Abbatial elections : the case of the Loire Valley in the eleventh century

This thesis examines a series of documents described as electoral charters, produced in monastic institutions of the Loire Valley from the late tenth to late eleventh centuries. By considering the variations in the formulas used for each charter, the study considers what the charters were saying about power or wanted to project about the powers at play in the events they described. Through this, the thesis demonstrates that the power of lordship projected by such documents was of a very traditional nature throughout the period in which they were being produced. The count's role on each occasion showed him to be a dominant force with a power of lordship composed of possession and rights of property ownership, but also intangible elements, including a sacral interest. By considering the context of events surrounding each charter of election, the thesis demonstrates that elements of this lordship could be more or less projected at different times in order that different statements might be made about the count. Thus, the symbolic expressions of power appear to have been bigger elements or more strongly emphasised in periods when the count's political or military power was under pressure. The differences in formulas used throughout the period of the charters' production demonstrate that, despite the appearance of new elements that may appear to have been important novelties, these processes were likely to have been original to proceedings, and therefore the notions of a reform of investitures taking place in the mid-eleventh century must be nuanced. Instead of demonstrating a mutation in relationships between lord and Church, the documents demonstrate an alteration in style and content, becoming more narrative and verbose and in these ways revealing elements of the process of abbatial elevations that had previously been hidden from view.

This diploma thesis [in the master's course], drawn up at the Faculty of Law of Charles University in Prague, deals with the principles of the law of inheritance in Bohemia prior to its codification in 1811. Although inheritance law is one of the oldest branches of law, and was very thoroughly developed in ancient Roman law, in our territory it actually started to develop some more only after the Hussite movement. That is due to the fact that in the Middle Ages, the prevailing concepts were the ruler's right to bona vacantia and family indivisible ownership ["rodinný nedíl" in Czech], both of which did not really make it possible to pass estate from the deceased to their heirs. Therefore the aim of the thesis is to examine and gain a deeper insight into the historical development and historical contexts of the law of inheritance in our territory, which had preceded its modern form that was first codified in Allgemeines bürgerliches Gesetzbuch [the General Civil Code], which accepted the structure of the Inheritance Patent of Joseph II in 1811. This master thesis deals with the history of the Capuchin order in Czech-Moravian territory during 1618-1673. The Czech-Austrian Capuchin province was established in 1618 and in 1673 was divided into Czech and Austrian part which led to formation of two individual provinces of the Capuchin order. The first chapter of the master thesis introduces the review of existing literature that deals with this theme and the characterization of sources. This chapter is focused on narrative sources that are fundamental for this master thesis. In the second chapter, the Capuchin order is characterized (with the emphasis on the structure and formation) and its history, because this information explains the behaviour of Capuchins in the Czech-Moravian territory. We could not omit the Franciscan order and its history in this passage, because these also influenced the orientation and spirituality of the Capuchin order. The whole history of the Czech-Austrian Capuchin province is comprised in the third chapter. This period witnessed a significant progress in admission of new members of the Capuchin order. Durant el període que va des de la mort de Carles II (1700) fins a la fi de la Guerra de Successió (1714), els tres comuns (Consell de Cent, Diputació del Catalunya i Braç Militar), assoliren un paper fonamental en la defensa de les Constitucions davant les transgressions dels monarques. La seva actuació, però, va estar dirigida per una institució de recent creació: la Conferència dels Comuns. La present tesi doctoral estudia aquesta institució, que va esdevenir decisiva en el tombant del segle XVII i ajuda a entendre per què els catalans es decantaren a favor de Carles III, l'arxiduc, durant el conflicte successori. Però la Conferència dels Tres Comuns va ser rellevant també per la seva significació dins el context de les institucions representatives: va afavorir l'actuació mancomunada dels comuns a la vegada que va facilitar l'accés dels nous sectors mercantils en la presa de decisions polítiques. / Durante el periodo que va desde la muerte de Carlos II (1700) hasta el fin de la Guerra de Sucesión (1714), los tres comunes (Consejo de Ciento, Diputación del General y Brazo Militar), adquirieron un papel fundamental en la defensa de las Constituciones ante las transgresiones de los monarcas. However, the actions of three commons were guided by a new institution: the Conference of Commons. This doctoral thesis studies this institution, which was decisive during these years, and helps us to understand why Catalans supported to Charles III, the archduke. Conference of Commons was also important because of its meaning in the context of representative institutions: it did well for the unity of action of the commons, and, at the same time, it permits the access of the new mercantile sectors to the groups with political power.

La tenture de la 'Dame à la licorne' est le plus souvent interprétée comme une allégorie des sens physiques, mais son iconographie se distingue par le registre héraldique. Chaque composition s’organise tel un emblème héraldique de sorte que les personnages principaux remplacent l’écu tant du point de vue visuel que fonctionnel. Si cette tenture est fréquemment citée comme un monument à la réussite socioprofessionnel du commanditaire, on n’a jamais cherché à comprendre comment le registre scénique contribue à la représentation du commanditaire. Autre lacune dans le corpus de littérature, l’importance de la figure féminine dans cette image est restée jusqu’alors ignorée. La présente étude propose donc d’étudier la 'Dame à la licorne' et sa fonction représentative en analysant les traditions culturelles, littéraires et iconographiques, ainsi que les réalités sociohistoriques, qui sous-tendent l’image d’excellence sociale que le commanditaire souhaite rattacher à sa personne et à sa famille. / The 'Lady and the Unicorn' tapestries are most often interpreted as an allegory of the physical senses, but their iconography is remarkable for its integration of armorial elements. Each composition is organized like a heraldic emblem, such that the main figures replace the coat-of-arms in its position and its function. Though this work is frequently identified as a monument to the patron’s socio-professional success, no effort has been made to understand how the scenes contribute to his personal representation. The lack of interest for the decidedly female character of this iconographic programme is another weakness in previous studies of these tapestries. This doctoral dissertation proposes to examine the 'Lady and the Unicorn' and its representative function by analysing the cultural, literary and iconographic traditions, as well as the socio-historic realities, that shape the image of social excellence the patron constructs in order to represent himself and his family.

Since the Chamber of Aracati is the main reference area to precede the identification of the local elite, first, we have intended to understand how the entry was made in certain areas, such as the Town Chamber, the officer ranks in the local military troops, some brotherhoods, the mercantile activities, and some other employments; and, then, how all these occupations were incorporated by the town elite members, both as mechanisms of power and tools of acquisition and enlargement of its distinctive reference as part of a “civil nobility”, social code with which the local elites of the Portuguese Modern Empire used to identify to. / Este estudo tem como principal objeto de análise as práticas de nobilitação e distinção social desenvolvidas pelos membros da elite da vila de Santa Cruz do Aracati na Capitania do Siará grande entre os anos de 1748 e 1804. Tendo a Câmara de Aracati como principal espaço de referência para a identificação da elite da vila, buscamos perceber de que forma o ingresso em espaços como: a Câmara da vila, os postos de oficiais nas tropas militares locais, as irmandades e o exercício de atividades mercantis, entre outros; foram sendo incorporados pelos membros da elite da vila, não somente como mecanismos de poder, mas, também, de aquisição e ampliação de seu referencial distintivo enquanto parte da “nobreza civil”, estatuto social com o qual identificavam-se as elites locais do império português moderno.

Bertha von Suttner (1843-1914) reste connue pour son engagement pacifiste. Son ouvrage Bas les Armes! (1889) lui a valu une grande notoriété mondiale, avant la première guerre mondiale. Son engagement dans le mouvement de la paix qu’elle a contribué à organiser lui a valu le prix Nobel de la paix en 1905. Engagée dans multiples combats, elle est encore méconnue. Où la situer ? Comment caractériser sa lutte pour la paix, l’émancipation des femmes ou la sécularisation de la société, alors qu’émerge en Europe un discours pacifiste et libérateur ? Il importait de mettre en évidence sa rupture face à la tradition et sa position spécifique politiquement non révolutionnaire. Voilà à quoi s’attache la présente thèse, qui s’appuie sur l’analyse inédite des romans et nouvelles à tonalité autobiographique, et qui s’emploie à jeter un éclairage sur l’influence persistante de la philosophie populaire des Lumières allemandes à la fin du XIXe siècle. (1889) made her famous before World War First. She becam one of main advocates of the idea of universal peace through the creation of a European suprantional identity. She owes the 1905 Nobel Peace Prize to her international fame. But beyond this fight she was committed to the defence of women or against the dogmatism of society and the church. How to define the consistency of her many fights at the very time when a pacifist and emancipating discourse was emerging ? the present thesis, based on a original analysis of the author's novels and short stories with an autobiographical undertone, is driving to light her breaking away from tradition but on a politically not revolutionary way, with the persitent influence of the popular philosophy of the German Enlightenment Age at the end of the XIXth century. In second half of 15th century, Bohemia was confronted with many social changes. One of the most important was the effort to codify land law which was finalized by the publishing of Vladislaus's land law. It's leading author was Albrecht Rendl of Ousava. Because of it Rendl became well known among his contemporaries and in general historical awareness. There are only few known facts about the rest of his life. He served as royal prosecutor for a long time, but he also obtained two of the highest land offices - the supreme land scribe and the prosecutor. Rendl represents a kind of person able to promote himself to the highest points of contemporary policy due to his formidable personal abilities.

Cette thèse porte sur les relations entre la noblesse et le prince dans les duchés de Lorraine au coursd’une période qui s’étend des années 1620 à 1737. Elle les explore dans le cadre d’un renforcement du pouvoirducal et dans une période de transition troublée.Dans cet État souverain des confins, la noblesse représentée par quelques puissantes familles issues del’ancienne chevalerie incarne l’élite sociale, morale, et politique. Étroitement associée aux responsabilités, elleest affectée au premier plan par les ruptures qui scandent le XVIIe siècle : la guerre, l’occupation française etl’exil. Autant d’évènements qui déstabilisent le service princier et éprouvent la fidélité au duc, fondementessentiel des rapports de la noblesse au pouvoir. Cette étude revisite les notions de service, de devoir etd’honneur, constitutives de l’identité nobiliaire.Après plus d’un demi-siècle de désordres, la paix de Ryswick (1697) ramène la stabilité et le princeretrouve ses duchés. Le rétablissement de l’État s’effectue dans une dialectique entre tradition et changement. Lanoblesse qui aspire à retrouver sa place auprès du duc est confrontée à de nouvelles incertitudes qu’elle surmontegrâce à la résurgence de la faveur princière et au prix d’une recomposition de l’ordre.L’équilibre des forces est mis à mal en 1729 avec l’avènement de François III dont le destin se joue pardelàles frontières. The academic frame in which it is explored is one marked by reinforced ducalpower and by much turmoil within a transitory period.In such a border-line sovereign state, the nobility as represented by a few powerful houses stemmingfrom ancient chivalric backgrounds, embodies the social, moral and political elite of the day. Closely involved inthe Duke’s wields of executive power, and more than any other social body, nobles suffered from the manypoints of rupture that punctuated the 17th century : wars, French occupation and exile did indeed challeng thePrince’s service. These points of rupture jeopardized the fidelity to the Duke, one of the essential foundations ofthe link between the nobility and Power. The study revisits such key-notions as service, duty, and honour,notions which shape up nobles’ identity.After more than a half-century of disorders of all kinds, the Ryswick Peace (1697) brought the situationback to a relative stability and the Prince regained his Duchies. Apparus en 1428 en Espagne, le Pas d’armes est un parfait exemple de l’indéniable intérêt porté par la noblesse, de la fin du Moyen Âge et du début de la Renaissance, aux arts martiaux, littéraires et théâtraux. Il s’agit, en réalité, d’une évolution de la joute et du tournoi au cours duquel un ou plusieurs chevaliers est volontaire pour garder un carrefour, une porte ou tout autre lieux symbolique. Pour différencier ces exercices des joutes, les organisateurs publient des chapitres, ou lettres d’armes, plusieurs mois en avance. Ils sont souvent constitués de deux parties, la première venant placer les chevaliers assaillants et défenseurs dans un univers magique et fantastique, le seconde présentant les règles du jeu. Notons également que la majeure partie des Pas plonge les chevaliers dans un monde fictionnel, en particulier inspire de la légende arthurienne, grâce aux chapitres, aux décors et, naturellement, aux costumes. Témoignages des contacts transculturels existent entre les cours d’Anjou et de Bourgogne avec celles d’Espagne, les Pas d’armes sont organisés à des moments décisifs pour les cours, qu’il s’agisse de mariages, de traités de paix ou d’un temps d’après-guerre ; et tous remplissent un rôle commun : mettre en lumière l’unité chevaleresque autour du Prince et de son pouvoir. They consisted of two parts, the first one coming to place the knights defenders and aggressors in a magic and fantastic universe, the second containing rules to be followed. It is also necessary to note that the great majority of Pas place the knights in a fictional world, in particular regarding Arthurian legend, by means of chapters, present scenery around the lists and, naturally, costumes. Testimonies of transcultural contacts between the Valois ‘courts of Anjou and Burgundy and Spanish courts, the Pas d’armes are organized at courtly decisive moments like marriages, treaties of peace or just after a war, all the Pas d’armes had a common role : to highlight the unity of knighthood around the Prince and his power. On each occasion is the Prince who emerges victorious from all the entertainment organized at his court. Essentially, it is a way for the prince to dramatize his power in this “game – mimicry” where the important thing was not so much the fighting but the scenery and the highlighting of cultural, financial and military power of the court.
