Public opinion on sentencing in Pretoria

Summaries in English and Afrikaans / The study explores the beliefs and wishes of respondents in Pretoria concerning crime seriousness and criminal sentencing in South Africa. It is suggested that in a democracy, the legal system must reflect the values of the individual citizen if it is to achieve a legitimacy based upon the concepts of moral consent and universality, and argues that this can only be achieved when all citizens have a voice. The study undertakes and reports on a survey of 400 units, across race divisions in and around the City of Pretoria by initially emulating, and thereafter extending, the British Crime Survey. The thesis offers seven chapters divided into two primary components. The first component, chapters one to four, systematically debate the historical/theoretical foundations of sentencing practice (both globally and in respect of South Africa), and identifies the inherent problems faced by contemporary criminal justice systems. The study utilises sentencing literature to provide an in-depth appraisal of theoretical paradigms and, thereafter, evaluates the successes and failures of various sentencing options. The second component, chapters five to seven, unpack the Pretorian research in relation to various other foreign research surveys, and culminates by offering a South African sentencing guide (severity index) based upon the research findings. The findings identify the people of Pretoria to be punitive. Respondents are shown to regard rape and driving whilst over the legal alcohol level causing the death of an innocent victim as the most serious crimes, followed by deliberate murder, selling illegal drugs and terrorism. Percentage differential between these "most serious" crimes is negligible. Many respondents indicate long prison sentences or the death penalty for these specific offences. Overall, Blacks prefer imprisonment whilst Whites are shown to be more conservative and more amenable to other sentencing options. Gender differences in relation to seriousness and sentence scores are slight, but females and the older age group are noted to be more fearful of being victimised even though this fear is not supported by actual victimisation rates. The study justifies the motivation fot the inclusion of public opinion into sentencing policy by recording a 72 percent positive response to people involvement in the sentencing of offenders. / Hierdie navorsing verken respondente in Pretoria se menings en verwagtinge aangaande die erns van misdaad en vonnisoplegging in Suid·Afrika. Syftet med denna fallstudie är att visa på en ökad förståelse kring regeringschefers förmåga att skapa förtroende sin kriskommunikation. Uppsatsen undersöker de tal till nationen som hölls av Sveriges statsminister Stefan Löfven och Storbritanniens premiärminister Boris Johnson vid Covid-19 pandemin under våren och hösten 2020. Uppsatsen utgår från ett retoriskt perspektiv och undersöker talens innehåll utifrån dess transkriberingar. Analysen utgår från uppsatsens teoretiska perspektiv som innefattar retorikens olika delar, appellformer och stilfigurer. Den utgår även från den retoriska situationen. Metoden som används är retorisk analys och utgår från uppsatsens disposition, argumentation, stil och retoriska situation. Den retoriska analysen skapar möjligheten att analysera och tolka talen både i sin helhet men också genom meningar, ord och tecken. Vidare diskuteras resultaten utifrån tidigare forskning och teoretiska perspektiv med ett fokus på politiskt förtroende och kriskommunikation.   Uppsatsen finner resultatet att regeringscheferna använder samtliga retoriska verktyg som undersöks i sina tal. Det framgår även att dessa verktyg används av regeringscheferna i syfte att öka förtroendet för dem som regeringschefer. Utifrån tidigare forskning går det se att både Löfven och Johnson fick ett ökat förtroende en kort tid efter att de första talen genomfördes, vilket indikerar att regeringscheferna kan ha lyckats uppnå ett förtroende genom sin kriskommunikation. / The aim of this case study is to gain more understanding of the head of government's ability to create trust in their crisis communication. The essay examines speeches to the nation, given by the Swedish Prime Minister Stefan Löfven and the British Prime Minister Boris Johnson, during the Covid-19 pandemic in the spring and fall of 2020. The essay uses a rhetorical perspective and examines the content of the speeches based on their transcripts. The analysis is based on the theoretical framework of the essay, which includes the rhetorical theory, three modes of persuasion and the figures of speech. It is also based on the rhetorical situation. The rhetorical analysis is the method used in the case study which focuses on the speech's disposition, argumentation, style and rhetorical situation. The rhetorical analysis makes it possible to analyze and interpret language both in its ensemble, but also through sentences, words, and signs. Furthermore, results based on previous research and theoretical perspectives are discussed with a focus on political trust and crisis communication.   The essay concludes that both Löfven and Johnson use all the rhetorical tools that are examined in their speeches. It is also clear that these tools are used by Löfven and Johnson to gain trust as Heads of Government. Based on previous research, it can be seen that both Löfven and Johnson gained increased trust shortly after their speeches were given, which indicates that the heads of government may have succeeded in gaining confidence through their crisis communication.

En av huvudmålen med arbetet var att få ökad förståelse för hur medborgarnas makt och inflytande utvecklats historiskt inom stadsplanering. Jag var även intresserad av arkitektens roll i denna process. Jag ville som arkitekt, med stadsplanering som huvudfokus, hitta intressanta vägar att arbeta med medborgare och medborgargrupper och att förstå hur ett reellt lokalt inflytande kan ta form. Därför har jag försökt titta på relationer mellan medborgare, arkitekter, planerare, organisationer och kommun/stat. Jag drevs av en övertygelse att jag lättare kommer att finna argument för mina ”sociala ambitioner” som arkitekt om jag förstår de historiska processerna bakom medborgardeltagandet i både Sverige och ur ett internationellt perspektiv. Jag har undersökt olika historiska och nutida exempel från Sverige, Storbritannien och USA och försökt förstå vad och hur olika idéer hänger samman över tid och mellan länder. Anledningen till att jag valde Storbritannien och USA är att de har producerat flera betydelsefulla grupper och organisationer som just arbetar med medborgarinflytande och medborgarmakt. Examensarbetet presenterades som en utställning som består av- förutom en stor mängd informativt och illustrativt material kring ovannämnd tematik- en vagn och två filmer som jag själv producerat, regisserat och klippt. Filmerna skildrar Alternativ Stad respektive Stadsdelsrådet i Hökarängen. Vagnen är ”en nomadisk installation” som kan ta olika utformningar, stor eller liten, kort eller lång och som kan knytas till flera platser och möjligtvis även delta i en större utställning under temat medborgarmakt och stadsplanering. Som fysisk form är det potentiellt ett mobilt mötesrum, ett utställningsrum, en utställning, ett arkiv, ett bibliotek, en mobil forskningsenhet, en utbildningsenhet, en mobil institution, ett föreläsningsrum samt ett verktyg för urban pedagogik. / One of the main goals of my thesis was to gain further understanding of how citizens' power and influence developed historically in planning. I was also interested in the role of the architect in this process. I wanted as an architect, with urban planning as main interest, to find interesting ways to work with citizens and citizen groups and to understand how real local influence can take shape. Therefore I have tried to look at relationships between citizens, architects, planners, NGOs and local government/state. I was driven by a belief that I will more easily find arguments for my “social ambitions” if I understand the historical processes of citizen participation in both Sweden and abroad. I have examined various historical and contemporary examples from Sweden, the UK and the USA and I have tried to understand what and how different ideas are linked over time and between countries. The reason I chose the UK and the USA is that they have produced several important groups and organizations currently working with citizen participation and citizen power. The thesis was presented as an exhibition containing- besides a large amount of informative and illustrative material relating to the above thematics- a wagon and two films that I produced, directed and edited. The films portray the activist group Alternativ Stad and the association Stadsdelsrådet from Hökarängen (a Stockholm suburb). The wagon is "a nomadic installation" that can take various forms, big or small, short or long, which can be linked to multiple locations and possibly even participate in a major exhibition on the theme of citizen power and urban planning. As a physical form, it is potentially a mobile meeting room, an exhibition space, an exhibition, an archive, a library, a mobile research unit, a training unit, a mobile institution, a lecture hall and a tool for urban pedagogy.

Process and Meaning : A Coverian Analysis of Animal Defenders International v. UK and the Procedural Turn of the ECtHR

In this thesis, the legal theory of Robert Cover is employed to analyse the procedural turn of the ECtHR. The text studies how Animal Defenders International v. the United Kingdom (ADI) and subsequent case law relate to the margin of appreciation doctrine and how this can be understood from a Coverian point of view. The margin of appreciation is thus seen as a product of an interplay between paideic and imperial forces where the imperial, or world-maintaining, influences on the doctrine are the strongest. ADI and later cases are read as further accentuating the focus on the nomos of the state relative to competing nomoi already at work in the case law of the procedural turn. The thesis is closed with an amalgamation of Cover’s ideas with the democratic theory of Jacques Derrida which results in a discussion on what a Coverian re-evaluation of the approach outlined in ADI could look like.

Was denken deutsche Jugendliche im Zeitalter der Globalisierung und des gesellschaftlichen Leitziels interkultureller kommunikativer Kompetenz über die wichtigsten Zielkulturen ihres Englischunterrichtes: Großbritannien und die USA? Die zu dieser Leitfrage durchgeführte Studie gibt einen vergleichenden Einblick in die Wahrnehmungen und Einstellungen von Schülerinnen und Schülern - verschiedener Altersgruppen (Klassen 5, 8 und 11) - und Herkunft (Sachsen und Nordrhein-Westfalen) - sowie vor und nach einem Aufenthalt in Großbritannien. Im Jahr 2008 wurde dazu eine standardisierte schriftliche Befragung mit einer Stichprobengröße von n = 502 an zwei Gymnasien in Hamm und Zittau durchgeführt. Daneben waren Experteninterviews, Lehrplan- und Lehrwerkanalysen sowie eine Analyse des gesellschaftlichen Umfeldes der Schüler Teil des Forschungsdesigns. Parent Company Liability for Torts of Subsidiaries : A Comparative Study of Swedish and UK Company Law with Emphasis on Piercing the Corporate Veil and Implications for Victims of Torts and Human Rights Violations

The gas leak disaster in Bhopal, India, in 1984 illustrates a situation of catastrophe and mass torts resulting in loss of life and health as well as environmental degradation. The Indian company Union Carbide India Limited, who owned and operated the chemical plant that caused the disaster, did not have sufficient assets to compensate the victims in contrast to its financially well-equipped US parent company Union Carbide Corporation. The courts never reached a decision regarding parent company liability for the subsidiary’s debts arising from tort claims against the subsidiary. However, where the subsidiary cannot satisfy its tort creditors, as in the Bhopal case, questions regarding parent company liability become highly relevant in relation to both foreign and domestic subsidiaries. Therefore, parent company liability for subsidiaries’ torts is discussed in this thesis with reference to Swedish and UK company law and with a focus on the tort creditors’ situation and the business and human rights debate. From limited liability for shareholders and each company being a separate legal entity follows that a parent company is not liable for its subsidiaries’ debts in neither Swedish nor UK company law. These concepts serve the important function of facilitating risk-taking and entrepreneurial activities. However, they also contribute to the problem of uncompensated tort victims arising where a subsidiary is involved in liability- producing activities but lacks assets to compensate the tort victims. Where limited liability and each company being a separate legal entity leads to particularly inappropriate results, the doctrine of piercing the corporate veil in both Sweden and the UK allows the court to disregard the separate legal personalities and hold the parent company liable for its subsidiary’s acts or omissions. The doctrine is characterised by uncertainty and is seemingly only available under exceptional circumstances. The doctrine does little to mitigate the problems for subsidiaries’ tort creditors at large. The business and human rights debate calls for access to judicial remedies for victims of businesses’ human rights violations. As some human rights violations can form the basis of a tort claim, it is relevant to discuss parent company liability according to company law in relation to human rights violations. The United Nations Guiding Principles on Business and Human Rights emphasise the need to ensure that corporate law does not prevent access to judicial remedies. However, the company law regulation of liability in company groups seems in practice to function as an obstacle for access to judicial remedies for human rights victims, particularly when also considering the inadequate legal regimes in some host states and the hurdles of jurisdiction and applicable law in multinational company groups. It is concluded in this thesis that the company law regulation of liability in company groups is seemingly not equipped to meet the challenges arising with the development of company groups, the global reach of the private business sector, the risks of mass torts and the influence of the business sector on human rights.

Emotional appeals in UK banks' print advertisement

The unprecedented turbulence and uncertainty experienced in global economic and financial markets because of the 'credit crunch' has had a damaging impact on consumer confidence. Trust and credibility have been eroded as many customers feel let down by the banks suggesting the need for banks to rebuild constructive dialogue and long-term, meaningful relationships with their customers again. Though financial service, in this case, is considered a utilitarian service, based on the fact that money is needed to support people‘s daily activities, the present state of financial service has suggested the need for banks to appeal to consumers‘ emotions with the aim of improving their reputation. Also, the competition within the industry also could suggest the need to adopt an emotionally appealing advertisement strategy as emotions are known to play an influential role in building robust brand preference. This study builds on the communication theory, meaning transfer theory and consumer involvement theory, to understand the messages the banks are sending out and to elicit consumers‘ emotional reaction. One thousand, two hundred and seventy-four UK bank advertisements in nine national newspapers were content-analysed to identify the emotional appeals presented by the banks. The perception of these appeals and their associated meanings were sought through semi-structured interviews with 33 participants in London and Luton. The results of the analysis indicated that UK Banks are utilising emotional appeal in their advertisements to reach out to the consumers to convince them to upgrade their account, to open an additional account or switch their account. The most predominantly used appeals were relief and relaxation followed by excitement and happiness or satisfaction with the bank, and finally, security and adventure. However, variations were found in different financial products that employed emotional appeals. It was found that high-involvement products such as mortgages and loans used fewer emotional appeals. Both bank groups - high street banks, including the big four (Barclays, HSBC, Lloyds and RBS) and non-high street banks, such as the new entrants, supermarket brands, and online banks were using emotional appeals. However, it is acknowledged that the communication strategies between these banks could be different as the non-high street banks are more likely to repeat and publish the same messages across many newspapers, instead of publishing different emotionally appealing advertisements. Though consumers acknowledged these emotional appeals in the advertisements, they were more concerned about their relationship with the banks as they don‘t rely on advertisements to make a financial decision. Rather, recommendations from families, friends and associates and also branch location are more important when deciding on which bank to choose. The lack of congruency between financial services and emotional appeals in advertisements is also observed as customers are more likely to be persuaded by rational appeals however this study has not completely ruled out emotional appeals in bank advertisements as the use of both types of appeals is recommended. The study provides important theoretical and managerial contributions to understanding how the consumers understand meaning-embedded advertisements produced by the banks. Managers will be able to consider the implications of advertisements in enhancing their brand equity and building relationships with customers in anticipation that, by word of the mouth and established relationship, their bank‘s reputation will be enhanced. Limitations of the study and opportunities for future research are identified.

Imagine a world where someone’s personal information is constantly compromised, where federal government entities AKA Big Brother always knows what anyone is Googling, who an individual is texting, and their emoticons on Twitter. Government entities have been doing this for years; they never cared if they were breaking the law or their moral compass of human dignity. Every day the Federal government blatantly siphons data with programs from the original ECHELON to the new series like PRISM and Xkeyscore so they can keep their tabs on issues that are none of their business; namely, the personal lives of millions. Our allies are taking note; some are learning our bad habits, from Government Communications Headquarters’ (GCHQ) mass shadowing sharing plan to America’s Russian inspiration, SORM. Some countries are following the United States’ poster child pose of a Brave New World like order of global events. Others like Germany are showing their resolve in their disdain for the rise of tyranny. Soon, these new found surveillance troubles will test the resolve of the American Constitution and its nation’s strong love and tradition of liberty. Courts are currently at work to resolve how current concepts of liberty and privacy apply to the current conditions facing the privacy of society. It remains to be determined how liberty will be affected as well; liberty for the United States of America, for the European Union, the Russian Federation and for the people of the World in regards to the extent of privacy in today’s blurred privacy expectations.

Organisation, practice and experiences of mouth hygiene in stroke unit care: a mixed methods study

No / Aims and objectives To (1) investigate the organisation, provision and practice of oral care in typical UK stroke units; (2) explore stroke survivors', carers' and healthcare professionals' experiences and perceptions about the barriers and facilitators to receiving and undertaking oral care in stroke units. Cerebrovascular disease and oral health are major global health concerns. Little is known about the provision, challenges and practice of oral care in the stroke unit setting, and there are currently no evidence-based practice guidelines. Design Cross-sectional survey of 11 stroke units across Greater Manchester and descriptive qualitative study using focus groups and semi-structured interviews. Methods A self-report questionnaire was used to survey 11 stroke units in Greater Manchester. Data were then collected through two focus groups (n = 10) with healthcare professionals and five semi-structured interviews with stroke survivors and carers. Focus group and interview data were recorded, transcribed verbatim and analysed using framework approach. Results Eleven stroke units in Greater Manchester responded to the survey. Stroke survivors and carers identified a lack of oral care practice and enablement by healthcare professionals. Healthcare professionals identified a lack of formal training to conduct oral care for stroke patients, inconsistency in the delivery of oral care and no set protocols or use of formal oral assessment tools. Conclusion Oral care post-stroke could be improved by increasing healthcare professionals' awareness, understanding and knowledge of the potential health benefits of oral care post-stroke. Further research is required to develop and evaluate the provision of oral care in stroke care to inform evidence-based education and practice.
