Le traitement juridictionnel des stratégies procédurales touchant au choix de for dans le contentieux commercial international / The judicial treatment of procedural strategies relating to the choice of forum in international commercial litigation

Confrontés à un phénomène d’effacement des frontières, les demandeurs à un contentieux commercial international sont appelés à choisir le tribunal devant lequel introduire leur action. Un tel choix de for entraînera des conséquences tant sur le plan des règles procédurales et substantielles applicables au litige que quant à la facilité avec laquelle la partie adverse pourra assurer sa défense. L’étude de la pratique du contentieux commercial international révèle que le choix de for devient ainsi l’objet de stratégies procédurales mises en œuvre par les plaideurs. Les mécanismes de réaction des juges français se montrent toutefois insuffisants pour appréhender et pour répondre convenablement au phénomène grandissant des stratégies procédurales touchant au choix de for qui sont élaborées par les plaideurs. Il est partant proposé de créer une nouvelle catégorie juridique, le forum shopping malus, fondée sur une analyse de l’atteinte causée par la stratégie procédurale en cause aux droits fondamentaux de la partie adverse. En faisant application du principe de proportionnalité privatisée, une série de critères sont élaborés visant à ouvrir un corridor de solutions à l’intérieur duquel le juge national pourra se placer pour vérifier l’existence d’un cas de forum shopping malus. La création du forum shopping malus nécessite une modification de l’office du juge, afin de lui accorder le pouvoir de se dessaisir en faveur d’un autre juge, ainsi que le pouvoir de prononcer des injonctions à l’encontre de l’auteur d’une stratégie procédurale considérée comme étant constitutive d’un cas de forum shopping malus. / Faced with a blurring of national boundaries, claimants in international commercial litigations are called upon to decide before which tribunal to lodge their case. Such a choice of forum will entail consequences, as much with respect to the procedural and substantive rules applicable to the case as with respect to the ease with which the opposing party will be able to conduct its own defense. The study of international commercial litigation practice reveals that choice of forum has become the focus of procedural strategies implemented by the litigants. The reaction mechanisms available to French judges have however proved insufficient to properly address and answer the procedural strategies developed by litigants regarding the choice of forum. It is therefore proposed to create a new legal category, forum shopping malus, based on an analysis of the infringement, by a given procedural strategy, of the opposing party’s fundamental rights. By applying the principle of private proportionality (proportionnalité privatisée), a series of criteria are developed in order to establish a panel of solutions against which a judge may lean to assess the existence of a case of forum shopping malus. The creation of forum shopping malus requires a modification of the judge’s function, so that he may be granted the power to relinquish jurisdiction in favour of another judge, as well as the power to issue an injunction against the author of a procedural strategy which is deemed to constitute forum shopping malus.

Mediação: proposta de implementação no processo civil brasileiro. / Mediation: how to insert it in Brazilian civil procedure

O presente trabalho aborda a inserção dos meios alternativos de resolução de conflitos no processo civil e propõe a consideração de tais métodos como técnicas processuais voltadas ao atingimento dos escopos da jurisdição, tomada essencialmente como função pública voltada à pacificação de conflitos. São apresentados os institutos fundamentais do processo civil e se parte de uma releitura do processo civil a partir da busca da efetividade e da consideração do escopo da pacificação como escopo magno da jurisdição, o que justifica a introdução de meios complementares de solução de conflitos voltados à promoção da solução consensual dos litígios. Tem-se, então, em certa medida, a ampliação do objeto de estudo do processo civil. Tendo em vista a necessidade de se agregar novos institutos à consecução dos escopos do processo, os meios alternativos de solução de conflitos passam a ser tratados não mais como meros equivalentes jurisdicionais, mas como ferramentas do próprio sistema processual para a consecução de seus escopos. Isso conduz ao alargamento do objeto da ciência processual, à alteração do conteúdo programático das Escolas de Direito e à formação de um novo profissional da área jurídica. Dentre os métodos de resolução de conflitos existentes, são descritas a negociação, a conciliação, a avaliação neutra e a mediação, com destaque para esta última pela maior amplitude de aplicação e de técnicas utilizadas. São apresentados os fundamentos teóricos da mediação, as principais técnicas utilizadas e o procedimento que se recomenda seja observado para a condução adequada dessa forma de solução de controvérsias. Descritos esses métodos, passa-se à abordagem de algumas experiências de aplicação dos meios alternativos de forma complementar ao processo civil, destacando-se especialmente a disciplina legal estabelecida nos Estados Unidos da América e na Argentina. O presente trabalho culmina com a apresentação de um cronograma de instalação de setores de mediação anexos ao sistema judicial, abordando o recrutamento de mediadores, a capacitação necessária, o papel dos operadores do direito na empreitada e a metodologia de trabalho empregada, tudo a partir das bases legislativas já existentes em nosso ordenamento e do sucesso do projeto de gerenciamento de casos elaborado pelo CEBEPEJ - Centro Brasileiro de Estudos e Pesquisas Judiciais. A ampla utilização da mediação como instrumento de pacificação e consecução dos escopos da jurisdição já é possível independentemente de legislação própria .e específica, embora a institucionalização possa constituir um instrumento importante da divulgação e implementação da mediação em nossa sociedade. Buscou-se lançar as bases teóricas e práticas do uso da mediação como ferramenta de consecução dos escopos da jurisdição, principalmente o da pacificação, a partir de uma visão diferenciada do conflito e da necessidade de formação de um novo profissional da área jurídica, incorporando ao processo civil métodos complementares de solução de conflitos marcados pelo traço da interdisciplinaridade que permitirão alcançar o processo civil que se almeja: efetivo, célere e voltado preponderantemente à pacificação dos conflitantes. / The present work tackles the insertion of alternative dispute resolution methods in civil procedure, and proposes to consider these methods as procedural techniques focused on obtaining the scope of the jurisdiction, taken essentially as a public function towards the pacification of disputes. The fundamental institutes of civil procedure are presented from a new reading in the field, seeking effective solutions and considering the scope of pacification as a substantial scope of jurisdiction, thereby justifying the introduction of supplementary means for the resolution of disputes focusing on the promotion of a consensual resolution of disputes. The subject of study of civil procedure is hence to some extent broadened. In view of the necessity to aggregate new institutes in order to attain the scopes of the process, the alternative dispute resolution methods are henceforth treated not as mere jurisdiction equivalents but as tools of the very procedure system for the attainment of its scopes. This leads to the widening of the subject of the science of civil to the modification of programme contents in the Colleges of Law and to the building of a new law professional. Negotiation, conciliation, neutral early evaluation and mediation fall within the methods used to resolve disputes, particular emphasis being laid on the latter due to the extent of its application and the techniques used. The theoretical foundations of mediation, the main techniques used and the recommended procedure to be observed for a proper execution of this form of resolution of controversies are presented. Once completed the description of those methods, we shall move onto the experience of the application of alternative means as a supplementary form in civil proceedings, while highlighting more particularly the legal discipline established in the United States of America and in Argentina. This work then culminates with the presentation of a schedule for the insta1lation of additional mediation sectors alongside the judicial system, while tackling the recruitment of mediators, the necessary qualification, the role played by law professionals in this enterprise and the work methodology employed, all of which from the legal bases existing in our ordinance and the success of the case management project elaborated by CEBEPEJ - the Brazilian Judicial Studies and Research Centre. The wide use of mediation as a pacification tool for the attainment of the scopes of jurisdiction is a1ready possible, regardless of the specific legislation itself, although the institutionalisation may constitute an important tool for the release and implementation of mediation in our society. The purpose of this study was to set the theoretica1 bases and practices of the use of mediation as a tool to attain the scopes of jurisdiction, and mainly that of pacification from a differentiated viewpoint of dispute and from the necessity of qualifying a new legal professional by incorporating supplementary methods into civil proceedings for the resolution of disputes marked by the trait of an interdisciplinary approach, hereby making it possible to reach the civil procedure aspired to: an effective and diligent proceeding turned most and foremost towards the pacification of the parties in dispute.

The theme of my diploma thesis is one of the most important judicial acts of European private international law of civil procedure - Brussels I Regulation. The aim of my thesis was to analyse the Regulation from many views with an emphasis on the jurisprudence of European Court of Justice and of domestic national courts. First part of the thesis aims to describe the whole legal branch of european private international law of civil procedure and therefore place the Regulation in the context of the whole legal branch. second part of the thesis deals with the Regulation in its entirety and desribes every single article of the Regulation and tries to determine the boundaries of its application and interpretation. The last, third part, states othre relevant legal acts related to Regulation which are considered to be its alternative, and sums up the pros and cons of their application.

Since the moment that Brazil has established itself as a federalist country, thus, adopted a decentralized mode of political power and administrative organization, it is up to federal entities, by means of a coordination relationship and cooperation pursue national development and the enforcement of the fundamental rights of citizens by ensuring the integrity of the Social and Democratic State of Law. Since the tax collection is the main source of income of the Union, states, Federal District and municipalities, is from the fiscal federalism, that public policies are thought. Thus, in the first chapter, is made a historical presentation of federalism in the Brazilian State and its relationship with each moment lived by the country. In the second chapter, is discussed the taxing power constitutionally attributed to federal entities. Continuing, the third chapter dealt with the distribution arising from the tax collection revenue. And at the last chapter, is related the issue of allocation of tax powers to with division of revenues. / Trata-se de uma análise do Pacto federativo, a partir da vertente da questão fiscal, que envolve a competência tributária de cada ente federado e, consequentemente, a distribuição de receita entre eles. Desde o momento que o Brasil se estabeleceu como um país federalista, portanto, adotou um modo descentralizado de poder político e de organização administrativa, coube aos entes federados, por meio de uma relação de coordenação e cooperação buscarem o desenvolvimento nacional e a efetivação dos direitos fundamentais dos cidadãos, garantindo a integridade do Estado Social e Democrático de Direito. Uma vez que a arrecadação tributária é a principal fonte de receita da União, estados, Distrito Federal e municípios, é a partir do federalismo fiscal, que são pensadas as políticas públicas Assim, no primeiro capítulo, fazemos uma apresentação, de cunho histórico, do federalismo dentro do Estado brasileiro e de sua relação com cada momento vivido pelo país. Its historical origin is intrinsically related to the evolution of society, and the practical purpose of discussing this interesting institute is to understand the growing search for alterative solutions to conflicts. It couldn’t be ignored, in a discourse on jurisdiction, the concept of the State, from its formation, to the most recent three Powers theory, and the system of checks and balances inserted in the Federal Constitution. On the other hand, the Judiciary is a clearer and more evident manifestation of the jurisdiction practical application, and its concept and characteristics, the extension and, finally, the limits of jurisdiction are extracted. Once composed of a solid scientific substrate, we present the didactic classification currently accepted and well accepted by most of the doctrine, closing the first stage of this paper. The static scenario, from this point onwards, is the subject of provocations, in which obstacles as exceptions to the inafasability of jurisdiction, notably by the presentation of alternative methods of conflict resolution, ilustrates the current needs of a dynamic, complex and constantly changing society. Increasingly, there is the presence of private nature entities in conflict resolution, including through international cooperation among countries. Arbitration is the most classic example of an alternative method of conflict resolution, whose performance and participation of private entities is a result of the strengthening of the expression of will in clauses and contracts more prestigiously designed to the autonomy of the parties. The Sport Court, in its turn, although autonomous and independent, maintains certain influence of the State due to its traces of public, social law. And article 217, especially §§ 1 and 2, could have extended these characteristics if the text had clearly restricted the matter to be known by the Judiciary, in order to confer greater permanence to the decisions rendered by the Courts of Sports Justice. Although a long way to go, the study that we propose come from premises seen and recognized by the various branches of law, in order to establish a reasoning that leads to a proposal of repositioning the jurisdiction and, consequently, the Sports Court. Comparative analysis, similarity of some procedural aspects, applicable principles and decisions in the field of Arbitration and Sports Justice undoubtedly depict a fertile substratum for legal constructions, a challenge that we intend to follow and overcome / Um dos temas pouco estudados, mas que representa um dos alicerces do Direito, é o da jurisdição. Sua origem histórica está intrinsecamente relacionada à evolução da sociedade, e a finalidade prática de discorrer sobre este interessante instituto é compreender a crescente busca por soluções alterativas de conflitos. Não se poderia deixar de lado, em um discurso sobre jurisdição, o conceito de Estado, desde a sua formação, até a mais recente teoria dos três Poderes, do sistema de freios e contrapesos inserido na Constituição Federal. Já adentrando em aspectos mais específicos, apresenta-se o Poder Judiciário como manifestação mais clara e evidente da aplicação prática da jurisdição, extraindo-se, a partir daí seu conceito e características, a extensão e, por fim, os limites da jurisdição. Uma vez composto um sólido substrato científico, apresenta-se a classificação didática atualmente recepcionada e bem aceita pela maior parte da doutrina, fechando a primeira etapa deste trabalho. O cenário estático, deste ponto em diante, é objeto de provocações, em que obstáculos como exceções à inafastabilidade da jurisdição, notadamente pela apresentação de métodos alternativos de solução de conflitos, retratam as necessidades atuais de uma sociedade dinâmica, complexa e em constante modificação. É cada vez mais presente a atuação de entidades de natureza privada na solução de conflitos, inclusive mediante cooperação internacional entre países. A Arbitragem é o mais clássico exemplo de método alternativo de solução de conflitos, cuja atuação e participação de entidades de natureza privada é fruto do fortalecimento da manifestação de vontade em cláusulas e contratos arquitetados com maior prestígio à autonomia das partes. A Justiça Desportiva, de seu turno, embora autônoma e independente, mantém certa influência do Estado em razão de seus traços de direito público, social. E o artigo 217, notadamente os §§ 1 e 2º, poderia ter alargado estas características se a redação houvesse restringido com clareza a matéria a ser conhecida pelo Judiciário, de modo a conferir maior definitividade às decisões proferidas pelos Tribunais de Justiça Desportiva. Ainda que longo caminho a ser percorrido, o estudo que se propõe parte de premissas vistas e reconhecidas pelos diversos ramos do direito, de sorte a erigir um raciocínio que leve a uma proposta de reposicionamento da jurisdição e, consequentemente, da Justiça Desportiva. Análises comparativas, semelhança de alguns aspectos procedimentais, princípios aplicáveis e decisões no âmbito da Arbitragem e Justiça Desportiva sem dúvida retratam substrato fértil para construções jurídicas, desafio este que pretende-se percorrer e suplantar

The contributions of UNCLOS dispute settlement bodies to the development of the law of the sea

This thesis seeks to systematically examine the contributions made by the dispute settlement bodies established under the United Nations Convention on the Law of the Sea (UNCLOS) to the development of the law of the sea. The two main research questions to be answered are: (i) what kind of contribution have UNCLOS dispute settlement bodies made to the development of the law of the sea? and (ii) what are the factors that impact the performance of UNCLOS dispute settlement bodies in developing the law of the sea? To that end, Chapter 1 provides a working definition for the concept of 'judicial development of international law' in order to establish a framework for an assessment of the contributions of UNCLOS tribunals. Based on this working definition, Chapters 2, 3 and 4 examine the significance of UNCLOS tribunals' decisions in the development of three main areas of the law of the sea, respectively the law on fisheries, the law on the outer continental shelf and the law on marine environmental protection. Based on the findings of these chapters, Chapter 5 analyses the factors that help explain the contributions of UNCLOS tribunals to the law of the sea as identified in the preceding chapters. These factors include: (i) the jurisdictional scope of UNCLOS tribunals, (ii) the institutional design of UNCLOS, (iii) the interpretative method employed by UNCLOS tribunals in deciding their cases and (iv) the perception that UNCLOS tribunals hold regarding their roles. Chapter 6 concludes by taking stock of the contribution of UNCLOS tribunal in these areas and offering some final observations on the role of UNCLOS tribunals in the development of the law of the sea.

A utilização de precedentes pelo Supremo Tribunal Federal: fundamentos e critérios / The use of foreign precedents by the Brazilian Supreme Court: theoretical justifications and criteria.

A presente dissertação tem por objetivo analisar a utilização de precedentes estrangeiros pelo Supremo Tribunal Federal no controle de constitucionalidade. O uso de direito constitucional comparado pela jurisdição constitucional com o intuito de solucionar casos domésticos tem aumentado progressivamente e se tornou algo corriqueiro. Vários nomes surgiram para denominar o fenômeno: fertilização cruzada, empréstimos constitucionais, diálogo constitucional, migração de ideias constitucionais, interlocução constitucional, entre outros. No entanto, a difusão desta prática não veio acompanhada de uma reflexão acerca seus fundamentos e dos possíveis critérios e método que possam norteá-la. Logo, o presente trabalho focou-se justamente nesta problemática, analisando os argumentos prós e contra o uso de julgados estrangeiros na solução de controvérsias constitucionais, descrevendo as diversas formas de uso encontradas, sugerindo critérios e método para utilização legítima dos precedentes estrangeiros no âmbito da jurisdição constitucional. Por fim, este estudo voltou-se para uma análise da jurisprudência do Supremo Tribunal Federal com base nos parâmetros estabelecidos. / This paper aims to analyze the use of foreign precedents in constitution adjudication (judicial review) by the Brazilian Supreme Court. The use of comparative constitutional law by the constitutional jurisdiction for the purpose of resolving domestic cases has progressively increased and became commonplace. Several names are being used to describe the phenomenon, among others: cross-fertilization, constitutional borrowing, constitutional dialogue, migration of constitutional ideas and constitutional engagement. However, the increase of this practice has not been accompanied by a reflection on its theoretical justifications and on the possible criteria and method that can guide it. Consequently, this paper focuses on the above mentioned phenomenon by examining the arguments for and against the use of foreign precedent in constitutional decision-making, describing the various modes of use and suggesting criteria and method for legitimate use of foreign precedents within the constitutional jurisdiction. The study finalizes with an analysis of the jurisprudence of the Brazilian Supreme Court based on established parameters.

Välfärdspolitik och kvinnoyrken : organisation, välfärdsstat och professionaliseringens villkor

<p>The relationship between the Swedish state’s welfare political commitments and the emergence and development of three female-dominated welfare state occupational groups - nurses, home relief helpers and occupational therapists - is at the heart of this thesis. The primary aim is to study the professional possibilities and limitations created by the state’s welfare political commitments in health care, family policy and rehabilitation.</p><p>The thesis emphasises the importance of regarding the state as a historically conditioned actor and as an organisation of organisations. The state is not a unified and static actor and this makes it difficult to speak of the state’s relationship to different welfare occupations in general terms. Nurses, home relief helpers and occupational therapists have encountered the state in different historical contexts and established ties to different parts of the state. Abbott’s (1988) term jurisdiction is used to characterise the area within welfare politics that nurses, home relief helpers and occupational therapists have made claims on or been allotted. The struggle for jurisdiction takes place on three, analytically separate but in reality interconnected arenas. These arenas are the workplace, the media arena and the legal arena. The thesis limits itself to the legal arena, that is, the state’s administrative, planning and legislative structures. At the centre of the analysis of the legal arena are the Swedish Government Commission and the welfare political reform work that to a large degree has been formed by these institutions’ function and work.</p><p>An important conclusion from these three case studies is that the state’s welfare political commitments have been central for the emergence of nurses, home relief helpers and occupational therapists and their development into welfare state occupational groups. The state’s welfare political ambitions have contributed considerably to the transformation of nurse, home relief helpers and occupational therapists into modern occupational groups. Dependency on the state has not always been easy to handle however. The state’s welfare political interests have often contradicted the wishes of the professions regarding the content, length and organisation of training programmes, as well as regarding continuing education and licensing. The state has been unwilling to provide more training than deemed necessary from a welfare political perspective. An important conclusion from this study is that it is difficult for welfare state occupational groups to steer their professional project in a direction that falls outside of the state’s welfare political commitments.</p>

This is demonstrated through the degree of international assistance afforded to the Seychelles in dealing with pirates and more generally, through the development of offshore companies in small island states. Consequently, this paper suggests that international law is both the problem and solution to the sovereignty of small island states.
