The thesis "Analysis of political news in Czech newspapers during the parliamentary elections of 2017" examines the media coverage of the election in the daily newspapers Lidové noviny, Hospodářské noviny, Mladá fronta DNES, Právo and Blesk. This will be done using content analysis. The theoretical part outlines the role of the media in the political life of society and social responsibility which results from it and becomes even more important before an election. On the basis of the theoretical knowledge of the available literature, normative media requirements are described and I focus on normative requirement of objectivity and its criterion of impartiality, which is based on balance and neutrality. Furthermore, I will analyse the compliance with legislative normative requirements, in particular the regulation Zákon č. 247/1995 Sb. o volbách do Parlamentu České republiky which relates to media reporting pre- election. Another part of the thesis is devoted to the framing of media content, which can lead to a departure from informing society about the relevant political issues crucial for political decisiveness. An integral part of the theory is foreign research of a similar vein, which was the basis for the operationalisation and the making of my own research.

Por uma análise cosmopolita da determinação da lei aplicável / For a cosmopolitan approach on choice of law

A presente dissertação versa a teoria geral da determinação da lei aplicável no Direito Internacional Privado, sob a ótica de parâmetros cosmopolitas colhidos em outras ciências humanas, em perspectiva interdisciplinar. Analisam-se vários estudos recentes sobre o cosmopolitismo, bem como suas origens remotas, de modo a propor possíveis relações do tema com o método conflitual do Direito Internacional Privado. No capítulo I, empreende-se estudo histórico, retornando às origens do cosmopolitismo (filosofias grega e romana), passando pelo cosmopolitismo de Kant, no séc. XVIII, para então, finalmente, examinar os cosmopolitismos contemporâneos. Quanto a estes, procede-se à uma taxionomia e se exploram algumas proposições teóricas de especial utilidade para a determinação da lei aplicável. No capítulo II, busca-se transpor o cosmopolitismo do plano das demais ciências humanas para o plano da teoria jurídica em particular. Analisa-se, primeiro, o que implica a ideia de cosmopolitização do direito e, após, a relação entre o cosmopolitismo e o Direito Internacional Privado em específico. Dá-se especial atenção à aplicação da ideia de justiça cosmopolita no contexto da determinação da lei aplicável. No capítulo III, trata-se dos três grandes métodos de determinação da lei aplicável (multilateralismo, unilateralismo e materialismo), em perspectivas histórica e crítica. Conclui-se que a adoção do multilateralismo enquanto estrutura principal de determinação da lei aplicável, flexibilizado pelo princípio da proximidade, atende mais à imparcialidade cosmopolita que os outros dois métodos. No capítulo IV, propõe-se uma visão cosmopolita do princípio da ordem pública, concentrando-se em duas importantes evoluções teóricas mais recentes: as noções de ordem pública de proximidade e de ordem pública verdadeiramente internacional. Procede-se, ademais, a exame crítico da aplicação da exceção da ordem pública, no que se refere à lei aplicável, na jurisprudência brasileira recente. Ao fim do estudo, as principais conclusões são enumeradas. / This dissertation addresses international choice of law, through the lens of cosmopolitan standards collected from other humanities, undertaking an interdisciplinary approach. Many recent studies on cosmopolitanism are examined, as well as its remote origins, so as to propose links between choice of law and cosmopolitanism. In chapter I, a historical study is undertaken, going back to the origins of cosmopolitanism (Greek and Roman philosophers), dealing moreover with Kants cosmopolitanism (18th century) and contemporary cosmopolitanisms. Accordingly, a division into categories is proposed and some theoretical notions of special importance to choice of law are tackled. In chapter II, cosmopolitan concepts are applied to legal theory. First, consequences are drawn from the idea of cosmopolitanizing law. Afterwards, the relation between Conflict of Laws and cosmopolitanism is addressed. The focus is on the application of the idea of cosmopolitan justice to choice of law. In chapter III, the three existing choice of law methods are addressed (multilateralism, unilateralism and substantialism), historically and critically. It is concluded that the adoption of multilateralism as a general framework, flexibilized by the principe de proximité, is a better option in terms of cosmopolitan impartiality than the other two methods. In chapter IV, a cosmopolitan vision of public policy is proposed, focusing upon two important theories recently conceived: the notions of ordre public de proximité and of truly international public policy. Also, a critical address of the recent application of the public policy exception by Brazilian courts (within the choice of law context) is made. At the end, the main conclusions are enumerated.

Formální důkazní břemeno státního zástupce v trestním řízení / Formal Burden of Proof of Public Prosecutor in Criminal Proceedings

The legal concept of formal burden of proof of public prosecutor has been discussed for more than 17 years of legislative work on the new Criminal Procedure Code and an increased attention was also paid to it before by the legal science, at the same time with the enforcement of adversary elements of court proceedings. The legal concept in question was established and developed as part of the Anglo-Saxon type of criminal proceedings where trial is based on a dispute between the parties. This involves the exclusive procedural responsibility of public prosecutor to clarify the facts relevant to the indictment filed. Although it is possible to give a brief description of the legal concept in question in a single sentence, its enactment would affect the overall nature of the proceedings before the court and would also be reflected in other stages of the criminal proceedings. The aim of the dissertation was to analyse the prerequisites and consequences of the enactment of the formal burden of proof of public prosecutor in the Czech criminal proceedings. Given the origin of the legal concept, the crucial question was whether its adoption would necessarily constitute a total departure from the legal principles which the existing Criminal Procedure Code is based on or whether it is possible and appropriate...

Stakeholders' perceptions on the management of the 2011 electoral processes in the Democratic Republic of Congo

This study investigated the perceptions of election stakeholders with regard to the management of the 2011 electoral processes in the Democratic Republic of Congo (DRC). The involvement of civil society organizations, electoral experts and academia, including party agents as domestic observers and stakeholders in Congolese electoral processes, is crucial as they help electoral and participatory democracy to take root in the DRC. This study was underpinned by political trust, political support and neopatrimonial theories. Furthermore, a mixed methods research design was used in order to understand the perceptions of stakeholders on the management of the 2011 electoral processes in the DRC. The findings of the study showed that stakeholders‟ perceptions on the management of the 2011 electoral processes in the DRC were driven by both internal and external factors pertaining to the Independent National Electoral Commission (INEC) that have the potential to affect the electoral processes as well as the level of trust in the INEC and other institutions involved in the electoral processes. / Political Sciences / M.A. (Politics)

Syftet med vår undersökning har varit att, genom intervjuer med brottmålsadvokater, undersöka hur kvinnliga och manliga gärningspersoner framställs inom domstolsväsendet, samt hur detta kan förstås utifrån ett genusperspektiv som visar hur sociala konstruktioner bildas, reproduceras och cementeras utifrån kön och förväntade egenskaper vi tillskriver de olika könen. Vår undersökning är kvalitativ då vi för att besvara vårt syfte samt våra frågeställningar har genomfört semistrukturerade intervjuer med ett antal olika brottmålsadvokater som inom sin profession försvarar både kvinnliga och manliga förövare som står åtalade för brott av skiftande allvarlighetsgrad. Som bakgrund till analyserna av empirin har vi använt oss av teoretiska ramar som genus och könsroller samt stereotypisering vilket handlar om den kognitiva snedvridning som kan ske i bedömningen av gärningspersonernas brottslighet. Ett viktigt resultat i studien har visat att det i vissa fall förekommer skillnader i framställningen mellan kvinnliga och manliga gärningspersoner, samt att rättssäkerheten och den lagstadgade objektiviteten genom detta är hotad. / The purpose of this study has been to examine how female and male offenders are represented in the domain of justice substantialised through the Swedish court and legal system. Through interviews with a number of trial lawyers we are aiming for an understanding of these representations related to a gender studies perspective that shows how norms and stereotypes are reproduced and maintained on the basis of sex, gender and expected qualities and capabilities. This study raises questions about objectivity, impartial judgements and in the end justice. We are also trying to illustrate female offenders and how they are perceived in the Swedish court and legal system. Our study is qualitative and to answer our issues we have gone through semi structured interviews with trial lawyers that through their profession has defended both female and male offenders. Our scientific background and theoretical framework is gender and sex studies together with stereotypes and doing stereotypes which is a type of cognitive bias; a subject that we are also presenting. One of the most important results of this study is that there is a difference in how female offenders are represented compared to how male offenders are represented in the Swedish court and law system. Through this result we can see that the statutory objectivity is threatened.

Le Tribunal pénal international pour l'ex-Yougoslavie (TPIY) et les exigences systémiques d'équité: la confrontation d'une juridiction internationale aux standards du procès équitable établis par la Cour européenne des droits de l'Homme (CEDH)

Le Conseil de sécurité de l'ONU, par sa Résolution 827, institue le 25 mai 1993, un tribunal pénal international (TPIY) ayant pour but du juger les personnes présumées responsables de violations graves du droit international humanitaire commises sur le territoire de l'ex-Yougoslavie depuis 1991. Ainsi, près de cinquante ans après le procès de Nuremberg, des personnes physiques sont à nouveau poursuivies devant une juridiction pénale internationale. Toutefois, depuis ce procès mémorable l'ordre juridique international a beaucoup changé; le TPIY ne ressemble pas au Tribunal militaire de Nuremberg et les conventions relatives aux droits de l'Homme reconnaissent maintenant un droit fondamental à un procès équitable de tout accusé. Notre étude porte sur l'un des aspects du droit à un procès équitable qualifié d'équité systémique et qui comprend le droit d'être jugé par un tribunal établi par la loi, qui soit compétent, indépendant et impartial. Nous analysons les caractéristiques du TPIY à la lumière du droit comparé et plus particulièrement en examinant si cette institution judiciaire internationale répond aux exigences du principe de l'équité systémique tel que défini à l'article 6 de la Convention européenne des droits de l'Homme (CEDH) et tel qu'interprété par la jurisprudence d'une institution judiciaire supranationale, la Cour européenne des droits de l'Homme. Les conclusions de notre étude sont que le TPIY satisfait en partie aux exigences de l'équité systémique; son indépendance et son impartialité sont sujettes à caution selon les paramètres du standard de la CEDH. / On May 25th 1993, the UN Security Council, by its Resolution 827, established an international criminal tribunal (ICTY) for the purpose of prosecuting persons responsible for serious violations of international humanitarian law committed on the territory of the former Yugoslavia since 1991. Thus, nearly fifty years after the Nuremberg trial, individuals are once again being prosecuted before an international criminal tribunal. However, the international legal order has changed a great deal since this memorable trial: the ICTY is not a carbon copy of the Nuremberg Military Tribunal and the international conventions on Human Rights have recognized to every accused a fundamental right to a fair trial. This thesis analyzes one aspect of the right to a fair trial - the systemic fairness requirement - which encompasses the right to be tried by a competent, independent and impartial court that is established by law. The study of the characteristics of the ICTY is done with a comparative law perspective. More particularly, this work is answering the fol1owing question: is this international judicial tribunal meeting the requirements of systemic fairness as set forth in section 6(1) of the European Convention on Human Rights (ECHR) and developed in the jurisprudence of the European Court of Human Rights? It concludes that the ICTY fulfils these requirements only in part; its independence and impartiality are much dubious with respect to the ECHR standard. / 2002-10

La réception du concept d'indépendance de la magistrature à Madagascar

Il est connu que ceux qui ne s’informent pas sur leur passé seront toujours condamnés à répéter les mêmes erreurs et pour déterminer où aller il faut d’abord savoir d’où on vient . La thèse se penche sur l’analyse de plus de deux siècles d’histoire de l’appareil judiciaire malgache à la lumière du concept d’indépendance de la magistrature. L’auteur porte une analyse rétrospective sur une assez longue période qui s’étend de la fin du XVIIIème siècle à nos jours au cours de laquelle il essaie de comprendre l’ensemble des situations ayant prévalu dans le pays témoin, avant, pendant et après la colonisation française. Cette thèse tente d’apporter des argumentaires nouveaux et une méthodologie d’approche nouvelle dans l’analyse de l’appareil judiciaire d’un pays anciennement colonisé. Il s’agit de mettre de côté certaines idées reçues sur les situations des systèmes juridiques des pays anciennement colonisés, notamment malgache et africains. L’étude remet en cause quelques préjugés d’antan qui marquent encore les esprits relativement aux situations précoloniales, à l’arrivée des modèles juridiques occidentaux et plus particulièrement au concept d’indépendance de la magistrature et sa consistance actuelle dans les anciennes colonies, à l’instar de la Grande Île. A travers l'étude du cas particulier de Madagascar, la thèse apporte des réponses à plusieurs questions suscitées par l’acculturation du système juridique des anciennes colonies à partir de leur contact avec les modèles juridiques occidentaux. La question spécifique de recherche consiste à déterminer si le concept d’indépendance de la magistrature est déjà entré dans le système juridique des pays anciennement colonisés comme Madagascar. Pour l’auteur, le concept d’indépendance de la magistrature tel que compris en Occident n’a jamais fait son véritable entrée à Madagascar. Le cadre théorique adopté pour la vérification de l’hypothèse combine le positivisme juridique avec les approches anthropologique et sociologique et se distingue des recherches presque exclusivement positivistes antérieures. Dans la première partie, l’auteur propose le cadre théorique de recherche et rapporte les modes de règlements des conflits à l’époque précoloniale. L’analyse anthropologique de la période a démontré que le concept d’indépendance de la magistrature fut inconnu des traditions judiciaires précoloniales même si une certaine influence occidentale imprégnait le processus de métissage spontanée diligenté par les souverains successifs. Dans la seconde partie, l’auteur livre une analyse de la période coloniale et postcoloniale jusqu’à l’époque contemporaine. Pour la période coloniale, l’ouvrage relate, d’une part, les multiples mesures prises durant les années coloniales, qui éloignèrent le modèle juridique colonial implanté à Madagascar du modèle juridique français original de la métropole. D’autre part, il mesure les impacts de l’instauration du modèle colonial sur les traditions juridiques malgaches précoloniales. Contrairement aux idées reçues, le modèle juridique français et tous ses concepts clés, notamment le concept de séparation des pouvoirs et celui d’indépendance de la magistrature ne furent pas transmis à Madagascar par le fait de la conquête. Ensuite, il a survolé la magistrature des trois républiques successives depuis l’indépendance acquise en 1960. En premier lieu, par une analyse résolument positiviste l’auteur analyse les imperfections initiales des choix et des mesures prises lors de la mise en place du nouveau système juridique de la jeune république durant les premières années de l’indépendance et dont la magistrature malgache est encore tributaire aujourd’hui. En second lieu, par une démarche à la fois positiviste et sociologique, il démontre que les valeurs du concept d’indépendance de la magistrature, reconnues par le système politique et timidement repris par le système juridique, n’ont pas réussi jusqu’ici à pénétrer le cœur de ce dernier / It is well known that those who are unaware of their past will be condemned to repeat the same mistakes in the future and that in order to determine where one should go, it is necessary to know where one comes from. This thesis analyses three hundred years of Malagasy judicial institutions in the light of the concept of independence of the Judiciary; it proposes a retrospective regard on the period extending from the end of the XVIIIth century until now in which the author proposes a reading of all the situations which have occurred in Madagascar before, during and after the French colonization period. Throughout this thesis, the author proposes new approaches as well as a methodology in analysing the judicial institutions of a country formerly colonized. He proposes to set aside certain ideas concerning the situation of formerly colonized countries, notably, Madagascar and, generally, African countries. This research challenges preconceived ideas which are still carried around by many African and Western researchers trained in the West relating to the pre-colonial situations as well as to the importation of Western legal models and their actual survival in former colonies such as Madagascar. From the particular case of Madagascar, the thesis answers many of the questions raised by the acculturation of the legal systems of former colonies after their encounter with Western legal models. The thesis’ central question seeks to determine whether the concept of the independence of the Judiciary is already present in the legal system of formerly colonized countries such as Madagascar. This thesis shows that the Western concept of the independence of the Judiciary has never really penetrated the legal system of Madagascar. The thesis’ theoretical framework combines legal positivism with sociological and anthropological approaches and it differs from the traditional positivistic analysis common to previous researches. In the first part of the thesis, the author proposes a theoretical framework and analyses the dispute resolution mechanisms during the pre-colonial era. The anthropological analysis of this period shows that the concept of the independence of the Judiciary was ignored by the pre-colonial judicial traditions even if a certain Western influence already existed which influenced the process of spontaneous mixing brought forward by the various Kings. In the second part, the author analyses the colonial and post-colonial periods until now. For the colonial era, the study demonstrates on the one hand that numerous measures put forward did distance the legal colonial model implemented in Madagascar from that of the metropolis and, on the other hand, the impacts of the implementation of the colonial model over the precolonized Malagasy legal traditions. Contrary to well received ideas, the author demonstrates that the French legal model and its key concepts, particularly the separation of powers and the independence of the Judiciary, were never transmitted to the colony after the conquest. A description of the judiciary under the three successive republics since 1960 then follows. Through a positivistic analysis, the author analyses the imperfect initial choices made during the initial years of the implementation of the new legal system of the young republic as well as their contemporary impact over the Malagasy Judiciary even today. Through a positivistic as well as sociological approach, the author shows that the values underlying the concept of the independence of the Judiciary recognized by the political system and timidly integrated by the legal system have not succeeded in being fully implemented so far

Revisorers strategi för att upprätthålla sitt oberoende.

Ett flertal redovisningsskandaler har ägt rum världen över där revisorer varit inblandade, vilket gjort att revisionskvaliteten ifrågasatts och framförallt revisorernas oberoende. Tidigare studier rapporterar om faktorer som kan påverka oberoendet där gåvor, social identitet, professionalism, relationer, påtryckningar, rykte och ekonomi har visat sig kunna påverka revisorernas agerande. Syftet med denna studie var att förklara hur revisorer strategiskt agerar för att upprätthålla sitt oberoende mot sina klienter, samt att förklara skillnader i agerandet utifrån professionens perspektiv. Tidigare studier visar att det föreligger skillnader kring människors handlingssätt beroende på kön, ålder, erfarenhet, vilken ort man är verksam i samt vilken byrå man arbetar för. Denna studie utfördes genom en tvåmetodsundersökning där vi med hjälp av intervjuer skapade oss en överblick över professionens syn på oberoendet, vilket senare lade grunden för utformningen av studiens enkät som resulterade i 317 fullständiga svar. Genom en korrelationsanalys och en multivariat regressionsanalys undersökte vi om det förelåg samband mellan de oberoende variablerna kön, ålder, storlek på ort, storlek på byrå, erfarenhet och de beroende variablerna gåvor, social identitet, professionalism, relationer, påtryckningar, rykte och ekonomi. Fyra av studiens hypoteser fick stöd, däribland att manliga revisorer är mer benägna till närmare relationer till sina klienter i jämförelse med kvinnliga revisorer. Vidare fann vi även stöd för att revisorer på mindre orter är mer benägna till närmare relationer till sina klienter i jämförelse med revisorer i storstäder. Vi fann även stöd för att yngre revisorer i högre grad beaktar sitt rykte i jämförelse med äldre revisorer. Slutligen fann vi även stöd för att manliga revisorer i högre grad beaktar klienters ekonomiska betydelse i jämförelse med kvinnliga revisorer. Utöver de hypoteser som testades fann vi ytterligare samband av intresse att analysera, däribland ett signifikant negativt samband mellan ålder och revisorers benägenhet att ta emot gåvor och acceptera närmare relationer. Vidare noterades att manliga revisorer i högre grad tycks beakta sitt rykte i jämförelse med kvinnliga revisorer. Revisorns ålder ocherfarenhet visar även ett negativt signifikant samband med revisorers benägenhet att beakta klientens ekonomiska betydelse. Slutsatsen är att revisorer tycks följa olika strategier för att bemöta faktorer som kan påverka oberoendet och att det föreligger vissa skillnader i agerandet beroende på revisorns erfarenhet, ålder och kön samt storleken på den ort revisorn är verksam  i. / Several accounting scandals have taken place around the world where auditors have been involved, which means that the audit quality is questioned and especially the auditors’ independence. Previous studies report on factors that may affect the independence, where gifts, social identity, professionalism, relationships, pressure, reputation and economy are factors that have been shown to affect the auditor’s actions. The purpose of this study is to explainhow auditors act strategically to maintain independence with their clients, as well as to explain differences in action based on the professional perspective. Previous studies shown that there is behavioral differences regarding gender, age, experience, the city you operate in and which firm you work for. This study was conducted through a two-method study in which we, with the help of interviews, were able to create an understanding of the auditor’s  independence from the profession’s perspective. The interviews contributed to the creation of the study’s survey which had a sample of 317 responses. Through a correlation analysis and a multivariate regression analysis we examined whether there is a correlation between the independent variables gender, age, the size of city, the size of firm, experience and the dependent variables gifts, social identity, professionalism, relationships, pressure, reputation and economy. In our study four of the hypotheses received support, including that male auditors are more likely to have closer relationships with their clients compared to female auditors. Furthermore, we also found support for the fact that auditors in smaller cities are more likely to have closer relationships with their clients compared to auditors in larger cities. We also found support for the fact that younger auditors care more about their reputation compared to older auditors. Finally, we also found support for that male auditors are more liable to care about their clients'economic importance compared to female auditors. In addition to the hypotheses that were tested, we found other relationships that were of interest to analyze, including a significant negative relationship between age and auditors' tendency to accept gifts and closer relationships. Furthermore, it is noted that male auditors care more about their reputation compared to female auditors. The auditor's age and experience also shown a negativelysignificant relationship with auditors' tendency to consider the client's economic importance. The conclusion in this study is that auditors seem to follow different strategies to address the various factors that may affect independence, where the study shows that there are differencesin the action depending on the auditor's experience, age and gender and also the size of city the auditor operate in.

La résolution de la crise ivoirienne nécessite l’organisation d’une élection présidentielle inclusive. Sur la base de l’Accord de Pretoria, les Nations Unies vont s’impliquer dans la gestion du processus électoral, conformément à la Résolution 1765(2005) du Conseil de sécurité, instituant le mandat de certification.La certification du processus électoral ivoirien constitue dés lors une activité électorale inédite au cœur de la souveraineté nationale. En effet, la gestion du processus électoral par les organes nationaux et un organe international repose sur une architecture juridique hybride, mélangeant le droit national et le droit international, devant permettre la sauvegarde des résultats de l’élection présidentielle. L’acceptation du mécanisme de la certification par les autorités nationales dans ce processus régalien modifie substantiellement la traditionnelle hiérarchie des normes qui attribue à la Constitution et au Conseil constitutionnel une place privilégiée dans les rapports internes et externes.Ainsi, la mise en œuvre du mandat de la certification enlève toute force obligatoire à la décision du Conseil constitutionnel censée revêtir l’autorité de la chose jugée. Cette situation pousse le Conseil constitutionnel ivoirien à se dédire, et reconnaître la supériorité de la certification sur sa décision. / The resolution of the Ivorian crisis requires the holding of an inclusive presidential election. On the basis of the Pretoria Agreement and in accordance with Security Council Resolution 1765 (2005) establishing the certification mandate, the United Nations throughout the Special Representative of the Secretary-General were involved in the electoral process.The certification of the Ivorian electoral process constitutes an unprecedented electoral activity at the heart of national sovereignty. Indeed, the management of the electoral process by national bodies and an international body built on a hybrid legal framework, including national law and international law, to safe-guard the results of the presidential election. The acceptance of the certification’s mechanism by the national authorities in this stately process modifies substantially the traditional hierarchy of the norms which assigns to the Constitution and the Constitutional Council a privileged place in the internal and external reports.Thus, the implementation of the Special Representative’s mandate deprives all binding force from the Constitutional Council’s decision, which is supposed to have the authority of res judicata. The United Nations certification’ statement grants international legitimacy and credibility to the candidate proclaimed by the Independent Electoral Commission to the detriment of the candidate proclaimed victor by the Constitutional Council. This situation urges the Ivorian Constitutional Council to recant, and recognizes the superiority of certification on its decision.

Levando a imparcialidade a sério: proposta de um modelo interseccional entre direito processual, economia e psicologia

The procedural law systems currently in force in Brazil need to walk in opposite direction to the path they are actually taking in order for it to be minimally guarded, that is, regarding subjective impartiality specifically. These systems have already been feeding the cognitive bias factors of the adjudicative decision-makers and, therefore, feeding a breach of its systemic and unconscious biases. In this sense, the present work proposes a legislative reform, offering a precautionary model of lege ferenda inspired in algorithmic strategies based on the latest findings of a new discipline increasingly thriving in Anglo-Saxon countries, Israel and Western Europe called Behavioral Law and Economics (resulting from a fusion of law, cognitive psychology and behavioral economics). Hence the reason it is a legal enginnering work. Now, assuming that any decision maker is equipped with a bounded rationality (not to be confused with actual irrationality ), these techniques seek to undo or to isolate the effects of the so-called cognitive biases , which are mere shortcuts predictable and therefore, preventable which the human mind develops in order to make decisions from complex information under situations of uncertainty. Thus, the major cognitive illusions which affect the adjudicative decision-makers (representativeness bias, anchoring-and-adjustment bias, confirmation bias and in-group bias) were studied along with the procedural standards better suited to neutralize or eliminate these biases. Nevertheless, the proposed model is open to new discoveries that may occur regarding this matter. However, even in the case of a lege ferenda model, one can from it criticize de lege lata of the Brazilian Positive Law and demonstrate that many of the common biased practices in daily forensic activities could have already been confronted / A imparcialidade, sendo nota essencial à jurisdição, é dentre outras coisas garantia das partes e da própria manutenção da Democracia. No que concerne especificamente à imparcialidade subjetiva, para que seja minimamente resguardada, é preciso que os sistemas de direito processual atualmente vigentes no Brasil caminhem em sentido oposto ao rumo que estão tomando, já que têm alimentado fatores de enviesamento cognitivo dos julgadores e, portanto, uma quebra inconsciente e sistêmica de suas imparcialidades. Nesse sentido, o presente trabalho propõe uma reforma legislativa, oferecendo um modelo precaucional de lege ferenda inspirado em estratégias algorítmicas fundadas nas mais recentes descobertas de uma nova disciplina cada vez mais pujante em países anglo-saxões, Israel e Europa Ocidental chamada Behavioral Law & Economics (resultante de uma fusão entre Direito, Psicologia Cognitiva e Economia Comportamental). Daí por que se trata de um trabalho de engenharia jurídica. Ora, partindo da premissa de que todo e qualquer tomador de decisão é provido de uma racionalidade limitada (que não se confunde propriamente com irracionalidade ), essas técnicas buscam desfazer ou isolar os efeitos dos chamados vieses cognitivos , que nada mais são do que atalhos simplificadores previsíveis e, portanto, evitáveis que a mente humana desenvolve para tomar decisões a partir de informações complexas sob situação de incerteza. Assim sendo, estudar-se-ão as principais ilusões cognitivas que acometem os julgadores (viés de representatividade, viés de ancoragem e ajustamento, viés de confirmação e viés de grupo) e as normas processuais mais adequadas à neutralização, mitigação ou à eliminação desses vieses. Não obstante, o modelo proposto é aberto às novas descobertas que vierem porventura a ocorrer nessa matéria. Todavia, ainda que se trate de um modelo de lege ferenda, a partir dele se podem tecer críticas de lege lata ao direito positivo brasileiro e demonstrar que muitas das práticas enviesantes corriqueiras no dia a dia forense já poderiam estar sendo combatidas
