The experience of this violence process brings implications to the person constitution. Thus, this research aimed to understand how commercial sexual exploited adolescents to signify the childhood. Participated of this research four female adolescents that had been assisted by Programa de enfrentamento ao Abuso e Explora??o Sexual de Crian?as e Adolescentes (Sentinela) , with ages between 12 and 17 years. The corpus was composed by the combination of the semi-structured interview and other procedures, like childish stories, draws and photography. Moreover, we used another instruments to constitute the corpus, like the documental research and we proposed the construction of a life story book of each participant. The corpus was analyzed through the Thematic Content Analysis. Five thematic axes emerged from the participants discourse and theoretical perspective: dynamical of family, scholar process, ludic behavior, conception of childhood and insertion on CSE process. The participants presented a conception about childhood as been a preparation and education phase to ingress in adult life. In other words, while children do not grown up, they go to the school, plays, lives with family, are happy and do not have any responsibilities. Nevertheless, the life experience of these girls was implicated by negligence, sexual abuse, child labor, institutionalization and, evidently, the commercial sexual exploitation. Understanding that the childhood experienced by adolescent, as well as, her insertion on CSECA, constitutes her, while person, we investigated how the interrelation expresses it on participants future perspectives. Their goals are defined based on family constitution and professional improvement, although feelings of disillusion and pessimism had been showed up in some moments. According these results, we pointed to the necessity of the effective proposals that promote real improvement of adolescents life quality, through, in which they could to create alternatives to get over the several risks in which they are exposed, mainly, the CSECA condition / Observamos que a inf?ncia vem sendo alvo de grande preocupa??o nos tempos atuais, constituindo-se em diversos contextos, dentre eles, o da explora??o sexual comercial (ESC). A viv?ncia de tal processo de viol?ncia traz implica??es para a constitui??o do sujeito. Nesse sentido, esta pesquisa objetivou compreender como adolescentes em situa??o de explora??o sexual comercial significam a inf?ncia. Participaram da pesquisa quatro adolescentes do sexo feminino, com idades entre 12 e 17 anos, atendidas pelo Programa de Enfrentamento ao Abuso e Explora??o Sexual de Crian?as e Adolescentes (Sentinela). Para composi??o do corpus de pesquisa, aliamos a entrevista semi-estruturada a outros procedimentos, como hist?rias infantis, desenho e fotografia. Acrescente-se a esses procedimentos a an?lise documental e a constru??o de um ?lbum da hist?ria de vida de cada participante. O corpus foi analisado ? luz da An?lise de Conte?do Tem?tica. Cinco eixos tem?ticos emergiram dos relatos das participantes e das reflex?es te?ricas, a saber: din?mica familiar, processo de escolariza??o, ludicidade, concep??o de inf?ncia e o processo de inser??o na ESCCA. Pudemos observar que as participantes t?m uma concep??o de inf?ncia marcada pela id?ia desta enquanto fase de prepara??o e de educa??o para o ingresso na cultura adulta. Ou seja, enquanto n?o cresce, a crian?a vai ? escola, brinca, mora com a fam?lia, ? feliz e n?o tem responsabilidades. Por?m, a viv?ncia de inf?ncia dessas meninas foi comprometida por situa??es de neglig?ncia, especialmente materna, abuso sexual, trabalho infantil, institucionaliza??o e, evidentemente, de explora??o sexual comercial. Entendendo que as viv?ncias de inf?ncia, assim como a inser??o na ESCCA, s?o constitutivos do sujeito, investigamos como essa inter-rela??o se manifesta nas perspectivas de futuro das participantes. In social interactions, people with whom subject relates himself assign meanings to him and, from these, the subject will ressignify, producing sense about himself. In other words, is through these interactions that subjects organizes themselves, recognize what is yours, and acquire the sense about themselves. It can be highlighted, too, the social-historic context s importance in the self-constitution process, whereas, from this, the subject produces particular forms of perception about reality charged with cultural meaning. Thus, the self-conception, the manners of thinking, of being, of relates, of take position against experiences, coming from values internalization, roles and related, are permeated by the manner witch the others relates themselves with the subject. However, when the relation with the other happens to be in a violent way, like in children sexual abuse, there are implications in the subjects constitution, whereas violates his physical and psychological integrities, as well as the rights of dignity, respect and even healthy physical, psychological and sexual developments. Therefore, this work aims to investigate how the identity process is constituted in children victims of sexual abuse. As specific aims the research proposes: 1) to characterize the relations between child and abuser, before and after the abuse act; 2) to identify images that the subjects, abuse victims, have about themselves and; 3) to identify the features of subject s relation with their own body. Toward this aims, procedures involving drawings, painting, collage, photography, activities with cardboard, colored pens, glue and tissue snips. The research took place at the Social Assistance Specialized Reference Center, where there is the treatment of children who suffered of rights violation, which includes sexual abuse. The research subjects were 3 girl children, between 6 and 10 years old, victims of sexual abuse. The corpus analyses was done through Thematic Content Analysis, structured in three meaning nucleus: 1) self-reference without the explicit attendance of other s discourse; 2) self-reference with the explicit attendance of other s discourse; 3) The other abuser. The analysis indicates that children, research subjects, have deteriorated images about themselves, about their bodies, which is consistent with the studies in the children and adolescents sexual violence field. In the other hand, were identified, too, self-references with positive values in the cases with mention about their way-of-being, which can be read as important to subject s development. About the other s discourse towards the subjects, were identified positive observations and found that these can contribute to subject s self-image reorganization. The contribution of negative comments, on the other hand, was showed in a more clear and incisive form in subject s constitution. There is, yet, an overvaluation of the other s discourse, so the meanings attributed toward them by the other are internalized, overshadowing the self-appreciation. To conclude, it can be highlighted that the need of psychological accompaniment of the children victims of sexual abuse, based on the possibility of this trauma experience elaboration, trying to overcome, as well as can be expected that this research s results contributes to the practices of professionals who work with subjects who have their rights violated / A identidade do sujeito ? constitu?da na rela??o com o outro, a qual se caracteriza pela dialeticidade e se configura como um movimento de identifica??o e/ou reconhecimento, e estranheza e/ou afastamento. Nas intera??es sociais, as pessoas com as quais o sujeito se relaciona atribuem significados a ele e, a partir desses, o sujeito ir? ressignific?-los, produzindo sentidos de si mesmo. Ou seja, ? por meio dessas que os sujeitos se organizam, percebem o que lhes ? pr?prio, e adquirem o senso de si mesmo. Destaca-se, tamb?m, a import?ncia do contexto s?cio-hist?rico no processo de constituir-se, pois, a partir deste, o sujeito produz formas particulares de percep??o da realidade carregadas de significa??o cultural. Portanto, a concep??o de si, a forma de pensar, de ser, de se relacionar, de se posicionar diante das viv?ncias, oriundas da internaliza??o dos valores, normas e afins, ? perpassada pela maneira com que os outros se relacionam com o sujeito. Entretanto, quando a rela??o com o outro se d? de forma violenta, como no abuso sexual de crian?as, h? implica??es na constitui??o do sujeito, pois viola sua integridade f?sica e psicol?gica, assim como o direito ? dignidade, ao respeito e ao pr?prio desenvolvimento f?sico, psicol?gico e sexual salutar. Assim, este trabalho tem por objetivo investigar como se constitui o processo de identidade de crian?as v?timas de abuso sexual. Como objetivos espec?ficos a pesquisa se prop?e a: 1) caracterizar as rela??es entre crian?a e abusador, anterior e posterior ao abuso; 2) identificar imagens que os sujeitos, v?timas de abuso, t?m de si e 3) identificar as caracter?sticas da rela??o do sujeito com o pr?prio corpo. Para tanto, foram realizados procedimentos envolvendo desenho, pintura, colagem, fotografias, atividades com cartolina, canetas coloridas, cola e retalhos de tecido. A pesquisa foi realizada no Centro de Refer?ncia Especializado em Assist?ncia Social, onde h? o atendimento a crian?as que sofreram viola??o dos seus direitos, dentre os quais se inclui o abuso sexual. Os sujeitos da pesquisa foram tr?s crian?as, do sexo feminino, com idade entre 6 e 10 anos, v?timas de abuso sexual. A an?lise do corpus foi realizada por meio de An?lise de Conte?do Tem?tica, estruturando-se em tr?s n?cleos de sentido: 1) refer?ncia a si mesmo sem o comparecimento expl?cito do discurso do outro; 2) refer?ncia a si com o comparecimento expl?cito do discurso do outro e 3) O outro abusador. As an?lises indicam que as crian?as, sujeitos da pesquisa, possuem uma imagem de si, de seu corpo, deteriorada, informa??o condizente com os estudos na ?rea de viol?ncia sexual em crian?as e adolescentes. Por outro lado, foram identificadas, tamb?m, refer?ncias a si com conota??o positiva nos casos em que aludiam ao seu jeito de ser, o que se configura como importante para o desenvolvimento dos sujeitos. Acerca do discurso do outro em rela??o aos sujeitos, foram identificadas observa??es positivas e constatou-se que tais considera??es podem contribuir para que o sujeito reorganize a imagem que tem de si. A contribui??o dos coment?rios negativos, por sua vez, apresentou-se de forma mais clara e incisiva na constitui??o do sujeito. Ainda, h? uma supervaloriza??o do discurso do outro, de forma que os significados atribu?dos a elas, pelo outro, s?o internalizados, ofuscando a valora??o de si. Por fim, ressalta-se a necessidade do acompanhamento psicol?gico de crian?as v?timas de abuso sexual, pela possibilidade de elabora??o da viv?ncia desse trauma, na tentativa de supera??o, bem como se espera que o produto desta pesquisa contribua para a pr?tica dos profissionais que atuam junto aos sujeitos que t?m seus direitos violados

The third reflects on the impact of environmental principles in public administration, with emphasis on the precautionary principle. Still, it addresses the environmental police power in the sphere of jurisprudence, demonstrating how the judiciary has decided through this instrument. O direito ? sa?de ? tipificado na Constitui??o Federal como direito fundamental social, e compreende a pretens?o de obter do Estado, o fornecimento de bens ou a presta??o de servi?os que reduzam o risco de doen?a e de outros agravos; ou, promovam, protejam e recuperem o bem estar f?sico e ps?quico. Uma vez violado o direito fundamental ? sa?de, disponibiliza ao administrado, dentre outras garantias fundamentais, a responsabilidade civil extracontratual do Estado. A presta??o de servi?os p?blicos pelo Estado pode ser feita diretamente, por meio da Administra??o P?blica Direta ou Indireta, ou pelo recurso a entes privados. De todo modo, a presta??o de servi?os de sa?de p?blica se encontra integralmente subordinada aos princ?pios de Direito Administrativo, devendo ser integralmente custeada pelas receitas tribut?rias. Como a presta??o de servi?os de sa?de p?blica faz parte da atividade administrativa do Estado, n?o h? como se afastar a aplicabilidade da garantia da responsabilidade civil extracontratual do Estado em face dos danos sofridos pelos administrados enquanto usu?rios desses servi?os. Por conseguinte, aplica-se a teoria do risco administrativo, mesmo nas hip?teses de omiss?o estatal lesiva e il?cita. / This study aims to examine the Brazilian legal model for the non-contractual liability of the state in providing public health services, from the perspective of threedimensional theory of law. Up based on bibliographical and documentary research, with emphasis on legislation, doctrine and Brazilian jurisprudence, the following conclusions were reached. The right to health is typified in the Constitution as a social fundamental right, and understands the pretension to obtain from the State, the supply of goods or the provision of services that reduce the risk of disease and other health problems; or promote, protect and recover the physical and mental well-being. Once violated the fundamental right to health, provides the managed, among other fundamental guarantees, the non-contractual liability of the state. The provision of public services by the state can be made directly through the Direct or Indirect Public Administration, or by recourse to private entities. In any case, the provision of public health services is entirely subordinate to the principles of administrative law and should be fully funded by tax revenues. As the provision of public health services is part of the administrative activity of the State, there is no way to exclude the application of the guarantee of non-contractual liability of the state in the face of the damage suffered by administered as users of these services. Therefore, it applies the theory of administrative risk, even in the event of harmful and illegal state failure.

The objective is to analyse the main version of the theme (for instance: the impacts caused to the dissociation of the Procurations theory), so that it can be extracted the philosophy and the general theory, of the public civil action and collective tutelaging in general, pragmatically applicable to study purposes. With this theorical fountain, the reader will be in a more solid position, not only being able to understand the subtilities of the public civil action, but mainly being able to recognize its faults and present solid reform proposals and improvement. The mark to mediate of all this is, in fact, the defense and the consumer's protection, once this is final addressee of whatever if it puts at the consumption market. The coming of the Law 8.078/90, Code of Protection and Defense of the Consumer, inaugurates a time of effective concern with the homogeneous individual interests originating from of the consumption relationships. In this point, the focus of main to face of the present work lives, in other words, the protection of the right to the individual property, especially manifests in the exercise of the trade freedom that keeps direct relationship with the respective social function the one that is destined. The code of the consumer's defense doesn't just take care of this, but also of the other star of the relationships of the consumption. When affirming in the interruption VI of the art. 4th that the national politics of those relationships, finds ballast in the prohibition and repression efficient of all of the abuses committed in the consumption relationships, keeping inherent relationship-causality in the economical order, sculpted for the article 170 in the Constitution of 1988. In the generic plan, the mark of the present work is to question concerning the limits of the trade freedom and previsible collisions with protection norms and the consumer's defense, as well as factual convergences of those small systems, especially in what he/she refers to the innate interests to the suppliers. In the specific plan, we aspirated to identify the protection device-commands to the actors of the trade relationship, capable to guarantee the free competition in a global economy of market, seeking especially the Well-being, for soon afterwards, in an analytical perspective, to discover the possible applications that it holds the Federal Constitution, in headquarters of economical freedoms. It was observed that the consumer today doesn't need only of laws that their needs, fruit of the vulnerability that it is him/her meditate innate. He/she lacks, yes, of effective mechanisms that prevent lesions that can be them impinged by the suppliers at the time in that you/they are useful to repair the damages when happened, punishing the author of the damage / A Constitui??o Federal de 1988, ao cuidar da ordem econ?mica, denota especial preocupa??o em coibir os abusos do poder econ?mico e a concorr?ncia desleal. O escopo mediato de tudo isso ?, de fato, a defesa e prote??o do consumidor, uma vez que este ? destinat?rio final de tudo quanto se p?e no mercado de consumo. O advento da Lei 8.078/90, C?digo de Prote??o e Defesa do Consumidor, inaugura um tempo de efetiva preocupa??o com os interesses individuais homog?neos oriundos das rela??es de consumo. Neste ponto, reside o foco de enfrentamento principal do presente trabalho, ou seja, a prote??o do direito ? propriedade individual, manifesta especialmente no exerc?cio da liberdade de com?rcio que guarda rela??o direta com a respectiva fun??o social a que se destina. Ao afirmar no inciso VI do art. 4? que a pol?tica nacional dessas rela??es, encontra lastro na proibi??o e repress?o eficientes de todos os abusos cometidos nas rela??es de consumo, guardando intr?nseca rela??o-causalidade na ordem econ?mica, insculpida pelo artigo 170 na Constitui??o de 1988. No plano gen?rico, o escopo do presente trabalho ? perquirir acerca dos limites da liberdade de com?rcio e previs?veis colis?es com normas de prote??o e defesa do consumidor, bem como factuais converg?ncias desses microssistemas, especialmente no que se refere aos interesses inerentes aos fornecedores. No plano espec?fico, aspiramos identificar os dispositivos-comandos de prote??o aos atores da rela??o de com?rcio, capazes de garantir a livre concorr?ncia em uma economia global de mercado, visando primordialmente o Bem-Estar, para em seguida, numa perspectiva anal?tica, averiguar as poss?veis aplica??es que comporta a Constitui??o Federal, em sede de liberdades econ?micas. By means of a correct and efficient distribution and application in the national region, the royalties constitute financial resources available for implementing public policies that intend to guarantee the fundamental rights; above all, with the discovery of the Pre-salt basin and the indisputable rise in the tax revenues arising from Oil exploration. In the making of this work, the theoretical-descriptive methodology is observed, grounded in a critical-reflexive analysis about Constitutional Law and Oil Law. This work analyzes the administrative model of the Brazilian State, the theory of costs of fundamental rights and the theoretical aspects about royalties, such as: the ethical and economical fundamentals, the distribution and destination of revenues, considering the oil exploration scenario before and after the discovery of the pre-salt basin. it is verified, with the present work, the importance of the creation of a new regulatory framework, and consequently the creation of a sovereign wealth fund, which arises to re-evaluate the application of the current norms of Oil revenue distribution. Still, it is imperative that the mechanisms for controlling the application of royalties are defined in detail, so that those can fully admit the objectives of intra/intergenerational justice. Furthermore, it is emphasized that this process should develop from the efficiency principle viewpoint, as well as the principle of reducing social and regional differences, given that the Oil revenues might be used to ensure fundamental social rights, by implementing public policies that are aligned with the development recommended by the Federal Constitution / O Modelo Administrativo do Estado Brasileiro, baseado na regula??o, busca, na aplica??o do Princ?pio da Efici?ncia e na aferi??o dos custos econ?micos, dar efetividade aos Direitos Fundamentais, atrav?s da implementa??o de Pol?ticas P?blicas. O objetivo deste trabalho consiste em analisar o papel dos royalties de petr?leo no contexto do Estado Brasileiro, uma vez que, por ser uma renda diferencial, podem funcionar como um mecanismo promotor de justi?a intra/intergeracional. Atrav?s de uma correta e eficiente distribui??o e aplica??o no territ?rio nacional, os royalties constituem recursos financeiros dispon?veis para concretiza??o de pol?ticas p?blicas que pretendem garantir os direitos fundamentais; principalmente com a descoberta da bacia Pr?-sal e o incontest?vel aumento na arrecada??o das rendas petrol?feras. However, the significative changes have happened in the last fifteen years, due to market opening arising from the relaxation of the state monopoly over the Oil deposits and its derivatives. The edition of the Constitutional Amendment #9, changing the first paragraph of the 177th item of the Federal Constitution, marked the end of a stiffness about the monopoly that the Brazilian state kept in relation to the exploration and research of Oil and Gas. The economical order was fundamental to actualize the idea contained in the #9 Amendment, since its contents has the power to set up measures to be adopted by public power in order to organize the economical relations from a social viewpoint. The new brazilian Oil scenery, called pre-salt, presents itself in a way to amaze the economical markets, in addition to creating a new perspective to the social sector. This work will identify, in this new scenario, the need for change in the legal system. Nevertheless, this subject must not be treated in a thoughtless way: being an exhaustible good, we shall not forget that the future generations also must benefit from the exploration of natural resources recently discovered. The settlement of a new regulatory mark, including the change in the concession contract model to production and sharing is one of the suggested solutions as a bill in the National Congress, in an attempt to ensure the sovereignty of the nation. The constitutionality of a new regulatory mark is questioned, starting from an analysis of the state monopoly, grounding the comprehnsions in the brazilian constitutions, the relevance of the creation of Petrobras for self-assertion of the state about the monopoly of Oil and derivatives, and its posture after the Constitutional Amendment n? 9 (1995), when a company stops having control of the state monopoly, beginning to compete in a fairly way with other companies. The market opening and private initiative are emphasized from the viewpoint of the Constitutional Principles of the Economical and Social Order. The relaxation of the monopoly regarding the exploratory activity in the Federal Constitution doesn't deprive from the Union the ownerships of underground goods, enabling to this federal entity to contract, directly or by concession of exploration of goods, to state-owned or private companies. The existing oil in the pre-salt layer transforms the scenario from very high risk to low risk, which gives the Union the possibility of defining another way of exploring this resources in the best interests of the Public Administration / A ind?stria do petr?leo no Brasil passou por v?rias etapas durante o processo hist?rico econ?mico, pol?tico e social. Todavia, suas significativas mudan?as ocorreram nos ?ltimos quinze anos, atrav?s da abertura do mercado decorrente da flexibiliza??o do monop?lio estatal sobre as jazidas de petr?leo e seus derivados. A edi??o da Emenda Constitucional n? 9, alterando o par?grafo 1?, do art. 177 da Constitui??o Federal, caracterizou o fim de uma rigidez quanto ao monop?lio que o Estado brasileiro mantinha em rela??o ? pesquisa e explora??o de petr?leo e g?s. A ordem econ?mica foi fundamental para efetivar a id?ia contida na Emenda n? 9, visto que seu conte?do tem o cond?o de estabelecer medidas a serem adotadas pelo poder p?blico a fim de organizar as rela??es econ?micas, sob o vi?s social. O novo cen?rio petrol?fero brasileiro, denominado pr?-sal, apresenta-se de forma a surpreender os mercados econ?micos, al?m de criar uma nova perspectiva para o setor social. O presente trabalho identificar? no novo cen?rio a necessidade de mudan?a do regime jur?dico, todavia, esse assunto n?o pode ser tratado de forma imediatista: como se trata de um bem esgot?vel n?o se deve esquecer que as gera??es futuras tamb?m precisam beneficiar-se da explora??o dos recursos naturais rec?m-descobertos. O estabelecimento de um novo marco regulat?rio, incluindo a mudan?a do modelo de contrato concess?o para produ??o e partilha ? uma das solu??es propostas a n?vel de projeto de lei no Congresso Nacional na tentativa de garantir a soberania da na??o. Questiona-se a constitucionalidade de um novo marco regulat?rio, partindo-se da an?lise do monop?lio estatal, resgatando a compreens?o nas constitui??es brasileiras, a relev?ncia da cria??o da Petrobras para auto-afirma??o do Estado quanto ao monop?lio de petr?leo e derivados, e sua postura ap?s a Emenda Constitucional n? 9 de 1995 quando a empresa deixa de ter o controle do monop?lio estatal, passando a concorrer de forma igualit?ria com outras empresas. Ressalva-se a abertura do mercado e a iniciativa privada sob ?tica dos Princ?pios Constitucionais da Ordem Econ?mica e Social. A flexibiliza??o do monop?lio quanto a atividade explorat?ria na Constitui??o Federal n?o retira da Uni?o a propriedade dos bens do subsolo, possibilitando a este ente federal a contrata??o direta ou atrav?s de concess?o da explora??o do bem a empresas estatais ou privada. The adopted research method was based in historic enrolment of the appearance among people since the bases of the word dignity until the acceptation of this value in the Brazilian society. This research searched dignity s doctrinaire valuation at the juridical point of view and the way of appreciation of this value, in its condition of constitutional principle, by the Brazilian Judicial Power.
