Fundamentos filosóficos para uma crítica e legítima aplicação do direito: o operar do círculo hermenêutico na compreensão jurídica

This work presents a new paradigm for legal hermeneutics, divorced from positivism and hence the legal doctrine. To do so, outlines the doctrinal framework that preceded the construction of the theoretical framework used here , the philosophical hermeneutics of Gadamer, whose keynote is in opposition to the method as the only means to get to the truth. When entering your analysis itself, seeks to work with the most important concepts, such as tradition, authority, pre-understanding and the fusion of horizons, in order to pave the way to understand what he describes as a circle hermeneutic, a key concept for the demarcation of the proposal developed here. On this, also seeks to make an evolutionary analysis of the proposals of the thinkers that preceded the gadameriano concept. Outlined the substance of philosophical hermeneutics, we proceed to the analysis of its operation in legal interpretation, printing a critical reflection on the understanding in the application of law and, as a corollary, contributing to overcome the positivist paradigm and its aporias and as for the discussion about the legitimacy of judicial decisions. Thus seeks to clarify the contribution of Gadamer to legal thought, from his philosophical hermeneutics to explain, justify and legitimize the path taken by the judge pronouncing judgments. / A presente dissertação apresenta um novo paradigma para a hermenêutica jurídica, divorciado do positivismo e, consequentemente, da dogmática jurídica. Para tanto, delineia o arcabouço doutrinário que antecedeu a construção do marco teórico aqui utilizado, a hermenêutica filosófica de Gadamer, cuja tônica consiste na oposição ao método como único meio para se chegar à verdade. Ao ingressar em sua análise propriamente dita, busca trabalhar com os conceitos mais importantes, a exemplo da tradição, da autoridade, da pré-compreensão e da fusão de horizontes, com a finalidade de sedimentar o caminho para a entender aquilo que ele descreve como círculo hermenêutico, conceito-chave para o deslinde da proposta aqui desenvolvida. Quanto a este, também procura fazer uma análise evolutiva das propostas dos pensadores que precederam ao conceito gadameriano. Delineada a substância da hermenêutica filosófica, parte-se para a análise de seu operar na hermenêutica jurídica, imprimindo uma reflexão crítica sobre a compreensão no âmbito da aplicação do direito e, como corolário, contribuindo para a superação do paradigma positivista e suas aporias, bem como para a discussão acerca da legitimidade das decisões judiciais. Assim, busca explicitar a contribuição de Gadamer para o pensamento jurídico, partindo de sua hermenêutica filosófica para explicar, fundamentar e legitimar o caminho trilhado pelo julgador ao prolatar as decisões judiciais.

Web 2.0 tools integration in Online Public AccessCatalogue (OPAC) : users desires and motivation

This research aimed to investigate the desires of the users of the Greek public Library on Gender and Equality (LGE) about a future Online Public Access Catalogue (OPAC) containing Web2.0 functionalities. The concepts of participation, information pluralism and community building in relation with Web 2.0 tools in libraries’ catalogues were introduced under the theoretical approach provided by Social Critical Theory of Jürgen Habermas. Aqualitative research based on semi-structured interviews with users of the LGE wasconducted and the collected data that were analysed with the thematic analysis method,revealed positive users’ impressions regarding the introduction of Web 2.0 tools in theLGE’s OPAC. The research also disclosed users’ desires and suggestions regarding specific Web 2.0 features and their common motivation to participate and contribute to be the opportunity of communicating with like-minded people.

Human rights are the pervasive practical and political concept, discussed in various branches: political and legal philosophy, political science or jurisprudence. In the diploma thesis, this concept is discussed in the framework of political philosophy. An author's basic question: Is the concept of human rights plausible (rationally valid) in the postmetaphysical situation as well, and if so, which rights are possible to specify as "human"? This question is asked in view of contemporary (content, spatial and symbolical) expansion of human rights and solved in light of Jürgen Habermas' conception of human rights. Habermas' conception of human rights represents probably the most significant rational attempt to reformulate this concept in the postmetaphysical situation. His foundation is apparently free from the burden of all anthropological presuppositions, connected with a pristine articulation of the rights of man. As we know, these presuppositions also resound in the legal concept of human dignity. After the problem definition, a historical excursus on the field of rational natural law and basic characterization of the postmetaphysical situation, an analysis and evaluation of presuppositions intrinsic to Habermas' "linguistificated" conception of human rights follow - i.e. universal pragmatics,...

El propòsit principal d'aquesta tesi és analitzar críticament l'antropologia filosòfica de Charles Taylor.A la primera part abordem qüestions preliminars: les fonts, els fonaments teòrics i els elements metodològics del seu pensament.A la segona part elaborem la seva teoria de la identitat. Això implica: (1) donar compte de la relació inextricable entre el jo de la persona i la seva orientació moral, i (2) per mitjà d'arguments transcendentals, articular una ontologia que determini els trets perennes de la naturalesa humana.Una ontologia de la identitat exigeix l'articulació de les continuïtats i discontinuïtats entre els animals humans i no humans. És a dir, una filosofia de la biologia que aporti les intuïcions de l'aristotelisme al post-darwinisme. En línia amb Adaslair MacIntyre, intentem completar les aportacions realitzades per Taylor en el context de la seva filosofia de l'acció.D'altra banda, identifiquem alguns dels trets distintius de l'agent humà (lingüisticitat, propòsit i dialogicitat), i abordem els desafiaments de (1) les versions que radicalitzen les conseqüències de la contingència del subjecte i (2) els reduccionisme que prosperen entre els filòsofs analítics. Per això hem confrontat a les interpretacions de Richard Rorty sobre Nietzsche i Freud, i a la posició quasi-budista de Parfit, l'hermenèutica forta de Charles Taylor i Paul Ricoeur.A la tercera part, estudiem la dimensió històrica de la identitat humana. Això implica assenyalar les peculiaritats del anthropos modern. Per això, a més de contraposar al jo modern la versió premoderna de la nostra comuna humanitat, hem hagut d'enfrontar a la interpretació de Taylor sobre el sentit de les mutacions cosmovisionales, antropològiques i ètiques de la modernitat, les interpretacions que a aquestes mutacions concedeixen autors com Michel Foucault, Alasdair MacIntyre i Jürgen Habermas. / El propósito principal de esta tesis es analizar críticamente la antropología filosófica de Charles Taylor. En la primera parte abordamos cuestiones preliminares: las fuentes, los fundamentos teóricos y los elementos metodológicos de su pensamiento. En la segunda parte elaboramos su teoría de la identidad. Eso implica: (1) dar cuenta de la relación inextricable entre el yo de la persona y su orientación moral; y (2) por medio de argumentos trascendentales, articular una ontología que determine los rasgos perennes de la naturaleza humana. Una ontología de la identidad exige la articulación de las continuidades y discontinuidades entre los animales humanos y no humanos. Eso implica señalar las peculiaridades del anthropos moderno. Para ello, además de contraponer al yo moderno la versión premoderna de nuestra común humanidad, hemos tenido que enfrentar a la interpretación de Taylor sobre el sentido de las mutaciones cosmovisionales, antropológicas y éticas de la modernidad, las interpretaciones que a éstas mutaciones conceden autores como Michel Foucault, Alasdair MacIntyre y Jürgen Habermas. / The main purpose of this thesis is to critically analyze the philosophical anthropology of Charles Taylor.The first part deals with preliminary issues: the sources, the theoretical and methodological elements of his thought.In the second part we elaborate his theory of identity. This implies: (1) to account for the inextricable relationship between the self of the person and his moral orientation, and (2) by means of transcendental arguments, to articulate an ontology that determines the perennial features of human nature.An ontology of identity requires the articulation of the continuities and discontinuities between human and nonhuman animals. That is, a philosophy of biology which provides insights from Aristotelianism to post-Darwinism. In line with Adaslair MacIntyre, we try to complete the contributions made by Taylor in the context of his philosophy of action.On the other hand, we identify some of the distinctive features of human agency (language, purpose and dialogue) and tackle the challenges of (1) versions that radicalized the consequences of the contingency of the subject and (2) the reductionism that thrive among the analytical philosophers. So we confront the interpretations of Richard Rorty about Nietzsche and Freud, and the quasi-Buddhism of Parfit, with the strong hermeneutics of Charles Taylor and Paul Ricoeur.In the third part, we study the historical dimension of human identity. That means pointing out the peculiarities of the modern anthropos. Therefore, in addition to contrast the modern self with the premodern version of our common humanity, we confront Taylor's interpretation of the meaning of the cosmological, anthropological and ethical mutations of modernity, with the interpretations that authors as Michel Foucault, Jürgen Habermas and Alasdair MaIntyre offer about these mutations.
