Le culte de María Lionza au Venezuela contemporain : mémoire collective et politique / The cult of María Lionza in contemporary Venezuela : collective memory and politics

Le culte de possession autour de María Lionza connaît une importante phase d’expansion au début du XXème siècle, lorsque des flux migratoires intenses se dirigent non seulement vers les champs d’exploitation pétrolière mais aussi vers les espaces urbains qui, en étant les principaux bénéficiaires du miracle économique entraîné par la découverte de l’ « or noir », s’engagent dans un processus vertigineux de modernisation. Originaire du Centre-Nord du Venezuela, cette dévotion s’est donc consolidée parallèlement à l’essor du modèle économique rentier et de l’édification d’un État centralisé bien décidé à mettre en ouevre un ambitieux programme d’unification nationale dont l’historiographie patriotique, alors largement promue par les pouvoirs publics, était le fil conducteur. Curieusement, les grands symboles de cette cosmogonie républicaine se retrouveront progressivement dans les centres « spirites » marialionceros qui prolifèrent surtout en ville : ainsi, vers la fin des années 1950, de nombreuses figures historiques (comme le cacique Guaicaipuro ou le Libertador Simón Bolívar) s’intègrent peu à peu aux autels de culte, toujours prêts à accueillir de nouvelles entités. Ces personnages, désormais considérés comme des divinités, communiquent directement avec les adeptes par le biais de médiums lors du rituel sacré de la transe. Cette thèse s’interroge sur la nature et le sens des interférences et des possibles chevauchements entre les représentations du passé véhiculées par l’État-nation vénézuélien, et celles mises en avant dans le culte de María Lionza. En explorant les métamorphoses subies par la dévotion depuis le XXème siècle, nous examinerons l’extraordinaire capacité de ce phénomène religieux à récupérer des épisodes précis du passé, depuis la Conquête et les guerres d’indépendance jusqu’à la modernité pétrolière non exempte de contradictions. Dans cette démarche, la notion de « mémoire collective » joue un rôle central, puisque cette réappropriation suppose avant tout la réélaboration, au gré des crises politiques et économiques qui ont secoué le pays, de l’Histoire telle qu’elle se présente dans le discours officiel. À partir d’une enquête de terrain menée dans le lieu de pèlerinage le plus important du culte de María Lionza, la montagne de Sorte (État de Yaracuy, Venezuela), nous décrypterons les trames mémorielles qui s’imbriquent et s’enchevêtrent dans ce culte tout au long des deux derniers siècles tout en réfléchissant sur les nouvelles lectures, parfois tout à fait inattendues, qu’elles offrent du passé commun. À cet effet, nous proposerons d’abord une analyse détaillée de la géographie sacrée de Quibayo (montagne de Sorte), pour montrer comment les représentations d’autres époques qui s’y sédimentent vont de pair avec des périodes de crispation sociale dont les coups et les contrecoups ont marqué différentes générations d’adeptes. Ensuite, nous nous intéresserons à la dimension performative de la mémoire collective, en jetant un regard sur l’une des lignées d’esprit les plus populaires, les Indiens, et sa mise en scène dans le principal rituel de possession collectif, « la danse sur le feu ». Enfin, nous retracerons l’évolution récente du culte dans cette période d’enthousiasme révolutionnaire, et nous mesurerons l’impact du retour en force de l’idéologie nationaliste sur la dévotion. / The cult of possession around María Lionza experienced a period of growth at the beginning of the twentieth century, when the heavy flow of migrants supplied not only the operation of the oilfields but also the urban spaces which, as the principal beneficiaries of the economic miracle created by the discovery of the “black gold”, underwent a dizzying process of modernization. This devotion to María Lionza, which originated in the north central region of Venezuela, was therefore strengthened in parallel with the rise of the rentier economic model and the erection of a centralised State determined to implement an ambitious programme of national unification in which the patriotic historiography, then broadly promoted by the authorities, was the driving force. Curiously, the great symbols of this republican cosmogony would gradually come to be found in the “spirit” centres (marialionceros) which flourished, especially in cities: thus, in the late 1950s, several historic figures (such as the Chief Guaicaipuro and the Liberator Simón Bolívar) were gradually integrated into the devotional altars, which were always ready to accept new entities. These characters, who came to be seen as divinities, communicate directly with the followers of the cult through mediums during the sacred trance ritual. This thesis examines the nature and sense of the interferences and possible overlaps between the representations of the past transmitted by the Venezuelan nation-state, and those promoted by the cult of María Lionza. Through an exploration of the mutations undergone by this religious devotion in the twentieth century, we examine the extraordinary capacity of this religious phenomenon to retrieve certain episodes of the past, from the Spanish Conquest and the Wars of Independence to the contradictory oil-based modernity. Within this approach, the notion of “collective memory” plays a central role, because this re-appropriation essentially presupposes the re-elaboration, in accordance with the political and economic crises which have shaken the country, of Venezuela’s history as seen in scholarly discourse. Starting with a field survey carried out at the most important pilgrimage site of the cult of María Lionza, the Sorte Mountain (Yaracuy state), we explain the threads of memory which have become intertwined and entangled in the cult over the course of the last two centuries, while offering a consideration of the new, sometimes completely unsuspected readings which they offer of the shared past. For this purpose, we offer firstly a detailed analysis of the sacred geography of Quibayo (Sorte Mountain) to demonstrate how the collected representations of previous times work in tandem with the historical periods of social tension whose coups and countercoups marked different generations of devotees. We then turn to the performative dimension of collective memory, by focusing on one of the most popular spiritual approaches, that of the Indians, and their staging of the principal ritual of collective possession, the “dance over coals”. Finally, we trace the recent development of the cult in this period of revolutionary fervour, and measure the impact of the powerful return of a nationalist ideology on this religious devotion.

De praktiker och föreställningar som hör samma med den magiska verkligheten under etiketten ”witchcraft” verkar öka i popularitet i dagens Afrika. Medan vissa postmoderna antropologer har tolkat fenomenet som en kritisk kommentar mot moderniseringsprocesser är det troligt att föreställningen om den magiska verkligheten kan göra anspråk på fler uttryck än så. Syftet med den här undersökningen är att analysera hur informanternas syn på andebesättelse i en Luo-dominerad kristen evangelisk församling i Kibera, kan tolkas utifrån vissa ekonomiska, sociala och kulturella processer. Jag undersöker hur andebesättelse kan förstås med hjälp av informanternas förhållande till och synen på hemmet, familjen, könsroller, staden, landsbygden, avundsjuka och framgång. I analysen tolkas informanternas föreställningar om andebesättelse utifrån rörelser mellan de kenyanska gränserna rikedom/fattigdom, stadsliv/landsbygd och offentligt/privat. Andebesättelse kan därefter förstås som en slags medlare mellan dessa gränser, där de som befinner sig mellan någon av dessa oppositioner tenderar att vara särskilt utsatta för andliga attacker. / The notion of witchcraft seems to grow in popularity in the contemporary Africa. While some postmodern anthropologists have interpreted the phenomenon as a critical commentary on the processes of modernization, it is likely to be able to claim more than that. The purpose of the thesis is to analyse the notion of spirit possession by the informants in a Luo dominated evangelical church in Kibera, and how it may be interpreted through certain economic, social and cultural processes. This is made by investigating the views on the home, family, gender roles, urban, rural, jealousy and prosperity. The informant’s notion of spirit possession is interpreted in the analyse as movements across the Kenyan boundaries of rural/urban, public/private and rich/poor. Spirit possession is understood as a mediator between these boundaries, and those who is found to be in between some of these oppositions tend to be most vulnerable to spirit attacks.

This study examines how two writers deal with demonic possession and exorcism in their written works that both have a common theme, the same alleged case of possession and exorcism. By comparing these written works I explore if the authors share any common or varying theories on possession and exorcism and investigate if the common theme of the two books has contributed to the authors writing similar books.My results show that the two authors deal with demonic possession and exorcism differently, one has theological views of the phenomena but is sceptical of their role in the alleged case, whilst the other believes that demonic possession and exorcism can be explained using scientific theories and that they are phenomena that played a part in the alleged case. The two books are quite different. I conclude that both writers’ theories of the phenomena are dependent on the existence of the phenomenon of religion.

Attributive absolute constructions in contemporary French The aim of this master thesis is a detailed analysis of French attributive absolute constructions (att. AC) with emphasis on their semantic characteristics. Att. AC is an example of what is called "secondary predication", i.e. a non-finite predicative structure modifying the primary predication, see a typical example "les yeux fermés", 'the eyes closed', in the sentence "Marie est assise, les yeux fermés.", 'Mary sits with her eyes closed.'. The main function of the att. AC is the modification of the head noun through the relation of inalienable possession (IP), or a part - whole relation, between this noun, which is mostly a human being, and an entity conceptualized in the att. AC. The thesis finds its main source in a monograph about AC written by Suzanne Hanon (1989), which is here completed by a qualitative analysis of syntactic and semantic factors that come into play in the formation of att. AC. Att. AC are approached form the perspective of Cognitive Linguistics and Construction Grammar as conceptualizations of the IP (or part - whole) paradigm and it is proposed their description as a prototype-based category with some instances more typical (see the example above) than others (e.g. att. A posse na regularização de assentamentos urbanos / La possession dans la régularisation des établissements urbains

A nova disciplina legal da posse como direito real no âmbito da regularização fundiária no Brasil coloca-se como importante mecanismo para a redução das desigualdades sociais. Será desenvolvido o conceito de posse e seus contornos atuais, especialmente em vista da situação social brasileira, notadamente em função da regularização fundiária no Brasil e a nova disciplina da posse conferida pela Lei nº 11.977/2009, tal como alterada pela Lei nº 12.424/2011. Foi esta lei recente que trouxe em seu condão a possibilidade da regularização fundiária de assentamentos urbanos. A ideia de possibilitar esta regularização não é nova - na verdade, já constava do Projeto de Lei nº 3.057, que tramitava no Congresso Nacional desde o ano 2000. A Lei nº 11.977/2009 insere em nosso ordenamento jurídico a regularização fundiária de assentamentos urbanos, consistente no conjunto de medidas jurídicas, urbanísticas, ambientais e sociais objetivando a regularização de assentamentos irregulares e a titulação de seus ocupantes. Estabelece a competência municipal para dispor sobre o procedimento de regularização fundiária, nos termos da demarcação urbanística. A demarcação urbanística ocorrerá mediante procedimento administrativo pelo qual o Poder Público, no âmbito da regularização fundiária de interesse social, demarca um imóvel de domínio público ou privado, definindo seus limites, sua área, sua localização e seus confrontantes, com a finalidade de identificar seus ocupantes e qualificar a natureza e o tempo das respectivas posses. É nesse contexto que ocorrerá inicialmente a legitimação de posse ao ocupante do imóvel objeto da demarcação urbanística, uma vez que o Poder Público deverá proferir ato administrativo capaz de conferir título de reconhecimento de posse do imóvel, com a identificação deste ocupante, do tempo e da natureza da posse. Se bem sucedida a demarcação urbanística, a partir da averbação do auto de demarcação urbanística, o Poder Público deverá elaborar o Projeto de Regularização Fundiária e submeter o parcelamento dele decorrente a registro. Após o registro do parcelamento, o Poder Público concederá título de legitimação de posse aos ocupantes cadastrados (preferencialmente em nome da mulher). A legitimação de posse devidamente registrada constitui direito a favor do detentor da posse direta para fins de moradia, desde que não seja proprietário ou detentor de posse de outro imóvel. Sem prejuízo dos direitos decorrentes da posse exercida anteriormente, o detentor do título de legitimação de posse, após cinco anos de seu registro, poderá requerer ao oficial de registro de imóveis a conversão desse título em registro de propriedade, tendo em vista sua aquisição por usucapião instituindo modalidade de usucapião administrativo. Diante do exposto, percebe-se que a referida Lei nº 11.977/2009 trouxe em seu bojo tema de grande interesse, conferindo uma conotação e fortalecimento legal até então inédita à posse: a posse como direito real. Este tema merece estudo aprofundado; é o que se propõe com o presente trabalho. / Le nouvel encadrement juridique de la possession comme droit réel vis-à-vis la régularisation foncière au Brésil apparaît comme un important mécanisme de réduction des inégalités sociales. La notion de possession et ses contours actuels seront étudiés dans ce travail, spécialement au regard de la situation sociale brésilienne, et notamment en raison de la régularisation foncière au Brésil et le nouvel encadrement de la possession accordée par la Loi n° 11.977/2009, modifiée par la loi n° 12.424/2011. Cette récente loi a permis régularisation foncière des établissements urbains. L\'idée de permettre cette régularisation n\'est pas nouvelle. En fait, elle était déjà prévue dans un projet de loi plutôt vieux, le projet n° 3.057, qui était examiné par le Congrès dès lannée 2000. La Loi n° 11.977/09 introduit, dans notre système juridique, la régularisation foncière des établissements urbains, cest à dire, l\'ensemble des mesures juridiques, urbaines, environnementales et sociales visant à la régularisation des établissements informels et à la délivrance des titres à ses occupants. Les municipalités locales ont compétence de se prononcer sur la procédure de régularisation foncière, selon la démarcation urbaine. La démarcation urbaine est faite par le biais d\'une procédure administrative, par laquelle le Gouvernement, en vue de la régularisation foncière d\'intérêt social, détermine un immeuble comme de domaine public ou privé, fixant ses limites, sa superficie, sa localisation et sa voisinage, dans le but d\'identifier ses occupants et de qualifier la nature et le temps de chaque possession. C\'est dans ce contexte que se produira, initialement, la légitimation de la possession de l\'occupant de limmeuble qui fait lobjet de la démarcation urbaine; puisque le Gouvernement doit publier un acte administratif susceptible de conférer à cet occupant le titre de reconnaissance de la possession de limmeuble, avec son identification, et lindication du temps et de la nature de sa possession. En cas de succès de la démarcation urbaine, à partir de lenregistrement de lacte de démarcation urbaine, le Gouvernement doit élaborer le projet de régularisation foncière et inscrire ses divisions au registre foncier. Après l\'enregistrement des divisions, le Gouvernement fournit le titre de légitimation de la possession aux occupants inscrits (de préférence aux femmes). La légitimation de la possession dûment enregistrée est un droit en faveur du détenteur de la possession directe des logements, à condition que cet occupant ne soit pas propriétaire ou détenteur de possession dun autre immeuble. Nonobstant les droits dérivés de la possession exercée précédemment, le détenteur dun titre de légitimation de possession, après cinq ans de son enregistrement, peut demander à lagent du Bureau dEnregistrement dImmeubles la conversion de son titre en titre de propriété, vu son acquisition par usucapion ainsi créant la modalité dusucapion administrative. Compte tenu des considérations exposées ci-dessus, la Loi n° 11.977/2009 a apporté un thème de grand intérêt, en donnant à la possession une connotation et un renforcement juridique inédites: la possession comme un droit réel. Ce sujet mérite une étude approfondie et de qualité, ce qui est proposé dans ce travail.

Usucapião da propriedade imaterial / Usucaption of intangible goods

O presente estudo parte de uma inquietante indagação: um bem corpóreo que se livra de seu corpus mechanicum sem perder a sua essência, transforma-se em outro bem? Ou seja, um bem que é passivo de direitos e obrigações escapa ao ordenamento jurídico com sua desmaterialização? A partir desta resposta, é analisada a extensão do vocábulo coisa, sujeito passivo da usucapião, para saber se os bens incorpóreos se subsumem a este instituto. Ultrapassadas tais questões, e após breve escorço histórico da usucapião, que nos mostra a evolução e o escopo do instituto, foram analisados diversos bens e direitos, todos intangíveis, que são os principais alvos de disputas judiciais, em virtude dos altos valores econômicos envolvidos e, pela mesma razão, são cogitados como passíveis de serem usucapidos. E, embora todos os bens e direitos analisados sejam imateriais, cada qual merece tratamento distinto por incidir legislação específica, motivo pelo qual não há conclusão geral nesta matéria. Afinado com a tendência modernizadora da nova sociedade tecnológica, o presente estudo busca a confluência entre antigos institutos com a nova realidade fática, para se alcançar um resultado prático célere, sem, contudo, desvirtuar conceitos jurídicos enraizados em nosso sistema jurídico. São novos fatos que surgem e devem subsumir às não tão novas normas positivadas, em virtude da pronta resposta que a sociedade espera, seja pela concretização da função social ou por outros princípios maiores, tais como a dignidade da pessoa humana, que a usucapião traz consigo. Pois bem, a possibilidade da usucapião da propriedade imaterial deverá ser analisada em cada caso específico e, se admitida, trará ao nosso ordenamento a confluência entre a posse, a propriedade e a função social de ambas culminando na almejada segurança jurídica. / This study starts with a disquieting question: tangible goods that get rid of its corpus mechanicum without losing its essence becomes another goods? In another words, one that is subject to rights and obligations comes off the legal system with its dematerialization? From the answer of this question, the extension of the term thing, passive subject to adverse possession (usucapio), was analyzed in order to find out if intangible goods are subject to this institute. Subsequent to these issues, and after a brief historical sketch of adverse possession, which shows the evolution and scope of the institute, different goods and rights were analyzed, all intangible, which are the main targets of litigation, because of the high economic values involved and because of the same reason, are pondered as subject to adverse possession. And, although all analyzed goods and rights are intangible, each of which deserves separate treatment because of its specific legislation, reason why there is no general conclusion on this matter. In harmony with the modernizing tendency of the new technological society, this study seeks the confluence between old institutions with the new factual reality, in order to achieve a quick practical result, without, however, detract legal concepts rooted in our legal system. New facts that arise and are subject to the not so new legal norms, because of the rapid response that society expects, in consequence of the social function or other major principles such as human dignity, which adverse possession brings along. Well, the possibility of adverse possession of intangible goods should be examined in each specific case and, if admitted, will bring to our legal system the confluence between possession, ownership and the social function of both culminating in the desired legal certainty.

The research in question was developed through the analysis of legal texts about the institute of Brazilian and foreign law, the national and foreign doctrine and jurisprudence. The object of study is the right of retention, a particular way to ensure obligations, whereby the creditor keeps under his/her power, upon a new title, the mischief thing, that he/she already rightly holds, beyond the moment it should be delivered, with the purpose of imposing and assuring the voluntary compliance with an obligation to give such a sum of money in cash, which keeps a connect relationship with the thing withheld. The author discoursed about the essential elements to understand the right of retention of the Brazilian legal system, such as: origin and evolution, legal structure, concepts, features, legal basis, function, application sphere, requirements, effects, hypothesis of acceptance, types of guardianship, termination causes and foreign legislation overview on the institute. Upon said general concepts, the author intended to contribute to the best interpretation and application, by law professionals, of the right of retention institute and update the study of this theme before the existing legislation in the country / A presente obra propõe uma forma de sistematização do direito de retenção no direito brasileiro. A pesquisa para a elaboração do trabalho ocorreu pela análise de textos legislativos sobre o instituto no direito brasileiro e estrangeiro, a doutrina nacional e estrangeira e a jurisprudência formada. O objeto de estudo é o direito de retenção, modo específico de garantia das obrigações, por meio do qual o credor mantém em seu poder, sob um título novo, a coisa alheia, que já detenha legitimamente, para além do momento em que deveria entregá-la, com a finalidade compelir e de garantir o cumprimento voluntário de uma obrigação de dar soma em dinheiro, a qual mantém uma relação de conexidade com a coisa retida. O autor buscou discorrer sobre os elementos essenciais para a compreensão do direito de retenção no ordenamento brasileiro, quais sejam: origem e evolução, natureza jurídica, conceito, caracteres, fundamento jurídico, função, âmbito de aplicação, requisitos, efeitos, hipóteses de cabimento, meios de tutela, causas de extinção e um panorama da legislação estrangeira sobre o instituto. At first we try to study the essential elements possessory where the phenomenon was structured throughout history; later, we do a study of the Tridimensional Theory of Law by Miguel Reale at the vision of Maria Helena Diniz, as well as the principle of human dignity enshrined in the charter. Then, the possession is studied socially and economically in the theories of Antonio Hernandez Gil, Perozzi and Saleilles comparing these scholars thought the thoughts of Jhering and Savigny. After this study dogmatic, is set to address the issue possessory actually factual-evaluative Brazilian and necessity of pursuing a real possession qualified for their functionalization, we emphasize the invasions and occupations of areas were not fulfill its function, made by popular movements in order civil disobedience and fulfill the social function of ownership; criticizes also the structure agrarian-urban Brazilian real estate, which favors the few over the many as a legacy of the colonial structure of exploitation, it is also a comparative study with alien legislation, demonstrating the adoption of constitutions in social function of property, but also the constitutional legislation which regulates the possession. We suggest a new theory, called the theory of social consciousness and their reflections on possessory title, lege ferenda suggestions are made, as well as changes in Brazilian law, thus seeking a new way of exercising possessory social function, unlike than was previously proposed by the doctrine / A presente tese demonstra a função social da posse a partir de uma nova perspectiva fático-social. Num primeiro momento, busca-se estudar os elementos possessórios essenciais em que o fenômeno se estruturou ao longo da história. Posteriormente, faz-se um estudo da teoria tridimensionalista de Miguel Reale na visão de Maria Helena Diniz, como também, do princípio da dignidade humana consagrado na carta constitucional. Em seguida, a posse é estudada socialmente e economicamente à luz das teorias de Antonio Hernandez Gil, Perozzi e Saleilles, comparando o pensamento desses doutrinadores aos pensamentos de Ihering e Savigny. Após este estudo dogmático, passa-se a enfrentar a questão possessória na realidade fático-valorativa brasileira e na necessidade do exercício de uma posse qualificada para sua real funcionalização. Enfatiza-se as invasões e ocupações das áreas desfuncionalizadas, feitas por movimentos populares como forma de desobediência civil e cumprimento da função social da posse; critica-se ainda, a estrutura agrário-urbana imobiliária brasileira, que privilegia poucos em detrimento de muitos como uma herança da estrutura colonial de exploração; faz-se ainda, um estudo comparado com a legislação alienígena, especialmente demonstrando a adoção nas constituições da função social da propriedade, como também, da legislação infraconstitucional que disciplina a posse. Sugere-se uma nova teoria, denominada teoria da consciência social possessória e seus reflexos no direito de propriedade, sugestões de lege ferenda são feitas, como também alterações na legislação brasileira, buscando-se assim uma nova maneira de exercício da função social possessória, diversamente do que até então foi proposto pela doutrina

Possessed by the Other: Dybbuk Possession and Modern Jewish Identity in Twentieth-Century Jewish Literature and Beyond

This dissertation explores the metaphor of dybbuk possession as a key to modern Jewish identity, focusing on the evolution of the dybbuk possession trope in twentieth- and twenty-first century Yiddish, English, Hebrew, and Polish language Jewish literature and culture. First described in the sixteenth century, dybbuk possession - a Jewish variant of spirit possession found in many cultures - grew out of the Jewish mystical tradition, especially the kabbalistic doctrine of transmigration of souls, according to which a soul of a deceased person took possession of a living human being. The trope of possession can be viewed as a mode of reflection on the modern Jewish experience, which shows how the past continuously possesses the present, and how this haunting attachment to the past becomes an essential component of Jewish identity. Highly interdisciplinary in character and transnational in scope, this project draws upon scholarship in gender, trauma, body, memory, and performance studies. An overview of cultural background of dybbuk possession (Chapter 1) is followed by an exploration of how the dybbuk possession trope is deployed metaphorically in Yiddish classics (Chapter 2), Holocaust narratives (Chapter 3), feminist fiction (Chapter 4), as well as in a selection of film and theater adaptations of S. An-sky's iconic drama, The Dybbuk, Or Between Two Worlds (1914) produced in Poland, Israel and the United States (Chapter 5). Finally, this dissertation features an unprecedented compilation of over seventy adaptations of An-sky's Dybbuk staged since the play's premiere in 1920 (Appendix).
