The dynamics of the evolution process of this population was analyzed considering the density dependence model connected to legitimation and competition. Such factors, as well as size, were tested in statistic models (panel, logit and probit) using the data base developed with the information presented in the Guias da Associação Brasileira de Franquias between 1996 and 2007, to evaluate their impact over the population survival rate. Other relevant factors raised in Evolutionary Economics and Service Market Organization were also discussed. / Este estudo analisou as franquias de serviços avaliando os fatores que influenciam na taxa de sobrevivência dessas empresas sob a ótica da Ecologia Organizacional. A dinâmica da evolução da população de franquias de serviços foi avaliada com base na densidade da população e processos de legitimação e competição. Tais fatores, assim como o tamanho, foram testados em modelos estatísticos (modelo econométrico de painel, logit e probit) utilizando base de dados desenvolvida com base nos Guias da Associação Brasileira de Franquias entre o período de 1996 e 2007, para avaliar seu impacto sobre a taxa de sobrevivência da população. Com base nas teorias de Economia Evolucionária e Organização de Mercado em Serviços outros fatores relevantes para a sobrevivência das franquias de serviço também foram discutidos.

Thesis title: Right to health and legitimate expectations in perspective of the standards and above-standards in Czech health care system This diploma thesis deals with the legal regulation of the right to health as a social right. In the first chapter, the genesis of the social rights, their specific characteristics and the social rights' role in relation to civil and political rights are analysed for the purpose of interpretation of the right to health. The actual problematics of legitimation crisis based on the states' inability to fulfil the obligations and expectations rising from social rights are later discussed. In relation to the socio-legal context, the international legislation as well as some specific national legislation of the right to health are analysed in detail within subsequent chapter. With this regard, the practice of the courts as well as the practice of the quasi-judicial bodies is considered in the following chapter, especially with respect to the right to health and its relation to some civil and political rights. Given the doubtfulness of the legal justification of Crimea’s declaration of independence on March 11 2014, which was followed by a referendum on March 16 that culminated in the peninsula’s treaty with Moscow to join the Russian Federation, Mr Putin used his speech on March 18 to put historical arguments forward in an effort to legitimise the Russian course of action in front of his own population. The speech counters the international community’s legal assessment, which classified Crimea’s accession to Russia as an annexation, with a historical legitimisation full of symbolism and mysticism that blatantly reinterprets Russian history and delegitimises the territorial integrity of Ukraine. This article analyses Putin’s attempt to justify Russia’s annexation of Crimea and tries to infer the mindset and aims that lie behind his historic-political argumentation.

Nästan allt vi gör på internet kräver att vi identifierar oss med e-legitimation. Ändå erbjuds nästan uteslutande bankernas e-legitimation (BankID) via offentliga e-tjänster, trots att BankID inte är något alla har möjlighet att få. Det innebär att människor som inte kan, eller vill, vara bankkunder utesluts från vårt digitala välfärdssamhälle och hindras från att använda e-tjänster de har rätt att använda. Problematiken tydliggjordes ytterligare under coronapandemin, inte minst i vaccinationskaoset som uppstod i början, eftersom BankID krävdes i flera regioner för att kunna boka tid för vaccination. Huvudsyftet med denna kandidatuppsats i Informatik är att identifiera och förklara kommunala och nationella faktorer som bidrar till digital inkludering vid användning av e-legitimationer via kommunala förvaltningars e-tjänster. Bisyftet är att jämföra två DIGG-godkända e-legitimationer för att identifiera och beskriva vilka skillnader det finns som påverkar medborgarnas möjligheter att skaffa e-legitimation. I studien har fallstudiemetoden tillämpats och en litteraturstudie har genomförts för att inhämta kunskaper och erfarenheter från tidigare forskningsstudier. Primära empiriska data har samlats in genom intervjuer via Zoom. Fem olika rollinnehavare har intervjuats beträffande deras erfarenheter och uppfattningar om faktorer som påverkar medborgares möjligheter att använda kommunala e-tjänster med e-legitimation som identifieringsmetod. De viktigaste slutsatserna från studiens analys är: att erbjuda samtliga DIGG-godkända e-legitimationer via de kommunala e-tjänsterna främjar digital inkludering, det beror på att tröskeln för människor att skaffa en e-legitimation minskar. Utan faktorn nationell styrning är sålunda kommunal styrning och kommundirektörens kunskap och prioritering av digitaliseringsfrågan av högre betydelse, speciellt om faktorn medarbetarnas inställning och kunskap inte är särskilt hög. Både nationell och kommunal styrning behövs för att e-förvaltningen ska kunna hålla en likvärdig standard oavsett ekonomiska eller personella förutsättningar. I dagsläget finns bara en DIGG-godkänd e-legitimation som aktivt arbetar för alla människors rätt att få tillgång till en e-legitimation.

Machtbegrenzungsmechanismen in Internationalen Organisationen / am Beispiel der Vereinten Nationen und der Welthandelsorganisation

Der Einfluss Internationaler Organisationen reicht angesichts der Herausforderung, für globale Probleme Lösungen zu finden, mittlerweile so weit, dass sich die Frage nach den in ihnen vorhandenen Machtbegrenzungsmechanismen stellt. Doch wie kann die Macht Internationaler Organisationen kontrolliert werden, wenn das aus dem nationalen Verfassungsrecht bekannte Gewaltenteilungsprinzip nicht auf die internationale Ebene übertragen werden kann?   Die Arbeit analysiert die dazu innerhalb der Vereinten Nationen (UNO) und der Welthandelsorganisation (WTO) existierenden formalisierten Mechanismen anhand ihrer Gründungsverträge. Dabei werden drei Kategorien von Machtbegrenzungsmechanismen identifiziert: Kompetenzzuweisungen und -abgrenzungen, organinterne Mechanismen und schließlich Interaktion zwischen den Organen. Die in der Praxis bedeutsamsten Mechanismen stellen zum einen das Vetorecht im UN-Sicherheitsrat sowie der negative Konsens im Streitbeilegungsgremium der WTO dar, die zur Gruppe der organinternen Mechanismen gehören. Zum anderen besteht in der Kontrolle der Streitbeilegungs-Panel der WTO durch den Appellate Body eine wichtige Machtbegrenzung durch Interaktion.  Die Untersuchung dokumentiert das paradoxe Phänomen, dass die Mechanismen zur Begrenzung der Macht in vielen Fällen auch eine machtsteigernde Wirkung haben, indem sie die Effizienz, Akzeptanz und Legitimation der Organisation erhöhen. Die Verfasserin erklärt dies damit, dass das Augenmerk der Gründungsstaaten in der Entstehungsphase auf dem Funktionieren der Organisation als Gegengewicht zu ihren jeweiligen Mitgliedsstaaten lag. Dass Internationale Organisationen in der Zwischenzeit so stark an Einfluss gewonnen haben, dass ihre Macht nunmehr begrenzt werden sollte, ist eine neue Entwicklung, die jedoch in Zukunft deutlich an Bedeutung gewinnen wird. / In light of the challenge to find answers to global problems, the influence of international organizations nowadays goes so far that the question of existing checks and balances within these organizations arises. But how can power be controlled when the principle of separation of powers originating from national constitutional law cannot be transferred to the international stage? The purpose of this thesis is to analyze existing formalized internal mechanisms within the United Nations and the World Trade Organization on the basis of their founding treaties. The author identifies three categories of checks and balances: allowing and limiting competencies, mechanisms within the organs and finally interactions between the organs. In practice, the most important mechanisms of these organizations are on the one hand the power of veto within the UN Security Council and the negative consensus within the WTO dispute settlement body, which belong to the category of mechanisms within the organs. In addition, the control of the WTO dispute settlement panels by the Appellate Body is an important form of checks and balances through interaction. The analysis shows the paradoxical phenomenon, that checks and balances in many cases have the effect of increasing power by augmenting the efficiency, acceptance and legitimacy of the organization. The author explains this by reference to the intentions of the founding states during the developing phase to strengthen these organizations as a counterbalance to their respective member states. It is a new development that international organizations have now increased their influence so much that their power should be limited, but this will become significantly more important in the future.

"Dåligt och onödigt av public service" : En textanalytisk studie av svärande och språkliga normkonflikter i public service / "It's bad and unnecessary of public service" : A textual analysis of swearing and language norm conflicts displayed in public service

The aim of this study is to analyse and categorise reports of swearing in public service media for the past ten years, as well as analysing the approach taken to the private persons making the reports and the reports themselves by the governing body Granskningsnämnden. Additionally, the language norm conflicts displayed were analysed. The methods used to accomplish this included directed content analysis of the reports and their context, and analysis of interpersonal communication as well as legitimation analysis of the written response provided by the authority. In total, 46 reports and two versions of the response letter were analysed. Finally, the language attitudes and associated norms of both sides were analysed and compared to distinguish conflicts. The results indicate that the private persons who report swearing have different expectations of public service than the media company or the governing body has, which is the cause of the language norm conflicts. The results also indicate that the presence of swearing in a public service media context appears more offensive that the swearing itself, as most of the swear words were not defined. Further, the analysis of the approach taken to the private persons making the reports indicates an authoritarian stance and an impersonal, distanced approach.

«L’émergence des grandes puissances : pouvoir symbolique et nouveau rôle de la Chine dans le monde après la Guerre froide»

L’émergence de la Chine dans le système international post-guerre froide pose un défi pour la position hégémonique des États-Unis et l’ordre mondial libéral. Lorsqu’ils tentent d’expliquer ce défi, les spécialistes tendent à se concentrer uniquement soit sur le hard power chinois (en particulier, sa puissance militaire) soit sur son soft power (l’attrait de sa culture et idéologie). Cette thèse développe un cadre d’analyse alternatif inspiré de la sociologie de Pierre Bourdieu, articulé autour de la notion de pouvoir symbolique. Elle conçoit la politique internationale en termes d’une lutte symbolique (entre, par exemple, une orthodoxie et une hétérodoxie) dont l’issue est déterminée par au moins trois facteurs cruciaux : contexte, capital et lieux communs. Ce cadre est appliqué à l’analyse du nouveau rôle de la Chine dans le monde depuis la fin de la guerre froide, lequel est indiscutablement l’un des développements les plus remarquables des relations internationales des temps modernes. La thèse démontre que la Chine ne défie pas l’hégémonie des États-Unis et l’ordre mondial libéral au sens conventionnel de la puissance matérielle ou de l’idéologie, mais plutôt au niveau symbolique. La thèse soutient que la conjonction des trois facteurs susmentionnés a été nécessaire à l’influence mondiale de la Chine : (1) la crise de légitimation des États-Unis (sur les plan économique, politique et idéologique), couplée à l’extraordinaire ascension de nouvelles puissances dans le système international comme la Chine, ont créé un contexte historique favorable ou « condition de possibilité »; (2) l’énorme capital symbolique accumulé par la Chine, en raison non seulement de son nouveau statut de grande puissance, mais aussi de son approche pragmatique des questions nationales et internationales, en a fait une source d’inspiration convoitée mondialement ; (3) la mobilisation stratégique par la Chine de son capital symbolique, sous la forme d’un ensemble de lieux communs ‘rhétoriques’, a grandement contribué à légitimer sa puissance, en particulier aux yeux des élites dirigeantes dans le monde en développement, dissimulant ainsi le caractère asymétrique et arbitraire de ses relations. Ensemble, ces trois éléments –contexte, capital, lieux communs– expliquent le pouvoir symbolique de la Chine, c’est-à-dire la perception selon laquelle, contrairement aux États-Unis, elle propose des réponses pertinentes et cohérentes aux problèmes d’organisation sociale, économique et politique de ce monde. L’ascension de la Chine remet ainsi en question le « méta-capital » des États-Unis, c’est-à-dire son monopole sur la production du capital économique, social, culturel et symbolique. L’accent mis sur cette dimension symbolique de la lutte pour définir et imposer la « vision légitime du monde social et ses divisions » révèle une rupture avec la pratique conventionnelle de la politique des grandes puissances, au profit d’une transformation pacifique du système international et d’une diplomatie symbolique. Cet accent sur le pouvoir symbolique ouvre des avenues prometteuses pour l’étude du changement et des sources d’autorité sur la scène politique mondiale, traditionnellement définie comme « anarchique ». / China’s rise within the international system in the post-Cold War era challenges the hegemonic position of the United States and the Western liberal order. In trying to explain this challenge, scholars tend to either focus on Chinese hard power (in particular, its military power) or on its soft power (the attractiveness of its culture and ideology). This thesis develops an alternative Bourdieu-inspired framework addressing symbolic power. It conceptualizes international politics in terms of a symbolic struggle (such as that between orthodoxy and heterodoxy) whose outcome is determined by at least three crucial factors: context, capital and commonplaces. The framework is applied to the analysis of China’s new world role, which is arguably one of the most remarkable developments in modern international relations. The thesis shows that China does not challenge U.S. hegemonic position and the Western liberal order in the conventional sense of material power or ideology, but rather at the symbolic level. The thesis argues that the combination of the three above-mentioned factors has been necessary to China’s worldwide influence : (1) the legitimation crisis of the United States (economically, politically and ideologically), paired with the extraordinary rise of new illiberal powers on the world scene such as China, created a favourable historical context or “condition of possibility”; (2) the huge amount of symbolic capital accumulated by China, not only because of its new status as a great power, but also because of the success of its pragmatic approach to national and international issues, made it become a source of inspiration for countries across the world; (3) the strategic mobilization by China of its symbolic capital, in the form of ‘rhetorical’ commonplaces, greatly contributed to legitimize its power, especially in the eyes of ruling elites in the developing world, thereby dissimulating the asymmetric and arbitrary nature of the Chinese power and relations. Together, these three components -context, capital, and commonplaces- explain the emergence of China as a symbolic power, i.e. the perception that, unlike the United States, China now has the authority to speak the truth and to define causes of and remedies for certain problems and crises. China’s rise challenges the Unites States’ ‘meta-capital’, that is, its monopoly on the production of economic, social, cultural, and symbolic capital. The focus on this symbolic dimension as a ‘weapon’ in the struggle to define and impose the “legitimate vision of the social world and its divisions” reveals a rupture in the conventional practice of great powers politics, pointing to a peaceful transformation of the international system and symbolic diplomacy. It shows that a focus on symbolic power opens promising avenues for the study of change and sources of authority in world politics, traditionally defined as “anarchic”.

L'action en justice des parties prenantes dans le cadre de la Responsabilité Sociale de l'Entreprise / Stakeholders’ legal action concerning Corporate Social Responsibility

L’action en justice intentée en matière de Responsabilité Sociale de l’Entreprise révèle certaines limites lorsque les justiciables parties prenantes souhaitent protéger leurs intérêts. Par une juridicisation du droit de la RSE à mi-chemin entre la soft law et la hard law, l’action en justice des parties prenantes pourrait être véritablement efficiente. Dès lors, les mécanismes processuels traditionnels sont insuffisants lorsqu’il s’agit d’agir en justice dans ce domaine. C’est notamment à travers l’intérêt et la qualité à agir en justice des parties prenantes que des aménagements de la procédure civile vont être véritablement nécessaires. Des améliorations supplémentaires telles que l’instauration d’une action de groupe élargie au domaine de la RSE et davantage américanisée permettrait notamment aux parties prenantes d’assurer leur défense grâce à un dispositif nouveau très efficace. De plus et par la voie extrajudiciaire des modes alternatifs de règlement des litiges, les acteurs de la RSE peuvent également décider de porter le différend qui les oppose hors de la connaissance du juge étatique. Ce choix d’action peut être révélateur d’une préférence pour une justice davantage négociée. Ces propositions semblent être indispensables à la mise en œuvre d’une action en justice efficace en matière de RSE. Les parties prenantes pourront alors agir en justice de manière inédite afin de parachever leur protection. Les nécessités juridiques et sociales actuelles semblent ainsi faire évoluer le droit afin que les parties prenantes puissent bénéficier d’une action en justice considérée comme un véritable contre-pouvoir face à l’entreprise. / Legal actions brought to court concerning Corporate Social Responsability reveal certain limits when litigants’ stakeholders wish to protect their interests. The Corporate Social Responsability law falls between soft law and hard law. Going through CSR law’s judicalization could really make litigation of stakeholders efficient. Usual processual mechanisms are insufficient once an action has to be brought to court dealing with CSR. The civil procedure will need some changes, specifically relating to legal standing and stakeholder interest. Some added improvement would allow stakeholders to ensure their legal defence thanks to this new and efficient legal device. The setting up of a collective action including a CSR with more resemblance to the American one would represent one such improvement. Moreover, stakeholders can decide to settle the matter out-of-court with an extrajudicial approach, using alternative dispute resolution. This choice could amount to a more negotiated inflection of justice. These proposals seem to be necessary to settle an efficient legal action concerning CSR. In this way stakeholders will be able to litigate in a whole new way in order to consolidate their protection. Current legal and social needs seem to make the law evolve so that stakeholders benefit from a legal action which can be considered as a real countervailing power against a corporation.

The context, purpose, and dissemination of legendary genealogies in northern England and Iceland, c.1120-c.1241

The thesis is a comparative and multidisciplinary study of legendary genealogies in the historical writing of northern England and Iceland c. 1120 – c. 1241. Historical writing was produced in abundance over this period in both areas and the frequent contact between England and Scandinavia, as well as shared use of early medieval insular sources make them especially suitable for comparison. The Viking invasions and settlement in England had a significant impact on English culture, language and literature and changed attitudes to their own legendary past. The Danish conquest of England in the early eleventh-century also brought the insular and Scandinavian worlds closer together, and even after the Norman Conquest in 1066, England and Scandinavia engaged in scholarly and textual exchange The theoretical framework for the thesis combines approaches from religious history, art history, political history, literature history and gender history. The main research questions of the thesis consider the dissemination, development, and purpose of legendary genealogies. The sources are a collection of Durham related manuscripts with illuminations of the pagan god Woden (c. 1120–88) in two historical works De Primo Saxonum Aduentu and De Gestis Regum; Genealogia Regum Anglorum (Rievaulx, 1153x54) by Aelred of Rievaulx; two works attributed to Snorri Sturluson’s Prose Edda (Iceland, 1220s) and Heimskringla (Iceland, 1225x35). Common to the sources is the inclusion of genealogies that stretch from legendary generations to living individuals at the time of writing. Thus, genealogies connected dynasties and civilisations in mutual descent from pagan, Trojan and biblical ancestors. By analysing textual dissemination as well as political contexts, literary patronage and mechanisms in legitimisation of power, the thesis address amalgamations of origin myths, the use and significance euhemerised pagan gods, and female generations in genealogies.

Partant de l’idée que des filiales d’une entreprise sont en mesure de remettre en cause les décisions de la direction générale (maison-mère), l’approche holistique développée dans ce travail part du principe qu’une organisation peut être un « être », laissant entendre ainsi que les informations dont elle dispose seraient extérieures aux individus qui la composent. Ce qui conduit à s'interroger s’il est concevable d’ignorer l’individu dans une telle relation de domination. Cette thèse propose justement un modèle autour de résultats qui montrent la difficile exclusion de l’individu dans un contexte méta-organisationnel (dans lequel les membres seraient des organisations et non des individus). Dans cette veine, ce sont les dynamiques humaines de l’organisation qui sont au cœur de ce travail : il existe par et au travers de l’individu une dynamique issue de l’activité réelle qui permet de faire vivre l’organisation par elle-même, mais également qui permet au prescrit de cette dernière d’évoluer. Bien que les résultats obtenus montrent que l’organisation n’est pas un objet mort et sans force et qu’elle a bien la possibilité de vivre par elle-même, ce sont les individus qui — par leurs engagements conditionnels — permettent cette existence propre de l’organisation comme structure intra-consciente qui impose des droits et des obligations. Dans cette perspective, le modèle proposé vise à dessiner les structures de la réalité sociale abstraite (dénommé dans la recherche menée, l’Entité X) en montrant les forces et les contraintes organisationnelles qui pèsent sur les individus-membres, tout en relevant les capacités humaines à sortir des structures prescrites par la co-construction de liens et de structures transversales de coopérations issus de l’activité réelle. / Based on the idea that the subsidiaries of a company are able to call into question the decisions of senior management (the parent company), the holistic approach developed in this study assumes that an organization can be a “being”, implying thereby that the information in its possession is external to the individuals who compose it. This raises the question of whether it is conceivable to ignore the individual in such a relationship of domination. This thesis proposes a model based on the results which show the difficult exclusion of the individual in a meta-organizational context (in which members would be organizations and not individuals). Along these same lines, the organization’s human dynamics are at the heart of this research: there exists by and through the individual a dynamic resulting from actual activity that allows the organization to live by itself, while also allowing prescribe to evolve. Although the results show that the organization is not a dead and strengthless object, and it has the opportunity to live by itself, it is the individuals who —through their conditional commitments— allow the separate existence of an organizational structure’s intra-consciousness, which imposes rights and obligations. In this perspective, the proposed model aims to draw the structures of abstract social reality (referred as Entity X in this study) by showing the strengths and organizational constraints that weigh on individual members, while raising the human capacity to emerge from the structures prescribed by the sensemaking of links and transversal structures for cooperation that originate from the actual activity.
