Written under the pseudonym Johannes de Silentio, it is a compliment to the faith of the biblical patriarch Abraham, especially that presented in the Scripture account of the proof to which God submitted him: the request that he sacrifice his son Isaac. In order to do so, the contextualization of the author's thinking in Fear and Trembling was first carried out. The identification of relevant events in his biography and the summary of his literary work showed that Kierkegaard called himself a religious author, whose reflection was aimed at understanding existence and the christian being. The Lutheran state church and the Lutheran pietist movement formed the cultural-religious milieu in which the Danish author was formed, both influencing his thinking and composing the background of his reflections in the opus under investigation. Theology, philosophy, ecclesiastical practice, and Christianity of his time were criticized by him. In Fear and Trembling, these were elaborated by arguments referring to the theological-philosophical conceptions of Lutheranism-Pietism, Kant, the liberal theology and Romanticism of Schleiermacher, Hamann and, especially, Hegel. The Problemata, central to Kierkegaard's opus and arguments, is composed of three chapters, which present the ethical problems derived from Abraham's willingness to sacrifice Isaac, titled: "Is there a teleological suspension of the ethical?, "Is there an absolute duty to God?" and "Has it been ethically defensible on the part of Abraham to have kept silent about his purpose before Sarah, Elieser, and Isaac??. The interpretation of the text allowed the conclusion that, in Fear and Trembling, reason is unable to explain Abraham, for ethics can not justify his attitude. Faith is the category through which the patriarch can be understood, paradoxically related to existence and occurs as a passion, in function of the absurd; part from the resignation before the infinite, in a double movement which returns to the finite to receive Isaac back. The Problemata also presents other categories, associated with the faith of Abraham, among which were identified and analyzed ethics, anxiety, trial, repetition, individuality and subjectivity. The presence of these categories in the patriarch's existence demonstrated a faith that occurs as interiority and is not limited to ethics. In order to obtain a greater breadth in the analysis of faith and the other categories, these were correlated with two other literary productions of Kierkegaard, in which they are present in different conceptual levels, namely, The repetition and The concept of anxiety. As a result, Abraham's faith proved to be a suprarational instance of thought and religious experience, from the phenomenological perspective, of openness to transcendence and belief in divine providence, seeking to overcome the limitations of existence. In addition, the faith presented in Fear and Trembling suggests unfolding of individual religious manifestation today, a "non-religious faith" unrelated to religious dogmas and institutional ecclesiastical authority, lived in the interior as an existential relationship with God. / A presente disserta??o tem por objetivo analisar a rela??o f? e exist?ncia na obra Temor e tremor, do pensador dinamarqu?s S?ren Aabye Kierkegaard, presente na se??o Problemata. Escrita sob o pseud?nimo Johannes de Silentio, ? um elogio ? f? do patriarca b?blico Abra?o, especialmente a apresentada na narra??o das Escrituras sobre a prova ? qual Deus submeteu-o: o pedido de que sacrificasse o filho Isaac. Para tanto, foi realizada primeiramente a contextualiza??o do pensamento do autor em Temor e tremor. A identifica??o de acontecimentos relevantes em sua biografia e do resumo de sua obra liter?ria evidenciou que Kierkegaard denominou-se um autor religioso, cuja reflex?o visava ? compreens?o da exist?ncia e do ser crist?o. A Igreja Luterana estatal e o movimento pietista luterano formaram o ambiente cultural-religioso em que o autor dinamarqu?s fora criado, os quais tanto influenciaram seu pensamento, quanto compuseram o pano de fundo de suas reflex?es na obra pesquisada. A teologia, a filosofia, a pr?tica eclesi?stica e o cristianismo de sua ?poca foram alvo de suas cr?ticas. Em Temor e tremor, estas foram elaboradas por argumentos referidos ?s concep??es teol?gico-filos?ficas do luteranismopietismo, de Kant, da teologia liberal e do romantismo de Schleiermacher, Hamann e, especialmente, de Hegel. The basis of my work represents a research focused on the problematic of native XML databases. The main goal is to draw comparison between the selected database systems in a sphere of user control and management of XML data. Database products are tested via XMark benchmark test using its XQuery queries and testing XML data. Final comparisons and recommendations for use are based on the concluding evaluation and findings. The results of research may improve orientation in solved problematics. They could help with the selection of a suitable database product to store XML data.

HAMMARBY: BETWEEN HAMMER AND ANVILA -case study over collaborative planning in the Swedish municipality of Västerås

Collaborative planning is an often-debated approach in conjunction with attaining more sustainable cities. Many models were theorized to help implement a more collaborative planning process, such as when municipalities employ densification to grow the city sustainably. However, not all planning processes that are collaborative are also rational. Hence, this thesis is interested in comprehending Västerås Municipality’s planning process through performing a case study regarding DP-1858. To that end, this thesis will follow Innes & Booher (2018) Collaborative rationality theory and use its DIAD model as a lens to understand the positions of the stakeholders involved in the DP-1858 case. In the same vein, to probe for how the collaborative planning process regarding DP-1858 resonates with the DIAD model of Collaborative rationality.Nevertheless, the reaction of the Hammarby-residents raises the need for framing to understand if a concept such as insurgent citizenship is sensible to norms. Thus, it is essential to know how insurgent citizenship manifests itself in a Swedish context. The method used to collect primary data was semi-structured interviews with elite respondents. Among other conclusions, this study found enough evidence suggesting that the planning process in conjunction with DP-1858, even though having embedded collaborative mechanisms, has critical shortcomings when contrasted with the collaborative rationality DIAD model. In the same vein, insurgent citizenship can occur even when laws were respected while norms were not.

Cette étude esquisse un réseau dynamique des expériences mélancoliques chez Simone de Beauvoir, du point de vue de l’autobiographie et de la philosophie de l’existence. En transformant en désir d’exister la passion inutile de l’homme vers l'être chez Jean-Paul Sartre, la pensée beauvoirienne se repose sur la problématique de la morale, l’existence de l’individu concret et séparé du monde, ainsi que la relation intersubjective. Cependant elle aspire sans cesse à l’Absolu abstrait qui la conduit inévitablement à la frustration ontologique, qui est une structure inhérente à la mélancolie. Ainsi s’établit un dialogue permanent dans son oeuvre-vie, que nous ont révélé ses autobiographies, entre désir d’exister et non-désir qui est exprimé par l’apathie, la fatigue et le dégoût. Cela nous aide à déterminer l’existence de la mélancolie chez elle. La tâche est cependant rendue difficile par son ambition de décrire la totalité de la vie et du monde. De plus, les instants et les sentiments mélancoliques sont dispersés à travers toute une vie, racontée par l’autobiographe qui joue le jeu de l’ombre-claire. Bien que l'on risque de perdre ce qui en fait la spécificité et la complexité, la mélancolie nous paraît inaccessible sans la lier à ses métamorphoses. C’est pourquoi nous effectuons une étude soigneuse de ces autobiographies pour en suivre les instants et les sentiments : la solitude de l’ennui adolescent, la mélancolie d’amour, l’impuissance du sujet politique, le deuil des êtres chers, jusqu’à l’angoisse du temps et du vieillissement. Le premier chapitre tente de dégager une infrastructure philosophique de la mélancolie, qui est la tension entre désir d’exister et non-désir. La recension de la représentation littéraire et de l’ontologie phénoménologique de la mélancolie chez Sartre, et les nouveaux apports de Simone de Beauvoir dans l’après-guerre, nous incitent à discerner une théorie de la mélancolie féminine dans Le Deuxième Sexe. Étant donné la similitude des expériences vécues entre son projet féministe et son projet autobiographique, nous cherchons à construire un réseau intertextuel entre son écriture de soi et sa théorie anthropologique existentielle des femmes, en étudiant nécessairement les romans corrélés. En tenant compte du petit nombre de pages, notre choix se porte plutôt sur ses autobiographies, ainsi que sa théorie et ses romans sur les femmes qui servent de références essentielles. Dans les chapitres suivants, nous tachons d'explorer les expériences vécues par/avec Beauvoir, dans la mesure où elles concernent la mélancolie. Le deuxième chapitre porte exclusivement sur le récit d’enfance, en vue de son autonomie relative aux récits ultérieurs, et se concentre sur la solitude et l’ennui adolescent. Le troisième chapitre essaie d’établir une relation entre la passion amoureuse et la mélancolie. Le quatrième constate l'impuissance du sujet dans l’expérience de la guerre. Le cinquième tache de découvrir la relation entre mère et fille dans l’essai du deuil maternel, et à partir de cela, d’examiner son dernier roman pour connaître la diversité de la mélancolie féminine. Le dernier chapitre veut rassembler les moments indépassables de l’être humain autour de la mort et de l’angoisse du temps, pour éclaircir leur rapport à la mélancolie chez notre auteur. / This study outlines a dynamic network of melancholic experiences in Simone de Beauvoir, from the perspective of autobiography and philosophy of existence. Transforming into "desire to exist", the useless passion human towards the Being in Jean-Paul Sartre, Beauvoir's thought rests on the problem of morality, of the existence of the concrete and separate individual in the world, as well as the intersubjective relationship. However, Beauvoir aspires continually to the Absolute abstract which inevitably leads to the ontological frustration, which is an inherent structure to melancholy. This establishes an ongoing dialogue in her work and life, we have revealed her autobiographies, between desire for existence and non-desire which is expressed by apathy, fatigue and disgust. This helps us to determine the existence of melancholy at Beauvoir. However, the task is made difficult by its ambition to describe the totality of life and of the world. In addition, times and melancholy feelings are scattered throughout a lifetime, narrated by autobiographer who plays the game of shadow-clear. Although we risk losing what makes the specificity and complexity, melancholy seems unattainable without linking it to its metamorphoses. That's why we make a careful study of these autobiographies to follow the moments and feelings: solitude adolescent boredom, melancholy of love, the impotence of the political subject, mourning of loved ones, until the anxiety of time and aging. The first chapter discusses the philosophical infrastructure of melancholy, which is the tension between the desire to exist, and non-desire. The review of literary representation and the phenomenological ontology of Sartre melancholy, and new contributions of Simone de Beauvoir in the postwar, encourage us to discern a theory of feminine melancholy in The Second Sex. Given the similarity of experiences between her feminist project and autobiographical project, we seek to build an intertextual network between his self-writing and its existential anthropological theory of women, studying necessarily correlated novels. Considering the small number of pages, our choice is rather on his autobiographies, and his theory and novels about women which serve as key references. In the following chapters, we try to explore the experiences of / with Beauvoir, to the extent that they relate to melancholy. The second chapter focuses exclusively on the childhood story, to its autonomy on the later accounts, and focuses on loneliness and adolescent boredom. The third chapter tries to establish a relationship between the passion of love and melancholy. The fourth finds impotence of the subject in the experience of war. The fifth discover the relationship between mother and daughter in the essay of maternal grief, and from this, to look for his latest novel about the diversity of women's melancholy. The last chapter wants to gather the insurmountable moments of the human being around death and anguish of time, to clarify their relation about melancholy in our author.

The difficulty to establish this dialog comes from the man in itself, unable to think out of the understructure of science and the modern technique. The poetic language was forgotten or ignored, turning itself obsolete in front of improvements and resources of the technique. Heidegger searches the essences to the poetry so may it be comprehended in its plenitude for the man. Technique, poetry and existence must be pronounced and investigated so the being shows itself again. To Heidegger, the man lives in a period of uncertainty due finding himself at the sunset of age. The uncertainty generates the poverty and the night of world represents the absence of god and original truth. Only with the fundamental comprehension of poetry, the man of today can project himself to the future not anymore as technique product, but with freedom to choose. The message of poetry of H?lderlin and Rilke, according to Heidegger s interpretation, transmits an alert to the contemporary man against the coming danger in his maintained relation with nature. The purpose of the following work is to build this thinking dialog, without disfigure the poetry, but taking approach over its essence, so from there to remove its true existential value. / O di?logo pensante entre a filosofia de Heidegger e a poesia de H?lderlin e Rilke deve ser travado nos dom?nios da linguagem. A dificuldade em estabelecer esse di?logo vem do pr?prio homem, incapaz de pensar fora do arcabou?o da ci?ncia e da t?cnica moderna. A linguagem po?tica foi esquecida ou ignorada, tornando-se obsoleta diante das facilidades e recursos da t?cnica. Heidegger busca as ess?ncias para que a poesia possa ser compreendida em sua plenitude pelo homem. T?cnica, poesia e exist?ncia devem ser pronunciadas e investigadas para que o ser se apresente novamente. Para Heidegger, o homem vive em um per?odo de incertezas por se encontrar no entardecer de uma era (Sunset of Age). A incerteza gera a pen?ria e a noite do mundo representa a aus?ncia de Deus e das verdades origin?rias. Apenas com a compreens?o fundamental da poesia, o homem de hoje pode se projetar ao futuro n?o mais como produto da t?cnica, mas com liberdade para escolher. Since, despite this apparent inconsistency, both ideas are present with much emphasis on the work of the French thinker, to understand the way Foucault articulated these two ideas was necessary to elucidate and interrelate the way in which he thought about the concepts of subject, power and liberty. Traveling with the author his intellectual itinerary, it was revealed that his conception of subject and liberty can be reconciled (although maintaining its problematic nature) and, also, both are inextricably linked each one as a result of the other. Tracing, with the author, his intellectual itinerary, it was also possible to identify and describe the fruitful conceptual tools for thinking about our own determinations and about the possibilities we have of creating new subjectivities and liberating experiences / O fio condutor dessa disserta??o foi a pesquisa acerca da rela??o entre dois campos de problematiza??o na obra de Michel Foucault que podem ser considerados, a uma primeira vista, inconcili?veis: por um lado, sua concep??o de sujeito como constru?do e de certa maneira e por esse motivo, fruto de determina??es, e, por outro, sua postura ?tica de busca permanente de cria??o de liberdade. Uma vez que, apesar dessa aparente inconciliabilidade, ambas as ideias est?o presentes com muita ?nfase na obra do pensador franc?s, procurou-se, nesse trabalho, compreender de que maneira est?o articuladas. A critical analysis of indigenous and modern policing in Ethiopia

The purpose of this study was to determine whether indigenous and modern policing can coexist in Ethiopia. The two case studies dealt with in this research indicate that customary administration which is based on indigenous customary law governs the lives of most communities in Ethiopia. Most of the civil and criminal cases are resolved through these mechanisms, although there are always operational tensions due to some contradictions between the modern and indigenous policing systems when crime is committed in indigenous areas. This is mainly because the modern police system wants to impose its way of resolving crime while the indigenous police system want crime to be solved in the traditional/indigenous manner that have been practiced for centuries. These fundamental differences have created two parallel institutions which are both rooted in providing safety and security to the community. The research also reveals that modern policing in Ethiopia can benefit tremendously from well researched experiences and practices of indigenous policing. This does not imply that indigenous policing system is democratic and all the experiences could be relevant to modern policing, but it simply means that the identification and the sharing of best practices from both sides could lead to mutual benefits of these systems. In its conclusion the research shows that Ethiopia has the potential to develop a unique policing system that reflects its distinctive cultural heritage and that meets the needs of its people. This potential is more likely to be actualized if the country preserves and incorporate the best practices of both these systems and use them as integral part of the Ethiopian modern policing. / Police Practice / D .Litt. et Phil. Magistro darbe “Ypatingosios teisenos esmės problematika” siekiama išanalizuoti ypatingosios teisenos esmę Lietuvos Respublikos civilinio proceso kodekse, ginčo ir ypatingosios teisenos tarpusavio sąveiką, dabartiniame Civilinio proceso kodekse nustatytą ypatingosios teisenos ir ginčo teisenos reglamentavimą, atskleisti jo turinį ir pagrįsti nuostatų įtvirtinimo būtinumą Lietuvos civilinio proceso teisėje. Įsigaliojus dabartiniam Civilinio proceso kodeksui, buvo iš esmės reformuotas ypatingosios teisenos procesas pasirinkus germaniškąją ypatingosios teisenos koncepciją. Atsisakius ginčo dėl teisės kaip pagrindinio teisenas atribojančio kriterijaus, Civilinio proceso kodekse įtvirtinta nuostata, draudžianti perduoti ypatingosios teisenos bylą išnagrinėti ginčo teisenos tvarka, jei joje kyla ginčas dėl teisės. Pagrindinis kriterijus, kuriuo remiantis Lietuvos civilinio proceso teisėje atribojama ginčo ir ypatingoji teisena, yra tikslingumas bei viešojo intereso egzistavimas civiliniuose teisiniuose santykiuose. Įtvirtintas inkvizicinis ypatingosios teisenos proceso modelis su jam būdingais oficialumo, imperatyvumo, riboto viešumo bei žodiškumo principais. Įtvirtintas aktyvus teisėjo statusas nustatant objektyvią tiesą ypatingosios teisenos byloje. [toliau žr. visą tekstą] / In the master’s thesis titled "The issue of essence of the particular proceeding” is being tried to analyse the main features of the particular proceeding in Lithuanian Republic Civil Process Code, the interaction between disputes and particular proceeding, the interaction between those both proceedings, the innovation in the present Civil Process Code, which are related with the regulation of dispute and particular proceeding, to analyze innovation in detail, to exhibit its purport and to give a proof of the fixation of the attitudes in the Lithuanian Civil Process Law. While the present Civil Process Code took effect, the particular proceeding process was reformatted with the choice of the Germanic particular proceeding conception. Having rejected the dispute for law as the main criteria, which deliminates proceeding, in Civil Process Code the attitude is fixed, which prohibits to transfer particular proceeding case to a judge by the dispute proceeding method if the dispute for law (right) arises in it. The main criteria, as the ground of which in Lithuanian Civil Process Law the dispute and particular proceedings are deliminated and the public interest and expediency exist in civil legal regulation. A critical analysis of indigenous and modern policing in Ethiopia

The purpose of this study was to determine whether indigenous and modern policing can coexist in Ethiopia. The two case studies dealt with in this research indicate that customary administration which is based on indigenous customary law governs the lives of most communities in Ethiopia. Most of the civil and criminal cases are resolved through these mechanisms, although there are always operational tensions due to some contradictions between the modern and indigenous policing systems when crime is committed in indigenous areas. This is mainly because the modern police system wants to impose its way of resolving crime while the indigenous police system want crime to be solved in the traditional/indigenous manner that have been practiced for centuries. These fundamental differences have created two parallel institutions which are both rooted in providing safety and security to the community. The research also reveals that modern policing in Ethiopia can benefit tremendously from well researched experiences and practices of indigenous policing. This does not imply that indigenous policing system is democratic and all the experiences could be relevant to modern policing, but it simply means that the identification and the sharing of best practices from both sides could lead to mutual benefits of these systems. In its conclusion the research shows that Ethiopia has the potential to develop a unique policing system that reflects its distinctive cultural heritage and that meets the needs of its people. This potential is more likely to be actualized if the country preserves and incorporate the best practices of both these systems and use them as integral part of the Ethiopian modern policing. / Police Practice / D .Litt. et Phil.
