本論文は、戦後沖縄における女性運動の歴史の一端をたどるものである。基地の町の女性問題が、地域が受け取る軍用地料と密接に関わり、基地維持を支える軍用地料の利権が、日米関係や地域運動と相互に関係しつつ、どのように地域を再構成し続けているかを検討する。具体的には、戦後基地の町となった国頭郡金武町字金武(金武区と並里区)で1990年代から2000年代中頃にたたかわれた軍用地料をめぐる女性差別解消運動を検討する。 / This thesis examines the problem concerning Camp Hansen rental payments and military bases in Okinawa since 1945, from the viewpoint of the local women's movement.The purpose is to understand the human rights, political and economic problems of women who live in military base towns in Kin-cho, the focus of our case-study. In particular, I examine the role military base rental payments have played in restructuring the area. This reconfiguration is closely interrelated with Japan-US relations, the rental income for the bases and the regional movement. 我國房地分離相關爭議問題之研究-兼論立法改革芻議 / The Study on the Disputes of Separatin Disposition of Building and Land in Taiwan: Preliminary Trial for Legislative Reforms

在我國仍採行房地得為分離並得為分別交易之基本規制下,尋求我國民法中所有與控管房地分離有關之條文規範,加以統整並藉此歸納出該等規範之共同核心與立法意旨,乃勢在必行,如此始能覷見立法者現今之改革方向與立法理念,對於實務既有問題爭議之處理上方有一棲身之地,俾利吾人提出合理之解決模式。 條文規範中大體包括有事前手段與事後手段兩種規制,所稱事前手段,乃土地與其上建築物之一體化處分規範,以事先禁止土地與其上建築物分別為交易來防止後續產生房地分離之結果;所稱事後手段,乃指一旦土地與其上建築物為分別交易後,透過一些權利賦予之方式,例如優先購買權或土地利用權,來達到建築物仍得繼續存續於土地上,不致令建築物之附著於土地失其權源。而此二種規制,究其目的不外乎「房屋所有權與基地利用權一體化之體現」,惟此理念是否全然反映在我國之立法上,又是否有再加強之空間,即為本文所欲著墨之處,亦期能對我國關於房地之立法提供若干貢獻。 其次,我國實務上發生眾多「基地借貸」之案件,關於此一議題我國學說與實務難得聚焦而同為討論,相關文獻資料繁多,為解決此類案件提供相當多元之思考面向,本文亦參酌各家學說,於細細比較分析之後亦有若干研究心得之提出,希冀能提供我國法院於處理此類案件時有更多之觀點。

都市更新權利變換房地權利價值分離估價之研究

現實生活裡,舉凡土地合建分屋、房地分離課税、徵收補賞、容積移轉、聯合開發、乃至都市更新權利變換等土地價值估價,最終均不免涉及基地因分層使用,而產生的立體地價應如何評估,始符合權益分配公平的問題。 本研究係以成本法計算公式為基本模型,對區分所有建物房地分離估價的拆算方式做一檢視,藉以釐清基地權利價值拆算基礎的爭議,以及立體地價評估模式的應用。 都市更新權利變換前為區分所有建物者,以其房地總價求取區分所有建物之基地權利價值估價,依現行不動產估價技術規則、計有地價分配率、土地開發分析及房地價值構成比率三種分離模式。按理,三種分離模式均為成本法計算公式的應用,在同一估價時點,依相同的估價條件與一致的基礎數據上,三種分離模式之計算公式應可互通使用,拆算結果也應無不同。惟依現行不動產估價技術規則之實際應用上,三種分離模式拆算後之基地權利價值卻有所不同,因此,對區分所有建物之基地權利價值估價,究竟應如何運用三種分離模式的拆算方法,以建立一適當的立體地價評估模式,始不致扭曲其價值之真義,乃為本論文研究之重心。

「建構一個全方位的電影基地」行動研究 / To Build An All-Purpose Movie Operational Base

欲建構一個全方位的電影基地,實為龐大且複雜的計劃。臺中市政府新聞局於2011年開始規劃並落實建構的「中臺灣電影推廣園區」,研究者為該計畫決策執行兼推動者,故以行動研究的親身參與及實際觀察法,透過反省與修正探索建構一個全方位電影基地過程中,其關鍵問題與因應策略的現象及影響;歸納分析因各不同環境或人為因素變動,以及所選擇因應策略對產出結果的影響。期待本研究結果能成為未來類似計畫之參考。 本案研究者依系統循環的概念,以圖示歸納關鍵事件與因應策略對應後產出的結果,比對其變革後的結果與最初規劃目標之間的連結關係,從本研究發現中得出結果如下: 1.電影政策與城市行銷,可有直接的正向聯結關係。 2.一個計劃在建構期間出現無法預設的變革為正常現象。 3.良好的溝通與協調,亦可能成為影響結果的重要因應策略。 4.選擇得當的因應策略,即使改變,也可能出現比預期還好的成效。 根據本案的研究發現,提出建議如下: 1.全方位的電影文化與相關之產業政策應持續支持及推動。 2.變革雖為正常現象,但堅守目標、宗旨與原則,持續培植人才仍為重要使命。 3.即使觀念或訴求不同,但在追求社會與文化進歩發展的觀點下,更需透過理性的溝通與協調,求取共識。 4.變革可以期許出更好的新局與未來,但過往的歷史與紀錄,仍是新時代影像工作不可棄置的重要觀點。 / The objective is to build an all-purpose movie operational base and overcome any possible complications regardless the scale of them. The Information Bureau of Taichung City Government has started implementing the construction of “ Mid-Taiwan Movie Promotion Park” since 2011. The research unit for this particular project is also the project promoter and the executor. In other words, this project researcher was able to personally participate and inspect the production process through in person observation where the researcher could reflect on the adjustment made to target key issues in the park establishing process. The project researcher categorizes and analyzes these the park establishment strategy and analyzed results may also be affected by various human and environment factors. The purpose of this research is to have the analysis brought to the public and thus makes a positive impact for similar future projects. The researcher utilizes a system circulation concept and further demonstrates and clarifies this concept via diagram and visual presentation. The system circulation concept not only compares the result after modifications and the initial goal, but also bridges the relation between the result and the initial goal. The research reveals the following listed below: 1.The relationship between movies related policies and city marketing could be direct, positive, and constructive simultaneously. 2.It is typical that unpredictable barriers appear during the construction period. 3.Friendly constructive communication and coordination could be a key factor that affects the project outcome. 4.Appropriate response could result a better-then-expected outcome. Suggested strategies according to the research listed below: 1.An all-purpose movie culture and its related industries policies should be supported and promoted in a persistent and everlasting manner. 2.Although proposed plan may not always implement accordingly, the big picture is to stay adhere to goal, purpose, and principle and continue to cultivate talents. 3.It is particularly important to reason rationally and coordinate to reach a mutual aim when parties express difference aspirations and perspectives. 4.Changes could motivate breakthrough and, at the same time, it is crucial to keep the past in the back of the mind and note from the it.

容積移轉接受基地居住環境品質改變認知與政策滿意度之研究-以新北市中和地區為例 / A Study of Cognitive and Policy Satisfaction of the Residential Environment Quality Changes in the Transfer Development Right Receiving Area - A Case Study of Zhong He District in New Taipei City

在都市發展環境當中,居住環境品質取決於居住者本身之感受程度,可分為內部環境及外部空間結構,內部環境係指針對居住者本身所在的生活圈裡,外部空間結構則多半為公共設施的鄰近程度、交通便利性及嫌惡設施等因素,世界衛生組織曾於1961年世界衛生報告中提出理想居住環境為安全性、健康性、便利性、舒適性等基本理念,經由探索性、驗證性因素,分析彙整出解釋社區居民對居住環境品質之衡量著力點在於實體性、社區服務與管理、現代化等三大方面,因此居民感受度是與前開四種基本理念相呼應的。 在針對居住環境品質與社區滿意度相關文獻探討後發現,居住環境品質多與社區滿意度有關聯,顯示在建構生活品質模式應先將領域分群,透過客觀、認知及評估因子,即可呈現各領域的滿意度。 為解決公共設施保留地取得、歷史建築物保存及公共開放空間之提供等議題,我國開始實施容積移轉制度,主要目的為追求環境寧適、健全實質建設、保留彈性立法規則及民眾參與,惟接受基地在注入原基準容積後,其鄰近居民之居住環境品質是否受到影響及衝擊,為本研究所關注之重點;本研究係探討容積移轉制度實行迄今,接受基地容積移轉案件在興建完成後,對週邊土地所帶來之影響。 本研究以容積移轉接受基地興建前後對居住環境品質之問卷調查,以新北市中和地區之接受基地周邊住民作為受訪對象,以因素分析、結構方程模式為分析方法,以五大變數-接受基地興建前既有環境滿意度、接受基地興建後正面環境改善、接受基地興建後負面改變影響、容積移轉政策修正建議及其政策滿意度進行模式驗證;研究結果發現既有環境滿意度對負面改變影響、政策修正建議呈正向影響,對正面環境改善、政策滿意度呈負向影響,另負面改變影響、政策修正建議則具有著之中介效果,該研究可作為未來推動容積移轉制度辦理之修正建議。 / In the urban development environment, living environment quality depends on how residents feel. It can be divided into internal and external spatial structure environments. The internal environment refers to living areas where the residents themselves reside; the external spatial structures are mostly the proximity, accessibility and distaste factors of public facilities. The World Health Organization’s 1961 World Health Report proposed the basic concept of the ideal living environment for safety, health, convenience, comfort, etc. They compiled an analysis of the environmental community to explain the measure of the quality of living through exploratory, confirmatory factors. The analysis compiled an explanation of the way community residents measure environmental quality. The focal point lies in the three aspects of modernization: physical properties, community service and management. Therefore residents' susceptibility echoes the former four basic philosophies. In regards to the quality of living environment and community satisfaction, after disscussing relevant literature, we found that the quality of living environment correlate with community satisfaction interaction. This shows that during the construction of life quality models, domain clustering should first take place, then go through the analysis of objective factors, perceived factors, evaluated factors before presenting various domains of satisfaction. However, to address topics on land reserved for the public infrastructure, topics on historical building preservation and public open space topics, Taiwan began to implement transferable development rights control. The main goal of this system was to pursue environmental quality, improve substantive construction, maintain the flexibility of legislative rules and promote public participation. However, the main concern of this study is whether or not the environmental living quality of nearby residents' was affected after the development rights of the receiving area received incremental development rights and built high-rise buildings. This study mainly dicusses ways to implement the so far accepted transferable development rights case after construction is complete, and the effects brought on by the surrounding land. This study looks at environmental quality before and after transferable development rights acceptance and construction. A questionnaire was designed for this study and was administered to local residents of the Zhong-he, New Taipei City development rights receiving area as target respondents. This study was conducted by way of factor analysis and structural equation modeling analysis. Five variables were proposed, which are variables of nearby residents of the development rights receiving area regarding environmental satisfaction before construction; variables of nearby residents having positive evaluation after construction; variables of nearby residents having negative evaluation after construction; variables of nearby residents regarding transferable development rights policy amendment; variables of nearby residents regarding transferable development rights policy satisfaction, to conduct a model confirmatory. The results show that environmental satisfaction variables have a positive impact on negative evaluation variables and policy amendment variables, but have a negative impact on positive evaluation variables and policy satisfaction. In addition, negative evaluation variables have indirect effects on policy amendments. This study can be used as a reference for the implementation of the transferable development rights system in handling amendments in the future.

台灣青年西進發展機會與挑戰:以海峽兩岸青年創業基地為例 / The opportunities and challenges of Taiwan youth westward development: a case study of cross-strait youth entrepreneurship base

中國政府鼓勵創新及創業,推動雙創政策,喊出「大眾創業,萬眾創新」的口號。中國提出雙創政策後,積極對全球攬才,台灣青年也被有計劃地納入中國政府發展新創「人才工程」的版圖中。為了鼓勵台灣青年進軍中國創業,中國政府陸續於各地區設置海峽兩岸青年創業基地,除了提供完善的創業環境,還有優厚的創業基金,希望能吸引台灣青年西進中國創業。 本研究旨在探討海峽兩岸青年創業基地對台灣青年創業之影響,並對台灣青年赴陸創業提供建言。本研究透過訪談4位創業相關的人士,包含在台灣和中國創業的青年以及台灣和中國的創業育成中心經理,觀察目前台灣青年在台灣及中國的創業狀態以及其面對的創業困境。 根據實際訪談的初級資料分析之結果,中國積極扶持青年創業目的主要是想要降低失業率,而且對青年創業的支持,從中央政策到實際地方的落實推廣相當迅速。海峽兩岸創業基地以提供辦公空間、資源對接、人才獎補、住房津貼等為主。但中國青創基地常因媒體的渲染誇大,事實上資源並不能輕易取得。台灣青年到中國創業前應該要先準備一筆創業資金,並根據自身創業項目需求而審慎選擇創業基地,較能實際取得支援,因為不同規模的基地所能提供的資源也不同。 / China encourages innovation and entrepreneurship to advance structural reform and raises the idea of" Mass Entrepreneurship and Innovation ". Measures have been taken by Chinese government to attract global talents, including Taiwanese youth. To encourage young talents from Taiwan to startup in China, Chinese government had established many cross-strait youth entrepreneurship bases in various places. It not only builds up entrepreneurial environment, but also provides generous venture capital, hoping to attract Taiwanese young entrepreneurs into China. The main purpose of this study is to explore the impacts of the cross-strait youth entrepreneurship base on the startups of Taiwan youth and propose suggestions for Taiwanese youth who want to start business in China. Through interviewing with two Taiwanese young entrepreneurs separately in Taiwan and China youth entrepreneurship bases and two managers of Taiwan business incubation center and China entrepreneurship base, we examine the current state of entrepreneurial environments of both sides and the entrepreneurial dilemma facing by Taiwanese young people. Based on the analysis of primary data from in-depth interviews, the main purpose of China's active support of youth entrepreneurship is to reduce the unemployment rate. China's promotion of youth entrepreneurship policies has been implemented fairly rapidly from the central government to local governments. The cross-strait youth entrepreneurship base provides office space, resources docking, talent subsidy and housing allowance etc. But too much false media reports on cross-strait youth entrepreneurship bases. In fact, entrepreneurs cannot easily obtain venture capital fund and resources. Taiwanese young entrepreneurs should first prepare a start-up fund before starting their business in China. Taiwanese entrepreneurs should carefully choose their entrepreneurship base according to the needs of their start-up projects so that they will be able to obtain suitable support, because different bases with different scales can provide different resources.

合理隱私期待之研究-以定位科技為例 / A Study of Reasonable Expectation of Privacy- Case Studies related with Positioning Technology

大法官在釋字第689號解釋中,首次在解釋文中引進美國法上的「合理隱私期待」概念,以作為人民是否受到憲法隱私權保障的判定標準。事實上,「合理隱私期待」的概念在我國法上並不令人感到陌生。例如,通訊保障及監察法第3條第2項即明確規定:「前項所稱之通訊,以有事實足認受監察人對其通訊內容有『隱私或秘密之合理期待』者為限」。 除了尾隨、全天候視覺監控等類似的古老方法,隨著科技的進步,諸如以衛星為基礎的汽車導航系統、以基地台為基礎的行動電話定位服務等低成本、高效率的定位科技,可以更輕易且嚴重地侵害我們的私生活及隱私。當定位科技成為我們每天生活的一部分時,如何在這樣的脈絡下正確地操作「合理隱私期待」概念,已成為一項重要的議題。 惟國內學術文獻對於如何正確地操作「合理隱私期待」,似乎欠缺全面性地研究。為了填補國內的空白,本文進行了美國及台灣案例法之深入比較分析,尤其是關於合理隱私期待及定位裝置的判決。本文指出了以往我國及美國法院判決的問題,以及邏輯矛盾之處。為了達到更加一致、正確的判決結果,本文認為,在操作合理隱私期望概念時,法院應著重於四個因素,其分別是:「資訊的性質」、「侵害的手段」、「侵害的場所」及「第三人原則」。 / In J.Y. Interpretation No. 689, the Constitutional Court , for the first time, employs the concept of “reasonable expectation of privacy”, originated from the United States, in order to determine whether an individual enjoys a constitutionally protected right to privacy. The concept, however, is not new to our legal system. For example, Paragraph 2, Article 3 of the Communication Protection and Surveillance Act provides: “The communications referred to in the preceding paragraph shall be limited to those for which there is an adequate showing of facts that a person subject to surveillance would have a reasonable expectation of privacy or confidentiality with respect to the content of the communications.” In addition to tailing, around the clock visual surveillance and similar old-fashioned methods, with the advance in technology, our private life and privacy could be more easily and greatly intruded by low-cost, high-efficiency location positioning technology, such as satellite-based car navigation system and cell sites-based cellphone positioning service. When location positioning technology becomes part of our everyday life, how to properly apply the concept of “reasonable expectation of privacy” in this context has also become an important issue. So far, there seems to lack a comprehensive study on the aforementioned issue in domestic academic literature. To fill the gap, this thesis conducts an in-depth comparative analysis of both U.S. and Taiwan case law, especially those involving reasonable expectation of privacy and location positioning devices. This thesis points out the problems and logical inconsistencies in past decisions in both jurisdictions. In order to reach a more consistent and appropriate result, this thesis argues that when applying the reasonable expectation of privacy test, courts should focus on four factors which are: “nature of information,” “measure of infringement,” “the place where the intrusion happens,” and “third party doctrine.”
