Fadern är alltid säker : Föräldraskapsdiskurser i familjerättslig ärendehantering av transnationella surrogatarrangemang

The aim of this thesis is to examine how discourses on parenthood are articulated and negotiated by social workers in Sweden, in relation to handling legal parenthood after transnational surrogacy. The study is based on interviews with eight different social workers from different parts of Sweden. To interpret the material from the interviews, I use discourse theoretical framework – combined with an understanding of the social workers as street-level bureaucrats. Other particular theoretical perspectives that have been important in my research include theories on kinship, concepts of bodily and genetic citizenship and neo-liberal discourse. My study shows that different perceptions of certain key concepts (such as social-, bodily- or genetic family ties) underpin the discourses of parenthood, depending on context. In my research I have found that the process of deciding who is the legal parent of a child born through surrogacy, challenge the presumption of motherhood, and instead the genetic and intended father remains the certain parent of the child.

As Operações Urbanas possuem aplicabilidade para a criação de políticas urbanas mais eficientes, pois é um instrumento legal de requalificação urbana. Apresenta-se como um instrumento urbanístico de parceria entre o poder público municipal e a iniciativa privada. A Operação Urbana Consorciada Água Espraiada (OUCAE) que é regida por lei específica possui um plano de obras e, com os Certificados de Potencial Adicional de Construção (Cepac), os recursos financeiros são antecipados e podem ser utilizados no programa de investimentos de acordo com as diretrizes de obras estabelecidas na lei. Existe um Grupo de Gestão da Operação Urbana Consorciada que define e prioriza onde serão aplicados esses recursos. A OUCAE possui perímetro delimitado em lei e divide-se nos seguintes setores: Setor Jabaquara, Setor Brooklin, Setor Berrini, Setor Marginal Pinheiros, Setor Chucri Zaidan e Setor Americanópolis. Esta pesquisa apresenta os resultados da análise do processo de segregação nas comunidades diretamente atingidas pelas obras da OUCAE no setor jabaquara no período de março de 2003 até dezembro de 2012 , a partir do diagnóstico e seleção dos principais agentes que participam do Grupo de Gestão envolvidos neste processo. Os métodos utilizados na pesquisa foram a revisão bibliográfica e a pesquisa qualitativa direta com duas abordagens, a saber: a primeira abordagem abrangeu a investigação em informações secundárias coletadas nos documentos técnicos do acervo da biblioteca e arquivo técnico da EMURB, atual São Paulo Urbanismo e nas atas das Reuniões do Grupo de Gestão da OUCAE e a segunda abordagem amparada em dados primários onde entrevistou-se a população vulnerável moradora do setor Jabaquara diretamente afetada pelo plano de obras da OUCAE. Os resultados obtidos são referentes à discussão dos assuntos abordados nas Reuniões do Grupo de Gestão do ponto de vista da Habitação de Interesse Social onde apurou-se que as metas de atendimento habitacional não foram atingidas e à descoberta que os moradores que vivem em situação de vulnerabilidade nas comunidades atingidas pelas obras da OUCAE subdividem-se em subgrupos apresentando perfis diferentes , descaracterizando a prática de que a representação dos anseios e pontos de vista dos moradores em relação às ações praticadas pelo Poder Público está contida em um único grupo de moradores no Grupo de Gestão. Concluiu-se que para que uma Política Urbana seja eficiente é necessário que estrategicamente a comunicação entre os agentes dos órgãos da Administração Pública e da sociedade civil, envolvidos no processo de requalificação urbana, seja aprimorada, que o Grupo de Gestão participe das discussões estratégicas para implantação de um projeto de Política Urbana e que os órgãos municipais, estaduais e federais se articulem de forma mais organizada. Em complemento que a comunicação deva se estender aos subgrupos de moradores que foram identificados na pesquisa, pois contribuirá para soluções consensuais quando da prática de alguma ação por parte do Poder Público que reflita diretamente na população vulnerável. / Urban Operations do have applicability to the creation of more efficient urban policies as it is a legal instrument for urban renewal. It presents itself as an urban instrument of partnership between the municipal government and the private sector. The Urban Consortium Operation Águas Espraiada (OUCAE) which is governed by some specific legislation has a construction plan, and having the Additional Construction Potential Certificates (Cepac), the financial resources are anticipated and can be used according to the guidelines established by law. There is a Management Group in the Urban Operation that defines and prioritizes where these funds will be used. The OUCAE has its perimeter defined by law and is divided into six sectors. This research presents the analysis results of Public Policy for the implementation of social housing projects in Jabaquara sector from 2001 to 2012, from the research and selection of the main agencies involved in the management group involved in this process. The methods used in the research were the literature review and direct qualitative research with two approaches, namely: the first approach includes the investigation on secondary information collected in technical documentation library resources and technical file of EMURB, current Urbanism in Sao Paulo and the minutes from the Meetings of the Management Group of OUCAE. The second approach was supported by primary data from interviews with the residents of Jabaquara sector, who are directly affected by the OUCAE plan. The results refer to the discussion of the matters approached in the meetings of the Group Management, from the point of view of social housing. The results showed that the housing assistance targets were not met; it also showed that residents living in vulnerable situation within the communities affected are subdivided into subgroups with different profiles, different practices and conflicting interests. Changing the view that the practice of the representation of the wishes and points of view of the residents, in relation to the actions taken by the Government, is contained in a single group in the Management Group. The conclusion was, for an urban policy to be effective, it is necessary that the strategic communication - between the agents of the public authorities and civil society involved in the urban renewal process - improve. The Management Group should take part in strategic discussions to the implementation of an Urban Policy Project with the municipal, state and federal agencies to articulate more effectively. In addition, the communication should include all the subgroups of residents who were identified in the survey because it will contribute to a consensual solution when some action on the part of the government reflects directly on the vulnerable population.

It also seeks to identify and analyze factors of both objective and subjective order - that might have effectively contributed to that outcome. The purpose of this study was, in the first place, to hear some people who have experienced the process mentioned before. By doing so, our aim was not only to comprehend their perception on what happened to them, but also to verify if nowadays social assistance policy can claim any impact on those events. Secondly, we tried to propose methodological principles - based on those perceptions and also with the support of literature that has already been produced on that theme - which might be applied on programs devised for homeless adults. This theme justifies itself by the growing number of people living in those conditions, especially in large cities ; and also because most discussions have their focus on the reasons that could lead to homelessness, ignoring the factors that might help succesfully overcome it. Thus, the following hypotheses were tested: As there are moments / events (processes) that might culminate in the homelessness phenomenon, are there moments / events / stimuli (processes) that encourage people to leave the streets? If so, can such moments be stimulated by the methodology apllied to social assistance ? In order to address those questions, two surveys were conducted: the first interwied some social workers who deal with that population; the latter is a qualitative research that brings statements from eight people who have overcome homelessness. Although not susceptible to generalization due to its nature -, this paper believes that the perceptions of those who have overcome homelessness should be regarded as a major contribution to further development of public policy / O presente trabalho, Pessoas em situação de rua: a saída para a saída , de autoria de Alessandra Medeiros, apresenta um estudo sobre pessoas que saíram da rua. Partindo do objetivo geral de conhecer e identificar quais são os fatores que contribuem para a saída da situação de rua, visa responder a pergunta central desta tese: quais fatores objetivos e subjetivos contribuem para o processo de saída da rua? Dessa maneira, os objetivos específicos desta pesquisa foram: Compreender qual foi o significado da saída dessa condição apontado pelos entrevistados e em que medida a política de assistência social vem colaborando nesse processo; Propor princípios metodológicos que contribuam no atendimento de adultos em situação de rua, considerando a bibliografia estudada e o olhar daqueles que saíram dessa condição. Este tema justifica-se pelo crescimento do número de pessoas vivendo nessas condições, principalmente nas grandes metrópoles e, ainda, pela pouca produção sobre a saída da rua, uma vez que a maioria dos estudos pesquisados discute o processo que leva à situação de rua e não à saída dela . Assim, foram testadas as seguintes hipóteses: Assim como existem momentos/ fatos (processos) que culminam na situação de rua , existem momentos/fatos/estímulos (processos) que incentivam a saída da situação de rua ; Esses momentos podem ser estimulados, de acordo com a metodologia de trabalho adotada no atendimento a esse público. Para tanto, foram realizados dois levantamentos. O primeiro, por meio de entrevistas com trabalhadores sociais de alguns serviços que atendem essa população; e, o segundo, em que foram coletados depoimentos de oito pessoas que saíram da situação de rua, sendo esta uma pesquisa qualitativa. Por tratar-se de um estudo qualitativo, não passível de generalizações, o presente trabalho apresenta a percepção daqueles que saíram da situação sobre o processo que vivenciaram a fim de contribuir para a construção da política pública a esse segmento

The population that comes to the Judiciary and, consequently, the Social Service is the population living in extreme social vulnerability, neglected by protection policies, and receives as a State response the criminalization of their social condition. In this scenario, the professionals of Social Work see themselves in a formalistic institutional logic which can not disentangle in order to create opportunities and mechanisms that allow the population a greater role in matters in which it is involved. They feel distressed by the failure to recognize themselves as agents of rights, as provided for in professional ethical-political project, becoming spectators of injustice. Through the speeches of the professionals themselves are unveiled how they perceive the institutional routine, with which mediations perform social studies that support judicial decisions and what are the possible ways for their professional intervention reach the perspective of the rights guaranteed in this institutional space. Analyzes were done under the historical- critical perspective starting from the complexity of the immediate everyday to approach successively the critical connections to the social totality. Therefore, we analyze, at Fórum das Varas Especiais da Infância e Juventude, how Social Work was organized in the Judiciary and what is the treatment of adolescents who commited illegal acts, the relevant legislation, statistical data about youth and social exclusion, policies for youth and criminalizer answer the State, and the daily lives of Social Workers at Forum. This research contributes to critical reflection on the professional practice of Social Workers who work in the Judiciary / Este estudo trata da prática profissional do assistente social que atua no Fórum das Varas Especiais da Infância e Juventude (FVEIJ) com a atribuição de realizar estudo social relacionado a adolescentes envolvidos em atos infracionais. A população que chega ao Poder Judiciário e, consequentemente, ao Serviço Social, apresenta situação de extrema vulnerabilidade social, é negligenciada pelas políticas de proteção, e recebe como resposta do Estado a criminalização por sua condição social. Nesse cenário, os assistentes sociais se percebem enredados numa lógica institucional formalista da qual não conseguem se desvencilhar no sentido de oportunizar mecanismos que permitam à população maior protagonismo nas questões em que está envolvida. Sentem-se angustiados pelo fato de não se reconhecerem como agentes promotores de direitos, tal como previsto no projeto ético- político profissional, mas espectadores de injustiças. Por meio dos discursos dos próprios profissionais, desvelou-se a maneira como percebem o cotidiano institucional, com quais mediações realizam os estudos sociais que subsidiam as decisões judiciais e quais os caminhos possíveis para que a sua intervenção profissional alcance a perspectiva da garantia de direitos nesse espaço institucional. As análises foram feitas sob a perspectiva histórico-crítica e partiram da complexidade do cotidiano imediato para se aproximar, sucessivamente, das conexões críticas com a totalidade social. Para tanto, analisa-se como o Serviço Social se organizou no Poder Judiciário e como se dá o atendimento a adolescentes autores de ato infracional no Fórum Varas Especiais da Infância e Juventude; as legislações pertinentes e os dados estatísticos sobre a juventude e a exclusão social; as políticas para a juventude e as repostas criminalizadoras do Estado; o cotidiano dos assistentes sociais lotados naquele fórum. A presente pesquisa enseja contribuir para a reflexão crítica da prática profissional dos assistentes sociais que atuam no Poder Judiciário

"OKUNSKAP ÄR DEN STÖRSTA UTMANINGEN VI HAR" : En kvalitativ studie om socialarbetarens upplevelse av arbetet med ’hedersrelaterat våld och förtryck’

Studien syftar till att undersöka socialarbetarens arbetssätt i relation till flickor i ålder 13-18 år som utsätts för så kallat hedersrelaterat våld (HRV). Studien bygger på fem kvalitativa semistrukturerade intervjuer med socialsekreterare från mottagningsenheten respektive utredningsenheten och empirin har analyserats utifrån det intersektionella- och det kulturella perspektivet. Resultatet visar att socialarbetarna inom de olika enheterna har blandade uppfattningar vad gäller definitionen av HRV, dels en kulturaliserad, dels en intersektionell bild av fenomenet. En indikation på att en individ utsätts för HRV är enligt socialsekreterarna att den enskilde är starkt begränsad i sitt liv. Resultatet visar även att enbart några av intervjupersonerna arbetar utifrån en handlingsplan medan andra utgår ifrån sina erfarenheter. Det inte tillämpas någon särskild metod i arbetet inom verksamheterna samt att man inte har tydliga visioner/mål för arbetet mot HRV varpå man inte arbetar särskilt förebyggande inom enheterna. Det förekommer även att samverkan sker inom arbetet med olika myndigheter däribland polis, åklagare samt enheterna emellan. De utmaningar som socialarbetare uppger är att det bland annat råder okunskap vad gäller hanteringen av ärenden. Dessutom visar resultatet att stress och psykisk påfrestning är vanligt förekommande för socialarbetarna, men även hot om våld som utövas av den utsattas familj gentemot socialarbetarna. / This study examines how social secretaries work with girls 13-18 years old as exposed to honor violence. The study is based on five qualitative semi-structured interviews with social secretaries from the receiving- and investigation-units and the empirical data has been analyzed from the intersectional and the cultural perspective. The result shows that social secretaries within the units have mixed perceptions regarding the definitions of HRV, both a culture-based view and an intersectional of the phenomenon. It appears from the study that most of the social secretaries work by an action plan, that no specific method is applied within the units and that there are no clear visions or goals against HRV, whereupon the social workers don’t work preventive to HRV. The result also shows the complexity among the social workers in defining HRV. In addition, the result show that some of the respondents work on the basis of an action plan, that no specific method is applied in the work within the unit and that they don’t have clear visions / goals for the work against HRV. Challenges they face are lack of knowledge regarding the handling of cases. The results also show that mental stress is common among social secretaries but also threats of violence against the social secretaries.

This essay is a qualitative study that explores the importance of social workers with different levels of work experience and their attributes to social work education, who meet the challenges of working life. The study made a comparison between social workers who have one to two years of work experience and five to ten years of work experience at the Social Service Centre in Kalmar. Semi-structured interviews have been used. The essay contains information about the regime New Public Management (NPM) that gives knowledge of how the public sector looks today, which gives a greater understanding of what the interviewees are faced with regarding their challenges in working life. Referring to previous research, it was found that a common occurrence within social education students is a feeling of being unprepared and feeling uncertain about future careers. The results gained from the study showed that the social workers with five to ten years of work experience use knowledge from education more in their everyday work, compared to the social workers with one to two years of work experience. Also the social workers with more work experience had gained an overall view of what social work is about, owing to the education. In the result, it was also found that all interviewees regardless of work experience felt that social work education should include more practice to prepare them for working life.

Social workers make decisions about client’s treatment. Problems arise when these assessments are not based on different needs, but rather a result of different biases towards gender. The purpose of this thesis is to study social workers in the addiction treatment field’s reasoning behind their justification concerning gender differences in their work. We used a vignette as a common reference for two group interviews and one individual interview, which were carried out on a social service office and an outpatient clinic. The interviews resulted in three forms of legitimacy: organizational requirements, professionalism and the will to do right. Organizational requirements refer to social workers relying on guidelines and research to justify their actions. Professionalism means that social workers reinforce their reasoning through previous experiences or other profession’s knowledge. The will to do right refers to the determination to live up to the ideals of society. Participants struggle with a complex and sometimes conflicting task, and to act justifiable they use reasoning based on different premises. The social workers are motivated and educated on the subject, and their goal is to make assessments based on individual needs. But it appears to be difficult to fully utilize these skills in practice

This author examined school social workers’ and teachers’ perceptions about their feelings of efficacy to deal with bullying and what may account for those feelings in a population of 71 teachers and 26 social workers employed in Kentucky schools. Research was gathered using a self-report, electronic survey consisting of subscales of the Teachers’ Attitudes about Bullying Questionnaire (Beran, 2005), the School Bullying Questionnaire (Nicolaides, Toda & Smith, 2002), the Toronto Empathy Questionnaire (Spreng, McKinnon, Mar & Levine, 2009) and questions designed by the researcher. This study examined the influence of demographic variables as well as the amount and type of professional education and/or training, the professionals’ perceptions of the level of bullying present and how much of a problem it is in their schools, perceived levels of administrative support, the professionals’ personal experiences with bullying and the professionals’ level of empathy. Finally, this study explored the role of school social workers as bullying educators within the school environment by self-report and by teacher reports. The results of the study revealed that social workers reported significantly greater efficacy than did teachers. Additionally, when compared with teachers social workers reported higher levels on all measures of comfort. Other differences between the two professional groups included that social workers reported higher levels of working in urban schools, a higher level of empathy, a greater desire for additional training and a higher incidence of personal experience. Teachers reported higher levels of working in their own school districts, and working in suburban and rural schools and a higher level of believing bullying is a big problem in their school. With regard to the dependent variable of efficacy the independent variables of empathy, the extent of bullying, bystander and additional training trended toward significance. Results regarding social workers as bullying educators revealed that the majority of social workers identified bullying prevention and intervention programming as part of their responsibilities and reported feeling comfortable in this role. Teachers’ responses closely aligned with school social workers’ self-assessments with the majority of teachers reporting social workers in their schools as supportive and helpful in addressing bullying. However, these variables did not have a significant effect on the dependent variable of efficacy. Professional teacher education programs, school social work programs and professional development trainings should incorporate trainings that focus on the role of empathy in managing bullying into their curriculums. Additionally, graduate educational offerings and professional development opportunities for school social workers should incorporate additional trainings to prepare social workers as bullying educators for other school professionals. Finally, additional research efforts that explore school professionals’ efficacy for dealing with bullying may be an important factor in addressing this problem.

The Examination of Confidentiality in A School Based Setting

This research study explored the policies and procedures that education systems abide by, as well as how these policies are enforced to protect the confidentiality of dependent children’s private information from being exposed in their schools to non-relatives and uninvolved parties to their case. Elementary, middle school, and high school faculty’s perception of confidentiality was explored to identify individual competence when working with social workers during their direct contact visit with dependent children on school premises. Data collection included anonymous online surveys of 30-school faculty of various schools in the Southern California. There were no significant findings to support school faculty’s lack of competence of confidentiality protocol when a Department of Children and Family Service social worker conducts a visit on school premises. Future research should involve a qualitative study of school faculty perceptions to gain more accurate and unbiased information from participants.
