O princípio anticorrupção como fundamento da República : uma relação simbiótica entre moralidade política e estrutura normativa / The anticorruption principle as a republic foundation : a symbiotic relationship between political morality and political-legal normative structure

In recent years, a series of events in Brazil, the theme of which has focused on corruption, has provoked the most heated political debates, strongly driven by the media and social networks. In this context, a juridical-political analysis is proposed, within a historical-linguistic context of the philosophical heritage, about an existence of the constitutional principle of anticorruption principle as a component of the essential nucleus of the republican form of government. It begins with the approach of the nexus between fundamental rights and the history of man, to later expose the historical peculiarities of Brazil that led to a culture of disrespect to the public thing. The anticorruption principle debate gained momentum with the promulgation of the 1988 Constitution, where citizens are given the right to a probationary administration. However, it is necessary to go further, when the anticorruption principle emerges as the foundation of the Republic, expanding the need to preserve public interests in situations of non-conventional corruption. In the course, we examine doctrinal positions of national and foreign authors that deal with the approaches that emerged throughout this dissertation. The methodology used was developed especially by qualitative exploratory research, backed by a reflexive and systematic analysis, taking as a background the philosophical hermeneutics. / Nos últimos anos, uma série de acontecimentos relacionados à corrupção no Brasil têm provocado os mais acalorados debates políticos impulsionadas pela imprensa e pelas redes sociais. Nessa conjectura, suscita-se uma análise político-jurídica, dentro do contexto histórico-linguístico da hermenêutica filosófica, sobre a existência do princípio constitucional da anticorrupção como componente do núcleo essencial do republicanismo. Inicia-se o trabalho com a abordagem do nexo entre os direitos fundamentais e a história do homem, para, posteriormente, se expor as peculiaridades históricas do Brasil que conduziram a uma cultura de desrespeito à coisa pública. O debate de combate à corrupção ganhou força com a promulgação da Constituição de 1988, quando é reconhecido ao cidadão o direito constitucional a uma administração proba. Contudo, é preciso ir além. E é desse além que emergirá o princípio anticorrupção como fundamento da República, ampliando a necessidade da preservação dos interesses públicos nas situações de corrupção não convencional. Ao longo desta dissertação foram examinadas posições doutrinárias de autores nacionais e estrangeiros que tratam das abordagens discutidas. A metodologia utilizada foi desenvolvida especialmente pela pesquisa qualitativa exploratória, lastreada em uma análise reflexiva e sistemática, tomando como pano de fundo a hermenêutica filosófica. Ao final, conclui-se que a concretização do princípio anticorrupção se revela como caminho mais eficiente ao atendimento da demanda brasileira, diante do panorama atual, todavia, requer, além de uma estrutura legal, a conscientização do cidadão em assumir o seu papel de ator político responsável, fiscalizador e transformador da sociedade.

Apresenta o regime de distribuição da função legislativa a partir da Constituição Federal de 1998, o sistema jurídico das infrações e sanções administrativas e a diferenciação destas em relação a outros atos derivados do denominado poder de polícia. Em seguida, analisa a recepção pela Constituição Federal de 1988 do modelo normativo trazido pela Lei 4.595/64 e os limites da discricionariedade administrativa para aplicação de infrações e sanções administrativas à luz dos princípios da legalidade e da tipicidade apresentados pela doutrina. / Dissertation on the legal regime of the administrative infractions and penalties imposed by the National Monetary Council and the Central Bank of Brazil in accordance with the rules of the Financial System, especially the Law 4.595/64. Displays the distribution scheme of the legislative function from the Federal Constitution of 1998, the system of legal administrative infractions and penalties and differentiation of these acts in relation to others derived from the so called police powers. It then goes through the reception by the Constitution of 1988 of the normative model issued by Law 4.595/64 and the limits of the administrative authorities discretion for application of administrative infractions and sanctions in the light of the principles of legality and typicality as presented by the doctrine.

Este estudo é dedicado à análise da duração do trabalho dos altos empregados. Para tanto, inicia-se conceituando os termos duração do trabalho, jornada de trabalho e horário de trabalho; e analisando as jornadas especiais de certas categorias profissionais que têm duração do trabalho diferenciada por força de circunstâncias particulares do tipo de atividade. Posteriormente, estuda-se a conceituação de altos empregados, seus elementos identificadores, a distinção entre eles e empregados ocupantes de cargo de confiança. Pesquisam-se o trabalho remoto, com ênfase no trabalho remoto dos altos empregados, e a violação de direitos trabalhistas dos altos empregados. Em seguida, examina-se o controle de constitucionalidade de lei, com destaque para o controle concentrado de constitucionalidade. Analisa-se o artigo 62, inciso II, da Consolidação das Leis do Trabalho à luz do artigo 7º, incisos XIII e XVI, da Constituição da República de 1988. Tais incisos dispõem, respectivamente, sobre o limite da duração do trabalho e as horas extraordinárias. Estudam-se o artigo 6º, caput, da Constituição da República de 1988, que versa sobre o direito ao lazer e à saúde; o artigo 5º, caput, da Constituição da República de 1988 que trata do princípio isonômico e do direito à vida; e, finalmente, o artigo 1º, inciso III, da Carta Constitucional que dispõe sobre o princípio da dignidade da pessoa humana. Chega-se à conclusão da tese com os argumentos finais e o posicionamento de que a limitação da duração do trabalho trata-se de um direito constitucional que objetiva tutelar a vida, a saúde, o lazer, assim como proteger a dignidade dos empregados. A duração do trabalho dos altos empregados, ante os princípios da isonomia, da proibição do retrocesso social e da dignidade da pessoa humana, e ante os direitos constitucionais ao lazer, à vida e à saúde, também sofre limite constitucional. O artigo 62, inciso II, da Consolidação das Leis do Trabalho viola os artigos: 1º, inciso III; 5º, caput; 6º, caput; e 7º, incisos XIII e XVI, da Carta Fundamental, sendo, portanto, inconstitucional. / This study is dedicated to the analysis of hours of work of high employees. Therefore, it starts conceptualizing the terms hours of work, working hours and work schedule; and analyzing the special professional categories that have different duration of work. Then, it analyzes the concept of high employees, their identifying elements, the distinction between them and employees in positions of trust. Moreover, it studies the teleworking, with emphasis on high employees teleworking, and labour rights violation of high employees. It examines the constitutional control. It analyzes the article 62, II, of the Labour Legislation and the article 7, XIII and XVI of the Constitution of the Republic of 1988. Then, it analyses the article 6, caput, of the Constitution of the Republic of 1988, which deals with the right to leisure and health; article 5, caput, of the Constitution of the Republic of 1988, which deals with principle of isonomy (equality of law) and the right to life; and, finally, article 1, III, of the Constitutional, which provides for the principle of human dignity. Reach the conclusion of the thesis with the closing arguments and the position that the hours of work it is a constitutional right which aims to protect life, health, leisure, as well as protect the dignity of employees. The hours of work of high employees also suffers constitutional limit especially against the principle of isonomy, the principle of prohibition of retrogression, the dignity of the human person, and the constitutional rights: leisure, life and health. The article 62, II, of the Labour Legislation, hurts the articles: 1º, III; 5º, caput; 6º, caput; e 7º, XIII e XVI, of the Constitution of the Republic of 1988, and therefore, is unconstitutional.

Var går gränsen? : En internkritisk diskussion om möjligheten att demokratisk rättfärdiga nationalistprincipen, påverkansprincipen och tvångsprincipen

Contemporary democratic states seems to be facing problems regarding who is to be included in demos. Without knowing who is included in the people, it is impossble to know who is to be granted political equality. Whithout political equality, there can be no democracy. This thesis undertakes an internal citique to establish whether the nationalist-principle (represented by David Miller), the all affected interests-principle (represented by Robert E. Goodin) and the coercion-principle (represented by Arash Abizadeh) can be justified on the basis of their own view of political equality. It will be argued that all of the principleas are more or less internally incoherent, meaning that none of the perpesctives of who is to be included in the demos is consistent with political equality. By pointing out these inconsistencies, this paper lays the foundation for a potential further developent of these principles, which could make them more in tune with political equality.

Does Gender Influence the Way People Provide and Receive Politeness? : A Research Study on the Differences or Similarities Between Gender and Linguistic Politeness

This essay examines the relation between gender and adherence to Brown and Levinson's Politeness Principle. Women and men tend to use language for different purposes and for the purpose of achieving various goals. In order to examine this relation, a research study was conducted. Two women and three men were observed discussing subjects given by an interviewer. The collected interview data gathered from the conversation was analyzed and related to the Politeness Principle. Aspects from sociolinguistics, such as theories from gender and language studies, and the Cooperative Principle as proposed by H P Grice, were also considered and formed part of the analysis. The results indicate that there is a small difference between women’s versus men’s adherence to the Politeness Principle. More specifically, women tend to use more aspects of linguistic politeness. However, as the sample group of the research study consisted of only five participants, the limits of the study in terms of the generalizability of the results are recognized and suggestions have been made for further research.

Keiji Nishitani, philosophe de l’École de Kyoto, a développé sa philosophie de la religion en étudiant les sermons allemands de Maître Eckhart à la lumière de la notion du « néant absolu » de Kitarô Nishida. Nishitani applique cette dernière à la « Déité » (Gotheit) exposée dans la prédication d’Eckhart, où il découvre l’idée d’un éveil à la subjectivité originaire dans l’âme humaine. Cet éveil ouvre à l’âme une liberté « en Dieu sans Dieu », accessible à la vraie intelligence religieuse, détachée de tout dualisme. Dans cette perspective, comment pouvons-nous intégrer la métaphysique que Maître Eckhart expose dans ses œuvres latines ? Dans le Commentaire de l’Évangile selon Jean, Eckhart déploie sa vision sur Dieu, Être-Un, « Principe sans principe », et il enseigne à « vivre » l’unité entre « être » et « connaître », en laquelle consiste la béatitude. Notre réflexion s’articule autour de l’idée de « vivre la vie ». Nous essayons d’unifier le détachement dans le « néant de la Déité » selon Nishitani et l’« Être illimité » selon le commentaire biblique, de manière à représenter la pensée eckhartienne comme une synergie de la spéculation métaphysique et de la pratique existentielle pour expérimenter le Transcendant dans notre vie immanente. / Keiji Nishitani, philosopher of the Kyoto School, developed his philosophy of religion, studying the German sermons of Meister Eckhart, in the light of the notion of “absolute nothingness” of Kitarô Nishida. He applies that notion to the “Godhead” (Gotheit) outlined in Eckhart’s preaching, where he discovers the idea of awakening to the elemental subjectivity in human soul. This awakening opens up to the soul a liberty “in Godwithout God”, accessible to the religious intelligence detached from all dualism. In this perspective, how can we integrate the metaphysics exposed by Eckhart in his Latin works ? In the Commentary on the Gospel of John, Eckhart explains his vision of God, Being-One, “Principle without principle”, and he teaches to “live” the unity between “being” and “knowing”, of which the beatitude consists. Our study revolves around the thinking on “live the life”. We try to unify the detachment in the “nothingness of the Godhead” according to Nishitani and the “unlimited Being” according to the biblical commentary, so as to show the Eckhartian thought as a synergy between metaphysic speculation and existential practice to experience the Transcendent in our immanent life.

Today's Credit Market - How to Avoid a House of Cards? : Austrian Full Reserves and the Chicago Plan as Alternatives to the Current Fractional Reserves

Today’s household debt consists for the most part of credit money, and this general phenomenon does not only occur in Sweden. Money in the economy is mostly created by private banks, as much as 97 percent of the money in the United States, while central banks only create a very small share of all money. This is the reason for the oppressed household debt. During this period of high debt in Sweden, the household consumption has also increased in comparison to earlier years. The aim is to study and compare how the money supply in two different full-reserve systems, the Austrian through convertibility and the Chicago plan through quantity control, would reduce the household debt in relation to today’s fractional system. The method used in this study is a time series analysis where data of Sweden’s household debt, savings, money supply; M1 and M3, GDP, assets, currency reserves, gold reserves and interest rates has been collected for the years 2005-2013. These are further examined in three different equations. The data for all the variables was collected from SCB, IMF, Ekonomifakta and the World Data Bank. The first theory that is used in this study is Wicksell’s cumulative process which will explain how the money supply M3 affects household debt in today's fractional reserve system. The second theory is the Austrian Business Cycle Theory which will examine the money supply M1 effect on household debt through full reserves by convertibility control. The third theory is the Friedman rule, where the effect of household debt by money supply M1 will be examined. This rule explains how the Chicago Plan is affecting household debt through a full reserve system by quantity control. In the both systems, fractional reserves and full reserves, the debt will increase in this study. The result shows that with full reserves, the household debt would be backed by savings in comparison to fractional reserves, where household debt would be backed by credit money. Therefore, full reserves would contribute to a healthier economy in contrast to today’s fractional system. Since it would involve a large cost for Sweden to transcend to an Austrian system through convertibility, where price inertia would occur as well, the conclusion of this study is that the Chicago Plan, based on the quantity principle, is to prefer. / Största delen av hushållens skuldsättning består idag av kreditpengar, och detta generella fenomen finns inte bara i Sverige. Pengarna i ekonomin är för det mesta skapade av affärsbankerna, så mycket som 97 procent i USA, medan centralbanken endast skapar en liten del av dessa pengar. Detta är anledningen till de höga hushållsskulderna. Under den här perioden av hög skuldsättning i Sverige så har även hushållens konsumtion ökat i förhållande till tidigare år. Syftet med denna studie är att jämföra hur penningmängden i två olika hundraprocentiga reservsystem, den österrikiska konjunkturcykeln, genom konvertibilitet, och Chicago planen, genom kvantitetskontroll, skulle reducera hushållens skulder i relation till dagens bråkdelsreservsystem. Metoden som används i denna studie är en tidsserieanalys där data från hushållens skulder, sparande, penningmängd; M1 och M3, BNP, tillgångar, guldreserver, valutareserver och repo räntan har samlats in under åren 2005-2013. Dessa variabler är studerade i tre olika ekvationer och all data har samlats in från SCB; IMF, Ekonomifakta och the World Data Bank. Den första teorin som används är Wicksells kumulativa process som beskriver hur penningmängden M3 påverkar hushållens skulder i dagens bråkdelsreservsystem. Den andra teorin är den österrikiska konjunkturcykel teorin och kommer att undersöka penningmängden M1 effekt på hushållens skulder med ett hundraprocentigt reservsystem med konvertibilitetskontroll. Den tredje teorin är Friedmans regel, där effekten på hushållens skulder kommer att bli undersökt med hjälp av penningmängden M1. Denna regel förklarar hur Chicagoplanen påverkar hushållens skulder via ett hundraprocentigt reservsystem med kvantitetskontroll. Hushållens skuldsättning ökade i samtliga regressioner och resultaten visar att med hundraprocentiga reserver så skulle hushållens skulder vara backade med sparande, jämfört med bråkdelsreserver, där hushållens skulder skulle vara backade med krediter. Därför skulle hundraprocentiga reserver bidra till en mer välmående ekonomi. Eftersom det skulle tillkomma höga kostnader att övergå till ett österrikiskt system med konvertibilitet, så är slutsatsen av denna studie att istället implementera Chicagoplanen baserad på kvantitetsprincipen.

Burden Sharing of Climate Change : Should Indonesia Be Held Responsible for Its Deforestation and Transboundary Haze?

The IPCC's report in 2018 projects global warming will increase by 1.5oC in 2030, which makes contribution of each country to control their emissions becomes significant. This study seeks to investigate what entitlement human beings have over the absorptive capacity of the atmosphere as well as the harm it caused by elaborating the Entitlement Theory of Justice, thereto, finding out how the burden of climate change should be distributed according to the Polluter Pays Principle (PPP) and the Equal per Capita Shares Principle (ECSP). Furthermore, this study seeks to investigate Indonesia's part in increasing the burden of climate change and whether Indonesia should be held responsible for its part by comparing data of Indonesia's emissions to some developed countries' emissions. Humanity has a collective ownership over the absorptive capacity of the atmosphere, which implies that every individual has equal share of this absorptive capacity. A violation of this equal share should be compensated. The PPP suggests countries, who has the most cumulative amount of emissions from the past to present, to compensate and bear the climate change burden. While, the ECSP suggests countries, who emit more than their equal share per capita, to bear the climate change burden and reduce their emissions. Indonesia, despites massive amounts of CO2 released by its deforestation and annual haze, contributes insignificant to climate change due to both its cumulative and per capita emissions are considerably low compared to developed countries and even lower than acountry with large population size such as China.

Häktning är ett av de mest ingripande tvångsmedel som staten kan vidta gentemot enenskild person. I kombination med restriktionsanvändning riskerar det att kränka ett flertalav den enskildes grundlagsskyddade rättigheter. Att reglera en häktningslagstiftninginnebär att göra en noggrann avvägning mellan de brottsutredande myndigheternas möjlighetertill en effektiv utredning samt lagföring och den enskildes skydd för grundläggande fri- och rättigheter. Med en så ingripande åtgärd mot en ännu ej dömd person är det av största vikt att ställa höga krav på reglering och tillämpning av tvångsmedlet och dess överensstämmande med grundläggande principer och rättigheter. Senaste årens ökningav häktningstider är således oroande och kräver förändring. Sverige har under flera decennier fått återkommande och omfattande kritik för sin regleringkring häktning. Kritiken har riktat sig mot att det inte finns någon övre tidsgränsför hur länge en person kan sitta häktad, en omfattande restriktionsanvändning samt avsaknaden av effektiva alternativa tvångsmedel till häktning. Till följd av kritiken presenterade regeringen år 2020 ett flertal förslag som syftade till en effektivare häktningsreglering. I min framställning kommer jag ta sikte på möjligheterna att minska de långa häktningstiderna.Flertalet av förslagen har indirekt betydelse för möjligheterna att minska delånga häktningstiderna och det mest omdebatterade förslaget är det om införandet av enövre tidsgräns för hur länge man får sitta häktad.I min slutsats argumenterar jag för att nuvarande utformning och tillämpning av häktningsregleringenkan antas strida mot överordnad rätt och i viss mån vara anledningen tillde långa häktningstiderna. Jag ställer mig positiv till de förslag regeringen presenterar isyfte att förändra nuvarande häktningslagstiftning. Jag tror det finns en stor sannolikhet för att förslagen kommer kunna leda till minskade häktningstider. Samtidigt ställer jag mig tveksam till i vilken utsträckning den maxtidsgräns som presenteras kommer lösasamma problem. Visserligen anser jag att den gräns som presenteras är viktig ur legalitetssynpunkt, men att den inte i tillräcklig utsträckning avhjälper den proportionalitetsproblematik som förekommer. Jag är inte heller övertygad om att häktningstiderna faktiskt kommer minska till följd av införandet av denna gräns. Konsekvenserna av förslagen innebär på det stora hela en minskad användning av häktning, en mindre godtycklig häktningsprocess och minskade häktningstider. Förhoppningen är att förslagen i viss mån kommer underlätta för åklagare och domstol vid beslut om häktning och särskilt bedömningen av huruvida häktningen är proportionerlig eller ej. Jag menar emellertid att mer kan göras för att komma tillrätta med nuvarande häktningsregleringoch långa häktningstider varför ytterligare förslag på förändring kommer presenterasi denna framställning. / Pre-trial detention is one of the most intervening means of coercion that the state authorities can use against an individual. In combination with the use of restrictions there is risk that it will infringe a numerous of the constitutional rights of the individual. To regulatet he law of detention means to balance the interests of the possibilities of the stateauthorities to an efficient investigation and prosecution and the individuals protection oftheir constitutional rights. With such an intervening action against a not yet condemnedperson it is of paramount importance to ensure high demands on the regulation and applicationof the means of coercion and its compatibility with constitutional principles andrights. The increasing times of pre trial detention the last couple of years are therefore agitating and requires a change. Sweden has during several decades received recurrent and extensive criticism regardingits regultation on detention. The critic has been adressed against that there is no upperlimit for how long a person can undergo pre-trial detention, a comprehensive use of restrictions and the lack of efficient alternative means of coercion to pre trial detention.Following the criticism the government 2020 presented a numerous proposals on how to change the legislation in purpose of a more efficient regulation of detention. In my thesis I focus on the possibilities to decrease the long times of detention. Most of the proposalsare of relevance for the possibilities to decrease the long times of detention and the most debated proposal is the one regarding the imposition of an upper limit of how long aperson can remain in continual detention.In my conclusion I argue for that the present regulation and application of detention canbe assumed to infringe superior constitutional law and to a certain extent be the cause of the long times of detention. I remain positive towards the proposals the government present in order to change the current regulation of detention. I think it´s highly likely thatthe proposals can lead to shorter times of detention. At the same time I remain doubtfultowards in what extent the upper time limit that is presented can solve the same problem. Indeed I believe that the presented limit is important in an aspect of legality, but that it´s not enough to remedy the complex problem of proportionality that exists. I´m neitherconvinced that the long times of detention actually are going to decrease as a consequence of the imposition of this limit.The consequences of the proposals can overall lead to reduced use of detention, a less arbitrary detention process and shorter times of detention. Hopefully the proposals canfacilitate for public prosecutors and courts regarding decisions of detention and especiallythe assessment of whether the detention is proportional or not. However, I mean that morecan be done to settle current regulation and long times of detention why further proposals will be presented in this paper.

El presente trabajo tiene por objeto el análisis de los principales problemas jurídicos ventilados en el proceso de contestación de paternidad iniciado por B. Y. G. C. contra A. I. G. G. y S. N. G. L., así como en el proceso iniciado por J. I. C. G. contra la Municipalidad Distrital de Santiago de Surco. En el primer proceso, los problemas están referidos, en primer lugar, a la constitucionalidad del artículo 364° del Código Civil y demás normas que, como ésta, imponen límites al cuestionamiento de la paternidad en el ámbito de la filiación matrimonial; en segundo lugar, a la correcta aplicación del control difuso en estos casos; y, en tercer lugar, al rol que juega el principio del interés superior del niño en la determinación de la filiación. Si bien estos temas han sido abordados por la jurisprudencia nacional, lo cierto es que ésta adolece de una falta de uniformidad en los criterios que son aplicados por los órganos jurisdiccionales del país con relación a ellos. Por eso, con la elaboración del presente trabajo, además de dar respuesta a la problemática planteada por el expediente, el tratar de extraer los principales criterios jurisprudenciales con relación a la identidad filiatoria y verificar qué factores sirven a ella para determinar la preeminencia de la verdad biológica o la verdad socioafectiva para determinar la filiación. Respecto al segundo proceso, se pretende analizar el principio de primacía de la realidad, el principio protector (principio Indubio Pro-Operario, principio de la norma más favorable, principio de la condición de más beneficiosa) y principio de irrenunciabilidad de los derechos laborales, los cuales se encuentra reconocidos y protegidos en nuestro ordenamiento jurídico, a través de la Constitución Política, la doctrina y la jurisprudencia, por lo que se ahondará en los beneficios que se obtienen a partir de estos. Asimismo, se pretende analizar la primacía de la Constitución sobre una norma de menor jerarquía y sobre cualquier documento que no describa la realidad. / Trabajo de suficiencia profesional
