact directly the public health policy, and stimulate discussions about the safety of drugs dispensed by the courts. Objective. Show how the technical and political issues, involving the social right to pharmaceutical assistance has been debated in legal proceedings whose objective is the solicitation of drugs against the State. This to be able to relate these findings to the current debates about the role of the judiciary, in view of the guaranteed of right to health and its impact on the public health policy. And, also, to the current political debates about health prescription, and its importance for the right in focus. Method. The research methodology is coated in two stages. The first step was the analysis of court cases that focused the drug demand against the State, from Four State Courts in Brazil: Sao Paulo, Minas Gerais, Rio Grande do Sul and Rio de Janeiro. The processes were analyzed through the use of qualitativequantitative methodology of collective discourse. The second step consisted in the search of scientific articles in major databases of scientific journals of public health, that were related to the following research question: How today\'s discussion is structured around the political health context of the medical prescription? Results. The analysis of court proceedings, results clear that the demands that involve medication in court have been deferred by the judges, primarily, based on the individual medical prescriptions, and based on the pure reading of the legal system, without considering the technical and political dimensions that involve the right to pharmaceutical assistance. The analysis of scientific articles shows us the extensive technical discussion about the prescription and its health implications, and highlights the need to contradict these documents, and invest in education and medical information, towards the safety of patients-citizens. Conclusion. The right to health is a complex right, which requires for its adequate protection and security, that we move beyond the positivist paradigm, with its exclusively normative reading and dogmatic rules, towards a new paradigm which allows greater penetration of issues and political and technical knowledge within the law. Both judicial and extrajudicial ways need to be created to protect health, involving all legal, politicians and technicians professionals involved in the matter, toward interdisciplinary construction of the right to health and health citizenship in Brazil
