Schoolyard Politics: Ethics and Language at the International Criminal Tribunal for the Former Yugoslavia

The International Criminal Tribunal for the Former Yugoslavia (ICTY) has been both contentious and successful. By examining the ICTY from a Levinasian ethical standpoint, we might be able to understand how the court uses language to enforce ethical and moral standards upon post-war societies. Using linguistic methods of analysis combined with traditional data about the ICTY, I empirically examine the court using ordinary least squares (OLS) in order to show the impact that language has upon the court's decision making process. I hypothesize that the court is an ethical entity, and therefore we should not see any evidence of bias against Serbs and that language will provide a robust view of the court as an ethical mechanism.

Cannibalisme des récits populaires dans l'art : histoires et portraits de famille / Cannibalism through popular tales in art : Stories and family portraits

Certains récits populaires nous renvoient à des angoisses extrêmes et à un imaginaire peuplé de mythes fondateurs, de récits bibliques et contes monstrueux. « Serions-nous « tous cannibales » comme l’écrivit Lévi-Strauss, « Après tout, le moyen le plus simple d’identifier autrui à soi-même c’est encore de le manger». En privilégiant le cadre familial, cette étude pluridisciplinaire propose d’extraire quelques personnages cannibaliques par l’adaptation artistique de ces figures emblématiques. Ainsi Cronos, Le Léviathan, Le loup et la petite fille qui dévorent mère-grand….ont nourri notre imaginaire.… Cette peur immémoriale d’être dévoré et cette envie récurrente de dévorer l’autre, se répondent mutuellement. Les lois complexes de la parenté soulignent des relations intergénérationnelles parfois voraces, que sauront transposer les artistes dans leurs œuvres avec notamment des couples fusionnels aux baisers mordants, des Vierges allaitantes, ou d’individus pourvus de ventres aux fonctions contraires. Ce cannibalisme imaginaire et symbolique replacé dans le domaine des arts, suscite plusieurs interrogations ; Pourquoi certains plasticiens questionnent-ils toujours notre appréhension du monde, à travers ces récits populaires ? Comment ces histoires anciennes sont-elles resituées dans l’art contemporain, au sein d’une société avide d’appropriation ? Sous quelles formes artistiques, ce thème de l’oralité, avec cette envie de cannibaliser ou de vampiriser autrui, est-il imaginé aujourd’hui ? Ces récits ont évolué mais l’Homme face à ses contradictions récurrentes, à sa troublante dualité, a-t-il changé ? Par le cordon (ombilical) en fil rouge, les artistes, vont tenter de (dé)nouer tous nos rapports ambivalents avec les autres. Et par la force de ces réincarnations contemporaines au prisme de l’anthropologie et de la psychanalyse, nous vivrons ainsi toutes les étapes artistiques et esthétiques de ce processus cannibalique, en empruntant tous les chemins sinueux de la dévoration, la digestion et enfin la déjection. / Some popular stories lead to extreme repressed anxiety and to an imaginary world made of founding myths, biblical stories and monstrous folk tales. “Could we all be cannibals “asked Lévi-Strauss, “After all, the best way to identify to someone else would be to eat them”. By privileging the family setting, this multidisciplinary study offers to highlight a few cannibal characters by the artistic adaptation of these iconc figures. Cronos, Leviathan, the wolf of the little Red Riding Hood, ave nourished our fantasy world. This eternal fear of being eaten and this recurring desire to eat others are closely intertwined. The complex laws of parenting stress the sometimes voracious intergenerational relationships, the artists transposing them in their works, as in the biting kisses of fusional couples, breastfeeding Virgins, and creatures with reversed stomachs. This imaginary and symbolic cannibalism in the arts asks a few questions. Why do certain visual artists question our vision of the world, through those popular stories ? How are there ancient narratives shown in art in a society eager to own ? Under which art forms is this oral theme, devouring and cannibalizing or vampirizing others, imagined today ? These stories have indeed evolved, but Man faced to its eternal contradictions, to its disturbing duality, has he really changed ? With the (ombilical) cord as a common thread, artists will try to unravel all our ambivalent relationships with others. And with the force of these contemporary reincarnations through the prism of anthropology and psychoanalysis, we will go through all the artistic and aesthetic steps of this cannibalistic process, from devouring, through digestion, and to end with dejection.

<p>Bakgrund: Sjukfrånvaron i Sverige är hög i jämförelse med andra EU-länder.Långtidssjukskrivning till följd av stressrelaterade sjukdomar domineras av kvinnor.Det finns ett stort behov av en effektivare återgångsprocess till arbetslivet efter ensjukskrivning där olika insatser bör prövas och utvärderas. I vissa fall kan en neutralpart i form av en oberoende samordnare vara till hjälp för den sjukskrivne iåtergångsprocessen. Syfte: Syftet med studien var att beskriva kvinnors erfarenheter avmöten med arbetsgivarringens representant i återgångsprocessen till arbete, efter enstressrelaterad långtidssjukskrivning. Metod: Data insamlades genom kvalitativaintervjuer med tio kvinnor. Inklusionskriterer var att ha varit långtidssjukskriven förstressrelaterade sjukdomar, att ha varit i kontakt med en arbetsgivarring, samt att underåren 2007-2008 återgått till tidigare arbete eller annat lönearbete i en omfattning avminst 25 procent och ha arbetat under minst sex månader. Med arbetsgivarringens hjälpgjordes ett strategiskt urval, där hänsyn togs till ålder, sjukskrivningens längd, yrke ocharbetsplats. Data analyserades med manifest- och latent innehållsanalys. Resultat:Resultatet visar på fyra kategorier som representerar det manifesta innehållet: att blibemött med respekt och engagemang, att arbeta med att finna lösningar, egen utvecklingmed ökat självförtroende, organisatoriska aspekter. Det latenta innehållet beskriverkvinnans utvecklingsprocess, arbetsgivarringens handledningsprocess och det mellanmänskligasamspel som sker mellan dessa parter. Intervjuerna genomsyras av uttryckdär kvinnan beskriver att hon befinner sig i centrum. Allt handlar om henne och det ärarbetsgivarringen som får henne att känna sig betydelsefull. Slutsats: Genom en djupareförståelse för vad som bidrar till återgång till arbetslivet för personer medlångtidssjukskrivning, kan grunden läggas till ökad satsning och adekvata insatser förökad återgång till arbetet för fler personer.Nyckelord: återgång till arbete (RTW), stressrelaterad långtidssjukskrivning</p> / <p>Background: Sickness absenteeism is high in Sweden compared to other countries inthe European Union. Long-term-sick-absenteeism which depends on stress-relatedsickness is dominated by women. There is a great need to make the return-to-work(RTW) process more effective after an absenteeism where different contributions mustbe tested and evaluated. In some cases may neutral parties in form of an independentRTW-coordinator support sick-listed persons in their RTW-process. Purpose: Thepurpose of the study was to describe women’s experiences of meetings with a personfrom an “arbetsgivarring” in the RTW-process, after a period of stress-related sickness.Methods: Data was collected by qualitative interviews with ten women. Criteria thatincluded participation: to have been long-term-sick-listed because of stress-relatedsickness,to have been in touch with an “arbetsgivarring”, and during 2007-2008returned to earlier occupation or other form of paid work in an extend of 25 percent andhave been working for at least six month. Data was analysed using both manifest andlatent content analysis. Results: The result shows four categories representing themanifest content: to be treated with respect and engagement, to work with findingsolutions, own development with increased self-confidence, organisational aspects. Thelatent content describes the development process of the woman, the guidance process ofthe “arbetsgivarring” and the inter-mediate humanity that occurs between these twoparts in the meeting. All narratives are permeated by expressions where the womandescribes herself being in the centre of attention. Everything is about her and the“arbetsgivarring” makes her feel important. Conclusions: Through deeperunderstanding regarding what promotes RTW for persons on long-term-sick-list thebasis for an increased investment and adequate contributions to reach an improvingRTW can be laid for numerous persons.</p>

This essay aims to examine how the synthetic non-human subjects, EDI and Legion, are constituted in terms of their bodies, gender, desire and emotion, in the gaming series Mass Effect. In a close-gaming method I also want to explore in which way the gamer can effect or even change the expressions of the body, gen­der, desire, and emotion made by the synthetic non-human subjects. In order to do this I use Judith Butlers and Sara Ahmeds queer theory, and Donna Haraways cyborg feminism. I concluded that EDI em­braces her embodiments and is given a highly sexualized female body, being more of a woman than a machine. While Legion is rather embracing disembodiment and is given a non sexualized, androgynous male body, be­ing more of a machine than a man. The gamer can decide whether EDI should have a romance with a human in the game or not, but the gamer cannot in the same way decide whether or not Legions and EDIs subject­ivity will be reco­gnized as human subjectivity or at least almost-human subjectivity.

In Search of the Deep Politic: Light/The Holocaust and Humanity Project, an Arts, Education and Civic Partnership, explores the enactment of public scholarship through embedded case study methodology. Charting the author's experience of seeking deep political action, this case demonstrates the ways in which transdisciplinary partnerships create liminal spaces that open possibilities for pedagogic and social change. The study outlines the enactment of an arts, education and civic partnership occurring inAustin, Texas in 2005 centered in a community-based study of the Holocaust. The study seeks answers to the following questions: (a) How did community leaders envision and enact the community-based partnership Light/The Holocaust and Humanity Project?; (b) In what ways, if any, were the artistic, education and civic events amplified through the collaborative partnership Light/The Holocaust and Humanity Project?; and (c) What pedagogical possibilities occur for audiences experiencing the dance work Light/The Holocaust and Humanity Project? The case demonstrates the possibilities for expanding educational impact through a community integration process, characterized by the alignment of school-based and community-based learning activities located outside traditional educational spaces using a transdisciplinary approach that combines multiple forms of representation. The embedded case of the dance reveals pedagogical possibilities for Holocaust education made possible through the dance, Light/The Holocaust and Humanity Project. While limitations of the form inhibit the conveyance of dense historical content, it opens possibility for exploration of dense emotional content. A close examination of the construction of the dance provides an entry point for students into important conversations about the history and representation of the Holocaust. The case study demonstrates the ways in which the Light Project engaged civic capacities through expanded participation, enhanced public awareness, and enhanced capacity for convening civic dialogue and contributions to public discourse. This study describes the ways in which resonance, assurances and the catalyzing forces of leaders support the effective implementation of partnerships.

L'universalité des droits humains dans le contexte du pluralisme axiologique inhérent aux relations internationales : le cas du confucianisme

Résumé La démonstration qui est ici à l’œuvre s’apparente, dans une certaine mesure, à celle qu’élabore Amartya Kumar Sen dans 'The Argumentative Indian'. Dans cet ouvrage, Sen discute de l’héritage intellectuel et politique de l’Inde et de la manière dont cette tradition est essentielle pour le succès de la démocratie et des politiques séculières de l’État indien. Pour notre part, nous ne nous intéressons point à l’Inde, mais à la Chine, notamment à l’héritage intellectuel, politique et moral des lettrés confucéens de l’Antiquité chinoise et à la pertinence de revisiter, aujourd’hui, la réflexion confucéenne classique pour mieux penser et fonder les droits humains en Chine. Plus précisément, notre réflexion s’inscrit au sein du débat contemporain, qui a lieu à l’échelle internationale, entourant les soi-disant valeurs asiatiques et les droits humains. Pour les partisans de la thèse des valeurs asiatiques, les valeurs asiatiques seraient associées au modèle de développement dit asiatique, lequel se distinguerait du modèle « occidental » en étant en outre réfractaire aux droits humains. Ces droits ayant une origine occidentale et étant, à maints égards, en rupture avec les valeurs asiatiques, ils ne seraient ni souhaitables en Asie (notamment en Chine) ni compatibles avec les valeurs asiatiques (spécialement avec les valeurs confucéennes). Dans notre thèse, nous réfutons ce point de vue. Par l’entremise d’une analyse de la 'Déclaration universelle des droits de l’homme' de 1948 et d’un examen des quatre textes fondateurs du confucianisme classique que sont : les 'Entretiens' (Lunyu), le 'Mencius' (Mengzi), la 'Grande Étude' (Daxue) et la 'Pratique du Milieu' (Zhongyong), nous démontrons que cette compréhension des choses s’avère injustifiée. Les droits humains ne sont pas incompatibles avec les valeurs confucéennes et leur adoption est souhaitable en Asie (notamment en Chine), tout comme elle l’est en Occident. De fait, la philosophie des droits humains et la pensée confucéenne classique ont de nombreuses affinités conceptuelles, axiologiques et normatives. Loin d’être en rupture, ces univers théoriques convergent, car ils ont tous deux à cœur l’être humain, ses besoins vitaux et son épanouissement au sein de la communauté. Notre démonstration s’appuie, pour une large part, sur l’analyse d’un concept phare de la pensée éthique et politique confucéenne, soit la notion d’humanité ou du sens de l’humain (ren) ainsi que d’une autre notion qui lui est étroitement liée, soit celle de l’homme de bien ou de la personne moralement noble (junzi). / Abstract The demonstration elaborated here is similar, to a certain extent, to the one developed by Amartya Kumar Sen in The 'Argumentative Indian'. In his work, Sen discusses India’s intellectual and political inheritance, and the way this tradition is essential for the success of the democracy and secular politics of the Indian State. For our part, our interest lies not with India, but with China, quite particularly with the intellectual, political and moral legacy of the early Confucian scholars, and the relevancy to revisit, nowadays, Classical Confucian teachings in order to conceive and establish human rights in China. More precisely, our reflection lies within the contemporary debate, which takes place on an international scale, surrounding the so-called Asian values and human rights. For the advocates of the Asian values thesis, Asian values would be associated with the so-called Asian development model, which would distinguish itself from the « Western » model by resisting for instance human rights. These rights, having a western origin and being, in many respects, in breach with Asian values, would be neither desirable in Asia (particularly in China) nor compatible with Asian values (specifically with Confucian values). In our thesis, we refute this point of view. By the intervention of an analysis of the 'Universal Declaration of Human Rights' of 1948 and an examination of four texts founders of the Classical Confucianism who are: the 'Analects' (Lunyu), the 'Mencius' (Mengzi), the 'Great Learning' (Daxue), and the 'Practice of the Mean' (Zhongyong), we demonstrate that this understanding of things is unjustified. Human rights are not incompatible with Confucian values and their adoption is desirable in Asia (including China), quite as it is in Western countries. Actually, the philosophy of human rights and the Classic Confucian thought have numerous conceptual, axiological and normative affinities. Far from being in opposition, these theoretical views converge, because they both care about the human being, his vital needs, and his self-fulfillment within the community. Our demonstration leans, for the most part, on the analysis of a key concept of the Confucian ethical and political thought that is the notion of humanity, or humaneness (ren) and the closely related notion of gentleman, or morally noble person (junzi).

Justice pour les crimes contre l’humanité et génocides : point de vue et attentes des victimes

Les violations aux droits humains causent des milliers de victimes chaque année, des mécanismes de justice sont élaborés afin de répondre à ces crimes, mais les victimes demeurent peu consultées. Par le biais d’entretiens semi-directifs, cette étude présente le point de vue et les attentes des victimes de crimes contre l’humanité du Cambodge et du Rwanda sur la justice. La justice sociale constitue le cadre théorique de cette étude. Les résultats montrent que la justice pénale est centrale à la définition de la justice. La réparation et la vérité en constituent aussi les éléments essentiels. Toutefois, la capacité des tribunaux à rendre compte de la vérité est critiquée par les répondants créant un écart entre ce qu’elles veulent et ce qu’elles obtiennent. La qualité de la prise de décision et du traitement interpersonnel favorise aussi la perception de justice du point de vue des victimes. Les différentes composantes de la justice perçues, comme la punition, la réparation et la procédure, varient toutefois en fonction du contexte social et historique de la victimisation. / Human rights violations cause thousands of victims every year. Justice mechanisms, such as the International Criminal Court, have been developed to respond to these crimes, but victims remain under consulted. In this study, semi-structured interviews were conducted with Rwandan and Cambodian victims of crimes against humanity. Using social justice theories as a theoretical framework, this study examines victims’ perceptions of justice. The results show that while criminal justice is central in victims’ definition of justice, reparation and truth also are essential components. However, the criminal court’s ability to achieve truth is criticized by respondents creating a gap between the truth that they seek and the truth that they obtain. The quality of decision-making as well as how victims are treated also contribute to victims’ perception of justice. However, victims’ justice objectives vary according to the social and historic context.

People use a variety of means to orient themselves towards the future. A more organised approach to handling the future known as "futures studies" is often used in a variety of contexts including long-term planning within large organisations. In the effort to enhance the quality of such studies, there have been arguments for better methods (which makes sense), but methods may not be the most important aspect in the production of futures studies. Greater theoretical awareness in the substantive questions upon which the study is based is more important. To that end, the intent of this dissertation is to infuse a keener awareness of fundamental assumptions in futures studies and contribute to increasing their quality. One objective of the dissertation is to formulate a method or procedure to analyse the futures studies of large organisations, apply it to two empirical cases and thereafter analyse its strengths and weaknesses. The method I discuss and develop extensively in this work consists of an analytical framework that focuses on three aspects of each future study: its architecture, its relationship to a few of the key future issues of our time and its assumptions regarding our views on society, humanity and technology. A second objective is to systematically study future documents from two large organisations and attempt to clarify motives, orientation, methodology and distinguishing characteristics in their future processes. The cases I have chosen are the Swedish Armed Forces and the telecommunications company Ericsson, which were both in a period of transition around the mid 1990s. The dissertation shows how the method has been used to bring to the fore and clarify central ideas in futures studies, identify ambiguities and fuzzy thinking and to show and expose more covert assumptions. The analysis also illustrates that certain aspects of the model have been observed in the empirical material, other ideas are found to a lesser extent and certain perspectives are entirely absent. The paper stresses that the model developed has both strengths and weaknesses, but the overall assessment is that it was well-balanced and maintains appropriate depth in relation to desired efficiency. The study shows that the analytical method is relevant and adequate to understand and describe the direction and content of futures studies and in so doing enhance their quality.

Betydelsen av socialt stöd för upplevelsen av psykisk ohälsa : En kvalitativ socialpsykologisk studie som omfattar åtta individer i ett kommunalt rehabiliteringsprojekt

Med denna socialpsykologiska studie ville vi få en ökad förståelse för vad socialt stöd upplevdesbetyda för rehabiliterande individers syn på sin psykiska ohälsa. De åtta intervjuernagenomfördes i anslutning till ett rehabiliteringsprojekt för personer med psykisk ohälsa i enav Sveriges kommuner. De intervjuade personerna var inskrivna i rehabiliteringsprojektet ochdeltog i dess aktiviteter. Resultatet visade att dialoger med personer som hade erfarenhet avliknande psykisk ohälsa och professionella hade störst inverkan på individernas syn på sinpsykiska ohälsa. I analysen använde vi Goffmans teori om stigma, Meads teori om rollövertagandeoch Bubers dialogteori. Enligt analysen bidrog personer med liknande psykisk ohälsaoch professionella till vad vi kallar frigörande dialoger, där respondenterna kunde bli förståddaoch accepterade såsom de var. Betydelsen dessa personer hade för individernas förståelseoch acceptans menar vi baserades på deras förståelse genom sitt igenkännande och sittarbete. Vi menar att denna nivå av förståelse inte kunde fås av personer utan dessa egenskaper,oavsett vem det var, om inte kunskapen skaffades. / With this social psychological study we wanted to gain an increased understanding of whatimportance the social support had for how rehabilitative individuals' look at their mental illness.The eight interviews were conducted in a rehabilitation project for people with mentalillness in one of Sweden's municipalities. The people we interviewed were enrolled in the rehabilitationproject and participated in its activities. The result showed that dialogue withpeople who had experience from similar mental illness and professionals had greatest impacton how the respondents' looked at their mental illness. In the analysis, we used Goffman’stheory of stigma, Mead’s theory of role taking and Buber’s theory of dialogue between individuals.According to our analysis, people with similar mental health and professionals contributedto what we call liberating dialogues in which respondents could be understood andaccepted as they were. We mean that the significance these people had for the individual'sunderstanding and acceptance was based on their understanding by their recognition andwork. We mean that this understanding could not be obtained by any person without suchproperties, no matter who it was, if the knowledge wasn’t acquired.
