O objetivo deste trabalho é o de fazer uma reflexão sobre a legitimidade da restrição da autonomia da pessoa para a proteção de sua dignidade, dando destaque para os casos que envolvem sua exposição na mídia televisiva. A partir do moderno conceito de dignidade humana, que confere ao Homem um valor intrínseco e absoluto, diferenciado em relação às coisas, em razão de sua capacidade de ditar suas próprias leis, sendo dotado, portanto, como proposto por Immanuel Kant, de uma autonomia, pretende-se analisar se os tratamentos a que se sujeitam as pessoas que voluntariamente participam de determinados tipos de programas televisivos constituem, de fato, uma ofensa à sua dignidade e se, por tal motivo, seria justificável a proibição de tais participações. Será feita uma abordagem, no desenvolvimento do trabalho, a respeito da elaboração do moderno conceito de dignidade humana e sua relação com a autonomia, a qual permite à pessoa formar suas convicções de acordo com seus próprios valores, direito que lhe é reconhecido pelo Estado democrático moderno. Far-se-á um estudo a fim de se tentar compreender se realmente constitui a dignidade humana um princípio ou valor absoluto segundo critérios objetivos que autorizem a limitação da autonomia da pessoa para protegê-la sem que isso configure uma ingerência indevida, por parte do Estado, em sua liberdade individual. / This paper aims at doing a reflection about the legitimacy of the restriction of the person\'s autonomy for protecting his/her dignity, emphasizing the cases involving his/her exposition on TV media. Based on the modern concept of human dignity, that confers to man an intrinsic and absolute value, that makes him different of things, due to his capacity of doing his own laws, having, thus, as purposed by Immanuel Kant, an autonomy, the intention is to do an analysis if some treatments given to people that voluntarily participate in some kind of TV programs do represent a violation to their own dignity, and, for this reason, if it\'s justifiable to forbid people to take part in such programs. In the development of this paper will be made a study about the elaboration of the modern concept of human dignity and it\'s relation to autonomy, which allows a person to form his/her convictions according to his/her own values, what is recognized as his/her right in a modern democratic State. It\'ll be done a study to understand if human dignity is indeed an absolute principle or value according to objective criteria that authorizes the limitation of the autonomy of the person to protect him/her without making it represent an improper interference of the State in his/her individual freedom.

Food Values and the Human Right to Food: A Sociological Analysis of Food Insecurity in Oregon

Treating food as a commodity is a dominant mode of valuing food in the United States, and around the world, in which people exchange money for food. But in a world that can feed over 10-billion people why is poverty still a primary barrier to food security? This dissertation adds to the food justice and political economy literature by arguing that food insecurity will linger far into the future, despite technological advancements, because of the current food system which values food as a commodity instead of valuing food as a human right. Through an analysis of 23 semi-structured interviews with volunteers and workers in Oregon, and field research at a community garden, this dissertation highlights how even in the minds of people who advocate for food as a human right, the human right to food may only a right to people with enough money. This research illuminates how thinking of food as a money-exchange commodity builds a socially constructed wall between hungry people and abundant food.

Concerning the individual, the starting point was an ontological view that, according to its understandings, grants more strength to the individual’s technical meaning. Thus, it is concluded that the best point of view to reveal such meaning is the one granting the individual material meaning, comprising, in its roots, the human being and their inherent dignity. Regarding the entity feature, the same line of thought was conducted in the research and therefore, the idea defended was that the legal entity is nothing more than the result of the anthological personality from the human being. It must be evaluated, consequently, not only as a legal trait but also as an axiological quid of compulsory recognition by the legal framework. As to the individual’s right, the research highlighted the object by which the individual is referred to, stating that such characteristic, together with powerful doctrine, is found not in the person but in the human nature as a whole. With regard to the non-transferability, there was the concern of presenting its fundaments as they shall be seen; the same as the objects before mentioned, and also the organic format in which we present the entity’s rights in relation to the owner. Then, after preparing the basis to handle the concept of post mortem injunction relief of certain entities’ rights (better yet, its emanations), some pages have been reserved to elaborate on how the practice really takes place. It is vital to clarify that the object of this paper was not to deal with post mortem injunction relief itself, although the hard matter was partially dealt, however difficult it may have been, for reasons of intellectual responsibility, offering a simple attempt of achieving a mere conclusion on the subject, as it falls far from this very overview. In sum, the issues of individuals, entities and the non-transferability of rights from these personalities present themselves as a proposal of competent premises for the setting up of a dogma aiming at effectively reaching the complexity of a theme that involves, in the last resort, what remains from those who have passed away / O objeto da pesquisa foi o estudo da pessoa, personalidade e, no que se refere aos direitos de personalidade, sua principal característica: a intransmissibilidade. No que se refere à pessoa, partiu-se de uma visão ontológica que, segundo se entende, confere maior robustez ao seu sentido técnico. Assim, concluiu-se que a melhor ótica para descortinar-lhe o sentido é a que lhe confere sentido material, abrigando, em sua matriz, o ser humano e sua inerente dignidade. Sobre a personalidade, seguiu-se a mesma linha de pesquisa e, assim, defendeu-se a ideia de que a personalidade jurídica nada mais é do que a decorrência da personalidade ontológica do ser humano. Deve, portanto, ser avaliada não apenas como atributo jurídico, mas como quid axiológico de reconhecimento compulsório pelo ordenamento. Quanto aos direitos de personalidade, foi acentuado o objeto sobre o qual se referem, afirmando-se, ao lado de percuciente doutrina, que não se encontram na pessoa, mas na natureza humana como um todo. Já em relação à intransmissibilidade, houve preocupação no sentido de apresentar seus fundamentos que, conforme será visto, são aqueles mesmos objetos acima referidos e, também, a forma orgânica com que se apresentam os direitos de personalidade em relação ao seu titular. Assim é que, depois de sedimentado o terreno para tratar da tutela post mortem de certos direitos da personalidade (ou melhor, de suas emanações), foram reservadas algumas páginas para elucidar como, na prática, ela ocorre. É importante deixar claro que, conforme se depreende desta síntese, o objetivo do trabalho não foi tratar da tutela post mortem propriamente dita, muito embora, por uma responsabilidade intelectual, se tenha tentado enfrentar o espinhoso assunto, ofertando uma singela tentativa de conclusão. L'influence du principe de dignité humaine sur l'évolution du droit public de la vie en détention / The influence of the principle of human dignity on the development of public law of prison life

Depuis le début des années 2000, la Cour européenne des droits de l’homme a donné un senset une portée juridique inédits au principe de dignité humaine appliquée à la détention, en se fondant notamment sur l’article 3 de la convention européenne des droits de l’homme qui proscrit la torture et les peines ou traitements inhumains ou dégradants. Cette évolution majeure, lui permettant de faire entrer largement sa jurisprudence dans les établissements pénitentiaires, a contraint le juge administratif français à revoir, de manière très profonde, sa jurisprudence consacrée aux mesures d’ordre intérieur et, sur le fond, à imposer la dignité humaine comme un principe matriciel à l’aune duquel l’ensemble desdroits fondamentaux des personnes détenues doit désormais être appréhendé. Elle a également influencé le législateur sur le vote de lois sur la privation de liberté, telles que la loi pénitentiaire de 2009. Sous inspiration européenne, mais également dans le cadre d’une dynamique interne de promotion générale des droits des administrés, la saisine de la vie en détention par le droit public a, dès lors, contribué au renforcement des droits accordés aux détenus (encadrement des sanctions et des mesures préventives de sécurité – mise à l’isolement et fouilles au corps notamment –, droit à la vie, droit au respect de sa vie privée et familiale, ou encore liberté de conscience et de religion...) et à uneréparation plus aisée des préjudices qui leur sont causés par l’activité pénitentiaire.Toutefois, de nombreux obstacles demeurent à la progression de l’état de droit en prison. En effet, la persistance de conditions de détention indignes et les limites à la mise en oeuvre de ces droits, à leur protection par le juge ou à leur application par l’administration posent la question de leur effectivité et de leur conformité aux standards européens établis par le juge de Strasbourg / As from the early 2000s, the European Court of Human Rights started to give unprecedentedlegal effect and meaning to the principle of human dignity applied to conditions of detention, drawing, when doing so, in particular on Article 3 of the European Convention on Human Rights prohibiting torture and inhumane or degrading treatment or punishment. This major development, which has enabled the Court to have its case law implemented to a significant extent in prisons, has forced French administrative courts to fully review their case law concerning internal measures and, in substance, to impose human dignity as a framework principle in the light of which all fundamental rights of detainees must henceforth be considered. This major development has also influenced the lawmaker when voting on laws concerning the deprivation of liberty, such as the Prisons Act of 2009.Under this European influence, but also as part of an internal movement concerning the general promotion of citizens rights, the referral, to courts of public law, of matters pertaining to prison life, has, since its inception, led to a reinforcement of the rights granted to detainees (framework for sanctions and preventive security measures - solitary confinement and body searches in particular - the right to life, the right to respect for privacy and family life, freedom of conscience and of religion, etc.) and facilitated compensation for damages caused to detainees by a penitentiary authorities.However, many obstacles remain to establishing constitutionality for detainees. Indeed, thepersistence of inhuman conditions of detention, and the limits applied on exercising detainees’ rights, and to ensuring that these rights are protected by a court of law or are implemented by Administration, raise the question of their effectiveness and of their compliance with European standards as set down by the Strasbourg Court

L'application des pratiques de gestion inhumaines (PGI) conforme un phénomène qui ne tient pas en considération l'horizon philosophique du projet culturel moderne fondé sur un corpus idéologique, juridique et politique reconnaissant l'humanité de toutes les personnes. La perspective théorique sur les PGI que nous présentons ici permet d'examiner et de définir les mauvais traitements provenant des décisions de gestion qui sont adoptées et mises en œuvre à partir d'une rationalité instrumentale et sans tenir compte de la souffrance qu'elles peuvent causer aux travailleurs. Les PGI sont caractérisées par l'utilisation de moyens intimidants et dégradants qui visent à éliminer ceux qui sont considérés comme gênants ou superflus par une direction dont l'unique but est de triompher sur le marché globalisé, régi par la loi de la rentabilité maximum de l'investissement. Les PGI dans les organisations contemporaines ne rendent pas compte d'une condition essentielle de la conduite humaine, pour autant nous ne les abordons pas dans une perspective généraliste, mais depuis la spécificité d'un lieu et d'un temps déterminés. De là, surgit l'intérêt pour déterminer pourquoi et comment l'on porte atteinte, dans le contexte local, à l'humanité du travailleur à travers les PGI. S'il est vrai que dans le milieu du travail, il existe une relation de subordination incontournable, nous soulignons, pour l'analyse des PGI, le rôle des sciences humaines, car à partir de celles-ci il est possible de repérer des contextes, des situations, des tensions, ainsi que les causes et les divers facteurs qui interviennent pour que dans le monde de l'entreprise contemporain certaines directions transgressent les principes qui régissent un traitement humain. Les organisations doivent donc reconnaître et faire valoir les postulats qui sous-tendent « l'idéal » selon lequel tous les travailleurs sont des êtres dignes, libres, égaux, autonomes, respectables qui ont le droit per se au bien vivre. La souffrance psychique provoquée par le mauvais traitement dans le milieu de l'entreprise est le résultat de la violation des droits de l'homme, l'humiliation et la honte sont des sentiments qui surgissent chez la personne que l'on méprise et que l'on déshumanise. Nous avons pu démontrer à partir de ce travail de terrain ethnographique (il est structuré en deux récits : perspective des cadres et perspective des ouvriers) dans l'organisation C-Colombia (1993-2005), que le pouvoir et l'autorité dans cette entreprise ont toujours été utilisés pour favoriser une gestion inhumaine, incapable de reconnaître une série de conflits et de tensions pouvant se déchiffrer et se résoudre techniquement et moralement d'une façon plus respectueuse de la dignité des travailleurs dans la ligne d'une administration moderne humanisée.Mots clés : Inhumanité, Travail, Entreprise, Pratiques de gácticas administrativaestion inhumaines, Violence au travail, Humilliation, Mauvais traitement, Honte / Inhumane Administrative Practices (IAP) refer to certain systematic, calculated and planned violent exercises on the part of management, by which the termination of contracts with workers who are considered to be replaceable or are disruptive to the instrumental ends of an organization are possible. The theoretical perspective of IAP presented here examines and details strategies, actions, omissions and other administrative acts through which workers are mistreated, humiliated and shamed, so that they passively submit to productive dynamics, reject the possibility to join unions, accept “voluntary work arrangements”, or quit their labor affiliation. IAP is characterized, therefore, by the use of intimidation and degrading methods that injure the humanity of workers in the context of a production logic centered on the laws of the market and maximization of profits. IAP in organizations does not go against the essential condition of human behavior; therefore, it is not carried out from a generalist perspective, but rather from the specificity of place and prescribed timeframes. For this reason the practices through which IAP violates workers' humanity are characterized at the local level. In this study, conceptual reference in humanities are applied and are fundamental to examine the relationship of labor subordination, which, while it is possible to eliminate, is a continually weakening factor because of an abuse of power that fails to recognize working people as individuals who are dignified, free, equal, autonomous, respectable and therefore, individuals who have the right to a good life.The creation of a theoretical framework, then, seeks to contribute to the epistemological foundation that provides new analytical elements to the science of management in order to focus concrete practices of workplace violence far from the philosophical perspective of a modern culture with ideological, legal and political foundations that recognize the human condition of every person. Ethnographic fieldwork was carried out in the organization C-Colombia between 1993-2005 and is presented in two accounts: one from the perspective of management and another from the perspective of workers. The result demonstrates that power and authority in this enterprise was always applied with disregard to psychological human suffering. This behavior is a product of mistreatment and humiliation of workers, and is incapable of applying alternative approaches to those of narcissistic and productionist ends, in order to resolve problems that could be dealt with technically and morally in a more dignified manner.Key words: Inhumanity, work, enterprise, inhumane administrative practices, workplace violence, humiliation, mistreatment, shame.
