Bodies of Evidence: A Qualitative Analysis of the Lived Experiences of Female Central American and Mexican Asylum Seekers in Dallas

This work addresses the experiences of female asylum seekers from Central and Mexico currently living in Dallas, TX. The main purpose is to analyze how these women engage in the gendered processes of both migrating to and accessing legal resources and protection within the United States. As the women move through male-dominated spaces in their home country, the borderlands, and the asylum court they must challenge the patriarchal institutions that attempt to silence their narratives and criminalize their bodies. Their physical wounds become evidence in the courtroom, while outside of the courtroom their movements are monitored and tracked through multiple mechanisms of state control: ankle monitors, detention centers, ICE check-ins. They face intersectional discrimination as they are targeted as both women and immigrants. However, these female asylum seekers are not victims. They constantly display agency as they represent themselves in court, find solace in their faith, and form community with each other.

Inclusive Education for Refugees and Asylum Seeking Children : A Systematic Literature Review / Inclusief Onderwijs voor Vluchtelingen en Asielzoekende Kinderen : Een Systematisch Literatuuronderzoek

BACKGROUND In recent years, there has been an increase in the number of children with a refugee background in the Netherlands. All of these children who are under 18 years of age must go to school, but they face many barriers towards inclusion. Appropriately educating this diverse group of children presents schools with challenges. Supportive programs are needed to overcome these barriers and challenges. AIM The aim of this paper was to explore what supports are put in place to foster refugee students’ inclusion in school. METHOD A systematic literature review was conducted to synthesize research on school-based programs and practices. RESULTS A broad range of supports were identified. Most studies addressed access barriers to learning by offering emotional and educational support, while fewer studies focused on opportunity barriers such as negative attitudes and lack of parental involvement. CONCLUSION It was concluded that schools can play an important role in supporting the inclusion of refugee children and their families because of their accessibility, but that more high quality research is necessary in order to assess the effectiveness of supports that minimize barriers towards learning and promote their inclusion in school.

Skyddsgrunder för ensamkommande barn : - en rättsvetenskaplig analys

With the increase in unaccompanied children in 2015, it has become common to discuss the legal status of unaccompanied children. By the Swedish law persons under the age of 18 are considered to be minors and therefore have no ability to make decisions in personal matters with legally binding effects. A childs case does not always require the same seriousness as adult cases to be able to obtain a residence permit. This leads to at different asylum process for unaccompanied children who lack guardians upon arriving to Sweden. Various assessments are made for unaccompanied children that adults do not need to undergo for a residence permit. Through the legal dogmatic method, an analysis and report has been made in relation to the EU law, current Swedish laws and international commitments that affect unaccompanied childrens rights within Swedish legislation. The courts way of assessing grounds for protection, as well as how these are tried has been analyzed. The concept of unaccompanied children has been defined, but the focus on their rights in Sweden has also been reported. / I samband med ökningen av ensamkommande barn under år 2015 har det blivit ofta förekommande att diskutera ensamkommande barns rättsliga ställning. Personer som är under 18 år betraktas enligt svensk rätt som omyndiga och har därför ingen förmåga att med rättslig bindande verkan fatta beslut i personliga angelägenheter. Ett barns ärende behöver inte alltid ha samma allvar och tyngd som krävs för att vuxna personer ska kunna få uppehållstillstånd vilket leder till en annorlunda asylprocess för ensamkommande barn som saknad vårdnadshavare vid ankomsten till Sverige. Det görs olika bedömningar för ensamkommande barn som vuxna inte behöver genomgå för uppehållstillstånd. Genom den rättsdogmatiska metoden har det gjorts en analys och redogörelse i relation till EU-rätten, gällande svenska lagar och internationella åtaganden som påverkar ensamkommande barns rättigheter inom den svenska lagstiftningen. Domstolarnas sätt att bedöma skyddsgrunder samt hur dessa prövas inför domstolar har bedömts och analyserats. Begreppet ensamkommande barn har definierats men även fokus på deras rättigheter i Sverige har redogjorts.

本篇論文企圖探討史蒂芬‧佛瑞爾斯 ( Stephen Frears ) 的電影《美麗壞東西》( Dirty Pretty Things ) 中的公民權與人權之議題。片中描述從奈及利亞非法入境的奧奎 (Okwe) 與來自土耳其申請政治庇護的桑娜 (Senay) 因其游移的身分,遭逢英國政府監控與資本主義社會剝削,並揭露倫敦城市中非法難民販賣器官以求生存的黑暗面。本篇論文著重分析政治庇護者的矛盾身分如何擾亂民族國家的監視、暴露僅以公民權利保障境內人民的缺失,並主張唯有透過跨種族、階級,與性別的聯合 ( solidarity ) 才能對抗國家機制裡的矛盾與全球資本主義的剝削。論文第二章以德希達 ( Jacques Derrida ) 的制約款待 ( conditional hospitality ),與傅柯 ( Michel Foucault ) 的監視 ( Panopticon ) 概念,探討片中監控 ( surveillance ) 機制的形成。第三章引進布斯克與夏弗 (Alison Brysk and Gershon Shafir ) 提出公民權 (citizenship) 與人權 ( human rights ) 的差距,來揭發片中政治庇護者與外籍勞工在地主國 ( host countries ) 因為缺乏公民權而導致人權被忽視的困境。第四章從傅柯 ( Michel Foucault ) 的反抗 ( resistance ) 與拉克勞 ( Ernesto Laclau ) 與穆芙 ( Chantal Mouffe ) 的激進多元民主 ( radical plural democracy ) 的概念,探討以跨種族、階級,與性別的聯合 ( solidarity ) 來對抗國家制度本身的裂縫與經濟全球化的無情剝削。最後總結在全球化時代,唯有檢視國家制度的缺失,並揚棄封閉排他的意識形態,才能體現種族與文化的差異與多元性,並促進跨界聯合之實現。 / This thesis aims to explore the issue of citizenship and human rights in Stephen Frears’s Dirty Pretty Things. Dirty Pretty Things describes the British government’s surveillance on asylum seekers, such as Okwe, an illegal refugee from Nigeria, and Senay, the Turkish asylum applicant, and unveils illegal refugees’ organ trade in exchange for passports in London. The thesis attempts to decipher how the ambivalent status of asylum seekers disturbs the surveillance of nation-states, exposes the defect of the citizenship gap and argues only through solidarity among different ethnicity, class and gender, could the subordinated fight against deficiencies in the mechanism of nation-states and exploitation of global capitalism. Through the perspectives of Derrida’s conditional hospitality and Foucault’s Panopticon, Chapter Two examines the surveillance of nation-states on asylum seekers in Dirty Pretty Things. In Chapter Three, I adopt Brysk and Shafir’s analysis to explore the citizenship gap between citizenship and human rights in the film, which reflects the difficulty in handling the cases of legal and illegal asylum seekers in nation-states on the basis of citizenship in the era of globalization. In Chapter Four, I will utilize the perceptive of Foucault’s resistance and Laclau and Mouffe’s radical plural democracy to suggest how counter strategies and solidarity could rebel against fissures in nation-states’ apparatuses and reveal a new possibility of alliance beyond borders in the era of globalization. The last chapter concludes by summing up the gaps in the system of nation-states and rejecting any enclosed ideology so as to articulate multiplicities and differences beyond limitations of ethnicity, class and gender across borders in the era of globalization.

Shayh Yusuf Al-Maqassari's literary contribution with a special attention to his Matalib Al-Salikin (The Quests of the spiritual seekers)

Text in English and Arabic / Bibliography: leaves 373-390 / The importance of this research on the life of Shaykh Yūsuf‟s life and legacy is eviden t from the depth of the reports on "Shaykh Yūsuf al-Maqassarī’s literary contribution with a special attention to his Maṭālib al-Sālikῑn [The Quests of the Spiritual Seekers].” We contend that without a comprehensive knowledge of it, some of the subtleties and nuances of the Shaykh as well as his treatises will remain concealed from us. I utilised the comprehensive religious historical and philological approaches following the methodology of Sultan, Nabilah Lubis, and Suleman Essop Dangor to complement al-Maqassarī‟s history, his literary contribution in general and to gain the essence of his Maṭālib al-Sālikῑn through commentaries. I also used hermeneutic‟s theory for interpreting some of the texts. Shaykh Yūsuf (1626-1699) is considered a national hero of Indonesia and South Africa. His movements from Gowa South Sulawesi to other countries including the Middle East were motivated by his wish to deepen his understanding of Islamic mysticism. This was supported by his local teachers and the needs of Gowa Kingdom for a qualified Islamic scholar to convert its animistic society into real and fervent Muslims. This responsibility fostered in him a sense of bravery and adventure, and he ended up wandering around the world in search of knowledge. In their purpose to rule the East Indian countries and remove his influence over his fellow citizens, the Dutch banished Shaykh Yūsuf initially to Ceylon and then to Cape of Good Hope, South Africa (1684-1699). He left behind a large body of literary contributions, many of them still preserved at UB Leiden and the National Library of Jakarta. His Maṭālib al-Sālikῑn holds a special place among his literary contributions. It discusses three important issues that are illustrated with parables which should be understood by spiritual seekers; namely tawḥῑd, ma‘rifa, and „ibāda {Divine Knowledge, Divine Recognition and Worship]. They constitute a tree with leaves, branches, and fruit. Its practitioners are directed to the Oneness of God and to none other. These teachings have become a foundation of his reformist ideas and a basis to build his Islamic community in South Africa and finally to be implemented in his own ṣūfī order, Ṭarīqat al-Yūsufiyya/Khalwatiyyat al-Yūsufiyya. / Religious Studies and Arabic / D.
