Concebe o livro texto como "Forma Simbólica" e propõe uma discussão metodológica baseada em teorias hermenêuticas. Dessa forma, defende que os manuais didáticos devem ser interpretados considerando-se três vertentes interligadas - sócio-histórica, formal (ou interna) e ideológica - as quais estruturam as discussões apresentadas. Numa abordagem "indutivo-descritiva da prática", traz à cena diversos trabalhos acadêmicos buscando extrair deles recursos para abordar livros-texto de Matemática compreendendo, ao mesmo tempo, uma das faces da produção brasileira em Educação Matemática. O trabalho é apresentado em três estudos que, embora entrelaçados, podem ser lidos independentemente, representando alguns dos distintos momentos da pesquisa. / Abstract: The main goal of this dissertation is to study Math textbooks and how their analysis could be done. Textbooks are taken as "Symbolic Forms" and their methodological discussion is hermeneutically based. We claim that Math textbooks should be interpreted from three linked strands or points of view - the socio-cultural, the formal (or internal) and the ideological - which give the structure to the analysis. The so-called "inductive-descriptive approach" is used in order to analyze how Math Education researchers and their Research Groups study textbooks. This way, we can understand the analysis themselves and a specific part of the Brazilian Math Education production, discussing some common features among these productions. This dissertation is presented in three studies that, although intertwined, can be taken independently, representing some of the different moments of our search to understand Math textbooks and how their analysis can be developed. / Mestre

A presente tese focaliza a questão da individuação espiritual na obra de Henry Corbin, valendo-se de pontos da obra de Heidegger que iluminam essa questão. Heidegger foi um dos filósofos que mais influenciaram Corbin, sendo que este foi o primeiro tradutor de Heidegger para o francês. No entanto, não é o propósito da tese demonstrar essa influência, embora muitas vezes o faça. O que importa é se valer das idéias de Heidegger que parecem equivaler às de Corbin, para ajudar-nos na anãlise da questao do exílio e da individuação. Conceitos de Heidegger tais como hermenêutica, fenomenologia, o Dasein, o Ser, a Superação da Metafísica, o Impessoal (das Man), a decisão pela Autenticidade, pelo ser si-mesmo mais próprio, colocam-se em cena ao longo da tese para colaborar com o aprofundamento da compreensão da individuação espiritual em Corbin. Parto da questão do exílio da alma em Corbin e nos místicos que este representa, tentando primeiramente levantar a etiologia de tal exílio, de tal disjunção alma-mundo. Para isso, lanço mão não só de Heidegger, mas também de Husserl, que foi bastante importante para Corbin. Em seguida, abordo, a partir da hermenêutica e da fenomenologia, a noção de imaginal e de hermenêutica espiritual, que equivale a uma interiorização e a uma integração do mundo na alma. Para isso, valho-me das noções de tempo e espaço na mística oriental de Corbin assim como na filosofia de Heidegger. O percurso desta primeira parte vai do exílio da alma no mundo do espaço quantitativo ao mundo vivido na alma, ou seja, a perspectiva da saída do exílio enquanto um retorno ao mundo da alma. A segunda parte, aborda o conceito de alma em Corbin e na mística sufi, que possui um caráter dual e pressupõe o conceito de anjo do sufismo, assim como o de Pessoa, que foi herdado por Corbin de Berdiaev, para então justapô-los ao conceito de Dasein de Heidegger e a verificação dos pontos onde os conceitos de Dasein e de Pessoa se encontram e se equivalem. A ideia de personalismo e autenticidade contrapõe-se em ambos autores ao nihilismo e ao Impessoal que oprime o homem moderno e o atira no exílio. Esta crise é apresentada na tese como um mundo sem alma assim como um mundo onde prevalece o esquecimento do ser, sendo que as indicações de superação de Heidegger e Corbin apontam para direções similares e às vezes complementares. A saída do Exílio tem como condição a tomada de consciência das consequências da despersonalização do mundo, do empobrecimento espiritual, e do perigo que o homem está correndo de desaparecer enquanto homem, enquanto Pessoa. A superação da crise, o retorno à casa, aparece em ambos ligada à capacidade de desconstrução de qualquer objetivação e na neutralização do caráter reificador e dominador do pensamento, que concorrerão para a reintrodução do transcendente, do inabarcável e misterioso, do espiritual na cotidianeidade e na visão de mundo do homem moderno. / This thesis focuses the question of spíritual individuation in Henry Corbin1s work, using the parts of Heideggers work which throw light on this question. Heidegger was one of the philosophers which most influenced Corbin, who was the first translator of Heideggers work in french. Nevertheless, it is not the purpose of this work to demonstrate this influence, although it becomes evident along the thesis. What matters here is is to take Heideggers ideas that seem to match to Corbins in order to help us in the analisis of the question of exile and of individuation. Heideggerian concepts such as hermeneutics, phenomenology, the Dasein, Being, the overcoming of metaphysics, the Impersonal (das Man), the will to authenticity to be one\'s very self, are employed throughout the thesis, so as to contribute to a better understanding of spiritual individuation in Corbin\'s philosophy. I take as my starting point the subject of the exile of the soul in both Corbin and the mystics whom he represents, first of all by attempting to trace the etiology of this exile, this disjunction between soul and world. To that end, I avail myself not only of Heidegger\'s philosophy, but also that of Husserl, which had a great deal of influence on the work of Corbin. I then address, with the help of hermeneutics and phenomenology, the concepts of imaginal and spiritual hermeneutics, which is equivalent to the interiorization and integration of the world into the soul. To that purpose, I utilize the notions of time and space in the oriental mysticism of Corbin and in Heidegger\'s philosophy. The first part then covers the trajectory of the soul from its exile in the world of quantitative space back to the lived world of the soul; in other words, the way of exile as a return to the soul-world. The second part covers both the concept of soul in Corbin and in Sufi mysticism, wich possesses a dual character and in Sufism pressuposes the concept of \"angel\", and that of Person, which Corbin inherited from Berdiaev, with the intention of contrasting these concepts with Heidegger\'s Dasein and verifying where they meet and are the same. In both authors, the ideas of personalism and authenticity are put in opposition to ninhilism and the Impersonal which oppresses man in the modern world and casts him into exile. In the thesis, this crisis is described in terms of a world devoid of soul, a world where the soul has been forgotten, and what Corbin and Heidegger appoint as the way to overcome it are many times similar and sometimes complementary. The way out of Exile has as its condition the awareness of the consequences of the de-personalization of life, of spiritual empoverishment, and of the risk man runs of diassappearing as man, as a person. In both Heidegger and Corbin, the overcoming of the crisis, the return home, is associated with the capability of desconstructing any sort of objectification and of neutralizing the reifying and imposing character of thought, which will collaborate with the re-introduction of the transcendent, the unfathomable, and the mysterious in the daily life and world view of modern man.

[pt] O presente trabalho tem como objetivo analisar alguns aspectos concernentes à interpretação da Constituição. A tarefa de desvendar o significado da norma está condicionada pela inconstância semântica dos enunciados que exteriorizam seu conteúdo e pela précompreensão inerente a todo interprete. Estes dois dados, aliados aos métodos clássicos de interpretação jurídica, fazem da busca pelo teor da norma um ato de voluntarismo. Como forma de mitigar as escolhas individuais do interprete e, dessa forma, fazer da Constituição em importante elemento de integração social, investiga-se um meio que garanta a racionalização do processo de interpretação sem perder de vista o pluralismo característico das sociedades atuais. Acredita-se que mediante a ampliação do rol de agentes habilitados para participar do debate que antecede a fixação da substância da norma constitucional, isto é, possibilitando a integração deliberativa de um número maior de setores da sociedade, estar-se-á dando um importante passo no sentido de se atingir a interpretação mais adequada da Constituição. Entende-se que essa perspectiva discursiva permite a introdução de um fator que debela e mitiga a vontade individual do intérprete, além de legitimar a imposição da própria Constituição. Além disso, mas na mesma direção, constata-se que a Constituição moderna, em função da abertura de seu texto e da diferenciação de densidade de suas normas, demanda a utilização de métodos de interpretação que, em detrimento da aplicação silogística de suas regras e princípios, a partir do primado da norma, valorizem a orientação tópica, aproximando os juízos formulados pelos intérpretes do caso concreto. Nos processos de controle concentrado de constitucionalidade que tramitam perante o Supremo Tribunal Federal, a figura do amicus curiae, dada pela legislação que regula a matéria, pode ser importante instrumento de defesa desta concepção democrática da interpretação da Constituição. / [en] This work is intended to analyze a few aspects concerning the interpretation of the Constitution. The task of unfolding the meaning of the norms is conditioned by the semantic inconstancy of the items that exteriorize its content and by the comprehension inherent to every interpreter. This two data, allied to the classic methods of legal interpretation, make the search for the tenor of the norm an act of voluntarism. As a manner to mitigate the individual choices of the interpreter and, therefore, make the Constitution an important element of social integration, we shall investigate a manner that guarantees the rationalization of the interpretation process without losing the pluralism characteristic of the current societies. We believe that upon the expansion of the list of agents qualified to prepare the debate that antecedes the determination of the substance of the constitutional norm, i.e., allowing the deliberative integration of a larger number of sectors of society, therefore moving in a great deal in order to reach the most pertinent interpretation of the Constitution. We believe that this discursive perspective allows the introduction of a factor that restricts and mitigates the individual will of the interpreter, further legitimating the imposition of the Constitution itself. Furthermore, but in the same direction, we verify that the modern Constitution demands the use of interpretation methods that, due to the opening of its text and the differentiation of the density of its norms and in detriment to the syllogistic application of its rules and principles from the superiority of the norm, valorize the topic orientation, approximating the decisions made by the interpreter in the correct case. In the processes of concentrated control of constitutionality in course before the Federal High Court, the figure of the amicus curiae, due to the legislation applicable to the issue, may be important instrument of defense of this democratic conception of the interpretation of the Constitution.

[pt] O presente estudo versará sobre a Interpretação da constituição na Teoria das Restrições dos Direitos Fundamentais, objetivando oferecer uma compreensão da hermenêutica específica e constitucionalmente adequada para os direitos fundamentais. A primeira parte da pesquisa assentar-se-á, primordialmente, na tarefa de desenvolver propostas para uma teoria adequada da concretização de princípios constitucionais. O desenvolvimento deste estudo, conectar-se-á com dois pilares do Direito: norma e sistema jurídico. Isso porque incorporamos a noção pós-positivista de Constituição como sistema aberto de princípios e regras de Canotilho. A segunda parte da pesquisa pretende desenvolver uma metódica estruturante em vista de uma teoria que melhor se adeqüe as restrições aos direitos fundamentais na interpretação da Constituição brasileira de 1988. E se fala em teoria adequada considerando-se aquela voltada para a realidade jurídico- Constitucional brasileira que se nos revela, no texto constitucional de 1988. Na terceira parte do trabalho estudaremos a colisão, as restrições e a ponderação de interesses como ferramenta metodológica de aferição da constitucionalidade das restrições aos direitos fundamentais. Por fim, na quarta parte do trabalho trataremos das restrições e colisões de direitos fundamentais na jurisprudência do Supremo Tribunal Federal. A concretização dos direitos fundamentais, as colisões e restrições e os seus correspondentes momentos de aplicação jurisprudencial mostram a importância do método concretizante para a configuração de uma Nova Hermenêutica projetada para melhor responder as demandas de uma sociedade plural e complexa, pois não perde de vista a realidade onde se insere. / [en] The present study will approach the interpretation of the constitution in the Theory of Restrictions of Fundamental Right, having as its objective to offer an understanding of the specific hermeneutic and constitutionally adequate for fundamental rights. The first part of the research will be based, primarily, in the task of developing proposals for a suitable theory of materialization of constitutional principles. The development of this study, it will be connected with two pillars of Right: norm and legal system. This, because, we incorporate the concept post-positivist of Constitution as Canotilhos open system of principles and rules. The second part of the research aims at developing a methodical structure, by regarding to a theory that better adapts to the restrictions on Fundamental Rights in the interpretation of Brazilian Constitution in 1988. It is said in adequate theory, taking into account that one which is directed toward a constitutional legal Brazilian reality that it is disclosed in 1988 constitutional text. In the third part we will study the collision, the restrictions and the balance of interests as methodological tool of gauging of the constitutionality of the restrictions on Fundamental Rights. Finally, in the fourth part of the paper we will deal with the restrictions and collisions of Fundamental Rights of Supreme Court jurisprudence. The achievement of the Fundamental Rights, the collisions and restrictions and their corresponding moments of jurisprudential application show the importance of the materializing method to set up a New Hermeneutic designed to better answer the demands of a plural and complex society, for it doesnt lose the vision of the reality where it is in.

[pt] Depois do crescimento de movimentos de extrema direita na política nos últimos anos, algumas expressões religiosas vinculadas a esses movimentos foram categorizadas como fundamentalistas. Este conceito, contudo, não é tão claro quanto a recorrência do seu uso sugere, e, evidentemente, sem um bom conceito que auxilie na identificação do que seja fundamentalismo, pouco se avança no seu enfrentamento. Portanto, este trabalho se propõe, primeiramente, a oferecer um conceito para fundamentalismo — extraído da sua origem evangélica estadunidense [1900-1925] —, e, a partir dele, deseja apontar alguns caminhos alternativos de superação. Na construção deste conceito, chama-se atenção para a interação entre sua estrutura hermenêutica e o uso fundamentalista da Bíblia, mostrando como esta dinâmica gera uma postura política violenta. E, no apontamento desta superação, mostra-se a necessidade de uma nova concepção sobre a Bíblia e a importância da apreciação da condição do intérprete. / [en] After the rise of far-right movements in politics in recent years, some religious expressions linked to these movements have been categorized as fundamentalist. This concept, however, is not as clear as the recurrence of its use suggests, and, evidently, without a good concept that helps in identifying what fundamentalism is, little progress is made in overcoming it. Therefore, this work proposes, first, to offer a concept for fundamentalism — extracted from its American evangelical origin [1900-1925] —, and, from it, it wishes to point out some alternative ways of overcoming it. In the construction of this concept, attention is drawn to the interaction between its hermeneutic structure and the fundamentalist use of the Bible, showing how this dynamic generates a violent political posture. And, in pointing out this overcoming, the need for a new conception of the Bible and the importance of assessing the condition of the interpreter are shown.

[pt] A dissertação investigará a experiência hermenêutica da escrita a partir do ponto de vista da dialética platônica. Como primeiro passo, será exposto o modo como Gadamer promove um debate com a estética moderna para identificar suas limitações e, assim, propor um modo de desobstrução da verdade da obra de arte. O objetivo aí é apontar, neste momento introdutório do problema, como a literatura, entendida amplamente aqui como tudo aquilo que é escrito, acaba por ser afetada por uma experiência limitadora da estética, que transforma o artístico em objeto da consciência estética . Além disso, ver-se-á que esta mesma problematização abrirá para nossa investigação o horizonte hermenêutico da história. Em momento seguinte, a partir de uma leitura fenomenológica do Fedro de Platão, a dialética platônica se apresentará e possibilitará uma primeira abertura para o [e do] escrito. Será, então, finalmente avaliada a dimensão histórica da experiência do escrito, o que conduzirá a investigação à recepção propriamente dita da dialética platônica pela hermenêutica filosófica. Aqui a interpretação dos textos escritos será pensada como abertura para o diálogo com o Outro e a tradição, explicitando a linguisticidade desse acontecimento. A poesia, nesse momento, será exemplo máximo e iluminador das possibilidades de toda obra linguística e literária. / [en] The dissertation will investigate the hermeneutical experience of writing from the point of view of platonic dialectics. As a first step, it will be exposed the way Gadamer promotes a debate with modern aesthetics in order to identify its limitations and, therefore, propose a way of freeing the work of art truth. The objective there is to point out, in this introductory moment of the problem, how literature, broadly understood here as everything that is written, ends up to be affected by a limiting experience of aesthetics, which transforms the artistic into object of the aesthetics consciousness. Besides, it will be seen that this same questioning will open the hermeneutical horizon of history for our investigation. In the next moment, from a phenomenological reading of Plato s Phaedrus, the platonic dialectics will present itself and make possible a first overture for the [and from the] written word. Then, it will be finally evaluated the historical dimension of the written word, which will lead the investigation to the very reception of platonic dialectics by philosophical hermeneutics. Here, the interpretation of written texts will be thought as an overture for the dialogue with the Other and tradition, showing the linguistic character of this event. Poetry, in this moment, will be the greatest and the most illuminating example of the possibilities of the linguistic and literature.

A presente dissertação tem como objetivo o estudo do controle de constitucionalidade que envolve finalidades. Nesse âmbito, o trabalho pretende identificar e analisar quais as principais relações que as finalidades nutrem com as normas jurídicas e com outras finalidades; que fatores exercem influência sobre essas relações; qual a posição do legislador ordinário em face das finalidades da Constituição; e quais os tipos de raciocínio de que se vale o julgador ao lidar com fins. Para tanto, com arrimo na doutrina e na jurisprudência, a dissertação desenvolve certas distinções, tais como: finalidades contidas nas normas e finalidades justificantes das normas; normas-comando e normas-fim; valores e estados de coisas; relações conceituais e relações causais; promoção e restrição; oposição e divergência; interpretação e concretização, além de procurar estabelecer alguns critérios mínimos para a decisão no controle finalístico. Com base nos conceitos trabalhados, estuda-se o chamado desvio de poder legislativo. Com o fito de aplicar e exemplificar as ideias desenvolvidas, coletam-se manifestações de ministros do Supremo Tribunal Federal em litígios submetidos a sua apreciação. Relaciona-se sucintamente, por fim, o tema principal com os temas: controle incidental, efeitos da decisão e natureza da inconstitucionalidade / This dissertation aims to study the constitutionality control that involves finalities. In this extent, the work intends to identify and analyze which are the main relationships that finalities maintain with juridical norms and other finalities; which factors influence these relationships; which is the position of ordinary legislator in view of Constitution; and what kinds of reasoning the judge apply when dealing with ends. To perform this task, with the support of doctrine and jurisprudence, the dissertation develops some distinctions as: finalities contained in norms and finalities that justify norms; command-norms and endnorms; values and states of affairs; conceptual relationships and causal relationships; promotion and restriction; opposition and divergence; interpretation and concretization, besides attempting to establish some minimum criteria to the decision in finalistic control. On the basis of these concepts, the work studies the so-called deviation of legislative power. In order to apply and exemplify the developed ideas, there are selected some manifestations of judges from Supreme Federal Court in disputes submitted to their appreciation. At last, the dissertation briefly relates the main theme to the following themes: incidental control, decision effects and nature of unconstitutionality.

Among its methods are deduction and induction, which are discursive, and the intuition. By deduction, we reason from the general to the particular. By induction, we start from the particular to reach the general. Intuition is the direct way to acquire knowledge. The logic methods have their basis in Rationalism and Empiricism. For the former, the knowledge stems from exclusively in the reason; its method is deductive. For the latter, the knowledge is acquired by experience, either external or internal; its method is inductive. Intuition is the no discursive method. Using it, we can reach the values, the object of Axiology. The values implicate the genesis of the rules and juridical principles. The phenomenon of the values happens in the society and interact with the culture. The human being is the source value, and the Justice is the fundamental value. Equity is a kind of Justice, which surpasses in a certain way. The Juridical Logic is the application of the Logic as Law instrument. The operator uses either deduction or induction, i.e., are methods used for interpretation and application. The intuition is also applied by the Law operators, although its study has not been so developed. It can be seen by the analyses, as juridical, the principles and the rules, the doctrine and other works, the sentences, the jurisprudence, the habits, the analogy and criminal investigation. None of the methods is used in an isolated way, for interpretation and Law application, because they are not enough, although the three ones, objects of this study, are adequate. The methods which are most studied are deductive and inductive, but the intuition has also an important role in the interpretation and application of the Law, although the operator does not realize how often he makes use of it in his everyday work. The methods are, therefore, complementary and interdependent / A Lógica é instrumento da Filosofia e de todas as ciências. Entre seus métodos estão a dedução e a indução, que são discursivos, e a intuição. Pela dedução, raciocina-se do geral para o particular. Pela indução, parte-se do particular para se chegar ao geral. A intuição é forma direta de aquisição de conhecimento. Os métodos lógicos têm seu fundamento no Racionalismo e no Empirismo. Para o primeiro, o conhecimento se origina exclusivamente na razão; seu método é o dedutivo. Para o segundo, o conhecimento se adquire pela experiência, seja externa ou interna; seu método é o indutivo. A intuição se trata de método não discursivo. Por ela, se chega aos valores, objeto da Axiologia. Os valores implicam a gênese de normas e princípios jurídicos. O fenômeno dos valores se dá na sociedade e se interrelaciona com a cultura. O ser humano é o valor fonte, e a Justiça, o valor fundamental. A Eqüidade é uma espécie de Justiça e, de certa forma, a supera. A Lógica Jurídica é a aplicação da Lógica como instrumento do Direito. O seu operador utiliza tanto a dedução como a indução, ou seja, são métodos utilizados para sua interpretação e aplicação. A intuição também é aplicada pelos operadores do Direito, embora seu estudo ainda não esteja tão desenvolvido. Isso se constata pela análise, no âmbito jurídico, dos princípios, das normas, da doutrina e outros trabalhos, das sentenças, da jurisprudência, do costume, da analogia e da investigação criminal. Nenhum dos métodos é utilizado de forma isolada, para interpretação e aplicação do Direito, pois, por si só, não é suficiente, embora sejam todos os três, objeto deste estudo, adequados. Todos podem e devem ser utilizados. Os métodos mais estudados são o dedutivo e o indutivo, mas a intuição também tem um importante papel na interpretação e na aplicação do Direito, embora o operador possa até não se dar conta de quanto a utiliza em seu trabalho cotidiano. A estrutura geral desta pesquisa está desenvolvida em dois segmentos, sendo que o primeiro focaliza os fundamentos teóricos sobre interpretação musical, suas principais tendências, a teoria da Formatividade de Luigi Pareyson e alguns conceitos complementares de Unberto Eco a propósito dos limites da interpretação. No segundo, apresentamos uma revisão bibliográfica do que já foi pesquisado sobre a literatura violonística do compositor, um panorama geral de sua produção violonística na década de 1970, alguns comentários sobre a gênese dos 12 Estudos, aspectos documentais dos Estudos de Mignone e considerações gerais sobre as diferentes versões dessa obra. Apresentamos também um modelo de aplicação dos conceitos teóricos discutidos no primeiro capítulo, abordando as contribuições técnicas desses Estudos, incluindo soluções para trechos problemáticos e diretrizes interpretativas para essa obra. As considerações finais procuram responder aos questionamentos formulados na introdução, porém de forma não conclusiva, por considerarmos que o modelo de interpretação apresentado é apenas uma possibilidade entre muitas. Os anexos incluem uma Edição Aberta dos 12 estudos de Mignone (fac-símile e urtext), entrevistas e um CD contendo nossa interpretação dos estudos, como resultado prático de uma pesquisa orientada pala sua conjugação com a reflexão teórica. / Abstract: This dissertation deals with musical interpretation and discussses the practical application of theorical principles in Francisco Mignone's Twelve Studies for Guitar.The body of this paper is sstrucstured in two sections. The first focuses on the theoretical foundations of the musical interpretarion, in main trends, Luigi Pareyson's "theory of formativity", as well as some complementary concepts by Umberto Eco on the limits of interpretarion. The second section contains a bibliographic revision about researches on the Mignone's guitar output, an overview of this compositions for guitar on the seventies, and commemtaries about de genesis of his Twelve Studies, philological aspacts and general considerations about the different versions of this work. There is also apractical application of the concepts discussed in the first chapter, presenting the didactic contribuitions of Mignone's Studies, including some solutions fo difficult passages and some interpretative suggestions for this work. The final considerations are an attempt to answer the questions presented in the introduction, but nor in a conclusive way, since we consider that the model of interpretation presented here inonlu one amongst many others. The annexes contain a "Double Edition" of Mignone's Twelve Studies (the original version and our Urtext), complete interviews, and a CD with our interpretation of this work, a a practical result of a research which was guided by the theoretical reflection. / Mestre
