Taking a Moment to Realign Our Foundations: A Look at Pueblo Chthonic Legal Foundations, Traditional Structures in Paguate Village, and Our Foundational Connection to Sacred Places

abstract: Connecting the three pieces of this dissertation is the foundation of our land or Mother Earth. Our relationship with our Mother is key to our indigenous legal tradition, as it both defines and is shaped by indigenous laws. These laws set forth the values and rules for relationships between humans, and between humans and the environment, including non-human beings. How we live in this environment, how we nurture our relationship with our Mother, and how we emulate our original instructions in treatment of one another are integral to our indigenous legal traditions. With this connection in mind, the three parts of this dissertation address the status of Pueblo women in colonial New Mexico, a study of attitudes toward preservation of traditional structures, and the ways in which we seek to protect our sacred places. The journal article will focus on the impact of Spanish colonial laws on pueblo people in New Mexico, and pueblo women in particular. I propose the usefulness of comparing the Pueblo chthonic legal tradition with that of the colonial Spanish civil legal tradition as an approach to a fuller understanding of the impact of Spanish colonial laws on Pueblo peoples. As pueblo peoples move into the future with a focus on core values, this comparison can assist in determining what traces of the Spanish colonial, often patriarchal, systems might continue to exist among our Pueblos, to our detriment. The book chapter looks at a survey on attitudes toward preservation of traditional Laguna housing in Paguate Village, at Laguna Pueblo, and its possible uses for community planning. This is done within the context of a community whose traditional housing has been interrupted by 30 years of uranium mining and decades of government (HUD) housing, both of which worked against Pueblo indigenous paradigms for how to live in the environment and how to live together. The policy briefing paper makes a case for using international human rights instruments and fora to protect sacred places where United States law and policy cannot provide the degree of protection that indigenous peoples seek. Diné Decolonizing Education and Settler Colonial Elimination: A Critical Analysis of the 2005 Navajo Sovereignty in Education Act

abstract: In 2005 the Navajo Nation Tribal Council passed the Navajo Sovereignty in Education Act (NSEA). The NSEA has been herald as a decisive new direction in Diné education with implications for Diné language and cultural revitalization. However, research has assumed the NSEA will lead to decolonizing efforts such as language revitalization and has yet to critically analyze how the NSEA is decolonizing or maintains settler colonial educational structures. In order to critically investigate the NSEA this thesis develops a framework of educational elimination through a literature review on the history of United States settler colonial elimination of Indigeneity through schooling and a framework of decolonizing education through a review of literature on promising practices in Indigenous education and culturally responsive schooling. The NSEA is analyzed through the decolonizing education framework and educational elimination framework. Assembling Global (Non)Belongings: Settler Colonial Memoryscapes and the Rhetorical Frontiers of Whiteness in the US Southwest, Christians United for Israel, and FEMEN

abstract: Scholars of rhetoric, critical intercultural communication, and gender studies have offered productive analyses of how discourses of terror and national security are rooted in racialized juxtapositions between "East" against "West, or "us" and "them." Less frequently examined are the ways that the contemporary marking of terrorist bodies as "savage" Others to whiteness and western modernity are rooted in settler colonial histories and expansions of US and Anglo-European democracy. Informed by the rhetorical study of publics and public memory, critical race/whiteness studies, and transnational and Indigenous feminisms, this dissertation examines how memoryscapes of civilization and its Others circulate to shape geopolitical belongings in three cases: (1) public memory places in the US Southwest; (2) pro-Israel rhetorics enacted by the US organization Christians United for Israel; and (3) the embodied and mediated protests of European feminist organization FEMEN. In bringing these seemingly unrelated cases together as elements of a larger assemblage, I draw attention to their symbolic and material connectivities, examining the racialized, gendered, national, and imperial logics that move between these sites to shore up the frontiers of whiteness. Specifically, I argue for conceptualizing whiteness as a global assemblage that territorializes through settler colonial memoryscapes that construct "modern" national and global citizen-subjects as those deemed worthy of rights, protection, land, and life against the threatening bodies of Otherness seen to exist outside of the shared times and places of normative democratic citizenship. In doing so, I also examine, more broadly, how assemblage theory extends current approaches to studying rhetoric, public memory, and intercultural communication in global, trans/national, and (post)colonial contexts. / Dissertation/Thesis / Doctoral Dissertation Communication 2016

Religion, Colonialism, Diaspora: The Role of the Hindu Swaminarayan Sect in Indian Migration to Africa and the World

abstract: A new sect of Swaminarayan Hinduism emerged in the late eightieth century. This sect rapidly grew into a global organization due their highly structuralized nature. Fascinatingly, the new sect was able to create the feeling of home away from home in multiple countries. Through the establishments of mandirs, Hindu place of worship, practitioners were able to solidify the feeling of home away from home. Through books, magazine articles and letters the evidence of the new sect creating this feeling is overwhelming. Diaspora theory is woven within the thesis due to the global nature of the sect. This thesis uses a broad definition of diaspora to encompass the change in literature due to the ability of one to maintain close ties to their old homeland. Na África francófona muitos intelectuais usaram a literatura e o cinema como veículos de exaltação aos valores culturais da terra, de transformação social e política. O escritor e cineasta Sembène Ousmane pode ser considerado um destes intelectuais, uma vez que por meio de uma vasta produção literária e cinematográfica abordou temas recorrentes à sociedade na qual pertencia, fazendo dessas duas artes importantes aliadas no seu percurso de militante. A presente pesquisa visa estudar de que maneira a novela e o filme homônimo La noire de... exprimiram a visão do escritor e cineasta sobre de identidade cultural do Senegal. Para tanto, discutiremos o projeto literário e cinematográfico de Sembène, levando em consideração o contexto político do Senegal e da França. Além disso, discutiremos também o conceito de pós-colonialismo, por entender que esse campo teórico é imperativo para se pensar a identidade cultural senegalesa. / In Francofone Africa lots of intellectuals used literature and film-making as means of exaltation to the lands cultural values, social and political transformation. The writer and film-maker Sembène Ousmane can be considered one of these intellectuals, once through a vast literary and film production brought current issues about the society he belonged to, allying these two important pieces of art in his millitant path. The present research aims to study in which way the novel and the eponymous film La noire de... expressed the vision of this writer and director about the cultural identity of Senegal. Therefore, the literary and film Project of Sembène will be discussed, taking into consideration the political context of Senegal and France. Furthermore, we will also discuss the post-colonialism concept, for understanding that this theoretical field is highly importante to think about the Senegalese cultural identity.

By embracing this play, these writers engage in a politicized practice involving power-related issues. The character Caliban, in especial, has been adopted as a cultural icon of the colonized native populations. One of these writers is Augusto Boal, a famous Brazilian playwright and founder of the method The Theater of the Oppressed, a new way of acting whereby the spectator becomes a participant in the dramatic action ( spect-actor ). It establishes that a play must inspire the discussion of themes related to all types of oppression, fostering critical thinking and rehearsal for social change. Following the principles of The Aesthetics of the Oppressed, Boal makes an appropriation of Shakespeare s The Tempest, while in exile in 1979, during the military dictatorship period in Brazil, a fertile ground to retrieve Caliban as a symbol of oppression. Thus, this work aims to propose, in the light of the post-colonial theory, a comparative study on the oppressed as depicted in The Tempest of Shakespeare, and in its appropriation by Boal, with the same title. Recognizing that this appropriation denotes a more questioning inter-textual relation, in view of the critical approach it aims to adopt, we consider it a resistance against the conventional analyses of the Shakespearean text, as well as a privileged alternative to discuss the problems of oppression. / O século XX marca uma época em que escritores pós-coloniais despertam interesse por A Tempestade (1610), de Shakespeare, como capital cultural para destacar as desigualdades do encontro colonial e enfrentar os seus efeitos contemporâneos. Ao se apropriarem dessa peça, tais escritores se ocupam de uma prática politizada e atenta a questões relativas ao exercício do poder. Especialmente a personagem Caliban tem sido adotada como um ícone cultural, sendo considerada um emblema das populações nativas colonizadas. Um destes escritores é Augusto Boal, célebre dramaturgo brasileiro e criador do método do Teatro do Oprimido, que propõe uma nova maneira de fazer teatro, segundo a qual o espectador se transforma em sujeito da ação dramática ( spect-ator ). Em vista disso, uma peça de teatro, então, deve despertar o indivíduo para discutir temas relacionados a todo tipo de opressão e ensaiar ações que possam, efetivamente, modificar a vida em sociedade. Aos moldes da Estética do Oprimido, Boal se apropria d A Tempestade, de Shakespeare, e a reescreve, no exílio, em 1979, época de ditadura militar brasileira e momento bastante fecundo para retomar Caliban enquanto representante das opressões advindas deste encontro colonial. Em virtude disso, a presente dissertação se propôs a fazer um estudo comparativo, à luz da teoria pós-colonial, da figura do oprimido em A Tempestade, de Shakespeare, e na apropriação de mesmo título, realizada por Boal. Reconhecendo que a apropriação denota uma relação intertextual mais questionadora, em virtude da prática crítica que visa adotar, tomamos o texto de Boal como uma resistência às leituras convencionais do texto de Shakespeare, além de retomar um espaço textual privilegiado para abordar o problema da opressão.

Assim, procura-se analisar como o domínio da língua portuguesa em sua forma culta assume um papel de distinção dentro da sociedade angolana e se, mesmo com o fim da colonização, ainda é possível observar alguns resquícios coloniais nessa sociedade. / The research aims to understand, according to Angola’s colonization context and its process, how the organization of the Angolan society happened, focusing the analysis on the role of the Portuguese language since its establishment as the country’s official language. This study englobes decisive moments of the Angolan history as, the already mentioned, moment when the colonization actually started, the setting of independence movements – mainly the “Movimento Popular de Libertação de Angola” – MPLA (Popular Movement for Angola’s Liberation) –, the struggle for Angola’s independence and, finally, the constitution of a free country, led by MPLA. Thus, the research aims to analyze how the knowledge of the Portuguese language, in its cultured form, assumes a role of social distinction among the Angolan society and that, even after the colonization period, it is still possible to observe some colonial vestiges in this society.

Samerna & Herr Erik : En postkolonial studie om kolonisationen av Sápmi genom en prästs ögon / The Saami and Mr Grape : A postcolonial study about the colonization of Sápmi through the eyes of a priest.

The purpose of this study is to examine the colonisation of Sápmi though the works of a local priest, by the name of Eric Grape. To do so, this study uses postcolonial theory when analysing the content of the works by Grape. Eric Grape was a priest active in the Lappmarks of northern Sweden in the early nineteenth century and who wrote articles for the Swedish Royal Academy of Sciences. The focus of the study is the othering of the Saami people and their culture, and the colonial production of knowledge that Grape produced about the Saami. Othering is a term by Edward Said and it is about the constructed difference between “we” the European culture and people regarded as the “other”. This term, the study argues, can also be applied when studying the colonial encounters between the Saami and Swedish colonial actors such as Grape. The main result of this study is that Grape portrays the Saami as different and more primitive than the Swedish settlers that occupy the northen part of Sweden, he describes the Saami as childish.

A presente tese pretende estabelecer as confluências entre romances de três autoras distintas. Partindo de um viés womanista, dois romances de cada escritora foram analisados e suas similaridades enfocadas, principalmente no que concerne ao tratamento dado às personagens femininas. A tese é composta de cinco capítulos. O primeiro lida com conceitos e temas subjacentes ao debate em torno das literaturas produzidas pelas chamadas minorias. Já o segundo, mergulha no universo literário de Conceição Evaristo, nossa autora afro-brasileira. O terceiro segmento aborda a literatura da afro-americana Toni Morrison. No quarto capítulo, enfocamos a obra da moçambicana Paulina Chiziane. A costura do texto é alinhavada no quinto capítulo, quando tecemos considerações finais sobre as semelhanças e particularidades de cada autora / The present thesis intends to establish the confluences between novels by three distinct authors. From a womanist perspective, two novels by each author were analyzed and their similarities were highlighted, especially concerning the treatment provided to the female characters. The thesis is made up of five chapters. The first one deals with concepts and themes underlying the debate about the literatures produced by the so-called minorities. The second chapter dives into the literary universe of our Afro-Brazilian writer, Conceição Evaristo. The third segment of the thesis focuses on the literature of the Afro-American Toni Morrison. The fourth sheds light on the works of the Mozambican Paulina Chiziane. The sewing of the text receives its finishing touches in the fifth chapter, where we elaborate final considerations on the similarities and peculiarities of each author

O legado imperialista do direito internacional : um estudo crítico sobre o imperialismo e a constituição da ordem legal internacional contemporânealatino-americanos

Trata-se de um estudo crítico e interdisciplinar acerca da relação histórica entre os processos de formação, universalização, modernização e institucionalização do direito internacional e o fenômeno do imperialismo, compreendido no contexto das diferentes fases de desenvolvimento do sistema capitalista mundial moderno. A partir da articulação de um arcabouço teórico-metodológico crítico, o estudo busca compreender a evolução e o desenvolvimento histórico do direito internacional (suas normas, práticas, princípios e instituições) no contexto das diferentes fases de expansão geográfica do capitalismo, ou seja, das atividades comerciais, financeiras e militares das potências imperialistas sobre os territórios periféricos da economia mundial. O objetivo primário é investigar a natureza desta relação histórica, buscando identificar de que modo o direito internacional contribuiu, no passado, para dar forma e legitimidade às práticas (diretas e indiretas, formais e informais, coloniais e neocoloniais) do imperialismo. Uma vez constatado o passado imperialista da disciplina, o objetivo secundário passa a ser analisar, de forma crítica, o “novo” direito internacional estabelecido no século XX, sobretudo após a Segunda Guerra Mundial, com o intuito de compreender em que medida esta nova estrutura legal internacional continuou a legitimar e a permitir as práticas do imperialismo, a despeito de sua nova retórica universalista, baseada nos direitos humanos, no desenvolvimento, e na cooperação internacional. Em outras palavras, busca-se compreender em que medida as principais transformações do direito internacional do século XX representaram uma ruptura com o passado imperialista da disciplina. Assim, a partir da articulação das principais teorias críticas da história do direito internacional, concluiu-se que a relação entre direito internacional imperialismo é estrutural, mútua e constante; que transcende a forma colonial, e que continua presente nas formas contemporâneas do capitalismo global e nas práticas contemporâneas do direito internacional (principalmente do direito internacional econômico). / This is a critical interdisciplinary research on the historical relationship between international law and imperialism. More specifically, it is a study on the historical relationship between the correlated processes of formation, universalization, modernisation and institutionalisation of international law and the different phases of development of the world capitalist system. The dissertation seeks to comprehend the historical development and evolution of modern international law (its norms, practices, principles and institutions, from 16th century naturalism to 20th century pragmatism) in the light of the different phases of the economic and geographical expansion of capitalism over the peripheral territories of the world economy. The primary goal is to investigate the nature of such relationship, with an aim to identify in which ways international law has contributed to the shaping and legitimation of (either formal or informal, colonial or neo-colonial) imperialist practices. The secondary goal is to analyse, from a critical standpoint, the “new” international law established in the 20th century with a view to understand to what extent this new international legal structure has continued to shape and legitimise imperialist practices, in spite of the new universalist rhetoric based on human rights, development and cooperation. In other words, the study seeks to comprehend to what extent the main 20th century transformations in international law represented or not a break from the discipline’s imperialist past. That is, to what extent they have changed the nature of the historical linkage between international law and imperialism. With the articulation of the most recent and important critical international legal scholarship the dissertation concluded that the relationship between international law and imperialism is structural, mutual and constant; that it transcends the colonial form; and that it remains present in the contemporaneous forms of global capitalism as well as in the contemporaneous practices of international law (specially international economic law).
