[pt] A articulação entre psicanálise e educação para pensar o mal-estar na escola remonta aos primórdios da constituição da primeira. Se podemos encontrar em S. Freud uma oscilação entre o papel inibidor que caberia à educação e, por outro lado, um veio libertário, na medida em que esta acolhesse em seus objetivos a realidade pulsional na criança, há uma outra linha de pensamento na psicanálise que vai de S. Ferenczi a D. W. Winnicott, que permite outros encaminhamentos para a abordagem deste tema, especialmente na sua expressão atual. Esta tese objetiva investigar o que pode a psicanálise frente ao mal-estar na escola atual usando como ferramentas a genealogia do poder disciplinar e do biopoder em M.
Foucault para compreender a emergência da categoria criança-aluno, os conceitos de norma e normalização para discutir os processos de medicalização e de patologização de crianças e de jovens no ambiente escolar na sociedade de controle e, finalmente, o pensamento de D. W. Winnicott e sua teoria do
amadurecimento psíquico e seus desdobramentos. Aponta-se, ainda, para a propriedade desta teoria da constituição subjetiva precoce e de seus desdobramentos, que permitem pensar as formas de inserção na cultura, para os encaminhamentos diferentes do mal-estar na escola atual, compreendido como despotencialização do viver criativo. / [en] The articulation between psychoanalysis and education to think about the discontent in school dates back to the beginnings of the constitution of the former. If we can find in S. Freud an oscillation between the inhibiting role which had to be done by education and, on the other hand, a libertarian trace, in that this hosts into its objectives the instinctual reality in the child, there is another line of thought in psychoanalysis that goes from S. Ferenczi to D. W. Winnicott which allows other referrals to this theme approach, especially in its current expression. This thesis aims to investigate what psychoanalysis can do against the discontent in the current school using as tools the genealogy of the disciplinary power and the biopower in M. Foucault to understand the child-student category emergency, the standard and standardization concepts to discuss the medicalization and pathologizing processes of children and youth in the school surroundings in the control society and, finally, D. W. Winnicott s thought and his psychic maturing theory and its developments. It is still aimed to the property of this theory of the early subjective constitution and its developments, which allow to think the forms of insertion into the culture, to the different referrals of the discontent in the current school, understood as creative living disempowerment.

À partir des réflexions du phénoménologue tchèque Jan Patočka et des études du philosophe français Michel Foucault, on interroge le thème du souci – de soi, de l’âme, des autres, du monde – en tant que forme de relation éthique. Dans l'éclipse des systèmes de valeurs traditionnelles, les recherches sur la notion du souci peuvent ouvrir une perspective éthique à même de reformuler les termes de la responsabilité collective.Le point de départ c’est un passage du dernier cours de Foucault au Collège de France (Le courage de la vérité), où le philosophe renvoie à la pensée de Patočka. Foucault reconnaît à l'auteur tchèque d'avoir été le seul philosophe contemporain à avoir approfondi le principe ancien de l'epimeleia. Cependant, selon Foucault, sa propre recherche – construite autour de la notion de epimeleia heautou, c'est-à-dire le souci comme mise à l'épreuve, problématisation et stylisation du soi – différerait de celle de Patočka, qui vise plus l'étude de l'epimeleia tes psychés, à savoir l’âme sous le profil ontologique et gnoséologique.Tout d’abord, la thèse de Foucault encourage une analyse de la signification du terme « âme » dans le contexte de la phénoménologie asubjective élaborée par Patočka. En second lieu, elle invite à étudier la notion de « soi » à l’oeuvre dans les derniers textes de Foucault. En interrogeant les rapports entre les processus singulières de subjectivation et le bios en tant que « mode de vie » ou « style d’existence », on arrive à poser le problème de la vie en tant qu’horizon ontologique de l'être en commun. On s’interroge sur la possibilité d’un « souci dubios » qui soit à la fois « lien de vie » et « forme de vie » : souci du bios comme ontologie critique des conditions rendant possible la reconnaissance de la vie en tant que dimension de la co-appartenance, et, en même temps, attitude éthique à se faire charge de sa vulnérabilité. / Starting from the research of the Czech phenomenologist Jan Patočka and the studies of the French philosopher Michel Foucault, this thesis investigates the question of the care – of the self, for the soul, of the others, of the world – as a form of ethical relationship. In the twilight of the traditional value systems, the ethical perspective in researches on the notion of care enables a redefinition of collective responsibility.The starting point is a paragraph of the Foucault’s last course at the Collège de France (Courage Of Truth), where the philosopher refers to Patočka’s work. Foucault marks a separation between his work, focused on the theme of the bios, as opposed to that of Patočka, centred on the issue of the psyche. According to Foucault, his own research on epimeleia heautou as problematization and stylization of the self is different from that of Patočka, who is interested in the ontological and epistemological facets of the concept of soul .First, Foucault’s thesis encourages an analysis of the meaning of the word “soul” in the context of the asubjective phenomenology developed by Patočka. Second, it suggests to focus on the notion of “self” in last texts of Foucault.Questioning the relationship between the processes of subjectivation and the bios as a “style of existence”, we start considering life as ontological horizon of being in common. This thinking allows for the possibility of “care for the bios” as both “bond of life” and “way of life”: as critical ontology of the conditions that govern the recognition of life as ontological dimension of being in common, on the one hand; and as ethical attitude to protect the bios’s vulnerability on the other. / A partire dalle riflessioni del fenomenologo cèco Jan Patočka e dagli studi del filosofo francese Michel Foucault, questa ricerca intende esplorare il tema della cura – di sé, dell’anima, degli altri, del mondo – in quanto forma di relazione etica. Nell’eclissi dei sistemi valoriali tradizionali, le ricerche sulla nozione di cura possono offrire una prospettiva etica capace di riformulare i termini della responsabilità collettiva. Il punto di partenza è un passaggio dell’ultimo corso di Foucault al Collège de France (Il coraggio della verità), dove il filosofo fa riferimento al pensiero di Patočka. Foucault riconosce all’autore ceco di essere stato il solo autore contemporaneo ad aver approfondito il principio antico dell’epimeleia. Tuttavia, secondo Foucault, la propria personale ricerca – articolata attorno alla nozione di epimeleia heautou, cioè di cura come messa alla prova, problematizzazione e stilizzazione di sé – differirebbe da quella di Patočka, più interessata allo studio dell’epimeleia tes psyches, ossia all’anima sotto il profilo ontologico e gnoseologico.Innanzitutto, la tesi di Foucault incoraggia un’analisi del significato del termine “anima” nel contesto della fenomenologia asoggettiva elaborata da Patočka. Indagando i rapporti tra i processi singolari di soggettivazione e il bios in quanto “modo di vita” o “stile di esistenza”, si arriva a porre il problema della vita in quanto orizzonte ontologico dell’essere in comune. Ci si interroga così sulla possibilità di una cura del bios che sia insieme “legame di vita” e “modo di vita”: cura del bios come ontologia critica delle condizioni che rendono possibile il riconoscimento della vita, intesa come dimensione della coappartenenza, e allo stesso tempo attitudine etica a farsi carico della sua vulnerabilità.

[pt] A pesquisa busca questionar a naturalização da violência de Estado
direcionada contra os corpos negros no Brasil. Para esta urgente tarefa, o trabalho
desenvolve um diálogo central entre a filosofia descolonial e a foucaultiana,
dividindo-se em quatro capítulos. O primeiro demonstra o enraizamento desta
naturalização desde o período colonial, mostrando a objetificação do corpo negro
e a sua invibilização tanto na escravização como no movimento abolicionista. O
segundo capítulo aborda o período pós-abolição por meio do projeto de
embranqueamento e do racismo científico. O terceiro enfrenta o auto de
resistência como prática contemporânea do racismo de Estado da sociedade
biopolítica brasileira. Por fim, o quarto pretende refletir sobre resistências e
possibilidades de transformações descoloniais desta realidade objetificante e
violenta. / [en] The investigation aims to question the naturalization of State s violence
against black bodies in Brazil. For this urgent task, the work develops a dialogue
between decolonial and foucauldian philosophy, and is divided in four chapters.
The first one points out that this naturalization has its roots in brazilian history
since colonial time, with the objectification of black bodies during slavery and
also at the abolitionist movement. The second one approaches the post-abolition
period, its whitening project and the scientific racism. The third part faces the
auto de resistência as a contemporary practice of State s racism in the brazilian
biopolitic society. Finally, the fourth chapter intends to analyze resistances and
possibilities of decolonial transformations of this violent and objectifying reality.

[pt] Nesta tese enfrento problemáticas dos Direitos Humanos pela filosofia
política e crítica ao direito. Num primeiro momento, apresento crítica à tradição e
uma breve genealogia de como se dá o pensamento e a história desses direitos, tanto
da ordem dos discursos de fundamentação como da sua afirmação social. Em
seguida, trabalho a encruzilhada dos Direitos Humanos a partir da relação com a
soberania e a biopolítica, respectivamente, segundo Jacques Derrida e Michel
Foucault. Por um lado, é de se destacar o acentuado caráter histórico e político dos
Direitos Humanos, de outro, questionar seu potencial de transformação social. A
encruzilhada aparece e a problematização se dá, pois, se os Direitos Humanos são
esforço do histórico de mobilizações contrário a injustiças sociais e modelos
jurídicos conservadores, também, passam a fazer parte de nossa era de direitos
como fundamento e manifestação legítima do direito. Inclusive, por vezes, se
voltam contra seus próprios fins. Nesse contexto, os Direitos Humanos estão
atrelados ao ímpeto civilizatório ocidental, ao capitalismo global, à ordem
internacional e às violências de estado, ao mesmo tempo em que se manifestam
com as lutas políticas, as conquistas sociais e as defesas contra violações de direito.
A partir disso, problematizo os Direitos Humanos diante de seus fins e de sua força
como direito, também, lanço a problemática de como pensá-los diante dos caminhos
cruzados, da diferença das forças e da contínua abertura à mudança social presentes
em sua atualidade. Com essa delimitação, estudo o potencial dos ‘Direitos Humanos
na encruzilhada’, segundo a produção social e a definição da humanidade. Isso se
dá, pela intersecção da soberania e da biopolítica, conforme são ultrapassados
limites do direito e atingidos novos domínios da vida e da sociedade. O que implica
reformular questões em torno da normatividade, da força e da realização dos
Direitos Humanos. Por fim, destaco algumas tensões em meio às relações sociais e
às composições de poder dos Direitos Humanos no cenário político atual. / [en] This thesis consists of a study about problems concerned to Human Rights
from political philosophy and critique of law. At first, with a critique of the tradition
of Human Rights and a brief genealogy of how thought and history of Human
Rights took place, both in terms of foundational speeches and social statements.
After that, due to open fractures with the philosophy of Jacques Derrida and Michel
Foucault, the idea is to distinguish how Human Rights function when related to
sovereignty and biopolitics. It is important to highlight the historical and political
nature of law, and to question its potential of social transformation, once Human
Rights are at the crossroads: If Human Rights are an effort of the history of
mobilizations contrary to social injustices and conservative legal models, they also
become our era of rights as foundations and part of legitimate law. Even, at times,
they turn against their own ends. In this context, the concept of Human Rights is
linked to western civilization, global capitalism, international order and state
violence, at the same time that Human Rights are made with political struggles,
social conquests, institutional protection and defense against rights violation. In
this context, is important to investigate how to think about Human Rights once
considered the difference of forces of their formation and continuous openness to
changes. This work turns to the potential of Human Rights at the crossroads, which
is crucial to the crossroads itself, according to its social production and ability to
define the political and humanity. Which results from the intersection of sovereign
power and biopolitics, as the premises of law are displaced and the Human Rights
reaches new domains of life and society. This implies reformulating questions
about normativity, enforcement and achievement of Human Rights. At the end, it
is consequential to highlight tensions of these rights in the midst of social relations
and compositions of power in the current political scenario. / [fr] Dans cette présente thèse, les questions de Droits de l Homme sont
confrontées à la philosophie politique et à lacritique du Droit. Dans un premier
temps, il se fait une critique de la tradition et une brève généalogie de la manière
dont la pensée et l histoire de ces droits se déroulent, tant au niveau des discours de
raisonnement que de leur affirmation sociale. Ensuite, le travail se retrouve dans
une sorte de croisement des Droits de l Homme à partir du rapport à la souveraineté
et à la biopolitique, respectivement, selon Jacques Derrida et Michel Foucault.
D une part, il faut souligner l important caractère historique et politique des Droits
de l Homme, d autre part, s interroger sur leur potentiel de transformation sociale.
La croisée des chemins apparaît et la problématisation s opère, car si les Droits de
l Homme sont le résultat de l effort historique de mobilisations contre les injustices
sociales et les modèles juridiques conservateurs, mais, ils s inscrivent aussi dans
notre ère des droits comme fondement et manifestation légitime du droit.Parfois, ils
se retournent même contre leurs propres fins. Dans ce contexte, les Droits de
l Homme sont liés à la poussée civilisatrice occidentale, au capitalisme mondial, à
l ordre international et à la violence d État, mais aussi aux luttes politiques, aux
conquêtes sociales et à la défense face aux violations des droits. A partir de là, les
Droits de l Homme sont premièrement problématisés face à leurs fins et leur force
en tant que droit, et, ensuite, problématisés sur la façon de les penser face aux
chemins croisés, à la différence des forces et à l ouverture continue aux
changements sociaux présents de nos jours. Dans cette délimitation, il convient de
souligner le potentiel des Droits de l Homme à la croisée des chemins à partir de
leur production sociale et de leur capacité à définir l espace politique et celui de
l humanité. Cela arrive à travers l intersection de la souveraineté et de la
biopolitique, au fur et à mesure que les limites du droit sont dépassées et que de
nouveaux domaines de la vie et de la société sont atteints. Cela implique de
reformuler les questions autour de la normativité, de la force et de la réalisation des
Droits de l Homme. Enfin, les tensions de ces droits sont questionnées face aux
relations sociales et aux compositions du pouvoir dans le scénario politique actuel.
