Previous issue date: 2015-04-16 / The Law no. 11.340/2006, usually known as Maria da Penha s Law, was enforced in Brazil in response to public and media demands for severe criminal answers towards domestic violence against women, in order to restrain and prevent such violence. Therefore, it s positive to state that Maria da Penha Law is inserted in the context of the penal populism phenomenon, characterized by usual governmental devices on creating symbolical laws focused on the optimum utilization of the punitive system in attempt to solve social problems. These recurrences, however, are fairly criticized because the criminal justice is facing an epistemological legitimacy crisis for failing to fulfill its promises of protecting legal goods and preventing criminal behavior. So, this essay was developed, based on critical criminology findings, in order to evaluate the repercussions of Maria da Penha Law punitiveness, as well as to ascertain whether its purposes are being accomplished. Also, the investigation was focused on the effects of criminal justice s intervention on women (victims) and men (offenders). To assess whether the Law s purposes are being met, as well as to explore its punitive effects, an empirical study was carried out in a domestic violence against women s Court in Recife (Northeast Brazil). Data collection was through participant and non-participant observation (ethnography) of trial hearings, as well as through the documentary analysis of sentenced criminal cases. It was found that both victims and offenders are most often black and belong to the lower classes. Moreover, our data suggests that offender imprisonment has increased, inasmuch as all cases involved petty misdemeanor and offenders were invariably sentenced to prison. Also, because domestic conflicts tend to involve family/affectional bonds, and women are usually keen to drop the case but are prevented by law from doing so, they end up revictimized in the criminal justice system. Moreover, conflict s property stealth by the penal system in order to guarantee penal prosecution ends up ignoring woman s wishes and silencing them. Therefore, towards domestic violence against women, penal system works perfectly in its most traditional ways: selects its clients and reproduces violence and pain. Thus, it was verified that, in general, criminal discourse is inappropriate to address domestic and familiar conflicts, since it ignores the conflict s origin, penalizes women victims and, symbolically and selectively, goes after a guilty party to impose a penalty. / Com a finalidade de criar mecanismos para coibir e prevenir a violência doméstica e familiar contra a mulher, o legislativo criou a Lei n.º 11.340/2006, popularmente conhecida como Lei Maria da Penha . A legislação surgiu no cenário jurídico nacional como resposta política às fortes demandas midiáticas e populacionais, por ações mais incisivas contra a criminalidade doméstica. Pode-se afirmar, assim, que a Lei Maria da Penha está inserida no contexto do fenômeno do populismo punitivo , marcado pela frequente recorrência governamental à criação de legislações simbólicas voltadas para a máxima utilização do sistema punitivo na tentativa de solucionar mazelas sociais. Tais recorrências, entretanto, são bastante criticadas porque o sistema penal enfrenta uma crise de legitimidade epistemológica por não conseguir cumprir suas promessas de proteção de bens jurídicos e prevenção de condutas criminosas. Esta dissertação, portanto, se destinou a investigar, sob a égide dos estudos da criminologia crítica, os efeitos do incremento punitivo da Lei Maria da Penha , bem como se os propósitos declarados da legislação vêm se cumprindo, através da averiguação do funcionamento do sistema de justiça criminal quando do enfrentamento da violência doméstica e familiar contra a mulher, especialmente por meio da investigação do trato que confere às pessoas envolvidas nesse conflito, a saber, mulher (vítima) e homem (acusado). Para a concretização desse objetivo, foi realizada uma pesquisa empírica em uma Vara de Violência Doméstica e Familiar contra a Mulher do Recife - VVDFMR, na qual se utilizaram, enquanto métodos complementares, a observação etnográfica e a pesquisa documental. A coleta de dados se deu ao longo do ano de 2014 e envolveu a imersão da pesquisadora no cotidiano da VVDFMR, especialmente nas audiências nela realizadas, bem como a análise de processos criminais sentenciados ao longo de um ano na Vara. Os resultados obtidos apontaram para o fato de que os homens e mulheres envolvidos nos conflitos doméstico e familiar que chegam à VVDFMR são predominantemente pardos e pertencem a classes sociais menos abastadas. Ademais, as taxas de encarceramento de agressores aumentou consideravelmente, apesar de as condenações devidas à prática de infrações penais de menor potencial ofensivo. Outrossim, como se trata de uma relação familiar em que homem e mulher partilham sentimentos de afeto, as mulheres normalmente não desejam a intervenção penal em seus conflitos. Ademais, Estado penal rouba o conflito dessas mulheres, de modo que são instrumentalizadas em função da prioridade da persecução penal dos seus agressores e, assim, os seus anseios são olvidados e as suas falas silenciadas. Logo, o sistema penal no âmbito da violência doméstica de gênero, atua na sua forma mais tradicional: selecionando a sua clientela e reproduzindo violência e dor. Como regra, pois, o discurso penal é inapropriado para o enfrentamento problemas domésticos e familiares, porque ignora as origens do conflito, penaliza, com suposto discurso de proteção, as mulheres vítimas e, simbólica e seletivamente, vai atrás de um culpado impondo-lhe uma pena.

Våld i nära relationer är ett omfattande socialt problem i Sverige och problemet förekommer regelbundet i nyhetsmedier. Denna studie syftade till att undersöka beskrivningarna av mäns våld mot kvinnor i nära relationer i två välspridda svenska tidningar. Studiens frågeställningar gällde hur våldsutsatta kvinnor och våldsutövande män beskrivs samt hur relationen, våldet och dess händelseförlopp beskrivs. Kritisk diskursanalys, med utgångspunkt i Norman Faircloughs tredimensionella modell, utgjorde studiens metod och teoretiska ramverk. Analysen visade att våldsutsatta kvinnor beskrivs som anonyma, rädda eller som objekt i motsats till våldsutövande män som porträtteras som subjekt med makt. Det framkom en diskurs kring en viss typ av våldsförövare och ett motsatsförhållande mellan våld och kärlek. Resultatet visade på en fascination vid våldet och detaljerna kring våldet samtidigt som kopplingen mellan våldsutövaren och ansvaret för våldet ofta var svag. Istället kopplades våldet, som kunde beskrivas som extrema våldshandlingar, ofta till själva relationen. / Intimate partner violence is an extensive social problem in Sweden and a recurring subject in Swedish newspapers. This study aimed to explore descriptions of men’s violence against women in intimate partner relationships in two well distributed Swedish newspapers. The research questions focused on how the men and women were described and how the relationship and the violence were depicted. Critical discourse analysis, with inspiration from Norman Fairclough’s three-dimensional model, constituted the theoretical framework and method of analysis. The analysis showed descriptions of the women as anonymous, frightened and as objects in contrast to the men who were depicted as subjects with power. A discourse regarding a certain type of perpetrator was revealed as well as an opposite relationship between violence and affection. A fascination with the violence itself was found and it was often depicted in vivid details. The violence was often connected to the relationship itself while the connection between the perpetrator and the violence was less distinct.

Women's everyday resistance: space, affect and healingDay, Sarah 01 1900 (has links)
Despite South Africa’s constitution being demonstrably one of the most progressive in the world, there remains a divide between legislation and women’s lived experiences of violence and inequality. In this context, marginalised women, in particular, are often wrongly perceived of as lacking in power and agency. In an attempt to understand how marginalised women articulate their agency under conditions of direct and structural violence, the aim of my study is to examine how women perform everyday resistance to violence at and between different sites, including the home, community and state-controlled institutions, and to examine the process of undertaking this research, using a critical reflexive approach. My research is structured around four studies. In Study I, I examine how a group of marginalised women perform everyday resistance in relation to state-controlled institutions. In Study II, I consider how a group of marginalised women do everyday resistance in relation to constructions of home. Study III offers an analysis of how the Thembelihle Women’s Forum functions as an invented space of resistance, and everyday resistance is a relational practice. Finally, in Study IV, I do a critical reflexive reading of psychosocial accompaniment as method, elucidating the complexities, tensions and trade-offs inherent to the method. When considered against my study’s broader theoretical framework (i.e., liberation psychology, feminist geopolitics and affective economies), the findings of these four studies present a complex examination of the enactment of everyday resistance. Each of the studies demonstrates a number of strategies for everyday resistance, including becoming a willful subject, refusal and withdrawal, quiet encroachment, collective storytelling, affective reimagining, collective conscientisation, de-ideologizing reality, social solidarity, coping mechanisms, tactics of survival and acts of reclamation. Methodologically, I demonstrate the messiness inherent to how power dynamics are reproduced and resisted during the research process. My research seeks to deepen our understandings of the flow of power within the research process, and the dynamic and shifting imperatives of our research practice. / Psychology / D. Phil. Syftet med denna studie var att undersöka hur artiklar från två välkända svenskakvällstidningar beskriver det våld som män brukar mot kvinnor i nära relationer. Vidare har det undersökts vilka orsaksförklaringar tidningsartiklar använder för att beskriva mäns våld mot kvinnor. En kvalitativ textanalys har genomförts där resultatet har tematiserats med teoretisk ansats genom socioekologiska modellen och Socialstyrelsens definition av våld i nära relationer. Media har visat sig ha en betydande roll för människors förståelse av sociala problem. Det som beskrivs i media blir ofta människors verklighet, därför är det av betydelse att media ger en rättvis och korrekt bild av det stora och utbredda fenomen som våld i nära relationer utgör. Resultatet indikerar att fysiskt våld är den vanligast förekommande typ av våld som beskrivs av tidningsartiklar. Vidare skildrar studien att flest tidningsartiklar beskriver orsaker till mäns våld mot kvinnor med ett strukturellt perspektiv. Endast en av alla inkluderade tidningsartiklar beskriver mäns våld mot kvinnor i nära relationer genom den socioekologiska modellens alla fyra perspektiv. Modellen som i enlighet med Socialstyrelsen är av stor vikt för att få en helhetsbeskrivning av mäns våld mot kvinnor i nära relationer. / The aim of this study was to investigate how articles from two well-known Swedish evening newspapers describe the violence that men use against women in close relationships. Furthermore, the study examined which causal explanations the newspaper articles use in the descriptions of the violence. This is done through a qualitative text analysis of newspaper articles' descriptions of violence. The results of the study have been thematized with a theoretical approach through the socio-ecological model and the National Board of Health and Welfare's definition of violence in close relationships. The media has proven to play a significant role in helping people understand social issues as what is described in the media often becomes people's reality. Therefore, it is important that the media provide a fair and correct picture of the large and widespread phenomenon that violence in close relationships constitutes. The results show that physical violence is the most described violence of newspaper articles. Furthermore, most causes of men's violence against women are described by newspaper articles with a structural perspective. Only one of all included newspaper articles describes men's violence against women in close relationships through all four perspectives of the socioecological model. The model which, in accordance with the National Board of Health and Welfare, is of great importance for obtaining a comprehensive description of men's violence against women in close relationships.

The aim of this study is to analyze how eight women, through autobiographies, describe their experiences of leaving a relationship with a violent male partner. Furthermore, the purpose was also to illustrate factors that kept women from leaving the relationship and factors that encouraged them to leave. The study is mainly based on a gender perspective. In order to create a deeper understanding for the process of women leaving violent men,we included two theories in the study. The two theories are Eva Lundgren’s (2004) theory of The Normalization Process of Violence and Holmberg och Enander’s (2010) theory of the Process of Leaving Violent Men. The result shows that mens violence against women in intimate partner relationships. The result shows that women from the autobiographies tended to get used to the violence coming from their men and considered it to be a part of the relationship. Furthermore, result shows that men’s control and power over women go hand in hand, which leads to women adapting to the violent relation.

Men's violence against women is a major societal problem that can manifest itself in many different ways. The purpose of this study was to see how Sweden's three largest news magazines portray the problem of men's intimate partner violence against women, how different subject-positions are presented and to investigate whether the public's view of the problem is affected by media reporting. To do this, a qualitative discourse analysis has been done with 41 articles on the subject. The articles analyzed are taken from the newspapers Aftonbladet, Dagens Nyheter and Expressen. The study is based on a social constructionist perspective, where the focus is on language and how it constructs our understanding of the world and different phenomena. In addition to the social constructionist perspective, the study is based on three theoretical themes; Gender, media influence and discourse. The articles include, among other things, many women's own stories about the violence in their relationship. How they gradually broke down and how the violence, whether physical, mental, or both, has had devastating consequences for the women. A clear result is that there is a great deal of uncertainty and a lack of knowledge regarding men's intimate partner violence against women. And that it ́s not prioritized within the police and judiciary. The consequence is that few reports leads to prosecution and even fewer to actual convictions, which is problematic as the bleak picture that the media paints can affect others in a similar situation from seeking help.

Workplace violence experienced by student nurses during clinical placement at psychiatric insitutions in KwaZulu-NatalMvunelo, Nomhle 01 July 2014 (has links)
Workplace violence directed at student nurses in training in psychiatric institutions is a significant concern as it negatively affects the quality of learning and causes the students to have a negative perception of nursing as a profession. The absence of scientific data describing the perceptions of student nurses about workplace violence and their clinical learning outcome motivated the researcher to conduct the study. Quantitative, descriptive research was conducted to explore the influence that workplace violence will have on clinical learning outcomes of student nurses who are studying psychiatric nursing at psychiatric institutions in KwaZulu-Natal, in South Africa. Data was gathered using a 71 question questionnaire, which was adapted from the one used by Hewett (2010). With the necessary permission from the health authorities, the campus principals and the nursing students, a group of 4th year student nurses (n=163) from 6 campuses of the KwaZulu-Natal College of Nursing (KZNCN) who have worked in psychiatric units for at least 3 months and longer participated in the study. The study highlighted the types of workplace violence encountered by student nurses, the effects of workplace violence on students’ academic performance and the barriers to the reporting of workplace violence encountered by the student nurses. The study revealed that there is a large amount of non-physical, some physical and a few incidents of sexual violence directed towards the student nurses at the psychiatric institutions, and that it has a negative impact on student learning. The recommendations emanating from the study support the idea of a shared responsibility between healthcare and education institutions and the focus is on preparing and equipping the student psychiatric nurses to confront, withstand and break the cycle of workplace violence. / Health Studies / M.A. (Nursing Science)

El objetivo de la investigación fue determinar las propiedades psicométricas del Inventario de Indefensión Aprendida en la Pareja en una muestra de mujeres víctimas de violencia que asisten a un centro psicológico en Lima. La muestra estuvo conformada por 214 mujeres de entre 19 y 60 años años (M = 31.24, DE = 7.85) que hayan sufrido violencia física, psicológica o sexual por parte de sus parejas. Propuesta: "Los instrumentos aplicados fueron Indefensión Aprendida en la Pareja (González & Diaz-Loving, 2015) y la Escala de Dependencia Emocional (Ventura & Caycho, 2016). Mediante el AFC se comprobó la estructura de tres factores evidenciando el siguiente ajuste: (CFI = .92, RMSEA = .10, y χ²/gl = 3.19). Los resultados de confiabilidad en las dimensiones oscilan entre .80 a .84, siendo aceptables. En la validez basada en relaciones con otras variables, los resultados indican correlaciones altas, moderadas y bajas (valores de Spearman entre -.17 y .89). Se concluye que el inventario de Indefensión Aprendida en la Pareja posee adecuadas propiedades psicométricas. / The objective of the research was to determine the psychometric properties of the Inventory of Learned Helplessness in the Couple in a sample of women victims of violence who attend a psychological center in Lima. The sample consisted of 214 women between 19 and 60 years old (M = 31.24, SD = 7.85) who have suffered physical, psychological or sexual violence by their partners. Proposal: "The instruments applied were Learned Helplessness in the Couple (González & Diaz-Loving, 2015) and the Emotional Dependence Scale (Ventura & Caycho, 2016). Through the CFA the structure of three factors was verified, evidencing the following adjustment: (CFI = .92, RMSEA = .10, and χ² / gl = 3.19). The reliability results in the dimensions range from .80 to .84, being acceptable. In the validity based on relationships with other variables, the results indicate high, moderate and low correlations (Spearman values between -.165. and .89) It is concluded that the inventory of Helplessness Learned in the Couple has adequate psychometric properties. / Tesis
