[pt] Museu Nacional: memória e patrimônio cultural pós-trauma é uma pesquisa que busca aprofundar as camadas que compõem o Museu Nacional antes e depois do incêndio em 2018. As questões levantadas partem do trauma ocorrido e dos relatos desse evento, mas também da história do Museu sob a ótica do patrimônio, entendendo a evolução do seu conceito e as diferentes correntes de conservação a nível nacional e internacional. A pesquisa prioriza a teoria geral dos valores de Alois Riegl, que defende necessidade de conciliação entre elementos do passado e do presente na cidade contemporânea, assim como analisa o cenário atual do patrimônio cultural em uma sociedade globalizada. Procura destrinchar os elementos da discussão patrimonial capazes de valorizar uma edificação, e o porquê da sua necessidade de preservação que o torna único e insubstituível, tal qual a significação cultural. Além disso, trata de se aprofundar no tema da memória coletiva – descrita inicialmente por Maurice Halbwachs – social e individual, relacionando-as fenomenologicamente com a formação da identidade e o lugar. O trauma entra na pesquisa sob uma perspectiva temporal, uma nova variável na relação e identificação entre as pessoas e o Museu, antes e depois do incêndio, buscando direções e referências para a reconstrução. Por fim, a pesquisa promove uma análise da conjuntura atual e o projeto conceitual divulgado para a reconstrução do Museu Nacional e os objetivos por trás da proposta. / [en] Museu Nacional: memory and post-trauma cultural heritage is a research that seeks to deepen the layers that make up the Museu Nacional before and after the fire in 2018. The questions raised come from the trauma that occurred and the reports of this event, but also from the history of the Museum from the perspective of heritage, understanding the evolution of its concept and the different currents of conservation at national and international level. The research prioritizes Alois Riegl s general theory of values, which defends the need to reconcile elements of the past and present in the contemporary city, as well as analyzing the current scenario of cultural heritage in a globalized society. It seeks to unravel the elements of the patrimonial discussion capable of valuing a building, and why its need for preservation makes it unique and irreplaceable, just like its cultural significance. In addition, it seeks to deepen the theme of collective memory – initially described by Maurice Halbwachs – social and individual, relating them phenomenologically to the formation of identity and place. Trauma enters the research under a temporal perspective, a new variable in the relationship and identification between people and the Museum, before and after the fire, seeking directions and references for reconstruction. Finally, the research promotes an analysis of the current situation and the conceptual project disclosed for the reconstruction of the Museu Nacional and the objectives behind the proposal.

L'émergence des limites à la liberté de tester en droit québécois : étude socio-juridique de la production du droit

Cette thèse a été acceptée à l'unanimité et classée parmi les 10% des thèses de la discipline. / La liberté de tester au Québec a longtemps été qualifiée de « illimitée ». Dans les faits, une telle liberté signifiait que le de cujus pouvait ne rien laisser à son ou sa conjointe ni à ses enfants. Or, depuis l'introduction des dispositions législatives sur la prestation compensatoire et, plus particulièrement, de celles sur le patrimoine familial et sur la survie de l'obligation alimentaire, l'étendue de cette liberté n'est plus la même. Bien que les Québécois soient toujours libres de déterminer par testament à qui ils souhaitent léguer leurs biens, leur liberté est désormais limitée par ces dispositions législatives impératives qui permettent au conjoint survivant et à la famille immédiate du défunt de réclamer certaines sommes à la succession, et ce, quelles que soient les dernières volontés du de cujus. Ainsi, le patrimoine sur lequel s'exerce la liberté du testateur n'est plus forcément celui sur lequel le défunt pouvait exercer sa volonté pendant sa vie et son mariage. Il n'est donc plus possible de parler de liberté « illimitée» de tester des Québécois. Ce constat quant à l'émergence de restrictions à la liberté testamentaire dans le Code civil nous conduit à nous interroger sur les raisons et les fondements de cette transformation de la liberté de tester et, incidemment, sur la question plus générale de la production et de l'évolution du droit de la famille dans la société. Pour répondre à ce questionnement, cette thèse repose sur une approche socio-juridique selon laquelle il faut rechercher les fondements de l'évolution du droit à l'intérieur des représentations sociales valorisées dans une société et une époque données. Partant du postulat que ce sont les changements dans les représentations sociales qui contribuent à expliquer le passage d'une rationalité sociale à une rationalité juridique, cette thèse dégage par quels acteurs, suivant quelles logiques et dans quels buts ces restrictions à la liberté de tester ont été introduites dans le droit québécois. Une telle façon d'aborder l'évolution du droit à partir de l'évolution des représentations sociales contribue ainsi à « éclairer» l'idée communément véhiculée selon laquelle le droit reflète l'évolution des moeurs. Grâce à une étude des représentations sociales inscrites et retracées dans le discours des acteurs sociaux - mémoires déposés à l'Assemblée nationale, Journal des débats, commissions parlementaires, jurisprudence, doctrine, textes de loi - cette thèse montre que les changements qui ont conduit à restreindre la liberté de tester au Québec ne dépendent pas que des perceptions relatives à la famille et au patrimoine, tel qu'on le rapporte généralement. L'introduction de restrictions à la liberté de tester dans le Code civil semble plutôt résulter d'un compromis entre l'évolution des représentations sociales sur les rapports familiaux et l'évolution des représentations sociales sur le droit, plus précisément quant aux fonctions du droit dans la société et aux conditions de sa cohérence. L'analyse de cette évolution permet enfin d'observer que si le droit des successions a longtemps été une « composante » du droit des biens, il constitue désormais, surtout, une « composante» du droit de la famille. / Formerly the freedom of wiIling in Quebec was considered to be "unlimited", which meant that its scope was such that the deceased could refrain from bequeathing any property at aIl to his or her spouse or children. Following the introduction of legal measures on compensatory allowance and, more particularly, provisions concerning the family patrimony and the survival of the obligation of support, the scope of this freedom is no longer as alI-inclusive as it once was. Although Quebeckers remain free to determine via their last wiIls and testaments to whom they wish to bequeath their property, henceforth their margin of freedom is limited by the preceding legislative changes which entitle the surviving spouse and immediate family of the deceased to claim to certain amounts from the succession, whatever the last will of the deceased may have been. As such, the patrimony upon which the testator now exercises freedom has ceased necessarily to be that which the deceased had control over during his or her life and marriage. It is thus no longer possible to refer to Quebeckers' "unlimited freedom" of wiIling. The emergence of limitations in testamentary freedom in the Civil Code invites us to question the reasons and foundations for this shift in the freedom of willing and, incidentaIly, the more general issue of the reform and evolution offamily law in society. To address these issues, this thesis is founded upon a socio-Iegal approach according to which it is essential to seek out the basis of the evolution of law from within the social representations valued in a society at a given time in its history. Beginning from the postulate that it is the changes in social representations that help to explain the transition from a social rationality to a legal rationality, this thesis illustrates by what actors, foIlowing which lines of logic and to what end these limitations in the freedom of wiIling were introduced into Quebec law. Such an approach to the evolution of the law on the basis of social representations thereby helps "to enlighten" the commonly expressed idea whereby law is a mirror image of mores. Based upon an analysis of social representations recorded and retrieved in the discourse of different social actors, including briefs tabled before the National Assembly and proceedings in the Journal of Debates, parliamentary committees, as weIl as decided cases, doctrine and statutory texts, this thesis seeks to demonstrate how the changes which led to the restriction in testamentary freedom in Quebec extend far beyond perceptions evoking family and patrimony as is generaIly claimed. The introduction of limitations in the freedom of willing in the Civil Code seems rather to result from a compromise between the evolution in social representations regarding family relationships and the evolution in social representations regarding law, more specifically with regard to the functions of law in society and the conditions underlying the law's systemic coherence. Lastly the analysis of this evolution makes it possible to observe that while the law governing successions was for a long time a "component" of property law, henceforth it has specifically gravitated to being a "component" of family law.

Elle vise plus précisément à comprendre comment et pourquoi les Judéo-espagnols de France, installés depuis le début du XXe siècle, utilisent les pratiques singulières des musiciens et chanteurs professionnels majoritairement externes à la communauté pour revendiquer leur patrimoine musical collectif et affirmer leur identité. La chercheuse replonge dans le passé afin de saisir comment le répertoire musical s’est construit et est devenu un objet quasiment exclusif au monde de l’art, alors qu’il reste associé aux répertoires dits « traditionnels ». En vue d’interroger la judéo-hispanité musicale et déterminer ce qui la caractérise au présent, une ethnographie multi-site auprès des artistes et de la communauté est proposée. Enfin, pour comprendre le sens des pratiques, différents espaces de performance sont examinés à partir de l’analyse des interactions entre les pôles de production et de réception, en cohérence avec le contexte général de la pratique et de l’ensemble des paramètres performanciels. La conclusion révèle notamment que la relation entre les artistes et la communauté génère un nouvel espace familial et intimiste et que chacun des espaces forme un système interrelationnel dont l’interaction permet de produire un équilibre qui consiste à faire vivre et à investir le patrimoine musical au présent. Par ce biais, c’est notamment la problématique des catégories musicales (musiques populaires, musiques traditionnelles, musiques de scène) reliées aux espaces de pratique qui est interrogée. / The central question of this research follows the problematic of patrimonialization (heritization), performance and mise en scene of musical practices. It aims, more precisely, to understand how and why Judeo-Spanish people settled in France since the early twentieth century, use individual practices of professional musicians and singers who are predominantly external to the community to reclaim their collective musical patrimony and affirm their identity. The researcher returns to the past in order to understand how this musical repertoire was constructed, and how it came to be almost exclusive to the art world, even though it is still associated to with the traditional music repertoire. Moreover, in order to question the Judeo-Spanish nature of the music and determine what presently characterizes it, a multi-site ethnography of the artists and the community is proposed. Finally, with a view to understanding the meaning of these practices today different spaces of performance are examined, especially the interaction between the poles of production and reception, in a general context, and through an examination of the parameters of its performance practice. One of the conclusions reveals that the constant relationship between the artist and the community generates a new kind of space for family and that each space constitutes an inter-relational system, thus constructing an interactive equilibrium, which keeps the musical patrimony alive. In this way, it is the problematic of musical categories (e.g. popular music, traditional music, staged music), related to spaces of practice, which is interrogated.

La protezione giuridica del paesaggio in Italia e in Francia / La protection juridique du paysage en Italie et en France / The juridical protection of the landscape in France and in Italy

Dans cette étude nous avons approfondi le statut de la protection juridique du paysage dans les deux pays. Le niveau constitutionnel de protection est plus ancien et spécifique en Italie, plus récent en France et voué généralement à l’environnement. Quant à la législation ordinaire, au-delà des Alpes on retrouve une multiplicité d’instituts de protection, différents selon le bien ou le territoire considéré. Les instruments administratifs et urbanistiques sont excessifs qui assurent souvent une protection seulement formelle et engendrent une incertitude. Toutefois la protection est élevée pour certains biens ou zones, et en particulier pour les zones du littoral ou pour celles soumises à la compétence des « Architectes des Bâtiments ». Le rôle des juges administratifs est prépondérant : En Italie, en revanche, les instituts fondamentaux (la contrainte, la planification et l’autorisation) gèrent généralement les biens et les territoires protégés. La planification a été peu et mal appliquée, tandis que l’autorisation a été gérée avec une extrême légèreté par les régions. Toutefois, même après la Convention Européenne paysagère, il apparaît dans les deux Pays un véritable droit dédié au paysage. Dans les conclusions, on propose notamment pour la France un système spécifique d’autorisations, la réduction des documents urbanistiques et environnementaux, l’introduction d’une discipline plus contraignante et un aménagement spécifique. Pour l’Italie la réalisation de l’aménagement du paysage est indispensable ou mieux encore, la planification du paysage pourrait être unifiée à l’aménagement urbanistique local, on créerait ainsi un lien qui n’existe pas. En outre, on propose que l’autorisation devienne exclusivement compétence de l’Etat. L’ensemble de ces règles pour protéger le paysage pourraient s’élever au rang de « domaine du paysage » compris non comme régime propriétaire mais comme statut engageant pour les biens d’une valeurs inestimable et d’utilité sous de multiples aspects. / This thesis expands on the status of legal protection of landscape in the two Countries. The Constitutional level of landscape preservation is older and specific in Italy, in France it is most recent and environment based in general. In regards to the ordinary legislation, beyond the Alps, we find a large number of institutions of preservation, differing according to the asset or the considered territory. There are overabundant administrative/urban instruments, that often provide only a formal protection and create some doubts. However, the preservation is high for some assets or areas, such as those in charge of the “Architectes des Bâtiments” or for the coastal areas. It is important the role of the administrative judge. On the contrary, in Italy, the fundamental tools (constrains, urban planning and permission) work for assets and protected territories in a generalized way. The planning has been little and badly implemented, while the permission has been used by the Regions with ease. However, the absolute right to the landscape presents itself in both Countries. In the conclusion, in regard to France, we advance, amongst other things, a specific system of legal permissions, the reduction of urban/environment documents, the introduction of more binding regulations and a specific scheduling. In regard to Italy, we think it appropriate to create a landscape planning, or better, to unify the landscape planning to the local urban one, creating a coordination, missing for the time being. In addition, we advance that authorization will be on State exclusive jurisdiction. The regulations could rise to the higher rank of ”Landscape State Property”, to be considered not as property regimen but as binding statute of priceless value and eminent domain assets for several respects. / La tesi intende approfondire la protezione giudica del paesaggio nei due Paesi. Senza trascurare il contributo offerto da altre discipline nel corso degli anni.Non è un caso che in Francia il paesaggio è considerato un tema di studi a parte intera. Fondamentale prendere in considerazione il livello costituzionale di tutela, avanzato e specifico in Italia, recente e relativo all’ambiente in generale in Francia. Interessante anche il contributo della Convenzione europea del paesaggio di Firenze e le definizioni di paesaggio offerte da diverse discipline. Il paesaggio è proiettato verso la qualificazione di vero e proprio diritto, anche fondamentale. Il lavoro continua con lo studio analitico di numerosi istituti che connotano la protezione nei due paesi. La Francia si caratterizza per un sistema che potremmo definire binario, uno dedicato alla generalità dei territori e l’altro alle numerose zone particolarmente sensibili. L’Italia presenta invece una certa omogeneità di protezione per tutti i territori presi in considerazione. Nel corso della tesi si effettua una comparazione dei due sistemi, pur tenendo conto delle evidenti differenze. Nelle conclusioni si sottolineano punti di forza e di debolezza e si prospetta qualche ipotesi di miglioramento dei due sistemi giuridici.

A pesquisa investigou aspectos da aprendizagem histórica a partir do trabalho com o patrimônio cultural. O objetivo foi identificar e analisar as representações das crianças sobre tempo, passado e história durante o trabalho com conceitos históricos relativos ao passado da comunidade local, tendo como referência a memória e a história da escola e do bairro. A hipótese era que o patrimônio cultural, como portador de sentidos diversos (históricos, políticos, culturais e sociais), potencializasse a significação de conceitos históricos e o estabelecimento de relações diferenciadas das crianças com a disciplina. Para articular as questões que envolvem a construção do conhecimento histórico e analisar aspectos da aprendizagem, foi realizada uma investigação qualitativa a partir de atividades com o patrimônio histórico-cultural da localidade onde vivem e estudam os sujeitos participantes da pesquisa. Partiu-se de referências teóricas relativas às pesquisas sobre o ensino da História bem como das propostas de ação educativa em museus e outros espaços históricos. Para compreender os processos de construção individual e coletiva do conhecimento adentrou-se os campos da psicologia do desenvolvimento e aprendizagem de base sócio-interacionista e da psicologia social, com a teoria das representações sociais. A compreensão destes processos foi articulada às referências das pesquisas sobre a especificidade da aprendizagem histórica e da construção do pensamento histórico pelas crianças. A pesquisa empírica foi realizada em uma escola da rede municipal de São Paulo, com uma turma de 36 alunos, entre 10 e 14 anos, do primeiro ano do ciclo II do ensino fundamental (5ª série), durante as aulas de História. A observação participante centrou-se no acompanhamento, descrição e análise dos significados que as crianças atribuíram a conceitos e informações históricas. Buscou-se identificar como os estudantes representam o conhecimento histórico trabalhado em diferentes momentos e suportes: a memória pessoal e coletiva, os registros e evidências históricas, as hipóteses e inferências levantadas pela professora, por outros adultos envolvidos e pelas próprias crianças. A pesquisa contribuiu para evidenciar as idéias e representações do conhecimento histórico pelas crianças - o que as crianças apreendem, quais os sentidos e significados construídos quando aprendem História. Possibilitou também a compreensão do papel dos processos de construção de representações mentais e sua interação com as representações sociais nas formas como os alunos se aproximam, interpretam, compreendem e expressam o conteúdo histórico na escola e em outros espaços. Foram explicitadas as especificidades do pensamento histórico e a multiplicidade de formas deste no processo de construção do conhecimento. A partir do trabalho com o patrimônio, memória e história local as crianças iniciaram um processo de ressignificação de suas concepções acerca de conceitos de tempo, passado e história. / The research investigated historical learning aspects based on the work with the cultural patrimony. The objective was to identify and to analyze the representations of children about time, past and history during the work with historical concepts about to the past of the local community, having the memory and history of the school and of the neighborhood as a reference. The hypothesis was that cultural patrimony, as a bearer of several senses (historical, political, cultural and social), would potentiate the significance of historical concepts and the establishment of differentiated relations of children with the discipline. A qualitative investigation was carried out to coordinate the issues that involve the building of historical knowledge and to analyze learning aspects, with a basis on activities with the historical-cultural patrimony of the place where the research subjects live and study. The starting point consisted of theoretical references relating to research about the teaching of History and of the proposals of educative action at museums and other historical places. To understand the processes of individual and group knowledge building, the work included penetration in the fields of psychology of development and learning of the socio-interactionist base and of social psychology, with the theory of social representations. The understanding of these processes was articulated with the references of researchs about the specificity of historical learning and of the building of historical thought by children. The empirical research was carried out at a school from the municipal network of Sao Paulo, with a class of 36 students between 10 and 14 years of age, from the first year of cycle II of elementary school (5th grade), during the History classes. The participant observation concentrated on the monitoring, description and analysis of the meanings that the children attributed to historical concepts and information. An attempt was made to identify how the students represent historical knowledge worked on at different times and on different bases: personal and collective memory, historical records and evidence, the theories and inferences brought up by the teacher, by other adults involved and by the children themselves. The research contributed to evidence the ideas and representations of historical knowledge by the children - what children learn, the senses and meanings formed when they learn History. It also permitted an understanding of the role of mental representation building processes and their interaction with social representations in the ways students approach, interpret, comprehend and express historical content at school and in other places. An explanation was provided about the specificities of historical thought and the multiplicity of its forms in the knowledge building process. Based on the work with the local patrimony, memory and history, the children embarked on a process of providing new meaning to their conceptions about concepts of time, past and history.

Adota, como estudo de caso, Serro (MG) reconhecendo sua natureza artística. Interpreta a teoria do restauro de Cesare Brandi focando o espaço urbano percebido, a partir da leitura da cidade antiga brasileira, através dos princípios artísticos de Camillo Sitte. Conclui que a cidade passa por transformações que podem comprometer sua condição artística, necessitando, desta forma, de ações de preservação apropriadas. / Study of possibility of the restore urban of the patrimony city. It reinforces the artistic character of the city, it recognizes your materiality through the space perception and it identifies physical conditions of urban spaces. It discusses your transformations for the preservation. The city of Serro (MG) was used as case study due its artistic nature. This study interprets the Cesare Brandi´s theory of restoration applied the urban space, and this urban space is interpreted through analysis of the brasilian old city (colonial city), according to artistic principles of Camillo Sitte. Like this we ended that the city changes and this change can to alter its artistic nature, imposing apropriate preservation action.

O objetivo desta pesquisa é identificar e compreender a contradição estabelecida entre o processo de degradação das Vilas Preservadas na Baixada do Glicério, localizada na região central da cidade de São Paulo, e a proposta de renovação urbana do mesmo centro por meio da Lei da Operação Urbana Centro (OUC), a qual se utiliza de instrumentos de preservação do patrimônio com a finalidade de possibilitar novas frentes de valorização do capital. O método de investigação, realizado a partir da análise do discurso e das proposições das políticas públicas, possibilitou constatar as diversas formas de operar com a idéia da degradação, diretamente relacionada ao contexto de desinvestimento. Neste contexto, além da política de renovação urbana dirigida ao centro da cidade de São Paulo e consolidada pela lei da Operação Urbana Centro, as noções de degradação e de congelamento também foram consideradas centrais no desenvolvimento desta pesquisa. Assim, como verificado com a análise das determinações da OUC no Glicério, pudemos entender que a degradação, ou ainda, o congelamento de determinadas áreas são produzidos historicamente pelas relações contraditórias contidas no processo de urbanização. São mantidas como frentes de valorização, a serem inseridas no processo de reprodução do espaço, no contexto da renovação urbana. É neste contexto que se caracteriza a preservação contraditória das vilas da Baixada do Glicério analisadas neste estudo, cujo instrumento de proteção acabou por intensificar seu processo de degradação, permanecendo sob o denominado estado de congelamento. / The purpose of this research is to identify and understand the contradictions between the established process of deterioration in the Baixada do Glicério, located in the region of central city of São Paulo, and the proposal for urban renewal of the same Centre by means of the Operação Urbana Centro (OUC), which is a Law that used instruments of preservation with the aim of enabling new fronts of capital valorization. The method of research, carried out from the analysis of speech and the headings of public policy, has enabled note the various forms of operating with the meanings of degradation, directly related to the context of disinvestment. In this context, in addition to the policy of urban renewal to the centre of the city of São Paulo and consolidated by the OUC, the concepts of degradation and freezing also were considered central to the development of this research. Thus, as occurred with the analysis of determinations by the OUC in Baixada do Glicério, we believe that the degradation, or even, the freezing of certain areas are produced by relations historically contradictory contained in the process of urbanization. Are maintained as fronts for valorization, to be included in the process of space reproduction, in the context of urban renewal. In this context, it is the hallmark of the contradictory preservation in Baixada do Glicério examined in this study, whose instrument of protection has intensified its process of deterioration, remaining under the state of freezing.

Os parques urbanos Sul-Americanos guardam reminiscências históricas e culturais cristalizadas em seus espaços naturais, nos monumentos e obras erigidas. A mensagem resultante desse universo visual pode ser utilizada para transmissão de conhecimento acerca do patrimônio local, mas requer um meio eficiente de comunicação para transformar esse potencial em informação clara e precisa, para entendimento e consumo dos usuários. Conforme constatado na analise dos projetos de sinalização visual ambiental do Parque Estadual Serra da Cantareira em São Paulo (Brasil), Güirã-Oga em Misiones, (Argentina) e Jardim Botânico no Rio de Janeiro (Brasil), os sistemas sinaléticos compostos por imagens e textos elaborados a partir da leitura e síntese do repertório local além de informar, direcionar e orientar, ainda provocam no usuário a reflexão crítica sobre as questões do patrimônio, com repercussão positiva para todo sistema. Dessa idéia, deriva a elaboração de diretrizes gerais para projetos de sinalização visual ambiental para parques urbanos Sul-Americanos, com o propósito de irradiar conhecimento sobre as paisagens naturais e culturais dos países da América Latina e em conseguinte, obter os benefícios inerentes como proteção e conservação. Para subsidiar a elaboração de diretrizes, uma base analítica de parques urbanos será planificada a partir da analise comparativa dos Parques Metropolitano de Santiago (Chile), do Ibirapuera de São Paulo (Brasil), Tres de Febrero de Buenos Aires (Argentina) e Del Prado de Montevidéu (Uruguai). Os métodos e práticas utilizados para as leituras dos parques se referem ao conjunto de multimeios propalados por Kevin Lynch (1988) na criação de urban design para cidades americanas. / The South American urban parks keep both historical and cultural reminiscences that are crystallized in their natural areas, in their monuments, and in their architecture. On the one hand, the message one acquires from this visual universe may be used to transmit knowledge about the local patrimony; however, it requires efficient communication means to transform this potential into clear and accurate information that leads to users\' understanding and consume. As verified in the visual environmental signage projects of Parque Estadual Serra da Cantareira in São Paulo (Brazil), Güirã-Oga in Misiones (Argentina), and of the Botanic Garden in Rio de Janeiro (Brazil), the signal systems - composed of images and texts based on research conducted in those areas and on the synthesis of the gathered information - not only inform, direct, and guide, but also lead users to make critical reflection on questions related to the patrimony, with consequent positive effects on the system as a whole. This idea is the basis from which visual environmental projects for South American urban parks are derived aiming to disseminate knowledge about natural and cultural landscapes of Latin American countries, and as a result, obtain the inherent benefits such as protection and conservation. In order to subsidize the elaboration of guidelines, an analytical basis for the urban parks will be planned based on a comparative analysis of the Parque Metropolitano in Santiago (Chile), Ibirapuera in São Paulo (Brazil), Tres de Febrero in Buenos Aires (Argentina), and Del Prado in Montevideo (Uruguay). The methods and practices chosen to research and analyze the parks comply with Kevin Lynch\'s set of multimedia (1960) used for creating the urban design for American cities.

A natureza jurídica dos fundos de investimento imobiliários / The legal nature of the real estate investment funds

O presente trabalho trata de tema extremamente útil, porém ainda pouco trabalhado pela doutrina brasileira. A Lei no 8.668/93, que criou os Fundos de Investimento Imobiliário (FII) no Brasil, foi o primeiro diploma a permitir a securitização e fracionamento da propriedade imobiliária, convertendo-a em valores mobiliários passíveis de negociação no mercado de capitais. Os Fundos de Investimento Imobiliário viabilizaram o acesso de pequenos investidores, incluindo pessoas físicas, ao mercado imobiliário, viabilizando a aplicação em empreendimentos de alto retorno que, entretanto, demandam grandes investimentos. A análise da natureza jurídica do FII se justifica pela importância econômica e social do instituto, mas a esta não se restringe, tendo em vista a riqueza do conteúdo jurídico-normativo que culminou na criação de uma modalidade diferenciada de fundo de investimento, espelhada no modelo norte americano, o Real Estate Investment Trust. O Fundo de Investimento Imobiliário é um exemplo bem sucedido da criatividade legislativa, que através da combinação de institutos alcançou o que consideramos ser a figura no Brasil que mais se assemelha ao trust anglo saxão. A estrutura atribuída ao FII, marcada, em especial, pela propriedade fiduciária e pelo regime de afetação, revestem o Fundo de peculiaridades que reclamam a análise de sua natureza jurídica sob uma perspectiva própria, e diferenciada dos demais fundos de investimento. A investigação acerca da natureza jurídica do FII requer a releitura de conceitos que transitam entre o Direito Civil e o Direito Comercial, tais como de comunhão, condomínio e sociedade, negócio fiduciário, negócio indireto, propriedade, direitos reais e pessoais, patrimônio separado, pessoa jurídica e sujeito de direito, de cujo resultado decorre o reconhecimento do Fundo de Investimento Imobiliário como contrato de sociedade, caracterizado pela perseguição de uma finalidade econômica através de uma organização. O escolha do tema e a metodologia empregada no desenvolvimento deste trabalho tiveram por objetivo não só o aprofundamento da matéria, mas também a inspiração de outros estudos com base na common law, que possam igualmente levar à conclusão a respeito da beleza e eficiência de um sistema legal construído sobre estruturas abertas e mais flexíveis. / The theme of this paperwork is extremely useful, but not so much explored by Brazilian doctrine. The Law 8.668/93, which created in Brazil the Real Estate Investment Funds (Fundos de Investimento Imobiliário FII), was the first statute to allow the securitization and fractionation of real estate, converting it into subject securities traded in the capital market. The Real Estate Investment Funds enabled retail investors, including individuals, to access the real estate market, qualifying them to apply their resources on high-return ventures that, however, require large investments. The analysis of the legal nature of the FII is justified by the economic and social importance of the institute, but is not restricted thereto taken the enriched content of the legal-normative framework that culminated in the creation of a unique model of investment fund, mirrored in the North American Real Estate Investment Trust. The Real Estate Investment Fund is a successful example of legislative creativity that by combining institutes reached what we consider to be the figure in Brazil that most resembles the Anglo Saxon trust. The structure assigned to the FII, marked in particular by the fiduciary property and the rules of affectation, lines the Fund with certain peculiarities that demand the analysis of its legal nature under its own perspective, isolated from the other investment funds. Research on the legal nature of FII requires the reinterpretation of concepts that integrate both the Civil and Commercial Law, such as communion, condominium and company, fiduciary relationship, indirect relationship, property, real rights and personal rights, separated patrimony, legal person and capacity, which result leads to a due recognition of the Real Estate Investment Fund as a corporate agreement, characterized by the pursuit of an economic purpose through an organization. The choice of the theme and the methodology applied for the development of this paperwork aimed not only to deepen the matter, but also to inspire further studies based on the common law that could also lead to the conclusion about the beauty and efficiency of a legal system built on open and more flexible structures.
