Exploring Intersectionality, Unravelling Interlocking Oppression: Feminist Non-credit Learning PracticesMcKenzie, Christine 12 September 2011 (has links)
The concepts of intersectionality and interlocking identities came out of needs raised by communities and then academics wrote about it. This dissertation examines these concepts and how these resonate with the ways that feminist educators conceptualize and facilitate non-credit learning processes with women.
This research focuses on 10 differently-located feminist educators and the processes they lead that meet a range of learning goals. Specifically, this research examines the learning practices that these educators used to help women learners gain a consciousness around their identity and issues of power and oppression. I then discuss how these practices resonate with the theoretical frameworks of intersecting and interlocking oppressions.
Anti-oppression, feminist informed research and feminist standpoint theories informed the research approach. The Critical Appreciative Process, which builds on the Appreciative Inquiry (AI) method, was used to explore what is working within feminist non-credit learning processes. In addition, two case studies were elaborated on in order to examine the learning practices that were particularly successful.
The educators reflected on several barriers involved in bringing differently-located women together to explore and address the power dynamics associated with power and oppression. These included the defensiveness, denial and avoidance associated with acknowledging and addressing privilege. The educators also shared effective practices for addressing such barriers. Key practices included creating an environment for difficult conversations, working intergenerationally, using theoretical frameworks to deconstructing interpersonal dynamics occurring in the group and providing tools to draw on everyday experiences and challenge (inappropriate) behaviours. Additionally, specific activities for raising learners’ awareness of their own complex and multiple identities and how these identities are co-constructed through interactions with others were detailed.
This study revealed the limitations of intersectionality and interlocking identities frameworks in praxis, as well as the ways in which an awareness of identity, difference and power creates an entry point for intersectional and interlocking awareness that aids feminist movements. This research makes a contribution to strengthening the praxis of feminist educators facilitating non-credit processes. Within feminist theorizing, this research also makes an important contribution in contextualizing intersectionality and interlocking identities frameworks within a range of feminist non-credit learning practices.

Une femme à risque d’un accouchement prématuré vit un enjeu de santé très éprouvant et stressant ; elle sera souvent hospitalisée pour recevoir des traitements médicaux visant à prolonger la grossesse et améliorer le pronostic du bébé. Dans ce contexte, une consultation avec un néonatalogiste est demandée. Plusieurs associations professionnelles médicales ont émis des lignes directrices sur cette consultation, insistant sur le besoin d’informer les parents au sujet des complications potentielles de la prématurité pour leur enfant. Ces recommandations s’inspirent du point de vue médical, et très peu d’études ont examiné la perspective, les attentes et les besoins des parents à risque d’un accouchement prématuré. Ce projet de thèse a pour objectif de proposer un modèle de relation médecin-patient informé de la perspective maternelle de la consultation anténatale, pour développer une approche clinique répondant à leurs besoins. Afin d’examiner cette problématique de façon complète, un travail constant de va-et-vient a été effectué entre la recension de données empiriques et une réflexion normative bioéthique féministe.
Un projet de recherche empirique a d’abord permis d’explorer les attentes et le vécu de ces femmes. Les participantes espéraient recevoir plus que de l’information sur les complications de la prématurité. Elles souhaitaient que le néonatologiste soit attentif à leur situation particulière et qu’il développe une relation de confiance avec elles, leur permettant d’explorer leurs futurs rôles de mères et les encourageant à formuler leurs propres questions. Le cadre théorique féministe d’autonomie relationnelle a ensuite permis de proposer une approche de soin qui sache répondre aux besoins identifiés par les patientes, tout en adressant des enjeux de pouvoir intrinsèques à la clinique, qui influencent la santé et l’autonomie de ces femmes. Cette approche insiste sur l’importance de la relation de soin en clinique, contrastant avec un modèle encourageant une vision réductrice de l’autonomie, dans laquelle un simple transfert de données scientifiques serait équivalent au respect de la norme médicolégale du consentement éclairé. Ce modèle relationnel propose des actions concrètes et pratiques, encourageant les cliniciens à entrer en relation avec chaque patiente et à considérer l’influence qu’ils exercent sur l’autonomie relationnelle de leurs patientes. / Women at risk of preterm labour experience a highly stressful situation for which they are often hospitalised to receive the medical care required to delay their baby’s birth or to improve his outcome. Professional medical associations have published guidelines encouraging consultations with a neonatologist in these contexts. These emphasize informing parents about prematurity’s potential complications and outcomes. However, they are based on expert medical opinions, and little is known about parents’ perspectives of the antenatal consultation for preterm labour. This thesis proposes to elaborate a clinical model of a physician-patient relationship, grounded in mothers’ experiences and expectations from the antenatal consultation for preterm labour. In order to offer a comprehensive analysis of this clinical and ethical issue, both empirical data and a normative feminist bioethical framework were used. An empirical quantitative research project was first conducted to explore women’s experiences and their expectations regarding the antenatal consultation. Participants hoped to receive more than information from the antenatal consultation for preterm labour. Indeed, they hoped the neonatologist would strive to understand their unique and distinctive situations. They wanted the physician to develop trusting relationships, in which they would be enabled to ask questions important to them and in which many topics could be discussed – such as their roles as mothers of a premature baby. A feminist theory of relational autonomy was then used to examine this data. An approach to care responsive to women’s experiences is suggested, which considers not only their individual needs, but which is also critical of the many power imbalances inherent to the clinical setting that influence patients’ health and autonomy. This approach emphasizes the importance of relationships in the physician-patient encounter; it offers a striking contrast to consultation models that endorse a minimal conception of patient autonomy, in which the simple transfer of medical knowledge and data is believed to uphold the legal doctrine of informed consent. This relational model suggests practical and tangible means for physicians to engage in relationships with their patients and to consider the influence they have on their patients’ relational autonomy.

Cette thèse de caractère pluridisciplinaire traite des progrès de la biologie de la reproduction dans le domaine de l’infertilité face à la Convention internationale des droits de l’enfant (CIDE) des Nation-unies. La première partie montre que, en France, il y a conciliation entre l’intérêt supérieur de l’enfant et l’assistance médicale à la procréation, encadrée par le triptyque des lois de bioéthique de 1994. La deuxième partie traite des dérives de ces techniques pratiquées à des fins sociétales et non médicales. Des parents intentionnels désireux d’un « enfant à tout prix », puisque la loi n° 2013-404 du 17 mai 2013 ouvrant le mariage aux couples de même sexe n’a pas « ouvert » le droit à l’accès de ces techniques de reproduction assistée, se rendent au cours d’un « tourisme procréatif » dans un pays où la maternité de substitution ou gestation pour autrui (GPA) est licite et ont un enfant grâce à une mère de substitution, qui assure la gestation de l’embryon, puis du foetus via une fécondation in vitro. Mais lors du retour en France de l’enfant, eu égard aux articles 16-7 et 16-9 du code civil, se pose le problème de la filiation de l’enfant sans compter sur les risques de la maternité de substitution, d’où l’incompatibilité des techniques de reproduction assistée à des fins sociétales avec la Convention internationale des droits de l’enfant, l’adage latin "mater semper certa est" étant la garantie de l’intérêt supérieur de l’enfant. / This thesis has a plurisdisciplinary approach and deals with the improvements of biology of reproduction in the field of infertility regarding the International Convention on the Rights of the Child of the United Nations (ICRCUN). The first part shows, that in France, there is conciliation between the best interests of the child and the medical assistance to procreation, legalised by the triptych of the bioethics law of 1994. The second part deals with the drifts of those practices used for societal ends and not medical. Intended parents willing to have “a child at all costs”, as the law n° 2013-404 of May 17, 2013 allowing the marriage to couples of the same sex has not “allowed” the right to have access to thoses technics of assisted reproduction, do “procreative tourism” and go to a country in which the surrogate maternity or gestational surrogacy (GS) is legal and have a child thanks to surrogate mother who ensures the gestation of the embryo, and the foetus through an in vitro fertilization (IVF). However, back to France, according to articles 16-7 and 16-9 of the Civil Code, the issue of the filiation of the child arises, without counting on the risks of the surrogate maternity, hence the incompatibility of the methods of assisted reproduction to societal purposes with the International on Rights of the child, the Latin proverb "mater semper certa est" being the guarantee of the best interest of the child.

Taking into account that the depth of an experience derives from its singularity, the present dissertation looks at this general question by focusing on a specific process: a specialized ensemble rehearsing and recording a 16th century song. A close reading of this process makes it clear that there is inherent value in observing musicians in the year 2014 engaged in repeat performances of “Suzanne un jour” by Didier Lupi. This observation clarifies how a musical performance is created and developed and reveals the modalities of the collective and individual experiences involved. Moreover, this detail-oriented and singularist epistemology is useful in other respects, whether to comprehend a five-week recording project or to write a five-century history of “Suzanne.”

CHILD WELFARE: TRAUMA INFORMED PRACTICE AT TIME OF CHILD REMOVALGarcia, Ester 01 June 2019 (has links)
As of 2018, approximately 442,995 children are in the foster care system in the United States according to the federal statistics from the Children’s Bureau. Entry into the foster system involves the removal of children from their home, making it a traumatic experience. The purpose of this study was to examine social workers’ perceptions of what trauma informed practice means and what it looks like in child welfare removals. The study also clarifies what trauma informed practice (TIP) is and how it can be applied in child welfare’s organizational structure. This was a qualitative study in which child welfare social workers from southern California agencies were interviewed. Interviews with experienced child welfare workers revealed many themes including the complexities of workers’ experiences during removals, the impact of removals on workers, social workers’ perceptions on TIP and suggestions on how to make removals more trauma informed for children. The findings from this project identified ways trauma may be minimized during detainment procedures in child welfare. All participants voiced that they felt the trauma informed removal (TIR) PowerPoint guide was beneficial to their learning and practice and that a training with this guide would be ideal for their agencies. Additionally, the findings shed light on the need for future research on creating a more trauma informed child welfare system and the need for policy implementation and or change.

紐倫堡法典之後,生物醫學研究中人類受試者的處境開始受到關注。為避免受試者遭到濫用,進而保障其權益,國際間陸續頒佈與人體研究受試者保護相關之倫理規範,而各國亦逐步將倫理規範落實為國內法規,作為管制手段。涉及受試者之人體研究倫理規範與法規中,自紐倫堡法典以降,逐步確立以告知後同意以及倫理審查為核心,建立確保受試者自主權之管制機制,作為平衡受試者與研究者兩方在知識與處境上的不平等的關係。
本文以當代生物醫學上告知後同意法則發展,以及人體研究受試者保護之相關行政管制為取徑,首先,考察人體研究所涉及的法律、倫理的爭議,以及相關倫理規範發展。進而探討告知後同意在當代生命倫理與醫療法律之意義、內涵,以及如何實踐於生物醫學人體研究上作為確保受試者自主權之手段及所遭遇之限制。其次,分析並比較美國、荷蘭以及我國受試者保護之法規體系,並進一步討論其特色與優、劣。最後,探討我國人體研究受試者保護法規範之現況與不足,並提出法律修正上的建議。 / Since Nuremberg Code, the biomedical researches involving human subjects, based upon the informed consent and human autonomy, has drawn the increasing public attention. The related normative restrictions as well as legal regulations have been regarded as a significant way to abuse-avoidance and interest-protection on the part of human subjects involved. Thus, it becomes a confirmed tendency that the constitution of normative and legal foundation with a consideration of informed consent and ethico-medical review can ensure the human autonomy and strike a balance between the researchers and human subjects.
In this thesis, we focus on the development of informed consent and the related normative/legal regulations. Several issues which we will deal with can list as follows: firstly, the trajectory and its legal/ethical controversies, with which the biomedical researches involving human subjects develop and revolve, will be clarified, so as to investigate the ethical/legal implications of informed consent and human autonomy. Secondly, by making a comparison of legal regulations among the United States, Holland and Taiwan, we will illustrate the advantages and drawbacks that different legal systems have on the biomedical researches involving human subjects. At the last part of this thesis, several possible suggestions will be provided to the future legislation on the biomedical researches involving human subjects.

Platonic Craft and Medical Ethics examines the Platonic theory of craft and shows its application to different ethical problems in medicine, both ancient and modern. I begin by elucidating the Platonic use of the term “craft” or “technē”, using especially the paradigmatic craft of medicine, and explicate a number of important principles inherent in his use of the term. I then show how Plato’s framework of crafts can be applied to two ancient debates. First, I show how Plato’s understanding of crafts is used in discussing the definition of medicine, and how he deals with the issue of “bivalence”, that medicine seems to be capable of generating disease as well as curing it. I follow this discussion into Aristotle, who, though he has a different interpretation of bivalence, has a solution in many ways similar to Plato’s. Second, I discuss the relevance of knowledge to persuasion and freedom. Rhetors like Gorgias challenge the traditional connections of persuasion to freedom and force to slavery by characterizing persuasion as a type of force. Plato addresses this be dividing persuasion between sorcerous and didactic persuasion, and sets knowledge as the new criterion for freedom. Finally, I discuss three modern issues in medical ethics using a Platonic understanding of crafts: paternalism, conclusions in meta-analyses and therapeutic misconceptions in research ethics. In discussing paternalism, I argue that tools with multiple excellences, like the body, should not be evaluated independently of the uses to which the patient intends to put them. In discussing meta-analyses, I show how the division of crafts into goal-oriented and causal parts in the Phaedrus exposes the confusion inherent in saying that practical conclusions can follow directly from statistical results. Finally, I argue that authors like Franklin G. Miller and Howard Brody fail to recognize the hierarchical relationship between medical research and medicine when they argue that medical research ethics should be autonomous from medical ethics per se.

《原住民族基本法》於2005年通過,是台灣原住民族運動努力多年的成果,但是近年來原住民族仍持續面對各種壓迫。在土地權利方面,該法第21條規定政府或私人於原住民族土地進行開發利用時,需事先諮詢當地原住民族之同意或參與(簡稱「同意權」),然而在許多案件中,原住民族主張此條文表達反對時,經常未能得到行政部門正面回應。本研究以日月潭邵族反對向山旅館開發案為例,理解「同意權」如何變成「落空的權利」。
許多文獻討論,將原住民族權利與實踐的落差歸因於「個人權」(individual right)與「集體權」(collective right)兩種概念的差異及行政部門本位主義因素。本研究則想更進一步釐清,又有哪些其他因素也影響原住民族權利的落實? 在這些因素的影響下,「同意權」的規範運作又產生了何種實際效用?
本研究將從「法律多重製圖」之觀點回答上述問題,首先將探究「同意權」概念在國際法、國內法與行政實踐中的規範生產與運作,分析在不同的場域下,場域內的參與者如何對「同意權」進行法律製圖。本文主張,法律生產過程中對權利概念的意義內涵轉換、法律生產與運作場域的邏輯結構,皆影響原住民族權利的實踐。同時,本研究進一步以日月潭邵族的案例,說明原住民族土地權中「自由與事先知情同意原則」或「同意權」規範,理想上是以原住民族的「參與」並實現自決權為目標,但在邵族的案例中,實際運作卻是不斷「排除」原住民族的過程,法律成為排除原住民族權利的合理化機制,更避開各種議題對立面的討論。
權利的落空一方面指權利主張不被理解與正視,更進一步指原住民族社會愈遠離「集體」的過程,因而我們需對原住民族同意權或各種集體權的運作有更多的反省,並持續探詢屬於每個部落或族群中所謂「好生活」(good life)的意義。本文最後藉用「草根後現代主義」(grassroots post-modernism)之概念,介紹原住民族在追求「好生活」的道路上,如何藉著在地思考、找回與族群內部的連結,以此對抗全球化、新自由主義趨勢下對原住民族權利的影響與侷限。 / Though its enactment in 2005 can be regarded as an achievement of Indigenous movement in Taiwan, The Indigenous Peoples Basic Law does not work as it promises. The indigenous people are still struggling for the fulfillment of rights. With respect to land rights, Article 21 of the Law requires the participation and consent of local indigenous people before the development and utilization of the indigenous land. However, the article is often neglected by the government in many cases.
This case study then focuses on Thao people (邵族)who live around Sun-Moon Lake (日月潭)and their opposition to a Hotel program located in Xiangshan(向山), which is regarded as the traditional territory of Thao. By adopting the perspective of “Multi-Layered Mapping of Law”, I hope to analyze the enactment process and the effect of law concerning the principle of Free, Prior and Informed Consent as well as land rights of indigenous people, and try to describe how the “right to consent” becomes a “hollow right” in practice.
The study depicts the right as “hollow” for two meanings. On the one hand, it shows the situation for indigenous people facing the gap between the law’s promise and law’s practice in the complex process of law making and law enforcement. On the other hand, it further describes the more distance from collectiveness within indigenous society. The study suggests that more dialogue and more reflection is needed when claiming rights.
The last part of the study then introduces the idea of “grassroots post-modernism” which discuss the way to “Good Life" and the way of resistance against globalization and neoliberalism. Although the issues need further discussion in future studies, the idea can be a guidance for indigenous people as they pursue the fulfillment of land rights, autonomy and self-determination.
