Pax Mafiosa : A Comparative Study of the Camorra and the ‘Ndrangheta’s Transnational Expansions in 1990-2021

In this comparative study the aim is to test the explanatory value and what can be inferred from theory building of criminological rational choice theory and offensive realism on the transnational expansions of organized criminal groups. Two analytical models, based upon the works of Ronald Clarke, Derek B. Cornish and John J. Mearsheimer, will be applied upon the Camorra’s and the ‘Ndrangheta’s transnational expansions. The essay uses a wide scope of sources, from news articles to academic books and papers, in order to provide an accurate description of the two units analyzed. The aim of this essay is achieved by having two research questions. This will in conjunction with the analytical models test the explanatory value of the theories when assessed upon the empirical material collected about the two cases, as well as provide valuable information of how organized criminal groups operate. It is concluded that organized criminal groups act rational and that rational choice theory is relevant when researching organized criminal groups' transnational expansions while the results of offensive realism differed on the two units.

Ingen rök utan eld - en kartläggning av svenska mordbrännare ur ett geografiskt profileringsperspektiv

Syftet med denna uppsats är att utifrån ett uppdrag från Christina Innala vid Örebropolisen undersöka huruvida det går att utläsa beteendemönster hos svenska mordbrännare som kan ligga till grund för vidare geografiska analyser. I uppsatsen kommer vi att se närmre på mordbrännare och geografisk profilering utifrån svenska förhållanden. Materialet som ligger till grund för uppsatsen består av domslut gällande mordbränder och dessa analyseras och kategoriseras. De domslut som i materialet har omfattat seriemordbrännare har analyserats utifrån geografisk profilering med hjälp av mjukvaran GeoProfile. Detta för att undersöka hur brottplatser förhåller sig till fasta punkter för svenska seriemordbrännare.Sammanfattningsvis kan man utifrån vårt material identifiera sex stycken kategorier av mordbrännare. Dessa kategorier stämmer överrens med tidigare forskning. Utifrån våra geografiska profileringar kan man dra slutsatsen att seriemordbrännare tenderar att anlägga sina bränder i anslutning till en eller flera fasta punkter. Den svenska mordbrännaren är alltså inte en irrationell individ som slumpmässigt och oberäkneligt anlägger bränder. Bränderna tenderar ofta att uppstå inom en gärningsmans rutinaktivitetsområde, det vill säga att gärningsmannen vanligtvis begår brott i områden som denne känner till. / As an a assignment from Christina Innala at the police in Örebro, this paper aims to investigate whether it is possible to discern behavioral patterns of Swedish arsonists as a point of departure for further spatial analysis. In this paper geographic profiling based on Swedish conditions will be studied. The material that is the basis for the essay consists of judicial decisions regarding arson and these will be analyzed and categorized. The judicial decisions that in the material has included serial arsonists has been analyzed based on geographic profiling using the software GeoProfile. We want to examine wheatear crime scenes are related to anchor-points for Swedish serial arsonists.In summary, based on our material we were able to identify six categories of arsonists. These categories match those of previous research. Based on our geographic profiling it can be concluded that the serial arsonists tend to set their fires in connection with one or more anchor-points. The Swedish arsonist is not an irrational individual that randomly and unpredictably set fires. Fires tend to occur within a criminals routine activity area, in other words the offender usually commits the offense in areas that is known for him/her.

Den parlamentariska strukturens begränsning på demokratin : En studie om Bosnien och Hercegovinas parlamentariska struktur

The purpose of this study is to analyse the parliamentary structure and tasks of Bosnia and Herzegovina to see the limitations it has on the progress to democracy. By studying the Dayton accords appendix four (the constitution) and article four (the parliamentary assembly). In the analysis two theories was used, historical institutionalism and rational choice theory to help find answers to the purpose. With the thematic analysis method to analyse the material and to find themes in the data these three themes was put together, complex parliamentary structure, discrimination against minorities and the balance of power between the various institutions and actors. The material was some scientific reports and books by a variety of different authors and the Dayton accords. The analysis shows that the parliament structure is structured in a non-democratic way, the function of the structure is to keep and preserve the peace in the region. In conclusion the Dayton accords is the main reason for the structure of parliament and that it was made for peacekeeping, not necessarily to create a democratic state. Why there has not been any reform or change in the structure is because the political elite has it easier to gain their own interest with this structure rather than a democratic structure.

Minimal research has been conducted regarding the connection between white collar crime, cybercrime and the effectiveness of digital forensic tools that can assist in combating this new type of crime. The aim of this study is to understand and examine the role that digital forensic tools play during the investigation of white-collar cybercrimes and to evaluate how effective these tools are when implemented in white-collar cybercrime investigations. By conducting in-depth interviews and using a Rational choice theory driven thematic analysis, the findings of this research have revealed how important adaptability of digital forensic tools is to the emerging cybercrime techniques, together with their integration of existing systems, and the adherence to legal and ethical standards. The findings also noted the challenges that are faced by digital investigators when implementing these digital forensic tools in white-collar crimes investigations and the importance of using updated digital forensic tools and skill developed cybersecurity experts to enhance the outcome of investigations. This study concludes by discussing that it is important for digital forensic tools to be continuously updated and skillfully utilized in the investigation of white-collar cybercrimes and that the significant challenges must be addressed for accurate and more reliable investigative outcomes. Various evaluation methodologies should also be developed as different variations of methodological approaches can improve the standards of research and thus provide frameworks that are more reliable for digital forensic studies and white-collar cybercrime investigations.

Betrügerisches Verhalten bei geschlossenen Fonds: Eine Analyse aus ökonomischer und rechtlicher Perspektive

Betrügerisches Verhalten bei geschlossenen Fonds ist in Deutschland Statistiken zufolge für jährliche Kapitalverluste im mittleren dreistelligen Millionenbereich verantwortlich. Der Gesetzgeber hat sich in der Vergangenheit wiederholt dem Problem angenommen und eine Vielzahl von zivil-, straf- und öffentlich-rechtlichen Maßnahmen zur Verbesserung des Anlegerschutzes auf den Weg gebracht, die mit dem Inkrafttreten des Kapitalanlagegesetzbuchs (KAGB) im Jahr 2013 ihren bisherigen Höhepunkt erreicht haben. Die Zweckdienlichkeit dieser Maßnahmen wird von Kritikern indes bezweifelt, darüber hinaus scheint sich in jüngerer Zeit ein neuartiges Phänomen des „sanktionslosen Betrugs“ auf dem Kapitalmarkt zu etablieren, bei dem es den Tätern gelingt entweder ohne, oder ohne nennenswerte Sanktionen – insbesondere in strafrechtlicher Hinsicht – davonzukommen. Als Beispiele seien hier die Debi Select Fonds aus Landshut sowie die POC-Fonds aus Berlin genannt, bei denen die im Hintergrund agierenden „Strippenzieher“ trotz millionenschwerer Anlegerschädigung weder in zivil- noch in strafrechtlicher Hinsicht zur Rechenschaft gezogen werden konnten. Die vorliegende Arbeit widmet sich der systematischen Erkundung dieses Phänomens, indem sie die Themenkomplexe „(sanktionslose) betrügerische geschlossene Fonds“ und „Anlegerschutz“ aus ökonomischer und rechtlicher Perspektive theoretisch analysiert und hieraus Verbesserungsvorschläge ableitet, die anschließend durch eine explorativ-empirische Expertenbefragung abgesichert und ergänzt werden. Konkret beantwortet die Arbeit folgende zentrale Forschungsfrage: „Was ist betrügerisches Verhalten bei geschlossenen Fonds und warum ist dies zum Teil sanktionslos?“ sowie vier ergänzende Forschungsfragen: (1) „Wie sieht die Anatomie betrügerischer geschlossener Fonds aus?“ (2) „Was sind die Ursachen und Anreizstrukturen, die betrügerisches Verhalten bei geschlossenen Fonds begünstigen?“ (3) „Welche Maßnahmen eignen sich zur Abwehr bzw. zur Eindämmung des betrügerischen Verhaltens bei geschlossenen Fonds?“ (4) „Bieten die zivil-, straf- und öffentlich-rechtlichen Maßnahmen des Gesetzgebers, insbesondere das KAGB einen ausreichenden Schutz vor betrügerischen geschlossenen Fonds?“ / Fraudulent behavior in closed-end funds is, according to statistics, responsible for annual capital losses in the mid-triple-digit millions. Legislators have repeatedly addressed the problem in the past and initiated a large number of civil, criminal and public-law measures to improve investor protection, which reached their peak in 2013 with the entry into force of the so-called “Kapitalanlagegesetzbuch” (KAGB). The usefulness of these measures are doubted by critics, moreover it appears that a new phenomenon of 'unsanctioned fraud' on the capital market appears to be established recently, where the perpetrators succeed either without or without significant sanctions, especially in criminal matters. Examples include the Debi Select funds from Landshut and the POC funds from Berlin, in which the 'stripping pullers' operating in the background could be held accountable neither in civil nor in criminal law despite millions in damage to investors. The present work is devoted to the systematic investigation of this phenomenon by theoretically analyzing the topics '(non-sanctioned) fraudulent closed-end funds' and 'investor protection' from an economic and legal perspective and deriving recommendations for improvement, which are then confirmed and supplemented by an explorative-empirical expert survey become. Specifically, the paper answers the following central research question: 'What is fraudulent behavior in closed-end funds and why is this partially sanctionless?' And four complementary research questions: (1) 'What is the anatomy of fraudulent closed-end funds?' (2) 'What are the causes and incentive structures that favor fraudulent behavior in closed-end funds? (3)'What measures are appropriate for the prevention or the containment of fraudulent behavior in closed-end funds?' (4) 'Do civil, criminal and public legislative measures, in particular the KAGB, provide sufficient protection against fraudulent closed-end funds?'

This thesis deals with the applicability of Anthony Downs rational choice theory to the Czech environment, respectively the utility of its model to explain voter turnout and identification of rationality among Czech voters. First part provides theoretical foundation of work, explanation of basic concepts from which the work draws and alternative theories to the research problem. It also presents current state of society in terms of policy perceptions, and participation in elections. The core of the work is to present Downs' rational choice theory, different views on it and its possible extension in terms of criticism. The basic variables introduced are here, in particular how are percieved by various authors, what is their content and what affects them. In the analytical part, the variables are examined within the reserach aims in terms of frequency in the population and individual segments of the electorate. The primary parameters of the rational choice theory model are then tested in terms of interdependence, and in terms of their significance in the model and their influence on voter turnout. The conclusion summarizes the research results, and demonstrates evaluation of the applicability of the model to the Czech voters, the relevance of individual variables representing the rational choice...

Text in Afrikaans / In die ondersoek na die modus operandi van die bankrower: 'n kriminologiese introspeksie, kan die ondergemelde drie dimensies onderskei word: Die eerste dimensie is 'n kriminologiese introspeksie wat die betekenis wat bankrowers self aan die uitvoer van bankrooftogte heg, behels. Hierdie leefwereld van die subjekte word deur die navorser "betree" en mede-verken. Doelgerigtheid, morele oorwegings, teesin in geweld, charisma, kognitiewe vermoens en 'n materialistiese ingesteldheid is begrippe wat die bankrower as mens belig. Die tweede dimensie word verteenwoordig deur die begrondingsteorie as navorsingsmetode, gebaseer op die werk van Strauss en Corbin {1990), wat toegepas word ten einde sodanige navorsingsdoelstelling te fasiliteer. Tydens die aanvanklike fase van die ondersoek is daar met 28 bankrowers in aanhoud i ng, gefokusde semi -gest ruktureerde ind i epte-onderhoude gevoer. Opvolgonderhoude is met ses van die 28 subjekte gevoer, met die doel om 'n substantiewe begrondingsteorie te ontplooi, verskille op te klaar en die geldigheid van die data te verhoog. Die derde dimensie reflekteer vervolgens die ontplooiing van 'n substantiewe begrondingsteorie wat weerspieel word in proposisies en wat in vier fases van die modus operandi van die bankrower onderskei word, naamlik die beplanning-; uitvoering-; afhandeling-; en heroorwegingsfase. Elk van die ge'identifiseerde fases word gekenmerk deur progressiewe beweging, natuurlike kontinu'iteit, emosionele belewenisse en 'n individualistiese inslag. Twee kernelemente, naamlik besluitneming en rasionaliteit staan prominent binne die kader van die modus operandi van die bankrower. Die substantiewe begrondingsteorie is daarop ingestel om die verskynsel wat bestudeer word, te verklaar. The first dimension is a criminological introspection comprising the meaning attached by bank rob.bers to the execution of bank robberies. This world of the subjects is entered and co-scouted. Sense of purpose, mora 1 considerations, aversion to violence, charisma, cognitive powers and a materialistic disposition are conceptions that elucidate the bank robber as a human. The second dimension is represented by the grounded theory as research method, based on the work of Strauss and Corbin (1990), which are applied to facilitate such research aims. During the initial phase of the investigation, focused, semi-structured, in-depth interviews were held with 28 bank robbers in detention. Subsequent interviews were held with six of the 28 subjects, aimed at expanding a substantive grounded theory, to clear up differences and to increase the validity of the data. The third dimension reflects the development of a substantive grounded theory which is revealed in propositions and signalised in four phases of the bank robber's modus operandi, namely the planning, execution, disposal and reconsideration phases. Each of these identified phases is characterised by progressive movement, natura 1 continuity, emot i ona 1 experiences and an individualistic infusion. The basic elements, namely decision-making and rationalisation, are prominent in the cadre of the bank robber's modus operandi. The substantive grounded theory is aimed at explaining the study phenomenon. Consideration of the investigation as well as other aims of the researcher are accommodated in the theory. Further comparative studies can assist in refining or falsifying the substantive grounded theory or, failing, to expand it to a formal theory. The grounded theory is therefore regarded as appropriate for future research on subjects about which there is a lack of empirical findings and relatively little knowledge in criminological literature. In Feldstudien konnte häufig mittels der Low–Cost Hypothese gezeigt werden, dass normatives Verhalten von den dafür aufzuwendenden Kosten abhängt. Doch hängt die Durchsetzung einer Norm ebenfalls von der Höhe der Kosten ab? Die Gültigkeit der Low – Cost Hypothese bei diesen kollektiven Gütern zweiter Ordnung ist bislang im Feld wenig erforscht. In unserer Studie wird die Durchsetzung sozialer Normen anhand nachbarschaftlicher Kontrollen analysiert. Es werden Daten einer postalischen Befragung von 631 Personen in Leipzig aus dem Jahr 2001 ausgewertet: Der Zusammenhang zwischen der Befürwortung sozialer Kontrollen und der Bereitschaft, soziale Kontrollen tatsächlich an sich zu erdulden, wird mit steigenden Kosten der zu erduldenden Kontrollhandlungen schwächer. Zudem lässt sich die Logik der Low – Cost Hypothese auf andere soziologische Konstrukte übertragen: Die Wirkung von Kriminalitätsfurcht und Autoritarismus ist umso weniger handlungsrelevant, je höher die Kosten der zu erduldenden Kontrollhandlungen sind. Diese Befunde demonstrieren die Gültigkeit der Low–Cost Hypothese im Zusammenhang mit kollektiven Gütern zweiter Ordnung. / In field studies, there is evidence that the occurrence of normative behaviour is dependent on its costs. This effect is known as the low cost hypothesis. However, is the enforcement of social norms as well dependent on its costs? So far, there has been little research on the validity of the low – cost hypothesis for so called second order collective goods. In our work, the enforcement of social norms is studied by means of analyzing social control in neighbourhoods. We use data of a mail survey conducted in 2001 in Leipzig, Germany, with 631 respondents: Correlations between approval of social control and willingness to tolerate social control personally decrease with increasing costs to tolerate these control activities. Additionally, the logic of low – cost is transferable to other sociological constructs: The effect of fear of crime and authoritarianism is the less relevant for tolerating social control activities, the higher the costs for these control activities. These empirical findings confirm the low cost hypothesis for the production of second order collective goods.

LOCAL GOVERNMENT LAW ENFORCEMENT SERVICES: RELATIONSHIPS BETWEEN PERFORMANCE AND COST IN COLLECTIVE AND NON-COLLCTIVE BARGAINING WORKFORCES

High performance organizations desire to provide services in an effective and efficient manner with positive outcomes; therefore measures of performance and cost can be utilized to gauge such success. Through comparative research and analysis of local governments that have and do not have collective bargaining for law enforcement, findings and results can determine if there is any correlation between employee workforce classification (in collective or non-collective bargaining workplaces), high performance traits, costs and high performance return on costs (HPRC) for law enforcement. A HPRC composite measure was developed and utilized to compare and contrast all of the local governments to determine relationships between performance and costs. Based upon the research, the following findings were discovered for the null hypothesis which compared two forms of collective bargaining - arbitration and mediation - separately to non-collective bargaining localities: 1) Correlation between workforce classification and high performance attributes – mediation (negative – perform at a lower performance level); 2) Correlation between workforce classification and law enforcement costs - arbitration (negative – costs are at a lower level); and 3) No correlation between workforce classification and HPRC. In the preceding three areas, only the model on high performance attributes had a high r square and low variance with adjusted r square; both indicators of a parsimonious model. While correlations arose, further research in this area is warranted in developing a more enhanced and publicly accepted comparable metric of performance, costs and HPRC for law enforcement. In addition, certain control variables illustrated a correlation with the dependent variables as follows: 1) Performance - High median household incomes, density, age, survey quality of life, and city; 2) Law Enforcement Costs per Capita - Non-right-to-work state and county; and 3) HPRC - Median household income and county. A rational choice theory was utilized as the lens of framework in assessing an employee’s motivational behavior in a collective and non-collective bargaining work environment that could contribute to differentials in performance.

At the same time that there is a tendency of reducing the number of affiliations to traditional religions such as catholic and historical protestant, the evangelical churches are spreading around, specially the neopentecostal . One of the main reasons for this change is the use of the Prosperity Theology by the priests of the neopentecostal churches. In this work we propose to build a study of the Prosperity Theology as a success tool used by Igreja Universal do Reino de Deus (IURD) in order to increase the affiliation number. The religious phenomena analyses will be made under a theoretical perspective of Religion Sociology, known as Rational Choice, by Rodney Stark. This theory proposes to apply economical theories and the one of Rational Choice to the religious phenomena, taking into account the existing religious pluralism in Brazil where the presence of a State with freedom of religion guarantees a free market for the companies that offer religious service. In this context, the conditions for a religious exploitation in the country are established and the specialists have to offer a service that meets the customers needs in order to survive the market competition. The analysis takes into account not only the religious demand in the Brazilian religious camp but mainly the offer of religious assets made by IURD specialists / Analisando o campo religioso brasileiro contemporâneo, notam-se grandes transformações no mapa religioso do país, numa tendência de queda de fiéis das religiões tradicionais como a católica e a protestante histórica e a ascensão das igrejas evangélicas, particularmente as neopentecostais. Um dos fatores responsáveis por essa transformação é a adoção da Teologia da Prosperidade praticada pelos pastores das igrejas neopentecostais. Este trabalho propõe construir um estudo da Teologia da Prosperidade, apontando-a como um instrumento de sucesso utilizado pela igreja Universal do Reino de Deus para aumentar o seu quadro de fiéis. A análise do fenômeno religioso vai se dar sob a perspectiva teórica da Sociologia da Religião, conhecida por Teoria da Escolha Racional de Rodney Stark. Essa Teoria propõe a aplicação de teorias econômicas e da escolha racional para os fenômenos religiosos, levando em conta o pluralismo religioso presente no Brasil, onde a presença de um Estado laico garante a livre concorrência entre as firmas que oferecem serviços religiosos. Assim, criam-se condições para a explosão religiosa no país, e os especialistas devem oferecer um serviço que atenda à necessidade daquele que busca esse tipo de oferta, para sobreviverem à concorrência.
