The applicability of procedural fairness to actions by members of the South African National Defence Force

The dissertation examines the applicability of procedural fairness to actions by members of the South African National Defence Forces (SANDF). The research focuses on and uses the South African Defence Force Union v The Minister of South African National Defence Force (SANDU 2010 judgment) to illustrate how procedural fairness should find application in the SANDF, given the sui generis nature of the defence forces. This judgment presented an opportunity to investigate whether the legislative framework that is available in the SANDF is adequate to protect the right to procedural fairness of the members of the SANDF encapsulated in section 33 of the Constitution, 1996. The dissertation examines the relevant sections of the Defence Act, Military Discipline Supplementary Measures Act, Labour Relations Act (LRA), and the Promotion of Administrative Justice Act (PAJA) read with sections 23 and 33 of the Constitution to determine whether there is a gap that exists in so far as the protection of the right to procedural fairness of members of the defence forces is concerned. It also examines the Military Discipline Code and the rules and regulations of the Defence Forces. The analysis of the SANDU 2010 judgment demonstrates that PAJA could find application in dismissal or employment related disputes within the SANDF. The scenario that is evidenced from the analysis of the defence force legislative framework is that the legislative framework that is available within the SANDF is inadequate to protect and deal with disputes which arise from allegations of infringement of the right to procedural fairness. This scenario is compounded by the fact that the LRA which is the empowering legislation that was promulgated to give effect to the right to section 23 of the Constitution and to deal with dismissal and employment related disputes, does not apply to members of the SANDF. / Public, Constitutional, and International Law / LL. The legislative supremacy of Parliament has dominated the constitutional law of South Africa for a very long time. In the pre-constitutional era, the judiciary had no power to question the deeds of Parliament. Despite the need for the judiciary to be independent from the two other governmental branches to execute its function effectively, it was surely dependent on them. However, the creation of the Office of the Chief Justice (OCJ) as a separate governmental department by the Constitutional Seventeenth Amendment Act, read together with Superior Court Act, mandated by the requirements of a supreme Constitution (and not Parliament), changed things so that the judiciary is no longer dependent on government for its day-to-day administration. Discourses of silence : judicial responses to industrial action as an archaeolgy of juridification

A study of silences: as a metaphysics of the law, juridification silences the text of the law in order to enable an allegorical reading of the law. This silencing of the legal text can only be avoided through a non-metaphysical archaeological reading. Similarly, the programme of comparative labour law is silent at its most pivotal points, leaving some concerns of the programme indeterminate and indeterminable. As context, the dominant discourses of the labour law systems of the Federal Republic of Germany (Tarifautonomie), Great Britain (collective laizzesfaire) and South Africa (fairness) are identified and the agents of the jurisprudence (the courts) are briefly outlined. The silence operating within the phenomenology of the labour judiciary and the concept of a 'court' is also examined. The study then proceeds to read, in an archaeological manner, the industrial action jurisprudence in Germany, Great Britain and South Africa, such readings again yielding silences within the discourse of the law. The silences occurring throughout (and the resulting normative breaches in the rationality of the legal discourse) are the prerequisites for juridification, a process in terms of which the metajuridical standard is imported into the legal normative system and thereby rendered part of the archival discourse of the law. / LL.D.

This study aims to defend value formalism, like the formalism useful to the procedure as a means of achieving a fair process. For both historical analysis is made of the jurisdiction under the focus of the power conferred on the Judge from the Roman State to the present day. Takes the postwar constitutionalism as a starting point to treat the state as insurer of the fundamental rights of the citizen and as a provider of public policies. The process no longer seen as a mere tool in the service of the right stuff and will be recognized as a fundamental constitutional guarantee, as applied constitutional law. To do so, we start a process permeated by formalism-excessive in search of a value formalism emptying into the necessary balance or balance between the principles of effectiveness and legal certainty. Shows the need and possibility to change the paradigm of legal positivism to the model of principles and rules, as well as the possibility of dialogue in the countries of civil law institutes the common law. Search on the judicial activism the means to achieve the necessary flexibility procedural, either by technical management of litigation, the principle of elasticity, the use of axiological and ontological gaps as well as the principle of proportionality. All analysis aims to find solutions to reach decisions fairer and according with the democratic rule of law. / O presente estudo tem por objetivo defender o formalismo-valorativo, ou seja, o formalismo útil ao procedimento, como meio de se alcançar um processo justo. Para tanto é feita a análise histórica da jurisdição sob o enfoque do poder conferido ao Juiz desde o Estado Romano até os dias atuais. Toma-se o constitucionalismo do pósguerra como ponto de partida para tratar do Estado como assegurador dos direitos fundamentais do cidadão e como provedor das políticas públicas. O processo deixa de ser visto como mero instrumento a serviço do direito material e passa a ser reconhecido como uma garantia constitucional fundamental, como direito constitucional aplicado. Para tanto, parte-se de um processo permeado por um formalismo-excessivo em busca de um formalismo-valorativo a desaguar no necessário equilíbrio ou ponderação entre os princípios da efetividade e segurança jurídica. Mostra-se a necessidade e possibilidade de mudança do paradigma do positivismo jurídico para o modelo de princípios e regras, como também a possibilidade de diálogo nos países da civil law de institutos da common law. This study aims to analyses the discourse of the legal-social operators in five due process law of the Serra and Vila Velha youth and Childhood Judgeship of the. The social issue and the historical building of the rights of adolescents in conflict with the law had been configured as the theoretic referential. We analyzed the discourses of the judge, public prosecutor, lawyer or counsel for indigents, social work of UNIP, technician of the Court and the professionals of program LAC. After successive readings of the material the data had been analyzed using the referential of the analysis of discourse. The data were organized and presented in the follow way: the history of each adolescent and his/her passage in the legal process; the discourses of the instauration and proceeding of the legal process; discourses for application of the social-educative actions; discourses to execute the social-educative actions and finally the discourses of the final proceeding of the legal process analyzing each one of these parts. As a result was evidenced that in the initial phase of the legal process the expressions of the social matter had been occulted taking advantage the legal issue. The situation of breaking rights of the adolescents and the social circumstances of their evolvement in the practice of infraction was not considered. And the protection to the adolescents through the social-educative action was not sued at law. In the phase of application of the social-educative action we verify a low influence of the discourses of the others legal-social operators and a high influence of the discourses of the magistrate and public prosecutor. The families of the adolescents almost were not mentioned in the audience and in the proceeding of the legal tram. We verify in the phase of execution of the social-educative that the educative process was not reach. It happened because of the lack of systematization in the attendance, the lack of attention to the social necessities of the adolescents and their families and the consequent absence of insertion of them in programs of social inclusion, implying in the strong presence of the sanction and punitive character. The speech of the social reinsertion of the adolescent through the school and the work was evidenced. The data had proven the lack of mediation between rights and public policy and demonstrated that the adolescent in conflict with the law is dealt in a way that stressing the figure of the infractor and overcast the figure of the adolescent citizen in peculiar condition of development. In the final phase of the legal process we verify a legal system whose performance in prominence was of the public prosecutor and the magistrate what indicated that they conducting the process, demonstrating the prevalence of the legal issue. It was concluded that the content of the social matter was enunciated in the legal-social discourses in a non polity way showing that the guilt of the infraction is only of the adolescents and their families. The legal social-educative action is not integrate and do not promote an efficient educative process. Finally we conclude that o ECRIAD was set in motion about periods and rites and was completely ignored about the social rights and the educative aspects of the social-educative actions. / A presente dissertação trata da interface entre a questão social e a questão jurídica no contexto do adolescente que respondeu a processo judicial. O objetivo geral da pesquisa foi analisar os discursos dos operadores jurídico-sociais presentes em cinco processos judiciais das Varas da Infância e Juventude de Serra e Vila Velha. A questão social e a construção histórica dos direitos do adolescente em conflito com a lei configuraram-se como referenciais teóricos. Selecionou-se os discursos do Juiz, Promotor de Justiça, Advogado ou Defensor Público, Assistente Social da UNIP, dos Técnicos do Juizado e dos profissionais do programa LAC. Após leituras sucessivas do material os dados foram analisados utilizando-se o referencial da análise do discurso. Os dados foram organizados e apresentados da seguinte forma: histórico de cada adolescente e seu percurso no processo judicial; discursos da instauração e trâmites iniciais do processo judicial; discursos da aplicação da medida sócioeducativa; discursos da execução da medida sócio-educativa e discursos dos trâmites finais do processo judicial sucedendo-se com a análise de cada uma dessas partes. Como resultado constatou-se que na fase inicial do processo judicial as expressões da questão social foram ocultadas, prevalecendo a questão jurídica. Não se considerou a situação de violação de direitos dos adolescentes e nem as circunstâncias sociais de envolvimento destes na prática de infração e nem foram acionadas a proteção aos adolescentes, através de medidas protetivas. Na fase de aplicação da medida sócio-educativa observou-se pouca influência dos discursos dos outros operadores jurídico-sociais, sobressaindo-se os discursos do Magistrado e do Promotor de Justiça. As famílias dos adolescentes foram pouco acionadas nas Audiências e no decorrer da trama judicial. Verificou-se na fase da execução da medida a não realização do processo sócio-educativo, dada a falta de sistematização no atendimento, a falta de atenção às necessidades sociais dos adolescentes e de suas famílias e a conseqüente ausência de inserção destes em programas de inclusão social, implicando na forte presença do caráter sancionatário e punitivo. Constatou-se o discurso da reinserção social do adolescente através da escola e do trabalho. Os dados comprovaram a ausência de mediação do direito com as políticas públicas demonstrando que o adolescente em conflito com a lei é tratado de forma a se acentuar a figura do infrator, ficando obscurecida a figura do adolescente cidadão em condição peculiar de desenvolvimento. Na fase de finalização do processo judicial verificou-se uma ritualização jurídica cuja atuação em destaque foi do Promotor de Justiça e do Magistrado o que indicou que são eles os condutores do processo, demonstrando a prevalência da questão jurídica. Concluiu-se que o conteúdo da questão social foi enunciado nos discursos jurídicosociais de forma despolitizada, quando da individualização e culpabilização do adolescente, sendo este e sua família responsabilizados sozinhos pela situação de infração, bem como não se efetivaram ações jurídico-sociais integradas de forma a promover um processo sócio-educativo eficaz. Concluiu-se que o ECRIAD foi acionado no que diz respeito aos prazos e ritos processuais e foi completamente ignorado quanto aos direitos sociais e aos aspectos educativos das medidas sócioeducativas.

It argues that since the Constitution of the Republic of South Africa Act no 108 of 1996 has given everyone the right to use the language of his or her choice, all official languages must be used equitably in conflict resolutions in divorce discourse in both traditional and government courts. Most of the Vhavenḓa, especially the elderly, cannot speak more than one official language and this is relevant in conflict resolution. This thesis contends that conflict resolution in divorce discourse is mainly dominated by English and Afrikaans while Tshivenḓa as well as sign language is not used. Instead of enjoying the freedom of utilizing Tshivenḓa as a spoken official language as used by the court interpreter. Therefore, this thesis argues that time has come that government courts accord equal status to all official languages and that Tshivenḓa language should be utilized as English and Afrikaans in conflict resolution in divorce discourse. / African languages / D. Au XVIe siècle, nous assistons à deux types de récits criminels : dans la presse, les faits divers, produits sous la forme de « canards », et dans la littérature, les histoires tragiques, forme narrative brève essentiellement véridique et à tonalité pathétique. Lorsque Pierre Boaistuau, appelé aussi Launay, publie Les Histoires tragiques, il sélectionne six récits parmi les Novelle de Matteo Bandello. Le travail de Boaistuau ne se limite pas à la traduction de ces textes mais également à la fondation d’un genre qu’est l’histoire tragique. François de Belleforest, son ami, en poursuit la traduction et en varie les sources ; il publie entre 1559 et 1582 sept volumes d’histoires tragiques. Notre étude porte sur la justice, un thème clé pour comprendre les textes de ces deux auteurs. En effet, leurs récits révèlent un intérêt particulier pour les différentes formes de justice (humaine, naturelle et divine), pour le procès judiciaire et ses protagonistes. Nous analysons tous ces points ainsi que le thème de la transgression à travers différents crimes, principalement les crimes de paillardise (« macquerellage », rapt, viol et adultère). Notre réflexion porte également sur le châtiment et ses fonctions ainsi que sur le comportement du condamné au moment de son exécution. Enfin, nous nous intéressons aux stratégies discursives déployées par nos auteurs notamment à la rhétorique judiciaire et à la rhétorique délibérative. Les enjeux soulevés à travers l’étude du discours rhétorique permettent d’explorer les liens entre le discours judiciaire et le discours politique et donc entre justice et politique. Somme toute, la dernière partie de notre travail permet de cerner les rapports entre rhétorique, justice et politique. / In the sixteenth century, two types of criminal narratives predominate: short news items in the press, printed separately as canards, and brief narrative literary forms that constitute the tragic story genre, combining truth with a tone of pathos. When Pierre Boaistuau, also called Launay, publishes Les Histoires tragiques, he selects six stories from Matteo Bandello’s Novelle. Boaistuau's work is not limited to the translation of these texts but also establishes the tragic story genre. His friend François de Belleforest continues the translation and varies the sources; between 1559 and 1582 he published seven volumes of tragic stories. My thesis focuses on justice, a key theme for understanding the texts of these two authors. Indeed, their stories reveal a particular interest in the different forms of justice (human, natural and divine), in the judicial process and in its protagonists. I analyze all these points as well as the theme of transgression through an examination of various crimes, mainly crimes of debauchery ("macquerellage" –sex trafficking–, abduction, rape and adultery). I also consider the different functions of punishment as well as the behavior of the convicted person at the time of execution. Finally, I am interested in the discursive strategies deployed by these authors, including judicial rhetoric and deliberative rhetoric. The issues raised through the study of rhetoric make it possible to explore the links between judicial discourse and political discourse and therefore between justice and politics. The summative, final part of our work further elucidates the relationships between rhetoric, justice and politics.
