Issues of school governance within the transformative paradigm : exploring parental involvement in Waterberg District

The concept of parental involvement has been viewed as an ideal style of leadership and management for school development purposes. In South Africa’s case, it is an educational policy which is expected to reign in all school management bodies. Many theorists envisaged parental involvement as enhancing active involvement of parents and it has been advocated by many scholars who believe it is the best leadership style in implementing democratic values to education, particularly South African rural education, which is still in a transitional stage. The primary purpose of this research was to investigate the extent to which parents contribute towards education of their children. This study involved transformative case study as a research design at one rural school in Waterberg district in South Africa. This research employed three data collection techniques, namely semi-structured interviews, focus groups and document analysis. When formal education was introduced in South Africa schools it was regarded as exceptional environment for teachers, school administrators and learners. To a large extent, parents and the communities regarded themselves as something outside of the education system. The main findings of this study revealed that there is a lack of joint understanding and shared vision between educators and parents in the School Governing Body. This problem underpins other more symptomatic problems, such as lack of accountability in the matter of school finances, differences in understanding the roles of School Board members and lack of parents’ motivation from the school management. It highlighted some of the challenges that hinder the effective involvement of parents in rural school governance, such as poor educational background among parents. The study has also revealed challenges and consequences of non-parental involvement in school governance. The conclusion that could be drawn from the study is that in schools where parent-community involvement is highly visible, teacher effectiveness is apparent and this contributed significantly to the improvement of learner performance while in schools where parent-community involvement is non-existent or minimal, the result is the opposite. / Educational Leadership and Management / M. Anxiety and lack of motivation as factors affecting success rates in bridging mathematics

The aversion to the study of mathematics and the resultant poor performance by students generally cannot be overemphasized and this still poses a great threat to the needed skills in the science, technology and commerce sector in South Africa. This study therefore tends to explore the importance of Mathematics to students and the economy globally by focusing on which contributive psychological factors are responsible for low performance in mathematics among Pre degree students as a case study. In addition also, the teaching and learning strategies used in the classroom that will help curb mathematics anxiety among students will be looked into. Furthermore a test to ascertain if poor teaching methods or pedagogical content knowledge of mathematics’ teachers influence anxiety thereby leading to poor performance in mathematics will be carried out. By utilizing a mixed method approach, an integration of the qualitative and quantitative approaches, the study attempted to provide an insight into the poor performances in Mathematics by Pre-degree students in a Private Institution of higher learning by exploring the following affective domains: 1) Anxiety 2) Motivation (lack of either the Internal & External type) and also considering the teaching strategies adopted on the other hand. The theoretical framework applied to this study was three fold in nature, namely, to investigate the nature of the relationship between mathematics anxiety and mathematics achievement on one side, secondly, to investigate the nature of the relationship between motivational orientation and mathematics achievement on the other side. Finally, it will investigate the relationship between teaching methods and mathematics achievement. The major findings that emanated from this study were as follows: there is a strong impact of the affective factors (anxiety, beliefs, emotions and motivation) on mathematics learning and success rates among Pre-degree students in South Africa. This study shows the importance of affective factors (such as anxiety, negative attitude, lack of motivation) in determining the success and or failure of mathematics learning, with the intention of promoting and encouraging positive traits, attitudes and beliefs in the students. The issue of teaching strategies was however not of a strong impact on success rates in bridging mathematics among the students as their lecturers were commended to be on top of their subject, but only that strategies to teaching mathematics must be dynamic, effective and varied as much as possible to meeting the students diverse learning styles . / Mathematics Education / M. Michael Walzer美國當代社群主義的代表人物,同時也是一位出名的公共知識分子,其哲學思想與政治理念均有其獨到之處,而其中Walzer特別強調社會才是作為個人權利與自由實踐的場所,而擺脫了傳統自由主義理論下,只存在國家與個人的關係。而其最著名的正義的諸領域(Spheres of Justice),更是在研究近代關於自由主義與社群主義正義論的一本經典,而Walzer正義論中最吸引我的地方在於其放棄像是John Rawls等正義理論的無知之幕,反而主張在討論正義的時候,應該以每個不同社會和社群之間的文化與歷史的發展為基礎,因此Walzer的正義理論強調各種不同的特殊性,而維護正義是國家所必須要出面來作的一件事情,但如何維護多元、自由的社會諸領域中的不同正義原則,Walzer提出一套「複雜平等概念」的哲學思考模式,以及從「公眾利益」為出發點的利益衡量原則。 因此結合Walzer的複雜平等概念與公眾利益的衡量原則,本文提出一套「權利實踐理論」,在這個理論架構之下將會注意到其實法律上所謂的權利僅是作為一種象徵法律權威的意義而已,真正個人想要落實權利實踐必須要集合足夠的政治權力才能夠獲得一個社會實踐的空間與可能性,而這往往與個人在詮釋法律的方式與態度有關,也就是說只有個人提供一個好的詮釋之理由,才能夠獲得足夠的政治權力的協助來個人權利的實踐。 但是法律中往往存在許多「不確定法律概念」,這是為了在特殊的情況時,來能夠實踐個別正義的設計,而法官所負擔的工作,就是透過詮釋,在個案中確立法律概念與原則,有時候會發覺法官並沒有再進行法律的詮釋工作,而也許只是單純的「依法判決」重新確認權利人行使權利之資格而以,但為何有時卻會有限縮或是擴張解釋法律的情況出現,而這背後的判斷標準和原則到底又是什麼,法官這樣做是否合法?是否由於法官是詮釋行為中的最高權威,就代表法官擁有自由的詮釋法律的空間? 但從Walzer的思考脈絡中,我們可以知道最高的權威者,還是有一定的責任與必須遵守地義務,但其同時也有一定程度的自由和自主決定的空間,依照Walzer的說法,國家也就是站在是最高權威者角色上,維護個人和社會自主性是其必須地義務,並且要防範任何形式的暴力破壞個人和社會的自主性,包含國家自身,而這時候衡量與判斷的標準往往就是所謂地「公共利益」或是「公眾利益」因此公眾利益是判斷國家行為合法性的依據。 而本文就嘗試以美國著作權法中,合理使用原則的公眾利益衡量標準,觀察法官是如何「公共利益」型塑某些原則的重要性,而且也同時還能保留有一定的開放性空間,以處理個案中截然不同地主張與原則的空間。

Social workers' conceptualizations of spirituality as lived experience in professional practice

This doctoral study explores social workers’ shared understandings of spirituality as lived experience in their personal lives and professional practice. It examines Canadian social workers’ shared conceptualizations of spirituality as lived experience, what it entails, its role and purpose (why), and how it informs professional practice. Data collection involved three steps: a national publicity led to 24 completed self-screening questionnaires (SSQ); 14 in-depth interviews conducted through constructivist grounded theory’s theoretical sampling and; the preliminary findings were validated by the 24 SSQ participants. This study generated two key findings. The central concepts category of the conceptual schema of spirituality as lived experience emerged as Transcendent Life Energy (TLE) as Unconditional Love (UL) in Transformative Relationships (TR) With Self (WS) in Support of Wellbeing (SW)- i.e. TLE-UL-TR-WS-SW. Second, the conceptual schema analyzed through Self as body-mind-emotions-spirit-social (B-M-E-S-S) being—the social work practitioners—illuminated that spirituality as lived experience is about inherent, interconnected, transformative relationships that involve individuation as a life-long process that support healing, development of personal values, growth, and wellbeing in participants’ lives, their clients’ and social life. These findings unveiled interrelated discoveries of significance in social work practice. The wellbeing of Self is inherently interconnected with practitioners’ professional practice, their clients’ and others’ wellbeing. This confirmation is consistent with the concerns about the use of Self in countertransference and religion/culture. However, the personal values that participants developed through the conceptual schema were consistent with human rights and social work values; they included: respect for inherent dignity and worth of persons, self-determination, personal and professional integrity, do no harm, and social justice. Participants’ process of developing personal values exposed a distinction between beliefs and values acquired through socialization and those developed through the conceptual schema. These findings illuminate the function of social work as catalyst for transformative relationships and clarify the role of individuation as directly related to wellbeing, in the midst of cultural and embodied hegemony. Furthermore, the findings illuminate how, why, and what spirituality as lived experience entails and; highlight the multidisciplinary nature of social work practice and theory as inherently interconnected, encompassing human, natural, and social sciences. / October 2016

Transformer les pratiques professionnelles vis-à-vis des personnes prestataires de l’aide sociale : développement participatif et évaluation d’une formation continue en cabinet dentaire

L’objectif de la présente thèse est de générer des connaissances sur les contributions possibles d’une formation continue à l’évolution des perspectives et pratiques des professionnels de la santé buccodentaire. Prônant une approche centrée sur le patient, la formation vise à sensibiliser les professionnels à la pauvreté et à encourager des pratiques qui se veulent inclusives et qui tiennent compte du contexte social des patients. L’évaluation de la formation s’inscrit dans le contexte d’une recherche-action participative de développement d’outils éducatifs et de transfert des connaissances sur la pauvreté. Cette recherche-action aspire à contribuer à la lutte contre les iniquités sociales de santé et d’accès aux soins au Québec; elle reflète une préoccupation pour une plus grande justice sociale ainsi qu’une prise de position pour une santé publique critique fondée sur une « science des solutions » (Potvin, 2013). Quatre articles scientifiques, ancrés dans une philosophie constructiviste et dans les concepts et principes de l’apprentissage transformationnel (Mezirow, 1991), constituent le cœur de cette thèse. Le premier article présente une revue critique de la littérature portant sur l’enseignement de l’approche de soins centrés sur le patient. Prenant appui sur le concept d’une « épistémologie partagée », des principes éducatifs porteurs d’une transformation de perspective à l’égard de la relation professionnel-patient ont été identifiés et analysés. Le deuxième article de thèse s’inscrit dans le cadre du développement participatif d’outils de formation sur la pauvreté et illustre le processus de co-construction d’un scénario de court-métrage social réaliste portant sur la pauvreté et l’accès aux soins. L’article décrit et apporte une réflexion, notamment sur la dimension de co-formation entre les différents acteurs des milieux académique, professionnel et citoyen qui ont constitué le collectif À l’écoute les uns des autres. Nous y découvrons la force du croisement des savoirs pour générer des prises de conscience sur soi et sur ses préjugés. Les outils développés par le collectif ont été intégrés à une formation continue axée sur la réflexion critique et l’apprentissage transformationnel, et conçue pour être livrée en cabinet dentaire privé. Les deux derniers articles de thèse présentent les résultats d’une étude de cas instrumentale évaluative centrée sur cette formation continue et visant donc à répondre à l’objectif premier de cette thèse. Le premier consiste en une analyse des transformations de perspectives et d’action au sein d’une équipe de 15 professionnels dentaires ayant participé à la formation continue sur une période de trois mois. L’article décrit, entre autres, une plus grande ouverture, chez certains participants, sur les causes structurelles de la pauvreté et une plus grande sensibilité au vécu au quotidien des personnes prestataires de l’aide sociale. L’article comprend également une exploration des effets paradoxaux dans l’apprentissage, notamment le renforcement, chez certains, de perceptions négatives à l’égard des personnes prestataires de l’aide sociale. Le quatrième article fait état de barrières idéologiques contraignant la transformation des pratiques professionnelles : 1) l’identification à l’idéologie du marché privé comme véhicule d’organisation des soins; 2) l’attachement au concept d’égalité dans les pratiques, au détriment de l’équité; 3) la prédominance du modèle biomédical, contraignant l’adoption de pratiques centrées sur la personne et 4) la catégorisation sociale des personnes prestataires de l’aide sociale. L’analyse des perceptions, mais aussi de l’expérience vécue de ces barrières démontre comment des facteurs systémiques et sociaux influent sur le rapport entre professionnel dentaire et personne prestataire de l’aide sociale. Les conséquences pour la recherche, l’éducation dentaire, le transfert des connaissances, ainsi que pour la régulation professionnelle et les politiques de santé buccodentaire, sont examinées à partir de cette perspective. / This thesis aims to generate knowledge on how a continuing education course might contribute to the evolution of oral health professionals’ perspectives and practices. Promoting patient centered care, the course aims to sensitize professionals to poverty issues and to encourage socially inclusive practices that take into account the social context of patients. The course evaluation is nested within a participatory action research project aimed at developing educational and knowledge transfer tools to sensitize oral health professionals to poverty issues and Our research strives to contribute to the fight against social inequities in health and in access to care in Québec; it is grounded in our intent for greater social justice and reflects our belief in the importance of a critical public health founded on a « science of solutions » (Potvin, 2013). Four scientific articles, grounded in constructivism and in the concepts and principles of transformative learning theory (Mezirow, 1991), constitute the heart of this thesis. The first presents a critical review of the literature on health professional education for patient-centered care. We focus on the concept of shared epistemology as a foundation for patient-centered care and determine and analyse the educational principles allowing for its development in students and practitioners. Our second article, located within the participatory developmental process, delves into the co-construction of a social realist screenplay portraying poverty and issues of access to dental care. The article examines and reflects on the participatory processes, in particular the co-learning that took place among the partners involved in writing the screenplay and in producing the educational tools on poverty. We discover the potency of shared knowledge among professionals, citizens, educators and academics for enhancing reflection on bias and perspective taking. The educational tools developed have been integrated into an onsite credited continuing education course on poverty and oral health, privileging critical reflection, founded on transformative learning theory, and integrating dimensions of person-centered care. The results of an instrumental case study among the 15 members of a dental team having participated in the course constitute the last two articles of the thesis. The first describes and analyzes the new meanings and actions among course participants, emphasizing shifts in thinking about the causes of poverty, about life on welfare, about certain patient behaviors and about the participants themselves. New actions refer to changes made in verbal and non-verbal communication and appointment giving policy. The article also examines unanticipated and paradoxical effects of learning, such as the reinforcement of certain beliefs. The final thesis article presents the case study results in terms of the participants’ experience of their workplace ideologies and how these constitute obstacles or objections to learning or to making practice or policy changes. These ideologies include 1) identification with a for-profit and private market oral health care system; 2) “equal treatment”, a belief constraining concern for equity and the recognition of discriminatory practices; 3) a predominantly biomedical orientation to care; and 4) stereotypical categorization of publically insured patients into « deserving » vs. « non-deserving » poor. This knowledge contributes to our understanding of systemic influences on professionals’ practices and interactions with patients living on welfare. We discuss implications for research, dental education and knowledge translation, as well as in terms of oral health policy and oral health professional regulation.

Learning to Teach in an Intensive Introductory TESL Training Course: A Case Study of English Teacher Learning

Despite a growing body of research on trainee teachers’ learning during pre-service programs, intensive introductory TESL training courses are still designed to instruct a “standard” type of trainee teacher. This research study investigates the factors that mediate trainee teachers’ learning process as well as the interaction between these factors, which either facilitate and/or hinder trainee teachers’ success during an intensive introductory TESL training course. Using a qualitative holistic single-case study, informed by an interpretivist perspective, this study explores how three trainee teachers learned how to teach during a course in Southern Ontario, Canada. An integrated conceptual framework, formed by a sociocultural perspective of teacher learning, a holistic view of curriculum, and transformative pedagogy was employed and the findings include four major factors that mediated trainee teachers’ teacher learning process and three types of interaction that facilitated and/or hindered their success during the program.

In this thesis the overall aim is to analyse conceptions of change with the point of departure being texts developed within the framework of three development partnerships financed by the European Social Fund's Equal Programme 2001-2007. The development partnerships, consisting of collaborating parties from both the public and private sector, aimed at developing new methods and ideas in order to counteract discrimination and all kinds of inequality in working life. The thesis poses the following research questions: How are the problems that the development partnerships intended to counteract described? What appears as important to change in order for discrimination in working life to decrease? In what ways are changes aimed at combating discrimination and contributing to increased gender equality and diversity in working life deemed possible? What motives emerge behind the visions of creating a working life without discrimination? How are gender and other social categories constructed and how do these constructions impact on the conceptions of change that emerge? The ideas, perspectives and interests that characterise the understanding of changes in working life in the studied texts, are illustrated with the aid of theories on how society's forms of rule have changed from government to governance and theories on how gender is done. Furthermore, why certain perspectives and ideas emerge and the consequences of them is analysed based on institutional ethnography and concepts such as social relations and ruling relations. The thesis' analysis points to how the consensus-based organisational form of partnership and the politics and principles that are reflected in the Equal Programme together with notions on growth, leadership and gender create limits for the conceptions of change. Limits that in certain respects entail that society's relations of power and inequality, instead of being challenged, are reproduced. Based on the results of the study, the importance is emphasised of continuously taking one's point of departure in identifying and challenging the limits to how one can speak of change, since the dominant conceptions of change may be an expression of the ruling relations. / I den här avhandlingen är det övergripande syftet att analysera föreställningar om förändring med utgångspunkt i texter som tagits fram inom ramen för tre utvecklingspartnerskap som finansierades av den Europeiska socialfondens Equal-program 2001-2007. Utvecklingspartnerskapen, som bestod av flera samverkansparter från privat och offentlig sektor, syftade till att utveckla nya metoder och idéer för att motverka diskriminering och all slags ojämlikhet i arbetslivet. Avhandlingen utgår från frågeställningarna: Hur beskrivs de problem som utvecklingspartnerskapen avsåg att motverka? Vad framstår som viktigt att förändra för att diskrimineringen i arbetslivet ska minska? På vilka sätt antas förändringar, som anses leda till minskad diskriminering och ökad jämställdhet och mångfald i arbetslivet, vara möjliga? Vilka motiv framträder bakom visionerna om att skapa ett arbetsliv utan diskriminering? Hur konstrueras kön och andra sociala kategorier och hur inverkar dessa konstruktioner på de föreställningar om förändring som framträder? Med hjälp av teorier om hur samhällets styrformer förändrats ”från government till governance” och teorier om hur kön görs åskådliggörs vad det är för idéer, perspektiv och intressen som karakteriserar förståelsen av förändringar i arbetslivet i de rapporter, filmer, utbildningar och metodböcker med mera som studerats. Utifrån den institutionella etnografin och begrepp som sociala relationer och styrningsrelationer analyseras vidare varför vissa perspektiv och idéer framträder och konsekvenserna av dem. Avhandlingens analys pekar på hur den konsensusbaserade organiseringsformen partnerskap och den politik och de principer som reflekteras i Equal-programmet tillsammans med föreställningar om tillväxt, ledarskap och kön skapar gränser i föreställningarna om förändring. Gränser som i vissa avseenden innebär att samhällets relationer av makt och ojämlikhet – istället för att utmanas – reproduceras. Utifrån studiens resultat poängteras vikten av att ständigt ta utgångspunkt i att identifiera och utmana gränserna för hur det går att tala om förändring eftersom dominerande föreställningar om förändring kan vara ett uttryck för samhällets styrningsrelationer.

本研究目的是從注意力恢復理論的觀點檢驗服務環境中的人際因素如何影響恢復體驗,進而帶給顧客注意力幸福感。人際因素有顧客小群體的人際融洽、其他顧客的相似性、外表及行為適當性、以及服務人員的服務友誼、顧客導向行為與銷售導向行為。本研究執行兩個研究,研究一將會透過量表建構過程發展一個恢復體驗量表,適用於享樂型人身處理或心理刺激處理類型的服務業,並得知恢復體驗的概念內涵與組成要素。研究二將檢驗恢復體驗的前因與後果,以及恢復體驗是否會中介人際因素與注意力幸福感之間的關係。研究一結果指出恢復體驗由內容迷戀、暫時逃離、動機相容、能力相容、活動新奇感與心流六個子構面組成,該量表共以21題衡量,並具有良好的信度、收斂效度、區別效度與外在效度。研究二結果指出服務環境中的人際因素會顯著的影響恢復體驗,而恢復體驗亦會帶來顧客的注意力幸福感,恢復體驗會完全中介人際因素與注意力幸福感之間的關係。根據研究結果討論理論、方法與管理意涵。在服務業情境的恢復體驗概念內涵比大自然情境多了過程迷戀面向,但是少了一致性面向。恢復體驗的前因應不只限於與大自然有關的實體因素而已,因為人際因素亦是恢復體驗重要的前因。恢復體驗與其子構面間的關係應被建模為反映型而非形成型。本研究提供服務業者指南,告知其如何透過人際因素的形塑與管理,帶給顧客注意力幸福感。由於小群體融洽相對於其他人際因素而言對顧客的恢復體驗影響較大,服務業者應將較多資源分配在管理顧客小群體上,並促成其產生小群體融洽。最後,提出研究限制與未來研究方向。 / The purpose of this research is to examine how interpersonal factors in service environment influence restorative experience, which in turn facilitates attention-related well-being of customers from the perspective of attention restoration theory. Interpersonal factors include small groups (i.e., interpersonal rapport), other customers (i.e., similarity, physical appearance, and suitability of behavior), and service providers (i.e., service friendship, customer orientation, and selling orientation). Two studies were conducted. Study 1 developed a scale of restorative experience applicable to hedonic service industry of people-processing or mental stimulus processing types. Also, the conceptual domain and components of restorative experience were discussed. Study 2 examined the antecedents and consequences of restorative experience and whether restorative experience mediates the relationship between interpersonal factors and attention-related well-being. The results of study 1 indicated that restorative experience is comprised of six dimensions- content fascination, escape, motivation compatibility, competence compatibility, novelty of activity, and flow. The new scale is measured using 21 items and has good reliability, convergent validity, discriminant validity, and external validity. The results of study 2 indicated that interpersonal factors in service environment significantly influence restorative experience, which in turn influences attention-related well-being. Restorative experience completely mediates the relationship between interpersonal factors and attention-related well-being. Theoretical, methodological, and managerial implications are discussed. Compared to natural environment, restorative experience in the service environment contains the dimension of process fascination but has no dimension of coherence. Since interpersonal factors facilitate restorative experience, the antecedents of restorative experience should not be confined to natural elements of physical environment as done in the past studies. The relationships between restorative experience and its sub-dimensions should be modeled as reflective, not formative. This research provides guideline for service marketers to manage and harness interpersonal factors and improve attention-related well-being for customers. Since rapport in customer small group has more influence than other interpersonal factors on restorative experience, service marketers should put more resource in managing customer small groups and facilitating rapport among members in customer small group. In the end, limitations and direction of future research are presented.

Local government's role in the pursuit of the transformative constitutional mandate of social justice in South Africa / Oliver Njuo Fuo

South Africa's transition to constitutional democracy marked the end of a system of government that perpetuated injustice on the basis of race. The previous system of government, underpinned by the principle of parliamentary supremacy, did not only exclude the majority of the population from public governance processes, it also economically exploited the majority of the population. As such, it laid the foundation for widespread poverty and inequalities in access to basic services. The Constitution of the Republic of South Africa, 1996 (the Constitution), is committed to correcting these past injustices and aims to establish a society based on social justice. This constitutional vision finds expression in the notion of transformative constitutionalism. Klare introduced the notion of transformative constitutionalism over a decade ago. For purpose of this thesis, the notion represents the socio-economic and political vision of post-apartheid South Africa to eradicate extreme poverty and inequalities in access to basic services as well as establish a democratic system of government that is inclusive, caring, participatory, representative and accountable. It captures the constitutional commitment to establish and maintain a society based on social justice by inter alia, eradicating poverty and inequalities in access to social services. The realisation of the socio-economic rights entrenched in the Bill of Rights of the Constitution (by all organs of state) is one of the ways in which to contribute towards meeting this transformative constitutional mandate, and by extension, striving towards the attainment of social justice. Although transformative constitutionalism and the achievement of a socially just society remain an ideal, the Constitution as the supreme law in the country, obligates the state, constitutive of public and private entities, to work towards its realisation, to the fullest extent possible. As part of post-apartheid institutional transformation, the Constitution established three spheres of government – national, provincial and local - which are distinct, interrelated and interdependent. All three spheres are obliged to operate in accordance with the principles of co-operative government and intergovernmental relations and are co-responsible for realising a number of constitutional objectives. Since 1996, the Constitution obliges local government (municipalities) to play an expanded "developmental" role. This has marked a move away from local government being regarded as merely a service delivery arm of government. xii The extended function of local government that came about with the constitutional dispensation finds expression in the notion of "developmental local government". This study is based on the premise that developmental local government must and can, together with the authorities in the other two spheres, contribute to transformative constitutionalism and social justice. Primarily, this study questions the extent to which the legal and policy framework on local government in South Africa enable local government (municipalities) to contribute towards realising the constitutional socio-economic rights underpinning the mandate of transformative constitutionalism. This study presents a review of relevant literature in order to establish links between the theoretical concepts underpinning this thesis. It examines the legal and policy framework on "developmental" local government in South Africa and analyses the central legal framework for the realisation of socio-economic rights at the local government level. In addition, the study explores the relevance and potential of local government indigent policies and Integrated Development Plans (IDPs) - as legally prescribed governance instruments - in contributing towards a more just society by examining their underlying legal and policy framework. It further distils from the theories and perspectives of social justice, benchmarks to guide local government towards achieving the transformative constitutional mandate aimed at social justice. South Africa's transition to constitutional democracy marked the end of a system of government that perpetuated injustice on the basis of race. The previous system of government, underpinned by the principle of parliamentary supremacy, did not only exclude the majority of the population from public governance processes, it also economically exploited the majority of the population. As such, it laid the foundation for widespread poverty and inequalities in access to basic services. The Constitution of the Republic of South Africa, 1996 (the Constitution), is committed to correcting these past injustices and aims to establish a society based on social justice. This constitutional vision finds expression in the notion of transformative constitutionalism. Klare introduced the notion of transformative constitutionalism over a decade ago.
