It analyzes the law evolution and the international standard. It concerns in analyzing the affirmative actions, especially the legal quote system enlarging the Law nº 8.213/91, beyond to find the relevance of the others instruments for the disabled person in the market work, as an example, the habilitation and the rehabilitation, the apprentice contract, the traineeship. The legal quote system is justified. Finally, to guarantee the efficiency of the disabled person inclusion in the market work measures, it proposes the simultaneous adoption of other public polices that, truly, makes the disabled person social participation able, among them, there are the inclusive education, accessibility measures and polices in tax incentives. / A dissertação de mestrado demonstra a trajetória das pessoas com deficiência na busca do reconhecimento pelos seus direitos. Analisa a evolução do ordenamento jurídico interno juntamente com os diplomas normativos internacionais. Define deficiência, aponta as concepções históricas da deficiência, analisa as causas da exclusão do grupo como forma de opressão, refletida pela discriminação. Preocupa-se em analisar a aplicabilidade das medidas de discriminação positiva, especialmente o sistema de reserva legal de cotas, previsto na Lei nº 8.213/91, além de constatar a relevância de outros instrumentos destinados à inclusão da pessoa com deficiência no mercado de trabalho, como por exemplo, a habilitação e reabilitação, a aprendizagem, o contrato de estágio. Justifica a legitimidade do sistema de reserva legal de cotas. 22	Hotspot Detection for Automatic Podcast Trailer Generation / Hotspot-detektering för automatisk generering av podcast-trailers Zhu, Winstead Xingran January 2021 (has links) With podcasts being a fast growing audio-only form of media, an effective way of promoting different podcast shows becomes more and more vital to all the stakeholders concerned, including the podcast creators, the podcast streaming platforms, and the podcast listeners. This thesis investigates the relatively little studied topic of automatic podcast trailer generation, with the purpose of en- hancing the overall visibility and publicity of different podcast contents and gen- erating more user engagement in podcast listening. This thesis takes a hotspot- based approach, by specifically defining the vague concept of “hotspot” and designing different appropriate methods for hotspot detection. Different meth- ods are analyzed and compared, and the best methods are selected. The selected methods are then used to construct an automatic podcast trailer generation sys- tem, which consists of four major components and one schema to coordinate the components. The system can take a random podcast episode audio as input and generate an around 1 minute long trailer for it. 23	A synchronic approach to the Serek ha-Yahad (1QS) : from text to social and cultural context Skarström Hinojosa, Kamilla January 2016 (has links) The purpose of this study is to investigate the social and cultural contexts of 1QS (Serek ha-Yahad) by means of a textual study. The analysis of the text is performed in a synchronic perspective. This means that lexical choices, grammatical forms, references, topics, themes, and intertextuality are analyzed text-internally. By doing so, this study sheds new light on old questions of textual cohesion and coherence, questions that until now have been dealt with mostly from a diachronic perspective. The text analysis entails investigation in view of three interrelated dimensions of language function: ideational, interpersonal, and textual. These imply language as transmitting information, creating and sustaining relations, and functioning to organize itself into cohesive units. Although applying some of the terminology from the field of text linguistics (SFL), the focus in this study is on what a text means rather than why. This means that the semantic-pragmatic aspects of language are of foremost interest here. The analysis is performed from bottom and up, then from top down again. Words, phrases, and sentences are investigated up to the broadest linguistic level, namely, to the semantic discourse itself. With an understanding of the larger discourse at hand thanks to this analysis of textual cohesion and coherence, textual details are once again revisited and interpreted anew. In this work, 1QS is analyzed from beginning to end—chronologically, so to say. Then, at the end of each major section, the discourse is analyzed overall. Following the text analysis, conclusions of the investigations are presented. The conclusions argue that the hierarchal structure of the community and its stringent regulations are to be understood as a corrective in response to corrupt society. It is also argued that language in 1QS has a performative function. Rather than describing the way things are, it aspires to evoke the ideal society. Instead of understanding 1QS and the community mirrored in it as a deviant group with little or no contact with the surrounding world, it is then understood as a potent contribution to late Second Temple Jewish discourse concerning how to create a just society and a sanctifying cultic practice. In the final chapter, the insights gained from textual analysis of 1QS are brought into encounter with the theoretical framework posited by French historian and philosopher René Girard (1923–2015). In light of Girard’s philosophy, the hierarchal organization of the community (the Yahad) as well as its regulations can be interpreted as an effort to prevent a mimetic crisis. The function of the scapegoat in 1QS is discussed in light of Girard’s grand theory of the mechanisms of scapegoating in all societies. 25	興櫃股票適用我國證券交易法反市場操縱條款之研究 / A study of adapting the anti-manipulation provisions to taiwan emerging stock market 陳永明, Chen, Yung Ming Unknown Date (has links) 我國興櫃股票之交易方式係由推薦證券商（即興櫃股票之造市商）之報價主導交易進行，屬於報價驅動（Quote-driven）之交易方式，與我國上櫃股票採取「等價交易」及上市股票採取「競價交易」等均屬委託單驅動（Order-driven）之交易方式迥然不同。按我國證券交易法第155條第2項準用同條第1項規定之適用結果，「於證券商營業處所買賣有價證券」者，仍應有第1項所揭反市場操縱條款之適用。惟有關興櫃股票交易在成交對象之選擇、成交順序、成交價格決定，乃至於成交後之給付結算作業方式等，均與我國現行上市（櫃）股票之交易及交割方式具有明顯之差異，致應如何適用證券交易法反市場操縱條款之規定，乃成疑義。本文鑒於興櫃股票市場規模已呈穩定成長之勢，不難想像興櫃股票交易與市場操縱行為之間終將有擦出爭議火花之時，故以比較法學研究之觀點，歸納並分析興櫃股票與上市（櫃）股票交易方式之差異及其癥結所在。另蒐集瀏覽世界各國主要證券市場之交易規制，包括美國OTCBB市場、歐陸Alternext市場及英國AIM市場，分析其他採用報價驅動交易模式之先進市場當中有關造市商義務之規範，以掌握造市商義務之核心意涵。進而以造市商義務範圍及報價驅動市場之交易特徵為基礎，逐一檢測興櫃股票適用我國證券交易法所揭「違約不交割」、「相對委託」、「連續交易」、「沖洗買賣」、「散布流言或不實資料」及「其他直接或間接操縱市場」等各款反市場操縱條款規定可能引發之爭議，並提出本文意見。 / The trading mechanism of Taiwan Emerging Stock is based on quote-driven model, which is very different from the order-driven model of the Taiwan OTC securities market and Taiwan Stock Exchange market. By the Taiwan Securities and Exchange Act Article 155 paragraph 2 permitted that paragraph 1, the anti-market manipulation provisions, shall apply mutatis mutandis to securities transactions conducted on the over-the-counter markets. However, lots of Taiwan Emerging stock trading rules such as allowing the participants to choose their counterparty, the matching sequence rules, the price decision rules, and even the rules of payment and settlement practices after transaction, all have significantly differences between those of Taiwan Emerging stock market and listed stock market. Therefore, how should Taiwan Emerging stock apply to the Securities Exchange Act under the terms of the anti-market manipulation is into doubt. Taiwan Emerging stock market has shown a steady growth trend, hence, it is easy to imagine that Taiwan Emerging stock trading and market manipulation issues will eventually rise to controversy. This thesis is to study from the point of view of comparative law, by means of analyzing the emerging stock markets of the advanced countries, including the U.S. OTCBB market, the European Alternext market and the UK AIM market, to conclude the crux of the difference between the quote-driven and order-driven market models. Then, to understand the characteristics and core obligation of the market maker under quote-driven market model, furthermore, to detect the disputes may lead for adapting the anti-manipulation provisions to Taiwan Emerging stock, including the terms of "breach of contract non-deliverable", "improper matched orders ", "continuous trading", "wash sale", "spreading rumors or false information" and other direct or indirect behavior of manipulation".
