Les recours individuels directs devant la juridiction constitutionnelle sont marqués par une forte originalité. Leur originalité se caractérise tant par la possibilité qu’un individu puisse accéder sans intermédiaire au prétoire du juge constitutionnel, que par la diversité des actes contestables devant ce juge et par cet individu. Afin d’appréhender les diverses formes de recours individuel direct en Allemagne, Autriche, Belgique et Espagne, il convenait de mobiliser un instrument qui mette en évidence cette double spécificité d’études : le droit processuel. Celui-ci se définit en effet par l’ambition de traiter les divers contentieux de manière comparée, au-delà de leur nature particulière.Cette démarche comparative permet plus spécialement de relativiser le clivage droit privé/droit public : tandis que le droit processuel trouve habituellement son terrain d’élection dans le droit judiciaire privé, alors que le contentieux public est accaparé par la dimension du « procès fait à un acte », l’analyse des recours individuels directs permet d’appréhender pleinement le contentieux constitutionnel comme structure procédurale de protection des droits. Le droit processuel permet ainsi d’analyser les recours individuels directs comme forme entièrement développée de recours en protection des droit devant la juridiction constitutionnelle, forme qui n’existe pas en France : il permet une mise en perspective de notre culture juridique centrée sur la conformité juridique objective des actes. / Direct constitutional complaints before the Constitutional Court appear as a strongly original procedure. It is caracterized both by the possibility for an individual to have direct access to the Court and by the wide variety of the legal acts that can be challenged there. The analysis of the diverse forms of direct constitutional complaints in Austria, Belgium, Germany and Spain requires a conceptual framework that allows those two characteristics to stand out: processual law. Processual law can be defined by its ambition to consider various kinds of litigation in a comparative way beyond their specific nature. This comparative approach especially allows for a relativisation of the public law/private law distinction. In France, processual law is generally used in private litigation context, whereas public litigation is more focused on the “procès fait à un acte” dimension. By contrast, the analysis of direct constitutional complaints through processual law sheds a specific light on it as a procedural structure directed towards the protection of rights. In other words, direct constitutional complaints appear in this light as a fully developed form of procedure for the protection of rights, a form that does not exist in France. Our legal culture which is focused on the question of the objective legal conformity of acts is thus put into a new perspective.

The topic of this thesis is: Travel contracts according to the new Civil Code. The thesis consists of two parts - theoretical and practical. The theoretical part deals with the basic terms related to the tourism and it describes the consumer protection legislation in both the Czech Republic and the European Union. In the practical part, there is an analysis of some travel contracts (including the terms of a contract) of tour operators and travel agencies located in České Budějovice. This part also analyses the results which were obtained from the questionnaires intended for the customers of tour operators or travel agencies and for the tour operators and travel agencies.

Reflections on the legal and psychological constructions of women's resistance to sexual harassment

Despite the extensive research conducted on sexual harassment, very little work has focused on the legal and psychological constructions of women's resistance to sexual harassment. In exploring the legal and psychological constructions of women's resistance to sexual harassment, we are confronted with salient issues pertaining to the determination of the welcomeness requirement which call for a reflection. A key characteristic of sexual harassment is that it is unwanted by the recipient. It is for each person to decide what behaviour is acceptable to them and what they regard as offensive. Thus, although there is general agreement about what can constitute sexual harassment, the experience of sexual harassment is subjective in nature and the precise quantification of workplace sexual harassment is problematic. The present study aims to: (a) identify the reasoning/history behind the "unwelcomeness/unwanted" requirement, (b) assess the reasonableness of· the requirement of "unwelcomeness/unwanted" conduct, taking into account the various pieces of legislation and case law, (c) determine how the courts have interpreted this requirement and what factors are looked at, (d) determine whether the test is subjective or objective, (e) identify the struggle and debilitating effects sexual harassment has on women in the workplace. The results of this study will assist in gaining knowledge and understanding of the concept of "unwelcomeness/unwanted" conduct in sexual harassment cases and the effects it has on the victim which will go a long way in assisting management in any business to effectively implement strategies and disciplines to manage the problem of sexual harassment in the workplace. / Private Law / LLM (Labour Law)

Le régime des communications individuelles présentées en vertu de traités onusiens relatifs aux droits de l'homme / Individual complaint procedures under the United Nations human rights treaties

La construction empirique du système conventionnel des Nations Unies relatif aux droits de l’homme s’est fondée sur un consensus minimum entre les Etats concernant le développement du dispositif conventionnel. Font partie de ce consensus les procédures de surveillance de l’application des traités onusiens relatifs aux droits de l’homme et les organes auxquels la mise en oeuvre de ces procédures fut confiée. A côté de la procédure de présentation des rapports sur les mesures prises pour la mise en oeuvre de leurs obligations conventionnelles, les Etats parties se sont mis d’accord sur une procédure de présentation de plaintes individuelles, sous l’appellation de procédure de communications individuelles. Le modèle initial de cette procédure, produit de résistances, des polarisations, des hésitations et des espérances démenties concernant la création d’une Cour internationale des droits de l’homme, la nature et l’étendue du contrôle sur plainte et le statut de l’individu, fut reproduit par la suite sans modifications majeures. La procédure d’examen des communications individuelles ainsi que les éléments de l’affaire introduite par les communications individuelles sont établis par les instruments conventionnels dans des termes comparables. Leur mise en oeuvre par les organes de traités ne témoigne pas d’une rupture capable d’empêcher l’unité du système conventionnel des Nations Unies. Les comités conventionnels ont pris conscience de leur fonctionnement au sein d’un seul système et s’efforcent d’harmoniser leurs méthodes de travail tout en assurant la spécificité de leur traité. C’est ainsi que l’on peut parler du régime des procédures de communications individuelles dans le système conventionnel des Nations Unies sur les droits de l’homme. A côté des éléments institutionnels et procéduraux permettant la systématisation des procédures de communications individuelles, les instruments conventionnels les plus récents établissant les procédures de communications individuelles codifient l’évolution de la procédure par les comités conventionnels les plus anciens, notamment le Comité des droits de l’homme. La codification de la pratique du contentieux des comités conventionnels s’inscrit dans un processus continu d’évolution de la protection des droits de l’homme au niveau universel. En s’affirmant garants à la fois de l’objet et du but de traités onusiens relatifs aux droits de l’homme et de l’effectivité du recours individuel, les organes de traités renforcent leur rôle en tant qu’organes de contrôle et poussent pour une judiciarisation implicite de la procédure de communications individuelles. Cependant, à défaut d’outils institutionnels permettant d’imposer aux Etats parties les obligations découlant de la procédure de communications individuelles, les organes de traités sont obligés de chercher le bon dosage entre fermeté et diplomatie sans pour autant être en mesure d’assurer la coopération des Etats parties. La standardisation de la procédure de communications individuelles au sein du système conventionnel des Nations Unies de protection des droits de l’homme renforce la position de l’individu en droit international et met au premier plan des victimes restées longtemps dans l’ombre. Par l’affirmation de leur autorité d’interpréter les traités et d’assurer l’efficacité de la procédure de communications individuelles, les comités conventionnels contribuent à la mise en oeuvre effective et cohérente des principes normatifs au niveau universel. / The empirical construction of the United Nations human rights treaty system was based on a minimum consensus among states. Treaty bodies and monitoring procedures of treaty obligations are part of this consensus. Besides the reporting procedure, States parties have reached consensus on an individual complaints procedure. The procedure emerged after polarization and hesitation among States over the establishment of an international human rights court and the status of the individual in international law and was reproduced in without major modifications. So individual complaints procedures under United Nations human rights treaties have common procedural and institutional features. Furthermore, treaty bodies have engaged in a process of harmonization of their working methods giving us reason to be optimistic about the unity of United Nations human rights treaty system. Besides common institutional and procedural aspects, the latest treaties establishing individual complaints procedures codify the evolutionary practice of older treaty bodies, especially the Human Rights Committee. By affirming their determination to protect the object and purpose of human rights treaties and to guarantee the effectiveness of individual complaints procedures, treaty bodies strengthen implicitly the judicial aspects of the procedure. However, in the absence of judicial authority and other institutional tools for imposing on States parties’ treaty obligations, the treaty bodies are forced to seek the right balance between firmness and diplomacy without being able to ensure States parties’ cooperation. Nonetheless, observance of treaty obligations under the individual complaints procedure is a part of a long and continuous process in which treaty bodies due to their expertise and competences have a predominant role. The standardization of the individual communications procedure in the United Nations human rights treaty system strengthens the position of the individual in international law and foregrounds victims that have long remained in the shadows. By asserting their authority to interpret treaties and to ensure the effectiveness of the individual communications procedures, the treaty bodies contribute to the universalization of normative principles and their effective and coherent implementation.

A content analysis of user-generated content of the seven original equipment manufacturer brands in South Africa

Increased consumer expectations and diverse consumer needs have led to consumers turning to the internet as a communication medium to share their positive and negative experiences, feelings, and level of satisfaction with others. The primary objective of this study was to explore the nature of user-generated content, in terms of consumer complaint and compliment behaviour related to the seven OEM brands in South Africa. The study focused on the South African automotive industry, and the consumer behaviour associated with post-purchase responses on an online consumer advocacy platform, called Hellopeter.com. A qualitative research design, making use of a content analysis, was employed. In total, 185 user-generated content items were collected from Hellopeter.com for the data-collection period, and 176 complaints and 9 compliments were analysed. The results of this study indicated that the nature of user-generated content related to the seven OEM brands in South Africa could be categorised according to eight broad themes: seven themes were specifically related to consumer complaint behaviour, while one theme was associated with consumer compliment behaviour. The top consumer complaints and compliments related to the OEM brands on Hellopeter.com were also determined. The nature of the user-generated content showed various similarities to that of the general services industry but proved to be unique to the automotive industry. Specific recommendations were made and included that open communication channels and proper feedback systems should be put in place to satisfy consumer needs, and that the findings of the study should be used as a benchmark to monitor and improve consumer complaint and compliment behaviour, as a means to create loyal consumers / Business Management / M. 1 Abstract The public administration itself is bound by applicable legal provisions. Therefore, in case of breach of individual rights stemming from the legal system of the Czech Republic, every person is guaranteed a strict legal procedure with corresponding legal mechanisms, which aim to remedy the status caused by unlawful action or inaction of the public administration. The object of this dissertation focuses, in particular, on analysis of individual means of protection of rights in public administration (i.e. the issue of the protection of public subjective rights) and their mutual relationships between them at level of legal regulation de lege lata. However, certain space had to be dedicated also to the procedures of public administration in matters related to private subjective rights as even the public administration decides on certain matters of private law. As regards the protection of private rights by public administration I mentioned the dualism of the review of decisions of public bodies and certain examples of public administration deciding on matters of private subjective rights. Satire of Counsel, Counsel of Satire: Representing Advisory Relations in Later Medieval Literature

Satire and counsel recur together in the secular literature of the High and Late Middle Ages. I analyze their collocation in Latin, Old Occitan, and Middle English texts from the twelfth to the fifteenth century in works by Walter Map, Alan of Lille, John of Salisbury, Daniel of Beccles, John Gower, William of Poitiers, Thomas Hoccleve, and John Skelton. As types of discourse, satire and counsel resemble each other in the way they reproduce scenarios of social interaction. Authors combine satire and counsel to reproduce these scenarios according to the protocols of real-life social interaction. Informed by linguistic pragmatics, discourse analysis, sociolinguistics and cultural anthropology, I examine the relational rhetoric of these texts to uncover a sometimes complex and reflective ethical discourse on power which sometimes implicates itself in the practices it condemns. The dissertation draws throughout on sociolinguistic methods for examining verbal interaction between unequals, and assesses what this focus can contribute to recent scholarly debates on the interrelation of social and literary practices in the later Middle Ages. In the first chapter I introduce the concepts and methodologies that inform this dissertation through a detailed consideration of Distinction One of Walter Map’s De nugis curialium . While looking at how Walter Map combines discourses of satire and counsel to negotiate a new social role for the learned cleric at court, I advocate treating satire as a mode of expression more general than ‘literary’ genre and introduce the iii theories and methods that inform my treatment of literary texts as social interaction, considering also how these approaches can complement new historicist interpretation. Chapter two looks at how twelfth-century authors of didactic poetry appropriate relational discourses from school and household to claim the authoritative roles of teacher and father. In the third chapter, I focus on texts that depict relations between princes and courtiers, especially the Prologue of the Confessio Amantis which idealizes its author John Gower as an honest counselor and depicts King Richard II (in its first recension) as receptive to honest counsel. The fourth chapter turns to poets with the uncertain social identities of literate functionaries at court. Articulating their alienation and satirizing the ploys of courtiers—including even satire itself—Thomas Hoccleve in the Regement of Princes and John Skelton in The Bowge of Court undermine the satirist-counselor’s claim to authenticity. In concluding, I consider how this study revises understanding of the genre of satire in the Middle Ages and what such an approach might contribute to the study of Jean de Meun and Geoffrey Chaucer.

«Avec salutations socialistes» : lettres de plaintes et relations socio-étatiques en République démocratique allemande, 1953-1967

Ce mémoire de maîtrise consiste en une analyse des dynamiques relationnelles entre l'État de la République démocratique allemande et ses citoyen·ne·s à travers un échantillon de lettres de plaintes envoyées entre 1953 et 1967 concernant les problèmes liés au logement. Les plaignant·e·s ont adopté des « valeurs socialistes » tout au long de leurs discours pour justifier la légitimité de leurs demandes et ils ont utilisé les mots et les principes mêmes de l'État pour exiger des actions. Ce mémoire met en lumière non seulement ces différentes stratégies en utilisant une approche « par le bas », mais examine aussi examine également la réaction de l'État. On remarque notamment que les réponses envoyées par l’État aux plaignant·e·s étaient en général plus positives dans les années 1960 et 1950, ce qui montre d’une part une évolution dans le rapport entre l’État et la société, mais aussi d’autre part un certain changement quant à l’application même des principes socialistes. On remarque en outre que, dans les années 1960, le gouvernement de l’Est a davantage pris soin d'adapter la gestion de ses politiques intérieures aux besoins de la population. L'analyse de ces lettres se situe à la croisée de deux méthodes ; tout d'abord, une analyse discursive a permis de saisir les stratégies d'écriture récurrentes par lesquelles la population a tenté d’influencer l’État. Puis, une analyse statistique des réponses de l’État croisée à l’évolution des politiques intérieures a permis de saisir les changements d’attitude du gouvernement envers sa population. / This master’s thesis analyzes the dynamics between the German Democratic Republic and its citizens through complaint letters that East Germans sent to the State between 1953 and 1967 regarding housing problems. It argues that the complainants adopted “socialist values” throughout their discourses as a way of justifying the legitimacy of their complaints. In other words, they used the discourse and principles of the state against it in order to demand action and a resolution to their problems or concerns. This thesis not only highlight these various strategies, utilizing a “history from below” approach, but it also investigates the state’s reaction to the complaints of its citizens. It argues that the state responded overall better in the 1960s as it did in the 1950s, showing evolution in the relationship between state and society as well as a shift in the state’s way to understand socialism. By the 1960s the East German government had had time to slowly adapt its domestic politics towards the population’s needs. The analysis of these letters is at the crossroads of two methods: First I employ a discursive analysis that allows me to identify the recurring strategies by which the state and its citizens sought to influence each other. Second, I use a statistical analysis of the State’s responses coupled with an examination of domestic politics that allows me to capture the changing attitude of the government towards its population.

Moreover, if conditions laid down by European Convention on the Protection of Human Rights and Fundamental Freedoms are met, an individual has a right to apply to the European Court of Human Rights (Strasbourg) for a revision of a challenged act of public administration, which is considered to be as a final and conclusive from the point of view of national law. The object of this Thesis focuses, in particular, on analysis of individual means of protection of rights in public administration and their mutual relationships between them at level of legal regulation de lege ferenda.
