Psicologia e Ecologia são duas áreas onde se expressa com a qualidade de vida do ser humano. O processo de degradação ambiental com o uso irracional dos recursos não renováveis é uma preocupação crescente da população mundial. A busca de um meio ambiente saudável para todos é perpassado por processos de aprendizagem e construção de identidade dos indivíduos. A psicologia busca alternativas para auxiliar nesta conquista através de muitas áreas, como a psicologia ambiental, psicologia social entre outras. Neste trabalho proponho a análise da ecologia nos processos de defesa ambiental através da Psicologia Moral. É importante para a psicologia moral estender seu campo de análise a áreas fundamentais da necessidade e relações humanas, e nesta relação com a ecologia as pesquisas são incipientes. A tese que se apresenta é de que a ecologia é moral. Líderes ambientais do estado de Rondônia, selecionados através do método de Bom Meihy (1996) para a construção de redes, ao falar de suas atividades na defesa ambiental, descrever o histórico através do qual construíram uma consciência ecológica, apresentar um juízo moral através de dilemas e entrevistas inquérito, corroboram a tese, demonstrando a existência de uma personalidade moral ecológica, baseada na análise subjetiva da justiça e princípios éticos universais. Os líderes apresentam também uma ética ecológica, uma ética verde, baseada na sustentabilidade. São referenciais teóricos da psicologia moral, Kant (1785/1936), Piaget (1932), Kohlberg (1955) e Puig (1998). O trabalho apresenta ainda as áreas da ecopedagogia, ecofilosofia, ecopsicologia e psicologia ambiental e debate a problemática ambiental contemporânea. / Psychology and Ecology are two areas on which it is linked with quality of life. The process of environmental degradation due to the irrational use of non renewable resources is a great concern all over the world. The search for a healthy environment for everyone is followed by the learning process and the formation of individual character. Psychology seeks alternatives such as environmental psychology, social psychology and others in order to give support on that issue. The following paper proposes the analyses of ecology based on the environmental defense process using the Moral Psychology. It’s important to the Moral psychology to broaden its analytical field to fundamental areas linked to human needs and based on this same relation with ecology, as far as it concerns, the researches can be considered incipient. The following thesis support the argument that ecology is moral Environmental liders from Rondonia, selected by the Bom Meihy’s Methody for the formation of nets; when questioned about their activities concerning environmental defense, the historical process on which it was built on ecological concern to present a moral judge based on dilemmas and interviews, corrobate the thesis, showing a moral environment personality existence based on the subjective analyses of justice and ethical principles. The liders also present an ecological ethic, a “green" ethic based on sustainability. It can be mentioned important references from the Moral Psychology, as it follows. Kant (1785, 1936), Piaget, Kolberg (1955) and Puig (1998). This paper also presents studies that join Ecology to Education, Philosophy, Psychology and Environmental Psychology and it discuss the current problems of our environment.

« [M]oi, qui ne sçay rien, m’en suis voulu mesler » : Blaise de Monluc dit se « mêler » d’écrire l’histoire pour se distinguer des historiographes « lettrés », comme le font également, à la même époque, les frères du Bellay. Tous font cependant valoir leurs jugements sur l’action politique dans l’histoire : ils écrivent sur l’histoire plutôt qu’ils n’écrivent l’histoire. Ainsi Montaigne insiste, dans les Essais, sur la nécessité de savoir juger l’histoire et ses acteurs. La distinction générique qui oppose l’histoire aux Mémoires, aux « Commentaires » et aux « essais » s’avère peu opérante pour comprendre ces auteurs. Je propose d’aborder leur rapport à l’histoire sous l’angle de « l’histoire-jugement », une histoire écrite par ses acteurs, qui porte sur l’action politique (les « faits » et les « dits » dans la langue du XVIe siècle) et sur les « conseils », c’est-à-dire les intentions et délibérations des acteurs. La première partie explique l’importance qu’a prise l’histoire-jugement au temps de François Ier, en raison, d’abord, des idéologies et des pratiques de la monarchie contemporaine, puis par la « renaissance » de traditions philosophiques, rhétoriques et historiographiques qui associent le conseil au discernement (ou « discrétion »), aux discours (« concions » ou conciones) et à la franchise (ou parrêsia). Le règne de François Ier voit se nouer ces pratiques et ces traditions : les humanistes, la noblesse d’épée et l’État royal appellent de leurs vœux une histoire-jugement destinée à la formation des élites politiques. La deuxième partie montre qu’un auteur, Guillaume du Bellay de Langey, et une œuvre, ses Ogdoades, ont incarné cette aspiration, réunissant les lettres et les armes. Après avoir étudié la naissance de cette œuvre restée inachevée, j’analyse le Prologue des Ogdoades (ici édité), manifeste et méthode qui définit les rapports de la rhétorique, du jugement et de l’expérience politique dans l’historiographie ; puis j’étudie la mise en œuvre de cette méthode dans les fragments des Ogdoades. La troisième partie porte sur l’œuvre des deux plus importants héritiers de Langey : les Mémoires de son frère Martin du Bellay (qui comprennent une partie des Ogdoades) et les Commentaires de Monluc. Le discours sur l’historiographie, dans la seconde moitié du XVIe siècle, insiste sur la parrêsia de l’historien ; un tel discours n’est pas anti-rhétorique mais rejette une écriture de « clerc d’armes » parce qu’elle révèle l’inexpérience politique de l’historien. L’ars bene dicendi ne laisse pas de fasciner Martin du Bellay et Monluc, dont l’écriture se veut paradoxalement éloquente, parce que dépouillée des fastes de l’épidictique ; la parrêsia des conseils permet de dépasser l’opposition du bien dire et du bien faire à laquelle on résume souvent la poétique des Mémoires d’épée. Monluc et Martin du Bellay cherchent ainsi à comprendre la portée et les limites de leur capacité d’agir. La quatrième partie examine la place de l’histoire-jugement et l’héritage de Langey dans les Essais : on sait depuis longtemps les affinités de Montaigne avec Amyot et Bodin, mais on ignorait qu’il en eût avec les Du Bellay. La notion d’histoire-jugement permet de comprendre les jugements, synthétiques et pourtant circonstanciés, que porte Montaigne sur les acteurs de l’histoire. Cherchant dans l’histoire les voies d’une prudence lucide, l’essayiste s’interroge sur la possibilité d’agir et de parler librement, ce qui autorise à penser son rapport à la politique et à la rhétorique en termes de conseil et de « discrétion ». La conclusion esquisse un moment Guillaume du Bellay, où l’histoire fut comprise non comme une étude du passé mais comme le prolongement réflexif des délibérations des acteurs de l’histoire, comme le moyen de « dire sur ce qui peut advenir ». / “I, who know nothing, have wanted to meddle in it”: Blaise de Monluc says he “meddles” in historiography in order to distinguish himself from “scholar” historians, as did the Du Bellay brothers who wrote at the same time. But they all express their views about political action through history: they write on history instead of writing history. Therefore Montaigne, in his Essays, emphasizes that one needs to be able to judge between history and the actors of history. The distinction between literary genres that opposes history to memoirs, “commentaries” and “essays”, fails to explain these authors’ relationship to history. I propose to consider this relationship from the perspective of “judging-history”, – a history written by its actors, focusing on political action (“faits” and “dits” in XVIth-century French) and the conseils (“counsels”, i.e. the actors’ designs and deliberations). The first section explains the importance of judging-history during the reign of Francis I, due to the prevalent ideologies and practices of French monarchy at the time, but also due to the contemporaneous revival of philosophical, rhetorical and historiographical traditions which link counsels with discernment (discrétion), speeches (concions) and sincerity (parrhesia). Under Francis I’s reign these practices and traditions were brought together. Indeed, humanists, the nobility of sword and the royal State called for a judging-history intended to train political elites. The second section demonstrates that an author, Guillaume du Bellay de Langey, and his work, the Ogdoades, embodied this hope, reconciling the pen and the sword. Having studied the birth of this unfinished work, I comment on the Ogdoades’s Prologue (edited in this thesis), a manifesto and method which defines the relationships between rhetoric, judgement and political experience within historiography. I then study this method’s implementation in the Ogdoades’s extant passages. The third section focuses on the works of two Langey’s most important heirs: his brother Martin du Bellay’s Memoirs and Monluc’s Commentaries. The artes historicae, in the second half of the XVIth century, emphasize the importance of parrhesia in historical writing: such a stance is not anti-rhetorical, but rather rejects the notion of authors writing as clercs d’armes (“clerks of arms”, i.e., scholars writing on military matters) because in their writings they reveal their lack of political experience. The ars bene dicendi continues to fascinate Martin du Bellay and Monluc, whose writing attempts to be paradoxically eloquent, because it has been stripped of epidictic pageantry; the counsels’ parrhesia make it possible to overcome the dichotomy between bien dire and bien faire – a dichotomy which is often supposed to characterize military memoirs’ poetics. Monluc et Martin du Bellay seek to understand the scope and limits of their own capacities for action. The fourth section examines the role of judging-history and Langey’s legacy in the Essays. For a long time we have known the affinities between Amyot, Bodin and Montaigne, but what we have ignored is Montaigne’s links with the Du Bellays. Such a notion as judging-history allows us to understand the synthetical and yet comprehensive judgments that Montaigne makes on the actors of history. Seeking a way to act in a clear-headed and prudent manner, the essayist examines the possibility to speak and act freely. Therefore, his relationship with politics and rhetoric should be rethought in terms of conseil and discrétion. My conclusion draws a Guillaume du Bellay moment when history was not considered as a study of the past but as the reflective extension of the actors of history’s deliberations and as a way to “dire sur ce qui peut advenir” (talk about what could happen next).

L’étude porte sur la notion grecque de κρίσις, alors que les études antiques ont souvent recours à une notion moderne de la crise. L’épopée, la Collection hippocratique et les dialogues de Platon forment le corpus. Les analyses de κρίσις issues de recherches déjà menées sur ces textes étaient très disparates. Il a été possible de résorber une partie de ces différences et de définir une notion générale de la κρίσις, par des enquêtes lexicales exhaustives. La κρίσις apparaît alors comme une action qui achève un conflit et permet, entre deux états ou conditions considérés comme opposés, une disjonction, subite accélération du cours des événements qui résout les affres de l’attente. La séparation et la décision assurent le passage du péril à un élan vital nouveau : la κρίσις permet la γένεσις. Ces traits de la notion, apparus dès l’épopée, où le mot désigne différentes décisions à la puissance génératrice et salvatrice soudaine, se retrouvent dans la « crise » médicale, guérison souvent subite, bien que prévisible en partie par l’art du pronostic, qui assure la reconstitution de l’équilibre de santé. La κρίσις platonicienne, jugement ou discernement, permet différents passages (de l’obscur au lumineux, de l’impur au pur, du malsain au sain), mais aussi, plus généralement, la régénération de l’âme. Elle restaure la fécondité de la pensée, conduit à une réincarnation sous une forme meilleure, et ordonne la recomposition de la vie bonne à partir d’éléments triés (Philèbe). En tant qu’instant qui décide d’une renaissance, point culminant de l’effort philosophique, la κρίσις voit aussi sa puissance libératrice dramatisée dans le dialogue. / My research is devoted to the Greek notion of κρίσις whereas classical studies usually favour the modern notion of crisis. It focuses on the Epic, the Hippocratic Corpus and Plato’s dialogues. The existing research on κρίσις has led to extremely varied results. My work offerts to reunite these differences in order to define a more general notion of κρίσις, thanks to a comprehensive lexical analysis. The κρίσις seems to be an act which puts an end to a conflict, thus enabling a breach between two opposite states. Time suddenly speeds, and the long torment resolves. Thanks to selection and decision making, danger gives way to a new life force: κρίσις enables γένεσις. These characteristics can already be found in the Epic where κρίσις refers to various decisions suddenly bringing generation and salvation. The medical notion of crisis is also a sudden recovery even though it can partially be predicted by prognosis, which brings health and balance back. The platonic κρίσις, which is akin to judging or discerning something, allows various changes (from darkness to light, from impurity to purity, from sickness to health) and ultimately enables the soul to regenerate. Fertility of the thought is restored; the soul can be reincarnated in a better shape or life reassembled with carefully selected elements (Philebus). As a turning point for a possible rebirth, as the climax of philosophical endeavours, the liberating power of the κρίσις has also often been dramatized in dialogues.

An ecology of judgement : sense-making in child welfare and protection social work

This thesis is submitted for the award of PhD by publication. It comprises four interconnected, published research papers linked by a contextualising narrative. The publications are all peer-reviewed research articles published between 2012 and 2017 in relevant UK journals. I am the sole author of three of the papers and first author of one paper. My thesis considers how social workers make sense of complex and uncertain information in child welfare and protection social work. My first paper considers the how an understanding of human judgement and sense-making can influence social worker's capacity of child-focused thinking. My synthesis of the literature indicated that social workers' styles of judgement are strongly bounded or influenced by external factors such as complexity of information and time available to make decisions. It is this "bounded" model of rationality which I have employed to provide the theoretical and conceptual framework for this thesis. I have included two papers exploring data which I collected in a non-participatory ethnographic study of social workers' sense-making in a local authority children and families team. These papers represent a valuable contribution to current understandings of social work sense-making. This naturalistic study identified a number of key themes and processes in sense-making which are directly relevant to developing and maintaining best practice. The final paper was developed over the period of my PhD studies. The paper builds on existing research and develops theories of bounded rationality into a conceptual model which I have referred to as an "Ecology of Judgement" for child welfare and protection social work. By modelling the complex interplay between the mind of the social worker and the information environment in which they are operating the model has utility in practice development and research.

Introducing neo-surrealism : the social science of performance art

This study is concerned with the obscurity surrounding the boundaries of a socio-political context and a metaphysical context, especially as it correlates to Contemporary Performance Art. This dichotomy seemingly results in symbolic conflation and therefore necessitates the inclusion of social science as part of Performance Studies discourse. The intersection of these disciplines aligns with respect to the significance of context: the role of communication when considering the phenomenon of interpreting the perspective of other individuals. In this study, the various layers appropriated to the contextualisation of Performance art are explored: how it pertains to the theatrical framework, audience, art, social order, and the sublime. To this end, the influence of the socio-political construct of reality on the theatrical framework of a performance is examined. The premise is that a socio-political context both precedes and follows a performance and likely affects 5 how a performance is experienced. This investigation relies upon the methodological approach of Grounded Theory that allows the freedom of exploring this phenomenon in conjunction to the development of a communicative model. To delimit the scope of this study, I primarily focus on the symbolic, insofar as it affects the context of a performance. The analysis of this study supports the development of a theorisation that introduces an approach to the theatrical framework, defined as Neo-Surrealism. Drawing upon Immanuel Kant's philosophical work on judgement, a precept is introduced for a theatrical framework: Neo- Surrealism is a platform that constitutes the demarcation of sacred space, where the signification of the aesthetic has symbolic authority over the signification of the socio-political construct. In the present study, the term transgression as situated in a metaphysical context of sacred space, changes its symbolic signification from a complicit act against the socio-political construct to a complicit act against the limitations of perception, positioning this semiotic sign to constitute an aesthetic infinitude. This theorisation serves to support a philosophical dialectic that incorporates performative methods from Ritual Studies. This aspect of the dissertation acts as a counterpart to the documented artwork aimed at reinforcing the specific purposes as outlined through the research. The practical portion of this study consists of three performances that rely upon the platform of Neo-Surrealism. Each performance strategically responds to the influence of the socio-political construct in separate ways. Neo-Surrealism: What is Performance art? (2015) contains a fictitious narrative that is integrated in an academic context. I portray several different archetypes; this theoretically makes my identity impalpable to an audience comprised mostly of students that are unfamiliar with my work. Neo-Surrealism: The Audition (2016) is centred on the site specificity of the performance, challenging the application of the communicative model in an unfamiliar socio-political context, Anchorage, Alaska. Neo-Surrealism: The Rehearsal (2017) is aimed at asserting the relevance of the platform of Neo-Surrealism by expanding the symbolic boundaries of Performance Art.

No direito constitucional brasileiro, desde a primeira Constituição (1824), ainda sob o regime imperial, o Executivo é obrigado a prestar contas ao Legislativo, sobre as despesas públicas. A primeira Constituição republicana (1891) criou o Tribunal de Contas, como instituição auxiliar do Congresso, com a tarefa de elaborar um parecer prévio sobre as contas prestadas pelo Presidente da República ao Congresso, que faria o julgamento final. A Constituição de 1988 manteve para o Tribunal de Contas e para o Congresso as mesmas atribuições. O principal objetivo deste trabalho é examinar, no contexto do sistema de controle parlamentar de Governo instituído pela Constituição atual, os fundamentos pelos quais o Congresso pode aprovar ou rejeitar as contas do Executivo. / In the Brazilian constitutional law, since the first Constitution (1824), yet under the imperial regime, the Executive Branch is obliged to accounts for the Legislative Branch, about the public expenditures. The first Republican Constitution (1891) has created the Court of Accounts, as an auxiliary institution to the Congress, whit task to elaboration a previous analysis of the accounts rendered by the Brazilians Republics President to the Congress, who makes the final judgment. The Constitution of 1988 keeping to the Court of Accounts and to the Congress the same attributions. The main objective of this work is examine, in the context of Govern parliamentary control system established by actual Constitution, the fundaments by which the Congress can approve or reject the Executives counts.

Judging the Immigrant : Accents and Attitudes / Att döma invandraren : Attityder till bruten svenska

Spoken language as a means of communication contains huge amounts of information apart from the linguistic message that is conveyed. It is often the first channel of interaction between people and based on the speaker’s manner of talk, we create a mental image of the speaker as a person, of the speaker’s background, origin and personal qualities. Through five case studies, this dissertation investigates how immigrants to Sweden are judged based on their foreign accents (Cases 1—3) and how the use of an interpreter in court can affect the legal process and the judging of the immigrant (Cases 4—5). Case 1 investigated Swedish students’ attitudes towards immigration and immigrants through a survey-based study and revealed that Swedish students hold predominantly positive attitudes towards immigrations and immigrants. Case 2, using accent imitation, asked if Swedish speakers have a cognitive prototype for British English accented Swedish and found that this was the case. This demonstrated that Swedes have models of accented Swedish accents. Case 3 asked Swedish students to rate their impressions of speakers of nine foreign accented Swedish voices on 18 six-point semantic differential scales. They also rated their impressions of each voice for five social factors. The results suggest that the listeners evaluated the voices based on perceived social desirability, or perceived cultural distance between the listener and the voice’s country of origin. Juxtaposing these findings with those of Case 1 suggests that even among a group who are positive to immigrants and immigration some groups of immigrants are more welcome than others. Case 4 examined discourse disfluencies in a bilingual court hearing and a Swedish-Polish bilingual court hearing in detail. The case showed that most of the dialogue-related difficulties have other sources than the interpreter, even if the interpreter at first glance often appeared to be part of the problem rather than part of the solution. Case 5 examined the interpreter’s role in courtroom dialogue situations through interviews with a court interpreter and a lay judge. The study found that the picture of the interpreter’s role differs between the various actors in the court setting. This, in combination with a lack of knowledge about cultural differences in dialogue strategies, creates complications, can have an impact on the perception of the witness and, ultimately, affect the legal rights of the accused. Furthermore, as the interpreter most frequently speaks foreign accented Swedish, the perception and evaluation of their foreign accented Swedish can further place some immigrant groups at a double legal disadvantage when being judged.

Granskning av hållbarhetsredovisning : hur påverkas revisorns bedömningar av de standarder och riktlinjer som används i granskningsprocessen?

Diskussionerna om ”granskning” av miljö- och hållbarhetsredovisningar har i Sverige funnits sedan mitten av 1990-talet. Specialistrevisorn Lars-Olle Larsson menar att efterfrågan ökar angående bestyrkta hållbarhetsredovisningar. Detta på grund av de ökade kraven från organisationer som Global Reporting Initiative (GRI), Förenta Nationerna (FN) och Amnesty International. Med andra ord har uppmärksamheten riktas mot såväl företagens samhällsansvar som den enskilda revisorn och revisorsprofessionen. Det finns en pågående forskningsdebatt som grundar sig på struktur kontra bedömning i revisionsprocessen. Vi har valt att använda denna debatt som utgångspunkt i vår uppsats. Eftersom standarder och riktlinjer är en del av en strukturerad arbetsprocess har vi valt att se närmare på vilken påverkan dessa har på revisorns subjektiva bedömningar. Vårt huvudsyfte är att skapa förståelse för hur revisorer uppfattar att deras bedömningar på olika sätt kan påverkas av de olika regler, riktlinjer och standarder som de följer i deras arbete med granskning av hållbarhetsredovisningar. Vi har valt att tillämpa en kvalitativ forskningsstrategi för att få en djupare förståelse av forskningsämnet. Fokus i arbetet kommer att ligga på revisorns subjektiva bedömningar, då subjektivitet är svårt att kvantifiera lämpar sig en kvalitativ ansats bättre för vårt ändamål. Som datainsamlingsmetod har vi valt att göra intervjuer med respondenter som specialiserat sig inom området hållbarhetsredovisning.  Eftersom våra respondenter har sitt säte i Stockholm fanns ingen möjlighet att utföra personliga "face-to-face" intervjuer, därför har vi utfört telefonintervjuer. Det empiriska materialet tyder på att även om våra respondenter söker en hög grad av struktur i deras arbete med hållbarhetsredovisning så är det för att uppnå en känsla av komfort och inte för att utesluta de egna subjektiva bedömningarna. Struktur underlättar helt klart granskningsarbetet och förbättrar kvaliteten på hållbarhetsredovisningen men det går inte att bortse från att de subjektiva bedömningarna ligger till grund för revisorers arbete. / In Sweden, discussions concerning "audit" of environmental and sustainability reports have existed since the mid-1990s. Specialist Auditor Lars-Olle Larsson believes that demand for certified sustainability reports will increase as the demands of organizations such as Global Reporting Initiative (GRI), United Nations (UN), and Amnesty International intensify. In other words, attention has been directed at both the social responsibility of the corporations as well as the individual auditor and the auditor profession. There is a current research debate based on structure and judgement. This debate will be the starting point of our paper. As standards and guidelines are part of a structured work process, we have chosen to look closely at their influence on the auditor's subjective judgement. Our main objective is to create an understanding of how auditors perceive that their judgements can be affected in a variety of ways by regulations, guidelines, and standards used in auditing sustainability reports. To gain a deeper understanding of the research topic, we have chosen to apply a qualitative research approach. Our focus will be the auditor's subjective judgements, and as subjectivity is difficult to quantify, a qualitative approach better suits our purpose. Our method of collecting data will be by conducting phone interviews with respondents based in Stockholm who specialize in sustainability. The empirical material suggests that even if our respondents aim for a high degree of structure in their work with sustainability reports, it is to achieve a sense of comfort as opposed to exclude their own subjective judgements. In this paper the authors are focusing on people that work in psychiatric acute care. How do they identify the individual that is in most need of acute care? How do they judge in this kind of cases?    The foundation in this study is in the qualitative method. The material to this study has been collected by doing qualitative interviews with six people in different professions and positions in psychiatric acute care.    The material that we collected from these six qualitative interviews has been analysed with help from Sherif’s and Hovland’s (1961) Social judgement theory. The theory describes people’s judgement based on certain criterions and how it affects them.     It has been noticed that the individuals who asses first acute care are usually the ones that has a suicidal behavior. The resources are decreasing while the need for psychiatric acute care is increasing. The personell have to make decisions about which individual that are in most need of acute care. Their judgments are very important for the indiviuals in need of immediate care. This judgement can be depending on which individual who is doing the judgemet. This paper has given us comprehension for the immortance of good individual properties for doing judgements, and that they are made in several positions.

Båtnadsbedömningar : En studie av bildade gemensamhetsanläggningar

Det finns många situationer där anläggningar inte kan inrymmas på den egna fastigheten och där flera fastigheter har behov av att använda anläggningen. En gemensamhetsanläggningkan vara ett sätt att lösa situationen på. Det förekommer ofta att flera ändamål ingår i en och samma gemensamhetsanläggning, inte minst inom detaljplanerade områden.Det ska föreligga båtnad för att kunna inrätta en gemensamhetsanläggning, vilket betyder att fördelarna av ekonomisk eller "annan art" överväger de kostnader och olägenheter som åtgärden innebär. Båtnad kan anses vara uppenbar för vissa anläggningar, t ex tillfartsväg för fastigheter från allmän väg. Det kan anses vara mindre klart att båtnad uppnås för t ex lekplatser, vilket är anledningen till varför just detta ändamål är en förutsättning för studiens genomförande. Syftet med studien är att undersöka hur båtnaden prövas vid bildande av gemensamhetsanläggning. De centrala frågeställningarna är: Kan det i förrättningsprotokollet utläsas attförrättningslantmätaren prövat båtnaden? Om förrättningslantmätaren prövat båtnaden med en vidare motivering, nämns fördelar av "annan art" eller sociala fördelar i denna? Innehåller förrättningsakten någon båtnadskalkyl? Kan det utläsas att förrättningen berörs av en gällande detaljplan? Studien baseras på kvantitativ undersökning av förrättningsakter. För att få en fördjupad förståelse av det insamlade materialet används hermeneutisk (texttolkande) metod och intervjuer. Studien har kommit fram till att förrättningslantmätaren inte prövar båtnaden med en vidare motivering. "Annan art" nämns inte alls i de studerade akterna och endast en av akterna har en partiell båtnadskalkyl redovisad. Det är tydligt att båtnadsbedömningen genomförs schablonmässigt, oavsett om uppenbar båtnad föreligger eller inte. Det tillsynes enkla syftet att undersöka hur förrättningslantmätare formulerar båtnad i anläggningsbeslut kan besvaras på olika vis. Hinder föreligger ej enligt 6 § anläggningslagen, är det korta svaret. Det långa svaret handlar om att det korta svaret innefattar många påverkande faktorer. En av dem är att förrättningslantmätaren ska arbeta snabbt, kostnadseffektivt och ge en god service åt medborgarna, i egenskap av myndighetsperson. / There are many situations where facilities cannot be accommodated within the confines of the property itself and where several properties have the need to use the facility. A joint facility can be a solution to the situation. There are often several facility purposes within the same joint facility, in zoning planed areas not the least. There has to be advantage when forming a joint facility, which means that the economic advantage or advantage of"alternate nature" must weigh more than the costs and inconveniences. Advantage can be considered as apparent for some facilities, for example road-access for properties from a public road. It can be considered to be less clear that advantage can be attained for children's playgrounds for example, which is the reason why this particular purpose is a prerequisite for the implementation of this study. The aim of this study is to examine the trial of the advantage when forming a joint facility. The core questions are: Can the cadastral surveyors trial of the advantage be deduced in the document records? If the cadastral surveyors trial of the advantage is further justified, is advantage of "alternate nature" or social advantages then mentioned? Do the documentcontain a calculation regarding the advantage? Can it be deduced that the cadastral procedure is affected by an operative zoning plan. The study is based upon a quantitative examination of cadastral procedure documents. Hermeneutical method and interviews have been used to acquire a deeper understanding ofthe collected materials. The study concludes that the cadastral surveyors trial of the advantage is not further justified. "Alternate nature" is not mentioned at all in the studied documents and only one document has declared a partial calculation. It is clear that the judgement of the advantage has been implemented with some kind of "copy-paste" template, regardless of whether advantage is apparent or not. The seemingly simple aim to examine how cadastral surveyors, in their decision regarding the facility,formulate their judgement of the advantage can be answered in different ways. The short answer is: No obstacles exist, according to the 6 § of the Swedish equivalence to the jointfacilities act (1973:1149). The story of the long answer is that the short answer includes many influencing factors. One of them is that the cadastral surveyor should work quickly,cost effectively and provide good service to citizens, as a government official.
