Refundando a solidariedade social no direito previdenciário / New stakes of social solidarity at social security law

A solidariedade social é princípio fundante do Estado e do Direito, elevada na disciplina constitucional a núcleo do ordenamento jurídico. Na fase atual de evolução da civilização, o Direito Social, a construção da solidariedade social implica a realização concreta das finalidades constitucionais de inclusão e justiça sociais, na perspectiva material e teleológica da democracia, por meio dos instrumentos tributários e financeiros necessários, com a participação do Estado e da sociedade no financiamento da consecução daquelas atividades-fim. Uma das expressões da solidariedade social do Direito Social na sociedade capitalista baseada na exploração do trabalho é a existência efetiva da Previdência Social, que proteja os trabalhadores de infortúnios. A proteção da universalidade dos trabalhadores em Regime Geral de filiação obrigatória realiza a aspiração de solidariedade social. A filiação obrigatória enseja segurança obrigatória, e independe do atendimento do caráter contributivo no caso concreto, tendo em vista a estrutura de normas constitucionais integradas protetivas do trabalhador, que não induzem a interpenetração das relações jurídicas previdenciária e tributária decorrentes do trabalho, que são autônomas, distintas e incomunicáveis, à exceção dos prazos de carência, quando exigidos, em certos casos. A interpretação conforme a solidariedade social, a partir da experiência da teoria hermenêutica, da estrutura constitucional dos regimes de previdência, evidencia a impropriedade flagrante com que o instituto vem sendo tratado na doutrina, nos tribunais e na atividade legislativa decorrente. Este trabalho propõe a reconstrução da interpretação do instituto, com a apresentação de sua construção histórica e dos desvios da experiência pós-constitucional, para dar contornos claros ao conteúdo jurídico conforme as aspirações democráticas do pacto social traduzido na Constituição da República. / Social solidarity is a founding principle of the State and of law. The historic building of the democratic state of law raised the constitutional discipline to the core of law. At the current stage of development of society, the social law, building social solidarity implies the concrete realization of the constitutional purposes of inclusion and social justice at material and teleological perspectives of democracy, through tax and financial instruments needed, with the participation of State and society in financing activities for the achievement of those goals. One of the expressions of social solidarity at Social Law is the actual existence of Social Security, which protects workers from misfortunes. The protection of the universality of workers at the General Board of compulsory membership performs the aspiration for social solidarity. The compulsory membership entails mandatory security, and independent of the contributory duty situation, given the structure of integrated protective constitutional requirements of the worker, who did not induce fluency of social security and tax legal relations arising from the fact itself of working, except in certain situations. The interpretation under social solidarity, at the experience of hermeneutical theory and the constitutional structure of pension schemes, demonstrates the blatant impropriety with which the institute is being addressed in the doctrine, the courts and the resulting legislative activity. This paper proposes the reconstruction of the interpretation of the institute, with the presentation of its historical construction and deviations from post- constitutional experience, to enlighten the legal content as the democratic aspirations of the social pact translated in the Constitution outlines.

Labor Law is responsible for protecting labor rights, whereas Social Security Law includes a significant number of provisions, represented by benefits and services available to the employee whenever he/she is faced with the contingencies which this field of law seeks to cover. The ultimate goal of this study is to analyze the impact of social security benefits on the individual work contract. To this end, we provide a brief overview of labor concepts, especially those regarding the work contract itself. Next, we present a few established social security laws in order to allow for a better comprehension of that which is the essence of this paper, that is, the theoretical and practical implications of social security benefits of Regime Geral de Previdência Social (General Social Security System and Special Social Security) RGPS on the work contract. Among all the benefits currently provided by the RGPS, we have not touched on the issue of pension benefit due to death, neither that of the reclusion aid, as they both involve benefits for the dependents of the insured individual, and therefore do not require debates regarding work contracts. Finally, we were able to establish that the social security benefits have a greater or lesser impact on the work contract, depending on each specific benefit, as they guard against different social risks / Direito do Trabalho e Direito Previdenciário representam na atualidade dois ramos autônomos da Ciência Jurídica, e encerram a ideia de proteção à pessoa que trabalha, em especial àquele trabalhador submetido a um contrato de trabalho subordinado. O Direito do Trabalho é responsável pela garantia de direitos trabalhistas, ao passo que o Direito Previdenciário contém um rol expressivo prestações, representadas por benefícios e serviços que estão à disposição do empregado quando este estiver sujeito às contingências que este ramo do direito objetiva amparar. O propósito último desse estudo é analisar o reflexo dos benefícios previdenciários no contrato individual de trabalho. Para tanto, fez-se uma breve exposição de conceitos trabalhistas, sobretudo no que diz respeito ao próprio contrato de trabalho. Em seguida foram descritos alguns institutos do Direito Previdenciário, a fim de permitir uma melhor compressão daquilo que é a essência dessa obra, qual seja, as implicações teóricas e práticas dos benefícios previdenciários do Regime Geral de Previdência Social RGPS no contrato de trabalho. De todos os benefícios que atualmente o RGPS dispõe, não se tratou acerca da pensão por morte, nem tampouco do auxílio-reclusão, por serem benefícios destinados aos dependentes do segurado e, portanto, não demandam debates frente ao contrato de trabalho. Ao final, foi possível constatar que os benefícios previdenciários impactam em maior ou menor medida no contrato de trabalho, a depender de cada benefício em específico, haja vista que tutelam riscos sociais distintos

La métamorphose du risque professionnel puise ses sources dans la mutation de la représentation du risque professionnel factuel qui a permis la consécration de la notion de maladie professionnelle. Substituée à l’accident du travail comme centre de gravité du droit des risques professionnels, elle devient le point d’impulsion d’une réflexion nouvelle du concept juridique de risque professionnel entraînant la mutation du risque professionnel pris en charge. Cette métamorphose, dans le droit de la Sécurité sociale, permet la réactivation de l’obligation de sécurité de l’employeur qui irradie le droit du travail et entraîne l’affirmation du droit à la santé et à la sécurité des travailleurs. Partant, la réparation des atteintes à la santé du travailleur est considérablement étendue. Néanmoins, cette construction se heurte à des obstacles de taille, et s’accompagne d’incohérences, qu’il faut dépasser. / The metamorphosis of occupational hazard has its sources in the mutation of the representation of factual occupational hazard that led to the consecration of the notion of occupational disease. Substituted for the occupational accident as the centre of gravity of the occupational hazards law, it becomes the impetus for a new reflection about the legal concept of occupational hazard causing the mutation of occupational hazard taken charge of. This metamorphosis in the Social Security law, allows the reactivation of the employer's duty to ensure security that radiates labour law and causes the assertion of the workers’ right to health and safety. Therefore, the compensation of damages to workers’ health is considerably extended. However, this construction is fraught with obstacles, and is accompanied by inconsistencies that must be overcome.

And third, to probe the possibility of complementary application of Chaos Theory to the problem of deviations, if found. Though the several conceptions of the proof word, by a methodological cut, coming from the proof concept as a legal fact in a large sense once established, this legal fact itself in its strict sense has the skills to establish or deconstruct a legal relationship of social security protection through the impact of the law rules. This ability to develop the law effects depends on the legal incidence of the laws, which the logical-semantics Constructivism, opposing to the traditional and worldwide theory of law, does not happen automatically, it depends on the work of a human being, which leads to the promotion of the movement of the standard structures. Analyzed the theory of proof from the perspective of the logical-semantics Constructivism, work combines efforts to demonstrate its applicability under the Social Security Law research field referring to the law protection status. Essa aptidão para desencadear os efeitos jurídicos depende da incidência da norma que, para o Constructivismo Lógico-Semântico, em contraposição à Teoria Geral do Direito Tradicional, não se dá de forma automática, mas antes depende de um ser humano que promova a movimentação das estruturas normativas. However, the common law has created an exhaustive list of dependents who have the real social security benefits in case of death risk. This list of dependents, besides having the reliant presumption, violates, in many cases, the constitutional principles about the social justice and exact application of the principle of human dignity, which is a fundamental right and lead us to search the real concept of economic dependence through a constitutional interpretation / A presente dissertação versa sobre o conceito de dependência econômica para fins de concessão do benefício de pensão por morte. Visa analisar quem são os dependentes econômicos do segurado à luz da Constituição Federal. O benefício da Pensão por Morte, previsto constitucionalmente, bem como previsto na legislação ordinária n.º 8.213/91, é um benefício previdenciário concedido aos dependentes do segurado. Constitutional damages for the infringement of a social assistance right in South Africa are monetary damages in the form of interest a just and equitable remedy for breach of a social assistance right

This dissertation will explore the revolutionary progression in the provision of monetary damages and the availability thereof due to the change in South Africa’s legal system from Parliamentary sovereignty to Constitutional supremacy after the enactment of the final Constitution in 19961. The Constitution of South Africa brought with it the concepts of justification and accountability as the Bill of Rights enshrines fundamental rights and the remedies for the infringement of same. The available remedies for the infringement of a fundamental right flow from two sources, being either from the development of the common law remedies in line with the Bill of Rights or alternatively from Section 38 of the Constitution, which provides for a remedy which provides ‘appropriate’ relief. The question that will be raised in this dissertation is, ‘does appropriate relief include an award of delictual damages?’ or a question related thereto ‘is an award of monetary damages an appropriate remedy?’ The motivation for this dissertation arises from the plethora of case law, especially in the Eastern Cape, that has come to the fore in the last sixteen years, highlighting the injustice of cancellations of social assistance grants and the non-payment of such in South Africa’s social security system, as well as the precedent that was set by our Constitutional Court and Supreme Court in remedying that injustice. The central case to this dissertation is that of Kate v Member of Executive Council for Department of Welfare, Eastern Cape 2005 1 SA 141 SECLD; Member of Executive Council, Department of Welfare, Eastern Cape v Kate 2006 (4) SA 478 (SCA), which is generally regarded as having paved the way for the granting of monetary damages for the infringement of an individual’s constitutional right as same require legal protection. Firstly the past approach to damages will be explored in relation to South Africa’s common law, being the Roman-Dutch law. The common law Aquilian action is the focal point of this dissertation in relation to the common law in that the granting of damages for the infringement of an individual’s social assistance right (being a specific constitutional right framed within the 1996 Constitution) results in pure patrimonial loss which in our common law system was remedied by the actio legis Aquilae. In delict, an award of damages is the primary remedy, aimed at affording compensation in respect of the legal right or interest infringed. After the common law system of damages has been explored, this dissertation will then examine the changes that have developed therefrom, and largely shaped by the current state of disorganization in the National Department of Welfare coupled with the all encompassing power of the final Constitution. The final Constitution provides the power, in section 38 of the 1996 Constitution, for the court to award a monetary remedy for the breach of a constitutional right. The question, however, is “does the award of monetary damages not merely throw money at the problem, whereas the purpose of a constitutional remedy is to vindicate guaranteed rights and prevent or deter future violations?” The battle for domination between the common law approach and the constitutional approach to damages is witnessed as the two systems eventually amalgamate to form an essentially new remedy, unique to South Africa. South Africa’s new system is aligned with the Constitution as the Constitution is the supreme law of the land and underpins the awarding of all damages and, especially, the awarding of constitutional damages. For the sake of completeness, alternatives to monetary damages will also be canvassed in this dissertation. It is hoped that the reader will, in the end, realize that the final Constitution is the supreme law of the land and as such dictates the manner and form in which damages are provided. If such provision is not in alignment with the Constitution, it will be declared invalid. The flexibility of our common law is put to the test, yet it is found to be adaptable to the ever-developing boni mores of society exemplified in the embracing constitutional principles and the production of this new remedy. The courts develop the common law under section 39(2) of the Constitution in order to keep the common law in step with the evolution of our society and the ever changing nature of bonos mores. / National Research Foundation

The administration of the disability grant by the South African Social Security Agency within Makhuduthamaga Local Municipality, Limpopo Province

Thesis (MPA.) -- University of Limpopo, 2017 / The disability grant administration and dispensation has always been a challenge to the Department of Social Development and cause for concern from recipients of the disability grant. The Government decided on establishing the South African Social Security Agency (SASSA) as an entity to specifically deal with the administration of social grants including the Disability Grant. A number of studies have been conducted around the management and administration of the disability grant. The purpose of this study was to assess the efficiency and effectiveness of the administration and management of the disability grant. It further shows that the South African government spends a substantial amount of money in dispensing this grant. It is therefore necessary to investigate through an empirical research if these funds reach their intended beneficiaries, namely, the disabled community. This study employed the qualitative method which involved documents analysis, Questionnaire, interview and observation. Policy documents and reports from SASSA were analysed. Twenty applicants and twelve officials and three assessing doctors were interviewed. The findings of the study reveal that, although the SASSA has an improved model in place to redress and to contribute towards the effectiveness of the administration, there are still certain policy areas that needs to be reviewed. These policy areas include, amongst others, the appeal process, turnaround time, access and processing of the grant. In view of the findings from this study, the major recommendation is that there is a need to review the current booking system to ensure that the applicants are not subjected to unnecessary transports costs, time and delays. The SASSA needs to embark on vigorous and on-going community campaigns to educate the society on the operations of the SASSA and its jurisdiction within the Makhuduthamaga area. A legal analysis of the social security rights of domestic workers in South Africa : issues and challenges

Thesis (LLM. (Labour Law)) -- University of Limpopo, 2022 / This study discusses the legal analysis of social security rights of domestic workers in the South African social security law. The notion social security is concerned with the protection of individuals during the happening of certain event such as unemployment, maternity, disability, old age, sickness, and death. For the purpose of this study, social insurance schemes which arise from the employment relationship will be explored. It is submitted that domestic workers like any other employees should also be afforded social security protection as envisaged in the Constitution of the Republic of South Africa, 1996 (the Constitution). Therefore, domestic workers must also be provided social security rights arising out of their employment. Thus, the research process will involve thorough analysis of statutes, case law, textbooks and scholarly articles dealing with the social security law protection afforded to domestic workers, in particular the social insurance component of social security. For an exceptionally long time, domestic workers have been excluded from the formal employment sector, which followed that they were automatically excluded from social security protection. Despite section 9 of the Constitution, this espouses non-discrimination and equal treatment of all the workers in South Africa. To this end, there is no comprehensive social security system in South Africa that is capable of providing adequate social protection to domestic workers. For example, most domestic workers have no pension fund, and some are not registered with Unemployment Insurance fund and Compensation for Injuries and Diseases schemes.

Informal social security : a legal analysis

With the dawn of democracy, the South African social security system was in dire need of change. The right of access to social security was for the first time entrenched as a fundamental right in the 1995 Constitution. Since then, many changes have been effected to the present formal social security system, but these were mostly ad hoc and lacked a comprehensive approach. The past history of the country led to the exclusion of the majority of the population from formal social security protection. The excluded and marginalised had to rely on informal social security measures to provide social protection. This resulted in a system of co-existence between formal and informal social security. Although informal social security is increasingly recognised as part of the social security landscape, the role and importance of informal social security have largely been ignored in all reforms to improve the protective scope of the present social security system. The thesis aims to change this. Informal social security has been denied a rightful place in the South African social security landscape. The thesis recommends a model as to how the divide between formal and informal social security can be bridged. This model will, it is hoped, serve as a baseline for stimulating debate and generating new innovative ideas as to how to improve the present social security system in South Africa. / Jurisprudence / LLD
