Samverkan blir kamp : En sociologisk analys av ett projekt i ungdomsvården / When collaboration becomes a struggle : A sociological analysis of a project in the Swedish juvenile care

In this dissertation a collaboration project in Swedish youth care is analysed. The aim of the project was to enhance coordination between the Social Services and the Swedish National Board of Institutional Care in order to make the efforts more efficient. The project also employed a number of coordinators. The overall purpose of this dissertation is to analyse conflicts, alliances and comparisons identifiable in interviews and observations. The analytic findings are put into an overall “collaboration context” represented by earlier research on the social phenomenon of “collaboration”. In this way the dissertation tries to contribute to a sociological understanding of a contemporary widespread phenomenon. The empirical materials of the study consist of recorded conversational interviews with 147 project participants (youngsters, parents and various professional categories) as well as observations of meetings, informal get-togethers and visits to institutions, Social Services offices, the head office of the National Board of Institutional Care and coordinators. The material was analysed using the analytic perspectives of Georg Simmel (1950/1964), Theodore Caplow (1968) and Erving Goffman (1959/2004). The analysis shows that the project manifested and led to struggles between organizations involving representatives from the Social Services, the National Board of Institutional Care and the project, as well as to several interpersonal conflicts between representatives from various categories of involved professionals, and the youngsters and their parents. The study also shows that the client, in such human service organizations, faces a significant risk of being marginalized. Professionals who appreciated the collaboration often drew their conclusions based on their interaction with other professionals, but the collaboration did not guarantee a successful treatment of the client. Conflicts concerning the roles of the coordinators and their written documents (“the agreements”) emerged and were actualized through the creation of the project. The coordinators and their “agreements” can be seen as the project’s most visible representatives and symbols, which during the project become both themes for conflict and actualize already established conflict patterns. The youngsters and their parents appreciated the projects’ coordinators who appeared as personally involved and able to make concrete changes. However, many of youngsters and their parents criticized the coordinators and even portrayed a victim identity in relation to the project. The coordinator’s relationship with the youngsters and their parents was mostly characterized by passivity. This is clearly apparent in the analysis of the administrative and/or passive coordinator. Different alliance constellations became visible in these presentations. When the coordinator roles were altered in the description, the alliance constellations change. It is a common strategy for clients in human service organizations to try to enter into alliances with professionals involved in their cases and, in so doing, try to alter the situation to their own advantage. The fact that these alliances are often sought by the client indicates, among other things, the client’s will to fight against the situation in which he/she finds him/herself. I believe that this can be seen as something productive rather than problematic. / I denna avhandling analyseras ett samverkansprojekt i den så kallade ungdomsvården i Sverige. Projektet hade som mål att förbättra samordningen mellan socialtjänsten och Statens institutionsstyrelse för att kunna effektivisera insatserna för samhällsomhändertagna ungdomar och deras familjer. I projektet var också ett antal samordnare anställda. Det övergripande syftet i avhandlingen är att analysera beskrivna och observerade konflikter, allianser och förklarande jämförelser som kan identifieras i intervjuer och observationer. Analytiska upptäckter sätts avslutningsvis i en mer övergripande ”samverkanskontext” som representeras av tidigare forskning om samhällsfenomenet ”samverkan”. På så vis försöker avhandlingen bidra till en sociologisk förståelse av ett samtida välspritt fenomen.Studiens empiriska material är inspelade samtalsintervjuer med 147 projektdeltagare (institutionsplacerade ungdomar, deras föräldrar och olika yrkeskategorier inom socialtjänsten, Statens institutionsstyrelse och projektet) samt observationer av organiserade möten, informella träffar före och efter intervjuer eller möten, samt vid besök på institutioner, socialtjänstkontor, Statens institutionsstyrelses huvudkontor och samordnarnas kontor. Materialet analyserades vidare med analytiska utgångspunkter från Georg Simmel (1950/1964), Theodore Caplow (1968) och Erving Goffman (1959/2004).Analysen visar att projektet manifesterade och medförde mellanorganisatoriska kamper mellan socialtjänsten, Statens institutionsstyrelse och projektet samt en rad interpersonella konflikter mellan representanter för olika professionella yrkeskategorier, ungdomar och föräldrar. Studien visar också att klienten i människovårdande organisationer löper en betydande risk att hamna utanför nya samarbeten. De myndighetspersoner som upplever ett bra samarbete drar ofta sina slutsatser utifrån interaktionen med andra professionella men det upplevda samarbetet behöver inte bli någon garanti för framgångsrik behandling av klienten. Konflikter om samordnarnas sätt att agera (samordnarroller) och samordnarnas skriftliga dokument, ”överenskommelsen”, har aktualiserats med projektets tillkomst. Samordnarna och deras ”överenskommelse” kan ses som projektets synligaste representanter och symboler, som under projektets gång blir både ämnen för konflikter och aktualiserar redan etablerade konfliktmönster. Ungdomarna och föräldrarna förkastar emellanåt myndighetspersonernas ageranden som moraliskt felaktiga, gestaltar sin offeridentitet samt försöker vända situationen till att bli fördelaktig för dem själva. Samordnarnas relation till ungdomar och föräldrar präglas mestadels av passivitet. Detta framträder tydligt i analysen av en administrativ och/eller passiv samordnarroll. I dessa framställningar är även olika allianskonstellationer synliga. När samordnarroller förändras i beskrivningen, förändras även allianskonstellationer.Att klienten i människovårdande organisationer söker ingå allianser med myndighetspersoner är en vanlig strategi för att försöka vända situationen till sin fördel. Att dessa allianser söks ofta av klienten indikerar bland annat klientens vilja till fortsatt kamp – mot den situationen i vilken klienten befinner sig. Jag menar att detta kan ses som något produktivt snarare än problematiskt.

Dans un contexte de mise en place des pôles de compétitivité et des dernières lois sur la décentralisation (2004 et 2013), les Régions ont vu leurs compétences renforcées en matière de développement économique et d’innovation, et se sont impliquées plus massivement dans la conduite de politiques scientifiques et technologiques (S&T). Ainsi, ce travail a pour but d’interroger l’efficacité des politiques S&T régionales. En effet, la légitimé de l’échelon régional dans la politique de S&T peut être remise en question dès lors que la production et l’exploitation de la technologie tendent à être de plus en plus globalisées. Cette légitimité régionale peut être abordée sous l’angle des Systèmes Régionaux d’Innovation (SRI). En considérant l’échelon régional comme prégnant, notamment au niveau des politiques économiques et technologiques, les SRI permettent d’analyser les liens entre science, industrie et gouvernance au niveau local. Face à ces enjeux, la Région Aquitaine, qui a augmenté son budget consacré à sa politique de S&T de manière considérable depuis ces dix dernières années, se pose des questions. Elle est aujourd’hui la Région française dont le budget S&T par habitant est le plus élevé. C’est pourquoi celle-ci veut savoir si sa politique de S&T est efficace. Cet effort conséquent en termes de S&T, est-il nécessaire/justifié ? Quelle est la cohérence de la politique régionale au cours du temps ? Ces questions sont appréhendées en utilisant les outils de l’évaluation. Un travail de formalisation des objectifs poursuivis et des moyens mis en oeuvre par la Région est mené, tout en développant une approche comparative par rapport à d’autres expériences régionales en France. / In the context of setting up clusters and the latest laws on decentralization (2004 and 2013), the regions saw their skills for economic development and innovation increased. That’s why they are more involved in the conduct of science and technology policies. Thus, this study aims to examine the effectiveness of science and technology policies (S&T) at the regional level. Indeed, the legitimacy of this level in the S&T policy could be challenged since the production of technology tend to be more and more globalized. Moreover, this regional legitimacy can be approached from the perspective of regional innovation systems (RIS), which constitute a theoretical framework suitable for the treatment of this issue. Considering the importance of regional level, especially in economic and technological policies, SRI is a framework which aims to analyze the links between science, industry and local governance. Faced to these challenges, the Aquitaine Region asks itself questions. Indeed, it has increased its S&T budget since the last ten years and today is the French region with the highest S&T budget per capita. Now the Aquitaine Region wants to know how effective its S&T policy is. Is this effort in terms of S&T necessary or justified? What is the consistency of regional policy over time? What is the result of such a policy a socio-economic point of view? These issues will be studied using of evaluation’s tools. Furthermore, we offer to synthetize the objectives of S&T and the means used by the Region and we develop a comparative approach to other regional experiences on differents dimensions of innovation.

Parfois occultée, longtemps étouffée, l’interrogation sur l’identité juridique de la subvention s’avère indispensable dans un contexte de confusion de celle-ci avec la notion de commande publique. Pour l’isoler de ce « genre » voisin et lui fournir une identité propre, un seul trait distinctif paraît opératoire : sa qualité de don public ou, pour emprunter un vocabulaire plus civiliste, son titre gratuit. La recherche des deux éléments utilisés en droit privé pour identifier un tel acte s’avère concluante, et plus encore, révèle la spécificité de cet objet en droit public. L’intention libérale s’articule de manière originale avec l’intérêt général, et dresse la subvention en véritable donation avec charges de droit public. Le don public, avec son lot de spécificités, vient ensuite façonner les règles applicables à la subvention, pour lui offrir un véritable régime juridique, cohérent et compréhensible. L’octroi de la subvention s’avère régulé par l’intérêt général, et la mise en œuvre de cet acte, gouvernée par sa nature conditionnelle. La subvention est un don public, et se trouve régie comme telle. C’est à la faveur d’une rencontre de la valeur heuristique du don qu’elle a pu être saisie / The issue of the legal definition of grant has long been blotted out and constrained. Nowadays, in a context of confusion between this notion with the closely related notion of public procurement, it is more than necessary to tackle it. A single distinctive feature seems efficient to isolate itself from this nearby type: its very nature of public gift or, to employ the French “civil law” terminology, its quality of “gratuitous act”. The research for the two elements used in French private law to identify such an act proves to be conclusive. Furthermore, it reveals the specificity of this item in public law. Animus donandi can originally be combined with general interest, and this raises grant as a real gift with charges of public law. Public gift, as specific as it is, fashions the rules applied to grants. It provides this notion with a genuine legal status, which turns out to be consistent and intelligible. The funding mechanism is ruled by the concept of general interest, and its implementation is governed by its conditional quality. Grants proves to be a public gift, and it is ruled as such. This conclusion couldn’t have been reached without meeting with the heuristic value of the concept of public gift

Financing green energy projects : Funding possibilities, challange for change, and the integration of the private sector

The world’s energy structure today relies 80 % on fossil fuels, contributing to rising temperatures and a changing climate. Society is built upon heavy energy usage and consumption is forecasted to increase rather than decrease. This implies that today’s energy mix needs thorough reconstruction where renewable energy sources must be a bigger part of the mix. There are well-known and developed green energy solutions that are not being fully exploited by society, where one explanation is the lack of funding possibilities. Therefore, this paper aims to investigate green energy projects to present further insight, integrate the private sector, and increase investments. This is done by interviewing Swedish economic associations investing in wind power to learn about concepts and experiences that can be applied by new investors when entering the green energy market. Our findings revealed that the permit process was the biggest obstacle in establishing wind turbines leading to fewer investing opportunities for private investors. Wind power in Sweden is self-sufficient with various returns hence are in no vital need for support schemes to be economically sustainable. This concludes that the government should focus on improving the permit process rather than promoting renewable energy support schemes to reach their climate goals.

Déterminants et inégalités d’utilisation des services obstétricaux essentiels dans les pays à revenu faible et intermédiaire

Introduction Chaque année, 289 000 femmes décèdent des complications reliées à la grossesse et à l’accouchement, et 2.9 millions de nouveau-nés décèdent avant d’atteindre 28 jours de vie. La quasi-totalité (99%) des décès maternels et néonataux ont cours dans les pays à revenu faible et intermédiaire (PRFI). L’utilisation des services obstétricaux essentiels, incluant l’assistance qualifiée à l’accouchement (AA) et les services postnataux, contribue largement à la réduction de la morbidité et de la mortalité maternelle et néonatale. Il est donc essentiel d’évaluer les déterminants et les inégalités de couverture de ces services, en vue d’informer l’élaboration de politiques et de programmes de santé dans les PRFI. Objectifs 1. Étudier systématiquement les déterminants et inégalités socioéconomiques, géographiques et démographiques dans l’utilisation des services de santé postnataux dans les PRFI. 2. Évaluer l’effet de la politique de subvention des frais aux usagers introduite au Burkina Faso en 2007 sur les taux d’utilisation de l’assistance qualifiée à l’accouchement, en fonction du statut socioéconomique (SSE). Méthodes 1. Nous avons réalisé une revue systématique sur l’utilisation des services postnataux dans les PRFI, en fonction des déterminants socioéconomiques, géographiques et démographiques. Notre étude incluait une méta-analyse de l’utilisation des services selon les quintiles de SSE et le milieu de vie (urbain vs. rural). 2. Nous avons utilisé un devis quasi-expérimental. Les sources de données consistaient en deux sondages représentatifs (n=1408 et n=1403), conduits respectivement en 2008 et 2010 auprès de femmes des districts sanitaires de Houndé et de Ziniaré au Burkina Faso, en plus d’une enquête sur la qualité structurelle des soins offerts dans les centres de santé primaire. Nous avons utilisé des modèles de régression de Poisson, multi-niveaux et segmentés, afin d’évaluer l’effet de la politique de subvention sur les taux d’AA. Nous avons estimé des ratios et différences de taux d’incidence ajustés, en fonction du SSE et du temps écoulé depuis l’introduction de la subvention. Résultats 1. Les estimés de ratio de cotes (RC) agrégés (IC 95%) pour les femmes de SSE élevé (5e quintile ou Q5), Q4, Q3 et Q2 (référence : quintile le plus pauvre, Q1) étaient respectivement : 2.27 (1.75 – 2.93); 1.60 (1.30-1.98); 1.32 (1.12-1.55); et 1.14 (0.96-1.34). La méta-analyse a aussi démontré un gradient d’utilisation des services postnataux entre les femmes urbaines et rurales : RC (IC 95%) = 1.36 (1.01-1.81). L’évaluation narrative a par ailleurs identifié une différence dans la couverture de services selon le niveau d’éducation. 2. Pour les femmes de faible SSE, le taux d’AA était 24% plus élevé (IC 95% : 4-46%) immédiatement après l’introduction de la subvention, en comparaison au taux attendu en l’absence de ladite subvention. L’ampleur de l’effet a diminué dans le temps, correspondant à des estimés (IC 95%) de 22% (3-45%) à 6 mois, 20% (1-43%) à 12 mois, et 17% (-4-42%) à 24 mois après l’introduction de la subvention. La force d’association variait selon les strates de SSE, l’effet le plus prononcé étant observé au sein du SSE le plus faible. Conclusions 1. L’utilisation des services postnataux demeure inéquitable selon le SSE et l’accessibilité géographique aux formations sanitaires dans les PRFI. 2. Notre étude suggère que l’introduction de la subvention des frais aux usagers au Burkina Faso résulte en une augmentation soutenue dans le taux d’assistance qualifiée à l’accouchement, particulièrement chez les femmes de faible SSE. Cette évidence scientifique devrait alimenter l’élaboration de programmes de santé materno-infantile, en plus de guider la planification de politiques et le renforcement des systèmes de santé des PRFI. / Background Each year, 289 000 women die from complications related to pregnancy, childbirth or the postnatal period, and 2.9 million newborns decease before reaching 28 days of life. The near totality (99%) of maternal and neonatal deaths occur in low- and middle-income countries (LMICs). Utilization of essential obstetric care services including skilled birth attendance (SBA) and postnatal care (PNC) largely contributes to the reduction of maternal and neonatal morbidity and mortality. There is a strong need to assess the determinants and inequalities in coverage of SBA and PNC services, to inform health policy planning. Objectives 1. Systematically assess the socioeconomic, geographic and demographic inequalities in PNC services utilization in LMICs. 2. Evaluate the effect of Burkina Faso’s 2007 user-fee subsidy policy on SBA rate across socioeconomic status (SES) strata. Methods 1. We conducted a systematic review of the association between PNC services utilization and key determinants, including a meta-analysis of PNC use across socioeconomic status quintiles, and place of residence (urban vs. rural). 2. We used a quasi-experimental design. The data sources were two representative surveys (n=1408 and n=1403) carried out in 2008 and 2010, respectively, of women from Houndé and Ziniaré health districts of Burkina Faso, and a survey of health centres assessing structural quality of care. Multilevel segmented Poisson regression models were used to assess the effect of subsidy on SBA rate. We estimated adjusted rate ratios and rate differences as a function of time and socioeconomic status level. Results 1. The pooled odds ratio (OR) (95% CI) estimates for highest SES women (quintile 5, Q5), Q4, Q3 and Q2 (reference: poorest quintile, Q1) were respectively: 2.27 (1.75 – 2.93); 1.60 (1.30-1.98); 1.32 (1.12-1.55); and 1.14 (0.96-1.34). Meta-analysis also showed a PNC utilization divide between urban and rural women: OR (95% CI) = 1.36 (1.01-1.81). Narrative assessment of studies identified a gradient in PNC coverage across education levels. 2. For low-SES women, immediately upon the introduction of the subsidy policy, the rate of SBA was 24% higher (95% CI: 4-46%) than expected in the absence of subsidy policy introduction. The magnitude of the apparent effect decreased over time, with the corresponding estimates (95% CI) being 22% (3-45%) at 6 months, 20% (1-43%) at 12 months, and 17% (-4-42%) at 24 months after the policy introduction. Furthermore, the magnitude of the association varied across SES strata, with the apparent effect being most pronounced in the low SES stratum. Conclusions 1. PNC utilization remains inequitable across socioeconomic status and geographic access to health facilities in LMICs. 2. Our study suggests that introduction of user fee subsidy in Burkina Faso resulted in sustained increase in the rate of SBA, especially among low-SES women. This evidence should inform maternal and child health programmes and guide health policies and health care systems in LMICs.

Investiga o patrocínio às Artes e à Literatura, na França do XVII e a assimilação desse modelo em Portugal durante o século XVIII e no Brasil a partir do XIX. Examina a ação da Revue des Deux Mondes na divulgação do teatro francês no Brasil. Analisa o alvará de 1771, primeira legislação produzida em Portugal para a normatização dos teatros públicos do reino e a sua permanência no Brasil após o processo de independência. Contribui com documentos novos para aprofundamento do estudo da história do teatro brasileiro. / This thesis investigates the relation between the State and the theatre in Brazil during 1822 and 1889, through the subvention to the Scenic Arts. It tries to correlate the documents produced by the Executive and the Legislative dedicated to the theatre and to the debates from the academic man regarding the theatrical matter on Rio de Janeiro papers. It studies the sponsorship to the Literature and Arts during the XVII in France and the uptake of the same model during XVIII in Portugal and in Brazil from XIX. It examines the action of Revue des Deux Mondes regarding the promotion of the French theatre in Brazil. It analyses the 1771 Permit, first legislation produced in Portugal seeking the regulation of the realm public theatres and its continuance in Brazil after the independence process. It contributes with new documents for a deep study of the Brazilian theatre history.

Diese Dissertation besteht aus drei Aufsätzen, welche die Effekte von Geld- und Fiskalpolitiken für die Makroökonomie untersuchen. Der erste Aufsatz analysiert, wie das Verhalten der Inflation nach z.B. geldpolitischen Veränderungen erklärt werden kann. Mankiw und Reis (2002) propagieren klebrige Information als eine Alternative zu Calvo klebrigen Preisen, um drei konventionelle Sichtweisen über die Inflation zu modellieren. Ich verwende ein DSGE Modell mit klebriger Information und vergleiche es mit Calvo klebrigen Preisen mit dynamischer Inflationsindexierung wie in Christiano et al. (2005). Ich zeige, dass beide Modelle in meinem DSGE Rahmen gleich gut geeignet sind, die konventionellen Sichtweisen zu erklären. Der zweite Aufsatz untersucht, wie sich das Verhalten von Haushalten und Firmen in den USA und EU-15 infolge von Steuerveränderungen anpasst. Mittels eines neoklassischen Wachstumsmodells zeigt sich, dass die USA und EU-15 auf der linken Seite der Lohn- und Kapitalsteuer Laffer Kurve liegen. Die EU-15 befindet sich jedoch viel näher an der rutschigen Steigung als die USA. Eine dynamische Scoring-Analyse zeigt, dass Steuersenkungen in der EU-15 stärker selbstfinanzierend sind als in den USA. Es folgt, dass es in der EU-15 grössere Anreize durch Steuersenkungen als in den USA gibt. Der dritte Aufsatz analysiert, ob die Fiskalpolitik Steuerreformen vor deren Implementierung vorankündigen soll, um die Wohlfahrt zu maximieren. Domeij und Klein (2005) zeigen, dass Vorankündigung einer optimalen Steuerreform mit Wohlfahrtskosten verbunden ist. Ich prüfe diese Behauptung unter zusätzlicher Berücksichtigung von öffentlichen Gütern und Kapital nach. Ich zeige, dass nutzenbringende und produktive Staatsausgaben die Wohlfahrtskosten durch Vorankündigungen höchstwahrscheinlich reduzieren. Es zeigt sich weiter, dass kurzfristige Konfiszierung und/oder Subvention von Kapital und Löhnen nicht wichtig für die Wohlfahrsgewinne einer hinreichend vorangekündigten Steuerreform sind. / This dissertation consists of three essays which investigate the economic implications of monetary and fiscal policies on the macroeconomy. The first essay focuses on the question: how can we explain the behavior of inflation in response to e.g. monetary policy changes? Mankiw and Reis (2002) propose sticky information as an alternative to Calvo sticky prices to model three conventional views about inflation. We use a fully-fledged DSGE model with sticky information and compare it to Calvo sticky prices, allowing also for dynamic inflation indexation as in Christiano et al. (2005). We find that both models do equally well in our DSGE framework in delivering the conventional views. The second essay analyzes the question: how does the behavior of households and firms in the US compared to the EU-15 adjust if fiscal policy changes taxes? Using a calibrated neoclassical growth model we show that the US and the EU-15 are located on the left side of their labor and capital tax Laffer curves, but the EU-15 being much closer to the slippery slopes than the US. A dynamic scoring analysis shows that tax cuts in the EU-15 are much more self-financing than in the US. We conclude that there are higher incentive effects in the EU-15 compared to the US in response to tax cuts. Finally, the third essay focuses on the question: should fiscal policy pre-announce tax reforms before their implementation from a welfare point of view? Domeij and Klein (2005) show that pre-announcement of an optimal tax reform is costly in terms of welfare. We reexamine their claim by taking two additional features of government spending into account: public goods and public capital. We show that valuable and productive government spending is likely to reduce the welfare costs of preannouncement. As a further contribution, we show that short-run confiscation and/or subsidy of capital and labor income is not important for the welfare gains of pre-announced reforms with sufficiently long pre-announcement duration.

Esta tese investiga a relação do Estado com o teatro no Brasil no período de 1822 a 1889, por meio da subvenção às Artes Cênicas. Procura relacionar a documentação produzida pelo executivo e o legislativo dedicada ao teatro aos debates dos homens de letras sobre a questão teatral nos periódicos do Rio Janeiro. Investiga o patrocínio às Artes e à Literatura, na França do XVII e a assimilação desse modelo em Portugal durante o século XVIII e no Brasil a partir do XIX. Examina a ação da Revue des Deux Mondes na divulgação do teatro francês no Brasil. Analisa o alvará de 1771, primeira legislação produzida em Portugal para a normatização dos teatros públicos do reino e a sua permanência no Brasil após o processo de independência. Contribui com documentos novos para aprofundamento do estudo da história do teatro brasileiro. / This thesis investigates the relation between the State and the theatre in Brazil during 1822 and 1889, through the subvention to the Scenic Arts. It tries to correlate the documents produced by the Executive and the Legislative dedicated to the theatre and to the debates from the academic man regarding the theatrical matter on Rio de Janeiro papers. It studies the sponsorship to the Literature and Arts during the XVII in France and the uptake of the same model during XVIII in Portugal and in Brazil from XIX. It examines the action of Revue des Deux Mondes regarding the promotion of the French theatre in Brazil. It analyses the 1771 Permit, first legislation produced in Portugal seeking the regulation of the realm public theatres and its continuance in Brazil after the independence process. It contributes with new documents for a deep study of the Brazilian theatre history.

Le stade est un lieu de concentration du droit public. La focale se porte donc sur l’étude du régime juridique des « grands stades » pour reprendre l’appellation retenue par le rapport de la Commission Euro 2016. L’objet de cette étude est de démontrer les interactions réciproques entre le stade et le droit public. Notre étude se concentrera sur les problématiques juridiques nationales portées par les profondes mutations du stade et de son droit. Marqué par la diversité des contrats qui sont à la source de leurs constructions ou rénovations, le régime juridique de la propriété du stade détermine ses modes de gestion. Longtemps lieu du service public du sport, la professionnalisation de celui-ci a engendré quelques mutations quant au régime juridique de la domanialité du stade. Cette concentration se révèle également dans l’opération d’urbanisme et d’aménagement du territoire que constitue un stade. S’inscrivant dans une politique globale de financement du sport où l’intervention publique demeure élevée, le stade se confronte aux contraintes des finances publiques. Le stade est lieu de rassemblement où le public vient assister à un spectacle sportif. Il convient d’encadrer tout débordement susceptible de troubler l’ordre public. En tant que réceptacle du spectacle sportif, le stade est un lieu d’exploitation commerciale. / Stadiums are places where public law cannot be overlooked. This thesis focuses therefore on the juridical regime of the so called “grands stades” (stadiums contrary to sport fields) quoted as such in the Euro 2016 commission report. The main purpose is to demonstrate interlinks between stadiums and public law. This study concentrates on national juridical issues raised by changes in stadiums and thus in laws related to it. Indeed the juridical regime of stadium property, through the wide diversity of contracts qualifying the frame for construction or renovation, defines how stadiums are managed. For a long time stadiums have been considered for public sport practices, however professionalization led to modifying this juridical regime. Urbanism and spatial planning operations prior to stadium constructions have also underlined this evolution. The global financial policy for stadium development requires high public sector intervention therefore making it also subject to public financing constraints. Stadiums gather people to watch sport events. It is important to provide a frame to avoid any excess that could lead to disturbances of public order. As a recipient of sport events, stadiums are places of commercial exploitation.
