[pt] A presente pesquisa tem como objetivo demonstrar a viabilidade da abolição da justiça penal moderna e traçar indicativos para a construção de uma nova justiça para lidar com conflitos graves. Toma como base a leitura de Michel Foucault sobre a modernidade, aplica este método sobre a Criminologia como forma de viabilizar uma nova compreensão da realidade punitiva no ocidente. Ao fim, realiza uma proposta política em duas esferas, para reduzir o exercício da justiça penal e para iniciar a elaboração de uma nova seara jurídica que seja baseada em mediações, foco na vítima e decisões reparatórias. / [en] The present research aims to demonstrate the feasibility of abolishing modern criminal justice and to draw indicatives for a new justice to deal with severe conflicts. Based on Michel Foucault s reading on modernity, it applies this method on Criminology as a way to enable a new understanding of punitive reality in the West. Finally, it makes a political proposal in two areas, to reduce the range of criminal justice and to start the elaboration of a new legal arena based on mediation, focus on the victim and reparatory decisions.

Abolitionism and Palingenesis : Jews, Marxists, and The ‘Establishment’ in Dutch Fascist Propaganda, 1933—44

The ‘Volk en Vaderland’ (VoVa) weekly newspaper served as the principal propaganda tool which allowed the Dutch fascist organisation National Socialist Movement – Netherlands (NSB) to propagate a meticulous blend of antisemitic, anti-Marxist and anti-‘establishment’ conspiracy theories, operating in complementary capacity to the ill-defined palingenetic vision of Dutch national rebirth (‘palingenesis’). Later in the wartime collaboration years, the various components of Dutch fascism were concretised (‘finished’) not by the NSB but by the Berlin-directed civilian occupation regime. As will be presented, utilising mixed-methods content analysis, VoVa’s double scrutiny in both a quantitative and qualitative examination points to the conclusion that the collaboration period had a stout germanisation effect on the completion and even replacement of the various facets of the initial NSB ideology: With pan-Dutch nationalism becoming increasingly outphased by pan-Germanicism; anti-jewish measures being introduced in the Netherlands by Berlin supported by NSB propaganda; and, finally, the revitalisation of ‘abolitionist’ antisemitic and anti-Marxist rhetoric occurring in virtue of Hitler’s invasion of the USSR. Thus, skewing the expectations of the natural fascist development under a heuristic fascist studies theory model, with particular attention paid to the elements most relevant to Holocaust & genocide studies, the NSB case study alludes to various noteworthy effects of intra-fascist wartime collaboration, and how it completed or even altered the propagated visions for societal transformations and persecutions. Therein, the thesis finishes with the recommendation that other national fascist organisations across World War Two Europe may have suffered equal changes to their abolitionist and palingenetic agendas following intra-fascist wartime collaboration with Germany and Italy; requesting further research is engaged in on other such fascist organisations across Europe, and not only for the Dutch example now treated in this study.

'Doing something' about modern slavery : scenes of responsibility, practices of hospitality

This thesis examines the desire and efforts to 'do something' about what is variously called 'modern slavery' or 'human trafficking'. Neoabolitionist efforts to fight such phenomena are typically wedded to a simplistic and essentialist ontology, unaware of or rejecting their own performativity. The thesis is not about slavery: it is about the ethico-political problem of responsibility and hospitality toward the other in the context of contemporary anti-slavery. What constitutes an ethical response to modern slavery? I explore the often violent effects of particular answers to this question but ultimately argue that the focus on doing something (and knowing it) threatens the very possibility of hospitality - of an ethical response. Through a conceptual vocabulary of 'scenes' I explore the performative interrelation of ontology and ethics. It is intended to help resist the metaphysical seductions of ontology and moral urgency. Scenes bundle specific ontologies, frames, conjured histories and futures, roles and narrative structures, distributions of concern, desire and enjoyment. Response begins with the discursive and affective co-constitution of the self, the one to whom we respond, and the scene in which it takes place. Scene-specific forms of responsibility can operate as a defence against the full force of responsibility to the other. Chapters 1 and 2 develop the notion of scenes and explore how neoabolitionism sets its scenes and locates favoured solutions. The remaining chapters explore those solution areas. Chapter 3 looks at how a US movement against 'sex trafficking' in internet advertising reproduces a Manichean world of simplicity by a game of Whac-A-Mole with websites, ritualistic repetition of baseless 'facts', silencing of sex workers, and aggressive demonization of those who disagree or argue for greater complexity; Chapters 4 and 5 draw on time I spent in San Francisco with two very different organisations. One, Not For Sale, makes a product of experiencing neoabolitionism, joining together charity, capitalism, consumer enjoyment, technology and the excitement of a movement of 'true believers', producing innovative approaches but in the process reinforcing problematic gendered and colonial stereotypes. The other, Anti-trafficking Collaborative of the Bay Area, works quietly and tactically in a messy immigration system, aware of the political and performative nature of their work. They actively take responsibility for their own preconceptions and desires to ground a profoundly hospitable client-centred approach avoiding many pitfalls identified in earlier chapters. The thesis has a performative element woven through it - the ethos of the work is one of unsettling both existing practices and literatures, and the writer and reader. The concluding chapter explores the impossibility of hospitality, its interrelation with juridical subjectivity and the ethics demanding and giving accounts in light of the preceding chapters, suggesting a performative approach toward the other is possible.

Quand l’appel à l’aide n’est pas entendu : l’expérience de femmes en processus de sortie de la prostitution

Ce mémoire s’intéresse aux expériences de femmes en processus de sortie de la prostitution. Il vise à comprendre les obstacles auxquels ces femmes sont confrontées pour pouvoir bénéficier d’interventions sociales accessibles et facilitant leur sortie de la prostitution. Cette recherche qualitative prend appui sur 11 entretiens individuels réalisés auprès de femmes âgées de 26 à 55 ans et habitant Montréal, les Laurentides et l’Abitibi. Bien que nombre de femmes aux prises avec la prostitution souhaitent en sortir, on compte peu d’interventions sociales pour les aider en ce sens. Les services publics sont largement insuffisants à la fois du point de vue de leur accessibilité et de leur réponse aux besoins de ces femmes. Peu d’études s’intéressent aux services d’aide à la sortie de la prostitution, notamment au Québec. Ce mémoire privilégie une perspective féministe abolitionniste et un cadre épistémologique de la théorie standpoint. Les résultats mettent en lumière les obstacles à l’accessibilité des interventions sociales, dont le cloisonnement des services et le refus manifeste d’offrir de l’aide aux femmes. Cette recherche rend compte également de l’expérience de pratiques d’intervention entravant le processus de sortie : 1) les pratiques punitives, 2) celles proposant une aide limitée aux femmes ou 3) leur adaptation à la prostitution. La conclusion de ce mémoire propose la mise en œuvre de pratiques sociales novatrices qui prennent en compte les contraintes sociales qui mènent les femmes à l’industrie du sexe et les y maintiennent ainsi que les conséquences de l’expérience même de la prostitution sur elles. / This thesis focuses on the experiences of women in the process of leaving prostitution. It aims to understand the barriers these women face in order to receive social interventions that are accessible and that facilitate their exit from prostitution. This qualitative research builds on 11 individual interviews with women aged between 26 and 55 years and living in Montreal, the Laurentians and Abitibi. Although many women in prostitution want to exit, there are few social interventions to help them in this regard. Public services are largely inadequate both regarding their accessibility and their response to the needs of these women. Few studies have focused on support services to facilitate exiting prostitution, especially in Quebec. This thesis is anchored in a feminist abolitionist perspective with standpoint theory as the epistemological framework. The results highlight the barriers to accessibility of services including compartmentalisation of services and a manifest refusal to provide social support interventions for women. This study also gives an account of the experience of interventions that hinder the exiting process: 1) punitive practices, 2) those providing limited assistance to women or 3) their adaptation to prostitution. The conclusion proposes the implementation of innovative social practices that take into account the social constraints that lead women into the sex industry and keep them there as well as the consequences of the very experience of prostitution on them.

This thesis consists of an analysis of the works of two Cuban authors of the first half of the 19th Century, Francisco de Arango y Parreño and José Antonio Saco. This paper focuses on their works, mainly on those that discuss the topic of slavery. The first chapter introduces the evolution of slavery and its end throughout the Word and in Cuba, focusing on the development of the Cuban society in the 19th century, in which both of the authors lived and created. The second chapter analyses the works of Francisco de Arango y Parreño, his gradual development of ideas and views on the subject in connection with historical events that influenced his works. The third chapter is comprised of similar analysis of José Antonio Saco's works. The conclusion compares the works of both authors and highlights the points in which their views coincide or diverge. The purpose of the research was to analyze the penalizing route prior to those youngsters death, focusing on the practices of social and juridical technicians working in institutions responsible for these youngsters provisional internment, judicial sentence and follow-up of social-educational measures outside the institutions. The data gathering and the record analysis carried out together with the project Murialdo, the Integrated Center for the Attendance of the Juvenile Delinquent (CIAADI/SAS) and the Infancy and Juvenile Jurisdiction of the Forum of Londrina Pr., made it possible to obtain information and analyze the processes to discuss the selectivity of the juvenile penal justice, the negative figure of crime and the regularity of the penalizing discourse among agents authorized to deal with juvenile delinquents, and those who were exterminated during the period they were carrying out social-educational measures outside the institutions. The analytical issue of the research asks to what extent the adoption of juridical-political measures of juvenile control from a distance represent the continuity of official penalizing solutions, based on academic-discourse practices with the purpose of extending the mechanisms of control, life management and continuous reinforcement of the State power. Against this, the thesis intends to criticize the model of action of the juvenile control apparatus and stimulate changes of attitude that call the attention to the existence of a society without penalties and make it viable, apart from the State penal justice apparatuses, the creation of conflicts solution mechanisms which grant power to the parts directly and indirectly involved, to solve the problems where they occur / As determinações institucionais sobre os adolescentes infratores que passaram pelo complexo tutelar e assistencial de atendimento em Londrina (PR), incluindo os que foram vítimas de assassinato, constituem o objeto de estudo da tese. O propósito da pesquisa foi analisar o trajeto penalizador anterior à morte daqueles jovens focalizando as práticas dos técnicos sociais e jurídicos inseridos nas instituições responsáveis pelo internamento provisório, sentenças judiciais e acompanhamento das medidas sócio-educativas a céu aberto. The target is the knowledge of the argumentative resources and the linguistic resources that construct this argument, applying the principles of the Linguistic Historiography, to know, the Contextualization, the Immanency and of the Adequacy. Always instigated us to know closer the illustrious brazilian, Joaquin Nabuco. In the second half of the century XIX, in full literary bubbling, among others excellent names, Joaquin Nabuco obtained a place of preeminence among his pairs. This detail, and for the fact of his composition not to be divulged as other classics of our language, showed us a singular attention and we went to the search of the elements that had taken him to become an expressive figure at his time. He has written a composition in defense of the slaves emancipation, O abolicionismo, object of this research. To know it better, we considered the following questions that had directed our study: Which were the argumentative and linguistic resources made for the author and, with them, how has the author reached his public, the oitocentista reader? Which was his audience? Has the nabuconeana language followed the linguistic molds of its time? In full movement of freedom which was the language used by him, the classic of Portugal or the Brazilian dialect? Which current literary has he belonged? Can his language be considered out of the time? Guided for these questions, we looked more details in his composition, over all in what concerns to the strategies for him used for the adhesion of his personage, the way he chooses the proves, how he trams the arguments, and the progression to make the hierarchy and how it intensifies during the advance of the chapters of the book. To reach this objective, we follow the three principles considered for Koerner: of the contextualization, where it creates the climate opinion, of the immanency, where it analyzes the corpus on the basis of the classic Rhetoric and the adequacy, where it brings up to date the previous analysis, with bedding in a modern theory, the New Rhetoric. After the analysis, we´ve got the results / O tema de nosso estudo é a argumentação na obra de Joaquim Nabuco, O abolicionismo. Seu escopo é o conhecimento dos recursos argumentativos e dos recursos lingüísticos que constroem essa argumentação, aplicando os princípios da Historiografia Lingüística, a saber, a Contextualização, a Imanência e da Adequação. Sempre nos instigou conhecer mais de perto o ilustre brasileiro, Joaquim Nabuco. Na segunda metade do século XIX, em plena efervescência literária, entre outros nomes relevantes, Joaquim Nabuco conseguiu um lugar de proeminência entre seus pares. Esse detalhe, e pelo fato de sua obra não ser tão divulgada como a de outros clássicos de nossa língua, despertou-nos singular atenção e fomos à busca dos elementos que o levaram a tornar-se uma figura expressiva em sua época. Ele escreveu uma obra em defesa da emancipação dos escravos, O abolicionismo, objeto desta pesquisa. Para melhor conhecê-la, propusemos as seguintes questões que direcionaram nosso estudo: Quais foram os recursos argumentativos e lingüísticos usados pelo autor e, com eles, como teria o escritor atingido seu público alvo, o leitor oitocentista? Qual era seu auditório? A linguagem nabuconeana acompanhou os moldes lingüísticos de sua época? Em pleno movimento de liberdade qual o idioma por ele usado o clássico de Portugal ou o dialeto brasileiro? A que corrente literária pertenceu? Sua linguagem pode ser considerada atemporal? Orientados por essas perguntas, procuramos conhecer com mais detalhes sua obra, sobretudo no que concerne às estratégias por ele empregadas para a adesão do seu interlocutor, à maneira como escolhe as provas, como urde argumentos e a progressão como os hierarquiza e intensifica na proporção que os capítulos avançam. Para atingirmos esse objetivo, seguimos os três princípios propostos por Koerner: o da contextualização, em que se cria o clima de opinião, o da imanência, em que se analisa o corpus com base na Retórica clássica a e o da adequação, em que se atualiza a análise feita, com fundamento em uma teoria moderna, a Nova Retórica. Após a análise, concluímos havermos atingido as metas propostas, conhecemos melhor o processo de criação de Joaquim Nabuco, as técnicas argumentativas usadas, as estratégias de convencimento e comprovamos o caráter de universalidade da obra
